    Abstract: Zur Bewältigung von Organisierter (Drogen)Kriminalität finden zeitlich und finanziell aufwändige, meist verdeckte Ermittlungen gegen eine Vielzahl von Akteuren statt. Um diese Hintergrundermittlungen nicht vorzeitig aufzudecken, wird die sog. ›Legendierte Kontrolle‹ eingesetzt, bei der die Ermittlungsbehörden eine Durchsuchung als allgemeine Verkehrskontrolle tarnen. Die Arbeit ordnet das Instrument in das bestehende System verdeckter und täuschender Ermittlungsmaßnahmen ein. Sie analysiert die verfassungs- und strafverfahrensrechtliche Zulässigkeit des staatlichen Vorgehens, das sich im Grenzbereich zwischen Gefahrenabwehr und Strafverfolgung bewegt. Ein besonderer Schwerpunkt liegt auf der Frage, ob entgegen dem Grundsatz der Aktenwahrheit eine legendierte, also unzutreffende oder unvollständige Aktenführung erlaubt sein kann. Hier werden die Grenzen der staatlichen Täuschungsbefugnis – trotz der Maxime einer effektiven Strafverfolgung – gegenüber Beschuldigten herausgearbeitet

The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Abstract: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Abstract: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO). This book will appeal to academics researching the intersection of intellectual property and the life sciences, civil society activists working to promote access to medicines, and students (particularly those at the post-graduate level) studying the relationship between intellectual property and medicine.

    Abstract: This book offers an introduction to the language of law from the perspective of logical semantics. As a logical tool, Boguslaw Wolniewicz’s formal ontology of situations is adapted. The central issue addressed is the meaning of normative statements, primarily legal norms. The main outcome of the book consists in explications of several legal notions (including legal events, legal acts and legal rules) in terms of the formal ontology of situations. In addition, the book concludes that legal norms are sentences in a logical sense, so some are true, while others are false, and that their logical value does not depend on whether or not they were adopted in the law-making process. Lastly, the book contends that there are semantic relations between orders that are similar to entailment, contradiction, opposition, and sub-opposition, despite the fact that orders are not sentences in a logical sense, i.e., they are neither true nor false. The book also presents some original Wittgenstein-style deontic logics built on the first order logic. The formal results are applied to selected problems in the theory of law, including the problem of the possibility of algorithmic application of legal norms.

    Abstract: The rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions.     Abstract: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Abstract: Wenigen anderen Ethnologen in der Bundesrepublik Deutschland war es vergönnt, so wie Rüdiger Schott durch eigene Aktivitäten als individuelle Forscherpersönlichkeit maßgebend zum Aufbau und Ausbau ihrer Disziplin beizutragen. Dieser Umstand verdankt sich einerseits den von ihm seit den 60er Jahren durchgeführten Feldforschungen bei den Bulsa in Nordghana und den in den 80er Jahren angestellten ethnographischen Erhebungen bei den Lyela in Burkina Faso (vormals: Obervolta), die ihm internationale Reputation und hohe wissenschaftliche Anerkennung eingetragen haben, andererseits der permanenten Umsetzung der erreichten Forschungsergebnisse in die akademische Lehre und in weitere Forschungen, die heute als beispielhaft gelten.
    Abstract: Nicht von ungefähr gehört das Seminar für Völkerkunde der Universität Münster, das von Rüdiger Schott begründet wurde und im April 1990 auf sein 25jähriges Bestehen zurückblicken konnte, gegenwärtig zu den auch im Ausland wohlbekannten deutschen Forschungsstätten seines Fachgebiets. Dies ist nicht zuletzt deswegen der Fall, weil Schott von Anbeginn seine ethnologischen Forschungen in ständigem Austausch mit einer Reihe benachbarter Disziplinen, insbesondere mit den sozialen Handlungswissenschaften betrieben hat, wie beispielsweise mit den Wirtschaftswissenschaften und der Soziologie, der Rechtswissenschaft und den Religionswissenschaften.
    Abstract: Seine Befähigung und bis auf den heutigen Tag praktizierte Bereitschaft zur Kooperation mit diesen Nachbardisziplinen basiert auf der Einsicht, daß die Ethnologie ihre eigene Identität nur gewinnen und fortentwickeln kann, wenn sie sich auch auf der Ebene der Ausbildung ihrer analytischen Denkansätze und Grundbegriffe hierfür hinreichend kontaktfähig hält. Was Person, Leben und Werk von Rüdiger Schott angeht, so sind die äußeren Rahmendaten seines bisherigen Forscher- und Universitätslebens rasch berichtet. Jedoch wird eine auf die Forschungsinhalte und die erzielten Ergebnisse gerichtete Analyse den von ihm vorgelegten Resultaten kaum gerecht, wenn sie sich nur auf deren Relevanz für die Ethnologie als solche beschränken wollte.

    Abstract: This book ties restorative justice into the exercise of patriarchal power. It is focused on the individual narratives of 15 girls and young women who have participated in a victim-offender restorative justice (RJ) conference and the perspectives of youth justice practitioners. Gender, Power and Restorative Justice expands feminist engagement with RJ by focusing critical attention on the importance of the social construction of gender, the exercise of power, shame, stigma, muting and resistance to girls’ experiences of RJ conferencing. Drawing upon recent developments to the sociology of stigma and feminist perspectives on shame, the book contends that RJ conferencing can produce harmful implications for girls and young women who participate. Ultimately it is argued that anti-carceral, social policy alternatives, underpinned by feminist praxis, should replace a youth justice jurisprudence for girls. This book will be of particular use and interest to those studying modules on criminology, youth justice, criminal justice and social work courses. Jodie Hodgson is a lecturer in Criminology at Manchester Metropolitan University, UK. Jodie has previously worked as a lecturer at Leeds Beckett University and the University of Liverpool.     Abstract: This book provides the student, researcher or practitioner with the tools to understand many of the most commonly used advanced statistical analysis tools in criminology and criminal justice, and also to apply them to research problems. The volume is structured around two main topics, giving the user flexibility to find what they need quickly. The first is “the general linear model” which is the main analytic approach used to understand what influences outcomes in crime and justice. It presents a series of approaches from OLS multivariate regression, through logistic regression and multi-nomial regression, hierarchical regression, to count regression. The volume also examines alternative methods for estimating unbiased outcomes that are becoming more common in criminology and criminal justice, including analyses of randomized experiments and propensity score matching. It also examines the problem of statistical power, and how it can be used to better design studies. Finally, it discusses meta analysis, which is used to summarize studies; and geographic statistical analysis, which allows us to take into account the ways in which geographies may influence our statistical conclusions.

    Abstract: Legisprudence considers a variety of perspectives and relies on contributions from numerous different disciplines. Rather than providing examples of the various possible approaches to legisprudential studies, this book – bringing together lawyers and legal theorists from seven different countries – highlights two aspects of the many disciplines involved. Firstly, it discusses theoretical abstraction, which borders on, or enters into the realm of full-fledged philosophical speculation. Secondly, it examines empirical observation of specific cases, precisely situated regarding their spatial or historical collocation, or referring to a particular species of legislative policy. Focusing on legislation both as a process and as a result, the aim of the book is twofold: on the one hand, it demonstrates that, far from being a purely theoretical and exclusively academic intellectual enterprise, legisprudence can offer criteria for both assessing and improving the quality of real-world legislation. On the other hand, it shows how lawmaking is at least as interesting and legitimate a field of inquiry as adjudication and interpretation of laws for legal theorists and philosophers of law, and that they are already equipped with extremely valuable intellectual tools for fruitful legisprudential inquiry. The book is organized in two parts. The first part comprises legal-theoretical accounts on general aspects of legislation as a process and as a result. The second part presents contributions focusing on specific experiences of evaluations of legislative quality and contributions to the legislature’s work on the part of the public, as well as on particular legislative policies, methodologies in lawmaking, and problems regarding legislation as an instrument.

Das Ziel des Buchs ist es, ein neues Narrativ in die Geschichte des Kulturgüterschutzes einzuführen. Das dominante Fortschrittsnarrativ soll durch eine kritische Genealogie des Völkerrechts ersetzt werden, welche die hegemonialen Strukturen der Vergangenheit und Gegenwart aufdeckt. Sebastian M.     Abstract: This book analyses the development of the norms of protecting cultural heritage from a postcolonial perspective. In contrast to the traditional historiography of ‘culture’ in international law, it reveals how the highly problematic and Eurocentric ‘standard of civilisation’ in the 19th and 20th centuries served as a driving force for the formation of cultural heritage protection norms. Various actors used the law in different ways to take part in this discourse on ‘civilisation’. The aim of this book is to lay down a new narrative on the history of the protection of world cultural heritage. It endeavours to replace the inherent politics of the dominant narrative on progress with a critical genealogy which reveals the long-lasting hegemonic structures of today’s international law. Sebastian M. Spitra is a research fellow at the Department of Legal and Constitutional History at the University of Vienna and a Grotius fellow at the University of Michigan Law School.

    Abstract: This book maps various national legal responses to gender mobility, including sex and name registration, access to gender modification interventions, and anti-discrimination protection (or lack thereof) and regulations. The importance of the underlying legislation and history is underlined in order to understand the law’s functions concerning discrimination, exclusion, and violence, as well as the problematic nature of introducing biology into the regulation of human relations, and using it to justify pain and suffering.     Abstract: This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book. In closing, the use of satellite data for legal purposes is not without its fair share of problems and concerns, which are also considered to guide the evolution of this emerging field.
