    Abstract: Jakob Weissinger nähert sich der zentralen rechtstheoretischen Frage nach einem Begriff subjektiver Rechte, indem er fundamentale Strukturelemente normativer Praxis und deren Verflechtungen analysiert. Darauf aufbauend entwickelt er einen eigenen Begriff, der bewährte Ansätze grundlegend in Frage stellt.
    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: Who is a child’s legal mother? Must a child have exactly one mother, can it have two or three, or can it have two fathers, but no mother? Or has the concept of motherhood become obsolete and should we just talk of parenthood in a gender neutral way? Questions such as these would have appeared esoteric only a few decades ago, but as a result of new social developments (such as frequent family reconstitutions, gay and lesbian emancipation or surrogacy) and of technological innovations (such as egg and embryo donations) they have become issues in a vehement debate. The interdisciplinary contributions to this book focus on the legal definition of motherhood, on the way in which legal conceptions structure the social discourse on motherhood (and vice versa), and on the influence of legal rules on power relations between mothers, fathers, children and the state. Among the issues addressed are - the challenges to our understanding of the legal regulation of motherhood by developments in reproductive medicine; - the challenges to our understanding of the legal regulation of motherhood by parental constellations deviating from the mother-father-model (single motherhood by choice, same-gender parenthood, multiple parenthood); - the exercise of parental rights in case of parental separation and the impact of legal rules on the bargaining positions of mothers and fathers.

    Abstract: "This book draws attention to the various factors that characterise migrant flows and mobilities, calling into question familiar concepts such as push and pull, migration as a life project and socio-cultural integration. It highlights processes such as flexible migrant routes, temporary and return migration, mental aspects of migration processes and transnationalism. Organised around the themes of shaping trajectories, frictions in space, and the migrant mental framework, - it brings together work from scholars from Europe and beyond. The book suggests a different understanding of migration and mobility as relational, non-linear, and fluid social processes, characterised by instability in migrant life trajectories. Emphasising the flexibility of migrants and migration and advocating the importance of emotionally charged, individual perceptions as central to migrant decision-making, it will appeal to scholars of sociology, anthropology, politics and geography with interests in migration and diaspora studies. The contributions collected here put emphasis the social and mental processes that underpin the migratory process, which can be seen as the "soft-side" of migration. Too often, this side is neglected when the governance of migration is discussed. The novel ideas expressed here also help to overcome the mechanistic view of migration as a 'push-pull' event"...

    Abstract: "In Asia, there are a growing number of gigantic megalopolises, accompanied by a series of speculative and extravagant megaprojects. Amid the fast-paced urban and development challenges, many Asian developing countries have started to search for successful Asian development models. South Korea and its capital city Seoul are frequently referenced models. South Koreas "economic miracle" of the late twentieth century, however, has been mostly studied through an economic policy lens. This book revisits the development of South Korea by looking at its urban dimension and exploring the city of Seoul as a developmental megaproject. Offering an alternative to the focus on economic policies when it comes to explaining South Koreas development successes, Joo looks at the urbanization that took place under the guidance of the strong developmental state. She provides empirical evidence of the "property state" at work, both complementing and supporting the developmental state. She also analyses why and how Seoul was able to emerge as an important Asian global city and a global front-runner in terms of ambitious and pioneering urban investments, despite its relatively recent history marked by massive slums and urban poverty. This book provides an analytical framework for studying South Koreas modern development under capitalism, as a precursor to the East Asian urbanism and development. It paints a comprehensive story of how cities have been both politically and economically important to Koreas development experience, and are increasingly becoming a new mode of development"--Provided by publisher

    Abstract: As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justicesystem. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical0exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated. It offers a unique perspective that is likely to become a significant reference point for the ever-growing debates about the power of algorithms in daily life in the worlds of research, policy and practice.     Abstract: This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. Itargues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies- more precisely securitization theory- by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU's policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations

    Abstract: Areas of limited statehood, in which the territorial State lacks effective control, either completely or in part, challenge International Humanitarian Law in various ways. This volume explores if and how the law adapts to these challenges on the basis of mainly two legal issues: detention and investment protection in (non-)international armed conflict. Does a sufficient legal basis exist for the former? Is it International Humanitarian Law that determines what the investor is owed under a 'full protection and security' standard? More fundamentally, the contributions strive to shed light on these practical legal issues in a manner that is also historically and theoretically informed. How can international law be effective in areas of limited statehood, in particular as regards non-State actors? Can the law provide incentives for compliance? Is it in need of being developed? If so, who enjoys the legitimacy to do so?

    Abstract: Amicus curiae participation in international courts is steadily growing since the late 1990 despite lack of clarity on the concept's nature, function and utility in international dispute settlement. Does amicus curiae infuse international judicial proceedings with alternative views, including the public interest in a case, as often advocated by NGOs? Does it increase the legitimacy and transparency of international dispute settlement, or the coherence of international law? Or is it an unhelpful impostor that impedes negotiated solutions and derails the proceedings at the expense of the parties to advance its own agenda? By way of an empirical-comparative analysis of the laws and practices of the ICJ, the ITLOS, the ECtHR, the IACtHR, the IACtHPR, WTO panels and the Appellate Body, and investment arbitration the dissertation examines the status quo of amicus curiae before international courts and tribunals to determine if the current amicus curiae practice is of added value to international proceedings and international dispute settlement in general. The dissertation shows that there is no common concept of international amicus curiae, but that amicus curiae before the international courts examined share a few characteristics. A proposed functional systematization highlights overlaps and diverging uses of the concept before international courts and helps scholars and practitioners to assess the opportunities and limits of the concept. Analysis of the concept's current regulatory framework and its substantive effectiveness reveals a hesitation in particular by courts with a strong adversarial tradition to take into account the views of a non-party despite the positive experience with the concept in regional human rights courts. The dissertation concludes that neither the expectations nor the concerns attached to amicus curiae participation in international proceedings have materialized. It argues that the concept can contribute to improved decisions and decision-making in international dispute settlement if regulated and used properly

    Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: As development policy moves away from considering the state as the primary driver of economic growth it is necessary to consider the institutional foundations of the market economy. It has been argued that without legal systems that allow for innovation and enterprise, all other attempts to improve economic growth are destined to fail. Law and Development offers an unparalleled assessment of the role of legal systems in development by extending the analytical framework of New Institutional Economics (NIE). Using empirical tests to critique Legal Origin Theory, and assess the role of culture in the formation of the legal environment, this book proposes that cultural factors are much more significant than allowed for by previous frameworks.     Abstract: This book offers a unique and insightful econometric evaluation of the policies used to fight transnational terrorism between 1990 and 2014. It uses the tools of modern economics, game theory and structural econometrics to analyze the roles of foreign aid, educational capital, and military intervention. Jean-Paul Azam and Véronique Thelen analyze panel data over 25 years across 124 countries. They prove that foreign aid plays a key role in inducing recipient governments to protect the donors' political and economic interests within their sphere of influence. Demonstrating that countries endowed with better educational capital export fewer terrorist attacks, they also illustrate that, in contrast, military intervention is counter-productive in abating terrorism. Recognizing the strides taken by the Obama administration to increase the role of foreign aid and reduce the use of military interventions, this book shows the significant impact this has had in reducing the number of transnational terrorist attacks per source country, and suggests further developments in this vein. Practical and timely, this book will be of particular interest to students and scholars of economics and political science, as well as those working on the wider issue of terrorism. Presenting a series of new findings, the book will also appeal to international policy makers and government officials

Es präsentiert die Impulse europäischer Instanzen und die Antworten verschiedener europäischer Staaten auf die Herausforderung, Flexibilisierung der Beschäftigung und Modernisierung der Sozialschutzsysteme in Einklang zu bringen. Increasing life expectancy in Europe entails a remodelling of career development and life course, marked by discontinuities and changing professional activities. One of the concerns is ensuring that everybody may participate in gainful activities during his or her life course while also guaranteeing social rights through adequate social protection. By means of legal, socio-political and empirical analyses this book embarks on the interrelationship of different social protection mechanisms and the resulting difficulties of adapting to these new employment patterns. It presents European impulses and the reactions of several European states to the challenge of reconciling flexibility of employment and modernisation of social protection. L’augmentation de l’espérance de vie en Europe suscite un changement des modes de parcours professionnels et de vie constitués de ruptures et de conversions d’activité. L’une des préoccupations est de permettre à chacun de poursuivre une activité professionnelle tout au long de sa vie tout en pouvant bénéficier d’une protection sociale adaptée. A travers des analyses juridiques, socio-politiques et empiriques, cet ouvrage aborde les interférences et les difficultés d’adaptation des mécanismes de protection sociale aux nouvelles évolutions. Il présente les impulsions européennes et les choix effectués au niveau national pour concilier flexibilité de l’emploi et modernisation des systèmes de protection sociale
