In Lion's Share Veit Erlmann traces the role of copyright law in this process and its impact on the South African music industry. Although the South African government tied the reform to its post-apartheid agenda of redistributive justice and a turn to a post-industrial knowledge economy, Erlmann shows how the persistence of structural racism and Euro-modernist conceptions of copyright threaten the viability of the reform project.     Abstract: Schon vor 50 Jahren kämpfte Afrika um seine Kunst, die während der Kolonialzeit massenweise in europäische Museen gelangt war. Und es fand durchaus Unterstützung im Westen. Am Ende jedoch war der Kampf nicht nur vergebens, er wurde auch erfolgreich vergessen gemacht. Auf der Grundlage von unzähligen unbekannten Quellen aus Europa und Afrika erzählt Bénédicte Savoy die gespenstische Geschichte einer verpassten Chance, einer Niederlage, die heute mit umso größerer Wucht auf uns zurückschlägt. Afrikas Bemühungen um seine in der Kolonialzeit nach Europa verbrachte Kunst sind keineswegs neu. Schon bald nach 1960, als 18 ehemalige Kolonien die Unabhängigkeit erlangten, wurde von afrikanischen Intellektuellen, Politikern und Museumsleuten eine ungeheure Dynamik in Gang gesetzt. In ganz Europa suchten daraufhin Politikerinnen und Politiker, Journalisten, Akademiker und einige Museumsleute einen Weg, afrikanische Kulturgüter im Sinne einer postkolonialen und postrassistischen Solidarität zurückzugeben. Die Argumente aber, mit denen andere versuchten, die Forderungen aus Afrika zu entkräften und Lösungen zu verhindern, ähneln auf frappierende Weise denen von heute. Schließlich verlief alles im Sand. „Gebt koloniale Raubkunst zurück! Dafür engagiert sich Bénédicte Savoy. In ihrem Buch zeigt die Kunsthistorikerin nun, dass ihr Kampf ein alter ist. Schon in den 1960er-Jahren drängten die neu gegründeten Staaten Afrikas auf eine Rückführung – erfolglos. In the case of Japan, these frictions have manifested themselves as historical issues. The history since World War II has also been a history of trying to overcome the hostility surrounding these issues. Since the end of the war there have been various attempts at reconciliation, and indeed, periods in which Japan has enjoyed good relations with China and also with South Korea. Despite that, historical issues have overheated in the twenty-first century, and their effects may extend beyond Japan's relations with China and South Korea to impact its relations with the United States, Southeast Asia, and Europe. --

    Abstract: This book examines the Kashmir dispute from both sides of the Line of Control (LoC) and within the theoretical frame of border studies. It draws on the experiences of those living in these territories such as divided families, traders, cultural and social activists. Kashmir is a borderland, that is, a context for spatial transformations, where the resulting interactions can be read as a process of "becoming" rather than of "being". The analysis of this borderland shows how the conflict is manifested in territory, in specific locations with a geopolitical meaning, evidencing the discrepancy between "representation" and the "living". The author puts forward the concept of belonging as a useful category for investigating more inclusive political spaces.

    Abstract: "Rights Make Might examines why the three most salient minority groups in Japan all expanded their activism since the late 1970s and chronicles the galvanizing effects of global human rights ideas and institutions on local social movements. The prehistory of the three groups reveals that minority politics in Japan before the 1970s featured politically dormant Ainu - an indigenous people in northern Japan -, active but unsuccessful Koreans - a stateless colonial legacy group -, and active and established Burakumin - a former outcaste group that still faced social discrimination. Despite the unfavorable domestic political environment, the infusion of global human rights ideas and the opening of international human rights arenas as new venues for contestation transformed minority activists' movement actorhood, or subjective understanding about their position and entitled rights in Japan, as well as the views of the Japanese public and political establishment toward those groups, thus catalyzing substantial gains for all three groups. Having benefited from global human rights, all three groups also repaid their debt by contributing to the consolidation and expansion of global human rights principles and instruments. Drawing on interviews and archival data, Rights Make Might offers a detailed historical and comparative analysis of the co-constitutive relationship between international human rights activities and local politics that contributes to our understanding of international norms, multilateral institutions, social movements, human rights, and ethno-racial politics."

In this time of expanding commercial activity, a mélange of Arab, Indian, Swahili and Baloch merchants, planters, jurists, judges, soldiers and seamen forged the frontiers of a shared world. The interlinked worlds of trade and politics that these actors created, the shared commercial grammars and institutions that they developed and the spatial and socio-economic mobilities they engaged in endured until at least the middle of the twentieth century.     Abstract: Women Judges in the Muslim World: A Comparative Study of Discourse and Practice' fills a gap in academic scholarship by examining public debates and judicial practices surrounding the performance of women as judges in eight Muslim-majority countries (Indonesia, Malaysia, Pakistan, Syria, Egypt, Libya, Tunisia and Morocco). Gender, class, and ethnic biases are inscribed in laws, particularly in the domain of shari'a-derived family law. Editors Nadia Sonneveld and Monika Lindbekk have carefully woven together the extensive fieldwork and expertise of each author. The result is a rich tapestry that brings out the various effects of women judges in the management of justice.     Abstract: This volume is an updated and expanded version of the authors original book, first published by Martinus Nijhoff Publishers and based on his cum laude doctoral dissertation. That volume discussed how the Five Principles of Peaceful Coexistence drowned in the first war between a communist and a non-aligned state. This new edition reproduces the original text, but supplements it considerably in light of subsequent developments and official records and reports only later released or leaked to the public. It places Sino-Indian relations in the wider, current context of the rise of China, the position of Tibet and the disorganised state of Asia. The border dispute did not prevent substantial economic relations developing between the two countries and visits taking place at the highest political level. But it still gives rise to almost daily incursions, and in the current climate, the risk of a clash is growing, as forces have been strengthened and most of the Line of Actual Control has not been demarcated. This thought-provoking volume sheds light on what is still a complex and uneasy relationship

    Abstract: "The debate over what makes human beings unique has raged for hundreds of years, and many believe it is urgent to convince others to accept their particular definition of what it is to be human. Despite these dire warnings, nobody has empirically examined whether particular definitions of a human actually lead to maltreatment. In this book sociologist John H. Evans does and concludes that the definitions of a human promoted by biologists and philosophers actually are associated with less support for human rights. Members of the public who agree with these definitions say they are less willing to sacrifice to stop genocides, and are more supportive of buying organs from poor people, experimenting on prisoners against their will, torturing people to potentially save lives, and having terminally ill people commit suicide to save money. It might appear that the assumptions of critics are empirically correct. However, Evans finds that these critics are actually only partially right, and a detailed examination of the public's views reveals a much more subtle and complex situation. First, he shows that only a minority of the general public agrees with the definitions associated with less support for human rights. Then, he shows that the public has its own definitions of a human being that are unlikely to lead to human rights abuses. So while the critics are right about the definitions of a human promoted by academic biologists and philosophers, at present their concern about widespread maltreatment is overblown"--

    Abstract: "Entsetzt verfolgen viele Menschen die Meldungen über die Gräueltaten des Terror-Regimes IS in Syrien und im Irak. Insofern erscheint der Titel von Guido Steinbergs neuem Werk durchaus angemessen: "Kalifat des Schreckens." Das Buch ist keines, das man nach der Lektüre einfach zur Seite legt. Sein Inhalt schreckt auf, beunruhigt, fordert eine Reaktion heraus. (...) "Kalifat des Schreckens" zielt darauf, ein breiteres Publikum anzusprechen IBM anders noch als Steinbergs vorangegangenes Buch "al-Qaidas deutsche Kämpfer". Es ist deutlich kürzer und einfacher geschrieben. Dennoch wären weniger Zeitsprünge, weniger Fakten und Informationen, dafür mehr Analyse zum besseren Verständnis des schwierigen Themas hilfreich gewesen. Dass der Autor das spielend beherrscht, ohne dabei an Qualität einzubüe︢n, hat er in seinen vielen Medienauftritten hinlänglich unter Beweis gestellt. (Deutschlandfunk, 03.03.2015)

    Abstract: "This highly original work demonstrates the role and importance of customary law as the primary source of law for indigenous peoples all over the world. The book reviews the relationship between customary, positive and natural law from the time of Plato up to the present day. It examines its recognition in constitutional law and in international human rights and environmental instruments. The author analyses the role of customary law in tribal, national and international governance of indigenous peoples' lands, resources and cultural heritage. He explores the challenges and opportunities for its recognition by courts and alternative dispute resolution mechanisms, including issues of proof of law and conflicts between customary practices and human rights. It concludes that indigenous peoples' rights to their customary legal regimes and states' obligations to respect and recognise customary law, in order to secure their human rights, are principles of international customary law, and as such binding on all states. At a time when the land and resources of indigenous peoples are increasingly under threat, the book provides an accessible overview of the key issues for both legal and non-legal scholars, students of human rights and environmental justice, and indigenous peoples themselves"--

    Abstract: In der moralphilosophischen Literatur existieren verschiedene Auffassungen darüber, worauf die Autorität moralischer Normen basiert. Einige Moralphilosophen führen das moralische Sollen auf die Vernunft, das Wohlwollen oder auch auf die Wahrnehmung moralischer Tatsachen zurück; andere dagegen meinen, dass das moralische Sollen auf äußeren Sanktionen wie sozialem Ausschluss oder inneren Sanktionen wie Schuldgefühlen beruht. Die sowohl in der Geschichte der Philosophie als auch in der gegenwärtigen Auseinandersetzung häufig vertretene Meinung, dass moralische Verpflichtung notwendig an Sanktionierung geknüpft ist, wird aus verschiedenen Perspektiven kritisch untersucht.

    Abstract: Die Außengrenzen sind zu einem umkämpften Raum der EU-Politik zwischen Grenzkontrollen und Flüchtlingsrechten geworden. Silja Klepp stellt diese Aushandlungskämpfe in einer Ethnographie der Seegrenze dar. Forschungsreisen entlang der Küsten von Libyen, Italien und Malta verbinden sich zu einem einzigartig dichten Blick auf die Zwänge und Handlungslogiken der Akteure im Grenzraum. Auf der Spur der Flüchtlinge von Süden nach Norden werden die Lage der Migrantinnen in Libyen, die Grenzschutzagentur Frontex und die Verhältnisse auf See sowie schließlich Haftzentren und andere Grenzeinrichtungen in den Ankunftsorten Malta und Süditalien illustriert und auf die europäische Politik rückbezogen. Eine intensive Perspektive auf einen umstrittenen Teil der europäischen Außenpolitik.
