Abstract: "After more than a century of heroic urban visions, urban dwellers today live in suburban subdivisions, gated communities, edge cities, apartment towers, and slums. The contemporary cities as we know are more often the embodiment of unexpected outcomes and unintended consequences rather than visionary planning. As an alternative approach for rethinking and remaking today's cities and regions, this book explores the intersections of critical inquiry and immediate, substantive actions. The essays inside recognize the rich complexities of the present city not as barriers or obstacles but as grounds for uncovering opportunity and unleashing potential. Now Urbanism asserts that the future city is already here. It views city making as grounded in the imperfect, messy, yet rich reality of the existing city and the everyday purposeful agency of its dwellers.Through a framework of situating, grounding, performing, distributing, instigating, and enduring, these essays written by a multidisciplinary group of practitioners and scholars illustrate specificity, context, agency, and networks of actors and actions in the re-making of the contemporary city"--

Abstract: "This book concludes a trilogy that began with Intelligent Cities: Innovation, Knowledge Systems and digital spaces (Routledge 2002) and Intelligent Cities and Globalisation of Innovation Networks (Routledge 2008). Together these books examine intelligent cities as environments of innovation and collaborative problem-solving. In this final book, the focus is on planning, strategy and governance of intelligent cities. Divided into three parts, each section elaborates upon complementary aspects of intelligent city strategy and planning. Part I is about the drivers and architectures of the spatial intelligence of cities, while Part II turns to planning processes and discusses top-down and bottom-up planning for intelligent cities. Cities such as Amsterdam, Manchester, Stockholm and Helsinki are examples of cities that have used bottom-up planning through the gradual implementation of successive initiatives for regeneration. On the other hand, Living PlanIT, Neapolis in Cyprus, and Saudi Arabia intelligent cities have started with the top-down approach, setting up urban operating systems and common central platforms. Part III focuses on intelligent city strategies; how cities should manage the drivers of spatial intelligence, create smart environments, mobilise communities, and offer new solutions to address city problems. Main findings of the book are related to a series of models which capture fundamental aspects of intelligent cities making and operation. These models consider structure, function, planning, strategies toward intelligent environments and a model of governance based on mobilisation of communities, knowledge architectures, and innovation cycles"--

Abstract: "This book explores the concept of a substantive right to equality and considers the underlying rationale behind the right to equality and non-discrimination within the European Convention on Human Rights (ECHR) and the EU. The book sets out a theoretical basis for the right to substantive equality before undertaking a careful analysis of the jurisprudence of both the European Court of Human Rights and the European Court of Justice in order to examine how the two Courts have approached the question through their case-law. The historical evolution of the prohibition of discrimination in the two legal orders is traced in order to demonstrate how the human interest safeguarded by a right to equality has developed and continues to develop within the jurisprudence of the Strasbourg and Luxembourg Courts. The book demonstrates how the right to substantive equality is becoming increasingly relevant. It shows how, despite the profound differences between the scope of ECHR and EU equality law, the two Courts have been willing to move beyond the apparent limitations of the written legal framework in several instances with a view to extending the personal and the material scope of what appears to be an emerging human right to equality"--

Abstract: "The adoption of the Convention on the Rights of People with Disabilities (CPRD) by the United Nations in 2006 marked a major watershed. The CRPD is the first comprehensive and binding treaty on the rights of people with disabilities. It establishes the right of people with disabilities to equality, dignity, autonomy, full participation as well as specific rights including the right to live in the community, supported decision-making and inclusive education. Prior to the CRPD, international law had provided only limited protections to people with disabilities, although some countries had begun to incorporate rights protections into their respective domestic legislation. This book analyses the development of disability rights as an international human rights movement, in selected countries in Asia, Africa, and the Middle East as well as the United States. The book begins with an examination of the status of people with disabilities under international law prior to the adoption of the CPRD and follows the development of human rights protections through the drafting process of the CRPD. People with disabilities, like women and children before them, waged a battle to enforce their rights on the international stage against a backdrop of changing international norms. The book highlights four areas the right to legal capacity (article 12), the right to liberty and freedom from torture (articles 14 and 15), the right to live in the community (article 19), and the right to inclusive education, in order to the transformation from the charity/deficit/medical model of disability to the human rights mode. These areas are analyzed from a comparative perspective including a discussion of the laws, policies, and practices in selected countries in order to show the success of the CRPD in achieving protections depends on the extent to which individual countries begin to enforce domestic laws and policies and the extent to which various societies change their attitudes about people with disabilities"--

Abstract: This book examines the nexus between nation-building and history education globally and the implication for cultural diversity and social justice. It studies some of the major education reforms and policy issues in history education in a global culture, and regards them in the light of recent shifts in history education and policy research. In doing so, the volume provides a comprehensive picture of the intersecting and diverse discourses of globalisation, history education and policy-driven reforms. It makes clear that the impact of globalisation on education policy and reforms is a strategically significant issue for us all. The book focuses on the importance of nation-building and patriotism in history education, and presents up-to-date research on global trends in history education reforms and policy research. It provides an easily accessible, practical yet scholarly source of information about the international concerns in the field of globalisation, history education and policy research

Abstract: This book on privacy and data protection offers readers conceptual analysis as well as thoughtful discussion of issues, practices, and solutions. It features results of the seventh annual International Conference on Computers, Privacy, and Data Protection, CPDP 2014, held in Brussels January 2014. The book first examines profiling, a persistent core issue of data protection and privacy. It covers the emergence of profiling technologies, on-line behavioral tracking, and the impact of profiling on fundamental rights and values. Next, the book looks at preventing privacy risks and harms through impact assessments. It contains discussions on the tools and methodologies for impact assessments as well as case studies. The book then goes on to cover the purported trade-off between privacy and security, ways to support privacy and data protection, and the controversial right to be forgotten, which offers individuals a means to oppose the often persistent digital memory of the web. Written during the process of the fundamental revision of the current EU data protection law by the Data Protection Package proposed by the European Commission, this interdisciplinary book presents both daring and prospective approaches. It will serve as an insightful resource for readers with an interest in privacy and data protection

Abstract: "The right of indigenous peoples to Free Prior and Informed Consent (FPIC) in relation to natural resource extraction in their territories is a principle that is increasingly recognised by intergovernmental organizations, international bodies, conventions and international human rights law as well as in the domestic law of some States. This book offers a comprehensive overview of the status of Free Prior and Informed Consent under international human rights law, considering the main controversies, obstacles and challenges associated with its recognition and implementation. The book examines the relationship between Free Prior and Informed Consent and territorial, resource and governance rights. The historical basis for FPIC is considered as well as the legitimacy of the dominant doctrines of exclusive State ownership of subsoil resources. The book argues that FPIC constitutes an emerging norm of international law with a tipping point having been reached in terms of the requirements recognition, both within and beyond the human rights regime. It draws on emerging jurisprudence from around the world, as well as evolving industry standards and policies, to illustrate the growing recognition of the fact that respect for the consent requirement is fundamental to securing indigenous peoples self-governance and territorial rights"--
Description / Table of Contents: IntroductionPart I. The role of indigenous peoples' consent in legitimising title to territory -- The genesis of indigenous consent under international law and its role in legitimishing title to territory -- Nineteenth-century positivists and divergence between the role of consent in theory and practice -- Part II. The requirement for free prior and informed consent in the normative framework of indigenous peoples' rights -- The evolving consent requirement under the ILO system -- The self-determination-based normative framework of indigenous rights -- FPIC and the normative framework of indigenous peoples' rights -- Debates in relation to the consent requirement -- Part III. Abstract: This book is the long awaited sequel to ""Continuous Productive Urban Landscapes: Designing Urban Agriculture for Sustainable Cities"". ""Second Nature Urban Agriculture"" updates and extends the authors' concept for introducing productive urban landscapes, including urban agriculture, into cities as essential elements of sustainable urban infrastructure. It reviews recent research and projects on the subject and presents concrete actions aimed at making urban agriculture happen. As pioneering thinkers in this area, the authors bring a unique overview to contemporary developments and have the

Abstract: This book examines the diverse use of visual representations by teachers in the science classroom. It contains unique pedagogies related to the use of visualization, presents original curriculum materials as well as explores future possibilities. The book begins by looking at the significance of visual representations in the teaching of science. It then goes on to detail two recent innovations in the field: simulations and slowmation, a process of explicit visualization. It also evaluates the way teachers have used different diagrams to illustrate concepts in biology and chemistry. Next, the book explores the use of visual representations in culturally diverse classrooms, including the implication of culture for teachers’ use of representations, the crucial importance of language in the design and use of visualizations, and visualizations in popular books about chemistry. It also shows the place of visualizations in the growing use of informal, self-directed science education. Overall, the book concludes that if the potential of visualizations in science education is to be realized in the future, the subject must be included in both pre-service and in-service teacher education. It explores ways to develop science teachers’ representational competence and details the impact that this will have on their teaching. The worldwide trend towards providing science education for all, coupled with the increased availability of color printing, access to personal computers and projection facilities, has lead to a more extensive and diverse use of visual representations in the classroom. This book offers unique insights into the relationship between visual representations and science education, making it an ideal resource for educators as well as researchers in science education, visualization and pedagogy

Abstract: How and to what degree do federations produce uniform law within their system? This comparative empirical study addresses these questions comprehensively for the first time. Originally produced under the auspices of the International Academy of Comparative Law, this volume examines legal unification in twenty federations around the world. Each of the successive chapters presents the forces of unification through the lens of a particular federal system. A comparative overview chapter provides a detailed analysis of the overall results with compelling visual illustrations of legal unification along different dimensions (e.g. by area of law; by federation; by civil vs common law system). The overview chapter summarizes and analyzes the means and methods of legal unification and the degree of legal unification of each system, and explains the driving forces of legal unity and diversity in federations more generally. The volume presents surprising findings that should make scholars rethink their abandonment of the civil law vs. common law distinction in comparative law. This book is a milestone in the study of federalism. It is a rare and welcome melding of comparative law and comparative politics using both original data and qualitative analysis. Wide-ranging, probing, and definitive, this book is an invaluable resource for students of law, politics, and multi-level governance. Abstract: The hunt for beneficial owners is on. Like an elephant, the beneficial owner hides in the jungle of complex legal structures, waiting to be discovered by eager prosecutors. But what lies behind this metaphor? What is a Beneficial Owner? Is beneficial ownership a right? What does this right encompass? What is the value of this right compared to other rights? And if beneficial ownership is not a right, is it still a legally relevant relation? How do courts, namely the U.S. Supreme Court deal with the concept? When do Anglo-American judges and European scholars resort to the concept? This book approaches these questions from two perspectives: legal fundamentals and the field of U.S. federal Indian law. Both legal theories and case law are scrutinized with the aim to find a better understanding of the basic conception and characteristics of beneficial ownership. Federal Indian law has been chosen for the study of the concrete implications of the beneficial ownership concept in what Roscoe Pound referred to as “the law in action.” To some, this choice of legal field might seem somewhat unusual. What answers could federal Indian law possibly offer with regard to pressing questions from the financial industry? As always, there is a short and a long answer. The short answer is that the analysis of an equally sophisticated field of law can open new perspectives on a given field of law. For example, not only potential criminals and tax evaders but also members of an older civilization are beneficial owners. The long answer can be found in this very book

Abstract: The proposed volumes are aimed at a multidisciplinary audience and seek to fill the gap between law, semiotics and visuality providing a comprehensive theoretical and analytical overview of legal visual semiotics. They seek to promote an interdisciplinary debate from law, semiotics and visuality bringing together the cumulative research traditions of these related areas as a prelude to identifying fertile avenues for research going forward. Advance Praise for Law, Culture and Visual Studies This diverse and exhilarating collection of essays explores the many facets both historical and contemporary of visual culture in the law. It opens a window onto the substantive, jurisdictional, disciplinary and methodological diversity of current research. It is a cornucopia of materials that will enliven legal studies for those new to the field as well as for established scholars. It is a ‘must read’ that will leave you wondering about the validity of the long held obsession that reduces the law and legal studies to little more than a preoccupation with the word. Leslie J Moran Professor of Law, Birkbeck College, University of London Law, Culture & Visual Studies is a treasure trove of insights on the entwined roles of legality and visuality. From multiple interdisciplinary perspectives by scholars from around the world, these pieces reflect the fullness and complexities of our visual encounters with law and culture. From pictures to places to postage stamps, from forensics to film to folklore, this anthology is an exciting journey through the fertile field of law and visual culture as well as a testament that the field has come of age. Naomi Mezey, Professor of Law, Georgetown University Law Center, Washington, D.C., USA This highly interdisciplinary reference work brings together diverse fields including cultural studies, communication theory, rhetoric, law and film studies, legal and social history, visual and legal theory, in order to document the various historical, cultural, representational and theoretical links that bind together law and the visual. This book offers a breath-taking range of resources from both well-established and newer scholars who together cover the field of law’s representation in, interrogation of, and dialogue with forms of visual rhetoric, practice, and discourse. Taken together this scholarship presents state of the art research into an important and developing dimension of contemporary legal and cultural inquiry. Above all, Law C ...

Abstract: The Handbook Argumentation Theory provides an up to date survey of the various theoretical contributions to the development of argumentation theory for all scholars interested in argumentation, informal logic and rhetoric. It describes the historical roots of modern argumentation theory that are still an important theoretical background to contemporary approaches. Because of the complexity, diversity and rate of developments in argumentation theory, there is a real need for an overview of the state of the art, the main approaches that can be distinguished and the distinctive features of these approaches. The Handbook covers classical and modern backgrounds to the study of argumentation, the New Rhetoric developed by Perelman and Olbrechts-Tyteca, the Toulmin model, formal approaches, informal logic, communication and rhetoric, pragmatic approaches, linguistic approaches and pragma-dialectics. The Handbook is co-authored by Frans H. van Eemeren, Bart Garssen, Erik C.W. Krabbe, A. Francisca Snoeck Henkemans, Bart Verheij and Jean Wagemans, who are a coherent and prominent writing team whose expertise covers the whole field. The authors are assisted by an international Editorial Board consisting of outstanding argumentation scholars whose fields of interest are represented in the volume

Abstract: "The thriving and well-established field of Law and Society (also referred to as Sociolegal Studies) has diverse methodological influences; it draws on social-scientific and arts-based methods. The approach of scholars researching and teaching in the field often crosses disciplinary borders, but, broadly speaking, Law and Society scholarship goes behind formalism to investigate how and why law operates, or does not operate as intended, in society. By exploring law's connections with broader social and political forces--both domestic and international-- scholars gain valuable perspectives on ideology, culture, identity, and social life. Law and Society scholarship considers both the law in contexts, as well as contexts in law. Law and Society flourishes today, perhaps as never before. Academic thinkers toil both on the mundane and the local, as well as the global, making major advances in the ways in which we think both about law and society. Especially over the last four decades, scholarly output has rapidly burgeoned, and this new title from Routledge's acclaimed Critical Concepts in Law series answers the need for an authoritative reference collection to help users make sense of the daunting quantity of serious research and thinking.Edited by the leading scholars in the field, Law and Society brings together in four volumes the vital classic and contemporary contributions. Volume I is dedicated to historical antecedents and precursors. The second volume covers methodologies and crucial themes. The third volume assembles key works on legal processes and professional groups, while the final volume of the collection focuses on substantive areas. Together, the volumes provide a one-stop 'mini library' enabling all interested researchers, teachers, and students to explore the origins of this thriving subdiscipline, and to gain a thorough understanding of where it is today"--

It uses court transcriptions and observations to discuss how the most contentious marriage-related issues - consent and age of spouses, dower, polygamy, and divorce - are adjudicated. The solutions proposed by different legal systems are reviewed , and some broader questions are addressed: how Islamic principles are harmonized with norms based on gender equality, how parties bargain strategically in and out of court, and how Muslim diasporas align their Islamic worldview with a Western normative narrative"--

Abstract: "Although nomadic peoples are scattered worldwide and have highly heterogeneous lifestyles, they face similar threats to their mobile livelihood and survival. Commonly, nomadic peoples are facing pressure from the predominant sedentary world over mobility, land rights, water resources, access to natural resources, and migration routes. Adding to these traditional problems, rapid growth in the extractive industry and the need for the exploitation of the natural resources are putting new strains on nomadic lifestyles. This book provides an innovative rights-based approach to the issue of nomadism looking at issues including discrimination, segregation, freedom of movement, land rights, cultural and political rights, and effective management of natural resources. Jeremie Gilbert analyses the extent to which human rights law is able to provide protection for nomadic peoples to perpetuate their own way of life and culture, and asks why such protection should be granted. The book questions whether the current human rights regime is able to protect nomadic peoples, and highlights the lacuna that currently exists in international human rights law in relation to nomadic peoples. It goes on to propose avenues for the development of specific rights for nomadic peoples, offering a new reading on freedom of movement in the context of nomadic peoples and their rights to land and natural resources"--

Abstract: "In contrast with the progressive dilution of religions predicted by traditional liberal and Marxist approaches, religions remain important for many people, even in Europe, the most secularised continent. In the context of increasingly culturally-diverse societies, this calls for a reinterpretation of the secular legacy of the Enlightenment and also for an updating of democratic institutions. This book focuses on a central question: are the classical secularist arrangements well-equipped to tackle the challenge of fast-growing religious pluralism? Or should we move to new post-secular arrangements when dealing with pluralism in Europe? Offering an interdisciplinary approach that combines political theory and legal analysis, the authors tackle two interrelated facets of this controversial question. They begin by exploring the theoretical perspective, asking what post-secularism is and looking at its relation to secularism. The practical consequences of this debate are then examined, focusing on case-law through four empirical case studies. This book will be of interest to students and scholars of political theory, philosophy, religion and politics, European law, human rights, legal theory and socio-legal studies"--

Prof. Dr. iur. Dr. phil. h.c. Peter M. Lynen ist Leiter des Zentrums für Internationales Kunstmanagement (CIAM) der Hochschule für Musik und Tanz Köln sowie Mitglied und Sekretar (Vizepräsident) der Klasse für Künste der NRW-Akademie der Wissenschaften und der Künste, Düsseldorf. Abstract: Time has become an increasingly important topic in urban studies and urban planning. The spatial-temporal interplay is not only of relevance for the theory of urban development and urban politics, but also for urban planning and governance. The space-time approach focuses on the human being with its various habits and routines in the city. Understanding and taking those habits into account in urban planning and public policies offers a new way to improve the quality of life in our cities. Adapting the supply and accessibility of public spaces and services to the inhabitants’ space-time needs calls for an integrated approach to the physical design of urban space and to the organization of cities. In the last two decades the body of practical and theoretical work on urban space-time topics has grown substantially. The book offers a state of the art overview of the theoretical reasoning, the development of new analytical tools, and practical experience of the space-time design of public cities in major European countries. The contributions were written by academics and practitioners from various fields exploring space-time research and planning

Abstract: This book explores to what extent transnational influences change national/local values and practices in the Nordic educational systems. It provides country cases and thematic chapters that give nuanced insights into the influence of transnational agencies on national governance and discourses. It describes how national discourses and regulation influences school leadership values, culture and practice, in competition with traditional values. The transnational and global discourse on educational leadership is mostly formed according to Anglo-American thinking and tradition. Pivotal foundations of this discourse are strong hierarchical societies/class societies with liberal democracies, and clearly streamed education systems. The Nordic discourse, however, builds on a more equal society and flat hierarchies with participatory democracy, and on comprehensive schooling with strong local community roots. Leadership thinking and practices are formed by the culture and context they are part of: they are primarily shaped by the national/local values, traditions and practices, and only partially shaped by politics, discourses and literature. Due to the fact that a great deal of the literature that is being used in the Nordic contexts is of Anglo-American origin and many of the research projects have Anglo-American foundations, it is difficult to distinguish the sources for leadership thinking and practice. This book distinguishes the Nordic from the Anglo-American thinking and presents important findings and arguments for leadership practitioners inside as well as outside the Nordic countries.

Benefiting from the considered views of two veteran teachers of critical pedagogy, the volume is far more than a knowledge-rich resource, offering as it does vital support in applying the tenets of critical pedagogy to classroom practice. Alongside specific examples of teachers engaging in critical pedagogy in elementary and early-childhood classrooms, the material features close analysis and guidance that will help ease teachers into reflective practice in critical pedagogy that is based on praxisthe point at which theory and practice meet and interact. Indeed, the authors move readers even further than this, showing how students as well as teachers can transform their experience of education through critical reflection. After surveying the field of critical pedagogy, the authors discuss the core precepts that inform the classroom practice of critical pedagogues. They move on to discuss how vital these early and elementary years are in forging childrens nascent identities. Other topics covered include discrimination, gender issues, the development of social justice projects, and the social transformations that critical pedagogy can manifest in the classroom. Finally, this resource explains how teachers can move forward in their classroom practice to enhance equity, justice and social responsibility. This book is essential reading for classroom practitioners in early and elementary education, whether neophytes or veterans, who are interested in deploying this powerful educational paradigm in their work. After surveying the field of critical pedagogy, the authors discuss the core precepts that inform the classroom practice of critical pedagogues. Abstract: This volume presents two Leibnizian writings, the Specimen of Philosophical Questions Collected from the Law and the Dissertation on Perplexing Cases. These works, originally published in 1664 and 1666, constitute, respectively, Leibniz’s thesis for the title of Master of Philosophy and his doctoral dissertation in law. Besides providing evidence of the earliest development of Leibniz’s thought and amazing anticipations of his mature views, they present a genuine intellectual interest, for the freshness and originality of Leibniz’s reflections on a striking variety of logico-philosophical puzzles drawn from the law. The Specimen addresses puzzling issues resulting from apparent conflicts between law and philosophy (the latter broadly understood as comprising also mathematics, as well as empirical sciences). The Dissertation addresses cases whose solution is puzzling because of the convoluted logical form of legal dispositions and contractual clauses, or because of conflicting priorities between concurring parties. In each case, Leibniz dissects the problems with the greatest ingenuity, disentangling their different aspects, and proposing solutions always reasonable and sometimes surprising. And he does not refrain from peppering his intellectual acrobatics with some humorous comments. bbbbbb
