    Abstract: This book offers a fresh perspective on the Habitats Directive's rules on designating Natura 2000 - the European biodiversity conservation network. Although the Habitats Directive came into force in the early 1990s, the network is not yet optimally set up and lacks coherence and connectivity. The author examines the Habitats Directive’s provisions regarding the designation of Natura 2000 and discusses possible reasons for the EU Member States’ ongoing lack of compliance with their designation duties. She reassesses the 2015 REFIT Fitness Check of the Nature Directives to look for the Member States’ reasons for not having optimally complied with their designation duties yet. She then analyses the Habitats Directive to reveal elements of non-optimal drafting in its designation provisions. Sensible law reforms that do not interfere with the general framework of the Habitats Directive and which keep in mind the relevant national, regional, and international biodiversity law and policy, as well as the relevant case law will be discussed to this end. As a result, this book presents an enhanced legal designation framework that can support Member States’ compliance with their designation obligations. The book finally goes beyond the European biodiversity legislation, also shedding light on the effects of the suggested reforms for the broader biodiversity and environmental law and policy landscape, and concludes that reforming the Habitats Directive would benefit a variety of contemporary areas of law. This book targets academics and policy-makers in the field as it provides a scholarly as well as a hands-on approach to the subject of strengthening European biodiversity law.

    Abstract: This book uses the early twentieth century surveillance reports of urban vice reformers in New York, Chicago, Lancaster, Pennsylvania, as well as the US vice report for the League of Nations’ Special Body on Trafficking in Women and Children (from 1927) and French police memoirs, treatises, and histories of vice enforcement in late nineteenth century and early twentieth century Paris to highlight the way in which American reliance on undercover tactics drove American vice enforcement policy, leading to a clash with French vice enforcement policy before the League of Nations. Both the failure of that early effort to exert international influence on vice enforcement and the American embrace of undercover tactics would set the stage for the later American efforts to promote a global war on drugs. Before the League of Nations, in particular, the American delegation’s notable lack of success in mobilizing European crackdowns on prostitution created a blueprint for how not to project American influence overseas, once American advocates of narcotics interdiction sought to promote a global war on drugs. Yet private reformers’ reliance on undercover tactics to investigate prostitution modeled the investigative tactics on which American law enforcement would come to depend, and which it would later seek to export, as a primary weapon in the war on drugs.

    Abstract: This book proposes a novel connectionist approach to a challenging topic of language modeling within the context of kernel memory and artificial mind system, both proposed previously by the author in the very first volume of the series, Artificial Mind System—Kernel Memory Approach: Studies in Computational Intelligence, Vol. 1. The present volume focuses on how syntactic structures of language are modeled in terms of the respective composite connectionist architectures, each embracing both the nonsymbolic and symbolic parts. These two parts are developed via inter-module processes within the artificial mind system and eventually integrated under a unified framework of kernel memory. The data representation by the networks embodied within the kernel memory principle is essentially local, unlike conventional artificial neural network models such as the pervasive multilayer perceptron-based neural networks. With this locality principle, kernel memory inherently bears many attractive features, such as topologically unconstrained network formation, straightforward network growing, shrinking, and reconfiguration, no requirement of arduous iterative parameter tuning, construction of transparent and hierarchical data structures, and multimodal and temporal data processing via the network representation. Exploiting these multifacet properties of kernel memory with interweaving the notion of inter-module processing within the artificial mind system provides coherent accounts for concept formation and how various linguistic phenomena, viz. word compoundings, morphologies, and multiword constructions, are modeled. The description is then extended to more intricate network models of context-dependent lexical network and syntactic-oriented processing, the latter being the central theme of the present study, and further to those representing a hybrid of nonverbal and verbal thinking, and semantic and pragmatic aspects of sentential meaning. The book is intended for general readers engaging in various areas of study in cognitive science, computer science, engineering, linguistics, philosophy, psycholinguistics, and psychology.

    Abstract: This book reflects on the nature of the rule of law in the European Union and the present and future consequences of the attacks that are undermining it. Presenting various case studies, it analyses violations of the rule of law and their impact on the quality of European democracy and on the workings of civil and political society. Written from an interdisciplinary perspective, the book connects legal aspects related to infringements of the rule of law with their political and sociological consequences at both a general and the EU level. The book is divided into three parts. The first focuses on the rule of law in the European context and the threats to democracy posed by its violations. It examines how populist movements and parties utilize the erosion of the checks and balances in liberal democracies to weaken resisting intermediate bodies, such as dissenting civil society groups.     Abstract: This volume presents the various ways in which the study of gender makes a difference in archaeological research, the archaeological academic milieu and the wider public’s thinking about gender and considers avenues of future development. It addresses questions such as why gender matters for archaeology, while examining gender from various angles (including aspects such as subjectivity, embodiment, diet, multifaceted perspectives and intersectionality) and in various periods (prehistory, Ancient Egypt, Roman antiquity, the Middle Ages and the modern and contemporary periods). It also discusses the relationship between archaeology and other academic fields involving the study of gender, as well as representations and debates on gender in the media. The theme ‘gender and change in archeology’ emerged out of concerns voiced within the ‘Archaeology and Gender in Europe’ (AGE) working community of the European Association of Archaeologists (EAA) with respect to the future of gender archaeology. This book unites researchers of gender archaeology from two perspectives: that of gender archaeologists from academic milieus where the study of gender has long been established and who in the meantime came to feel that this avenue of inquiry had become predictable and lost its provocative power, and that of gender archaeologists from countries where this field was only recently introduced and who, while more enthusiastic about the utility of gender archaeology, are concerned with how to disseminate it among skeptical peers. Both groups of archaeologists mainly argue that, four decades on, the study of gender in archaeology is still able to generate considerable change in our understanding of past and present-day societies.     Abstract: This open access book brings together different perspectives on migration and the city that are usually discussed separately, to show the special character of the urban context as a territorial and political space where people coexist, whether by choice or necessity. Drawing on heterogeneous situations in cities in different world regions (including Europe, North America, the Middle East, South, Southeast and East Asia and the Asia Pacific) contributions to this volume examine how migration and the urban context interact in the twenty-first century. The book is structured in four parts. The first looks at cities as hubs of cultural creativity, exploring the many dimensions of cultural diversity and identity as they are negotiated in the urban context. The second focuses on what lies outside the large urban centres of today, notably suburbs, while the third part engages with migration and diversity in small and mid-sized cities, many of which have adopted strategies to welcome growing numbers of migrants. Last but not least, the fourth part looks at the challenges and opportunities that asylum-seeking and irregular migration flows bring to cities. By providing a variety of empirical cases based on various world regions, this book is a valuable resource for researchers, students and policy makers.

    Abstract: This book gives an account of the origins of theoretical mechanics in antiquity, its limited reception in the Arabic and Latin Middle Ages, and its recovery and subsequent development in Italy to the time of Galileo. From late antiquity to the fifteenth century, the ancient science of mechanics—the theory of machines—was almost completely unknown in the Latin west. Then, from the mid-fifteenth century on, Italian humanists began to recover the ancient texts, and from them through the sixteenth century Italian mathematicians restored the ancient science of mechanics. The Renaissance of Mechanics first examines the principal ancient works on mechanics—the Aristotelian Mechanical Problems, the mechanical geometry of Archimedes, and Hero’s Mechanics—and then describes their limited reception in the Arabic world and their even more limited transmission to the medieval Latin west. It then traces their recovery in the fifthteenth century and their assimilation in the sixteenth by Niccolò Tartaglia, Francesco Maurolico, and Guidobaldo dal Monte, culminating in Galileo’s rediscovery of Hero’s lost mechanical principles. The book ends with an examination of Galileo’s mechanics and its relation to his new science of motion, and suggests how modern mechanics would emerge from these ancient roots. Detailed analyses of these works offer new insights and interpretations while remaining accessible to general historians. The Renaissance of Mechanics will be of especial interest to those working in the fields of renaissance humanism and the history of ancient, medieval, and renaissance science and mathematics.

The book describes that, in the case of decided return and reintegration to a post-conflict society and a fragmented state, like Bosnia and Herzegovina, the returnees do not conceptualize the emotional dimension of their BiH citizenship as home and belonging as this citizenship does not make them feel safe and secure. Instead, “feeling at home” is found in family, place and time, while belonging is categorized as ethnic, religious, relational, landscape, linguistic, and economic. The emotional dimension of the home state citizenship is constituted through a wide spectrum of emotions, ranging from anger, frustration, fear, guilt, shame, disappointment, nostalgia, powerlessness, to patriotic love, pride, defiance, joy, happiness and hope.     Abstract: This open access volume explores the impact of globalization on the contemporary study of deep-time art. The volume explores how early rock art research’s Eurocentric biases have shifted with broadened global horizons to facilitate new conversations and discourses in new post-colonial realities. The book uses seven main themes to explore theoretical, methodological, ethical, and practical developments that are orienting the study of Pleistocene and Holocene arts in the age of globalization. Compiling studies as diverse as genetics, visualization, with the proliferation of increasingly sophisticated archaeological techniques, means that vast quantities of materials and techniques are now incorporated into the analysis of the world’s visual cultures. Deep-Time Images in the Age of Globalization aims to promote critical reflection on the multitude of positive – and negative – impacts that globalization has wrought in rock art research. The volume brings new theoretical frameworks as well as engagement with indigenous knowledge and perspectives from art history.     Abstract: This book extends the contemporary concept of the minimal self by introducing the affective core self. The overall aim is to integrate certain psychoanalytical ideas into the phenomenological investigation of passivity and reformulate the idea of the phenomenological unconscious. This volume contributes to the multidimensional analysis of the self by positioning the affective core self between the layers of the more minimal and the less minimal self. It underscores the importance of the unconscious in the constitution of the affective core self by providing the comparative analysis of the phenomenological and the psychoanalytical unconscious. Furthermore, comparisons are drawn between Freud’s conception of the afterwardsness of trauma and the phenomenological notion of retroactive sense-constitution. The book concludes that retroactive sense-making is a double-sided phenomenon and differentiates between implicit-bodily and conscious-narrative retroactive sense-constitution. In order to bolster the idea of implicit-bodily sense-constitution the volume also examines and utilizes contemporary insights on the nature of body memory. The conclusion claims that the affective core self is constituted in time by means of the underlying processes of the two-sided retroactive sense-constitution.     Abstract: The book analyzes socioeconomic through the lens of a lawyer. In the past decade the world has witnessed some severe financial and economic crises, espe­cially the financial crisis of 2007-2008 and the crisis caused by the COVID-19 pandemic. The author states that the socio-economic order has in the past four to five decades been thoroughly redesigned, generally favouring models that prio­ritize the free market over the public interest or even, more generally, government operation. He works out that during four to five decades, globalized, capitalist societies are facing a multiplicity of fundamental problems, such as: (1) increasing debt that severely burdens both the private and public sectors; (2) persistent poverty and an ever-increasing polarization between rich and poor, in addition to (3) intractable environmental problems that, fifty years after the Club of Rome's report entitled ‘Limits to growth’ (1972), has dragged the world into what in recent years has been referred to as "climate change." The book explains why all this is the direct result of value choices made from the late Middle Ages onwards, when in the Western world the societal models of that time were increasingly abandoned for a societal model that came to rely on the primacy of economic interests. The book not only subjects the ethical choices but also examines various problems it has caused and probes for possible ways out. This is an open access book.

    Abstract: This open access book explains how leading business organizations attempt to achieve the responsible and ethical use of artificial intelligence (AI) and other advanced information technologies. These technologies can produce tremendous insights and benefits. But they can also invade privacy, perpetuate bias, and otherwise injure people and society. To use these technologies successfully, organizations need to implement them responsibly and ethically. The question is: how to do this? Data ethics management, and this book, provide some answers. The authors interviewed and surveyed data ethics managers at leading companies. They asked why these experts see data ethics as important and how they seek to achieve it. This book conveys the results of that research on a concise, accessible way. Much of the existing writing on data and AI ethics focuses either on macro-level ethical principles, or on micro-level product design and tooling. The interviews showed that companies need a third component: data ethics management. This third element consists of the management structures, processes, training and substantive benchmarks that companies use to operationalize their high-level ethical principles and to guide and hold accountable their developers. Data ethics management is the connective tissue makes ethical principles real. It is the focus of this book.     Abstract: In the summer of 1928, Kurt Gödel (1906–1978) embarked on his logical journey that would bring him world fame in a mere three years. By early 1929, he had solved an outstanding problem in logic, namely the question of the completeness of the axioms and rules of quantificational logic. He then went on to extend the result to the axiom system of arithmetic but found, instead of completeness, his famous incompleteness theorem that got published in 1931. It belongs to the most iconic achievements of 20th century science and has been instrumental in the development of theories of formal languages and algorithmic computability – two essential components in the birth of the information society. This book explores Gödel’s way from an exceptional high-school student to a firmly established young logician. Essays in Gödel’s hand from the high school show that his central philosophical and scientific convictions were formed early on, before his university studies. Particular emphasis is laid on the course that made Gödel one of the foremost logicians of all times. The scientific biography of young Gödel is followed by English translations from Gödel’s German Gabelsberger shorthand of all his early preserved notebooks on logic and related topics.

    Abstract: The starting point of this book is the generally shared observation that in violence-torn areas of limited statehood, the civilian population is often subject to deliberate attacks. This violence often escalates to core crimes such as war crimes, crimes against humanity and even genocide. The International Criminal Court (ICC) could potentially deter such crimes. In order to do so, it largely depends on the cooperation of the states on the territory of which alleged core criminals operate. Since such states are often unwilling or unable to cooperate, the book explores whether the ICC could instead seek assistance from international forces such as UN peace support operations, UN-mandated missions, and belligerent occupants. The book covers, on the one hand, the law and practice of the UN Security Council with regard to mandating international forces to arrest and transfer alleged offenders to the ICC or to other international courts. On the other, it addresses to what extent international forces may or must hand alleged offenders over to the ICC, regardless of such mandates. More precisely, the book examines whether the duties to prosecute genocide, torture, enforced disappearance, grave breaches and other war crimes apply extraterritorially and – if so – whether international forces can discharge these duties by transferring suspects to the ICC. At the same time, the book addresses the limitations to such extraterritorial action: firstly, to what extent the prohibition of the use of force and the principle of territorial sovereignty restrict extraterritorial deprivations of liberty and transfer to the ICC. Secondly, it explores the restrictions and permissions that the law of occupation and other norms of international humanitarian law impose on such apprehensions and transfers.     Abstract: This book defends the very contentious Idealist interpretation of Hume on external objects, and draws from it far-reaching metaphysical and epistemological consequences for Hume’s philosophy. Its interest is both interpretive and analytic. The content Hume ascribes to the belief in “bodies” is susceptible to more than one reading, and has not been systematically considered. Upholding the Idealistic interpretation is interesting in its own right, but also yields several important conclusions about the spatiality of objects, causation, Hume’s “science of man” and his epistemology. In this book, organizational learning (OL) is conceptualized from a relational governance perspective. Departing from the relational economics approach, it describes organizations as dynamic nexuses of stakeholders' resources and interests, extending beyond conventional intra-organizational contexts to encompass an open systems view. By viewing organizations as independent entities, distinct from individual stakeholders, the author introduces the concept of transactions as the fundamental unit of analysis in organization theory. Stakeholders contribute diverse rationalities, and OL emerges as the process of relationalizing these rationalities, enabling multi-contextual transactions within organizations. This book sheds light on epistemological and ontological challenges in OL literature, such as the OL paradox and anthropomorphism. To address these issues, the author advocates a shift from methodological individualism to methodological relationism, wherein OL becomes a micro-meso-relational process involving both stakeholders and the organization as an entity.     Abstract: This open access book addresses the epistemological and ontological significance as well as the scope of new mechanism. In particular, this book addresses the issues of what is "new" about new mechanism, the epistemological and ontological reasons underlying the adoption of mechanistic instead of other modelling strategies as well as the possibility of mechanistic explanation to accommodate a non-trivial notion of emergence. In his essay, Patočka reflects on our relation to the dead and on how the departure of a loved one affects our continued existence. The premise of Patočka’s investigation is that our existence always takes place by and through an originary and reciprocal “being for others”. The contributors in the volume extend the field of inquiry into the wider phenomenological and post-phenomenological discussion of death by being cognizant of how works of literature can broaden our understanding of the care of death, grief, forgiveness and non-reciprocal love.     Abstract: The book contains the results of the best research developments obtained during the implementation of major scientific events organized and carried out with the financial support of the Russian Science Foundation and the President of the Russian Federation. The scientific novelty of the work lies in the fact that for the first time at the level of Russian and international interdisciplinary social and humanitarian sciences, primarily economic and legal, firstly, philosophical concepts and regulatory legal approaches to the regulation of remote investment transactions have been studied; secondly, a set of economic and legal conditions and means of harmonizing and observing the mutual interests of participants in remote investment transactions has been developed and proposed in order to prevent and minimize potential conflicts between the parties; thirdly, the current state and international regulation of investment transactions concluded and executed on Internet platforms was critically assessed; fourthly, a system of guarantees and protection of the rights of participants in remote investment transactions is proposed, including special contractual structures and an economic and legal model for the proper fulfillment of obligations. Measures are substantiated to expand and increase the intensity of the national investment turnover based on the improvement of the current legislation regulating investments through remote digital technologies in the Internet space, which provided a solution to the world scientific problem of great socioeconomic and economic importance. The book is designed for a wide target audience—scientists of different generations, different disciplinary and industry affiliations. Among them are young researchers, as well as scientists who have received recognition from the world scientific community, studying the socioeconomic, managerial, and legal consequences of the emergence and spread of digital technologies in the field of investment. Readers can be all individuals and legal entities interested in the development of digital technologies in the field of investment.

    Abstract: This book reviews China’s strategic pathway over the last 1000 years and considers its prospects for ascending to high-income status by the end of the 21st century. It analyzes why, although China’s chances of joining the global core are sound, they are not outstanding; in addition, it faces mounting challenges, internal and external alike. The argument is presented in the framework of dynamic-strategy theory, which is expounded here in novel form. This exposition includes a wide ranging survey of global history, with a focus on the development of the industrialisation paths of the major economies of today, including a detailed study of Japan's long-run strategic pathway. The book’s closing section presents a scenario-based discussion of China’s potential place in the world in 2100. The analysis implies that China’s zenith is likely to be reached slightly before mid-century, after which its relative economic scale will likely decline. Beyond that general finding, the scenarios investigate the wide range of plausible outcomes that China may experience: a range that the author contends is much wider for China than for nations under-pinned by less complex political-economies.     Abstract: Dispositionalism, perhaps the most popular variant of non-Humean metaphysics, submits that dispositions, powers, or capacities, are part of the furniture of the world. In this book I advance an original approach to dispositionalism revolving around the notion of Dispositional Reality; the novelty lies in the fact that the account, unlike most alternatives on the market, does not require the reification of objects, facts, properties, nor their dispositional essences – and is in fact compatible with a far more deflationary approach to dispositions, while still being true to the non-Humean spirit of the proposal. This power metaphysics without powers allows one to dispel several puzzles in recent literature, or recast them under a new light. Albeit with its own peculiarities, this proposal constitutes a variant of explanatory dispositionalism, according to which realism about dispositions ought not to be understood as an ontological inflation, but as an explanatory inversion within the nomic and modal family. Some of these explanations are hereby attempted, and a study of various types of non-causal explanation will be provided.

    Abstract: This open access book provides the first comprehensive review of the state of the art of social tipping points applied to energy systems from a social interdisciplinary perspective. Is proposed the redefinition the policies’ mix that will allow fundamental changes in development, focused also on social and societal profit, the redefinition of productivity and environmental performance of businesses, and the rebalancing of work and leisure life.     Abstract: Sustainable (public and private) finance is closely interlinked with the Sustainable Development Goals (SDGs). The latter focus on enhancing the protection of both social and environmental assets at the local and global level, from the real economy and everyday life to financial markets and public policies, thereby laying the groundwork for a transition. Global sustainability challenges – including climate change, natural resource depletion, and rising inequality – are affecting the commercial environment and real economy in a way that presents both risks and opportunities for the private and public financial sectors. On the one hand, policymakers and investors (including banks and pensions funds) are increasingly recognizing the environment’s implications for the financial sector through both physical and transitional risks, producing impacts on financial services and products, not to mention corporate governance. On the other hand, governments and European and international institutions are aware of their sustainability-related responsibilities and the consequences of their actions. Both regulate and supervise financial markets but also use their budgetary and tax policies (e.g. carbon tax) and their participation in financial markets (e.g. green bonds and development banks) to overcome sustainability challenges. Therefore, the objective of this book is to help readers understand how private and public financial systems can be modified to create better value for society through sustainable approaches and initiatives such as the integration of environmental, social, and governance (ESG) factors in investment, procurement, and budgeting.

    Abstract: Law’s regulatory reach has grown significantly over the past few decades. Yet, at the same time, law schools and legal professions in Western and Western-oriented jurisdictions have undergone an acute crisis. How is this possible? In this insightful and wide-ranging book, Luca Siliquini-Cinelli argues that these trends are in fact complementary manifestations of a single phenomenon—namely, that law is and will always be more capable of regulating social interaction without the experiential contribution of legal experts. Siliquini-Cinelli contends that the separation of law’s regulatory function from legal experts is structurally linked to the former’s nature and operational dynamics as an intellectual artifact to be used for ordering purposes. As a product of the intellect, law is a matter of knowledge, not experience. In fact, Siliquini-Cinelli holds, law’s artifactuality voids experience, including that of legal experts, making it redundant. This explains how law can thrive as a regulatory phenomenon while the very places where future legal professionals are formed and those places where it is practised are in crisis. To show this, Siliquini-Cinelli embarks upon a historical, philosophical, and comparative analysis of law’s artifactuality, focusing on the teaching, study and practise of law as intellectual endeavours, from the advent of juristic activities in the Late Roman Republic to current legal pedagogies, practices, and reforms in Civil and Common law jurisdictions. In so doing, Siliquini-Cinelli employs the Latin phrase ‘scientia iuris’ to explain why and how legal education and practice pursue knowledge at the expense of experience, and the serious implications this has for lawyering activities. Moving beyond established narratives, Siliquini-Cinelli argues that ‘scientia iuris’ ought not be reduced to dogmatic analysis (scientia iuris as doctrina iuris). Rather, ‘scientia iuris’ denotes the knowledge of the law sought by all those who teach, study, and practise it, and which is actualised through a form of legal thinking and argumentation that moves along reason’s metaphysical, constructivist lines (scientia iuris as cognitio iuris). Thus, scientia iuris is not the prerogative of a few legal scholars; rather, it lies at the very core of Western legal education and practice, broadly understood. The relevance of Siliquini-Cinelli’s original and interdisciplinary analysis is profound and far-reaching: the crisis that legal education and practice are undergoing is not an isolated, or accidental, event; it is a consequence of the very ways in which law has been taught, studied, and practised since Rome.

    Abstract: In Pascal's God and the Fragments of the World, Martin Nemoianu offers a new interpretation of the thought of Blaise Pascal, drawn from the Pensées and beyond. The book takes Pascal's central theme to be the distinction - Infini rien - between the transcendent God and the created world, which, without God, would be nothing. Nemoianu identifies the distinction in Pascal, articulates it, and works through the difficulties attending the distinction's disclosure. He then considers the implications of the distinction for the nature of nature and the nature of the human being, culminating in the ideal of martyrdom. The book closes with treatment of a closely related theme: the relation between human freedom and divine grace, in the context of the vexed question of Pascal's Jansenism. It critically examines the consequences of the non-recognition of Muslim marriages within the civil legal framework and underscores the ambiguous intersections of MPL with broader legal systems, which leaves women in a precarious legal state overshadowed by religious doctrines.
