Abstract: International human rights law has expanded remarkably since the 1990s. It is therefore more important than ever to identify, beyond specific controversies, its deeper structure and the general pattern of evolution. Moreover, it has a logic of its own: though part of international law, it borrows many of its principles from domestic constitutional law. This leading textbook meets both challenges. It has been significantly updated for the new third edition, introducing sections on subjects including business and human rights, amongst other key areas. Features include forty new cases from various jurisdictions or expert bodies, and figures offering visual descriptions of the procedures discussed in the text. The 'questions for discussion' have also been systematically updated. The text retains its student-friendly design, and the features which made the previous editions so engaging and accessible remain. This popular textbook continues to be an essential tool for all students of human rights law.

Abstract: "Religious freedom has become an emblematic value in the West. Embedded in constitutions and championed by politicians and thinkers across the political spectrum, it is to many an absolute value, something beyond question. Yet how it emerged, and why, remains widely misunderstood. Tracing the history of religious persecution from the Fall of Rome to the present-day, [the authors] provide an...explanation of the birth of religious liberty. This book treats the subject in an integrative way by combining economic reasoning with historical evidence from medieval and early modern Europe. The authors elucidate the economic and political incentives that shaped the actions of political leaders during periods of state building and economic growth."--

Abstract: "Since Marcel Mauss published his foundational essay The Gift in 1925, many anthropologists and specialists of international relations have seen in the exchange of gifts, debts, loans, concessions or reparations the sources of international solidarity and international law. Still, Mauss's reflections were deeply tied to the context of interwar Europe and the French colonial expansion. Their normative dimension has been profoundly questioned after the age of decolonization. A century after Mauss, we may ask: what is the relevance of his ideas on gift exchanges and international solidarity? By tracing how Mauss's theoretical and normative ideas inspired prominent thinkers and government officials in France and Algeria, from Pierre Bourdieu to Mohammed Bedjaoui, Gregoire Mallard adds a building block to our comprehension of the role that anthropology, international law, and economics have played in shaping international economic governance from the age of European colonization to the latest European debt crisis. Abstract: "What is the purpose of comparative constitutional law? Comparing constitutions allows us to consider the similarities and differences in forms of government, and the normative philosophies behind constitutional choices. Constitutional comparisons offer "hermeneutic" help: they enable us to see "our" own constitution with different eyes and to locate its structural and normative choices by references to alternatives evident in other constitutional orders"--

Abstract: The expectation of reciprocity continues to be an important factor when states' consider their legal obligations in armed conflicts. In this monograph, Peeler looks at the text and negotiations around the 1949 Geneva Conventions and the Protocols Additional to the Geneva Conventions from 1977 to demonstrate the many places where international humanitarian law maintains expectations of reciprocity. This complements an examination of US policy regarding its Prisoner of War obligations in both the Vietnam War and the Global War on Terror, demonstrating how states make use of the expectation of reciprocity found in international humanitarian law to respond to continued non-compliance by an enemy.

Abstract: "This book examines the perception of European Union's identity by the main actors in international relations. Analysing issues related to public discourse in third countries as demonstrated by, amongst others, their political elites, civil society, and think-tanks, the book highlights a 'normative gap' with regards to the European Union's self-definition/perception and its perception in the international environment. It also shows that the European Union's perception of normative power in international relations is not shared consistently by the main principal actor yet is differentiated relative to geographical area and scope of activities undertaken by the EU. It demonstrates that the perception of the EU's normative identity is a source of the crisis of the European Union as an effective and significant player in the international arena. This book will be of key interest to scholar and students of European Union politics, European politics/studies, European integration, identity politics, and international relations"--

Abstract: "Cultural rights constitute one of the most exciting new frontiers of human rights research and practice. Cultural rights are also the ultimate law and humanities topic. These are good enough reasons for making cultural rights the main focus of a book. But there are other reasons, too. Cultural rights are both transformative and empowering rights. They enable people to aspire to a better future for themselves, their families, and the society in which they live, and they play a key role in realizing all other human rights. Furthermore, they provide a much-needed discourse or common forum in which we can explore, negotiate, and come to new cross-cultural understandings. All of this is supremely important today, at a time when respect for cultural diversity is a key concern worldwide, and when migration and advances in technology are increasing the level of cultural exchange but also fostering cultural clashes and incompatibilities previously masked by distance"--

Abstract: "The metaphor of 'dialogue' has been used to describe and evaluate institutional interactions and constitutional arrangements involving many of the most fundamental questions concerning democracy and rights. It has been put to a variety of descriptive and evaluative uses by constitutional and political theorists concerned with understanding interactions between democratic institutions, particularly interactions concerning rights. But it has also featured prominently in the opinions of courts, and even the rhetoric and deliberations of legislators. This volume brings together many of the world's leading constitutional and political theorists -both proponents and critics of dialogue theory. Together, they debate the nature and merits of constitutional dialogues between the judicial, legislative, and executive branches, explore dialogue's democratic and republican significance, examine its relevance to the functioning and design of different constitutional institutions, examine rights dialogues in specific constitutional contexts and cases of dialogue concerning certain rights, and explore constitutional dialogues from an international and transnational perspective".

Abstract: Der Liberalismus ist in Verruf geraten.

Abstract: This handbook is a detailed reference source comprising original articles covering the origins, history, theory and practice of Islamic law. The handbook starts out by dealing with the question of what type of law is Islamic law and includes a critical analysis of the pedagogical approaches to studying and analysing Islamic law as a discipline. The handbook covers a broad range of issues, including the role of ethics in Islamic jurisprudence, the mechanics and processes of interpretation, the purposes and objectives of Islamic law, constitutional law and secularism, gender, bioethics, Muslim minorities in the West, jihad and terrorism. Previous publications on this topic have approached Islamic law from a variety of disciplinary and pedagogical perspectives. One of the original features of this handbook is that it treats Islamic law as a legal discipline by taking into account the historical functions and processes of legal cultures and the patterns of legal thought. With contributions from a selection of highly regarded and leading scholars in this field, the Routledge Handbook of Islamic Law is an essential resource for students and scholars who are interested in the field of Islamic Law

Abstract: "The exposition of international law as a belief system is meant to serve critique and should be read as an invitation to international lawyers to temporarily suspend their belief system and unlearn some of their knowledge and sensibilities about the fundamental doctrines that they have been trained to reproduce and respond to. Exposing and suspending the international belief system constitutes the ambition of the discussion that follows"--

Abstract: "The age-old debate about what constitutes just punishment has become deadlocked. Retributivists continue to privilege desert over all else, and consequentialists continue to privilege punishment's expected positive consequences, such as deterrence or rehabilitation, over all else. In this important intervention into the debate, Leo Zaibert argues that despite some obvious differences, these traditional positions are structurally very similar, and that the deadlock between them stems from the fact they both oversimplify the problem of punishment. Proponents of these positions pay insufficient attention to the conflicts of values that punishment, even when justified, generates. Mobilizing recent developments in moral philosophy, Zaibert offers a properly pluralistic justification of punishment that is necessarily more complex than its traditional counterparts. An understanding of this complexity should promote a more cautious approach to inflicting punishment on individual wrongdoers and to developing punitive policies and institutions"--

Abstract: Socio-centric societies have vibrant-albeit different-concepts of human flourishing than is typical in the individualistic West. These concepts influence the promotion of human rights, both in domestic contexts with religious minorities and in international contexts where Western ideals may clash with local norms. Human Rights in Thick and Thin Societies uncovers the original intentions of the drafters of the Universal Declaration of Human Rights, finds inspiration from early leaders in the field like Eleanor Roosevelt, and examines the implications of recent advances in cultural psychology for understanding difference. The case studies included illustrate the need to vary the application of human rights in differing cultural environments, and the book suggests a new framework: a flexible universalism that returns to basics-focusing on the great evils of the human condition. This approach will help the human rights movement succeed in a multipolar era.

Abstract: "Self-Determination in Disputed Colonial Territories addresses the relationship between self-determination and territorial integrity in some of the most difficult decolonization cases in international law. It investigates historical cases, such as Hong Kong and the French and Portuguese territories in India, as well as cases that remain very much alive today, such as the Western Sahara, Gibraltar, the Falkland Islands and the Chagos Islands. This book provides a comprehensive analysis of colonial territories that are, or have been, the subject of adverse third-party claims, invariably by their neighbouring states. Self-Determination in Disputed Colonial Territories takes a contextual, historical approach to mapping the existing law and will be of interest to international lawyers, as well as scholars of international relations and students of the history of decolonization"--

Territorial integrity, irredentist claims, and the identification of self-determination Units; 4. Is there a 'colonial enclaves' exception to the self-determination rule?; 5. Overall conclusions

Abstract: "In this work, Professors Rosenfeld and Mancini have brought together an impressive group of authors to provide a comprehensive analysis on the greater demand for religions exemptions to government mandates. Traditional religious conscientious objection cases, such as refusal to salute the flag or to serve in the military during war, had a diffused effect throughout society. In sharp contrast, these authors argue that today's most notorious objections impinge on the rights of others, targeting practices like abortion, LGTBQ adoption, and same-sex marriage. The dramatic expansion of conscientious objection claims have revolutionized the battle between religious traditionalists and secular civil libertarians, raising novel political, legal, constitutional and philosophical challenges. Highlighting the intersection between conscientious objections, religious liberty, and the equality of women and sexual minorities, this volume showcases this political debate and the principal jurisprudence from different parts of the world and emphasizes the little known international social movements that compete globally to alter the debate's terms"--
Abstract: "Rethinking the Balance between Religion, Identity, and Equality Introduction: The New Generation of Conscience Objections in Legal, Political and Cultural Context Susanna Mancini and Michel Rosenfeld I. The New Conscientious Objection versus the Old The new generation of conscience based objections differs sharply from its predecessors in that it involves claims that are interventionist and intrusive as opposed to claims aimed at withdrawal and absence from discrete areas of mainstream collective undertakings. Typical of the past, are conscientious objectors who sought to be excused from serving in the military or from going to war, or else from pledging allegiance to their country's flag in public gatherings. In contrast, today's most notorious conscientious objectors seek exemption from generally applicable laws requiring employers to provide contraception coverage in the medical insurance benefits they must extend to their women employees; or from providing services offered to the general public, such as cakes or flowers for wedding celebrations or hotel rooms with large beds, to individuals belonging to sexual minorities; or from issuing marriage or civil union licenses in their capacity as state employees to same-sex couples"--

Abstract: "Technical standards are ubiquitous in the modern networked economy. They allow products made and sold by different vendors to interoperate with little to no consumer effort and enable new market entrants to innovate on top of established technology platforms. This groundbreaking volume, edited by Jorge L. Contreras, assesses and analyzes the legal aspects of technical standards and standardization. Bringing together more than thirty leading international scholars, advocates, and policymakers, it focuses on two of the most contentious and critical areas pertaining to standards today in key jurisdictions around the world: antitrust/competition law and patent law. (A subsequent volume will focus on international trade, copyright, and administrative law.) This comprehensive, detailed examination sheds new light on the standards that shape the global technology marketplace and will serve as an indispensable tool for scholars, practitioners, judges, and policymakers everywhere"--

Abstract: "This volume contains a collection of papers presented at the twenty-second British Legal History Conference held at the University of Reading. The conference coincided with the 800th anniversary of Magna Carta; the conference was thus concerned not only with Magna Carta itself but also with its enduring legacy. The theme around which this legacy is explored is that of challenges to authority and how these challenges result in the recognition of rights. Magna Carta now occupies a quasi-mythical status - particularly within common law jurisdictions - as an instrument which gave people liberty. Lord Denning described it as 'the greatest constitutional document of all times... the spirit of individual liberty which has influenced our people ever since'. Such a description omits the struggle which gave rise to these rights"--

Abstract: "Transitional justice is the dominant lens through which the world grapples with legacies of mass atrocity, and yet it has rarely reflected the diversity of peace and justice traditions around the world. Hewing to a largely Western and legalist script, truth commissions and war crimes tribunals have become the default means of "doing justice." Rethinking Transitional Justice for the Twenty-First Century puts the blind spots and assumptions of transitional justice under the microscope and asks whether the field might be re-imagined to better suit the diversity and realities of the twenty-first century. At the core of this reimagining is an examination of the broader field of post conflict peace building and associated critical theory, from which both caution and inspiration can be drawn. By using this lens, Dustin N. Abstract: As Europe deals with a so-called 'refugee crisis', Australia's harsh border control policies have been suggested as a possible model for Europe to copy. Key measures of this system such as long-term mandatory detention, intercepting and turning boats around at sea, and the extraterritorial processing of asylum claims were actually used in the United States long before they were adopted in Australia. The book examines the process through which these policies spread between the United States and Australia and the way the courts in each jurisdiction have dealt with the measures. Daniel Ghezelbash's innovative interdisciplinary analysis shows how policies and practices that 'work' in one country might not work in another. This timely book is a must-read for those interested in preserving the institution of asylum in a volatile international and domestic political climate.

Abstract: "The important aspects of human wellbeing outlined in human rights instruments and constitutional bills of rights can only be adequately secured as and when they are rendered the object of specific rights and corresponding duties. It is often assumed that the main responsibility for specifying the content of such genuine rights lies with courts. Legislated Rights: Securing Human Rights through Legislation argues against this assumption, by showing how legislatures can and should be at the centre of the practice of human rights. This jointly authored book explores how and why legislatures, being strategically placed within a system of positive law, can help realise human rights through modes of protection that courts cannot provide by way of judicial review"--

Abstract: "In recent times there has been a dramatic change in the nature and scope of constitutional justice systems in the global south. New or reformed constitutions have proliferated, protecting social, economic, and political rights. While constitutional courts in Latin America have traditionally been used as ways to limit power and preserve the status quo, the evidence shows that they are evolving into a functioning part of contemporary politics and a central component of a system of constitutional justice. This book lays bare the political roots of this transformation, outlining a new way to understand judicial design and the very purpose of constitutional justice. Authors Daniel M. Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
Abstract: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

Abstract: "Which mistake is worse: to deny a refugee claim that should have been granted, or to grant a claim that should have been denied? The law that governs fact-finding in any legal domain is built on a judgment about which potential error a decision-maker should prefer. Decisions to grant or deny refugee protection often hinge on findings of fact, yet refugee law has not engaged with this question. This hole in the law's foundations may well be undermining refugee protection across the globe, for as this book intends to show, it is contributing daily to the dysfunction of one the world's most respected refugee determination systems"--

Abstract: This Companion provides a broad, historically informed introduction to the study of the US constitutional system. In place of the usual laundry lists of cases, doctrines, and theories, it presents a picture of the constitutional system in action, with separate sections devoted to constitutional principles, organizational structures, and the various legal and extra-legal 'actions' through which litigators and average citizens have attempted to bring about constitutional change. Finally, the volume covers a number of subjects that are rarely discussed in works aimed at a general audience, but which are critical to ensuring that constitutional rights are honored in the day-to-day lives of citizens. These include standing and causes of action, suits against officeholders, and the inner workings of the Foreign Intelligence Surveillance Court (FISC). This Companion places present-day constitutional controversies in historical context, and offers insights from a range of disciplines, including history, political science, and law.

Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

Abstract: The founding of a constitutional court is often an indication of a chosen path of constitutionalism and democracy. It is no coincidence that most of the constitutional courts in East and Southeast Asia were established at the same time as the transition of the countries concerned from authoritarianism to liberal constitutional democracy. This book is the first to provide systematic narratives and analysis of Asian experiences of constitutional courts and related developments, and to introduce comparative, historical and theoretical perspectives on these experiences, as well as debates on the relevant issues in countries that do not as yet have constitutional courts. This volume makes a significant contribution to the systematic and comparative study of constitutional courts, constitutional adjudication and constitutional developments in East and Southeast Asia and beyond

Abstract: "As religious polarisation in society deepens, political actors and policy-makers have begun to struggle with questions on the role of the dominant religion and how religion influences constitutional commitments and development. By focusing on Indonesia, Malaysia and Sri Lanka, Constitutions, Religion and Politics in Asia demonstrates how constitution-making and the operation of constitutional arrangements involving religion cannot be separated from the broader political dynamics of society. Although constitutions establish legal and political structures of government institutions and provide tools for rights protection, they do not operate in a vacuum divorced from the games of power and the political realities surrounding them. Here, Shah sets out how constitutions operate and evolve and demonstrates how constitutional provisions can produce unintended consequences over time. A vital new source of scholarship for students and scholars of law and religion and comparative constitutional law, and those interested in issues of constitutionalism and legal and political history in Asia"--

Abstract: "Courts Without Borders is the first book to examine the politics of judicial extraterritoriality-the practice of domestic courts unilaterally applying domestic laws to conduct and persons outside a state's borders-and its consequences with a focus on the world's chief practitioner: the United States. For much of the post-World War II era, the United States has been a frequent yet selective regulator of activities outside its territory. U.S. federal courts are often on the front line in battles over the extraterritorial reach of U.S. law, enabling it in some instances and restricting it in others"--

For much of the post-World War II era, the United States has been a frequent yet selective regulator of activities outside its territory, and US federal courts are often on the front line in deciding the extraterritorial reach of US law. At stake in these jurisdiction battles is the ability to bring the regulatory power of the United States to bear on transnational disputes in ways that other states frequentlydislike both in principle and in practice. This volume proposes a general theory of domestic court behaviorto explain variations in extraterritorial enforcement of US law, emphasizing how the strategic behavior of private actors is important to mobilizing courts and in directing their activities"--

Januar 2017 in Oxford.

Abstract: Die hier versammelten Texte aus Niklas Luhmanns letzter Schaffensphase stellen sein Theorievermächtnis dar.

Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world
