Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out. Abstract: A new edition of a seminal text in Critical Race TheorySince the publication of the third edition of Critical Race Theory: An Introduction in 2017, the United States has experienced a dramatic increase in racially motivated mass shootings and a pandemic that revealed how deeply entrenched medical racism is and how public disasters disproportionately affect minority communities. We have also seen a sharp backlash against Critical Race Theory, and a president who deemed racism a thing of the past while he fanned the flames of racial intolerance and promoted nativist sentiments among his followers. Now more than ever, the racial disparities in all aspects ofpublic life are glaringly obvious. Taking note of all these developments, this fourth edition covers a range of new topics and events and addresses the rise of a fierce wave of criticism from right-wing websites, think tanks, and foundations, some of which insist that America is now colorblind and has little use for racial analysis and study. Award-winning authors Richard Delgado and Jean Stefancic also address the rise in legislative efforts to curtail K–12 teaching of racial history. Critical Race Theory, Fourth Edition, is essential for understanding developments in this burgeoning field, which has spread to other disciplines and countries. The new edition also covers the ways in which other societies and disciplines adapt its teachings and, for readers wanting to advance a progressive race agenda, includes new readings and questions for discussion aimed at outlining practical steps to achieve this objective

Abstract: This book examines the contemporary rise in community violence across the United States and globally from sociological and criminological perspectives. It comprehensively investigates police response to criminal incidents, engagements with criminal suspects, use of force by law enforcement, and crime control measures implemented or recommended to initiate effective crime control measures so that the unwanted rise of violence and serious crime can again be contained. The primary audience for the book will be upper level undergraduate and graduate level students, criminal justice and law enforcement practitioners, government policy makers, community advocates, and researchers in sociology, criminology, homeland security, criminal justice, public administration, and political science.

Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency. Despite the burgeoning recognition of the broader similarities between Roma and African Americans, including the systems that facilitate their marginalization and the barriers to their representation, no book-length work has sustained these comparisons"--

Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

Abstract: In contexts of insecurity and inequality across the world, criminal groups have developed into powerful, state-like organizations. Marginalized citizens in search of protection and support may look to criminal leaders, gangs and mafias rather than to politicians and state agencies. Providing residents with forms of social welfare, security and dispute resolution, these criminal organizations have taken on the functions and symbols of the state.00Criminals' positions of power are not only rooted in their social provisioning role, or in fear and force. 'Most Wanted' shows the role of popular culture in producing the socio-political authority of bosses, gangs and cartels. It illustrates this through discussions of Italian, Japanese and Russian mafias, and of criminal groups in Brazil, Ghana, Jamaica, and the United States. The essays collected here analyze different forms of visual, material and performative culture, including street art, film, video games, dance parties, popular music and various everyday objects. Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

Abstract: "How did Americans in the generations following the Declaration of Independence translate its lofty ideals into practice? In this broadly synthetic work, distinguished historian Richard Brown shows that despite its founding statement that "all men are created equal," the early Republic struggled with every form of social inequality. While people paid homage to the ideal of equal rights, this ideal came up against entrenched social and political practices and beliefs. Brown illustrates how the ideal was tested in struggles over race and ethnicity, religious freedom, gender and social class, voting rights and citizenship. He shows how high principles fared in criminal trials and divorce cases when minorities, women, and people from different social classes faced judgment. This book offers a much-needed exploration of the ways revolutionary political ideas penetrated popular thinking and everyday practice"--

Abstract: An innovative examination of American society, culture, and politics, The Age of Charisma argues that the modern relationship between American leaders and followers grew out of a unique group of charismatic social movements prominent in the late-nineteenth and early-twentieth centuries. Drawing on hundreds of letters and testimonials, Jeremy C. Young illustrates how 'personal magnetism' in public speaking shaped society by enabling a shift from emotionally-inaccessible leadership to emotionally-available leadership. This charismatic speaking style caused a rapid transformation in the leader-follower relationship, creating an emotional link between speakers and listeners, and the effects of this social transformation remain with us today. Young argues that ultimately, charismatic movements enhanced American democracy by encouraging the personalization of leadership - creating a culture in which today's leaders appeal directly to Americans through mass media.

Abstract: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction. .

Abstract: This book tackles the regulatory issues of Unmanned Aerial Systems (UAS) or Remotely-Piloted Aerial Systems (RPAS), which have profound consequences for privacy, security and other fundamental liberties. Collectively known as “drones,” they were initially deployed for military purposes: reconnaissance, surveillance and extrajudicial executions. Today, we are witnessing a growth of their use into the civilian and humanitarian domain. They are increasingly used for goals as diverse as news gathering, aerial inspection of oil refinery flare stacks, mapping of the Amazonian rain-forest, crop spraying and search and rescue operations. The civil use of drones is becoming a reality in the European Union and in the US.The drone revolution may be a new technological revolution. Proliferation of the next generation of “recreational” drones show how drones will be sold as any other consumer item. The cultural perception of the technology is shifting, as drones are increasingly being used for humanitarian activities, on one hand, but they can also firmly be situated in the prevailing modes of postmodern governance on the other hand. This work will be of interest to researchers in Criminology and Criminal Justice interested in issues related to surveillance, security, privacy, and technology. It will also provide a criminological background for related legal issues, such as privacy law, aviation law, international criminal law, and comparative law.

Abstract: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

Abstract: This book explores California’s prison system in the context of vocational education reform. For prisons in the early twenty-first century, ideologies of evidence-based management meant that reform efforts to change the purpose of prisons from punishment to rehabilitation through vocational education required “evidence” to justify policy prescriptions. Yet who determines what constitutes evidence? In political environments, solutions are typically pre-conceived, which means that the nature of the evidence collected is also preconceived. As a result, key assumptions about outcomes are often wished away to show improvement and be accountable. Through a detailed analysis interspersed with stories from the authors’ experiences “behind the wall” among California’s prison population, the authors challenge the nature of evidence-based research as used in the prison environment. In the process they describe the thorny problems facing reformers

Abstract: This volume takes a look at the status quo of whistleblowing in several jurisdictions from around the world. Covering a topic that draws the attention of a broad public and is gaining importance amongst legislators, practitioners and scholars all over the globe, the book examines the various aspects of whistleblowing. It looks at what kind of legal protection of whistleblowers is in force, who is protected, what kind of behaviour is protected, and what kind of behaviour whistleblowers are protected against. This is achieved by a combination of a general comparative report with country-specific reports that give information on whistleblowing in various jurisdictions. These countries include, amongst others, Canada, Germany, France, Italy, the Netherlands and the USA. A synopsis comprises information on whistleblowing in 23 countries in one tabula. The chapters of this book were originally prepared for the XIXth International Congress of Comparative Law (20th and 21〈st〈 sup=""〉 July 2014) of International Academy of Comparative Law in Vienna.〈/st.

Abstract: Undeniably widespread and powerful as it is, the Internet is not beyond control: it can reach as high as the sky (cloud computing), but it cannot escape competition. Yet, protecting competition in the “network of networks” is not without challenges: not only are competitive processes in platform-based industries complex, so is competition law analysis. The latter is often confronted with the difficulties in predicting the outcome of competition, in particular in terms of innovation. Do the specific competition law issues in a digital environment presuppose a reconsideration of competition law concepts and their application? Can current competition law tools be adjusted to the rush pace of dynamic industries? To what extent could and should competition law be supplemented by regulation? This book provides an analysis of recent developments in the most relevant competition law cases in a digital environment on both sides of the Atlantic (the EU and the US) and assesses platform competition issues from a legal as well as an economic point of view

Abstract: This book is highly topical. The shift from the multilateral WTO negotiations to bilateral and regional Free Trade Agreements has been going on for some time, but it is bound to accelerate after the WTO Doha round of negotiations is now widely regarded as a failure. However, there is a particular regional angle to this topic as well. After concluding that further progress in the Doha round was unlikely, Pacific Rim nations recently have progressed with the negotiations of a greatly expanded Trans-Pacific Partnership Agreement that includes industrialised economies and developed countries such as the United States, Japan, Australia and New Zealand, recently emerged economies such as Singapore, but also several developing countries in Asia and Latin America such as Malaysia and Vietnam. US and EU led efforts to conclude FTAs with Asia-Pacific nations are also bound to accelerate again, after a temporary slowdown in the negotiations following the change of government in the United States and the expiry of the US President’s fast-track negotiation authority. The book will provide an assessment of these dynamics in the world’s fastest growing region. It will look at the IP chapters from a legal perspective, but also put the developments into a socio-economic and political context. Many agreements in fact are concluded because of this context rather than for purely economic reasons or to achieve progress in fields like IP law. The structure of the book follows an outline that groups countries into interest alliances according to their respective IP priorities. This ranges from the driving forces of the EU, US and Japan, via Asia-Pacific resource-rich but IP poor economies such as Australia and New Zealand, recently emerged economies with strong IP systems such as Singapore and Korea to leading developing countries such as China and India and ‘second tier industrializing economies’ such as Thailand, Malaysia and Indonesia

Abstract: In recent decades, religion's traditional distinctiveness under the First Amendment has been challenged by courts and scholars. As America grows more secular and as religious and nonreligious convictions are increasingly seen as interchangeable, many have questioned whether special treatment is still fair. In its recent decisions, the Supreme Court has made clear that religion will continue to be treated differently, but we lack a persuasive account of religion's uniqueness that can justify this difference. This book aims to develop such an account. Drawing on founding era thought illumined by theology, philosophy of religion, and comparative religion, it describes what is at stake in our tradition of religious freedom in a way that can be appreciated by the religious and nonreligious alike. From this account, it develops a new framework for religion clause decision making and explains the implications of this framework for current controversies regarding protections for religious conscience

Abstract: Over the past 15 years, evidence-based practice in juvenile justice has moved from a concept to a full blown practice in a number of states. They have used research based principles and programs to: - completely reorganize their system for treating juveniles -reduce crime and recidivism -and saved money in the process. Evidence-Based Practice in Juvenile Justice describes the major players in this transformative process, the particular role they play in moving research to practice, and provides recommendations for applying this research in other locations. It will be of key interest to researchers in Criminology and Criminal Justice with a focus on Juvenile Justice or Juvenile Delinquency, or related fields such as Public Policy and Social Work, as well as policy-makers, and practitioners working in the juvenile justice system.

Abstract: This book provides the most current thinking on effective interventions in the lives of criminal offenders. Original articles by leading criminologists provide in-depth analyses of “turning points” in the desistance process experienced by criminal offenders. An understanding of the sources of turning points (or interventions) across the life course is vital to assessing their impact on criminal behavior. Three sources of interventions in criminal careers are identified in the literature: structural location, human agency and situated choice. Structural location refers to the social place occupied by an individual in the social structure: including marital and occupational status, education and income, and so on. Human agency means the active will of an individual to change his or her behavior, that is, the decision to stop engaging in criminal activities. In addition, situated choice coordinates the offender’s willingness to end a life of crime with the social structural supports that increase the odds of criminal desistance. This comprehensive book considers all three sources of turning points-structural location, human agency, and situated choice-across the life course of criminal offenders. The book also provides a section on cross-cultural perspectives on the effectiveness of interventions in the careers of criminal offenders. The policy implications of each intervention are considered in individual chapters. In addition, the authors suggest a research agenda to further the understanding of the interplay among the key interventions across the life course. This book will be of interest to researchers studying criminology from a life course perspective, as well as crime prevention, and public policy

Abstract: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.

Abstract: The book pays interest to a small and almost untouched topic: a health practitioner’ s duty to inform about alternatives. It covers both orthodox medicine practitioners and CAM practitioners. The topic is explored in a co mparative way, examining the laws of not only common law jurisdictions, such as the USA, England, Canada, Australia, New Zealand, but also two East Asia jurisdictions ( China and Japan ) . It uses the collective wisdom of several common law jurisdictions, but also differentiates them. It places the issue of “disclosure of alternatives” in a clear and wider context, making a cogent distinction between diagnosis/treatment and information disclosure

Abstract: In the last few years, the boom in biobanking has prompted a lively debate on a host of interrelated legal issues, such as the Gordian knot of the ownership of biological materials, as well as privacy concerns. The latter are due to the difficulty of accepting that biological samples must be completely anonymous without making it practically impossible to exploit their information potential. The issues also include the delicate role and the changing content of the donor’s “informed consent” as the main legal tool that may serve to link the privacy and property interests of donors with the research interests and the set of principles that should be at the core of the biobanking practice. Lastly, the IP issues and the patentability of biological samples as well as the protection of databases storing genetic information obtained from the samples are covered. Collecting eighteen essays written by eminent scholars from Italy, the US, the UK and Canada, this book provides new solutions to these problems. From a comparative viewpoint, it explores the extent to which digital technology may assist in tackling the numerous regulatory issues raised by the practice of biobanking for research purposes. These issues may be considered and analyzed under the traditional paradigms of Property, Privacy, Informed Consent and Intellectual Property

Abstract: As a child, he played with trucks and action figures and wanted to be a firefighter. As a youth, he began dressing up in his mother's clothes and becoming sexually aroused. When he started dating, he dreamed of being his girlfriends. "What am I?" he asked his therapist. "A transsexual? A transvestite? Something else?" This vignette describes a man who experiences autogynephilia: a paraphilic disorder in which men who are attracted to women are also erotically aroused by the idea of being women and sometimes want to undergo sex reassignment and live as women. Men Trapped in Men's Bodies explores the phenomenon of autogynephilia, arguing cogently that it accounts for many cases of male-to-female (MtF) transsexualism in Western countries. The book demonstrates that not all MtF transsexuals conform to the familiar stereotype of women trapped in men's bodies: Many resemble-and even describe themselves as-men trapped in men's bodies. Sometimes at odds with conventional wisdom about the interrelationships of sex, gender, and sexuality, the book examines the manifestations and clinical implications of autogynephilia, based on narratives provided by over 300 autogynephilic MtF transsexuals and transgender persons: stories of shame and confusion, courage and self-acceptance. The final chapter examines current and possible future treatment options for autogynephilic gender dysphoric men. Included in this important volume are: • Narratives by autogynephilic transsexuals • Developmental histories of autogynephilic transsexuals • Descriptions of different types of autogynephilia • Autogynephilia's relationship to heterosexuality • Narratives by nontranssexual autogynephiles • Contrasting views of the meaning of autogynephilia For researchers who study gender dysphoria, MtF transsexualism, paraphilias, and related conditions, and for clinicians who treat patients with these conditions, Men Trapped in Men's Bodies provides an essential resource for understanding an underappreciated aspect of MtF transsexualism. For MtF transsexuals and transgender persons, as well as their partners, family members, friends, and associates, the book is a welcome new source of information and validation.

Abstract: The more international law, taken as a global answer to global problems, intrudes into domestic legal systems, the more it takes on the role and function of domestic law. This raises a separation of powers question regarding law-making powers. In this book the author considers that specific issue. In contrast to other studies on domestic courts applying international law, the author’s constitutional orientation focusses on the presumptions concerning the distribution of state power. He collects and examines relevant decisions regarding treaties and customary international law from four leading legal systems, the US, the UK, France, and the Netherlands. Those decisions reveal that institutional and conceptual allegiances to constitutional structures render it difficult for courts to see their mandates and powers in terms other than exclusively national. What follows is a constitutional asymmetry between international law and national law generating an inevitable dualism which cannot necessarily be overcome by express constitutional provisions accommodating international law. The separation of powers thus frames the two principal horizons for any future, practicable attempts at integrating of the two legal orders. Either established concepts of constitutional law and constitutionalism will have to be revised, or what international law may do within a municipal legal system will have to be recalculated. This book offers new insight and new approaches in dealing with international law questions before domestic courts. It is an interesting work of reference and a basis for further debate on this topic among academics and practitioners in the fields of international and constitutional law. David Haljan is a Senior Research Fellow with the Institute of Constitutional Law, University of Leuven

Abstract: "Federal Indian Law encompasses nearly 400 Indian treaties, hundreds of federal statutes, and thousands of court decisions. When the first edition of The Rights of Indians and Tribes was published in 1983, it firmly established itself as the only book explaining Federal Indian Law in a clear and easy-to-understand way for students and practitioners of Indian law, tribal advocates, government officials, and the general public. Numerous tribal leaders highly recommend this book. Incorporating a user-friendly question-and-answer format, veteran legal counsel Stephen Pevar addresses the most significant legal issues facing Indians and Indian tribes, including tribal sovereignty, the federal trust responsibility, the regulation of non-Indians on reservations, Indian treaties, the Indian Civil Rights Act, the Indian Gaming Regulatory Act, and the Indian Child Welfare Act. This fully updated new edition includes a wealth of new information on recent legislation and judicial decisions, and it also features an introduction by John Echohawk, Executive Director of the Native American Rights Fund"--

The size and scope of their protests rivaled celebrated demonstrations from earlier decades for workers' rights, civil rights, or the end of war. Why and how did the immigrant rights' protests occur? Why did they end so abruptly? What is their legacy? This book is the first to address these questions by bringing together a broad, multidisciplinary account of the immigration rights rallies, protests, and boycotts of spring 2006. Drawing on top academics in the fields of sociology, political science, and Latino studies, as well as those involved with grassroots organizing and public policy debates, this volume covers the antecedents, evolution, and legacy of the 2006 protests, including discussions of unions, churches, media, immigrant organizations, and the landscape of immigration politics in the United States. Abstract: In this comparative study, Ellermann examines the capacity of the liberal democratic state to coercively regulate individuals within its borders. Ellermann shows that the conditions underlying socially coercive state capacity systematically vary not only across institutional contexts but also across stages in the policy cycle.

Abstract: In the past twenty-five years, no one has been more instrumental than Catherine MacKinnon in making equal rights real for women. As Peter Jennings once put it, more than anyone else in legal studies, she "has made it easier for other women to seek justice". This collection brings together previously uncollected and unpublished work in the national arena from 1980 to the present, defining her clear, coherent, consistent approach to reframing the law of men on the basis of the lives of women.
