    Abstract: "Based on legal-philosophical research informed by insights gleaned from empirical case studies, this book sets out three central claims about integration requirements as conditions for attaining increased rights (ie family migration, permanent residency and citizenship) in Europe: (1) That the recent proliferation of these (mandatory) integration requirements is rooted in a shift towards 'individualised' conceptions of integration. (2) That this shift is, on the one side, counterproductive as it puts barriers to participation and inclusion of newcomers (who will most likely permanently settle) and on the other, normatively problematic, insofar as it produces status hierarchies between native-born and immigrant citizens. (3) That the remedy for this situation is a firewall that disconnects integration policy from access to rights. The book draws on perspectives on immigrant integration in multiple EU Member States and includes legal and political reactions to the refugee/migrant crisis"--

    Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Citizenship was once an exceptional status, a kind of aristocracy of the ancient world in which freedom and political voice were not taken for granted. Even as the nation-state emerged as the primary form of human association, citizenship remained an anomalous status, reserved for the few who were privileged as such in republican democracies.     Abstract: "This book investigates how effective human rights and the inherent dignity of refugees can be secured in situations of protracted exile and encampment. The book deploys an innovative human rights-based capabilities approach to address fundamental questions relating to law, power, governance, responsibility and accountability in refugee camps. Adopting an original theoretical framework, the author demonstrates that legal empowerment can change the distribution of power in a given refugee situation, facilitating the exercise of individual agency and assisting in the reform of the opportunity structure available to the individual. Thus, by helping to increase the capability of refugees to participate actively in the decisions that most affect their core rights and interests, participatory approaches to legal empowerment can also assist in securing other capabilities, ultimately ensuring that refugees are able to live dignified lives while in protracted exile. Ultimately, the book demonstrates that legal empowerment for refugees can bring lasting benefits in establishing trust between refugees, the state, and local communities. It will be of interest to researchers within the fields of refugee studies, international law, development studies, and political science, as well as to policy makers and practitioners working in the fields of refugee assistance and humanitarian intervention"--

The constitutional right to engage in open expression is designed to secure personal dignity, civic engagement, and flow of information. No generation of interpreters can claim to capture its full relevance to social cohesion. The broad statement found in the Constitution has long been the subject of evolving, sometimes inconsistent, constitutional meaning. Since the early twentieth century, the Supreme Court has been at the forefront of efforts to articulate the range of words, symbols, arts, and other objects or activities that the First Amendment protects. Interpretation takes into account a variety of constitutional contexts, principles, and discursive considerations.     Abstract: "This book proposes that late Ḥanafī legal scholarship in the early modern period secured a role for the Ottoman sultanic authority in the process of lawmaking. It finds the reigning arguments for an epistemic divorce between the domain of Islamic law and the authority of the Ottoman state untenable. This study demonstrates that Ḥanafī jurists sustained and expanded Ottoman sultanic authority through careful reformulations of their own school and their engagement with new notions of governance embraced by the Ottomans. This late articulation of the Ḥanafī legal tradition is not only essential to the understanding of the movement to codify Islamic jurisprudence in the late 19th century CE, and the role of the sultan in these transformations, but also to the sketching of looming contentious issues with regard to legitimate governance, lawmaking, and the future of the in modern sari'ah legal jurisdictions in majority Muslim countries"--

    Abstract: Durch die Analyse der Beziehungen zwischen NGOs, dem UN-Sicherheitsrat und den Menschenrechten wird in diesem Buch argumentiert, dass sowohl NGOs als auch der UN-Sicherheitsrat die Menschenrechtssemantik selektiv in Bezug auf die Orte und Akteure, die sie betreffen, anwenden. Es beobachtet Wissen und Macht als Kräfte, die sich gegenseitig beeinflussen, was eine Erklärung dafür sein kann, wie Global Governance funktioniert. Darüber hinaus untersucht das Buch die Idee, dass Recht, abgesehen von der Durchdringung traditioneller Strukturen, von der Basis der Gesellschaft in Richtung institutioneller Bereiche aufsteigen kann. In diesem Zusammenhang schlägt der Autor vor, dass das Zusammenspiel zwischen nichtstaatlichen Akteuren und politischen Institutionen die Bottom-up-Prozesse im Zusammenhang mit der Gesetzgebung und der Gestaltung politischer Entscheidungen fördert. In Anbetracht der kritischen Probleme, die sowohl die NRO als auch der UN-Sicherheitsrat in Bezug auf Repräsentation und Reaktionsfähigkeit haben, stellt die Arbeit fest, dass die Beziehung zwischen ihnen auf eine ausschließende, technokratische und arkane Weise stattfindet.

    Abstract: "Children make up half of the world's refugees and over 40 per cent of the world's asylum seekers. Yet, children are largely invisible in historical and contemporary refugee law. Furthermore, there has been very limited interaction between the burgeoning children's rights framework, in particular the Convention on the Rights of the Child (CRC), and the 1951 Convention relating to the Status of Refugees (Refugee Convention). This book explores the possibility of a children's rights approach to the interpretation of the Refugee Convention and within that what such an approach might look like. In order to construct a children's rights approach, the conceptualisations of children outside the legal discipline, within international children's rights law and then within refugee law and refugee discourse are analysed. The approach taken is socio-legal and comparative in nature and the suitability of the Refugee Convention as a framework for the interpretation of child claims is examined. The book analyses to what extent the Refugee Convention is capable of dealing with claims from children based on the modern conceptualisation of children which is underscored by two competing ideologies - the child as a vulnerable object in law to be protected and the child as subject with rights and the capacity to exercise their agency. The influence each regime has had on the other is also analysed. The work discusses how a children's rights approach might improve outcomes for child applicants. The book makes an original contribution to child refugee discourse and as such will be an invaluable resource for academics, researchers and policy-makers working in the areas of migration and asylum law, children's rights, and international human rights law' --

Approaching contemporary legal debates with fresh insights, this original and powerful critique sheds new light on issues of overriding social importance, including false confessions, sexual consent, threats of violence, and criminal responsibility. By challenging basic legal assumptions with a nuanced and humane perspective, Dailey shows how psychoanalysis can further our legal system's highest ideals of individual fairness and systemic justice

    Abstract: In this innovative legal history of economic life in the Western Indian Ocean, Bishara examines the transformations of Islamic law and Islamicate commercial practices during the emergence of modern capitalism in the region. In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century. This study examines the Indian Ocean from Oman to India and East Africa over an extended period of time, drawing together the histories of commerce, law and empire in a sophisticated, original and richly textured history of capitalism in the Islamic world

    Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

    Abstract: Das Flüchtlingsrecht ist als Verfolgungschutzrecht dazu konzipiert, künftig drohenden Menschenrechtsverletzungen vorzubeugen. Gleichwohl dominiert in der Praxis und Literatur bisweilen der Blick in die Vergangenheit. Besonders prominent ist dies in Fällen sogenannter Nachfluchtgründe zu beobachten, also in Konstellationen, in denen erst im Aufnahmeland Umstände begründet werden, die eine Verfolgungsgefahr entstehen lassen. Anhand des historisch und aktuell bedeutsamen Anwendungsfalles der religiösen Konversion wird demonstriert, wie diese Vorhaben verwaltungsprozessual zur Geltung kommen können.
