    Abstract: NEUE PERSPEKTIVEN AUF DIE DEUTSCHE KOLONIALGESCHICHTE Die eigene Zeit als Kolonialmacht sei im Vergleich mit Ländern wie Frankreich oder Großbritannien kurz und relativ unproblematisch gewesen: So sah man es hierzulande lange. Doch das war ein Irrtum. Heute steht die deutsche koloniale Vergangenheit zu Recht im Zentrum kontrovers geführter Debatten über das koloniale Erbe in einer globalen Welt. Dieses Buch beleuchtet mit dem Auswärtigen Amt einen zentralen Akteur des deutschen Kolonialismus und spannt den Bogen vom Deutschen Kaiserreich bis weit ins 20. Jahrhundert hinein. Dabei richtet sich der Blick nicht nur auf Deutschland, sondern auch in die betroffenen Gesellschaften Afrikas, Asiens und Ozeaniens. Mit dem Versailler Vertrag von 1919 endete die formale deutsche Kolonialherrschaft. Doch koloniales Denken lebte in der Mitte der deutschen Ge sellschaft fort - so auch im Auswärtigen Amt, dem eine Mitverantwortung für Gewalt und Verbrechen in den deutschen Kolonien zukommt. Die Folgen seines Handelns sind noch bis in unsere Gegenwart spürbar. In der Zeit der NS-Diktatur verbanden sich nationalkonservative, monarchistische und antirepublikanische Haltungen im Auswärtigen Amt mit den expansionistischen und rassistischen Zielen des Nationalsozialismus. Ab 1949 prägten Indifferenz und Ignoranz, Passivität und Relativierung die bundesdeutsche Politik gegenüber den ehemaligen Kolonien im globalen Süden. Heute ist das Amt maßgeblich an Verhandlungen über Restitution und Wiedergutmachung beteiligt. Zudem wird es von einer diverser gewordenen deutschen Gesellschaft mit Fragen zur kolonialen Vergangenheit konfrontiert. Aus Gründen der historischen Gerechtigkeit, aber auch angesichts einer veränderten Weltlage muss sich das Amt seiner eigenen Kolonialgeschichte stellen.     Abstract: Ein hochrangiger Polizeibeamter bietet einer Angestellten eine Beförderung an und fragt sie dabei, ob sie sich ,,hochschlafen" wolle. Die Frau weist ihn zurück und behält den Vorfall jahrelang für sich. Zuvor hatte sie in der Polizei vergeblich um Unterstützung ersucht. Erst Jahre später taucht dieser Polizeibeamte in den Schlagzeilen auf, weil er seiner jungen Kripochefin nachgestellt haben soll. Erst daraufhin wird er aufgrund der Anzeige der Angestellten rechtskräftig verurteilt. Diesen konkreten Rechtsfall sexualisierter Grenzüberschreitung, nehmen die Herausgeber des Buches als Anlass interdisziplinär zu untersuchen, wie Mechanismen der Skandal- und Krisenbewältigung und die damit einhergehenden Formen der institutionellen Abwehr in der Organisation Polizei wirken. Das Wegsehen und rationalisierende Verdrängen seitens Vorgesetzter, Kolleginnen und Kollegen ist unbedingt aufklärungsbedürftig. Ziel des Buches ist die Schaffung einer interdisziplinären Grundlage für die Reflexion vergleichbarer Fälle in der ,,Organisation mit Gewaltlizenz" und damit die Initiierung eines organisationalen Lernprozesses, der solche Fälle zu verhindern hilft.

    Abstract: Wenigen anderen Ethnologen in der Bundesrepublik Deutschland war es vergönnt, so wie Rüdiger Schott durch eigene Aktivitäten als individuelle Forscherpersönlichkeit maßgebend zum Aufbau und Ausbau ihrer Disziplin beizutragen. Dieser Umstand verdankt sich einerseits den von ihm seit den 60er Jahren durchgeführten Feldforschungen bei den Bulsa in Nordghana und den in den 80er Jahren angestellten ethnographischen Erhebungen bei den Lyela in Burkina Faso (vormals: Obervolta), die ihm internationale Reputation und hohe wissenschaftliche Anerkennung eingetragen haben, andererseits der permanenten Umsetzung der erreichten Forschungsergebnisse in die akademische Lehre und in weitere Forschungen, die heute als beispielhaft gelten.
    Abstract: Nicht von ungefähr gehört das Seminar für Völkerkunde der Universität Münster, das von Rüdiger Schott begründet wurde und im April 1990 auf sein 25jähriges Bestehen zurückblicken konnte, gegenwärtig zu den auch im Ausland wohlbekannten deutschen Forschungsstätten seines Fachgebiets. Dies ist nicht zuletzt deswegen der Fall, weil Schott von Anbeginn seine ethnologischen Forschungen in ständigem Austausch mit einer Reihe benachbarter Disziplinen, insbesondere mit den sozialen Handlungswissenschaften betrieben hat, wie beispielsweise mit den Wirtschaftswissenschaften und der Soziologie, der Rechtswissenschaft und den Religionswissenschaften.
    Abstract: Seine Befähigung und bis auf den heutigen Tag praktizierte Bereitschaft zur Kooperation mit diesen Nachbardisziplinen basiert auf der Einsicht, daß die Ethnologie ihre eigene Identität nur gewinnen und fortentwickeln kann, wenn sie sich auch auf der Ebene der Ausbildung ihrer analytischen Denkansätze und Grundbegriffe hierfür hinreichend kontaktfähig hält. Was Person, Leben und Werk von Rüdiger Schott angeht, so sind die äußeren Rahmendaten seines bisherigen Forscher- und Universitätslebens rasch berichtet. Jedoch wird eine auf die Forschungsinhalte und die erzielten Ergebnisse gerichtete Analyse den von ihm vorgelegten Resultaten kaum gerecht, wenn sie sich nur auf deren Relevanz für die Ethnologie als solche beschränken wollte.

Yet large numbers of researchers, non-governmental organizations, trade unions, workers, and others who would seem like natural allies in the fight against modern slavery and trafficking are hugely skeptical of these movements. They object to how the problems are framed, and are skeptical of the "new abolitionist" movement. Why? This book tackles key controversies surrounding the anti-slavery and anti-trafficking movements head on. Champions and skeptics explore the fissures and fault lines that surround efforts to fight modern slavery and human trafficking today. These include: whether efforts to fight modern slavery displace or crowd out support for labor and migrant rights; whether and to what extent efforts to fight modern slavery mask, naturalize, and distract from racial, gendered, and economic inequality; and whether contemporary anti-slavery and anti-trafficking crusaders' use of history are accurate and appropriate

    Abstract: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

    Abstract: »Schuld« ist ein Basisbegriff in vielen Wissenschaftszweigen. Offensichtlich ist die Funktion von Schuld in der Rechtswissenschaft, wo sie einerseits im Strafrecht und andererseits im Zivilrecht das Fundament für die Rechtsmaterie bildet. In der Philosophie befasst sich vor allem die Ethik mit der wie auch immer definierten Schuld. Die antiken Tragödien drehen sich um verschuldetes wie unverschuldetes Unheil. In der Geschichtswissenschaft wird etwa die Frage nach der Kriegsschuld seit jeher intensiv erörtert. In der Wissenschaftsgeschichte wird über die mit wissenschaftlichen Entdeckungen einhergehende Schuld disputiert. Soziologie, Kunst- und Kulturwissenschaften befassen sich mit in den heutigen pluralistischen Gesellschaften medial und diskursiv präsenten Formen von Schuld. In der Medizin und in den Naturwissenschaften wird die Quantifizierung und Messbarkeit von Schuld sowie ihr eventueller evolutionärer Vorteil erforscht. Und in der Theologie ist die persönliche Schuld Maßstab für die Beurteilung des Menschen am dies irae. Diese Wissensfelder werden in dem vorliegenden Band miteinander in Beziehung und somit ein fruchtbarer interdisziplinärer Diskurs ins Werk gesetzt.

    Abstract: "This book has been brought to life in a period where transnational solidarity and cooperation seemed to be moving backwards rather than forwards. This was among others reflected in the so called refugee crisis in Europe in 2015. After the Brexit referendum in the United Kingdom in June 2016, and presidential elections in the US later the same year, the political agenda took a turn towards focusing primarily on the internal national perspective in relation to areas such as environmental protection, aid to countries in the Third World and trade with the outside world. It still remains to be seen when and how the United Kingdom will be leaving the European Union. In general, the EU has experienced a number of crises, among others an economic and financial crisis and later the refugee crisis, during the past years. These crises have challenged transnational solidarity in Europe. This development in Europe and the World stresses the question, whether and how transnational solidarity is possible. This book is motivated by these developments and discusses and attempts to answer this question. Our main presumption is that solidarity can create stability and sustainability (social, economic, environmental, peace etc.), within states, regions and globally, why it is crucial to gain more knowledge about it. Realization of the UN Sustainability Goals 2017 and 2030 go hand in hand with solidarity at both local, regional and global levels. In this work, we do of course build on earlier discussions and investigations of solidarity"--

    Abstract: This book explores and challenges common assumptions about gender, conflict, and post-conflict situations. It critically examines the gendered aspects of international and transitional justice processes by subverting traditional understandings of how wars are waged, the power dynamics involved, and the experiences of victims. The book also highlights the gendered stereotypes that underpin the (mis)perceptions about gender and war in order to reveal the multi-dimensional nature of modern conflicts and their aftermaths. Featuring contributions from academics in law, criminology, international relations, politics and psychology, as well as legal practitioners in the field, Gender and War offers a unique and multi-disciplinary insight into contemporary understandings of conflict and explores the potential for international and transitional justice processes to evolve in order to better acknowledge diverse and gendered experiences of modern conflicts. This book provides the reader with international and interdisciplinary perspectives on issues of international law, conflict, gender and transitional justice. Solange Mouthaan is Associate Professor of Law at the University of Warwick. Her research interests focus on the gendered experiences of children affected by armed conflict and the restrictive interpretation of international criminal law in this area. Olga Jurasz is a Senior Lecturer in the Law School at the Open University and works in the fields of international law, human rights, gender-based violence and gender and post-conflict reconstruction.

    Abstract: This volume in honour of Stephen Ellis is a follow-up to the public presentation of his book on the history of organised crime in Nigeria This Present Darkness (Hurst, 2016) at the University of Lagos, Nigeria on 28 October 2016.     Abstract: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence. The book thus offers multiple perspectives on the civil-military divide within modern conflicts, an issue whose powerful contemporary resonance is all too apparent

    Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: Die sogenannte Angewandte Ethik erfährt seit Jahrzehnten einen beachtlichen Aufschwung. Ihr Anspruch ist, in konkreten moralischen Problemstellungen einen Beitrag zur Orientierung zu leisten. Dass Ethik einen Bestand an Normen und Prinzipien auf reale Probleme in der Welt anwendet, ist freilich zu einfach gedacht. Denn weder die Problemformulierung noch die einschlägigen moralischen Normen können ohne Weiteres als begründet oder stets akzeptiert vorausgesetzt werden. In diesem Band werden Grundfragen der Anwendung in der Ethik kritisch reflektiert. In der Rechtsprechung ist die Anwendung von Normen zwar gut etablierte Praxis, neue Entwicklungen verlangen aber eine erneuerte methodologische Auseinandersetzung. In der Medizin und dem Bereich der Bildung lassen sich Fragen der ethischen Bewertung jenseits der Anwendung finden.

    Abstract: With over 240 million migrants in the world, including over 65 million forced migrants and refuggees, states have turned to draconian measures to stem the flow of irregular migration, including the criminalization of migration itself. Canada, perceived as a nation of immigrants and touted as one of the most generous countries in the world today for its reception of refugees, has not been immune from these practices. This book examines the "crimmigration" -- the criminalization of migration -- from national and comparative perspectives, drawing attention to the increasing use of criminal law measures, public policies, and practices that stigmatize or diminish the rights of forced migrants and regugees within a dominant public discourse that not only steoreotypes and criminalizes but marginalized forced migrants.

    Abstract: The regulation of civil society provides the framework under which those organisations can most effectively provide services in education, health, social services, housing, development aid and so on. Civil Society in Europe identifies common principles of civil society law in two ways. First, the approaches of the Council of Europe and the European Union are explored. Next civil society regulation in twelve domestic legal systems are investigated on a broad range of substantive areas of law including internal organisation, registration, external supervision, public benefit organisations and international activities. From these, the authors distill a set of minimum norms and optimal conditions under which civil society can deliver its aims most effectively.
