This reflected the participation of policymakers and civil society activists in global discourses of child saving and the new opportunities of governance under the constitutional reforms of 1919.     Abstract: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

Given that the cost of private secondary education is now in the region of £50,000 a year and the cream of Comprehensive Schools are now oversubscribed (William Ellis, Camden School for Girls, The Oratory, Cardinal Vaughan), parents are spending thousands on private tutoring and fee-paying prep schools in order to get their children into these academically excellent schools. Meanwhile hypocritical Labour politicians like Diane Abbott send their children to expensive private day schools. So, what alternatives - if any - are there? Peter Hitchens argues that in trying to bring about an educational system which is egalitarian, the politicians have created a system which is the exact opposite. And what's more, it is a system riddled with anomalies - Sixth Form Colleges select pupils on ability at the age of 15, which rules out any child who does not have major educational backing from home (heavy involvement by working parents or private tutors, for example) and academies also are selective, though they pretend not to be. This is an in-depth look at the British education system and what will happen if things don't change radically."

    Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: "This book identifies and examine the changing roles of Nigerian women: in the family, educational attainment and society as experienced and expressed by a sample of educated, Nigerian women. Five of the participants were children caught in Biafran (Nigerian) war and their education was interrupted during the war. All struggle to gain education as girls and women growing up in Nigeria in families with sometimes limited resources. The book is based on the assumption that changes are taking place at all levels of Nigerian society, and that these changes are reflected in the way Nigerian women think and express views about themselves and their extended families. Nine Nigerian women resident in Egypt, were interviewed in depth using the 'topical life history' method to reveal their attitudes and perceptions concerning the woman's role in the family. In lengthy, free form, non-directive interviews, the participants recount their life histories from small children to the present day, and in this process comment and reveal their feelings about personal, family and social issues. Based on a literature review some eight hypotheses are identified and examined concerning these issues and the participants' views about them. The response data are grouped under the hypotheses and analyzed. Conclusions suggest changing role patterns of women as expressed by these women from lower- and middle-class families, concerning education male and female children, bearing progeny, polygamy, earning income to provide for the family, marriage, male domination and influences and pressures from the extended family"--

    Abstract: Dispersal, or 'bussing', was introduced in England in the early-1960s after white parents expressed concerns that the sudden influx of non-Anglophone South Asian children was holding back their own children's education. It consisted of sending busloads of mostly Asian children to predominantly white suburban schools in an effort to 'spread the burden' and to promote linguistic and cultural integration. Although seemingly well-intentioned dispersal proved a failure: it was based on racial identity rather than linguistic deficiency and ultimately led to an increase in segregation, as bussed pupils were daily confronted with racial bullying in dispersal schools. This is the first ever book on English bussing, based on an in-depth study of local and national archives, alongside interviews with formerly bussed pupils decades later. --

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: This volume in honour of Stephen Ellis is a follow-up to the public presentation of his book on the history of organised crime in Nigeria This Present Darkness (Hurst, 2016) at the University of Lagos, Nigeria on 28 October 2016. In addition to four papers, and a book review presented at this colloquium, other contributions about crime in Nigeria have been added, written by Nigerian authors. In July 2015 Stephen died, and he has worked on This Present Darkness almost to his last moments, as a senior researcher of the African Studies Centre in Leiden.     Abstract: Memory is as central to modern politics as politics is central to modern memory. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena. In this volume, leading historians, anthropologists, and ethnographers explore the relationship between collective memory and national identity in diverse cultures throughout history. Placing commemorations in their historical settings, the contributors disclose the contested nature of these monuments by showing how groups and individuals struggle to shape the past to their own ends.     Abstract: The Oxford Handbook of the Ends of Empire offers the most comprehensive treatment of the causes, course, and consequences of the ends of empire in the twentieth century. The volume's contributors convey the global reach of decolonization, with chapters analysing the empires of Western Europe, Eastern Europe, China and Japan. The Handbook combines broad, regional treatments of decolonization with chapter contributions constructed around particular themes or social issues. It considers how the history of decolonization is being rethought as a result of the rise of the 'new' imperial history, and its emphasis on race, gender, and culture, as well as the more recent growth of interest in histories of globalization, transnational history, and histories of migration and diaspora, humanitarianism and development,0and human rights. The Handbook, in other words, seeks to identify the processes and commonalities of experience that make decolonization a unique historical phenomenon with a lasting resonance. In light of decades of historical and social scientific scholarship on modernization, dependency, neo-colonialism, 'failed state' architectures and post-colonial conflict, the obvious question that begs itself is 'when did empires actually end?'     Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent.     Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Abstract: "This is the first book to survey the experience of servants in rural Europe from the fifteenth to the nineteenth century. Live-in servants were a distinctive element of early modern society. They were typically young adults aged between 16 and 24 who lived and worked in other people's households before marriage. Servants tended to be employed for long periods, several months to years at a time, and were paid with food and lodging as well as cash wages. Both women and men worked as servants in large numbers. Unlike domestic servants in towns and wealthy households, rural servants typically worked on farms and were an important element of the agricultural workforce. Historians have viewed service as a distinct life-cycle stage between childhood and marriage. It brought both freedom and servility for young people. It allowed them to leave home and earn a living before marriage, whilst learning a range of agricultural and craft skills which reduced their dependence on their parents and increased their choice in marriage partners. Still, servants had limited rights: they were under the authority of their employer, with a similar legal status to children. In many countries the employment of servants was tightly controlled by law. Servants could demand their wages, and leave when the contract ended, but had to work long hours and had little say in their work tasks during employment. While some servants effectively became family members, trusted and cared for, others were abused physically and sexually by their employers."--Back cover

    Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

    Abstract: Taxing the Rich draws on unparalleled evidence from twenty countries over the last two centuries to provide the broadest and most in-depth history of progressive taxation available. Scheve and Stasavage explore the intellectual and political debates surrounding the taxation of the wealthy while also providing the most detailed examination to date of when taxes have been levied against the rich and when they haven't. Fairness in debates about taxing the rich has depended on different views of what it means to treat people as equals and whether taxing the rich advances or undermines this norm. Scheve and Stasavage argue that governments don't tax the rich just because inequality is high or rising--they do it when people believe that such taxes compensate for the state unfairly privileging the wealthy. Progressive taxation saw its heyday in the twentieth century, when compensatory arguments for taxing the rich focused on unequal sacrifice in mass warfare. Today, as technology gives rise to wars of more limited mobilization, such arguments are no longer persuasive. Taxing the Rich shows how the future of tax reform will depend on whether political and economic conditions allow for new compensatory arguments to be made. (Publisher's Web site)

    Abstract: This unique publication offers a complete history of Roman law, from its early beginnings through to its resurgence in Europe where it was widely applied until the eighteenth century. Besides a detailed overview of the sources of Roman law, the book also includes sections on private and criminal law and procedure, with special attention given to those aspects of Roman law that have particular importance to today's lawyer. The last three chapters of the book offer an overview of the history of Roman law from the early Middle Ages to modern times and illustrate the way in which Roman law furnished the basis of contemporary civil law systems. In this part, special attention is given to the factors that warranted the revival and subsequent reception of Roman law as the ‘common law’ of Continental Europe. Combining the perspectives of legal history with those of social and political history, the book can be profitably read by students and scholars, as well as by general readers with an interest in ancient and early European legal history. The civil law tradition is the oldest legal tradition in the world today, embracing many legal systems currently in force in Continental Europe, Latin America and other parts of the world. Despite the considerable differences in the substantive laws of civil law countries, a fundamental unity exists between them. The most obvious element of unity is the fact that the civil law systems are all derived from the same sources and their legal institutions are classified in accordance with a commonly accepted scheme existing prior to their own development, which they adopted and adapted at some stage in their history.     Abstract: This book presents an analysis of global legal history in Modern times, questioning the effect of political revolutions since the 17th century on the legal field. Readers will discover a non-linear approach to legal history as this work investigates the ways in which law is created. These chapters look at factors in legal revolution such as the role of agents, the policy of applying and publicising legal norms, codification and the orientations of legal writing, and there is a focus on the publicization of law. The author uses Herbert Hart’s schemes to conceive law as a human artefact or convention, being the union between primary rules of obligations and secondary rules conferring powers. Here we learn about those secondary rules and the legal construction of the Modern state, and we question the extent to which codification and law reporting were likely to revolutionize the legal field. These chapters examine the hypothesis of a legal revolution that could have concerned many countries in modern times. To begin with, the book considers the legal aspect of the construction of Modern States in the 17th and 18th centuries. It goes on to examine the consequences of the codification movement as a legal revolution before looking at the so-called “constitutional” revolution, linked with the extension of judicial review in many countries after World War II. Finally, the book enquires into the construction of an EU legal order and international law. In each of these chapters, the author measures the scope of the change, how the secondary rules are concerned, the role of the professional lawyers and what are the characters of the new configuration of the legal field. This book provokes new debates in legal philosophy about the rule of change and will be of particular interest to researchers in the fields of law, theories of law, legal history, philosophy of law and historians more broadly

    Abstract: The 20th century saw an unprecedented number of major wars, conflicts, and massive human rights violations. From each emerged the desire to make sense of the recent past (and present) by imagining new ways of dealing with such events. In order to prevent new forms of violence, or to punish the persons responsible of past horrors, various solutions have been imagined, deployed, implemented, and discussed, at different levels. This book is a reflection on the social and historical construction, appropriation, and circulation of categories, norms, and savoir-faire related to the ways social groups and institutions-state, judiciary, professional organizations-confront traumatic events. Even if there is a robust literature on purges and other mechanisms intended to deal with an authoritarian or violent past, written by authors belonging to numerous disciplines and exploring different periods and topics with a variety of theoretical and methodological backgrounds, our goal was to propose a more sociologically oriented model of analysis. Far from being only an intellectual frenzy, this orientation appears to be less normative than most “post-transitional” approaches and potentially more general than strictly monographic approaches. In doing so, our objective is not only to provide a critical approach, but also to sustain a more realistic view of this highly political and moral domain
