Abstract: "English as a global lingua franca interacts with other languages across a wide range of multilingual contexts. Combining insights from linguistics, education studies, and psychology, this book addresses the role of English within the current linguistic dynamics of globalization. It takes Singapore, Hong Kong, and Dubai as case studies to illustrate the use of English in different multilingual urban areas, arguing that these are places where competing historical assessments, and ideological conceptions of monolingualism and multilingualism, are being acted out most forcefully. It critically appraises the controversial concept of multilingual advantages, and studies multilingual cross-linguistic influence in relation to learning English in bilingual heritage contexts. It also scrutinises multilingual language policies in their impact on attitudes, identities, and investment into languages. Engaging and accessible, it is essential reading for academic researchers and advanced students of bi- and multilingualism, globalization, linguistic diversity, World Englishes, sociolinguistics, and second/third language acquisition"--

Abstract: 'New speakers' is a term used to describe those who have learnt a minority language not within their home or community settings, but through bilingual education, immersion or migration. Looking specifically at the impact of new speakers on language policy, this book provides an authoritative and detailed examination of minority language policy in Wales, Scotland, Ireland, the Basque Autonomous Community, Navarre, Catalonia and Galicia. Based on interviews with politicians, senior civil servants, academics and civil society activists, it assesses the extent to which interventions derived from a new speakers' perspective has been incorporated into official language practice. It describes several challenges faced by new speakers, before proposing specific recommendations on how to integrate them into established minority language communities. Shedding new light on the deeper issues faced by minority language communities, it is essential reading for students and researchers in sociolinguistics, language policy and planning, language education, bi- and multilingualism

Abstract: The first-ever critical anthology of the death arts in Renaissance England, this book draws together over 60 extracts and 20 illustrations to establish and analyse how people grappled with mortality in the 16th and 17th centuries. As well as providing a comprehensive resource of annotated and modernized excerpts, this engaging study includes commentary on authors and overall texts, discussions of how each excerpt is constitutive and expressive of the death arts, and suggestions for further reading. The extended Introduction takes into account death's intersections with print, gender, sex, and race, surveying the period's far-reaching preoccupation with, and anticipatory reflection upon, the cessation of life. For researchers, instructors, and students interested in medieval and early modern history and literature, the Reformation, memory studies, book history, and print culture, this indispensable resource provides at once an entry point into the field of early modern death studies and a springboard for further research

Abstract: "A heritage language is the term given to a language spoken at home by bilingual children of immigrant parents. Written by a leading figure in the field, this pioneering, in-depth study brings together three heritage languages - Hindu, Spanish, and Romanian - spoken in the United States. It demonstrates how heritage speakers drive morphosyntactic change when certain environmental characteristics are met and considers the relationship between social and cognitive factors and timing in language acquisition, bilingualism, and language change. It also discusses the implications of the findings for the language education of heritage speakers in the USA and considers how the heritage language can be maintained in the English-speaking school system. Advancing our understanding of heritage language development and change, this book is essential reading for students and researchers of linguistics and multilingualism, immigration, education studies, and language policy, as well as for educators and policy makers"--

Abstract: During the nineteenth century, words like 'intersex' and 'trans' had not yet been invented to describe individuals whose bodies, or senses of self, conflicted with binary sex. But that does not mean that such people did not exist. In nineteenth-century France, case studies filled medical journals, high-profile trials captured headlines, and doctors staked their reputations on sex determinations only to have them later reversed by colleagues. While medical experts fought over what separated a man from a woman, novelists began to explore debates about binary sex and describe the experiences of gender-ambiguous characters. Anne Linton discusses over 200 newly-uncovered case studies while offering fresh readings of literature by several famous writers of the period, as well as long-overlooked popular fiction. This landmark contribution to the history of sexuality is the first book to examine intersex in both medicine and literature, sensitively relating historical 'hermaphrodism' to contemporary intersex activism and scholarship

Abstract: "This handbook intends to offer a comprehensive and authoritative overview of the human rights implications of emerging technologies in the fields of life sciences and information and communication technologies (ICT). To this end, the volume brings together leading experts whose expertise encompasses several disciplinary domains (law, ethics, technology, basic science, medicine, business, etc.) with purposes of gathering extensive multidisciplinary knowledge about the evolutive transformation of the human rights framework in response to technological innovation. In particular, the aim of this volume is threefold. First, it aims to provide a comprehensive state-of-the-art report on emerging technologies that are likely to transform the human rights framework in the upcoming decades. Second, this collection of essays aims to raise awareness of the ethically and legally appropriate implementation of these technologies and to identify possible critical issues that arise or might arise in the context of their application. Third, and ultimately, the volume intends to contribute to the development of a robust, inclusive, and anticipatory human rights framework that can guide global societies across the ongoing digital transformation. In doing so, special attention is devoted to promoting policies and regulatory frameworks that foster the inalienable rights of individuals and the prevention of potential inappropriate uses or abuses of emerging technologies"--

Abstract: "This Element explores approaches to locating and examining social identity in corpora with and without the aid of demographic metadata. This is a key concern in corpus-aided studies of language and identity, and this Element sets out to explore the main challenges and affordances associated with either approach and to discern what either approach can (and cannot) show. It describes two case studies which each compare two approaches to social identity variables - sex and age - in a corpus of 14-million words of patient comments about NHS cancer services in England. The first approach utilises demographic tags to group comments according to patients' sex/age while the second involves categorising cases where patients disclose their sex/age in their comments. This Element compares the findings from either approach, with the approaches themselves being critically discussed in terms of their implications for corpus-aided studies of language and identity." Abstract: "International responsibility law today is in great need of theorizing, or, at least, that is the present volume's argument. This introduction sets the stage for that argument. It unfolds in four steps: first, it clarifies the reasons that led to putting this collection of essays together and explains what it hopes to achieve; second, it introduces the main theoretical challenges addressed in the volume; third, it provides some information about how the book is organized; and, finally, it sketches out the content of its successive chapters and their articulation"

Abstract: Moving beyond two main concepts of 'interlingual' and 'intralingual' discrimination, this Cambridge Element addresses the concept of 'translingual discrimination', which refers to inequality based on transnational migrants' specific linguistic and communicative repertoires that are (il)legitimized by the national order of things. Translingual discrimination adds intensity to transnational processes, with transnational migrants showing two main characteristics of exclusion - 'translingual name discrimination' and its associated elements such as 'name stigma' and 'name microaggression'; and 'translingual English discrimination' and its elements such as 'accentism', 'stereotyping' and 'hallucination'. The accumulation of these characteristics of translingual discrimination causes negative emotionality in its victims, including 'foreign language anxiety' and 'translingual inferiority complexes'. Consequently, transnational migrants adopt coping strategies such as 'CV whitening', 'renaming practices', 'purification', and 'ethnic evasion' while searching for translingual safe spaces

Abstract: "Genocide is a problem: not only the terrible fact of mass death, but also how the relatively new idea and law of genocide organises and distorts our thinking about civilian destruction. Taking the normative perspective of civilian immunity from military attack, this book argues that the implicit hierarchy of international law, atop which sits genocide as the "crime of crimes," blinds us to other types of humanly caused civilian death, like bombing cities, the "collateral damage" of missile and drone strikes, blockades, and sanctions. In other words, talk of genocide functions ideologically to detract from systematic violence against civilians perpetrated by governments. The Problems of Genocide also contends that this violence is the consequence of "permanent security" imperatives: the striving of states, and armed groups seeking to found states, to make themselves invulnerable to threats. To solve the problems of genocide, this book proposes replacing it with permanent security, which should be criminalized"--

Abstract: "Where does one situate business and human rights? From the perspective of law alone, business falls within the general sphere of private law, further broken down into discrete sub-spheres, particularly corporate law and commercial law. The human rights component is situated in constitutional and international law. Prima facie, 'business' and 'human rights' fall into distinct spheres of regulation and differ in their primary sources. If law were simply approached from a compartmentalized perspective, business would be of no relevance to human rights and vice versa. This, however, is artificial and is antithetical to holistic approaches to problem solving, not to mention the inter-connectivity of law.1 It is unfortunate that in simplifying the study of law through the creation of sub-disciplines, the emergence of sub-discipline expertise (e.g. labor law) has magnified the differences between them"-- ECIP Introduction

Abstract: On a variety of international legal matters, relations between the US and European countries are evolving and even diverging. In an ever-changing world, understanding the reasons for this increasing dichotomy is fundamental and has a profound impact on our understanding of world dynamics and globalization and, ultimately, on our awareness of where the West is going. This interdisciplinary volume proposes new frameworks to understand the differences in approach to international law in the US and Europe. To explain the theoretical and historical underpinnings of the diverging views, the expert essays present new research and develop innovative conclusions. They assess and explore issues such as the idea of sovereignty, constitutional law, the use of force, treaty law and international adjudication. Leading authorities in different disciplines including law and political science, the contributors engage in a new dialogue and develop a new discourse on inter-Atlantic views

Abstract: Despite the tremendous progress in the development of scientific knowledge, the understanding of the causes of poverty and inequality, and the role of politics and governance in addressing modern challenges, issues such as social inclusion, poverty, marginalization and despair continue to be a reality across the world - and most often impact Indigenous Peoples. At the Margins of Globalization explores how Indigenous Peoples are affected by globalization, and the culture of individual choice without responsibility that it promotes, while addressing what can be done about it. Though international trade and investment agreements are unlikely to go away, the inclusion of Indigenous rights provisions has made a positive difference. This book explains how these provisions operate and how to build from their limited success

Abstract: "Thirty years ago the Indian law community was small enough that it was possible for even a new scholar to the field to keep up with most of the Indian law scholarship published annually. However, as our field has proliferated, it has also fragmented, and today more than two-hundred pieces of new legal scholarship are published annually in law reviews alone. These law reviews are not just ivory tower musings; there are now some scholarly contributions which are as fundamental for the study of Indian law as many cases or statutes. These articles help to contextualize the changing doctrines announced by the court, reconcile contradictory authority, challenge assumptions of race/place/power, and push for courts, tribal leaders, legislators, lawyers, educators, and students to adopt new ways of thinking about our fundamental doctrine. However, with so many new contributions we realized that new scholars may miss some of the most impactful articles, and even the progenitors of the field will have forgotten about some of the best ideas put forward by colleagues over the years. While several federal Indian law textbooks exist to preserve judicial doctrine, there is no definitive collection of related legal scholarship"--

Abstract: This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings. Different essays discuss the theoretical and historical foundations of this view (grounded in Kelsen, Hobbes, Locke, Rousseau and others), and its contemporary relevance for areas as diverse as migration law, the conflict of laws, and foreign relations law.
Note: "Most of the essays in this collection are based on papers presented at a workshop held in June 2017 at the 'Wissenschaftskolleg zu Berlin'."

Abstract: "South Africa is a country characterised by great linguistic diversity. Large indigenous languages, such as isiZulu and isiXhosa, are spoken by many millions of people, as well as the languages with European roots, such as Afrikaans and English, which are spoken by several millions and used by many more in daily life. This situation provides a plethora of contact scenarios, all of which have resulted in language variation and change, and which forms the main focus of this insightful volume. Written by a team of leading scholars, it investigates a range of sociolinguistic factors and the challenges that South Africans face as a result of multilingualism and globalisation in both education and social interaction. The historical background to English in South Africa provides a framework within which the interfaces with other languages spoken in the country are scrutinised, whilst highlighting processes of contact, bilingualism, code-switching and language shift"--

Abstract: "In 1956, ICJ judge Philip Jessup highlighted the gaps between private and public international law and the need to adapt the law to border-crossing problems. Today, sixty years later, we still ask what role transnational law can play in a deeply divided, post-colonial world, where multinationals hold more power and more assets than many Nation States. In searching for suitable answers to pressing legal problems such as climate change law, security, poverty and inequality, questions of representation, enforcement, accountability and legitimacy become newly entangled. As public and private, domestic and international actors compete for regulatory authority, spaces for political legitimacy have become fragmented and the state's exclusivist claim to be law's harbinger and place of origin under attack. Against this background, transnational law emerges as a conceptual framework and method laboratory for a critical reflection on the forms, fora and processes of law making and law contestation today"--

Abstract: Place is inextricably linked to history by way of culture, language, philosophy, faith and the development of worldviews. The richness and depth of experience of the Asia-Pacific region has been under-studied, over-simplified and under-appreciated. This book addresses that lacuna in the subject area of international humanitarian law. Drawing on authoritative perspectives and interviews with experts in and on this topic, including four of the region's most distinguished international judges, forty-one chapters thematically examine the development of international humanitarian law; practice and application of international humanitarian law; implementation and enforcement of international humanitarian law; and looking to the future and enhancing compliance with international humanitarian law. The expert contributors draw out unique features, providing fresh insights to scholarship. Contributions on and from the area also grapple with the regional commitments to humanitarianism generally, illuminating how and why international humanitarian law might be more readily accepted or ignored in armed conflicts in the region.

Abstract: "An article that appeared in the April 1797 edition of the Monthly Magazine entitled "On Artificial Taste" offered readers a meditation on two of the most widely noted dimensions of this popular theme: "a taste for rural scenes" and the more "natural" quality of poetry that had been "written in the infancy of society." In some ways, both of these were standard topics, frequently discussed in the literary magazines of the day, though the article addressed them with compelling rigour and clarity, and with a refreshing impatience for empty poses and cultural double standards. It was curious, the author suggested, given people's widely professed love of nature, "how few people seem to contemplate nature with their own eyes. I have 'brushed the dew away' in the morning; but, pacing over the printless grass, I have wondered that, in such delightful situations, the sun was allowed to rise in solitary majesty, whilst my eyes alone hailed its beautifying beams." Having offered a no-nonsense reflection on the state of people's real interest in nature beyond the sort of "romantic kind of declamation" that was so much in vogue, the author moved on to offer a fairly standard list of the age's assumptions: poetry is a "transcript of immediate emotions" transfigured by the effects of those "happy moment[s]" in which the poet is enriched by images "spontaneously bursting on him" without the need for any recourse to "understanding or memory." This account of creativity, like the article's definition of the poet as "a man of strong feelings" giving "us a picture of his mind when he was actually alone, conversing with himself, and marking the impression which nature made on his own heart" seemed to converge with William Wordsworth's ideas about poetry in his Preface to the Lyrical Ballads. Its related insistence on the higher spiritual worth of those moments when the poet worshipped "in a temple not made with hands, and the world seems to contain only the mind that formed and contemplates it" seemed to echo Pysche's declaration of sublime internalization in Keats' ode. Except, of course, that the article was published in April 1797, well ahead of Wordsworth's account in the Preface to the 1800 edition of the Lyrical Ballads and a full generation before Keats's work"--

Abstract: "Two sentiments governed the post-war world: fear and hope. Fear of slipping into an unimaginable, worldwide atomic confrontation even more violent and destructive than the Second World War; and hope that, if the people of world could only acknowledge their common dignity, nations might find a way to perpetuate peace for the foreseeable future. These two feelings dominated the debates that gave birth to both the Charter of the United Nations and the Universal Declaration of Human Rights. In late April 1946, shrouded in the shadow of a horrific world war, nine delegates, selected for their individual expertise, gathered in New York at Hunter College to discuss what action the four-month old United Nations should take to advance "universal respect for, and observance of, human rights and fundamental freedoms," as set forth in the UN Charter (Art. 55). It was"--

Two leading specialists make research and theory accessible, providing the background knowledge necessary for practitioners to make informed choices about vocabulary teaching and testing. This second edition retains the popular format of the first edition, and has been rewritten to take account of the many developments in the past 20 years. There is a greater focus on the vocabulary learning process, with new chapters on incidental learning, and intentional learning, and a new wide-ranging discussion of formulaic language. The book now also includes extensive treatment of word lists and vocabulary tests, with explanations of their various strengths and limitations. Abstract: The 1947 Partition had a major impact on issues of citizenship and rights in India and Pakistan in the decades that followed. Boundaries of Belonging shows how citizenship evolves at a time of political transition and what this meant for ordinary people, by directing attention away from South Asia's Partition 'hotspots' - Bengal and Punjab - to Partition's 'hinterlands' of Uttar Pradesh and Sindh. The analysis, based on rich archival research and fieldwork, brings out commonalities, differences, and the mutual co-construction of the 'citizen' in both places. It also reveals the way in which developments across the border, such as communal violence, could directly impact on minority rights in its neighbour. Questioning stereotypes of an increasingly 'authoritarian' Pakistan and 'democratic' India, Sarah Ansari and William Gould make a major contribution to recent scholarship that suggests the differences between India and Pakistan are overstated

The increased use of these intelligent systems is changing our lives, our society, our economy - challenging at the same time the traditional boundaries of law. Algorithms are widely employed to make decisions that have increasingly far-reaching impacts on individuals and the society, leading potentially to manipulation, biases, censorship, social discrimination, violations of privacy, property rights, and more"--

Abstract: Migration and Integration clarifies and proposes answers for all of the politically toxic questions associated with large-scale migration from the Global South to the Western liberal democracies. Driven by the conviction that the Alt-Right is using the issues of migration and integration effectively to batter the defenses of liberal democracy, Professor Tom Farer argues that despite its strength, the moral case for open borders should be rejected and that while broadly tolerant of different life styles, the state should enforce core liberal values. Examining closely the policies and practices of various European states, Farer draws on their experience, contrasts it with that of the United States, and provides a detailed strategy for addressing the issues of who should be allowed to enter, how migrant families should be integrated and cultural conflicts resolved. This remarkable elaboration of a liberal position on migration and integration to which moderate conservatives could adhere combines powerful analysis with passionate advocacy.

Abstract: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels. In this work, we do of course build on earlier discussions and investigations of solidarity"--

Abstract: "Why should we care about religious liberty? Leading commentators, United Kingdom courts, and the European Court of Human Rights have de-emphasised the special importance of religious liberty. They frequently contend it falls within a more general concern for personal autonomy. In this liberal egalitarian account, religious liberty claims are often rejected when faced with competing individual interests - the neutral secular state must protect us against the liberty-constraining acts of religions. Joel Harrison challenges this account. He argues that it is rooted in a theologically derived narrative of secularisation: rather than being neutral, it rests on a specific construction of 'secular' and 'religious' spheres. This challenge makes space for an alternative theological, political, and legal vision. Drawing from Christian thought, from St Augustine to John Milbank, Harrison develops a post-liberal focus on association. Religious liberty, he argues, facilitates creating communities seeking solidarity, fraternity, and charity - goals that are central to our common good"--

Abstract: The New Feminist Literary Studies presents sixteen essays by leading and emerging scholars that examine contemporary feminism and the most pressing issues of today. The book is divided into three sections. This first section , 'Frontiers', contains essays on issues and phenomena that may be considered, if not new, then newly and sometimes uneasily prominent in the public eye: transfeminism, the sexual violence highlighted by #MeToo, Black motherhood, migration, sex worker rights, and celebrity feminism. Essays in the second section, 'Fields', specifically intervene into long-constituted or relatively new academic fields and areas of theory: disability studies, eco-theory, queer studies, and Marxist feminism. Finally, the third section, 'Forms', is dedicated to literary genres and tackles novels of domesticity, feminist dystopias, young adult fiction, feminist manuals and manifestos, memoir, and poetry. Together these essays provide new interventions into the thinking and theorising of contemporary feminism.

Abstract: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market. Professor Sonu Bedi argues that private racism is wrong, enlarging the boundary of justice in a way that is also consistent with our Constitution. A more just society is one that seeks to address rather than ignore this less visible form of racism

Abstract: "The metaphor of 'dialogue' has been used to describe and evaluate institutional interactions and constitutional arrangements involving many of the most fundamental questions concerning democracy and rights. It has been put to a variety of descriptive and evaluative uses by constitutional and political theorists concerned with understanding interactions between democratic institutions, particularly interactions concerning rights. But it has also featured prominently in the opinions of courts, and even the rhetoric and deliberations of legislators. This volume brings together many of the world's leading constitutional and political theorists -both proponents and critics of dialogue theory. Together, they debate the nature and merits of constitutional dialogues between the judicial, legislative, and executive branches, explore dialogue's democratic and republican significance, examine its relevance to the functioning and design of different constitutional institutions, examine rights dialogues in specific constitutional contexts and cases of dialogue concerning certain rights, and explore constitutional dialogues from an international and transnational perspective".

Abstract: The expectation of reciprocity continues to be an important factor when states' consider their legal obligations in armed conflicts. In this monograph, Peeler looks at the text and negotiations around the 1949 Geneva Conventions and the Protocols Additional to the Geneva Conventions from 1977 to demonstrate the many places where international humanitarian law maintains expectations of reciprocity. This complements an examination of US policy regarding its Prisoner of War obligations in both the Vietnam War and the Global War on Terror, demonstrating how states make use of the expectation of reciprocity found in international humanitarian law to respond to continued non-compliance by an enemy.

Comparing constitutions allows us to consider the similarities and differences in forms of government, and the normative philosophies behind constitutional choices. Abstract: "The topic of awareness and control is an elephant in the room in sociolinguistic research. To what extent are speakers aware of sociolinguistic variables? Are there different types or levels of awareness? Is 'control' of these variables a conscious or unconscious process, or is it some combination of the two? Are the variables we are aware of necessarily those we control, and vice versa? The extent to which speakers are aware of sociolinguistic information and use it strategically may drastically affect our understanding of the role that sociolinguistic cues play in the development of structural categories. This volume constitutes the first concerted effort to understand the nature of awareness and control using all the methodological and theoretical tools at our disposal. The contributors employ a variety of perspectives to address the relationship between awareness and control in sociolinguistic research"...

Abstract: How did Britons understand their relationship with the East in the late eighteenth and early nineteenth centuries? James Watt's new study remaps the literary history of British Orientalisms between 1759, the 'year of victories' in the Seven Years' War, and 1835, when T. B. Macaulay published his polemical 'Minute on Indian Education'. It explores the impact of the war on Britons' cultural horizons, and the different and shifting ways in which Britons conceived of themselves and their nation as 'open' to the East across this period. Considering the emergence of new forms and styles of writing in the context of an age of empire and revolution, Watt examines how the familiar 'Eastern' fictions of the past were adapted, reworked, and reacted against. In doing so he illuminates the larger cultural conflict which animated a nation debating with itself about its place in the world and relation to its others
