    Abstract: Ein Blick auf den Umgang der polnischen Regierung mit jüdischen und ukrainischen Minderheiten vor dem Zweiten Weltkrieg. Die Beziehungen zwischen dem polnischen Staat und seinen nichtpolnischen Bürgern waren vor 1939 von teils scharfen Auseinandersetzungen geprägt. Doch es gab auch Versuche, die Konflikte in beiderseitigem Einverständnis zu lösen. Diese fanden jenseits der parlamentarischen Bühne statt und wurden in der Regel von Akteuren aus der zweiten Reihe angestoßen. Stephan Stachs Studie untersucht erstmals die Herausbildung eines institutionellen Umfelds, in dem Wissenschaftler, Ministerialbeamte, Abgeordnete und Journalisten Konzepte zur Einbindung nationaler Minderheiten in den polnischen Staat entwickelten. Am Beispiel der jüdischen und ukrainischen Minderheiten in Polen werden Prozesse beleuchtet, die zu einem politischen Vertrauen zwischen den Konfliktparteien beitrugen.

    Abstract: Ein hochrangiger Polizeibeamter bietet einer Angestellten eine Beförderung an und fragt sie dabei, ob sie sich ,,hochschlafen" wolle. Die Frau weist ihn zurück und behält den Vorfall jahrelang für sich. Zuvor hatte sie in der Polizei vergeblich um Unterstützung ersucht. Erst Jahre später taucht dieser Polizeibeamte in den Schlagzeilen auf, weil er seiner jungen Kripochefin nachgestellt haben soll. Erst daraufhin wird er aufgrund der Anzeige der Angestellten rechtskräftig verurteilt. Diesen konkreten Rechtsfall sexualisierter Grenzüberschreitung, nehmen die Herausgeber des Buches als Anlass interdisziplinär zu untersuchen, wie Mechanismen der Skandal- und Krisenbewältigung und die damit einhergehenden Formen der institutionellen Abwehr in der Organisation Polizei wirken. Das Wegsehen und rationalisierende Verdrängen seitens Vorgesetzter, Kolleginnen und Kollegen ist unbedingt aufklärungsbedürftig. Ziel des Buches ist die Schaffung einer interdisziplinären Grundlage für die Reflexion vergleichbarer Fälle in der ,,Organisation mit Gewaltlizenz" und damit die Initiierung eines organisationalen Lernprozesses, der solche Fälle zu verhindern hilft.

    Abstract: Wenigen anderen Ethnologen in der Bundesrepublik Deutschland war es vergönnt, so wie Rüdiger Schott durch eigene Aktivitäten als individuelle Forscherpersönlichkeit maßgebend zum Aufbau und Ausbau ihrer Disziplin beizutragen. Dieser Umstand verdankt sich einerseits den von ihm seit den 60er Jahren durchgeführten Feldforschungen bei den Bulsa in Nordghana und den in den 80er Jahren angestellten ethnographischen Erhebungen bei den Lyela in Burkina Faso (vormals: Obervolta), die ihm internationale Reputation und hohe wissenschaftliche Anerkennung eingetragen haben, andererseits der permanenten Umsetzung der erreichten Forschungsergebnisse in die akademische Lehre und in weitere Forschungen, die heute als beispielhaft gelten.
    Abstract: Nicht von ungefähr gehört das Seminar für Völkerkunde der Universität Münster, das von Rüdiger Schott begründet wurde und im April 1990 auf sein 25jähriges Bestehen zurückblicken konnte, gegenwärtig zu den auch im Ausland wohlbekannten deutschen Forschungsstätten seines Fachgebiets. Dies ist nicht zuletzt deswegen der Fall, weil Schott von Anbeginn seine ethnologischen Forschungen in ständigem Austausch mit einer Reihe benachbarter Disziplinen, insbesondere mit den sozialen Handlungswissenschaften betrieben hat, wie beispielsweise mit den Wirtschaftswissenschaften und der Soziologie, der Rechtswissenschaft und den Religionswissenschaften.
    Abstract: Seine Befähigung und bis auf den heutigen Tag praktizierte Bereitschaft zur Kooperation mit diesen Nachbardisziplinen basiert auf der Einsicht, daß die Ethnologie ihre eigene Identität nur gewinnen und fortentwickeln kann, wenn sie sich auch auf der Ebene der Ausbildung ihrer analytischen Denkansätze und Grundbegriffe hierfür hinreichend kontaktfähig hält. Was Person, Leben und Werk von Rüdiger Schott angeht, so sind die äußeren Rahmendaten seines bisherigen Forscher- und Universitätslebens rasch berichtet. Jedoch wird eine auf die Forschungsinhalte und die erzielten Ergebnisse gerichtete Analyse den von ihm vorgelegten Resultaten kaum gerecht, wenn sie sich nur auf deren Relevanz für die Ethnologie als solche beschränken wollte.

    Abstract: Das Werk behandelt das Tragen eines Kopftuchs durch Lehrerinnen und Schülerinnen in der öffentlichen Verwaltung und in der Justiz. Eingehend behandelt werden die Interpretation des muslimischen Kopftuchs (Symbol der Unterdrückung von Frauen und des politischen Islam?) und das Neutralitätsgebot aus verfassungsrechtlicher und sozialwissenschaftlicher Sicht. Untersucht wird die Entwicklung des laizistischen Modells in Frankreich und der Versuch einer Übertragung dieses Modells auf Deutschland (Berliner Neutralitätsgesetz, Verbot des Kopftuchs von Schülerinnen). Auch das neue Bundesgesetz zum Erscheinungsbild von Beamtinnen und Beamten wird untersucht und auf die Notwendigkeit einer Neujustierung des überkommenen Neutralitätsverständnisses hingewiesen.
    Abstract: The work deals with the wearing of a headscarf by female teachers and students, in public administration and in the judiciary. The interpretation of the Muslim headscarf (symbol of the oppression of women and political Islam?) and the neutrality requirement from a constitutional and sociological perspective are dealt with in depth. The development of the laicist model in France and the attempt to transfer this model to Germany (Berlin neutrality law, ban on the headscarves for schoolgirls) are examined. The new federal law on the appearance of civil servants is also dealt with, as well as the need for a readjustment of the traditional understanding of neutrality.

    Abstract: Das Buch schreibt die Entstehungsgeschichte des Kulturgüterschutzes im Völkerrecht aus einer postkolonialen Perspektive neu. Im Gegensatz zur bisherigen Historiographie von „Kultur“ im Völkerrecht argumentiert die vorliegende Studie, dass der eurozentrische „Kulturstandard“ des 19. und 20. Jahrhundert maßgeblich in Wechselwirkung mit der Entwicklung des Kulturgüterschutzes stand. Verschiedene Akteure nutzten das Recht auf unterschiedliche Weise, um an dem „Zivilisationsdiskurs“ teilzuhaben. Das Ziel des Buchs ist es, ein neues Narrativ in die Geschichte des Kulturgüterschutzes einzuführen. Das dominante Fortschrittsnarrativ soll durch eine kritische Genealogie des Völkerrechts ersetzt werden, welche die hegemonialen Strukturen der Vergangenheit und Gegenwart aufdeckt. Sebastian M. Spitra ist wissenschaftlicher Mitarbeiter am Institut für Rechts- und Verfassungsgeschichte der Universität Wien und Grotius Fellow der University of Michigan Law School.
    Abstract: This book analyses the development of the norms of protecting cultural heritage from a postcolonial perspective. In contrast to the traditional historiography of ‘culture’ in international law, it reveals how the highly problematic and Eurocentric ‘standard of civilisation’ in the 19th and 20th centuries served as a driving force for the formation of cultural heritage protection norms. Various actors used the law in different ways to take part in this discourse on ‘civilisation’. The aim of this book is to lay down a new narrative on the history of the protection of world cultural heritage. It endeavours to replace the inherent politics of the dominant narrative on progress with a critical genealogy which reveals the long-lasting hegemonic structures of today’s international law. Sebastian M. Spitra is a research fellow at the Department of Legal and Constitutional History at the University of Vienna and a Grotius fellow at the University of Michigan Law School.

Nur in dieser einmaligen mündlichen Anhörung können die Antragsteller*innen Gründe für ihr Asylgesuch vortragen und ihre Fluchtgeschichte rekonstruieren - doch dieser Prozess wurde bisher kaum untersucht. Anhand von Fallanalysen zeigt Samah Abdelkader auf, dass die Rekonstruktionsverfahren während der Befragung nicht planlos entstehen, sondern methodisch systematischen Techniken folgen und sich an drei Kategorien orientieren: der internen sowie der externen Kohärenzprüfung der Fluchtgeschichte und der Prüfung von außertextuellen Indikatoren.

    Abstract: In der hier vorliegenden Masterthesis wird eine Betrachtung der Gleichstellungsarbeit der sächsischen Gleichstellungsbeauftragten der Landkreise und kreisfreien Städte vorgenommen. Im Rahmen eines medienvermittelten Leitfadeninterviews sind die Gleichstellungsbeauftragten zu ihrem Selbstverständnis und ihrer Arbeitspraxis befragt worden. Schwerpunktmäßig wurden der Gleichstellungsbegriff und das Bewusstsein seitens der Gleichstellungsbeauftragten als Interessenvertretung für queere Belange erfragt. Die Schwerpunktsetzung ergab sich aus den mangelnden institutionalisierten Gleichstellungsmaßnahmen für queere Menschen, die nach wie vor Diskriminierungen ausgesetzt sind. Queere Ansätze und Theorien bieten Perspektiven, die Kategorie Geschlecht umfassend und kritisch zu analysieren und zu dekonstruieren, um vorherrschende Denkmuster und darauf beruhende Ausschlüsse aufzudecken. Die Gleichstellungsbeauftragten wurden als geeignete Akteurinnen ausgemacht, da eine geschlechterwissenschaftliche Kompetenz und Handlungsspielraum Interessenvertretung sein zu können, vermutet wurden. Die erhobenen Interviewdaten wurden mittels qualitativer Inhaltsanalyse kategorienbasiert ausgewertet. Es zeigte sich, dass ein unterschiedliches Begriffsverständnis in Hinsicht auf Gleichstellung vorliegt und LSBTIQ*-Belange betreffend verschiedene Kenntnisse und Vorstellungen existieren. In Zusammenhang einer möglichen Interessenvertretung wurden zahlreiche Potenziale ausgemacht, allerdings besteht Bedarf an Kapazitäten, Wissen, Sensibilisierung, Reflexion und persönlichem Bezug. Die Untersuchung kann Inspiration für weitere Forschung bieten, wie die Ausgestaltung der Interessenvertretung erfolgen könnte.

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: The 1947 Partition had a major impact on issues of citizenship and rights in India and Pakistan in the decades that followed. Boundaries of Belonging shows how citizenship evolves at a time of political transition and what this meant for ordinary people, by directing attention away from South Asia's Partition 'hotspots' - Bengal and Punjab - to Partition's 'hinterlands' of Uttar Pradesh and Sindh. The analysis, based on rich archival research and fieldwork, brings out commonalities, differences, and the mutual co-construction of the 'citizen' in both places. It also reveals the way in which developments across the border, such as communal violence, could directly impact on minority rights in its neighbour. Questioning stereotypes of an increasingly 'authoritarian' Pakistan and 'democratic' India, Sarah Ansari and William Gould make a major contribution to recent scholarship that suggests the differences between India and Pakistan are overstated

Auf Basis dieser Betrachtungen erfolgt in diesem Buch ein Entwurf für die Post-Corona-Zeit.
    Abstract: Something new is happening in ethical thinking, for which empathy is increasingly becoming the starting point. However, it is not yet entirely clear how this basic empathetic attitude is changing ethics and what kind of empathy is involved. In this respect, the point of departure for a form of empathy based on collective humanity can be understood quite differently than if one only considers empathy to be the act of adopting a more or less sensitive perspective. Along with a basic empathetic attitude, listening has become important in the process of ethical reflection. Moreover, underpinned by empathy, an awareness of vulnerability is influencing thinking about human rights, justice and participation. On the basis of these considerations, this book develops a blueprint for ethical thinking in the aftermath of the coronavirus.

    Abstract: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market. Professor Sonu Bedi argues that private racism is wrong, enlarging the boundary of justice in a way that is also consistent with our Constitution. A more just society is one that seeks to address rather than ignore this less visible form of racism

    Abstract: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

    Abstract: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. On 10 December 2020, the book was officially launched with a webinar which brought together the editors of the book and prof. Stephan Parmentier (KU Leuven) and prof.     Abstract: When refugees flee war and persecution, protection and assistance are usually provided by United Nations organisations and their NGO implementing partners. In camps and cities, the dominant humanitarian model remains premised upon a provider-beneficiary relationship. In parallel to this model, however, is a largely neglected story: refugees themselves frequently mobilise to create organisations or networks as alternative providers of social protection. Based on fieldwork in refugee camps and cities in Uganda and Kenya, this book examines how refugee-led organisations emerge, the forms they take, and their interactions with international institutions. Developing an original theoretical framework based on the concept of 'the global governed', the book shows how power and hierarchy mediate the seemingly benign notion of protection. Drawing upon ideas from anthropology and international relations, it offers an alternative vision for more participatory global governance, of relevance to other policy-fields including development, humanitarianism, health, peacekeeping, and child protection

    Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

    Abstract: Die Beiträge dieses aus einer interdisziplinären Tagung hervorgegangenen Bandes widmen sich aktuellen Fragen, die sich in den kulturwissenschaftlichen Debatten um die Human-Animal Studies derzeit stellen. Sie berühren nicht allein die philosophischen, ethischen, rechtlichen, politischen und sozialen Aspekte der Beziehungen zwischen Menschen und Tieren, sondern auch die methodischen Herausforderungen und theoretischen Grundlagen ihrer Erforschung. Im Zentrum steht dabei die Frage, ob und inwieweit sich die anthropozentrisch geprägte Denkstruktur der Kulturwissenschaften um Perspektiven und Forschungsansätze erweitern lässt, die Tieren sowie ihren Rechten, Bedürfnissen und Interessen stärker gerecht werden. Indem die Human-Animal Studies den Blick für die enge Verflochtenheit menschlicher und tierlicher Existenzweisen öffnen, schaffen sie wichtige Voraussetzungen dafür, unser bisheriges Verhältnis zu ihnen grundsätzlich zu überdenken und zugleich praktisch zu verändern.

    Abstract: Dieses Working Paper legt die konzeptionellen Konturen des in der Abteilung ‚Recht & Ethnologie‘ des Max-Planck-Instituts für ethnologische Forschung angesiedelten Forschungsprojektes „Konfliktregulierung in Deutschlands pluraler Gesellschaft“ vor der Feldforschung der Teilprojektvorhaben im Jahre 2019 dar. Ziel der Forschung ist es, durch eine multiperspektivisch angelegte Betrachtungsweise ausgewählte ethnisch und/oder religiös geprägte Einwanderungsgemeinschaften in ihren spezifischen Lebenswelten in der Bundesrepublik Deutschland in den Blick zu nehmen. Der Fokus des Gesamtprojekts liegt dabei auf Ausprägungen von Konfliktkonstellationen, die aus staatlicher Sicht im Grundsatz ein zivil- und/oder strafrechtliches Substrat ausweisen. Die Teilprojekte, die jeweils Lebenswelten ausgewählter Einwanderungsgemeinschaften in den Blick nehmen, sollen dabei möglichst komparativ ausgestaltet sein, und ausgehend von jeweils unterschiedlichen Ansätzen Akteur*innen, deren Rechtsbewusstsein und Prozessen der Aushandlung von Konflikten nachgehen. Der in der breiten Öffentlichkeit verbreiteten Prämisse, es handele sich hierbei grundsätzlich um eine sogenannte Paralleljustiz, soll dabei kritisch-reflektierend nachgegangen werden. Bei dem im Sprachgebrauch der Debatte verwendeten Wortsinn des Begriffs Paralleljustiz handelt es sich um ein Phänomen, bei dem eine justizähnliche Autorität in einer gerichtsförmig verfassten Struktur ausgeübt wird, die a priori im Gegensatz zu rechtsstaatlichen Grundsätzen steht und jegliche Interaktion mit staatlichen Einrichtungen ausschließt. Dies wurde bisher jedoch wissenschaftlich in dieser Bestimmtheit nicht belegt. Das Forschungsvorhaben stellt daher als Ausgangspunkt die Hypothese auf, dass konfliktregulierende Verfahren in der Form, wie sie die Vertreter*innen der sogenannten Paralleljustiz verstehen, nicht per se als parallel zu betrachten sind. Wenn man den Akteur*innen eine rational handelnde Rechtssubjektivität zuschreibt, ist es viel eher denkbar, dass Akteur*innen ihre Anliegen in gerichtliche wie außergerichtliche Bestandteile aufspalten (forum shopping), um aus der betreffenden Fallkonstellation eine für sie jeweils möglichst optimale Rechtsfolge ableiten zu können. Ob und gegebenenfalls wie sich dies in der Lebenswirklichkeit darstellt, ist Kernbestand der empirisch ausgelegten Teilprojekte, die das staatliche Recht, soziokulturelle Rechtsverständnisse und Normderivate in den Blick nehmen. Anliegen dieser Grundlagenforschung ist es, sich in der gebotenen Nüchternheit eines Forschungsdesiderats in Deutschland anzunehmen, ohne dabei problematische Konfliktlagen zu ignorieren oder in den verbreiteten Alarmismus einzustimmen.

    Abstract: Wo liegen hier Chancen, wo Gefahren? Die Antidiskriminierungsstelle des Bundes hat dazu die Studie „Diskriminierungsrisiken durch Verwendung von Algorithmen“, vorgelegt von Dr. Carsten Orwat, gefördert. Die Studie nimmt sowohl die Ursachen algorithmenbasierter Diskriminierung als auch Handlungsoptionen zum Schutz davor in den Blick. Dabei wird insbesondere auf die Möglichkeiten, die Antidiskriminierungsstellen hierbei haben, eingegangen. Thematisiert werden beispielweise Algorithmen des Risikomanagements, welche das Kreditausfallrisiko, die Leistungsfähigkeit von Bewerbenden, das Mietausfallrisiko oder das Rückfallrisiko von Straftatbegehenden ermitteln und so zur Differenzierung von Personen verwendet werden. Aber auch Algorithmen zur zielgerichteten Werbung, der individuellen Entgeltgestaltung, der Kundenpflege oder deren Verwendung beim so genannten „De-Marketing“ können, wie die in der Studie vorgestellten Beispiele zeigen, Diskriminierungsrisiken beinhalten.

    Abstract: As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justicesystem. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical0exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated.     Abstract: This volume in honour of Stephen Ellis is a follow-up to the public presentation of his book on the history of organised crime in Nigeria This Present Darkness (Hurst, 2016) at the University of Lagos, Nigeria on 28 October 2016.     Abstract: Since Marcel Mauss published his foundational essay The Gift in 1925, many anthropologists and specialists of international relations have seen in the exchange of gifts, debts, loans, concessions or reparations the sources of international solidarity and international law. Still, Mauss's reflections were deeply tied to the context of interwar Europe and the French colonial expansion. Their normative dimension has been profoundly questioned after the age of decolonization. A century after Mauss, we may ask: what is the relevance of his ideas on gift exchanges and international solidarity? By tracing how Mauss's theoretical and normative ideas inspired prominent thinkers and government officials in France and Algeria, from Pierre Bourdieu to Mohammed Bedjaoui, Grégoire Mallard adds a building block to our comprehension of the role that anthropology, international law, and economics have played in shaping international economic governance from the age of European colonization to the latest European debt crisis.

Solange Mouthaan is Associate Professor of Law at the University of Warwick.     Abstract: This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. Itargues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies- more precisely securitization theory- by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU's policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations

    Abstract: This title examines the concept of intersectional discrimination and why it has been difficult for jurisdictions around the world to redress it in discrimination law. 'Intersectionality' was coined by Kimberlé Crenshaw in 1989. 30 years since its conception, the term has become a buzzword in sociology, anthropology, feminist studies, psychology, literature, and politics. But it remains marginal in the discourse of discrimination law, where it was first conceived. Traversing its long and rich history of development, the book explains what intersectionality is as a theory and as a category of discrimination.     Abstract: Supranational governance is being challenged by politicians and citizens around the EU as over-centralized and undemocratic. This book is premised on the idea that polycentric governance, developed by Vincent and Elinor Ostrom, is a fruitful place to start for addressing this challenge. Assessing the presence of, and potential for, polycentric governance within the EU means approaching established principles and practices from a new perspective. While the debate on these issues is rich, longstanding and interdisciplinary, it has proven difficult to sidestep the 'renationalisation/federalisation' dichotomy. The aim of this volume is not to reject the EU's institutional structure but provide a different benchmark for the assessment of its functioning. Polycentric theory highlights the importance of multilevel horizontal relationships within the EU - between states, but also between many sub-state actors, all the way down to individuals. This helps us answer the question: how do we achieve self-governance in an interdependent world?

    Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: "Principally, this book comprises a conceptual analysis of the illegality of a third-country national's stay by examining the boundaries of the overarching concept of illegality at the EU level. Having found that the holistic conceptualisation of illegality, constructed through a combination of sources (both EU and national law) falls short of adequacy, the book moves on to consider situations that fall outside the traditional binary of legal and illegal under EU law. The cases of unlawfully staying EU citizens and of non-removable illegally staying third-country nationals are examples of groups of migrants who are categorised as atypical. By looking at these two examples the book reveals not only the fragmentation of legal statuses in EU migration law but also the more general ill-fitting and unsatisfactory categorisation of migrants. The potential conflation of illegality with criminality as a result of the way EU databases regulate the legal regime of illegality of a migrant's stay is the first trend identified by the book. Subsequently, the book considers the functions of accessing legality (both instrumental and corrective). In doing so it draws out another trend evident in the EU illegality regime: a two-tier regime which discriminates on the basis of wealth and the instrumentalisation of access to legality by Member States for mostly their own purposes. Finally, the book proposes a corrective rationale for the regulation of illegality through access to legality and provides a number of normative suggestions as a way of remedying current deficiencies that arise out of the present supranational framing of illegality."--Bloomsbury Publishing

    Abstract: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence. The book thus offers multiple perspectives on the civil-military divide within modern conflicts, an issue whose powerful contemporary resonance is all too apparent

    Abstract: Since the turn of the century, South American governments and regional organisations have adopted the world's most open discourse on migration and citizenship. At a time when restrictive choices were becoming increasingly predominant around the world, South American policymakers presented their discourse as being both an innovative and exceptional 'new paradigm' and part of a morally superior, avant-garde path in policymaking. This book provides a critical examination of the South American legal framework through a historical and comparative analysis. Diego Acosta uses this analysis to assess whether the laws are truly innovative and exceptional, as well as evaluating their feasibility, strengths and weaknesses. By analysing the legal construction of the national and the foreigner in ten South American countries during the last two centuries, he demonstrates how different citizenship and migration laws have functioned, as well as showing why states have opted for certain regulation choices, and the consequence of these choices for state- and nation-building in the continent.
