    Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

    Abstract: "This book draws attention to the various factors that characterise migrant flows and mobilities, calling into question familiar concepts such as push and pull, migration as a life project and socio-cultural integration. It highlights processes such as flexible migrant routes, temporary and return migration, mental aspects of migration processes and transnationalism. Organised around the themes of shaping trajectories, frictions in space, and the migrant mental framework, - it brings together work from scholars from Europe and beyond. The book suggests a different understanding of migration and mobility as relational, non-linear, and fluid social processes, characterised by instability in migrant life trajectories. Emphasising the flexibility of migrants and migration and advocating the importance of emotionally charged, individual perceptions as central to migrant decision-making, it will appeal to scholars of sociology, anthropology, politics and geography with interests in migration and diaspora studies. The contributions collected here put emphasis the social and mental processes that underpin the migratory process, which can be seen as the "soft-side" of migration. Too often, this side is neglected when the governance of migration is discussed. The novel ideas expressed here also help to overcome the mechanistic view of migration as a 'push-pull' event"...

    Abstract: "This volume contains a collection of papers presented at the twenty-second British Legal History Conference held at the University of Reading. The conference coincided with the 800th anniversary of Magna Carta; the conference was thus concerned not only with Magna Carta itself but also with its enduring legacy. The theme around which this legacy is explored is that of challenges to authority and how these challenges result in the recognition of rights. Magna Carta now occupies a quasi-mythical status - particularly within common law jurisdictions - as an instrument which gave people liberty. Lord Denning described it as 'the greatest constitutional document of all times... the spirit of individual liberty which has influenced our people ever since'. Such a description omits the struggle which gave rise to these rights"--

    Abstract: Junge und minderjährige Geflüchtete sind spätestens seit 2015 eine nicht mehr aus der Kinder- und Jugendhilfe wegzudenkende Zielgruppe. Im Fokus der Veranstaltung stand deshalb drei Jahre "nach dem Ankommen" die Perspektivplanung in der Arbeit mit jungen Flüchtlingen - dies im Hinblick auf die Hilfeplanung insgesamt, mögliche Hilfeformen auch nach dem 18. Lebensjahr sowie die Zukunftsperspektiven und die Verselbstständigung der jungen Geflüchteten. Ein Schwerpunkt der Veranstaltung lag auf der Frage nach dem Ist-Stand und den Perspektiven der kommunalen Integration junger Geflüchteter in der Praxis. Welches sind in diesem Zusammenhang die dringendsten Aufgaben? Und welche Herausforderungen sind damit fachlich, infrastrukturell und personell für die Kinder- und Jugendhilfe verbunden?

Es präsentiert die Impulse europäischer Instanzen und die Antworten verschiedener europäischer Staaten auf die Herausforderung, Flexibilisierung der Beschäftigung und Modernisierung der Sozialschutzsysteme in Einklang zu bringen. Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities. One of the concerns is ensuring that everybody may participate in gainful activities during his or her life course while also guaranteeing social rights through adequate social protection. By means of legal, socio-political and empirical analyses this book embarks on the interrelationship of different social protection mechanisms and the resulting difficulties of adapting to these new employment patterns. It presents European impulses and the reactions of several European states to the challenge of reconciling flexibility of employment and modernisation of social protection.     Abstract: Das Thema Asyl ist in den Medien allgegenwärtig. Seit die Flüchtlingszahlen 2015 dramatisch gestiegen sind, stehen einerseits Forderungen nach einer Aufnahmebegrenzung und andererseits die Position, dass es keine Obergrenze beim Recht auf eine individuelle Prüfung des Asylanspruchs geben könne, im politischen Raum gegeneinander. Dabei besteht in der Öffentlichkeit wenig Klarheit darüber, wozu eigentlich das Grundgesetz und dessen Artikel 16a, die Genfer Flüchtlingskonvention und europäische Regelungen die Bundesrepublik verpflichten. Auch bezüglich des tatsächlichen Zusammenhangs zwischen Asylrecht und Zuwanderung besteht Informationsbedarf. Diesen Fragen gehen die Beitragsautorinnen und -autoren in diesem Sammelband nach. Die hierbei gewonnenen Erkenntnisse und Ergebnisse reflektieren das Themenfeld Asyl aus juristischer, politikwissenschaftlicher und praktischer Perspektive. Quelle: Verlag.

It is one of the effects of an increasingly globalized world, where capitalism and free trade are gaining prominence. Migration in East and Southeast Asia aims to bring migration-related problems in Asia to the forefront. The first part of the book deals with migration in Greater China, a region influenced by Confucianism. The "three Chinas" used to have a close connection in the past, and presently share much similarity. The Hong Kongese and Taiwanese societies are based on migration from Mainland China. However, each society has endured significant social, economic, and political changes. The second part of the book offers a closer look at migration flows in Southeast Asia. Most of the intra-ASEAN migration involves low-skilled labor for construction, agriculture, and domestic work"--

Each of these country reports contains a historical perspective on the evolution of domestic rules regarding custody and guardianship, and on the introduction and development of the notion of the best interests of the child.     Abstract: Migration war immer ein wichtiger Aspekt der Geschichte der europäischen Integration. Die bestehende Literatur hat dieses Thema hauptsächlich von einer nationalen und sozioökonomischen Perspektive betrachtet. Dieses Buch jedoch integriert solche fragmentierten Analysen, betrachtet sie aus einem weiteren Blickwinkel und ordnet sie im breiteren Zusammenhang des sozialen und demografischen Wandels Europas sowie der politischen und wirtschaftlichen Geschichte der europäischen Integration ein.Das Buch untersucht die Auswirkungen der EU-Migrationspolitik auf die politischen und wirtschaftlichen Außenbeziehungen Europas und erkennt die Migration aus osteuropäischen Ländern vor 1989 als Teil der europäischen Integration an.Indem das Buch zeigt, dass die Migrationspolitik und ihr Einfluss auf europäische Gesellschaften nur im Zusammenhang der EU-Rahmenbedingungen vollständig verstanden werden können, trägt es wesentlich zur Migrationsforschung im Allgemeinen bei.Mit Beiträgen von:Giulia Bentivoglio, Marcel Berlinghoff, Cristina Blanco Sío-López, Elena Calandri, Alice Cunha, Yves Denéchère, Pawel Jaworski, Slawomir Lukasiewicz, Willem Maas, Guia Migani, Simone Paoli, Dimitris Parsanoglou, Yvette Santos, Beatrice Scutaru, Jacek Tebinka, Moshik Temkin, Giota Tourgeli und Roberto Ventresca.
    Abstract: Movement of people has been a key feature in the whole history of European integration. While existing literature has mostly adopted national viewpoints and a socioeconomic perspective, this book integrates these existing fragmented analyses, views them from a broader perspective and places them in the wider context of the social and demographic transformation of Europe and the political and economic narrative of continental integration. It highlights the impact made by EC/EU immigration policies on the external political and economic relations of Europe and acknowledges that pre-1989 migration from East European countries is part of European integration. By showing that migration policies and their impact on European national societies and economies cannot be fully understood without taking into account the EC framework, this book, therefore, contributes to migration studies as a whole.

    Abstract: Legal studies and consequently legal history focus on constitutional documents, believing in a nominalist autonomy of constitutional semantics.Reconsidering Constitutional Formation in the late 18th and 19th century, kept historic constitutions from being simply log-books for political experts through a functional approach to the interdependencies between constitution and public discourse. Sovereignty had to be ‘believed’ by the subjects and the political élites. Such a communicative orientation of constitutional processesbecame palpable in the ‘religious’ affinities of the constitutional preambles. They were held as ‘creeds’ of a new order, not only due to their occasional recourse to divine authority, but rather due to the claim for eternal validity contexts of constitutional guarantees. The communication dependency of constitutions was of less concern in terms of the preamble than the constituents’ big worries about government organisation. Their indecisiveness between monarchical and popular sovereignty was established through the discrediting of the Republic in the Jacobean reign of terror and the ‘renaissance’ of the monarchy in the military resistance against the French revolutionary and later Napoleonic campaigns. The constitutional formation as a legal act of constituting could therefore defend the monarchy from the threat of the people (Albertine Statute 1848), could be a legal decision of a national constituent assembly (Belgian Constitution 1831), could borrow from the old liberties (Polish May Constitution 1791) or try to remain in between by referring to the Nation as sovereign (French September Constitution 1791, Cádiz Constitution 1812). Common to all contexts is the use of national sovereignty as a legal starting point. The consequent differentiation between constituent and constituted power manages to justify the self-commitment of political power in legal terms. National sovereignty is the synonym for the juridification of sovereignty by means of the constitution. The novelty of the constitutions of the late 18th and 19th century is the normativity, the positivity of the constitutional law as one unified law, to be the measure for the legality of all other law.
