    Abstract: The Commentary on the Treaty on the Functioning of the European Union (four volumes) is a major European project that aims to contribute to the development of ever closer conceptual and dogmatic standpoints with regard to the creation of “Europeanised research on Union law”.     Abstract: The aesthetics of law deals with the relationship between law and beauty by searching for aesthetic values in the law itself (an internal perspective), by finding material related to law in art and culture (an external perspective), and, lastly, by demonstrating the impact of legal norms on what can be broadly understood as beauty (law as a tool of aestheticization). Regarding all these phenomena, the aesthetics of law ultimately allows us to see the law more clearly and more profoundly. What is more, the law does not function, nor has it ever functioned, separately from its means of expression, which are incontrovertibly subject to aesthetic interpretation. If we think about law in this way, perceiving not only the message, but also the manner in which it is conveyed, the whole set of means and tools used, the perfection and beauty of the form, then we will see art in it. After all, the widely known and still applicable ancient maxim ius est ars boni et aequi equates law and art. This alone should be an argument for aesthetic reflection on the law, a field of endeavour that should never have been abandoned. The book’s twenty-three chapters, written by scholars from various countries and three continents, are thematically diverse. In them we present the manifestations of the aesthetics of law from an external perspective. If we accept a definition of the concept of law that is as broad as possible, not only as a synonym of a certain formalized normative system, but also including the process of its creation (legislation), its application and interpretation (jurisprudence), and even teaching on and research into it (doctrine), we can identify a wealth of aesthetic references in the law. A broadly understood aesthetics of law, approached solely from an external perspective, covers such disciplines as law and literature, the aesthetics of legal rhetoric, the trial as performance, the aesthetics of courthouse architecture, law in the fine arts, law in film, law and music, pictorial law, symbols of the law and legal symbols, symbols of the state and power, legal archaeology etc. The field of research is, therefore, wide. In addition to topics traditionally and obviously associated with the aesthetics of law, such as law and literature, law in the fine arts, and court rhetoric, there are chapters on e.g. legal ethics and trademarks. All authors share the belief that beauty in law is important, even when it is hidden in a caricature. Further, they argue for restoring the aesthetics of law to its proper place in philosophical and legal discourse, as doing so would yield a host of benefits for the addressees of law.

    Abstract: This book celebrates and explores some philosophical issues raised by the work of Alan Weir, who is Professor Emeritus at the University of Glasgow, having previously held positions at the Universities of Oxford, Edinburgh and Queen’s, Belfast. In a number of areas, Weir has elaborated strikingly original views which involve a radical departure from the mainstream. These include formalism in the philosophy of mathematics, and as well as naïve set theory, with a universal set, and a naïve theory of truth. In contrast to other contemporary defenders of the latter two theories, Weir rejects dialetheism and accepts classical rules for the logical connectives. He avoids contradictions by restricting certain structural inference rules, specifically some generalized versions of transitivity. In addition, Weir has developed radical versions of naturalism and physicalism (partly informed by his work on Quine) and perceptual realism. This collection includes contributions by a distinguished group of philosophers on Weir’s philosophy, as well as a memoir and a new essay on the philosophy of mathematics by Weir himself.

    Abstract: The book shows that the Regulation pursues its objective of ensuring greater equality of competitive conditions on the EU´s Internal Market only by accepting new bureaucracy, establishing the need for complex and extensive assessments and raising considerable legal uncertainties as a result of undefined legal terms and comprehensive Commission discretion. The EU legislators, the Council and the European Parliament, in June 2022 adopted a new regulation that entered into force 12 January 2023: Regulation 2022/2560 on foreign subsidies distorting the internal market. This book analyses the regulation in more detail. To this end, after the brief introduction, its rationale and core contents are first presented. Then, its scope of application is to be explored in more detail, as the Regulation was criticised early on with regard to its compatibility with international law, which has an intense bearing on the substantive and personal scope of application of the Regulation. Subsequently the central regulatory concepts of the Regulation will be presented and then the specific rules for concentrations and public procurement procedures analysed. The conclusion will summarise the findings. In view of the likely backlash from powerful third countries, there is a risk of new distortions to the detriment of EU companies´ activities in third country markets.

The book begins by defining the underlying problem: the abundance of cases in which states have unintentionally violated international law and the law of state responsibility’s apparent silence regarding the juridical consequences of such errors. In turn, it addresses three key areas of state responsibility. First, it explores how mistakes of fact can influence the analysis of attribution in international practice. Second, it addresses the implications of mistakes of fact in identifying “breaches” of international law. This includes a range of case studies, such as state responsibility for accidentally shooting down civilian aircraft or for the accidental killing of civilians on the part of state agents. The idea is to reduce potentially damaging compensatory strategies in the non-paretic leg, by ensuring a proper technology embodiment of the robotic exoskeletons in the nervous system. Upon reviewing control strategies for partial robotic exoskeletons applied to human gait, the book introduces robotic exoskeletons control algorithms, which were developed with the intention to promote gait symmetry by assisting the affected limb of hemiparetic patients according to the movement of the non-paretic leg. This new paradigm aimed at promoting the device's embodiment was expected to counteract the compensation mechanisms, which would become unnecessary and thus disappear. The control strategy relies on the gait phase estimation of the sound leg calculated using an adaptive frequency oscillator and was evaluated on post-stroke patients affected by hemiparetic gait, and the results are described in this book. All in all, this book offers a timely snapshot on control strategies for post-stroke robotic gait assistance. It also presents new findings concerning the role of robotic controllers in the embodiment of such devices, and their implications for new assistance paradigms for people with neurological gait disorders.

    Abstract: Open access. This open-access book discusses vulnerability and the protection-inclusion dilemma of including those who suffer from serious poverty, severe stigma, and structural violence in research. Co-written with representatives from indigenous peoples in South Africa and sex workers in Nairobi, the authors come down firmly on the side of inclusion. In the spirit of leaving no one behind in research, the team experimented with data collection methods that prioritize research participant needs over researcher needs. This involved foregoing the collection of personal data and community researchers being involved in all stages of the research. In the process, the term ‘vulnerability’ was illuminated across significant language barriers as it was defined by indigenous peoples and sex workers themselves. The book describes a potential alternative to exclusion from research that moves away from traditional research methods. By ensuring that the research is led by vulnerable groups for vulnerable groups, it offers an approach that fosters trust and collaboration with benefits for the community researchers, the wider community as well as research academics. Those living in low-income settings, in dire situations that are summarized with the term ‘vulnerability’ know best what their problems are and which priorities they have. To exclude them from research for their own protection is a patronizing approach which insinuates that researchers and research ethics committees know best. The team from this book have shown that minimally risky and minimally burdensome research tailored towards the needs of highly marginalized and stigmatized communities can be scientifically valuable as well as inclusive and equitable.     Abstract: The first book in the series provides the concept of a theoretical redefinition of 'horizontal geographies'. These denote the spatial syntheses as undertaken in various disciplines, whether as regional studies, area studies, new regional geography, and many more. The basis of the redescription is philosophical neopragmatism, which has occasionally been taken up in the spatial sciences, but has never been differentiated into a theory-driven empirical research program. This development of the research program guides the present book. Philosophical neopragmatism, especially as conceptualized by Richard Rorty, focuses in particular on contingency of society, self, and language, which also allows spatial syntheses to be understood not as 'images of reality' but as contingent proposals for redescribing spaces. As a result of the complexity of spatial processes, their horizontal geographic study requires a triangulation of theories, methods, researcher perspectives, data, and the involvement of people without expert special knowledge. To highlight the contingency of the spatial syntheses, the presentation of the results - —here especially graphic and cartographic - —resorts to the attitude of irony. Regarding the six levels of trigangulation, neopragmatism acts as a meta-theoretical orientation framework. Against the background of the complexity of spatial developments on the one hand and to operationalize Rorty's principle of private self-creation and public solidarity on the other hand, Ralf Dahrendorf's concept of life chances is drawn upon. Especially in the differentiation of this concept made in this book, it serves on the one hand for an understanding access of the (also spatial) expression of options and ligatures,, and on the other hand it offers a normative framework for the evaluation of socio-spatial developments. The reference to neopragmatic studies on spatial syntheses conducted to date and evaluated in this book shows the potential of the approach elaborated here in conceptual detail for the first time. .

    Abstract: The book analyzes socioeconomic through the lens of a lawyer. In the past decade the world has witnessed some severe financial and economic crises, espe­cially the financial crisis of 2007-2008 and the crisis caused by the COVID-19 pandemic. The author states that the socio-economic order has in the past four to five decades been thoroughly redesigned, generally favouring models that prio­ritize the free market over the public interest or even, more generally, government operation. He works out that during four to five decades, globalized, capitalist societies are facing a multiplicity of fundamental problems, such as: (1) increasing debt that severely burdens both the private and public sectors; (2) persistent poverty and an ever-increasing polarization between rich and poor, in addition to (3) intractable environmental problems that, fifty years after the Club of Rome's report entitled ‘Limits to growth’ (1972), has dragged the world into what in recent years has been referred to as "climate change." The book explains why all this is the direct result of value choices made from the late Middle Ages onwards, when in the Western world the societal models of that time were increasingly abandoned for a societal model that came to rely on the primacy of economic interests. The book not only subjects the ethical choices but also examines various problems it has caused and probes for possible ways out. This is an open access book.

    Abstract: In the summer of 1928, Kurt Gödel (1906–1978) embarked on his logical journey that would bring him world fame in a mere three years. By early 1929, he had solved an outstanding problem in logic, namely the question of the completeness of the axioms and rules of quantificational logic. He then went on to extend the result to the axiom system of arithmetic but found, instead of completeness, his famous incompleteness theorem that got published in 1931. It belongs to the most iconic achievements of 20th century science and has been instrumental in the development of theories of formal languages and algorithmic computability – two essential components in the birth of the information society. This book explores Gödel’s way from an exceptional high-school student to a firmly established young logician. Essays in Gödel’s hand from the high school show that his central philosophical and scientific convictions were formed early on, before his university studies. Particular emphasis is laid on the course that made Gödel one of the foremost logicians of all times. The scientific biography of young Gödel is followed by English translations from Gödel’s German Gabelsberger shorthand of all his early preserved notebooks on logic and related topics.

    Abstract: This volume presents the various ways in which the study of gender makes a difference in archaeological research, the archaeological academic milieu and the wider public’s thinking about gender and considers avenues of future development. It addresses questions such as why gender matters for archaeology, while examining gender from various angles (including aspects such as subjectivity, embodiment, diet, multifaceted perspectives and intersectionality) and in various periods (prehistory, Ancient Egypt, Roman antiquity, the Middle Ages and the modern and contemporary periods). It also discusses the relationship between archaeology and other academic fields involving the study of gender, as well as representations and debates on gender in the media. The theme ‘gender and change in archeology’ emerged out of concerns voiced within the ‘Archaeology and Gender in Europe’ (AGE) working community of the European Association of Archaeologists (EAA) with respect to the future of gender archaeology. This book unites researchers of gender archaeology from two perspectives: that of gender archaeologists from academic milieus where the study of gender has long been established and who in the meantime came to feel that this avenue of inquiry had become predictable and lost its provocative power, and that of gender archaeologists from countries where this field was only recently introduced and who, while more enthusiastic about the utility of gender archaeology, are concerned with how to disseminate it among skeptical peers. Both groups of archaeologists mainly argue that, four decades on, the study of gender in archaeology is still able to generate considerable change in our understanding of past and present-day societies. The volume is primarily of interest to archaeologists and researchers of gender studies.

    Abstract: This book aims to explore different aspects of networks in relation to the archaeology of buildings. It is divided into three major themes: the trade in materials, the exchange of knowledge (of techniques and/or materials), and the exchange of style. Within each of these themes, two primary aspects are addressed—notably, who were the actors and how did the network function? In medieval and post-medieval Europe, the development of buildings, of style and the use of material, cannot be understood from a local, regional or even national perspective. Not only were the borders different than in modern-day Europe, but the contacts of inhabitants also transcended local and regional boundaries. This volume describes the continuous exchange of aesthetic ideals, technological developments and building materials during this period.     Abstract: This open access book explains how leading business organizations attempt to achieve the responsible and ethical use of artificial intelligence (AI) and other advanced information technologies. These technologies can produce tremendous insights and benefits. But they can also invade privacy, perpetuate bias, and otherwise injure people and society. To use these technologies successfully, organizations need to implement them responsibly and ethically. The question is: how to do this? Data ethics management, and this book, provide some answers. The authors interviewed and surveyed data ethics managers at leading companies. They asked why these experts see data ethics as important and how they seek to achieve it. This book conveys the results of that research on a concise, accessible way. Much of the existing writing on data and AI ethics focuses either on macro-level ethical principles, or on micro-level product design and tooling. The interviews showed that companies need a third component: data ethics management. This third element consists of the management structures, processes, training and substantive benchmarks that companies use to operationalize their high-level ethical principles and to guide and hold accountable their developers. Data ethics management is the connective tissue makes ethical principles real. It is the focus of this book.     Abstract: This open access book investigates whether and how theoretical findings and insights in contemporary art conservation can be translated into the daily work practices of conservators or, vice versa, whether and how the problems and dilemmas encountered in conservation practice can inform broader research questions and projects. For several decades now, the conservation of contemporary art has been a dynamic field of research and reflection. Because of contemporary art’s variable constitution, its care and management calls for a fundamental rethinking of the overall research landscape of museums, heritage institutions, private-sector organizations and universities. At first, this research was primarily pursued by conservation professionals working in or with museums and other heritage organizations, but increasingly academic researchers and universities became involved, for instance through collaborative projects.     Abstract: Networks of today are going through a rapid evolution and there are many emerging areas of information networking and their applications. Heterogeneous networking supported by recent technological advances in low power wireless communications along with silicon integration of various functionalities such as sensing, communications, intelligence and actuations are emerging as a critically important disruptive computer class based on a new platform, networking structure and interface that enable novel, low-cost and high-volume applications. Several of such applications have been difficult to realize because of many interconnection problems.     Abstract: This book focuses on Robert Rosen’s contributions to relational system theory, which is the science of organization and function. This science was originally developed by Nicolas Rashevsky, and further developed by Rashevsky’s student Robert Rosen, and continues to be developed by Rosen’s student A. H. Louie amongst others. Due to its revolutionary character, it is often misunderstood, and to some, controversial. The formal and conceptual setting for Rosen’s relational system theory is category theory. Rosen was the first to apply category theory to scientific problems, outside of pure mathematics, and the first to think about science from the point of view of category theory. To better understand the work of Rosen, this book provides an overview of his theory of modeling, complexity, anticipation, and organism.     Abstract: This book proposes a novel connectionist approach to a challenging topic of language modeling within the context of kernel memory and artificial mind system, both proposed previously by the author in the very first volume of the series, Artificial Mind System—Kernel Memory Approach: Studies in Computational Intelligence, Vol. 1. The present volume focuses on how syntactic structures of language are modeled in terms of the respective composite connectionist architectures, each embracing both the nonsymbolic and symbolic parts. These two parts are developed via inter-module processes within the artificial mind system and eventually integrated under a unified framework of kernel memory. The data representation by the networks embodied within the kernel memory principle is essentially local, unlike conventional artificial neural network models such as the pervasive multilayer perceptron-based neural networks. With this locality principle, kernel memory inherently bears many attractive features, such as topologically unconstrained network formation, straightforward network growing, shrinking, and reconfiguration, no requirement of arduous iterative parameter tuning, construction of transparent and hierarchical data structures, and multimodal and temporal data processing via the network representation. Exploiting these multifacet properties of kernel memory with interweaving the notion of inter-module processing within the artificial mind system provides coherent accounts for concept formation and how various linguistic phenomena, viz. word compoundings, morphologies, and multiword constructions, are modeled. The description is then extended to more intricate network models of context-dependent lexical network and syntactic-oriented processing, the latter being the central theme of the present study, and further to those representing a hybrid of nonverbal and verbal thinking, and semantic and pragmatic aspects of sentential meaning. The book is intended for general readers engaging in various areas of study in cognitive science, computer science, engineering, linguistics, philosophy, psycholinguistics, and psychology.

    Abstract: This book offers a fresh perspective on the Habitats Directive's rules on designating Natura 2000 - the European biodiversity conservation network. Although the Habitats Directive came into force in the early 1990s, the network is not yet optimally set up and lacks coherence and connectivity. The author examines the Habitats Directive’s provisions regarding the designation of Natura 2000 and discusses possible reasons for the EU Member States’ ongoing lack of compliance with their designation duties. She reassesses the 2015 REFIT Fitness Check of the Nature Directives to look for the Member States’ reasons for not having optimally complied with their designation duties yet. She then analyses the Habitats Directive to reveal elements of non-optimal drafting in its designation provisions. Sensible law reforms that do not interfere with the general framework of the Habitats Directive and which keep in mind the relevant national, regional, and international biodiversity law and policy, as well as the relevant case law will be discussed to this end. As a result, this book presents an enhanced legal designation framework that can support Member States’ compliance with their designation obligations. The book finally goes beyond the European biodiversity legislation, also shedding light on the effects of the suggested reforms for the broader biodiversity and environmental law and policy landscape, and concludes that reforming the Habitats Directive would benefit a variety of contemporary areas of law. This book targets academics and policy-makers in the field as it provides a scholarly as well as a hands-on approach to the subject of strengthening European biodiversity law.

    Abstract: This book uses the early twentieth century surveillance reports of urban vice reformers in New York, Chicago, Lancaster, Pennsylvania, as well as the US vice report for the League of Nations’ Special Body on Trafficking in Women and Children (from 1927) and French police memoirs, treatises, and histories of vice enforcement in late nineteenth century and early twentieth century Paris to highlight the way in which American reliance on undercover tactics drove American vice enforcement policy, leading to a clash with French vice enforcement policy before the League of Nations. Both the failure of that early effort to exert international influence on vice enforcement and the American embrace of undercover tactics would set the stage for the later American efforts to promote a global war on drugs. Before the League of Nations, in particular, the American delegation’s notable lack of success in mobilizing European crackdowns on prostitution created a blueprint for how not to project American influence overseas, once American advocates of narcotics interdiction sought to promote a global war on drugs. Yet private reformers’ reliance on undercover tactics to investigate prostitution modeled the investigative tactics on which American law enforcement would come to depend, and which it would later seek to export, as a primary weapon in the war on drugs.

COVID-19 crisis prompted the public authorities to rethink the use of public space in order to develop means of transport that are both efficient and adapted to the health context and their effects on cycling practices in Europe, North, and South America. Its contributors collectively reveal and evidence through policies analysis, mapping, and innovative qualitative analysis bridging video and interviews, how those new infrastructures and policies can be a trigger for change in a context of mobility transition. This book provides an important element on the way local authorities can act in a quicker and more agile way. While some decisions are specific to the context of the beginning of the pandemic, the analysis offers lessons on the way to implement the transition toward a low-carbon mobility, on the importance of processes based on trials and errors, on the political stakes of reallocating road space.

    Abstract: This brief investigates the usefulness of Body-worn videos (BWVs) in non-policing environments. The first study of this kind, this research presents new datasets related to these devices, including: TOCS’ data on assaults and injuries Surveys of frontline members of staff A series of focus groups BWV activation metadata from BWV vendors Surveys with British Transport Police’s criminal justice unit. The data sources for this project span thirteen train operating companies across the UK, varying levels of risk of workplace violence, as well as different types of Public-Facing professionals and different BWV devices. Using a mixed-methods approach, this volume ultimately provides insight into the effectiveness of these devices in preventing and controlling risks of violence in the workplace, and recommendations on how to use them.     Abstract: This book focuses on OLAF, the European Union’s anti-fraud office, and examines the role of and challenges concerning fundamental rights in OLAF’s composite enforcement procedure. The mission of OLAF (Office Européen de Lutte Antifraude) is to fight fraud, corruption and any other illegal activities that affect the financial interests of the European Union. To this end, OLAF carries out administrative investigations, in which it gathers evidence itself, and coordination cases, in which it coordinates the Member States’ investigations. OLAF’s investigation and coordination efforts are conceived of as mere derivatives of other more traditional forms of law enforcement cooperation in which authorities enter into obligations to cooperate with one another, but in which each acts to fulfill these obligations within its own separately identifiable legal order and on the basis of its own law. This system, in its most conventional form, is founded on the notion of territorial sovereignty. If we extend the logic of this approach from enforcement (the ‘sword’) to fundamental rights (the ‘shield’), issues in relation to the latter – and the accompanying responsibility to prevent and/or remedy them – can arise only in individual (sovereign) legal orders. The way in which we view OLAF, as an evolved cognate of traditional forms of law enforcement cooperation, therefore directly dictates which fundamental rights issues enter into the equation, and in which manner. This book proposes an innovative way of looking at OLAF, which we refer to as ‘composite enforcement procedures.’ In this type of procedure, responsibilities for the entirety of enforcement are attributed to inextricably interlinked European Union and Member State legal orders. If we observe OLAF through this new lens, fundamental rights issues that would otherwise go unnoticed come to the forefront. These are issues that arise not in individual legal orders, but rather between or among the European Union and the Member States. This book addresses these fundamental rights challenges and makes concrete recommendations on how they can be addressed and resolved.

    Abstract: This open access book raises some central questions: Do we need moonshot policies to spur innovation and economic growth? What are the risks associated with such policies? Economic turbulence, the COVID-19 pandemic, and mounting environmental concerns have paved the way for a renaissance of targeted industrial policy. In particular, the idea that society should be organized around large missions is gaining momentum among high-income economies.     Abstract: This book reviews China’s strategic pathway over the last 1000 years and considers its prospects for ascending to high-income status by the end of the 21st century. It analyzes why, although China’s chances of joining the global core are sound, they are not outstanding; in addition, it faces mounting challenges, internal and external alike. The argument is presented in the framework of dynamic-strategy theory, which is expounded here in novel form. This exposition includes a wide ranging survey of global history, with a focus on the development of the industrialisation paths of the major economies of today, including a detailed study of Japan's long-run strategic pathway. The book’s closing section presents a scenario-based discussion of China’s potential place in the world in 2100. The analysis implies that China’s zenith is likely to be reached slightly before mid-century, after which its relative economic scale will likely decline. Beyond that general finding, the scenarios investigate the wide range of plausible outcomes that China may experience: a range that the author contends is much wider for China than for nations under-pinned by less complex political-economies.     Abstract: Based on a deliberative democracy, this book uses a hermeneutic-critical methodology to study bibliographical sources and practical issues in order to analyse the possibilities, limits and consequences of the digital transformation of democracy.     Abstract: This open access book provides an overview of urban digital platforms such as Airbnb and Deliveroo, which, along with Amazon, Google, Facebook and other IT companies, constitute by now the infrastructures for other businesses to operate on and for our social life to go on. These platforms serve as standards-based techno-economic systems that simultaneously capture cooperation through remote coordination and organize labor via algorithm management. Based on a three-years research project, this contributed volume outlines a general theory of platform capitalism that conceives these platforms not only as technical devices, but as generative engines that operate at the interface of several aspects, such as digitalization of forms of social cooperation; algorithm-based management of labor and participation; and private and vertical appropriation of profits. These elements are somehow iconic of the capitalist evolution of the last decades, and they open up a reflection on new forms of “primitive accumulation” (in particular regarding data), on the mechanisms used to capture and extract social surplus value, and on the logistic-financial dimensions of capital. Finally, in light of the transformations associated with the COVID-19 pandemic, the authors examine how platforms can evolve into hegemonic organizational structures. Assuming we are all already living in the age of the platform, this book takes a multifaceted approach—combining sociology with urban studies, and political sciences with economics—to grasp the challenges our societies face in terms of ensuring fair economic growth, adequate social protections, and labor rights. It will appeal to anyone interested in digital platforms and how they are changing the organization of labor, urban spaces, and forms of governance.

    Abstract: It is wrong when someone cannot exercise their rights in a court of law because they have no money to pay for a good lawyer, because they are too scared of the possible consequences, or because they simply don’t know that the law protects them. But does that mean governments have an obligation to intervene? And if so, how? This book provides the first systematic philosophical theory of equal access to justice. It begins by identifying the content of claims to equal access to justice. Then, it reviews traditional political and legal arguments on the right of access to justice, which it argues are both illuminating and insufficient. The best comparative way to approach equal access to justice, the book argues, is to think through the requirements of a moral, pre-political, duty to – at times and provisionally – pause, cool down and listen: in other words, we ought to demand that governments step in and protect access rights, because we have a moral and pre-political interest in cultivating our ability to comply with this duty. It is the recognition of this duty which best explains both law’s potential for promoting, as well as its potential for endangering, equal justice. In closing, the book tests this novel theory of equal access to justice against contemporary trends and reforms in procedural law. .

The introduced set impact measure allows for the direct treatment of objects described by nominal-valued attributes.     Abstract: This book puts the spotlight on a different and neglected aspect of law drafting and reform: the question of size. Specifically, how does the size of a jurisdiction affect its ability to make and change its laws? Some of the challenges affecting small jurisdictions include: a lack of resources and paucity of policy/drafting capacity; the pressures and pull from sources outside the jurisdiction (e.g. international bodies or NGOs; larger states; treaty commitments); a vulnerability to domestic capture (e.g. criminal elements, big local businesses, strong domestic lobby groups); weak/bad governance (e.g. laws or institutions which themselves do not encourage or promote good governance, reflection and reform); the legacy of colonial legal systems and their interaction with indigenous or customary laws; and struggles to comply with constitutional norms such as accountability and transparency. Despite these difficulties small jurisdictions also have certain advantages when it comes to making and reforming law: they can be flexible and creative; they can legislate very quickly if the political will is there; and there is strong informal/formal accountability in a small jurisdiction.     Abstract: This collection of original articles draws from a cross section of distinguished scholars of ancient Greek philosophy. It is focussed primarily on the philosophy of Aristotle but comprises as well studies of the philosophy of Socrates, Plato, and Epicurus. Its authors explore a range of complementary topics in value theory, moral psychology, metaphysics, natural philosophy, political theory, and methodology, highlighting the rich and lasting philosophical contributions of the thinkers investigated. Opening with an engaging intellectual autobiography of its honoree, Fred D.     Abstract: This book discusses the role played by powerful global institutions such as the IMF, the World Bank, the World Trade Organisation, multinational corporations, and the international credit rating agencies in keeping Africa marginalised in the world economy. The book focuses on the intrusive roles of these institutions as enablers and beneficiaries of capital outflows and financial subordination in Africa. Diverging from the official narrative that touts China and the other emerging economies as global reformers that are poised to partner Africa in its fight against financial subjugation, the book instead argues that, like the Western powers, the emerging economies are benefiting prodigiously from a rigged global financial system that keeps Africa as a net creditor to the rest of the world. The book draws its theoretical framework from the repressed heterodox theories including dependency, core-periphery, world systems and Marxist theories as well as the decolonial approach. It concludes with a call for a decolonial African agency that should champion an epistemic rebellion against the neo-liberal and neo-classic economic traditions that have been historically deployed to justify Africa’s subordinated position in the global economic governance. This book comes at moment in time when Africa is ready to become a Rule Maker not a Rule Taker. The analysis Dr. Moyo presents having been in the front line of public policy and international negotiations demonstrate the need for Africa to re-write the rules to foster our own Transformation.
