Les régulateurs des industries d’équipements collectifs publics se heurtent à un problème crucial : la réglementation des termes et conditions dans lesquels des entreprises en concurrence ont accès à des intrants clés fournis par des concurrents. Le développement de la concurrence et le succès de la libéralisation dépendent souvent des termes de l’accès et des conditions choisies, aussi les pouvoirs publics sont-ils soucieux de faire le bon choix. Préparé par le comité de la concurrence de l’OCDE, ce rapport traite du secteur des télécommunications et cherche à approfondir la compréhension de la réglementation de l’accès. Les problèmes d’accès ne sont pas des plus faciles pour les autorités de tutelle et les responsables de la politique de la concurrence : ils peuvent en effet être techniquement délicats et donner lieu à des polémiques retentissantes sur le plan pratique. En abordant la question sous ces deux angles, ce rapport cherche à aider les autorités de tutelle et les pouvoirs publics à tirer les leçons de l’expérience de l’OCDE pour obtenir des résultats efficients et compétitifs.

Buena parte del interés de política por fomentar la iniciativa empresarial se refleja en la convicción de que la creación de nuevas empresas contribuirá a facilitar el logro de importantes objetivos económicos y sociales. El aumento en el ritmo de creación de empresas es hoy una inquietud casi universal para las autoridades locales, al igual que para los gobiernos centrales que desean combatir la marginación económica local. Sin embargo, a pesar del amplio interés de política, pocos estudios han analizado sistemáticamente la relación entre la creación de nuevas empresas y el desarrollo económico local. Esta publicación analiza las principales rutas a través de las cuales la creación de empresas y su desarrollo puede tener un impacto sobre las economías locales. Así, se analiza la evidencia empírica acerca de la relación entre la iniciativa empresarial y las economías locales. Asimismo, se demuestra que aunque la creación de empresas puede resultar un componente crucial para el desarrollo económico local, el fomento de la iniciativa empresarial no constituye una panacea para el desarrollo. Por ello, se discuten a profundidad una serie de limitaciones potenciales de las estrategias orientadas hacia la iniciativa empresarial y cómo estas limitaciones pueden contrarrestarse. Este libro presenta detalladas recomendaciones de política tanto en el ámbito gubernamental local como nacional. Las recomendaciones se relacionan con tres ámbitos temáticos: estrategia, financiamiento y diseño de programas. Se espera que estos lineamientos sean de utilidad para los gobiernos centrales y locales en el diseño y la puesta en marcha de programas y estrategias eficaces en términos de costos. En este sentido, la presente publicación describe los tipos de investigación que deben llevarse a cabo para lograr un mejor entendimiento de los temas clave de política.

The regulation of the terms and conditions under which competing firms have access to essential inputs provided by rivals has become the single biggest issue facing regulators of public utility industries. Development of competition and the success of liberalisation often depend on the access terms and conditions chosen, and public policy interest in getting these terms and conditions right is important. Prepared by the OECD’s Competition Committee, this report focuses on the telecommunications industry and seeks to deepen the understanding of access regulation. Access issues are not easy issues for regulators and competition policy-makers - they can be both difficult technically and the source of noisy disputes in practice. By bringing together theory and practice, this report seeks to help regulators and policy-makers learn from OECD experience to achieve efficient and competitive outcomes.

Quelles sont les contraintes pour parvenir à des réseaux logistiques efficaces et respectueux de l’environnement ? Le projet TRILOG de l’OCDE vise à fournir une perspective sur ces questions clés grâce à l’échange d’approches et d’expériences relatives à la logistique du transport de marchandises en Asie-Pacifique, en Europe et en Amérique du Nord. Ce rapport cherche à identifier les contraintes et à analyser les problèmes communs aux trois régions. Il propose des solutions et des approches susceptibles de faciliter le développement de politiques visant à promouvoir une logistique efficace et durable au niveau international.

This year’s edition also includes data on the activity of affiliates of national firms abroad (outward investment). Volume I provides data for the manufacturing sector covering 18 variables including production, employment, investment, research and trade. Part I presents the main findings and highlights trends for each of the variables displayed by foreign multinationals and domestic firms in total manufacturing industry, leading sectors as well as a detailed geographical breakdown. Part II provides basic data and shows the share of each sector controlled by foreign multinationals for the available industrial variables. Data sources and definitions are also provided. Published for the first time, Volume II presents data for services. Five variables are covered: employment, turnover, value added, exports and imports. These data provide a measure of the impact of foreign direct investment on the economies of the OECD countries. From this standpoint, they provide a vital backup for data on direct investment flows.

    Abstract: Governments are significant purchasers of goods and services and these markets represent huge opportunities for international trade. This document presents a synthesis of the analytical studies on the quantification of the size of government procurement markets and proposes a series of estimates of procurement markets for over 130 individual countries. The world total government procurement is estimated to amount to $5550 billion in 1998, which is equivalent to 82.3% of the world merchandise and commercial services exports in 1998. The world value of government procurement that is potentially opened up to international trade is estimated at $2083 billion, which is equivalent to 7.1% of the world Gross Domestic Product (GDP) or 30.1% of the world merchandise and commercial services exports. Detailed estimates of government procurement markets are proposed for OECD countries, including estimates of procurement broken down by government levels, types of expenditure (consumption versus investment) and contestable shares. Informed knowledge about the size of government procurement markets and in particular the shares of national markets that are potentially opened up to intenational competition is relevant for the business community, government and trade negotiators.

    Abstract: Tradeable or transferable permits (TPs) are increasingly perceived as a cost-effective and flexible policy instrument for pollution control and natural resources management. Initially they were considered a policy tool whose applications were limited to only certain sectors, such as air pollution management and fisheries. However, over the last few years, there have been significant developments in the use of domestic TPs, across a broader range of environmental issues. TPs now face a double challenge: could they become a key instrument for curbing greenhouse gas emissions in light of the Kyoto Protocol? And could they be used in other areas of environmental management? This book presents the proceedings of an OECD workshop on domestic TPs held in September 2001 in Paris. It provides an analysis on recent developments in the use of domestic TP in new areas including climate change, renewable energy, transport, solid waste management, and water resources management. It highlights issues regarding the use of TPs in policy mixes, reviews key elements of ex post evaluations of earlier TP schemes, identifies key challenges in the design and use of TP systems, and attempts to link the past lessons to further research needs.

    Abstract: Globalisation and advances in information and communication technologies are reshaping the world’s trading patterns. Cette édition de poche des Principes de l'OCDE applicables en matière de prix de transfert contient la version intégrale des principes en matière de prix de transfert adoptée par les pays membres à l’usage des entreprises multinationales qui transfèrent des biens ou des services d’un pays à l’autre ou au sein d’un seul et même groupe d’entreprises. Ils réaffirment qu’un traitement de pleine concurrence doit être appliqué aux entreprises faisant partie d’un groupe multinational et que pour ce faire, les méthodes transactionnelles traditionnelles doivent être privilégiées. Ces questions controversées n’intéressent pas uniquement les spécialistes de la fiscalité. De fait, les administrations fiscales, les contribuables et les chefs d’entreprises ont tous un rôle à jouer pour éviter la coexistence de règles fiscales contradictoires qui risqueraient d’entraver sérieusement le développement des échanges mondiaux. Les Principes ont été également publiés en classeurs.

    Abstract: Services are the driving force in OECD economies, accounting for at least 70% of GNP in many countries. However, their potential contribution is hampered by government policies that were designed for manufacturing industries. This report shows that policies can be adapted to stimulate innovation and boost productivity in service sectors, with economy-wide benefits for employment and growth. Crucial in this regard are policies aimed at promoting the development of human capital/resources and stimulating competition in services within and between countries. Further regulatory reform is essential to achieve these goals. Governments must explore ways to strengthen the interface between innovative services and traditional industry sectors.

Ces données montrent comment les petites et moyennes entreprises perçoivent le coût de l’administration et de la réglementation nationales. La réglementation et les formalités administratives, ce qu'on appelle la "paperasserie", sont d’importants outils dont se servent les autorités publiques pour conduire leur action dans de nombreux domaines, notamment la sécurité, la santé et la protection de l’environnement. Toutefois, si elles sont mal conçues ou mal appliquées, inefficaces ou dépassées, elles peuvent entraver l’innovation, l’accès au marché, l’investissement, et créer des obstacles inutiles aux échanges et à l’efficacité économique. Une réglementation et des formalités administratives de piètre qualité ont un coût pour les économies nationales : la capacité de croissance de ces dernières, leur compétitivité, leur capacité d’adaptation et leur aptitude à créer des emplois peuvent en pâtir. Ce rapport s'appuie sur les résultats d’une enquête menée auprès de 8 000 entreprises, il fait le point sur la qualité, la mise en œuvre et le poids de la réglementation et des formalités administratives dans les domaines de l’emploi, de l’environnement et de la fiscalité. Les résultats sont inquiétants. Un exemple : la « paperasserie » absorbe 4 % du chiffre d’affaires annuel des entreprises (ce sont les plus petites qui sont le plus durement frappées) et ce coût augmente dans la plupart des pays.

    Abstract: Entre 1980 et 1997, le volume de résidus urbains par habitant a augmenté de 22 % tandis qu’il devenait de plus en plus difficile de trouver des sites pour implanter des installations d’élimination des déchets. Si, au cours des dernières décennies, d’importants progrès ont été accomplis en matière de réduction du volume de pollution de l’eau et de l’air produit par habitant, la production de déchets continue d’augmenter. Face à cet accroissement, de nombreux gouvernements ont passé en revue les différents moyens d’action dont ils disposent. Ils en ont conclu qu’imputer au producteur la responsabilité de contribuer ou de pourvoir à l’élimination de ses déchets pouvait permettre d'atténuer certaines des contraintes que ces derniers exercent sur l’environnement (après consommation du produit qu’ils accompagnent). La « responsabilité élargie des producteurs » (REP) est une stratégie en vertu de laquelle les producteurs acceptent d’assumer une responsabilité importante - d’ordre financier et/ou matériel - en ce qui concerne le traitement des déchets d’emballage. La prise en charge de cette responsabilité pourrait inciter à prévenir la production de déchets à la source, promouvoir la conception de produits dans le souci du respect de l’environnement, et contribuer à atteindre les objectifs publics de recyclage et de gestion des matériaux. Au sein de l’OCDE, la tendance est à l’élargissement de la REP à de nouveaux produits, groupes de produits et flux de déchets tels que les appareillages électriques et électroniques. Ce manuel d’orientation constitue un moyen d’informer les gouvernements des avantages et des coûts potentiels liés à la REP.

La première question est relative à l’intensité du caractère conjoint des produits multiples au niveau de la production. La seconde identifie les circonstances dans lesquelles intervient une défaillance du marché. Une troisième question conduit à examiner les caractéristiques des produits en question en tant que biens d’intérêt public et permet de mieux définir le type d’intervention le plus approprié. Ces interventions peuvent aller de la création d’un marché à l’imposition de charges d’utilisation, en passant par la constitution de clubs ou l’approvisionnement public financé au niveau local, régional ou national. La politique la plus efficace est définie par l’intensité du caractère conjoint des produits du côté de l’offre et par leurs caractéristiques du côté de la demande, l’ensemble des coûts et bénéfices étant considérés.

    Abstract: The term multifunctionality is increasingly used, but is prone to different interpretations concerning its definition, its utility and its implications for policy at domestic and international level. The OECD undertook this analysis to clarify the concept of multifunctionality and to try to establish a common analytical framework and terminology. Examining production, externality and public good aspects of multifunctionality, the analysis contained in this report leads to a series of questions, the answers to which determine if and when policy intervention is warranted and what the nature of that intervention should be. The framework encompasses both negative and positive externalities of agriculture. The first question relates to the degree of jointness in production between the multiple outputs. The second question identifies the circumstances in which market failure arises. A third question leads to an investigation of the public good characteristics of the outputs in question and helps to define the optimal type of intervention. These may range from market creation, to the imposition of user fees, the formation of clubs or public provision financed at local, regional or national level. The most efficient policy option is defined by the nature of jointness on the supply side and by the characteristics of the output on the demand side, all costs and benefits being taken into account.

    Abstract: Municipal waste has increased 22 % per capita from 1980 to 1997. At the same time, the difficulty of siting new waste disposal facilities has increased. While major progress has been made to lessen the per capita generation of air and water pollution over the past decades, waste generation is still on the rise. Faced with the increase of waste, many governments have reviewed available policy options and concluded that placing the responsibility for the post-consumer phase of certain goods on producers could provide a means to relieve certain environmental pressures, arising from post-consumer waste. Extended Producer Responsibility (EPR) is a policy approach under which producers accept significant responsibility - financial and/or physical - for the treatment or disposal of post-consumer products. Assigning such responsibility could provide incentives to prevent wastes at the source, promote product design for the environment and support the achievement of public recycling and materials management goals. Within the OECD the trend is towards the extension of EPR to new products, product groups and waste streams such as electrical appliances and electronics. This guidance manual represents one means to inform national governments about the potential benefits and costs associated with EPR.

    Abstract: Businesses’ Views on Red Tape provides the first opportunity to systematically compare data across 11 OECD countries. The data show how small and medium-sized enterprises perceive national administrative and regulatory costs. Regulations and government formalities, so-called "red tape", are important tools used by governments to carry out public policies in many policy areas, including safety, health, and environmental protection. However, if they are poorly designed or applied, inefficient, or outdated, they can impede innovation, entry, investment, and create unnecessary barriers to trade, investment, and economic efficiency. The result of poor regulation and formalities is that national economies become less able to grow, compete, adjust, and create jobs. Based on a survey of almost 8 000 businesses, this report assesses the quality, application and burdens of employment, environment and tax regulations and formalities. The results are dramatic: for example, red tape accounts for 4% of the annual turnover of companies, while the hardest hit are the smallest companies, and these costs are growing in most countries.

    Abstract: The OECD Joint Group on Trade and Competition was established in 1996 to help deepen understanding of the complex issues arising at the interface of these two policy domains against a globalising backdrop and explore how best to ensure that both sets of policies are mutually supportive in promoting greater economic efficiency. This publication, the third to arise from Joint Group activities, brings together a series of working papers that Member countries’ trade and competition authorities have considered during the past two years. The objective of the publication is to share with a broader audience the tangible progress made recently by the two communities in the analysis of important issues at the interface between trade and competition policies.

    Abstract: Tourism plays an increasingly important role in many OECD economies. How can its impact on the economy and its potential for job creation be measured? The Tourism Satellite Account and the Employment Module - two new economic instruments designed by the OECD’s Tourism Committee - provide insights into the socio-economic impact, structure and development of activities related to tourism. For the first time, Measuring the Role of Tourism in OECD Economies: The OECD Manual on Tourism Satellite Accounts and Employment reports on the most recent national experiences in implementing Tourism Satellite Accounts and presents the results of efforts made over the past decade to develop new methods to analyse tourism and tourism-related employment. Through its descriptions of the application of Tourism Satellite Accounts in 16 OECD countries, this new book aims to create awareness of the growing economic importance of tourism, and provides a methodology for the implementation of tools to measure the impact of tourism and for the interpretation of the results.

    Abstract: The taxation of professional services and other activities of an independent character under Article 14 of the OECD Model Tax Convention is problematic. For example, what activities and entities fall within Article 14 as opposed to the business profits Article (Article 7)? Is the distinction between those activities and entities satisfactory and easy to apply? What are the practical differences between taxation under Article 7 and 14? This report analyses those questions in detail and concludes that there is no practical difference between the two Articles or if any differences did in fact exist, there is no valid policy justification for them. It recommends that Article 14 be eliminated from the Model and describes the changes that would need to be made to the Articles and Commentary of the Model as a consequence.

Neue Institutionen werden gebraucht, um die internationalen Regeln und Rahmenbedingungen zu schaffen, die den Übergang zur wissensbasierten Gesellschaft erleichtern.     Abstract: Services are transforming OECD economies on a massive scale, but are still impeded by regulations and policies that stifle innovation and competition. Comprehensive reforms need to be pursued internationally as well as in individual OECD countries. These are the principal conclusions reached by participants in a Business and Industry Policy Forum organised by the OECD on 28 September 1999. The Forum was organised by the Industry Committee, partly to address the mandate of the OECD Ministerial to explain the differences which have emerged in growth performance among OECD countries. It brought together senior government officials, experts, and business and trade union leaders from 30 countries to address issues related to “Realising the Potential of the Service Economy: Facilitating Growth, Innovation and Competition”.
