    Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective. On the basis of the distinction between organizational and individual deviance, it could be shown across national boundaries that the unwritten rules of the organization make a decisive contribution in explaining organizational wrongdoing, as well as their containment. Implications for effective prevention derived from this are also pointed out.     Abstract: Krisen werden regelmäßig als Ausnahmen wahrgenommen. Dies erklärt auch, warum sich die rechtliche Auseinandersetzung mit Krisen auf Notstandskonzepte konzentriert. Gleichzeitig hat der Ausnahmezustand im Sinne Carl Schmitts Konjunktur, um bestimmte Krisenphänomene zu erklären. Zu diesen Phänomenen gehört, dass sich das Verständnis und damit der Inhalt bestehender Rechtsnormen in Krisen wandelt. Diese Auslegungsänderungen, häufig auch als Rechtsbrüche angeprangert, werden vor allem durch nichtrechtliche Einflüsse erklärt. Jasper Finke hingegen versteht Auslegungsänderungen in Krisenzeiten als Teil des Rechts. Ausgangspunkt hierfür ist ein Krisenverständnis, für das der Begriff der Erwartung zentral ist. Bei Krisen handelt es sich um Anpassungsprozesse dieser zunächst enttäuschten Erwartungen. Als Normalitätserwartung sind sie aber auch Bestandteil der Auslegung einer Norm. Ändern sich die Erwartungen, spiegelt sich dies im Inhalt der Norm wider.
    Abstract: Conceptualizing crises as part of the normality-exception dichotomy turns a blind eye to the long-term effects of crises, especially the impact they have on the meaning of existing legislation. Jasper Finke reveals why changing interpretations in response to a crisis are to be understood as a process that is inherent to law and not something that is imposed on law.

    Abstract: Thomas Kleinlein analysiert die unterschiedlichen Potentiale für eine dialogische und pluralistische Grundrechtsjudikatur, die föderalen Grundrechtssystemen innewohnen. Gegenstand seiner Untersuchung sind Deutschland, die USA und die EU. Als Alternative zu einem verbreiteten staats- und souveränitätszentrierten Verständnis schlägt er eine föderale Theorie der Mehrebenen-Grundrechtsjudikatur vor. Mit einer solchen föderalen Sichtweise lassen sich dogmatische Figuren, über die Anwendungsbereiche, Kontrollmaßstäbe und -intensität definiert werden, als Ausdruck der institutionellen Strukturen und der Interaktion der beteiligten Gerichte begreifen. Praktischer Ertrag der Forschung sind Vorschläge, die Gerichten in Mehrebenen-Strukturen Orientierung bieten können, vor allem angesichts der aktuellen Herausforderungen, mit denen der Grundrechtsschutz in Europa konfrontiert ist.

    Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. Ein Schwerpunkt der Untersuchung liegt auf dem Schnittpunkt von Einwanderung und dem Schutz der nationalen Sicherheit. Bei der Ausbalancierung der hier vorzufindenden gegenläufigen Interessen spielen Verfahrensrechte eine erhebliche Rolle. Die Autorin geht daher der Frage nach, ob bzw. welche materiellen und prozessualen Rechte einer einreisewilligen Person in einem Konsulat des Zielstaates auf ausländischem Territorium im Visumverfahren zustehen und welche Rechte der stammberechtigten Person in dem Zielstaat selbst zukommen. Die Beantwortung der Frage wird maßgeblich durch die Einbindung eines Staates in eine internationale bzw. supranationale Rechtsordnung bestimmt, weshalb ein besonderer Fokus auf dem Völkerrecht, dem Unionsrecht und dem europäischen Menschenrechtsregime liegt.

    Abstract: Das Spannungsverhältnis zwischen Einheit und Vielfalt durchzieht und charakterisiert föderale Systeme. Holger P. Hestermeyer arbeitet dieses anhand des Gegensatzpaares Eigenständigkeit und Homogenität auf. Dabei werden die föderalen Systeme Deutschlands, der USA und der EU verglichen und der Vergleich um den historischen Kontext bereichert. Vier, die Eigenständigkeit der Gliedstaaten betonende Topoi und drei, die Verfassungsräume eines föderalen Systems homogenisierende Mechanismen werden untersucht, Verfassungsrhetorik von Verfassungsrealität getrennt und gezeigt, welches Gleichgewicht zwischen zentripetalen und zentrifugalen Kräften die Systeme gefunden haben. Dabei geht der Verfasser davon aus, dass keine »optimale« Balance zwischen den beiden Polen existiert, sondern vielmehr jede Generation für sich neu entscheiden muss, welches Maß an Homogenität und welches Maß an Eigenständigkeit der Gliedstaaten ihr angemessen erscheint.

Hestermeyer compares the German, US and EU federal systems, including their historical contexts, and reveals the balance that has been struck in each between the two opposing tendencies.

    Abstract: In diesem Buch untersucht der Autor in einer vor allem rechtsvergleichenden Studie aus dem Wettbewerbsrecht den von marktbeherrschenden Unternehmen ausgeübten Behinderungsmissbrauch bei einer vertikalen Marktstruktur. Der unmittelbare Anlass sind die unterschiedlichen Urteile von U.S. Supreme Court und Europäischem Gerichtshof (EuGH) zur Kosten-Preis-Schere (KPS), welche eine Preisstrategie von vertikal integrierten Unternehmen ist. Mithilfe einer Analyse verschiedener Fälle werden sowohl die US-amerikanischen, die europäischen und die koreanischen Regulierungsgrundlagen eines bei einer bestimmten Marktstruktur ausgeübten Behinderungsmissbrauchs miteinander verglichen.     Abstract: Internetquellen spielen in der Praxis der deutschen Zivilgerichte eine wichtige Rolle. Gleichzeitig sind die Grundlagen und Voraussetzungen ihrer Berücksichtigung weitgehend ungeklärt. Vielfach wird das Rechtsinstitut der Offenkundigkeit gemäß § 291 ZPO herangezogen, um gerichtliche Internetrecherchen zu legitimieren. Dem widerspricht Georg Haas anhand einer umfassenden Auslegung der Vorschrift und zeigt auf, dass die Berücksichtigung von Internetquellen grundsätzlich im Rahmen des Beweisverfahrens zu erfolgen hat. Auf dieser Grundlage kann sich eine Befugnis des Gerichts zu Internetrecherchen insbesondere aus den Regeln über die Beweisaufnahme von Amts wegen ergeben. Diese Befunde werden durch eine rechtsvergleichende Untersuchung des US-amerikanischen Zivilprozessrechts erhärtet. Zudem zeigen die Erkenntnisse aus dem Bereich der Kognitionspsychologie, dass unbeschränkte richterliche (Internet-)Recherchen erhebliche Risiken bergen.     Abstract: Die Dissertation durchmisst ein ausweislich des Koalitionsvertrages für die 19. Legislaturperiode gesetzgeberisch noch unzulänglich strukturiertes Feld des Wirtschaftsstrafrechts. Oliver Jedynak untersucht die besonderen Schwierigkeiten bei internen Erhebungen, bei denen die Anforderungen unterschiedlicher Rechtsgebiete zu beachten sind. Auch die Tätigkeit eines Unternehmensanwalts wirft eine Reihe rechtlicher und praktischer Fragen auf, wenn es darum geht, Unternehmen im Hinblick auf drohende oder bereits anhängige Ermittlungsverfahren zu beraten. Hier spielt insbesondere die Frage nach der Beschlagnahmefreiheit von anwaltlichen Unterlagen eine große Rolle.     Abstract: Claudia Letzien untersucht am Beispiel der USA, Deutschlands und Großbritanniens die Strafbarkeit der Bestechung ausländischer Amtsträger und die verschiedenen Sanktionen, die in diesem Zusammenhang gegen Unternehmen verhängt werden können. Die Autorin widmet sich der Problematik der Jurisdiktionskonflikte, die entstehen, wenn verschiedene Staaten ihren Sanktionsanspruch gegen ein Unternehmen durchsetzen wollen und verdeutlicht, dass diese mit dem Grundsatz ne bis in idem nicht gelöst werden können. Sie schlägt ein Verfahren vor, mit dem ein bestmöglicher Ausgleich der unterschiedlichen Interessen bei der Unternehmenssanktionierung durch mehrere Staaten in Auslandsbestechungsfällen gelingen kann.     Abstract: "Do the United States and France, both post-industrial democracies, differ in their views and laws concerning discrimination? Marie Mercat-Bruns, a Franco-American scholar, examines the differences in how the two countries approach discrimination. Bringing together prominent legal scholars--including Robert Post, Linda Krieger, Martha Minow, Reva Siegel, Susan Sturm, Richard Ford, and others--Mercat-Bruns demonstrates how the two nations have adopted divergent strategies. The United States continues, with mixed success at "colorblind" policies, to deal with issues of diversity in university enrollment, class action sex-discrimination lawsuits, and rampant police violence against African American men and women. In France, the country has banned the full-face veil while making efforts to present itself as a secular republic. Young men and women whose parents and grandparents came from sub-Sahara and North Africa are stuck coping with a society that fails to take into account the barriers to employment and education they face. Discrimination at Work provides an incisive comparative analysis of how the nature of discrimination in both countries has changed, now often hidden, or steeped in deep unconscious bias. While it is rare for employers in both countries to openly discriminate, deep systemic discrimination exists, rooted in structural and environmental causes and the ways each state has dealt with difference in general.     Abstract: Law and economics are interdependent. Using a historical case analysis approach, this book demonstrates how the legal process relates to and is affected by economic circumstances. Glen Atkinson and Stephen P. Paschall examine this co-evolution in the context of the economic development that occurred in the nineteenth and early twentieth centuries as well as the impact of the law on that development. Specifically, the authors explore the development of a national market, the transformation of the corporation, and the conflict between state and federal control over businesses. Their focus on dynamic, integrated systems presents an alternative to mainstream law and economics. The authors apply John R. Commons's approach to three main law and economics issues: the changing relationship between corporations and the state, the application of the Commerce Clause and the Fourteenth Amendment of the US Constitution to state and federal regulation of business, and the relationship of antitrust law to industrialization. They provide a valuable linking of law with changing economic circumstances such as antitrust policy changes and the development of the corporate form.     Abstract: Taxing the Rich draws on unparalleled evidence from twenty countries over the last two centuries to provide the broadest and most in-depth history of progressive taxation available. Scheve and Stasavage explore the intellectual and political debates surrounding the taxation of the wealthy while also providing the most detailed examination to date of when taxes have been levied against the rich and when they haven't. Fairness in debates about taxing the rich has depended on different views of what it means to treat people as equals and whether taxing the rich advances or undermines this norm. Scheve and Stasavage argue that governments don't tax the rich just because inequality is high or rising--they do it when people believe that such taxes compensate for the state unfairly privileging the wealthy. Progressive taxation saw its heyday in the twentieth century, when compensatory arguments for taxing the rich focused on unequal sacrifice in mass warfare. Today, as technology gives rise to wars of more limited mobilization, such arguments are no longer persuasive. Taxing the Rich shows how the future of tax reform will depend on whether political and economic conditions allow for new compensatory arguments to be made. (Publisher's Web site)

    Abstract: This book explores California’s prison system in the context of vocational education reform. For prisons in the early twenty-first century, ideologies of evidence-based management meant that reform efforts to change the purpose of prisons from punishment to rehabilitation through vocational education required “evidence” to justify policy prescriptions. Yet who determines what constitutes evidence? In political environments, solutions are typically pre-conceived, which means that the nature of the evidence collected is also preconceived. As a result, key assumptions about outcomes are often wished away to show improvement and be accountable. Through a detailed analysis interspersed with stories from the authors’ experiences “behind the wall” among California’s prison population, the authors challenge the nature of evidence-based research as used in the prison environment.     Abstract: This book, which originated from the broadly held view that there is a lack of Rule-of-law in Mexico, and from the emphasis of traditional academia on cultural elements as the main explanation, explores the question of whether there is any relationship between the system of constitutional review ― and thus the ‘law’ as such ― and the level of Rule-of-law in a given state. To do so, it elaborates a theoretical model for achieving Rule-of-law and compares it to the constitutional review systems of the United States, the Federal Republic of Germany, and Mexico. The study concludes that the two former states correspond to the model, while the latter does not. This is fundamentally due to the role each legal system assigns to ordinary jurisdiction in carrying out constitutional review. Whereas the US and Germany have fostered the policy that constitutional review regarding the enforcement of basic rights is the responsibility of ordinary courts, Mexico has relied too heavily on the specialized constitutional jurisdiction. .

    Abstract: This book tackles the regulatory issues of Unmanned Aerial Systems (UAS) or Remotely-Piloted Aerial Systems (RPAS), which have profound consequences for privacy, security and other fundamental liberties. Collectively known as “drones,” they were initially deployed for military purposes: reconnaissance, surveillance and extrajudicial executions. Today, we are witnessing a growth of their use into the civilian and humanitarian domain. They are increasingly used for goals as diverse as news gathering, aerial inspection of oil refinery flare stacks, mapping of the Amazonian rain-forest, crop spraying and search and rescue operations. The civil use of drones is becoming a reality in the European Union and in the US.The drone revolution may be a new technological revolution. Proliferation of the next generation of “recreational” drones show how drones will be sold as any other consumer item. The cultural perception of the technology is shifting, as drones are increasingly being used for humanitarian activities, on one hand, but they can also firmly be situated in the prevailing modes of postmodern governance on the other hand. This work will be of interest to researchers in Criminology and Criminal Justice interested in issues related to surveillance, security, privacy, and technology. It will also provide a criminological background for related legal issues, such as privacy law, aviation law, international criminal law, and comparative law.

    Abstract: Das Werk beschäftigt sich mit der Frage, was genau unter indigenen Landrechten zu verstehen ist, wie sie im internationalen Vergleich realisiert werden, und ob der Schutz und die Durchsetzung indigener Landrechte in den einzelnen Ländern den völkerrechtlichen Mindestanforderungen entsprechen. Es bewegt sich hierbei auf der Schnittstelle zwischen öffentlichem Recht, Rechtsvergleichung und Völkerrecht. Im Ergebnis wird gezeigt, dass der Umgang der Staaten mit Landrechten indigener Völker den völkerrechtlichen Mindestanforderungen oftmals nicht entspricht. Ferner wird dargelegt, dass die Regierungen nicht auf die unterschiedlichen historischen Vorgehensweisen, durch die indigene Gebiete kolonisiert und indigene Völker in der Vergangenheit enteignet wurden, verweisen können, um eine Ungleichbehandlung indigener Völker in den unterschiedlichen Staaten oder in verschiedenen Regionen innerhalb ein und desselben Staates zu rechtfertigen. Stattdessen sind allein der politische Wille einer Regierung, die Einstellung der Mehrheitsgesellschaft gegenüber indigenen Völkern und das Auftreten und die Organisation der indigenen Völker ausschlaggebend dafür, ob und in welchem Umfang diese ihre Rechte an ihren traditionellen Gebieten durchsetzen können.

    Abstract: This book is highly topical. The shift from the multilateral WTO negotiations to bilateral and regional Free Trade Agreements has been going on for some time, but it is bound to accelerate after the WTO Doha round of negotiations is now widely regarded as a failure. However, there is a particular regional angle to this topic as well. After concluding that further progress in the Doha round was unlikely, Pacific Rim nations recently have progressed with the negotiations of a greatly expanded Trans-Pacific Partnership Agreement that includes industrialised economies and developed countries such as the United States, Japan, Australia and New Zealand, recently emerged economies such as Singapore, but also several developing countries in Asia and Latin America such as Malaysia and Vietnam. US and EU led efforts to conclude FTAs with Asia-Pacific nations are also bound to accelerate again, after a temporary slowdown in the negotiations following the change of government in the United States and the expiry of the US President’s fast-track negotiation authority. The book will provide an assessment of these dynamics in the world’s fastest growing region. It will look at the IP chapters from a legal perspective, but also put the developments into a socio-economic and political context. Many agreements in fact are concluded because of this context rather than for purely economic reasons or to achieve progress in fields like IP law. The structure of the book follows an outline that groups countries into interest alliances according to their respective IP priorities. This ranges from the driving forces of the EU, US and Japan, via Asia-Pacific resource-rich but IP poor economies such as Australia and New Zealand, recently emerged economies with strong IP systems such as Singapore and Korea to leading developing countries such as China and India and ‘second tier industrializing economies’ such as Thailand, Malaysia and Indonesia

    Abstract: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany.     Abstract: "Ten years ago, in the wake of massive crimes in central Africa and the Balkans, the first permanent international criminal court was established in The Hague despite resistance from some of the world's most powerful states. In the past decade, the court has grown from a few staff in an empty building to a bustling institution with more than a thousand lawyers, investigators, and administrators from around the world. Despite its growth and the backing of more than 120 nations, the ICC is still struggling to assert itself in often turbulent political crises. The ICC is generally autonomous in its ability to select cases and investigate crimes, but it is ultimately dependent on sovereign states, and particularly on the world's leading powers. These states can provide the diplomatic, economic, and military clout the court often needs to get cooperation-and to arrest suspects. But states don't expend precious political capital lightly, and the court has often struggled to get the help it needs. When their interests are most affected, moreover, powerful states usually want the court to keep its distance. Directly and indirectly, they make their preferences known in The Hague. Rough Justice grapples with the court's basic dilemma: designed to be apolitical, it requires the support of politicians who pursue national interests and answer to domestic audiences.
