Series Statement: Routledge studies in comparative legal history
Parallel Title: Erscheint auch als English law, the legal profession, and colonialism
Keywords: Lawyers History ; Practice of law History ; England Colonies ; Konferenzschrift
Abstract: "Modern legal history is increasingly interested in exploring the development of legal systems from novel and nuanced approaches. This edited collection harnesses the lesser-researched perspectives of the impact of global and imperial factors on the development of law. It is argued that to better understand these timely discussions, we must understand the process and significance of colonisation itself. The volume brings together experts in the field of law and history to explore the ways in which law and lawyers contributed to the expansion of the British Empire, and the ways in which the Empire influenced the Metropole. The book sheds new light on the role of the law and legal actors during the pivotal centuries that saw the establishment of the Empire. Exploring such topics as Atlantic relations, the impact of British jurists upon Indian law, and the development of the law settler colonies, this collection reveals some of the lesser-known intersections between law, history, and empire. The book will be of interest to students and researchers in legal history, comparative history, equity and trusts, contract law, the legal profession, slavery, and the British Empire"--
Note: "This volume derives from an online conference held in January 2021, organised by the editors and attended by participants from around the wold. The conference, "English law and colonial connections: histories, parallels, and influences" gathered a group of scholars undertaking research in the broad area of legal history within, across, or touching upon the British Empire. The following volume contains chapters written by some of the conference participants, as well as other scholars who were invited by the editors to contribute and strenghten the "global" character of the topics discussed."

Series Statement: Critiques and alternatives to capitalism
    Keywords: Commons ; Capitalism
Abstract: This book provides a lucid, rigorous, and critical account of the commons, its history and its political potentialities as well as its limitations and ambiguities. In particular, The Commons analyses the relations of solidarity and conflict between the commons and public welfare policies, as well as the role the commons can play in the struggle against the global socioecological crisis that is threatening the very future of humanity. Over the past decade, various theories, concepts and political projects connected to the commons have become fundamentally important for social science and numerous social movements around the world. In sociology, economics, political science, history, geography, the law and anthropology, the study of the commons has inspired many important academic innovations. In parallel, community activists, labour unions, ecologists, feminists and cooperativists have discovered in the commons a powerful and thought-provoking toolkit with which to defend public services, guarantee access to cultural goods, organize reproductive and care work, and more generally, fight against commodification and ecological destruction. The first two chapters analyse the dual origin of the academic rediscovery of the commons. On one side, from the realm of political science and economics, the concept of the commons has been used to challenge the dominant paradigms founded on rational choice theory. On the other, from the fields of history, law and anthropology, analysis of the violent destruction of the commons has served to deepen our understanding of the coercive and antidemocratic processes that form the bedrock of capitalism and our current plight. The third and fourth chapters examine the role that the commons can play in emancipatory political projects aiming to deepen democracy in mass industrial societies. As such, The Commons will appeal to scholars across the social sciences and academics with interests in social and political theory, the environment and sustainability, and political sociology.

Abstract: "This book is the first collection to showcase the flourishing field of environmental humanities in Central Asia. A region larger than Europe, Central Asia possesses an astounding range of environments, from deserts to glaciated peaks. The volume brings into conversation scholarship from history to social anthropology, demonstrating the contribution that interdisciplinary and engaged research offers to many urgent issues in the region: from the history of conservationism to the tactics of environmental movements, from literary engagements with 'pure nature' to the impact of fossil fuel extraction. The collection focuses on the Central Asian republics of the former USSR, where a complex layering of nomadic and sedentary, Turkic and Persianate, Islamic and Soviet cultures ends up affecting human relations with distinct environments. Featuring state-of-the-art contributions, the book enquires into human-environment relations through a broad-brush typology of interactive modes: to extract, protect, enspirit and fear. Broadening the scope of analysis beyond a consideration of power, the authors bring into focus alternative local cosmologies and the unintended consequences of environmental policy. The volume highlights scholarship from within Central Asia as well as expertise elsewhere, offering readers diverse modes of knowledge-production in the environmental humanities. This book is an important resource for researchers and students of the environmental humanities, sustainability, history, politics, anthropology and geography of Asia, as well as Soviet and Post-Soviet studies"--

Abstract: "This handbook interrogates the foundations of media literacy and media education research from a methodological standpoint. It provides a detailed, illustrated overview of key methods used in the study of media literacy and media education. It further reveals the diversity of this research field and organizes this diversity by using three categories of investigation: media practices, educational initiatives, and prescriptive discourses. The book offers valuable reference points and tools for exploring the range of research methods used to study media literacy and media education, and how these methods connect to epistemological stances, theoretical frameworks and research questions. It serves as a guide for researchers who wish to position themselves, reflect on the methods they use or are considering using, and compare and contrast them against alternative or complementary approaches. After reading this book, readers will be better able to identify and define the objects of study in media literacy and media education research, the preferred ways of conducting investigations, the phenomena, issues, and dimensions that these are likely to bring to light, and the knowledge that they generate. This comprehensive and up to date overview of the field of media literacy education research methods will be of great interest to scholars and students of education studies, media studies, media literacy, cognitive science, and communication studies"--

Abstract: "What is a contract in Islam? Is it an aspect of Muslim religion or of secular life? How much has it changed over the centuries? Undertaking a search that spans revelation, legal tradition, and the reality of the Muslim world, this book explores the Islamic contract ('aqd in Arabic) as a 'city' at the crossroads of convergent paths of translation, comparison, and law in context. In particular, the book shows that only by re-orienting traditional categories of Western law-religion towards the East can an alternative path of discovery for the 'aqd be advanced. Hence, through a fortuitous encounter with an Arab Girl, the reader will (re-)visit the Temple of Western modernity and explore a city ruled by Towers of dialectical forces, carrying a hermeneutical Ring that combines dialectics, Islamic studies, and media theory. This interdisciplinary approach will not only enrich our knowledge of the 'aqd but also make it more understandable as a cultural and social construction to which both Muslims and non-Muslims have participated in forging its multiple representations. By inviting the readers 'to know who they are' while looking at her, the Arab Girl is already waiting for us to listen to the Islamic contract in a new way. By applying a distinctive law and religion approach to the study of the contract in Islam, the book provides a comprehensive exploration of a topic that is of interest to legal and economic historians and comparatists, but also of topical meaning for international lawyers and the operators of an increasingly multicultural market"--

Abstract: "This book offers a portrait of early ethnographic work in the American Arctic, with a focus on understanding the mutual constitution of the Inuit and their early ethnographers. It draws mainly on a rich repository of written testimonies from the early twentieth century, the 'great ethnographic period' when new scholarly interest in the region took off. Supplementing the movements and observations of whalers, traders, and missionaries, the early chroniclers offered new knowledge of Inuit life. Although their descriptions of the Inuit bear the marks of their time, the texts have left a deep mark on later developments and contributed to a long-lasting view of human life in the Arctic. The chapters show the infiltration of lives and landscapes, of thoughts and materials, of Inuit and ethnographers. The book will be relevant to anthropologists as well as historians, geographers, and others with an interest the Arctic region and Indigenous studies"--

Abstract: "The Politics of Silence, Voice and the In-Between: Exploring Gender, Race and Insecurity from the Margins seeks to dismantle the deficit discourses generated through research about people as agency-less and, by extension, objects of study. The book argues that, regardless of marginalisation, people create spaces of liminality where they seek control over their lives by navigating the structures that exclude them. Challenging the false binary of silence as violence and voice as power, the book introduces the idea of an in-between 'liminal space' which is created by people to navigate conditions of oppression and move towards a politically stable and inclusive world. This book will be of great interest to students and scholars of gender studies, international development, peace and conflict studies, politics and international relations, sociology, and media studies. It will be an important resource for courses incorporating gender, feminist, and postcolonial perspectives"--

Abstract: "This book studies war narratives and their role in the political arenas of post-conflict societies, with a focus on the former Yugoslavia. How do politicians in post-war societies talk about the past war? How do they discursively represent vulnerable social groups created by the conflict? Does the nature of this representation depend on the politicians' ideology, personal characteristics, or their record of combat service? The book answers these questions by pairing natural language processing tools and large corpora of parliamentary debates collected in three southeast European post-conflict societies (Bosnia-Herzegovina, Croatia, and Serbia). Using the latest advances in computer science, the book explores patterns in the war discourse of the political elites of these countries and discusses how politicians talk about war in terms of common narratives and shared frameworks. Mapping over twenty years of parliamentary debates, the book presents a new perspective on the role of the legacies of war in public space and develops theoretical arguments about reconciliation in post-conflict societies. The wars of the 1990s and the breakup of Yugoslavia have created three totally different settings for remembering the past conflicts in these countries, despite their common history. It is a story of victorious battles (Croatia), past grievances (Bosnia-Herzegovina) and denial (Serbia), showing the different flavours of past wars in various national contexts that are symptomatic of many post-conflict societies in different parts of the world. This book will be of much interest to students of war and conflict studies, South-Eastern European politics, discourse analysis, and International Relations"--

Abstract: "Extracting Reconciliation argues that reconciliation constitutes a critical contemporary mechanism through which colonialism is seeking to ensure continuing access to Indigenous lands and resources. Making use of two historical case studies concerned with the intersection of resource extraction, Crown/Inuit relations, and waste legacies in Nunavut, Turtle Island (Canada), the authors illuminate the mechanisms of colonial and neoliberal governance globally that promise reconciliation while delivering the status quo. Through Indigenous and non-Indigenous anticolonial and posthuman concepts and theories, the book engages with the inhuman politics of settler colonial extractivism, and explores the socio-ethical social justice dimensions, political possibilities, and environmental implications of a much more challenging and accountable reckoning between (settler) colonialism and Indigenous land rights. This book is of interest to students and scholars in gender studies, postcolonial studies, environmental studies, indigenous studies, and politics"--

Abstract: "Pragmatic Imagination and the New Museum Anthropology shifts museum anthropology's relationship to the broader field from marginal to central by revealing the sophisticated transdisciplinary praxis (theory + practice) at the heart of current museum anthropologies. The book features international case studies that operate at the interfaces of critical museology, anthropology, material culture studies, art practice, and more. The theory of pragmatics proposes that meaning-making is collaborative and best evaluated through its impact in the world. Collectively the chapters in this volume evidence a 'pragmatic imagination' at work as museum anthropology practitioners ingeniously combine inventiveness (the possible) and practicality (the actual) in ways that drive the field forward. Defining museum anthropology as a pragmatic practice explicitly theorizes this work in order to mark its significance; demystify its processes of knowledge production; connect it more readily to debates within and beyond anthropology; and facilitate critique"--

Pushing global intellectual history forward, it uses methodological innovations in the history of concepts, gender history, imperial history, and history of normativity, many of which have emerged out of intellectual history in recent years, and it especially foregrounds the role of field theory for delimiting objects of study but also in studying transnational history and migration of persons and ideas. Abstract: "This book is an ethnography that draws upon 23 years of qualitative research and shipboard field work in the merchant cargo shipping sector. It explores the lives and work of seafarers and how these have changed over time. Change over time and the experience of time on board are organising themes throughout the text. They are contextualised with accounts of transformation in the regulation of the shipping industry and technological innovation. The book begins with a unique account of a voyage on a container ship. In this, the author details both the research process and the daily activities and shared thoughts of the seafarers who are on board. The narrative is further enhanced with illustrative examples taken from other voyages to illustrate continuities and change over time. The book will be of value to individuals, scholars, and researchers interested in ethnography of all kinds. Sociologists, anthropologists, maritime studies students, seafarers, ship operators, and policy makers will find the text engaging and revealing. It provides a vivid account that will appeal to academics interested in the study of work, workplace change and time. It is accessibly written and will be enjoyed by readers interested in the contemporary shipping industry, and the life and work of seafarers.

Encompassing a wide range of popular culture genres and mediums - from film and TV to literature, graphic novels and anime - the chapters offer a dynamic mix of approaches to analyze how popular culture has engaged with specific culture-bound syndromes such as hwabyung, hikikomori, taijin kyofusho, zou huo ru mo, sati, amok, Cuban hysteria, voodoo death, and others. Spanning a global and interdisciplinary remit, this first-of-its-kind anthology will allow scholars and students of popular culture, media and film studies, comparative literature, medical humanities, cultural psychiatry and philosophy to explore simultaneously a diversity of popular cultures and culturally rooted mental health disorders"--

Abstract: "This volume explores the historical trajectory of the spread of Islam in South Asia and how the engagements of the past have played a crucial role in the making of the present outfits of South Asian Islam. Islam in South Asia has maintained a distinct role while imbibing cultural, social, ethnic, folk, and artistic networks of the subcontinent in diverse echelons. In an unequivocal analysis, this volume showcases the visible varieties of Islam from an array of regional cultural, ethnic, and vernacular groups. While many characteristics remain distinct in different provinces or regions of South Asia, similarities are palpable in etiquettes, customary laws, art and architecture. More than regional differences, various ethnic groups from all poles of the Indian subcontinent have paved the way for the dissimilar landscapes of Islam, in tandem with differences of languages, cultures and festivals. The case studies in this book exhibit forms of cultural pluralism in the communities, which have helped in building a cohesive community. Part of the 'Global Islamic Cultures' series that looks at integrated and indigenized Islam, this book will be of interest to students and researchers of religion, religious history, theology, study of Islamic law and politics, cultural studies, and South Asian Studies. Abstract: "Ethnicity and Development studies the success or failure of the nations of Bangladesh and Pakistan. It analyzes the role of institutions in engendering economic and social progress and challenges the New Institutional Economics (NIE) narrative. The book argues that the NIE narrative has some gaps, particularly that it is blind to ethnic fragmentation and therefore does not account for the construction of institutions that can build national cohesion in low- low-middle income countries (L/LMICs). It shows that L/LMICs have a different cultural context and that they need to first build national cohesion on a foundation of horizontal - across ethnic groups - and vertical - across classes - equity. The author's analysis also examines other novel issues, such as the boost that is provided by nations acquiring the right of self-determination. Other novelties are the distinction between prime causes (triggers) for economic development and approaches for economic development. More important for this book is the distinction between natural and constructed nations and the conceptual framework presented to analyze their performance. Finally, the study examines the creation of national cohesion in ethnically diverse nations. Addressing a gap in the literature, this book will of interest to researchers in development economics, political science, sociology and specialists in comparative politics/political theory with a focus on Area Studies"--

It reconstructs the research of substances against harmful insects in museum collections within the historical context of the formation of nation states, colonialism, a strengthening chemical industry, the First World War and the resulting, broad-based hygiene movement, through the lens of the Ethnologisches Museum (Ethnological Museum) in Berlin. Due to their persistence, the consequences of the use of pesticides in museum collections are now unmistakable and well documented in many places. Numerous objects are highly contaminated and only accessible under difficult conditions regarding occupational health and safety. This creates obstacles for conservation and scientific processing, as well as for mediation in the context of exhibitions and external loans. The most precarious and difficult situations arise when contaminated museum objects are repatriated to their countries of origin. This monograph examines contemporary challenges in the 21st century museum landscape and contextualizes the history of pesticide use at the turn of the 20th century. The Toxic Museum will be of great interest to students and scholars working in conservation, museology, monument preservation, art and cultural studies, ethnology, history, and economics"--

Abstract: "Repatriation of Indigenous Cultural Heritage examines how returned materials--objects, photographs, audio and manuscripts--are being received and reintegrated into the ongoing social and cultural lives of Aboriginal Australians. Combining a critical examination of the making of these collections with an assessment of their contemporary significance, the book exposes the opportunities and challenges involved in returning cultural heritage for the purposes of maintaining, preserving or reviving cultural practice. Drawing on ethnographic work undertaken with Aboriginal communities and the institutions that hold significant collections, the author reveals important new insights about the impact of return on communities. Technological advances, combined with the push towards decolonizing methodologies in Indigenous research, have resulted in considerable interest in ensuring that collections of cultural value are returned to Indigenous communities. Gibson challenges the rhetoric of museum repatriation, arguing that, while it has been tremendously important to advancing Indigenous interest, it is too often over-simplified. Repatriation of Indigenous Cultural Heritage offers a timely, critical perspective on current museum practice and its place within processes of cultural production and transmission. The book is sure to resonate in other international contexts where questions about Indigenous re-engagement and decolonisation strategies are being debated and will be of interest to students and scholars of Museum Studies, Indigenous Studies and Anthropology"--

Abstract: "This book examines the everyday judicial experience in four multicultural jurisdictions as a means of exploring the relationship between legal systems and cultural identities. Increasing social heterogeneity has deeply affected legal systems as courts and parliaments must now deal with a growing rate of cases concerning cultural pluralism. Headline grabbing disputes usually concern challenges to fundamental rights and principles which may be put at risk by some religious or cultural practices. These are difficult issues questioning the compatibility between some cultural and religious practices and constitutional values. However, much of the interaction between law and cultural pluralism also concerns daily life activities, which do not necessarily challenge fundamental rights. This book deals with food, clothing and days of rest: three expressions of both human needs and identity, which are based on ethnic origin, tradition, culture, religion or, simply, taste. The volume looks at the intersection between these choices and constitutional rights such as religious liberty, or freedom of expression. It aims to understand how the state legal system deals with them and when non-mainstreaming behaviours are accommodated. Four legal systems are taken into consideration: the United States of America, Canada, Franc, and Italy, exploring similarities and differences in facing cultural diversity around these quotidian issues. The book pays particular attention to the places where diversity is most apparent and also considers the choices that are not based on religious precepts, but rather on "personal philosophy". The book will be of interest to researchers, academics and policy-makers working in the areas of Constitutional Law, Law and Cultural Diversity, Human Rights, Minority Rights and Discrimination Law"--

Abstract: "Mobilities in Remote Places explores the meanings, challenges, and opportunities of remoteness as practiced and experienced by those who live and work in some of the world's most remote communities. As mobilities around the world proliferate in countless forms, the meanings of remoteness undergo significant change. Places once considered impossibly distant have appeared to become closer, more accessible, and less distinct from global centres of geopolitical power. But instead of disappearing altogether, configurations of remoteness evolve, manifesting themselves through new possibilities, new challenges, and new insecurities. Drawing from a variety of case studies from around the globe, the book's contributors examine remoteness as an outcome of evolving mobility constellations. Rather that defining remoteness as an absolute or objective time-distance condition, the book shows how remoteness is a practice, experience, and representation that is situated, relational, and emergent. This collection of original and thought-provoking chapters will be of interest to students and researchers in the humanities and social sciences with an interest in mobilities, place, and human geography"--

Abstract: "Security, Religion, and the Rule of Law argues that true, substantive, and sustainable national security is only possible through respect for the rule of law, human rights, and religious freedom. Despite the emphasis on national security and the war on terror that has preoccupied governments for over two decades, nations-and the world-seem to be more divided than ever, with a concomitant impact of increasing the risk of terrorism and religious and political violence. The national security paradigm, previously reserved primarily for foreign threats, has been turned increasingly inwards, focussing on a state's own citizens as potential threats. This is often along religious lines, threatening fundamental human freedoms. This book provides a series of critical engagements on some of the most pressing issues at the interface of religion and security today, including: proposing a deeper engagement with theology when dealing with freedom of religious belief; exploring a better understanding between domestic peace and international relations; abiding by the rule of law while countering terrorism; and developing a broader understanding of identities and of the nature of citizenship. It provides the resources to further reflect upon and address these topics, as well as stimulating further discussions on religion and security matters across a range of different disciplines. Wide-ranging case studies consider Australia, China, Europe, the Kurdish people, Nigeria, Russia, Ukraine, the United Nations, and the United States. This book will appeal to students and scholars across a range of disciplines, including international relations, law, philosophy, political science, religious studies, security studies, and theology. It will also appeal to human rights lawyers, judges, NGO researchers, governmental agency specialists, and policy makers"--

Abstract: "This book explores African domestic and regional responses and approaches to environmental protection and sustainability. Written by African and international experts, the collection consists of five parts covering the whole of Africa. It provides broad coverage of specific themes, including environmental constitutionalism, climate change, gender and the environment, wildlife trade, environmental justice, and human displacement. The key aims are, first, to explore theoretical and empirical studies to interrogate and provide clarity on academic discourse on how and whether environmental human rights approaches and policy implications have effectively enhanced environmental protection and sustainability at African domestic levels. Second, to investigate and present innovative solutions on how African domestic legal regimes deal with environmental justice, natural resources governance, refugees' environmental rights, and climate-induced displaced persons. Finally, to propose innovative legal and institutionalised solutions to Africa's ecological realities by determining the legal and regulatory gaps on environmental-human rights issues on the continent. The collection will be a valuable resource for researchers, academics and policymakers in human rights law, environmental law, political science, ecology and conservation, environmental management, disaster management, and development studies"--

Abstract: "This book focuses on the testimonial evidence of traumatised witnesses in trials of international crimes, which deal with acts of genocide, war crimes and crimes against humanity. Such trials often involve the testimonies of those who experienced or witnessed extremely traumatic events, which can make it hard for these witnesses to recall specific details. Testifying during trial may in itself also pose challenges to their well-being. Yet the legal process of determining whether someone can be held criminally responsible for the alleged crimes needs to be fair, in accordance with the right to a fair trial of the accused, and the facts need to be determined as accurately as possible. This book argues that to ensure fair and accurate fact-finding when in particular traumatised witnesses testify, a balance needs to be struck between the needs of witnesses who testify about traumatic experiences, the fair trial rights of the accused, and the objective of the court to establish as accurately as possible the responsibility of the accused. This is crucial throughout the stages of selecting, preparing, presenting and assessing the testimonial evidence of traumatised witnesses. The methodology involves an analysis of transcripts of proceedings and case law of the International Criminal Tribunal for the former Yugoslavia, the International Criminal Court, and Dutch courts prosecuting international crimes. The research demonstrates that it is often difficult to strike a balance between the competing objectives during proceedings when traumatised witnesses testify due to the current lack of regulations and guidelines applicable during investigations and prosecutions. This book shows that this balance can, and should, be achieved when traumatised witnesses testify during criminal proceedings for international crimes. The work is an invaluable resource for researchers, academics and practitioners in criminal law, criminology, legal-psychology, legal-psychiatry, social anthropology and forensic sciences"--
