    Abstract: Main description: In dieser Arbeit werden die Universaltheorien Niklas Luhmanns (1927-1998) und Charles Peirces (1839-1914) zum ersten Mal grundlegend aufeinander bezogen. Auf der Basis einer kritischen funktionalen Analyse von System- und Zeichentheorie wird ein Zeichensystem neu konstruiert, dessen Auflöse- und Rekombinationsvermögen höher ist als das der genannten Einzeldisziplinen. Die theoretisch erzielten Ergebnisse lassen sich als Grundlage für konkrete sprach- und literaturwissenschaftliche oder auch soziologische Problemstellungen verwenden. Zudem kann das Buch als Einführung in das Denken Luhmanns und Peirces gelesen werden.
    Abstract: Main description: This study is the first to make a systematic attempt to relate the universal theories of Niklas Luhmann (1927-1998) and Charles S. Peirce (1839-1914) to one another. On the basis of a critical functional analysis of systems theory and semiotic theory, a newly designed semiotic system is proposed that displays a higher resolution and recombination potential than the individual disciplines involved. The theoretical results can be used as a foundation for dealing with concrete linguistic, literary, or sociological problems. In addition, the book can be read as an introduction to the thinking of Luhmann and Peirce.

    Abstract: "More Americans trace their ancestry to Germany than to any other country. Arguably, German Americans form America's largest ethnic group. Yet they have a remarkably low profile today, reflecting a dramatic, twentieth-century retreat from German-American identity. In this age of multiculturalism, why have German Americans gone into ethnic eclipse - and where have they ended up? Becoming Old Stock represents the first in-depth exploration of that question. The book describes how German Philadelphians reinvented themselves in the early twentieth century, especially after World War I brought a nationwide anti-German backlash."
    Abstract: "Using quantitative methods, oral history, and a cultural analysis of written sources, the book explores how, by the 1920s, many middle-class and Lutheran residents had redefined themselves in "old-stock" terms - as "American" in opposition to southeastern European "new immigrants." It also examines working-class and Catholic Germans, who came to share a common identity with other European immigrants, but not with newly arrived black Southerners."

    Abstract: The contributors to this volume investigate to what extent welfare has increased in the United States over the postwar period and provide a rigorous examination of both conventional measures of the standard of living, as well as more inclusive indices. The chapters cover such topics as: race, home ownership and family structure; the status of children; the consumer price index; a historical perspective on the standard of living; worker rights and labor strength in advanced economies. In addition, they explore two economic systems delivering the goods--the free enterprise system of the United States and the European social welfare state. They then present international comparisons and highlight the relative advantages and disadvantages of these two systems.

    Abstract: Die Arbeit befasst sich mit dem mandatum iuris gentium und der völkerrechtlichen Treuhand. Im ersten historischen Teil werden die rechts- und ideengeschichtlichen Wurzeln beider Institute nachvollzogen. Im zweiten Teil werden problematische Fälle des modernen Völkerrechts dargestellt, in denen das Mandats- bzw. Treuhandrecht in völkerrechtlichen Streitfragen besondere Relevanz hatte und z. T noch hat, z.B. Südwestafrika/Namibia, Israel/Palästina und Nauru. Im dritten und letzten Teil wird die Zukunft der völkerrechtlichen Treuhand untersucht, insbesondere in besonders aktuellen Fällen wie Kosovo, Afghanistan und Ost-Timor, die de facto mit der völkerrechtlichen Treuhand vergleichbar sind. In diesem Teil werden auch Vorschläge zu Wiederbelebung des UN-Treuhandsystems, auch im Umweltvölkerrecht, und ähnliche Vorschläge aus der Völkerrechtslehre diskutiert. Insgesamt wird festgestellt, dass der Treuhandgedanke seit seiner Entstehung im Völkerrecht nicht an Aktualität eingebüßt hat.

    Abstract: The security environment in the Middle East has become increasingly complicated during the past decade.     Abstract: The ability to predict future health care costs reasonably accurately is critical to planning for the Centers for Medicare and Medicaid Services (CMS). The models used for such projections to date, however, are limited in terms of their capacity to take into account the complex array of factors likely to affect future spending. To improve CMS's ability to map the effects on spending of such factors as medical breakthroughs and demographic trends, RAND Health developed the Future Elderly Model (FEM), a demographic-economic model framework of health spending projections that enables the user to answer "what-if" questions about the effects of changes in health status and disease treatment on future health care costs. What distinguishes the FEM from other models is its inclusion of a multidimensional characterization of health status, which allows the user to include a richer set of demographic controls as well as comorbid conditions and functional status. This report describes the development of the FEM and its application in four clinical areas: cardiovascular disease, the biology of aging and cancer, neurological disease, and changes in health care services. Beside those involved in planning at the Centers for Medicare and Medicaid Services, it should be of interest to health policy planners and health economists

    Abstract: Das Ziel der Studie ist es, das komplexe Phänomen sogenannter anonymer Begräbnisse als Erfahrung und als kulturelle Konstruktion lesbar zu machen. Sie geht dabei von zutiefst vergeschlechtlichten familienbezogenen und öffentlich-nationalen sepulkralen Repräsentationen aus, die sich ins kollektive Gedächtnis der westlichen Moderne eingeschrieben haben und sich bis heute in sozialen und symbolischen Ordnungen reformulieren. Die Arbeit kombiniert qualitativ-empirisch kultur- und sozial-theoretische Positionen und Methoden und führt selbst erhobenes Primärmaterial aus heterogenen Quellen zusammen. Frauen und Männer erzählen zu ihrer Motivation, das eigene Grab als anonymes zu bestimmen, und von ihrer Erinnerungsvorsorge, die ein individuelles Bezeichnen einer Grablage entbehrlich werden lässt. Nahestehende und Friedhofsbeschäftigte erlauben Einblicke in alltägliche Aneignungs- und Gestaltungsweisen dieser Grabform. Erinnerungsgegenstände und Trauerutensilien belegen spielerisch erfinderische Formen symbolischer Kommunikationen mit Toten. Der mehrperspektivische, kulturanalytisch ethnographische Zugang macht alltagsweltliches Wissen zu Sterben und Begraben wie zu Vergehen und Überdauern anschaulich und stellt es dem kulturpessimistischen Gestus des Forschungsstands an die Seite. Anonyme Gräber sind in traditionelle wie in individuell modellierte Praktiken, Materialien und visuelle Medien eingebettet, die sie auf unterschiedlichste Weise bedeuten und wirken lassen. Die Grabform gibt Auskunft über das spannungsvolle Verhältnis zwischen dem Wunsch, lebhaft erinnert oder still vergessen zu sein, und zwischen dem Unvordenklichen individueller Deutungen gegenüber den beharrlichen Setzungen des kulturellen Rahmens. 〈dt.〉
    Abstract: This study is a reading of so-called anonymous burials and connected practices of remembering as a form of individual experience and cultural construction. In modern western culture, private and public sepulchral representations can be considered as gendered and connotated as female. As practices they have become part of the collective memory and are constantly reshaped in the context of social and symbolic orders. The study combines qualitative-empirical methods with the perspectives of cultural and social theories and brings together primary material of heterogeneous origins. Women and men speak about their motivations to be buried in an anonymous grave and about their managing of ways to be remembered which can dispense with the individual signing of a burial place. Close friends and cemetery-workers allow insights in every-day routines of appropriation and arrangements with this kind of burial practice. Objects of remembering and mourning verify symbolic communication with the dead in a playful an inventive manner. The multiperspective and ethnographic approach works out common knowledge about dying and burying, vanishing and outlasting and contrasts it with the pessimistic views of civilisation in the current theoretical research of burial cultures. Anonymous graves are considered as imbedded in traditional and individually modelled practices, materials and visual media. Hence the graves accumulate different effects and meanings. The form of tombs informs about a highly charged relationship between the wish to be kept alive by being remembered or to be quietly forgotten and the unpredictability of individual understanding and persistent determination by the cultural framework. 〈engl.〉

    Abstract: The nineteenth century, a time of far-reaching cultural, political, and socio-economic transformation in Europe, brought about fundamental changes in the role of women. Women achieved this by fighting for their rights in the legal, economic, and political spheres. In the various parts of Europe, this process went forward at different paces and followed different patterns. Most historical research up to now has ignored this diversity, preferring to focus on women's emancipation movements in major western European countries such as Britain and France. The present volume provides a broader context to the movement by including countries, both large and small, from all regions of Europe. Fourteen historians, all of them specialists in women's history, examine the origins and development of women's emancipation movements in their respective areas of expertise. By exploring the cultural and political diversity of nineteenth-century Europe and at the same time pointing out connections to questions explored by conventional scholarship, the essays shed new light on common developments and problems

    Abstract: Die mit der Wiedervereinigung einhergehende Veränderung der wirtschaftlichen und politischen Strukturen wirkte sich vielfältig und nachhaltig auf das Leben der Bevölkerung in Ostdeutschland aus. Auf individueller Ebene wurden dabei Anreize für einen Lebensstilwandel geschaffen. Auf der Grundlage ökonomischer Modelle werden in dieser Arbeit die Wirkungen ökonomischer Anreize auf das individuelle Gesundheitsverhalten vor dem Hintergrund einer wirtschaftlichen Transformation untersucht. Anhand von Daten des Sozioökonomischen Panels (SOEP) wird analysiert, ob sich der Lebensstil ostdeutscher Bürger dem der Bevölkerung im Westen angenähert hat. Es läßt sich aufzeigen, daß auch mehr als zehn Jahre nach der "Wende" der ostdeutsche Transformationsprozeß als nicht abgeschlossen gelten kann.

    Abstract: How does an immigrant become an ethnic American? And does American society fundamentally alter because of these newcomers? In Ethnic Routes to Becoming American, Sharmila Rudrappa examines the paths South Asian immigrants in Chicago take toward assimilation in the late twentieth-century United States, where deliberations on citizenship rights are replete with the politics of recognition. She takes us inside two ethnic institutions, a battered women's shelter, Apna Ghar, and a cultural organization, the Indo American Center, to show how immigrant activism, which brings cultural difference into public sphere debates, ironically abets these immigrants' assimilation. She interlaces ethnographic details with political-philosophical debates on the politics of recognition and redistribution. In this study on the under-researched topic of the incorporation of South Asian immigrants into the American polity, Sharmila Rudrappa compels us to rethink ethnic activism, participatory democracy, and nation-building processes

    Abstract: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.

Sie und ihre Mütter waren in der deutschen Gesellschaft über einen langen Zeitraum hinweg geächtet. Zu Beginn des 20. Jahrhunderts wurde Unehelichkeit vornehmlich mit Armut, Kriminalität und Verwahrlosung in Verbindung gebracht. Uneheliche Kinder erschienen als eine sittliche Gefährdung der bürgerlichen Familie, ja sogar als existentielle Bedrohung der Gesellschaft. Sybille Buske untersucht die rechtliche und gesellschaftliche Stellung nichtehelicher Kinder und ihrer Eltern vom Kaiserreich bis in die Bundesrepublik. Die sechziger Jahre erfahren dabei besondere Beachtung, denn dieses Jahrzehnt brachte tiefgreifende Um- und Aufbrüche: Nach zähem politischem Ringen wurde die Reform des Unehelichenrechts auf den Weg gebracht. Ziel war es, den Kindern und Eltern mehr Rechte zuzuerkennen und ihre gesellschaftliche Diskriminierung zu beenden. Erstmals in der langen Geschichte der Unehelichkeit konnten ledige Mütter in eigener Sache gesellschaftlich und politisch gestaltend wirken. Der veränderte Umgang mit Unehelichkeit erschließt exemplarisch Dimensionen und Dynamik gesellschaftlicher Wandlungsprozesse in Westdeutschland. Der diachrone Ansatz der Studie ermöglicht, den Wandel der sechziger Jahre im Kontext des Jahrhunderts zu gewichten und seine Ergebnisse kritisch zu reflektieren.     Abstract: Bioethicists, moral philosophers and social policy analysts have long debated about how we should decide who shall be saved with scarce, lifesaving resources when not all can be saved. It is often claimed that it is fairer to save younger persons and that age is an ethically relevant consideration in such tragic decisions. Medical benefit should be maximized and final selection should aim to minimize the contaminating influence of chance. These claims are challenged by Duff R. Waring in Medical Benefit and the Human Lottery, one of the few books that attempts a sustained defence of random patient selection. This book combines ethics and political philosophy in its novel and strict egalitarian approach to patient selection for transplantable organs. Waring addresses the question of whether we should choose between lives on the basis of fair chances or best outcomes. He argues that final selection criteria should be based on fair chances that equalize opportunity as opposed to best outcomes. His defence of "hardy" egalitarianism aims to show that random selection by lottery can affirm both a common humanity and the equal value of lives. The notion of patient selection by lottery has not fared well in bioethics and has been regarded by some as a moral affront. Waring argues that a human selection lottery may be neither as crude nor as ethically anomalous as some have supposed. Indeed, it can reflect a familiar conception of equality as a political and moral ideal. This conception abstracts from many undeniable differences between patients and claims that scarce resources should be allocated on the principled assumption that each of their lives is equally worth saving. The book is also notable for its critiques of some recent utilitarian notions of medical benefit which can have an age-biased impact on elderly patients. Waring then argues against the leading, contemporary age-based approaches to patient selection. He explores the way random selection by lottery can affirm his egalitarian ethos in cases where eligible transplant candidates have each passed a threshold level of prospective medical benefit that has been set by democratic deliberation. Taming chance with a human lottery is defended as the most lucid means of ensuring equal opportunity. In so doing, Waring argues that we give the principle of equal concern and respect a radical expression: above a noncomparative threshold of medical benefit, each candidate can have an equal claim to life.

    Abstract: On the premise that pension provision in Europe will dramatically change over the next few decades, this book concentrates on the funded component of pension wealth, and specifically on annuities - financial products that, on the basis of actuarial equivalence, allow the conversion of wealth into a lifelong stream of income. Developing an Annuity Market in Europe provides an analysis of how longevity and return risks are dealt with, besides considering key features from both household and insurance company perspectives. It takes account of the fact that annuity markets are expected to attract much interest in future years given the prospective cuts in public pension expenditure. In order to fill the gap between shrinking pensions and desired retirement consumption, the authors argue, annuities must be well regulated and supplied with financially attractive products. These conditions hardly exist today: thin markets and scant interest prevail, information is incomplete and imperfect, products show significant disparities. The contributors to this book explore the causes of present malfunctioning and examine the changes that may give annuities a new and vital function, which, along with greater competition and greater regulation may significantly alter the present scene of pension finance. Finally, the book offers an overview of regulatory issues including transparency, prudential provisions, appropriate levels of guarantees, and administrative costs. Anhand von Expertengesprächen und vierzig qualitativen Interviews mit Sans Papiers werden polizeiliche Kontrollen und Kontrollen in den Bereichen Arbeitsmarkt, Gesundheitsversorgung, Wohnen sowie Schule und Kinderbetreuung eingehend untersucht. Das Buch diskutiert, ob globale ökonomische, politische und soziale Prozesse die Fähigkeit von Nationalstaaten einschränken, Migration zu kontrollieren. Es wird gezeigt, dass sich die Migrationspolitik der OECDStaaten in den vergangenen Jahren zwar auf der Ebene der Leitlinien und Gesetze angeglichen hat. Bei der Implementation von Kontrollen bestehen aber nationale Unterschiede fort. Die Interviews belegen, dass Sans Papiers in den USA weiterhin vielfältige Möglichkeiten zur gesellschaftlichen Partizipation haben. Im Gegenzug zeigt das Beispiel Deutschland, dass angesichts der weitgehenden Exklusion von Sans Papiers keine Rede von einem Kontrollverlust sein kann.
    Abstract: What are the effects of internal migration controls on migrants without a regular residence permit – on “sans papiers”? The book gives an answer to this question with a comparative study of the United States and Germany. Based on expert interviews and in-depth interviews with forty sans papiers, police controls as well as controls in areas such as labor market, health care, housing, schooling and childcare are carefully analysed. The book discusses whether global economic, political or social processes have restricted the ability of advanced capitalist countries to control migration. It argues that migration policy in the OECD countries has become more similar, but this convergence only takes place at the level of policy goals and legal norms. At the level of implementation, national differences persist. The interviews show that sans papiers in the U.S. continue to have many possibilities to participate in society. In contrast, the comprehensive exclusion of sans papiers in Germany confi rms that there is no general “loss of control”

    Abstract: This book argues that a unique late marriage pattern, discovered in the 1960s but originating in the Middle Ages, explains the continuing puzzle of why western Europe was the site of changes that, from about 1500, gave rise to the modern world. Contrary to views that credit upheavals from the late eighteenth century were reponsible for ushering in the contemporary global era, it contends that the roots of modern developments themselves are located in an event more than a millennium earlier, when the peasants in northwestern Europe began to marry their daughters almost as late as their sons. The appearance of this late marriage system, with its unstable nuclear household form, will also be shown to have exposed for the first time the common ingredients whose presence has perpetuated beliefs in the importance of gender difference and of a sexual hierarchy favoring males

    Abstract: Building upon his previous work and using Richard Hofstadter's The American Political Tradition as a model, Professor Moses has revised and brought together in this book essays that focus on the complexity of, and contradictions in, the thought of five major African-American intellectuals: Frederick Douglass, Alexander Crummell, Booker T. Washington, W.E.B. DuBois and Marcus M. Garvey. In doing so, he challenges both popular and scholarly conceptions of them as villains or heroes.     Abstract: This is the first full-scale one-volume survey of the demographic history of the United States. From the arrival of humans in the Western Hemisphere to the current century, Klein analyzes the basic demographic trends in the growth of the pre-conquest, colonial and national populations. He surveys the origin and distribution of the Native Americans, the post-conquest free and servile European and African colonial populations and the variation in regional patterns of fertility and mortality to 1800. He then explores trends in births, deaths, international and internal migrations in the nineteenth century and compares them with contemporary European developments. The profound impact of historic declines in disease and mortality on the structure of the late twentieth century population is explained. Finally the late twentieth century changes in family structure, fertility and mortality are evaluated for their influence on the evolution of the national population for the 21st century
