    Kurzfassung: The study provides an extensive legal, geopolitical and historical analysis of all controversial issues making up the Greek-Turkish maritime dispute: the delimitation of territorial waters, the national airspace, the delineation of exclusive economic zones and continental shelf as well as the issue of military presence on the Eastern Aegean islands and its relation to the Greek sovereignty over them. By immersing thoroughly into international jurisprudence, international treaties and historical facts, the book offers a detailed survey of legal precedents and legal regimes over similar issues worldwide. In this way, the reader has the opportunity to ascertain where every single legal and historical argument has been drawn from and its relevance in the international jurisprudence. Consequently, it follows the evolution of the dispute together with all its twists from 1973 to 2022 that saw a new low in the historically tense Greek-Turkish relationship. The book finally re-examines the dispute in the light of the new green energy geopolitics and the ongoing climate crisis and comes up with some suggestions for an alternative paradigm of co-existence in the Aegean Sea which in the author’s view is urgent and inevitable. .

    Kurzfassung: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. On 10 December 2020, the book was officially launched with a webinar which brought together the editors of the book and prof. Stephan Parmentier (KU Leuven) and prof.     Kurzfassung: Welche Bedeutung hat die Staatsbürgerschaft für Schwarze Deutsche? Emmanuel Ndahayo liefert mit seiner Studie einen wichtigen Beitrag zur Erforschung sozialer Ungleichheit und gesellschaftlicher Teilhabe im Kontext von Migration und Eingliederungsprozessen, die in besonderem Maße von Rassismus, (post-)kolonialistischen Ansichten und fragilen Inklusionsformen betroffen sind. Die Analyse der sozialen Lage von eingebürgerten Deutschen afrikanischer Herkunft schließt eine Forschungslücke. Die empirische Untersuchung mit Hilfe qualitativer Interviews bietet daher wichtige Erkenntnisse nicht nur für die Sozialwissenschaft, sondern auch für Praktiker*innen in der Integrationspolitik.

    Kurzfassung: Die ›freiheitliche demokratische Grundordnung‹ (fdGO) ist Kern der ›wehrhaften Demokratie‹ der Bundesrepublik. Als zu schützendes Rechtsgut ist sie in den Art. 18 und 21 GG benannt. Sie legitimiert exekutive und judikative sowie Abwehr- und Überwachungsmaßnahmen gegen politische Akteur/innen. Die vorliegende Arbeit vollzieht die Genese der fdGO als überpositives Rechtsgut nach, das heißt, wie sie vom unklaren Begriff im Verfassungstext zu einer verallgemeinerten Formel geworden ist. Als Quellen dienen Verfassungs- und Gesetzgebungsprozesse sowie juristische Kommentarliteratur und Gerichtsurteile. Methodisch wird die juristische Argumentationsweise politikwissenschaftlich kontextualisiert – auch um einen politikwissenschaftlichen Zugang zu Rechtstexten zu entwickeln. Im Fokus stehen die Debatten im Parlamentarischen Rat, der Gesetzgebungsprozess des 1. Strafrechtsänderungsgesetzes von 1951, die Parteiverbotsurteile des Bundesverfassungsgerichts und die ersten Kommentare zum Grundgesetz. Zudem stehen das Konzept der ›wehrhaften Demokratie‹ und die dazugehörigen geschichtspolitischen Legitimationen mit Bezug zu Weimarer Republik und Nationalsozialismus auf dem Prüfstand. Die Autorin gleicht die verschiedenen Positionen im staatsrechtstheoretischen »Weimarer Methodenstreit« mit nationalsozialistischen Rechtsauffassungen ab und zeigt so Traditionslinien auf, die sich auch in den Begründungen des Konzepts der ›wehrhaften Demokratie‹ wiederfinden. Deutlich wird dabei, dass die Narrative von der ›wehrlosen‹ Weimarer Republik und der ›legalen‹ Machtübernahme des Nationalsozialismus juristisch- zeitgeschichtlich überprüft werden müssen. Nach der historischen Kontextualisierung der fdGO werden ihre Ausbreitung und Anwendung in verschiedene Rechts- und Politikbereiche beleuchtet. Abschließend fragt die Studie nach den Konsequenzen des juristischen Blicks für politisches Handeln.

Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

Rudolf Steinberg unterzieht diese Annahmen einer kritischen Betrachtung und fragt nach der institutionellen Verortung eines deutschen Islam. Er führt in einer tour d'horizon sachlich und differenziert durch die aktuellen juristischen und politischen Diskussionen. Denn "die" Scharia gibt es ebenso wenig wie "den" Islam.

New or reformed constitutions have proliferated, protecting social, economic, and political rights. While constitutional courts in Latin America have traditionally been used as ways to limit power and preserve the status quo, the evidence shows that they are evolving into a functioning part of contemporary politics and a central component of a system of constitutional justice. This book lays bare the political roots of this transformation, outlining a new way to understand judicial design and the very purpose of constitutional justice. Authors Daniel M. Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
    Kurzfassung: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

    Kurzfassung: Memory is as central to modern politics as politics is central to modern memory. We are so accustomed to living in a forest of monuments, to having the past represented to us through museums, historic sites, and public sculpture, that we easily lose sight of the recent origins and diverse meanings of these uniquely modern phenomena. In this volume, leading historians, anthropologists, and ethnographers explore the relationship between collective memory and national identity in diverse cultures throughout history. Placing commemorations in their historical settings, the contributors disclose the contested nature of these monuments by showing how groups and individuals struggle to shape the past to their own ends. The volume is introduced by John Gillis's broad overview of the development of public memory in relation to the history of the nation-state. Other contributions address the usefulness of identity as a cross-cultural concept (Richard Handler), the connection between identity, heritage, and history (David Lowenthal), national memory in early modern England (David Cressy), commemoration in Cleveland (John Bodnar), the museum and the politics of social control in modern Iraq (Eric Davis), invented tradition and collective memory in Israel (Yael Zerubavel), black emancipation and the civil war monument (Kirk Savage), memory and naming in the Great War (Thomas Laqueur), American commemoration of World War I (Kurt Piehler), art, commerce, and the production of memory in France after World War I (Daniel Sherman), historic preservation in twentieth-century Germany (Rudy Koshar), the struggle over French identity in the early twentieth century (Herman Lebovics), and the commemoration of concentration camps in the new Germany (Claudia Koonz)

Every year, over 1.3 million people apply to visit, work, or settle in Canada and discover that their future rests in visa officers' hands. How do these officers decide who gets in? Seeking answers to this question, Vic Satzewich gained access to eleven overseas visa offices, revealing immigration officers in action as they determine credibility and risk. Contrary to popular opinion, individual bias rarely enters into their decisions. Instead, a combination of experience, organizational culture, and accumulated local knowledge shapes their decision to issue a visa or dig deeper into some people's stories and histories

    Kurzfassung: "In some religious countries, churches have drafted constitutions, restricted abortion, and controlled education. In others, church influence on public policy is far weaker. Why? Nations under God argues that where religious and national identities have historically fused, churches gain enormous moral authority--and covert institutional access. These powerful churches then shape policy in backrooms and secret meetings instead of through open democratic channels such as political parties or the ballot box. Through an in-depth historical analysis of six Christian democracies that share similar religious profiles yet differ in their policy outcomes--Ireland and Italy, Poland and Croatia, and the United States and Canada--Anna Grzymała-Busse examines how churches influenced education, abortion, divorce, stem cell research, and same-sex marriage. She argues that churches gain the greatest political advantage when they appear to be above politics. Because institutional access is covert, they retain their moral authority and their reputation as defenders of the national interest and the common good. Nations under God shows how powerful church officials in Ireland, Canada, and Poland have directly written legislation, vetoed policies, and vetted high-ranking officials. It demonstrates that religiosity itself is not enough for churches to influence politics--churches in Italy and Croatia, for example, are not as influential as we might think--and that churches allied to political parties, such as in the United States, have less influence than their notoriety suggests"--

    Kurzfassung: Ferdinand Tönnies, der mit seinem Werk „Gemeinschaft und Gesellschaft" von 1887 überwiegend als Soziologe und Philosoph wahrgenommen wird, hat sich schon recht früh mit staatswissenschaftlichen Problemen beschäftigt. Dabei kommt für Tönnies dem Staat nur eine instrumentale Rolle zu. Damit rückt er weit ab von den Traditionen des Kulturliberalismus im Kaiserreich. Im Gegensatz zur liberalen Demokratie erkennt Tönnies eine Fokussierung auf eine soziale Demokratie: Eine Entwicklung zum „Staat der Sozialreform". Er spricht dem Staat die Legitimation ab, als sittliche Macht im Hegelschen Sinne aufzutreten. Der Staat ist für Tönnies unlösbar mit der Gesellschaft verbunden. Es gibt keine innere Distanz, die ihm eine eigenständige externe Rolle gegenüber der Gesellschaft ermöglichen würde. Er ist vielmehr eine Art Wesensausdruck aller Grundzüge des sozialen Lebens unter den Bedingungen der vom Kürwillen beherrschten Gesellschaft. Er ist dem Interessenkampf von Menschen und Gruppen ausgeliefert, die sich gegenseitig als Mittel ansehen müssen nach Maßgabe des Kalküls des Eigeninteresses und der Gewinnmaximierung.     Kurzfassung: Die Teilhabe am Herrschaftsprozess ist für demokratische Gesellschaften von zentraler Bedeutung. Staat und Gesellschaft müssen miteinander verknüpft sein, sonst gerät die Legitimation politischer Entscheidungen in Gefahr. Die politische Teilhabe – etwa in Wahlen und Parteien – ist in Deutschland aber eng an die Staatsbürgerschaft geknüpft. Ausländer im rechtlichen Sinne dürfen nicht an allen politischen Entscheidungen mitwirken. Unter den Bedingungen einer fortschreitenden europäischen Integration und einer empirisch evidenten Zuwanderungsgesellschaft stellt sich daher die Frage, wie es um die Legitimation politischer Entscheidungen und um die politisch-demokratische Repräsentation derjenigen bestellt ist, die zwar in Deutschland wohnen, aber de jure nur eingeschränkte Teilhaberechte haben.
