    Abstract: Die Zuordnung zu einem Geschlecht hat für die individuelle Identität eines Menschen herausragende Bedeutung. Gleichzeitig wird diese Frage von den Rechtsordnungen der Europäischen Union nach wie vor sehr unterschiedlich beantwortet. Während immer mehr Staaten dazu übergehen, einer Person eine selbstbestimmte Entscheidung über ihr rechtliches Geschlecht zu ermöglichen, stellen zahlreiche Staaten weiterhin hohe Anforderungen an dessen Änderung. Angesichts der Diversität nationaler Regelungen untersucht Alix Schulz, wie das rechtliche Geschlecht eines Menschen in grenzüberschreitenden Sachverhalten bestimmt wird und welche grund- und menschenrechtlichen Vorgaben hierbei zu beachten sind

    Abstract: In der juristischen Literatur wird der Begriff der "Pfadabhängigkeit" zumeist metaphorisch verwendet. Anders ist dies in den benachbarten Gesellschaftswissenschaften, wo das gleichnamige Konzept der Erklärung insbesondere institutioneller Entwicklungsprozesse dient. Nico Schröter geht der Frage nach, ob und wie eine Rezeption dieses Konzepts auch für die Rechtswissenschaft erkenntnisversprechend ist. Dabei kann eine (informierte) Rezeption insbesondere dazu dienen, informelle Strukturbildungsprozesse im Recht besser zu verstehen. So bietet Pfadabhängigkeit eine plausible Erklärung für die relative Stabilität judikativer Entscheidungsstandards und rechtsdogmatischer Sätze sowie - in Ansätzen - auch dafür, inwieweit diese einem Wandel unterliegen. Die Rezeption des Pfadabhängigkeitskonzepts liefert daher eine Antwort auf bestehende Theoriedefizite bei der Erklärung rechtlicher Phänomene

    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out. It reveals an intriguing patchwork and generates insights for academics and practitioners about the (non-)active role of a diversity of actors in the governance of security during crises. This collection contains several insights and lessons learnt for scholars as well as practitioners of policing.” —Marleen Easton, Professor and head of the research group 'Governing and Policing Security' (GaPS) at the Department of Public Governance and Management at Ghent University, Belgium This book critically examines how countries across Europe have dealt with the COVID crisis from a policing and security perspective. Across the chapters, contributors from different countries examine the data, press coverage, and provide professional observations on how policing, law enforcement, police powers and community relations were managed. They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Some contributors draw on data from the COROPOL (Corona Policing) Monitor which collated data on crime, plural policing and public order in Europe and around the world during the early phases of the COVID crisis. Overall, this book seeks to provide comparative critical insights and commentary as well as a practical and operational understanding of security governance during the COVID-19 crisis and the lessons learned to improve future preparedness. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Abstract: Based on economic theory, this book offers a novel approach to understanding the marital dynamic, explaining the substantive regulation of marriage and modeling legal outcomes at the conflict of laws level. On this ground the author proposes specific rules to regulate the party autonomy for the law governing the relationship, and to determine the applicable law in absence of a choice of law agreement for key aspects of the relationship: maintenance obligations, divorce, and property regime.The book is organized in two parts, preceded by an introductory section, where the results achieved by the harmonization of conflict rules promoted by the EU are examined critically. The first part puts forward economics as the approach to better comprehend the couple's expectations of marriage. It focuses on explaining the economic rationale behind marriage, underlining its contractual nature, and demonstrating that common legal remedies as well as several mandatory and default rules in modern marriage law indeed have an economic foundation. The second part is devoted entirely to the conflict of laws dimension of marriage. The book will therefore be of interest to scholars and lawmakers attempting to launch reforms anywhere or looking for a practical and novel application of economics in the analysis of the law.

    Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation. Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today.     Abstract: "The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience.     Abstract: Schon vor 50 Jahren kämpfte Afrika um seine Kunst, die während der Kolonialzeit massenweise in europäische Museen gelangt war. Und es fand durchaus Unterstützung im Westen. Am Ende jedoch war der Kampf nicht nur vergebens, er wurde auch erfolgreich vergessen gemacht. Auf der Grundlage von unzähligen unbekannten Quellen aus Europa und Afrika erzählt Bénédicte Savoy die gespenstische Geschichte einer verpassten Chance, einer Niederlage, die heute mit umso größerer Wucht auf uns zurückschlägt. Afrikas Bemühungen um seine in der Kolonialzeit nach Europa verbrachte Kunst sind keineswegs neu. Schon bald nach 1960, als 18 ehemalige Kolonien die Unabhängigkeit erlangten, wurde von afrikanischen Intellektuellen, Politikern und Museumsleuten eine ungeheure Dynamik in Gang gesetzt. In ganz Europa suchten daraufhin Politikerinnen und Politiker, Journalisten, Akademiker und einige Museumsleute einen Weg, afrikanische Kulturgüter im Sinne einer postkolonialen und postrassistischen Solidarität zurückzugeben. Die Argumente aber, mit denen andere versuchten, die Forderungen aus Afrika zu entkräften und Lösungen zu verhindern, ähneln auf frappierende Weise denen von heute.
