    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

Across the chapters, contributors from different countries examine the data, press coverage, and provide professional observations on how policing, law enforcement, police powers and community relations were managed. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Abstract: "Since the 1980s the study of genocide has exploded, both historically and geographically, to encompass earlier epochs, other continents, and new cases. The concept of genocide has proved its worth, but that expansion has also compounded the tensions between a rigid legal concept and the manifold realities researchers have discovered. The legal and political benefits that accompany genocide status have also reduced complex discussions of historical events to a simplistic binary--is it genocide or not--a situation often influenced by powerful political pressures. Genocide addresses these tensions and tests the limits of the concept in cases ranging from the role of sexual violence during the Holocaust and state-induced mass starvation in Kazakh and Ukrainian history to what the Armenian, Rwandan, and Burundi experiences reveal about the uses and pitfalls of reading history and conducting politics through the lens of genocide. Contributors examine the pressures that great powers have exerted in shaping the concept; the reaction Raphaël Lemkin, originator of the word "genocide," had to the United Nations’ final resolution on the subject; France’s long-held choice not to use the concept of genocide in its courtrooms; the role of transformative social projects and use of genocide memory in politics; and the relation of genocide to mass violence targeting specific groups.     Abstract: Based on economic theory, this book offers a novel approach to understanding the marital dynamic, explaining the substantive regulation of marriage and modeling legal outcomes at the conflict of laws level. On this ground the author proposes specific rules to regulate the party autonomy for the law governing the relationship, and to determine the applicable law in absence of a choice of law agreement for key aspects of the relationship: maintenance obligations, divorce, and property regime.The book is organized in two parts, preceded by an introductory section, where the results achieved by the harmonization of conflict rules promoted by the EU are examined critically. The first part puts forward economics as the approach to better comprehend the couple's expectations of marriage. It focuses on explaining the economic rationale behind marriage, underlining its contractual nature, and demonstrating that common legal remedies as well as several mandatory and default rules in modern marriage law indeed have an economic foundation. The second part is devoted entirely to the conflict of laws dimension of marriage. The book will therefore be of interest to scholars and lawmakers attempting to launch reforms anywhere or looking for a practical and novel application of economics in the analysis of the law.

    Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: This volume analyzes the development of the reactions to Covid-19 by governments, the public and the crime patterns in 16 European countries. All countries are members of the European Union and share common European norms and values, but the Covid-19 pandemic can serve as an example of how these norms and values are interpreted differently with regard to people’s trust in public institutions, governmental control strategies, dealing with fear, anxiety and other emotional responses to the new virus, crime patterns and law enforcement priorities to prevent and combat them. The volume provides empirical data based on available statistics, media analysis and qualitative data from interviews and observations, and examines the similarities and differences in crime patterns and the consequences for local communities and law enforcement priorities. .

    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

    Abstract: Unsere Gesellschaft entwickelt gegenwärtig ein neues Verständnis von Gleichheit. Gesellschaft und Politik müssen auf soziale Ungleichheit reagieren, Diskriminierung verhindern und mit Identitätspolitiken umgehen. Doch was verbindet und was unterscheidet diese Dimensionen der Gleichheit bzw. Ungleichheit? Die Beiträger*innen des Bandes plädieren dafür, dass soziale Ungleichheit, Antidiskriminierung und Identitätspolitiken nicht gegeneinander ausgespielt werden dürfen. Vielmehr gilt es, auf der Grundlage sozialer Anerkennung ein mehrdimensionales Verständnis von Gleichheit zu entwickeln, das Hierarchien von Ungleichheit und vor allem auch Kompensationsspiralen vermeidet

Auf der Grundlage von unzähligen unbekannten Quellen aus Europa und Afrika erzählt Bénédicte Savoy die gespenstische Geschichte einer verpassten Chance, einer Niederlage, die heute mit umso größerer Wucht auf uns zurückschlägt. Afrikas Bemühungen um seine in der Kolonialzeit nach Europa verbrachte Kunst sind keineswegs neu. Schon bald nach 1960, als 18 ehemalige Kolonien die Unabhängigkeit erlangten, wurde von afrikanischen Intellektuellen, Politikern und Museumsleuten eine ungeheure Dynamik in Gang gesetzt. In ganz Europa suchten daraufhin Politikerinnen und Politiker, Journalisten, Akademiker und einige Museumsleute einen Weg, afrikanische Kulturgüter im Sinne einer postkolonialen und postrassistischen Solidarität zurückzugeben. Die Argumente aber, mit denen andere versuchten, die Forderungen aus Afrika zu entkräften und Lösungen zu verhindern, ähneln auf frappierende Weise denen von heute. Schließlich verlief alles im Sand. „Gebt koloniale Raubkunst zurück! Dafür engagiert sich Bénédicte Savoy. In ihrem Buch zeigt die Kunsthistorikerin nun, dass ihr Kampf ein alter ist. Schon in den 1960er-Jahren drängten die neu gegründeten Staaten Afrikas auf eine Rückführung – erfolglos.     Abstract: Welche Bedeutung hat die Staatsbürgerschaft für Schwarze Deutsche? Emmanuel Ndahayo liefert mit seiner Studie einen wichtigen Beitrag zur Erforschung sozialer Ungleichheit und gesellschaftlicher Teilhabe im Kontext von Migration und Eingliederungsprozessen, die in besonderem Maße von Rassismus, (post-)kolonialistischen Ansichten und fragilen Inklusionsformen betroffen sind. Die Analyse der sozialen Lage von eingebürgerten Deutschen afrikanischer Herkunft schließt eine Forschungslücke. Die empirische Untersuchung mit Hilfe qualitativer Interviews bietet daher wichtige Erkenntnisse nicht nur für die Sozialwissenschaft, sondern auch für Praktiker*innen in der Integrationspolitik.

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people
