    Abstract: While past labour market reforms have been successful in terms of employment, the relative poverty risk and income inequality have remained broadly unchanged in recent years. Some social groups remain particularly vulnerable, including individuals in non-regular employment, the unemployed and the low skilled. If in employment, their jobs tend to be unstable and wages and income mobility low. Continued efforts are needed to foster economic growth in a more inclusive manner, such that the most vulnerable groups benefit from and contribute to economic growth more strongly and such that the gaps between the rich and the poor in terms of income and wellbeing are reduced. These efforts should include enhancing the labour market outcomes of the most vulnerable and increase upward income mobility among disadvantaged individuals; strengthening skills at the lower end of the skills distribution; revising the tax and benefit system to improve incentives and to ensure efficient and well-targeted redistribution; and to make health and old-age pension insurance more inclusive.     Abstract: This report contains the Phase 1 and Phase 2 Global Forum Peer Reviews for Germany, incorporating the Phase 2 ratings. The Global Forum on Transparency and Exchange of Information for Tax Purposes is the multilateral framework within which work in the area of tax transparency and exchange of information is carried out by 120 jurisdictions, which participate in the Global Forum on an equal footing. The Global Forum is charged with in-depth monitoring and peer review of the implementation of the international standards of transparency and exchange of information for tax purposes. These standards are primarily reflected in the 2002 OECD Model Agreement on Exchange of Information on Tax Matters and its commentary, and in Article 26 of the OECD Model Tax Convention on Income and on Capital and its commentary as updated in 2004. The standards have also been incorporated into the UN Model Tax Convention. The standards provide for international exchange on request of foreseeably relevant information for the administration or enforcement of the domestic tax laws of a requesting party. Fishing expeditions are not authorised but all foreseeably relevant information must be provided, including bank information and information held by fiduciaries, regardless of the existence of a domestic tax interest or the application of a dual criminality standard. All members of the Global Forum, as well as jurisdictions identified by the Global Forum as relevant to its work, are being reviewed. This process is undertaken in two phases. Phase 1 reviews assess the quality of a jurisdiction’s legal and regulatory framework for the exchange of information, while Phase 2 reviews look at the practical implementation of that framework. Some Global Forum members are undergoing combined – Phase 1 and Phase 2 – reviews. The Global Forum has also put in place a process for supplementary reports to follow-up on recommendations, as well as for the ongoing monitoring of jurisdictions following the conclusion of a review. The ultimate goal is to help jurisdictions to effectively implement the international standards of transparency and exchange of information for tax purposes. All review reports are published once approved by the Global Forum and they thus represent agreed Global Forum reports.

    Abstract: Die jüngsten Reformen haben Deutschland zu einem der OECD-Länder mit den geringsten Beschränkungen für die Zuwanderung von hochqualifizierten Fachkräften gemacht, die Zahl der Zuzüge ist jedoch nach wie vor relativ gering. Da die Arbeitsmigration als eine der Möglichkeiten zur Bewältigung des Arbeits- und Fachkräftemangels gilt, zu dem es infolge des Rückgangs der Bevölkerung im Erwerbsalter kommt, befasst sich diese Publikation mit der Frage, wie gewährleistet werden kann, dass dringendem Arbeitsmarktbedarf, der nicht mit inländischen Arbeitskräften zu decken ist, durch internationale Arbeitsmigration begegnet werden kann. Der Bericht untersucht wichtige Fragen in Bezug auf die Gestaltung des deutschen Systems der Arbeitsmigration, sowohl von der Nachfrage- als auch von der Angebotsseite her. Deutsche Arbeitgeber können alle Arbeitsplätze, für die ein Hochschulabschluss erforderlich ist, mit Arbeitskräften aus dem Ausland besetzen. Doch selbst Arbeitgeber, die über Fachkräftemangel klagen, haben dies bislang häufig nicht getan, z.T. weil sie auf gute deutsche Sprachkenntnisse und besondere Qualifikationen bestehen, z.T. aber auch weil sie die Verfahren der internationalen Personalanwerbung für komplex und unzuverlässig halten. Diese Verfahren könnten zwar transparenter gestaltet werden, ihr schlechter Ruf ist aber dennoch ungerechtfertigt. Internationale Studierende scheinen gut geeignet, den Anforderungen der Arbeitgeber gerecht zu werden, Deutschland könnte jedoch mehr unternehmen, um diesen Weg der Arbeitsmigration zu fördern. Mit einer starken Nachfrage ist auch in Berufen zu rechnen, die eine abgeschlossene nicht universitäre Berufsausbildung voraussetzen; für diese Berufe gelten jedoch nach wie vor strengere Beschränkungen. Zur Behebung absehbarer Personalengpässe in diesen Berufen sollte mehr getan werden, um ausländische Arbeitskräfte für das duale System zu gewinnen, wobei Deutschlands neuer Rahmen für die Anerkennung von Berufsqualifikationen beitragen könnte, um neue Zuwanderungsmöglichkeiten zu schaffen.

    Abstract: Recent reforms have put Germany among the OECD countries with the fewest restrictions on labour migration for highly-skilled occupations, yet inflows continue to be relatively low. As labour migration is supposed to be one means to help meet future labour and skill shortages caused by a shrinking working-age population, this book addresses the question of how to ensure that international recruitment can help meet urgent needs in the labour market which cannot be met locally. The review examines key issues in the design of the German labour migration system, on the demand side and on the supply side. German employers can recruit from abroad for any job requiring university-level qualifications. Yet even employers declaring shortages have not done so, in part, due to their insistence on German-language skills and specific qualifications, and in part to a perception that international recruitment is complex and unreliable. While the process could be made more transparent, its negative reputation is unjustified. International students appear well positioned to meet employer concerns, but Germany could do more to promote this channel for labour migration. A large part of the demand is also expected in skilled occupations requiring non-tertiary vocational training, but here, channels remain more restrictive. To address anticipated shortages in these occupations, more should be done to recruit into the dual system, and Germany’s new recognition framework could contribute to open new channels.

    Abstract: Seit der letzten Prüfung der deutschen Energiepolitik durch die IEA im Jahr 2007 hat die Bundesrepublik zwei Grundsatzentscheidungen getroffen, die ihre Energiepolitik in den kommenden Jahrzehnten leiten werden. Im September 2010 hat die Bundesregierung das Energiekonzept verabschiedet, eine umfassende neue, langfristige und integrierte Strategie für die Entwicklung der Energieversorgung bis 2050. Nach dem Reaktorunfall von Fukushima Daiichi im März 2011 wurde dann der beschleunigte Ausstieg aus der Kernenergie bis 2022 beschlossen, wobei mit der sofortigen Stilllegung der acht ältesten Kraftwerke begonnen wurde. Diese Entscheidung führte zur Verabschiedung einer Reihe neuer Politikmaßnahmen zur Umsetzung der sog. Energiewende, mit der die erneuerbaren Energien zur tragenden Säule der künftigen Energieversorgung werden. Für diesen ehrgeizigen Umbau der Energieversorgung muss bis 2030 die Hälfte der Stromerzeugung aus erneuerbaren Energien stammen. Deutschland muss daher mit der Entwicklung kosteneffizienter marktorientierter Konzepte fortfahren, um die erwartete Expansion der dargebotsabhängigen erneuerbaren Energien zu begleiten. Außerdem müssen Kosten und Nutzen gerecht und transparent, unter besonderer Beachtung der privaten Haushalte, auf alle Markteilnehmer verteilt werden. Die Expansion der erneuerbaren Energien muss in Zukunft parallel zum zeitnahen Ausbau der Übertragungs- und Verteilungsnetze erfolgen. Zudem bedarf es eines stabilen Regulierungsrahmens, um langfristige Finanzierungsmöglichkeiten für die Netzbetreiber zu gewährleisten. Darüber hinaus gilt es, Deutschlands Kapazität zur Deckung des Spitzenlastbedarfs auf mittlere Sicht weiter genau zu beobachten. Deutschlands energiepolitische Entscheidungen haben zwangsläufig Auswirkungen über die Landesgrenzen hinaus und müssen im Kontext eines umfassenderen europäischen energiepolitischen Rahmens und in enger Fühlungnahme mit den Nachbarländern getroffen werden. Dieser Bericht analysiert die energiepolitischen Herausforderungen, vor denen die Bundesrepublik steht, und liefert Empfehlungen dazu, wie ihre Energiepolitik weiter verbessert werden kann. Er soll Deutschland Orientierungen auf dem Weg hin zu einer sichereren und nachhaltigeren Energieversorgung der Zukunft geben.

    Abstract: Since the IEA last reviewed Germany’s energy policies in 2007, the country has taken two fundamental policy decisions that will guide its energy policy in coming decades. In September 2010, the federal government adopted the Energy Concept, a comprehensive new strategy for a long-term integrated energy pathway to 2050. Following the Fukushima Daiichi nuclear accident in March 2011, Germany decided to accelerate the phase-out of nuclear power by 2022 starting with the immediate closure of the eight oldest plants. This decision resulted in the adoption of a new suite of policy measures, determined renewable energy as the cornerstone of future energy supply, a set of policy instruments commonly known as the Energiewende. In order to achieve the ambitious energy transformation set out in the Energiewende, by 2030 half of all electricity supply will come from renewable energy sources; Germany must continue to develop cost-effective market-based approaches which will support the forecast growth of variable renewable generation. Furthermore, the costs and benefits need to be allocated in a fair and transparent way among all market participants, especially households. Renewable energy capacity must expand alongside the timely development of the transmission and distribution networks. In addition, a stable regulatory system is necessary to ensure long-term finance to network operators. Furthermore, close monitoring of Germany’s ability to meet electricity demand at peak times should continue in the medium term. Energy policy decisions in Germany inevitably have an impact beyond the country’s borders and must be taken within the context of a broader European energy policy framework and in close consultation with its neighbours. This review analyses the energy-policy challenges facing Germany and provides recommendations for further policy improvements. It is intended to help guide the country towards a more secure and sustainable energy future.

    Abstract: One important element of the response to the crisis in Germany was the establishment of a new institution, the Bundesanstalt für Finanzmarktstabilisierung (Federal Agency for Financial Market Stabilisation, henceforth FMSA). The aim was to supplement the range of tasks performed by the Deutsche Bundesbank and the Bundesanstalt für Finanzdienstleistungsaufsicht (the Federal Financial Supervisory Authority). Neither one of these two institutions nor the legal framework, including especially the insolvency laws, were adequate for rescuing and restructuring stressed banks. While the FMSA was initially conceived as a temporary undertaking, the new German Restructuring Act implies that the FMSA is now a permanent part of the German banking landscape.

    Abstract: The Bologna Process put in motion a series of reforms for higher education. In Germany, the “Bologna reform” focused national standards and guidelines which served as criteria for obligatory programme accreditation by external bodies. This article reports on the results of an empirical study that examined the effects and limitations of accreditation as a means of monitoring the reform of study programmes. An analysis of 1 380 accreditation decisions taken in the Federal State of Lower Saxony between July 2004 and December 2009 and a series of interviews of key actors in the state’s 36 higher education institutions gave rise to a better understanding of whether accreditation does in fact support HEIs’ quality assurance goals.

    Abstract: The installation of final repositories for nuclear waste has been a most controversial topic on the German political agenda for decades. The beginning of efforts to solve this problem can be traced back to the 1970s when plans for the establishment of an Integrated Nuclear Waste Disposal Centre (Integriertes Entsorgungszentrum) in the State of Lower Saxony were developed. It was in this context that in 1976,1 the Atomic Energy Act (AEA) of 19592 (the 2002 consolidated text is reproduced in Supplement to Nuclear Law Bulletin No. 70) was amended by inserting Section 9a, paragraph 3, sentence 1, which reads very succinctly: “The Federation shall establish installations for the safekeeping and final disposal of radioactive waste.” Despite the subsequent AEA amendments of Section 9a, paragraph 3 and the addition of a paragraph 4 (1998)3 that were to allow the Federation to transfer the exercise of its functions to third parties, these administrative provisions were never used. Accordingly, full responsibility of the Federation for the fulfilment of its obligation under Section 9a, paragraph 3 of the AEA remains intact today.

    Abstract: This publication presents the Development Assistance Committee peer review of the aid programmes and policies of Germany for 2010. The policies and programmes of each DAC member are critically examined approximately once every four or five years. Five members are examined annually. The OECD’s Development Co-operation Directorate provides analytical support and is responsible for developing and maintaining the conceptual framework within which the Peer Reviews are undertaken. The Peer Review is prepared by a team, consisting of representatives of the Secretariat working with officials from two DAC members who are designated as “examiners”. The country under review provides a memorandum setting out the main developments in its policies and programmes. Then the Secretariat and the examiners visit the capital to interview officials, parliamentarians, as well as civil society and NGO representatives of the donor country to obtain a first-hand insight into current issues surrounding the development co-operation efforts of the member concerned. Field visits assess how members are implementing the major DAC policies, principles and concerns, and review operations in recipient countries, particularly with regard to poverty reduction, sustainability, gender equality and other aspects of participatory development, and local aid co-ordination. The Secretariat then prepares a draft report on the member’s development co-operation which is the basis for the DAC review meeting at the OECD. At this meeting senior officials from the member under review respond to questions formulated by the Secretariat in association with the examiners. This review contains the Main Findings and Recommendations of the Development Assistance Committee and the report of the Secretariat.

    Abstract: The future of Greece’s well-being will depend on improving educational performance to boost productivity and improve social outcomes. In the current economic context, with the need to get best value for spending, Greece must and can address inefficiencies in its education system. The challenges are significant. For example, Greece lags behind many OECD countries in performance on PISA, including countries with the same or lower levels of expenditure per student as well as countries with the same and lower levels of economic development. Salary costs per student are above the OECD average, mostly because Greek teachers have less teaching time and Greece has smaller classes. A smaller percentage of students who enter tertiary education complete a first degree within the statutory study time than in any other country in Europe. To address the challenges, the Greek government has established a bold agenda and sought advice from a task force on the development and implementation of reform proposals that reflect best practices in OECD countries. This report provides the outcomes of the work of the task force. It presents a roadmap for how the reforms can be successfully implemented, with pointers to relevant experience in other countries. As a contribution to the on-going policy discussions in Greece, it recommends specific short-, medium- and long-term actions that can improve efficiency in the country’s education system.

    Abstract: Learning for Jobs is an OECD study of vocational education and training (VET) designed to help countries make their VET systems more responsive to labour market needs. Germany has a very well developed and widely respected VET system with a strong dual component integrating learning in schools and workplace training. VET policy, design and delivery are strongly supported by social partner engagement and institutionalised VET research capacity. At the same time the German system confronts several challenges: the transition system is costly and suffers from undue fragmentation; more attention could be placed on adequate career guidance and basic skills provision; assessment is dominated by the Chamber exam; and only very few VET graduates take up university studies despite reforms to open access considerably. The OECD review assesses the main challenges faced by the VET system and presents an interconnected package of policy recommendations. For each recommendation, the report describes the challenge, the recommendation itself, supporting arguments, and issues of implementation.

    Abstract: The Global Forum on Transparency and Exchange of Information for Tax Purposes is the multilateral framework within which work in the area of tax transparency and exchange of information is carried out by over 90 jurisdictions which participate in the work of the Global Forum on an equal footing. The Global Forum is charged with in-depth monitoring and peer review of the implementation of the standards of transparency and exchange of information for tax purposes. These standards are primarily reflected in the 2002 OECD Model Agreement on Exchange of Information on Tax Matters and its commentary, and in Article 26 of the OECD Model Tax Convention on Income and on Capital and its commentary as updated in 2004, which has been incorporated in the UN Model Tax Convention. The standards provide for international exchange on request of foreseeably relevant information for the administration or enforcement of the domestic tax laws of a requesting party. “Fishing expeditions” are not authorised, but all foreseeably relevant information must be provided, including bank information and information held by fiduciaries, regardless of the existence of a domestic tax interest or the application of a dual criminality standard. All members of the Global Forum, as well as jurisdictions identified by the Global Forum as relevant to its work, are being reviewed. This process is undertaken in two phases. Phase 1 reviews assess the quality of a jurisdiction’s legal and regulatory framework for the exchange of information, while Phase 2 reviews look at the practical implementation of that framework. Some Global Forum members are undergoing combined – Phase 1 plus Phase 2 – reviews. The ultimate goal is to help jurisdictions to effectively implement the international standards of transparency and exchange of information for tax purposes. All review reports are published once approved by the Global Forum and they thus represent agreed Global Forum reports.

    Abstract: The balanced growth and stochastic growth theory implies stable consumption-to-output and investment-to-output ratios. It is tested by cointegration techniques for three different German data vintages. Systems cointegration tests are helpful in revealing inconsistencies across vintages. Differencing and rebasing, often used to adjust for benchmark revisions, are generally not sufficient to ensure consistent real-time macroeconomic data. Vintage transformation functions estimated by cointegrating regressions are more flexible. Empirically, the cointegrating property between consumption and output, as well as between investment and output, is often found, whereas the one-to-one relationship is mostly rejected. Moreover, the linear transformation function is helpful in describing the relation between two older final vintages. This function seems to be insufficient if the most recent data collection framework is involved.

    Abstract: Past consolidation has allowed the automatic stabilisers to operate fully during the crisis. Further fiscal easing in late 2008 and early 2009 contributed to a markedly widening fiscal deficit in 2010. A newly enacted fiscal rule, which limits the structural budget deficit of the federal government to a maximum of 0.35% of GDP and requires balanced structural budgets for the Länder, will help bring public finances back to a sustainable path. However, some elements of the new rule may need to be fine tuned in order for it to be more effective. To comply with the transition requirements of the new rule, consolidation beyond a mere phasing-out of the stimulus packages will be needed between 2011 and 2016. Priority should be given to reducing public expenditure, notably by improving public sector efficiency and by cutting back on grants and government consumption, and to phasing out distorting tax concessions. To improve the structure of the tax system, the government should consider raising the share of taxes on property and consumption in total tax revenues.     Abstract: This paper explores a range of perceived similarities and differences between male and female academics in the context of contemporary European Union “gender mainstreaming” policy. It concentrates upon the higher education systems of Germany and the United Kingdom, and is based upon questionnaire responses. A large majority of respondents believe that more needs to be done to remedy inequalities arising from maternity leave and child rearing, and that their universities are still gendered organisations with too few women at the top. Many females regard themselves as less strategic than males in managing their careers, and believe that they need to behave the same as men to succeed. They think that men have historically dominated in their subject area and still do so. Relatively small percentages of men endorse these opinions in relation to women, and their responses are often positive in their perception of female academics. It is almost universally agreed that women are doing a good professional job, and very few employees (either male or female) experience gross forms of bullying and harassment at work. A certain convergence between the genders in some respects may indicate the erosion of binary gender hierarchies in the current policy environment.

Issues examined include: strategy and policies for improving regulatory management; institutional capacities for effective regulation and the broader policy making context; transparency and processes for effective public consultation and communication; processes for the development of new regulations, including impact assessment and for the management of the regulatory stock, including administrative burdens; compliance rates, enforcement policy and appeal processes; and the multilevel dimension: interface between different levels of government and interface between national processes and those of the EU. This book is part of a project examining better regulation, being carried out in partnership with the European Commission.

    Abstract: The potential growth rate of the economy has been low for a long time and the crisis has had a further adverse impact. The meagre growth performance mainly reflects low growth in a number of services sectors; most manufacturing sectors, by contrast, expanded at a rapid pace in the years preceding the recent crisis, on the back of robust foreign demand. The challenge is to consolidate the past success of the export sector and to broaden it to the whole economy by making the policy framework more conducive to innovation and structural change. Specifically, product market regulation needs to be eased to prevent it from sheltering uncompetitive industries; the framework conditions for innovation need to be improved; the education system needs to be reformed further to supply a sufficiently large pool of highly qualified labour; and immigration policy needs to become more favourable to the immigration of high-skilled. Strengthening Germany’s attractiveness as a location for investment would contribute to a higher trend growth rate through lifting barriers to higher growth, which are particular binding in the non-traded goods sector. This would reduce Germany’s current account surplus and make a contribution to reduce global imbalances.     Abstract: “System accreditation” is a new approach developed for German universities to conduct the mandatory accreditation of all their study programmes. A pilot project at Johannes Gutenberg University in Mainz is playing an important role in paving the way for this alternative to prevailing programme accreditation. This article describes how system accreditation, an innovative approach towards organisational adaption to national regulations, was conceived and how it functions. Based on the experience of Johannes Gutenberg University, the article explores the potential of system accreditation to improve quality assurance and the development of study programmes. System accreditation faces three global challenges: that of creating an integrated approach, establishing a solid evidence base and fostering the effectiveness of evaluation efforts.

    Abstract: Wie wichtig eine wirkungsvolle Rechtsetzung ist, zeigt sich heute, nach dem schwersten Konjunkturabschwung seit der Großen Depression, deutlicher denn je. Doch wie kann bessere Rechtsetzung die wirtschaftlichen und sozialen Aussichten der Länder im Einzelnen verbessern, dauerhaftes Wachstum fördern und die Widerstandsfähigkeit der Volkswirtschaften stärken? Was genau ist wirkungsvolle Rechtsetzung? Wie sollte sich die Politik für bessere Rechtsetzung im kommenden Jahrzehnt gestalten und in welche Richtung sollte sie gehen? Um auf diese Fragen zu antworten, hat die OECD in Partnerschaft mit der Europäischen Kommission ein großes Projekt zur Prüfung der Bemühungen um bessere Rechtsetzung in 15 in der Europäischen Union vertretenen OECD-Ländern – darunter auch Deutschland – gestartet. In jedem Bericht werden die zentralen Elemente dargestellt und analysiert, die zusammengenommen für ein effektives Regulierungsmanagement sorgen, womit ein Rahmen für die künftige Entwicklung von Regulierungspolitik und -reform aufgezeichnet wird. Untersucht werden u.a. folgende Fragen: · Strategien und Maßnahmen zur Verbesserung des Regulierungsmanagements · Institutionelle Kapazitäten für wirkungsvolle Rechtsetzung und allgemeiner Kontext der politischen Entscheidungsfindung · Transparenz und Verfahren für wirkungsvolle Konsultation und Kommunikation mit der Öffentlichkeit · Verfahren für die Ausarbeitung neuer Rechtsvorschriften, wie z.B.     Abstract: Based on annual data for growth and inflation forecasts for Germany covering the 1970-2007 period and up to 17 different forecasts per year, we test for a possible asymmetry of the forecasters’ loss function and estimate the degree of asymmetry for each forecasting institution using the approach of Elliot et al. (2005). Furthermore, we test for the rationality of the forecasts under the assumption of a possibly asymmetric loss function and for the features of an optimal forecast under the assumption of a generalised loss function. We find evidence of the existence of an asymmetric loss function of German forecasters only in the case of pooled data and a quad-quad loss function. We can reject the hypothesis of rationality of the growth forecasts based on a pooled dataset, but not on data for single institutions. The rationality of inflation forecasts is frequently rejected in the case of single institutions, and also for pooled data.

    Abstract: Berlin is a creative city attracting talent from around the world. The Berlin Senate has made great strides in developing innovation as a pillar of its economy. But challenges remain: there is long-term unemployment, a low absorptive capacity in small and medium-sized enterprises and a large migrant population that lags behind in educational and labour market outcomes. How can Berlin’s higher education institutions capitalise on their long tradition of professionally relevant learning and research to transform social, economic and environmental challenges into assets and opportunities? What incentives are needed to improve higher education institutions´ regional and local orientation? This publication explores a range of helpful policy measures and institutional reforms to mobilise higher education for Berlin’s development. It is part of the series of the OECD reviews of Higher Education in Regional and City Development. These reviews help mobilise higher education institutions for economic, social and cultural development of cities and regions. They analyse how the higher education system impacts upon regional and local development and bring together universities, other higher education institutions and public and private agencies to identify strategic goals and to work towards them.

    Abstract: The German banking system came under pressure during the financial crisis, not least due to its significant exposure to toxic assets which originated in the US. In the short run, the stability of the system has been achieved, in large part through substantial government support measures. However, ensuring adequate capitalization of the banking system remains a major challenge going forward and may require more active government involvement. The underlying causes of the banking sector problems are related to: i) the activities of the Landesbanken which benefitted from government guarantees without a proper business model; ii) weak capitalization and high fragmentation of the whole banking system, possibly related to the particularly rigid three-pillar structure; and iii) deficiencies in banking regulation and supervision. The challenge is to address these three causes in order to raise the long-run stability of the banking system.
