Kurzfassung: This brief investigates the usefulness of Body-worn videos (BWVs) in non-policing environments. The first study of this kind, this research presents new datasets related to these devices, including: TOCS’ data on assaults and injuries Surveys of frontline members of staff A series of focus groups BWV activation metadata from BWV vendors Surveys with British Transport Police’s criminal justice unit. The data sources for this project span thirteen train operating companies across the UK, varying levels of risk of workplace violence, as well as different types of Public-Facing professionals and different BWV devices. Using a mixed-methods approach, this volume ultimately provides insight into the effectiveness of these devices in preventing and controlling risks of violence in the workplace, and recommendations on how to use them. This book is ideal for professionals working in workplace violence reduction and scholars who study technological advents, violence prevention and jurists who are interested in decisions to prosecute offenders. .

Kurzfassung: As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines. The main question to be answered is whether the foundations and general principles of private law and criminal law offer a functional and adaptive legal framework for the “autonomous systems” phenomena. The main purpose of this book is to identify and explore possible trajectories for the development of civil and criminal liability; for our understanding of the attribution link to autonomous systems; and, in particular, for the punishment of unlawful conduct in connection with their operation. AI decision-making processes – including judicial sentencing – also warrant close attention in this regard. Since AI is moving faster than the process of regulatory recalibration, this book provides valuable insights on its redesign and on the harmonization, at the European level, of the current regulatory frameworks, in order to keep pace with technological changes. Providing a broader and more comprehensive picture of the legal challenges posed by autonomous systems, this book covers a wide range of topics, including the regulation of autonomous vehicles, data protection and governance, personality rights, intellectual property, corporate governance, and contract conclusion and termination issues arising from automated decisions, blockchain technology and AI applications, particularly in the banking and finance sectors. The authors are legal experts from around the world with extensive academic and/or practical experience in these areas.

Notes on Constitutional Argumentation in Legislative Debates.
Kurzfassung: This book seeks to explore the potential and actual value of parliamentary debates as a source of legislative justification. Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

Kurzfassung: Can we regulate something that doesn’t exist yet? Can Europe create its own Silicon Valley? Who gets to create technological value in today’s world? Whatever happened to the once-flourishing idea of rags to riches? Will new and exciting innovations only ever come from big tech companies? Can the EU establish its own flexible framework for boosting innovation, e.g. by facilitating the transformative use of technologies and data? This book seeks to answer these questions by exploring the differences in copyright culture in Europe and the United States, with its flexible fair use framework. The findings are anything but obvious, and decades of case law on both sides of the Atlantic tell a story of judges going to great lengths to deal with new challenges while navigating the imperfections of statutory law – both where it is too broadly formulated and where it is too prescriptive. How can the population’s creative potential best be fostered? What do software innovations have in common with the evolution of living organisms? What are the vulnerabilities of distributed creativity? Answers are sought in the processes that came into being during the early years of the digital revolution and were then forced to take a back seat as control of the means of production was increasingly placed in the hands of tech companies. The findings and insights presented here are highly relevant for today’s digital policymaking. Market concentration processes in innovation haven’t ceased; they are ongoing. And in an age where data-driven services are creating and reinforcing global oligopolies, the question posed by the U.S. Supreme Court in Google v. Oracle is now more relevant than ever: who should hold the keys to digital innovation?

Kurzfassung: This is an open access book. Europe faces significant challenges in the coming decades: geopolitical, demographic, technological, increased competition, climate-related, and health issues due to an aging population, to mention a few. Given these challenges, technological progress and new ways of handling complex issues will be key to continued prosperity and growth. To accomplish a growth process driven by innovation and entrepreneurship, the institutional environment must take into account a multitude of different policy areas that interact to either strengthen or weaken an economy's innovative potential. Innovation is not only about R&D and higher education but is also intimately related to entrepreneurship. Similarly, entrepreneurship is not only about low start-up costs and favorable tax rates. Hence, a consistent and coordinated policy environment conducive to innovation and entrepreneurship is required to translate innovation into high-growth firms and macro-level growth. This book presents the basic cornerstones required to provide a policy regime that can nurture such dynamics. The authors draw extensively on empirical analysis of the development of the Swedish economy, which has been transformed from a so-called "sclerosis" state in the 1980s until the early 1990s to an economy characterized by successful entrepreneurship and innovation. This transformation resulted from a reform agenda that has been gradually rolled out, beginning in the mid-1980s. The authors argue that the Swedish experience provides useful lessons for other nations as well.

Kurzfassung: This open access book explains how leading business organizations attempt to achieve the responsible and ethical use of artificial intelligence (AI) and other advanced information technologies. These technologies can produce tremendous insights and benefits. But they can also invade privacy, perpetuate bias, and otherwise injure people and society. To use these technologies successfully, organizations need to implement them responsibly and ethically. The question is: how to do this? Data ethics management, and this book, provide some answers. The authors interviewed and surveyed data ethics managers at leading companies. They asked why these experts see data ethics as important and how they seek to achieve it. This book conveys the results of that research on a concise, accessible way. Much of the existing writing on data and AI ethics focuses either on macro-level ethical principles, or on micro-level product design and tooling. The interviews showed that companies need a third component: data ethics management. This third element consists of the management structures, processes, training and substantive benchmarks that companies use to operationalize their high-level ethical principles and to guide and hold accountable their developers. Data ethics management is the connective tissue makes ethical principles real. It is the focus of this book. This book should be of use to organizations that wish to improve their own data ethics management efforts, legislators and policymakers who hope to build on existing management practices, scholars who study beyond compliance business behavior, and members of the public who want to understand better the threats that AI poses and how to reduce them.

Kurzfassung: This open access book investigates whether and how theoretical findings and insights in contemporary art conservation can be translated into the daily work practices of conservators or, vice versa, whether and how the problems and dilemmas encountered in conservation practice can inform broader research questions and projects. For several decades now, the conservation of contemporary art has been a dynamic field of research and reflection. Because of contemporary art’s variable constitution, its care and management calls for a fundamental rethinking of the overall research landscape of museums, heritage institutions, private-sector organizations and universities. At first, this research was primarily pursued by conservation professionals working in or with museums and other heritage organizations, but increasingly academic researchers and universities became involved, for instance through collaborative projects. This book is the result of such collaboration. It sets out to bridge the “gap” between theory and practice by investigating conservation practices as a form of reflection and reflection as a form of practice.

Kurzfassung: This book presents the econometric foundations and applications of multi-dimensional panels, including modern methods of big data analysis. In light of the big data revolution and the emergence of higher dimensional panel data sets, it provides new results to synthesize existing knowledge on the field. The first, theoretical part of the volume is providing the econometric foundations to deal with these new high-dimensional panel data sets. It not only synthesizes our current knowledge, but mostly, presents new research results. The second empirical part of the book provides insight into the most relevant applications in this area. These chapters are a mixture of surveys and new results, always focusing on the econometric problems and feasible solutions. This second extended and revised edition provides an update of all existent chapters to reflect on new developments in the area as well as several new chapters on topics such as machine learning, nonparametric models, networks, and multi-dimensional panels in health economics. The book serves as a standard reference work, a textbook for graduate students in economics, and a source of background material for professionals conducting empirical studies.

Kurzfassung: This open access book provides insight on how the tactical urbanism has the capacity to influence change in mobility practices such as cycling. COVID-19 crisis prompted the public authorities to rethink the use of public space in order to develop means of transport that are both efficient and adapted to the health context and their effects on cycling practices in Europe, North, and South America. Its contributors collectively reveal and evidence through policies analysis, mapping, and innovative qualitative analysis bridging video and interviews, how those new infrastructures and policies can be a trigger for change in a context of mobility transition. This book provides an important element on the way local authorities can act in a quicker and more agile way. While some decisions are specific to the context of the beginning of the pandemic, the analysis offers lessons on the way to implement the transition toward a low-carbon mobility, on the importance of processes based on trials and errors, on the political stakes of reallocating road space.

Kurzfassung: This volume explores Hans-Georg Gadamer's philosophical hermeneutics within a musical context. It features contributions from philosophers, musicians, educators, and musicologists from a variety of backgrounds, and sheds light on both the hermeneutic nature of music and the musicality of hermeneutics. Contributors to this volume hermeneutically think with music to uncover its fundamentally hermeneutic character, and by thinking with Gadamer in a musical context, explore ways in which hermeneutics may be understood to possess an inherent musicality. Gadamer's thought is taken up in a variety of musical contexts including improvisation, musical performance, classical music, jazz, and music criticism. This first volume to explore Gadamer's hermeneutics in a musical context breaks new ground by challenging musical concepts and by pushing Gadamer's thought in new directions. It appeals to philosophers engaged with Gadamer's thought (and philosophical hermeneutics more broadly), as well as philosophers of music, musicologists, and musicians interested in critically engaging with the practice of performing and listening to music.

Kurzfassung: This book evaluates how the legal, institutional and policy frameworks for Unmanned Aircraft Systems (UAS) in the United States, South Africa and Kenya have addressed the current needs and challenges involved in these systems’ operation and integration into regulatory frameworks for civil aviation. It shows how the three states have developed their own constitutional frameworks, legislation, regulations, policies and strategic plans to address the challenges that emanate from integrating UAS into the civil aviation airspace. The book details the three countries’ integration experiences, investigating the extent to which existing international regulatory frameworks address the various concerns, and identifies the common thread that runs through UAS regulation, as well as each country’s unique issues and path to integration. Recognizing that the approach for integration of UAS into civil aviation needs to be gradual and pragmatic, the book recommends scaling up institutional capacity, coordination and funding, and intensifying regional efforts to redefine and support UAS integration.

Kurzfassung: The book analyzes socioeconomic through the lens of a lawyer. In the past decade the world has witnessed some severe financial and economic crises, especially the financial crisis of 2007-2008 and the crisis caused by the COVID-19 pandemic. The author states that the socio-economic order has in the past four to five decades been thoroughly redesigned, generally favouring models that prioritize the free market over the public interest or even, more generally, government operation. He works out that during four to five decades, globalized, capitalist societies are facing a multiplicity of fundamental problems, such as: (1) increasing debt that severely burdens both the private and public sectors; (2) persistent poverty and an ever-increasing polarization between rich and poor, in addition to (3) intractable environmental problems that, fifty years after the Club of Rome's report entitled ‘Limits to growth’ (1972), has dragged the world into what in recent years has been referred to as "climate change." The book explains why all this is the direct result of value choices made from the late Middle Ages onwards, when in the Western world the societal models of that time were increasingly abandoned for a societal model that came to rely on the primacy of economic interests. The book not only subjects the ethical choices but also examines various problems it has caused and probes for possible ways out. This is an open access book.

A Technopolitical Network for Participatory Democracy: The Future of a Collective Platform.
Kurzfassung: This Open Access book explains the philosophy, design principles, and community organization of Decidim and provides essential insights into how the platform works. Decidim is the world leading digital infrastructure for participatory democracy, built entirely and collaboratively as free software, and used by more than 500 institutions with over three million users worldwide. The platform allows any organization (government, association, university, NGO, neighbourhood, or cooperative) to support multitudinous processes of participatory democracy. In a context dominated by corporate-owned digital platforms, in the era of increasing social structuring via Artificial Intelligence, Decidim stands as a public or community owned platform for collective human intelligence. Yet, the project is much more than its technological features. Decidim is in itself a crossroad of the various dimensions of the networked society, a detailed practical map of its complexities and conflicts. The authors distinguish three general dimensions of the project: (1) the political - shedding light on the democratic model that Decidim promotes and its impact on public policies and organizations, (2) the technopolitical - explaining how this technology is democratically designed and managed to produce and protect certain political effects, and (3) the technical - presenting the conditions of production, operation, and success of the project. This book systematically covers those three levels in an academically sound, technologically consistent, and politically innovative manner. Serving as a useful resource and handbook for the use of Decidim, it will not only appeal to students and scholars interested in participatory and digital democracy but also to professionals, policy-makers, and a wider audience interested in learning more about the Decidim platform. This is an open access book.

Kurzfassung: This edited volume explores the concept of institutional inertia and its relationship to economic growth and development. Including insights from experts across disciplines, chapters identify the types, causes and effects—both positive and negative—of institutional inertia. By questioning the types of institutional inertia that improve economic performance and impact the effectiveness of the state, as well as studying their role in the dynamics of institutional change, the volume attempts to trace and understand the different evolutionary paths of societies. Bridging important research gaps, this volume will be of use to students, researchers, and practitioners of institutional and evolutionary economics, development economics, management, and organizational theory.

Kurzfassung: This book provides a comprehensive overview of the rapidly expanding field of decentralized finance (DF) and discusses how entrepreneurs can leverage it in their business activities. Decentralized finance (DF) is a system for exchanging value without centralized intermediaries. It relies heavily on peer-to-peer lending and borrowing, decentralized exchanges, trustless systems, and blockchain. Decentralized Finance is seen as a disruptive technology that could replace traditional financial systems in the future due to its advantages of being inclusive, non-discriminatory, resilient to risk management failures, cost-effective for lenders and borrowers to access the system and more efficient in terms of financial intermediation through automated trustless systems. This book explains the challenges and opportunities that these blockchain-based financial innovations present for both entrepreneurship and the broader financial system.

Kurzfassung: This open access book explores some of the struggles and challenges that researchers and practitioners face when conducting research in the Central Asian research setting. Written for scholars still in the planning stages of their research, it addresses key questions, including: How shall we problematize and reconceptualize the concept of positionality through lenses of local voices from the region? How does practitioners’ and scholars’ positionality contribute to their experiences of inclusion, exclusion, and access to the field? How do scholars navigate issues of personal safety and mental well-being in the more closely monitored societies of Central Asia? The book includes contributors from both Central Asia and Western countries, paying particular attention to the ways researchers’ subjectivity shape how they are received in the region, which, in turn, influences how they write about and disseminate their research. In featuring an even greater variety of voices, this book fills an important gap in the literature on field research and knowledge production in and on Central Asia.

Kurzfassung: This textbook provides a grounding in complexity theory, demonstrating how it can influence and shape social work interventions in policy, management, and practice, as well as forming an epistemological and methodological basis for research. It provides a contemporary theoretical basis for social work practice, equipping social workers to work in a 21st-Century world. The authors argue that the history of social work demonstrates the profession's engagement with the social and structural problems of each era since its emergence 150 years ago. However, in the 21st Century, such things as globalisation, the COVID-19 pandemic, and climate change have highlighted that existing theories and practice models are insufficient to the task of working with the complicatedness of contemporary life in a fast-changing world. Distilling the central tenets of Complexity Theory and the notion of complex adaptive systems in partnership with pragmatism, the book provides practice perspectives and guidelines which build on social work's enduring commitment to understanding the person-in-context. The recognition that social workers require conceptual and theoretical agility to work across micro, meso and macro 'levels' remains central, but the argument is made that their focus and practice must primarily be at the meso level. The authorship of combined academic and practice expertise enables such perspectives to be brought to life through the theoretical and practical analysis of conceptual and 'real-world' challenges. The book consists of 13 chapters organized in three sections: Part I: Complex Practice in a Complex World Part II: Thinking Complexity in Practice Part III: Thinking Complexity in Public Policy, Research and Education Complexity Theory for Social Work Practice encourages social workers to 'think complexity' and 'act pragmatically'. It is intended for final-year social work students; academics and researchers working in a range of disciplines, primarily in the social work field but also in the areas of sociology, psychology and anthropology; and practitioners in policy, research, management and practice settings. .

Themes, languages and fields of application of anamorphosis in contemporary culture are critically analyzed to make the reader aware of the communicative potentiality of this kind of geometrical technique. The book also has the aim to teach the reader the most appropriate geometric techniques for each of them, in order to achieve the designed illusion. Each typology of anamorphosis is accompanied in this book by contemporary installations, a geometrical explanation by means of 3D models and didactic experiments carried on in collaboration with the students of the Department of Architecture in Naples.

Kurzfassung: This book explains the variation and determinants of residential quality and housing preferences in urban private housing markets. It describes the residential characteristics and housing preference dynamics of Lagos urban residents who are majorly sheltered in the city’s private housing markets. Lagos Metropolitan Area (LMA) is a wide region with differentiated informal housing markets. The city private housing markets vary in quantity, quality, and prices which conjointly influence residents housing preferences and choices. Based on positivist philosophical stance, this book addresses the peculiarities of each residential market in Low Residential Density (LRD), Medium Residential Density (MRD), and High Residential Density (HRD) areas in terms of residential quality and housing preferences. With heuristic methods including predictive model and conjoint choice experimentation, this book unravels the level and variability of residential quality (neighborhood and structural) and housing preference (revealed and stated) decisions in Metropolitan Lagos. In addition, the residential quality and housing preferences are mapped to give their spatial patterns across Lagos megacity neighborhoods as segmented residential submarkets. Applying the positivist philosophical stance, the book provides evidence to support residential quality and housing preference variability across the city private housing submarkets. The book is both a guide and reference for students in the built environment, urban planners, urban policy decision makers, housing researchers, property managers, and real estate professionals who are interested in understanding the residential quality and preference dynamics within polarized cities.

Kurzfassung: In light of the resurgence of inflation in developed industrialised countries following a period of inordinately low inflation, this book analyses the causes and devastating effects of inflation by drawing lessons from the past. Focusing on the German hyperinflation of the 1920s and the inflationary waves of the 1970s, it examines the resulting economic crises and their influence on the subsequent periods of social and political turmoil, namely the fascism of the 1930s and the neoliberal revolution of the 1980s. Featuring five detailed case studies on inflationary waves in various countries in the 1970s, the book identifies economic policy errors of the past, seeking to prevent their recurrence. Offering empirical and theoretical insights alike, the authors present strategies for effectively combating inflation and deflation. In turn, the book assesses the complex ties between wage increases, income distribution, and price changes, ultimately providing valuable recommendations on how wage policy can be used to stabilise price level increases at a low level in a world characterised by diverse and extreme economic shocks. “The Resurgence of Inflation” fosters a vital discourse on wage and price dynamics, economic development and the role of trade unions, making it an essential read for policymakers, economists, and anyone seeking a deeper understanding of today’s economic challenges.

Kurzfassung: This two-volume textbook teaches about the uniqueness and the difficulty of the European unification project. It describes, as clearly as possible, what Robert Schuman declared in 1950, that "... Europe will not be made all at once…". Navigating the nexus of four academic fields - political science, institutional analysis, economics, and history - the book serves as a reference work for accurate, exhaustive, and well-researched information on the creation and functioning of the European Union. Volume 2 provides a comprehensive overview of the European Union's institutions and policies, such as agricultural and fisheries policies, economic and monetary policy, environmental policy, foreign affairs and defence policy, social policy, competition policy, regional policy, as well as immigration and asylum policy. Supported by numerous photographs, diagrams, maps, and sources, the book will serve as an essential textbook for undergraduate and graduate students studying the subject of European integration, as well as a useful resource for a broader audience interested in the European integration process.

China in the World-system: Strategic Pathways to 2100.
Kurzfassung: This book reviews China’s strategic pathway over the last 1000 years and considers its prospects for ascending to high-income status by the end of the 21st century. It analyzes why, although China’s chances of joining the global core are sound, they are not outstanding; in addition, it faces mounting challenges, internal and external alike. The argument is presented in the framework of dynamic-strategy theory, which is expounded here in novel form. This exposition includes a wide ranging survey of global history, with a focus on the development of the industrialisation paths of the major economies of today, including a detailed study of Japan's long-run strategic pathway. The book’s closing section presents a scenario-based discussion of China’s potential place in the world in 2100. The analysis implies that China’s zenith is likely to be reached slightly before mid-century, after which its relative economic scale will likely decline. Beyond that general finding, the scenarios investigate the wide range of plausible outcomes that China may experience: a range that the author contends is much wider for China than for nations under-pinned by less complex political-economies. Given its scope, the book will appeal to scholars of history, economics, geopolitics and sinology, and to anyone interested in learning about China’s economic prospects at a time of increasingly heated ideological and empirical debates.

Kurzfassung: In this textbook readers will acquire knowledge of problem-solving and learning to enhance both efficiency and the experience of service users in rapidly changing service environments, that can create new service models. Emphasizing that, above all else, individuals are at the centre of services, the book goes deeply into the nature of public services and their logic-of-practice. By applying learning and problem-solving approaches, the reader gains practical capabilities in addition to an appreciation of the latest research literature. Following a multidisciplinary, international approach, the book suggests a new typology of problem-framing and presents many examples of how new service solutions can be created in any public service context. The book offers a conceptual toolkit to understand and analyse dynamically changing services and the application of new technologies. Topics covered include pressing issues surrounding public services, such as e-technology, digitalisation, e-services, artificial intelligence, entrepreneurialism, sustainability, climate, inequality, developing economies, and smart cities. Chapters follow a similar structure: issue, problems, what we know, learning framework, worked example, theory and practice conclusions, as well as teacher and learner notes. Addressing advanced undergraduate and graduate students of public administration, public management, political science, sociology, computer science, and information systems, the book will also be a valuable resource for practitioners, i.e. experts and managers in public organizations, professionals in organizations working at the business and public sectors, consultants, and IT suppliers.

Kurzfassung: This book embarks on a comprehensive exploration of the jurisdiction of the International Criminal Court (ICC) and elucidates the three foundational aspects of its jurisdiction as laid out in the Rome Statute: the preconditions for exercising jurisdiction (Article 12 ICCRSt), its substantive competence regarding core crimes (Articles 5-8bis ICCRSt), and the principle of complementarity (Article 17§1(a) ICCRSt). This principle, crucial to understanding the ICC’s ‘ultimate jurisdiction’, is invoked only when a State Party demonstrates an inability or unwillingness to genuinely undertake investigation or prosecution. The book further probes the ‘negative preconditions’ of the Court’s jurisdiction, in particular, immunities (Article 27 ICCRSt) and exceptions through Security Council referrals (Articles 13(b) and 15 ICCRSt). Intended for students, scholars, and practitioners alike, this second edition offers invaluable insights into the ICC’s jurisdiction, making a notable contribution to the existing literature. Importantly, it also navigates emerging fields of international criminal law, addressing topical and thought-provoking subjects such as ecocide, cyber warfare, automated lethal weapons, artificial intelligence, and the legal complexities arising from the Russian invasion of Ukraine.

Kurzfassung: This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises. Crises challenge countries’ legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies: (i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems; (ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty. This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries’ domestic legal systems, or whether states’ responses to crises lead to legal divergence and disintegration. Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book’s originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness. From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

Kurzfassung: Digital technologies are playing a growing role in achieving the UN’s Sustainable Development Goals (SDGs). They are both a tool both for achieving developmental outcomes and a driver of change. However, the use of digital technologies also entails certain legal challenges. The purpose of this book is to highlight these challenges and suggest solutions. Written by leading researchers from six countries, who analyse legislative solutions from around the world, it includes chapters on the benefits of asset tokenisation, the role of artificial intelligence in achieving sustainable development, legal issues in the green digital transformation, and human rights in a digital world. Through a mixture of fundamental analysis and real-world examples, readers will learn how emerging digital technologies can help achieve various SDGs and what legal challenges arise from their application. This important resource will be of interest to academics, government and legal officials whose work involves the legal regulation of the introduction and use of new digital technologies, as well as sustainable development challenges. Legal experts engaged in the design of new legal infrastructures during the current phase of digital, climatic and social transformation in private, public and social organizations will also find it useful.

Kurzfassung: This book focuses on devising a comprehensive protective mechanism for the right to privacy in Pakistan. It argues that the existing legal regime lacks an effective remedy for victims of privacy violations and emphasizes the need for comprehensive legislation to safeguard this crucial right. Pursuing a multidisciplinary approach, the book thoroughly explores the issue of media intrusions into people’s privacy through thematic media content analysis and highlights the significant impacts of these intrusions on victims’ lives. In the process, the book addresses various conceptual aspects, their relevance, and their implications for privacy-related disputes during adjudication. Recognizing that theoretical underpinnings alone may not be sufficient to create a legal regime “from scratch,” it explores the enforcement of the right to privacy under the European Convention on Human Rights (ECHR), as interpreted and enforced by the European Court of Human Rights (ECtHR). The book subsequently goes beyond exploring international law by analyzing the impact of media-and-privacy cases on privacy protection in two major member states: Germany (a civil law jurisdiction) and the United Kingdom (a common law jurisdiction). Drawing upon these conceptual and comparative legal deliberations and findings, the book provides concrete guidelines for a new privacy law in Pakistan.

Kurzfassung: This book examines the lethal risks faced by police and traffic officers in Aotearoa New Zealand. It tracks lethal risk volume and type across 134 years of the New Zealand Police/Ngā Pirihimana o Aotearoa’s 137-year existence. Using data gathered from public records, official government reporting, and comparative studies, it reveals the current situation with regards to lethal risks from 1886 to 2019. The book identifies and presents two lethal risk hierarchies, the first for the period 1886-1999 and the second for the period 2000-2019. The hierarchies establish that the lethal risks faced come from: • Firearms • Assaults • And, potentially, cutting/stabbing attacks It determines that the nature of lethal risk has not changed, but rather the volume has reduced, meaning today’s officers are less likely to be harmed by lethal risk encounters than their predecessors were. This volume is an ideal starting point for researchers and practitioners interested in developing further scholarly research on lethal force and lethal risks faced by law enforcement officers and the organization they belong.

Kurzfassung: There are any number of studies on Turkish secularism. However, to date there has never been a comprehensive analysis of the constitutional protection of secularism, one that systematically covers all relevant aspects. Addressing that gap, this book presents a comprehensive and coherent analysis of the constitutional framework of this principle within the Turkish legal system. Secularism is a common fundamental principle of all three Turkish constitutions (1924, 1961, 1982). The principle has been granted an irrevocable status and has been strictly constructed within the Turkish constitutional system. Despite the guarantee of irrevocability, however, its interpretation and application have undergone a drastic transformation in response to changing social and political circumstances. Today, the complaints filed before the domestic and international judiciary predominantly concern the Turkish State’s neutrality and impartiality towards religion and the exercise of freedom of religion by religious minorities. While many observers have interpreted these problems in light of the contemporary policies pursued in the field of religion, a closer look reveals that the problem lies deeper in Turkey’s general constitutional framework. While the 1982 Constitution declares the principle as an unamendable characteristic of the Republic and protects it with multi-layered mechanisms, certain anti-democratic features of the Constitution, including the President’s predominant role in forming the high-ranking judiciary, affect the proper and consistent application of the principle of secularism. The consolidation of the secular state order depends on various factors other than a suitable constitution. However, it goes without saying that constitutions can help or hinder efforts to find solutions. Therefore, this book identifies the deficiencies in the Turkish constitutional and legal framework regarding the protection of secularism. It presents the historical development and definition of a secular state, analyzes the jurisprudence of the Turkish Constitutional Court and the European Court of Human Rights, studies the application of the party prohibition mechanism as a means of protecting the principle, and assesses the constitutional amendments of 2001, 2010 and 2017. Moreover, it proposes much-needed constitutional and legal amendments with a view to improving the application of the principle of secularism.

Kurzfassung: This book describes how statements made by non-state actors affect the scope of an individual's criminal responsibility and how they should be taken into account by domestic criminal courts. Sentencing is only possible on the basis and within the limits of the law. In the 21st century, this law increasingly means regulations formulated by various non-state actors: international organisations, human rights tribunals or statutory bodies. The content of these regulations does not only refer to states, but often has a direct impact on the legal situation of individuals. Two worlds collide here. Strict criminal law is influenced by fluid regulations issued by entities that have not been empowered to exercise the right to punish. The book presents an interpretative method to support the court's inference in the cases outlined above, based on the using the concept of two interrelated norms: the norm of the individual and the norm of the court.

Kurzfassung: This volume considers the most appropriate criminal jurisdiction to prosecute aggravated sex trafficking of the kind associated with northern Albanian crime groups. Watershed jurisprudence from the Yugoslav war crimes tribunal could prove pivotal to achieving the legislative changes for prosecuting Albanian sex trafficking in peacetime that this book advocates. This book revisits this relevant history to challenge the current transnational status of trafficking as a mischaracterisation. It is maintained that the Albanian sex trafficker has become, like the wartime rapist before him, the perpetrator of an offence that warrants recognition by the international criminal justice regime. The book considers the historico-cultural legacies of present-day root-causes of Albanian sex trafficking to understand how the same dehumanising ideology and sexual violence aimed at women during the Yugoslav Wars persisted post-conflict and continues to underscore contemporary Albanian sex trafficking and what these similarities in assailant attitudes and actions might mean for potentially prosecuting human trafficking within the international criminal justice system. Through the prism of neutralisation theory rooted in forensic cultural anthropology, in the form of a novel hypothetical model, a conceptual framework to consider the true nature of trafficking is offered. The model offers a précised interpretation of the key factors that establish certain criminal conduct as suitable for international criminal justice and how those factors relate to Albanian sex trafficking. The model distils the characteristics of Albanian sex trafficking; it extracts the essential elements and most important aspects of this type of criminality so we can recognise their presence in real-world cases. A case study featuring interviews with the traffickers themselves and individuals who have encountered them firsthand then describes how the model holds for the real-world experience of Albanian sex trafficking. Approached from the trafficker angle, the purpose of the case study is to support the theoretical model by showing how each element manifests in Albanian sex trafficking. For a richer understanding, each of the elements is explained and explored within a historico-cultural context. The chapters in this book feature key topics and supporting material, including: The backstory, purpose, and structure of the international criminal justice system followed by how the regime could and should be extended to encompass aggravated sex trafficking. The role of culturally-shaped neutralization theory in understanding decision-making in sex trafficking on the individual level Historico-cultural context, including competing elements of tradition and modernity Longstanding gender attitudes, particularly evaluating violence against women Interviews with Albanian sex traffickers and victims By evaluating Albanian sex trafficking through this lens, this book aims to identify international criminal justice as a more appropriate and effective approach to prosecuting aggravated sex trafficking and to suggest future opportunities for further research that can aid in improved policing and prisoner management as it relates to Albanian sex trafficking. This book is ideal for students and academic researchers interested in international criminal justice and sex trafficking studies.

Kurzfassung: This book presents a fresh approach to cybersecurity issues, seeking not only to analyze the legal landscape of the European Union and its Member States, but to do so in an interdisciplinary manner, involving scholars from diverse backgrounds – ranging from legal experts to ICT and engineering professionals. Cybersecurity requirements must be understood in a broader context, encompassing not just conventional aspects, but also emerging topics. This can only be achieved through an interdisciplinary approach. Indeed, cybersecurity should be consistently considered in relation to cybercrime and/or cyber defense, while examining it through the lens of specific domains that are intertwined with various legal fields. Moreover, it is crucial to uphold ethical standards and safeguard fundamental rights, particularly regarding personal data protection. By adopting this comprehensive perspective, the significance of cybersecurity in the exercise of public authority becomes apparent. It also plays an essential role in upholding the fundamental values of both individual Member States and the EU as a whole, such as the rule of law. Moreover, it fosters trust, transparency, and effectiveness in market relations and public administration interactions. In turn, the book draws on the expertise of its authors to provide insights into ICT components and technologies. Understanding these elements holistically is essential to viewing every "cyber" phenomenon from a legal standpoint. In addition to the holistic and interdisciplinary approach it presents, the book offers a captivating exploration of cybersecurity and an engaging read for anyone interested in the field.

Kurzfassung: This book focuses on OLAF, the European Union’s anti-fraud office, and examines the role of and challenges concerning fundamental rights in OLAF’s composite enforcement procedure. The mission of OLAF (Office Européen de Lutte Antifraude) is to fight fraud, corruption and any other illegal activities that affect the financial interests of the European Union. To this end, OLAF carries out administrative investigations, in which it gathers evidence itself, and coordination cases, in which it coordinates the Member States’ investigations. OLAF’s investigation and coordination efforts are conceived of as mere derivatives of other more traditional forms of law enforcement cooperation in which authorities enter into obligations to cooperate with one another, but in which each acts to fulfill these obligations within its own separately identifiable legal order and on the basis of its own law. This system, in its most conventional form, is founded on the notion of territorial sovereignty. If we extend the logic of this approach from enforcement (the ‘sword’) to fundamental rights (the ‘shield’), issues in relation to the latter – and the accompanying responsibility to prevent and/or remedy them – can arise only in individual (sovereign) legal orders. The way in which we view OLAF, as an evolved cognate of traditional forms of law enforcement cooperation, therefore directly dictates which fundamental rights issues enter into the equation, and in which manner. This book proposes an innovative way of looking at OLAF, which we refer to as ‘composite enforcement procedures.’ In this type of procedure, responsibilities for the entirety of enforcement are attributed to inextricably interlinked European Union and Member State legal orders. If we observe OLAF through this new lens, fundamental rights issues that would otherwise go unnoticed come to the forefront. These are issues that arise not in individual legal orders, but rather between or among the European Union and the Member States. This book addresses these fundamental rights challenges and makes concrete recommendations on how they can be addressed and resolved.

Kurzfassung: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers. Finally, it discusses how international forces can uphold the right to liberty and security as well as the principle of non-refoulement when they extraterritorially apprehend ICC suspects. This also reflects the book’s relevance with regard to the more general debate on the extraterritorial application of human rights.

Kurzfassung: This book explores key issues on the relational and operational dimension of the professional actions aimed at ensuring the well-being and inclusion of migrants in the reception system. Starting from the assumption that well-being is a multi-level phenomenon related to different and complex questions, the chapter authors articulated their reflections developing some thematic contents, complementary to one another, from the perspectives of different social actors involved in the inclusion process. A special attention is paid to the risk factors as potential obstacles to the inclusion, not only in the achievement of well-being but also in the relationship with the receiving society and with the reception system. Case studies will be presented to show how this complexity is explored integrating different theoretical perspectives with the participation of all social actors involved in inclusion pathways (unaccompanied migrant minors, immigrant families, refugees, social operators, voluntary guardians). The authors share the social responsibility in investing in human and professional resources in the reception system and in connecting it with the local community. Updating the social workers’ tools and methods become more and more relevant to enable the diffusion of new skills, functions, and roles in the management of reception of migrant minors and adults.

Kurzfassung: This Open Access book addresses climate change in Europe and Latin America from a comparative regionalism studies (CRS) perspective. Written by an international team of scholars and experts, chapters critically analyze proposals for mitigating climate change while contributing to the mutual understanding about the issues at stake across regions. The book is divided into three main sections. In the first section, authors discuss EU and Latin American cooperation, negotiations, and perspectives on climate change, exploring their agendas, the interests and key challenges at the global, regional and interregional levels. The second section focuses on the challenges to finance development and a greener economy. The third section explores new green solutions to climate change in the agriculture sector and initiatives such as nature-based solutions to climate change and best practices. Providing policy oriented solutions for combatting regional climate change at a critical juncture, this volume will be of interest to researchers and students of international relations, international law, and environmental politics, as well as public officials and climate change activists.

Kurzfassung: This volume collects six original essays by internationally respected researchers who have devoted themselves to the study of legal obligation. It brings together works that innovatively address key dimensions of the current debates concerning legal obligation from different and, in some cases, even opposing theoretical perspectives. As a result, the collection offers a comprehensive discussion of legal obligation that promises to significantly advance our understanding of the obligatory dimension of law. What specifically connects the contributions gathered here is one common thread: coming to terms with a notion – legal obligation – that is of both practical and theoretical importance. On the one hand, it is widely regarded as a fundamental legal concept by legal practitioners and laypeople alike, as not only judges, prosecutors, lawyers, and juries but also ordinary citizens make extensive use of obligation-related terms and discourses. On the other hand, the notion of legal obligation is of paramount significance for the theory of law. Indeed, even legal theorists who, quite understandably, refuse to reduce the law to a mere obligation-imposing device and opt instead for a view in which the normative dimension of the law also encompasses powers, rights, permissions, privileges and immunities, duly acknowledge the centrality of legal obligation for the understanding and conceptualisation of law. Hence the importance of the treatments presented in this volume.

Kurzfassung: The book brings to light how Latin American states have traditionally stood before the field of International Investment Law and Arbitration. It delves into their posture of resistance to critically examine how their perspective has gradually changed and how they have adapted and molded their investment agreements so as not to leave their position as players in the field of International Investment Law. Many Latin American states have appeared as defendants before international investment tribunals and some of these, like Venezuela, Bolivia or Ecuador, have denounced their international investment agreements. Deeming the law field as imbalanced, they have looked for alternatives to continue providing legal protection to foreign investors while protecting their right to regulate in the name of public interest. Some interesting investment agreements models, sometimes of a different ilk, have consequently flourished and have arrested the attention of those studying or working with international investment law. The main objective of this book is to critically discuss how Latin American states have accepted, resisted, or adapted themselves to international investment law and arbitration. Accordingly, the general connection between these states and international investment law are explained in an introduction which examines the general trends as per which Latin American states have offered a legal protection to foreign investments. The first part enters the merits of where international investment law and arbitration stand in some Latin American states whereby the experience of Brazil, Chile, Argentina, Venezuela, and Uruguay are discussed. The following parts explain the trends in international investment law and arbitration in Latin America. These trends are namely related to dispute settlement and governance, to the connection between investment law and human rights and finally to regionalization. In these parts, the experience of states like Brazil, Colombia, Peru, and Mexico are perused.

Kurzfassung: This book examines the intricate dynamics of when individuals adhere to laws, taking into account the context in which laws attempt to shape human behavior. While existing literature touches upon various reasons why people comply with laws, the book focuses on a critical question which has been missing from the discussion: when do people obey laws? By treating law as a form of social communication, it develops an integrated framework to answer this question. It explores how social, psychological, and institutional conditions shape compliance decisions of individuals. What does a law signify? When does the compulsion to obey arise? When do individuals comply out of a fear for legal sanctions or social repercussions? Why do some laws have high symbolic values and others fail despite harsh punishments? The book unveils the contextual intricacies that underlie obedience to law. It challenges conventional wisdom and offers a fresh perspective on the power and limitations of law in shaping human behavior. For scholars and academics seeking a deeper understanding of legal compliance and role of law in shaping behaviors, this book will be an indispensable resource.

Kurzfassung: This peer-reviewed book presents a comprehensive overview of the role space is playing in enabling Latin America to fulfil its developmental aspirations. Following on from the highly acclaimed Parts 1 to 4, it explains how space and its applications can be used to support the development of the full range and diversity of Latin America societies, while being driven by Latin American goals. The Latin American space sector is currently undergoing a phase of rapid and dynamic expansion, with new actors entering the field and with space applications increasingly being used to support the continent’s social, economic, and political development. All across Latin America, attention is shifting to space as a fundamental part of the continental development agenda, and the creation of a Latin American space agency is evidence of this. Additionally, while in recent years, significant advances in economic and social development have lifted many of Latin America’s people out of poverty, there is still much that needs to be done to fulfil the basic needs of the population and to afford them the dignity they deserve. To this end, space is already being employed in diverse fields of human endeavour to serve Latin America’s goals for its future, but there is still a need for further incorporation of space systems and data. This book will appeal to researchers, professionals and students in fields such as space studies, international relations, governance, and social and rural development.
