    Kurzfassung: "By the start of the nineteenth century, the impact of the geological sciences and advancements in the field had radically expanded people's perception of the Earth's age. In How the Earth Feels, Dana Luciano maps the emergence of a "geological fantasy," in which increased knowledge of planetary life was used to racialize Native peoples as fossils and curiosities. Further, the geological fantasy served to cement the notion that the Earth had been preparing for the presence of humans, and that humans were in fact the ultimate expression of the Earth's teleological development in a both scientific and spiritual sense. Counterposing a range of texts-from early European and US geological texts to Indigenous accounts of earthquakes to African American men's anti-slavery writing featuring geological tropes-Luciano reveals the workings of the geological fantasy as it operated across the racial and biopolitical discourses of the nineteenth-century United States. Luciano offers a rich and historically nuanced account of how imagined relations with the non-human world have long served as a means of avoiding engagement with the dynamics of racial and colonial power"

    Kurzfassung: This book explores and addresses body search practices in prison environments from different angles (criminology, sociology, human rights and law) and discusses such practices in different national contexts within Europe. Body searches are widely used in prison systems across the globe: they are perceived as indispensable to prevent forbidden substances, weapons or communication devices from entering the prison. However, these are also invasive and potentially degrading control techniques. It should not come as a surprise, then, that body searches are deeply contested security measures and that they have been widely debated and regulated. What makes theses control measures problematic in a prison context? How do these practices come to be regulated in an international and European context? How are rules translated into national law? To what extent are laws and rules respected, bent, circumvented and denied? And what does the future hold for body searches? Tom Daems is Professor of Criminology at the Leuven Institute of Criminology (LINC), KU Leuven, Belgium. At LINC, he coordinates the research line on ‘Punishment and Control’. Daems has published widely on punishment and prisons, in particular from a European perspective. With Palgrave, he previously published Electronic Monitoring: Tagging Offenders in a Culture of Surveillance (2020) and Europe in Prisons: Assessing the Impact of European Institutions on National Prison Systems (2017, co-edited with Luc Robert). .

    Kurzfassung: "Regardless of his own sexual orientation, L. Frank Baum's fictions revel in queer, trans, and other transgressive themes. Baum's life in the late 1800s and early 1900s coincided with the rise of sexology in the Western world, as a cascade of studies heightened awareness of the complexity of human sexuality. His years of productivity also coincided with the rise of children's literature as a unique field of artistic creation. Best known for his Oz series, Baum produced a staggering number of children's and juvenile book series under male and female pseudonyms, including the Boy Fortune Hunters series, the Aunt Jane's Nieces series, and the Mary Louise series, along with many miscellaneous tales for young readers. Baum envisioned his fantasy works as progressive fictions, aspiring to create in the Oz series "a modernized fairy tale, in which the wonderment and joy are retained and the heartaches and nightmares are left out." In line with these progressive aspirations, his works are often sexually progressive as well, with surprisingly queer and trans touches that reject the standard fairy-tale narrative path toward love and marriage. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective.     Kurzfassung: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Kurzfassung: This book offers a comprehensive analysis of the legal questions that arise for the legislative branch when implementing the crime of aggression into domestic law. Despite being the “supreme international crime” that gave birth to international criminal law in Nuremberg, its ICC Statute definition has been incorporated into domestic law by fewer than 20 States. The crime of aggression was also omitted in the rich debate held among German scholars in the early 2000s regarding the legislative implementation of other ICC Statute crimes. The current inability of the International Criminal Court to respond to the Russian aggression towards Ukraine invites the continuation of these academic debates without neglecting the particularities of the crime of aggression. The fundamental issues discussed in this volume include the obligation to criminalize aggression, the core wrong of the crime, the normative gaps under domestic law and the jurisdictional gaps under the ICC Statute. To facilitate the operationalization of domestic implementation, the book explores the technical options for incorporating the definition into domestic law, the geographical ambit of domestic jurisdiction—most notably universal jurisdiction—as well as legal challenges such as immunities. The book is aimed primarily at researchers and States with an interest in the domestic implementation of international criminal law but those already working in the field should also find much of interest contained within it. Dr. Annegret Hartig is Program Director of the Global Institute for the Prevention of Aggression and worked as a researcher at the University of Hamburg where she obtained her doctoral degree in international criminal law.

    Kurzfassung: "Racism and racial discrimination emerged as themes in public international law at the end of the First World War. This was a consequence of the participation of countries from the Global South who had hitherto been excluded from international law making. A Japanese proposal to recognise racial equality in the Covenant of the League of Nations was vetoed by President Wilson. The battle against racial discrimination at the international level really began with the United Nations, in 1946. The Global South pushed for action to deal with racism in South Africa, for example, among several other initiatives directed at racial discrimination. In the first decades of the United Nations, campaigns against racial discrimination were the beating heart of the human rights activities of the organisation. Major landmarks include the adoption of the 1965 Convention on the Elimination of Racial Discrimination and the 1973 Convention Against Apartheid. Important mechanisms in human rights were often instigated in measures directed at racial discrimination. These were invariable pushed by States of the Global South and obstructed by governments of Europe and North America. When the apartheid regime finally fell, in 1990, international activities were recalibrated with a focus on xenophobia. But the issue of racism and racial discrimination, directed principally at people of colour, returned with the 2001 Durban Conference. Tensions have continued about a range of issues, including reparations for slavery and the slave trade. In 2020, the murder of George Floyd prompted renewed activity. This book narrates the history of racism and racial discrimination in international law, challenging the narrative that human rights are a creation of the Global North while demonstrating the decisive contribution of the Global South"--

It adopts a comparative approach, with some chapters providing thematic overviews of the challenges posed by migration for employment law, and others addressing the main effects of migration upon employment law in particular countries.     Kurzfassung: Spider Web, Labyrinth, Tightrope Walk explores the shifting functions of the network as a metaphor, model, and as an epistemological framework in US American literature and culture from the 19th century until today. The book critically inquires into the literary, cultural, philosophical, and scientific rhetoric, values, and ideological underpinnings that have given rise to the network concept. Literature and culture play a major role in the ways in which networks have been imagined and how they have evolved as conceptual models. This study regards networks as historically emergent and culturally constructed formations closely tied with the development of knowledge technologies in the process of modernization as well as with an increasingly critical awareness of network technologies and infrastructures. While the rise of the network in scientific, philosophical, political and sociological discourses has received wide attention, this book contributes an important cultural and historical perspective to network theory by demonstrating how US American literature and culture have been key sites for thinking in and about networks in the past two centuries

The volume addresses an on-going situation, additionally complicated by renewed lockdown restrictions during autumn and early winter 2020. It assesses the assumptions of an imminent wave of domestic violence against reliable data from crime statistics, surveys, and various institutions responding to domestic violence. Collecting partner country reports from Austria, Finland, France, Germany, Hungary, Portugal, Scotland and Slovenia, it demonstrates the effects that lockdown measures starting March 2020 had on reported DV incidents. It considers the differences between each country with respect to policing, legal systems, social and cultural factors and highlights best practices to prevent conditions resulting from Covid-19 lockdown undermining victims’ security and frontline responders’ capacities to provide services and prevent domestic violence.

    Kurzfassung: This proceedings volume combines chapters derived from papers presented at the 4th and 5th Annual Conferences on the Future of the Commercial Contract in Scholarship and Law Reform. This ongoing research project brings together scholars from all over the world at an annual international conference in London.     Kurzfassung: This book considers the intellectual property protection of clinical test data that has been submitted to governments, in particular through test data exclusivity rights. It focuses on how these intellectual property rights first emerged in the early 1980s, how they have globalised over the past four decades, and what impact they have had upon access to medicine. This book makes a number of significant and original contributions to the literature around the protection of submitted test data. First, the book draws upon the theory of regulatory globalisation to provide an explanation of how intellectual property rights in submitted pharmaceutical test data have become nearly ubiquitous in the legal systems of most major economies. Second, through a comprehensive analysis and synthesis of provisions on the protection of submitted test data in free trade agreements, as well as a comparison of a range of national approaches to the protection of submitted test data, it reveals the broader global regulatory pattern that has given rise to these intellectual property rights. Third, by analysing data on drug approvals in the US, it provides an empirical insight into the impact of test data exclusivity in national pharmaceutical markets. Fourth, the book covers a number of developments regarding test data exclusivity that have occurred as a result of responses to the COVID-19 pandemic, both at the national level as well as at the World Trade Organisation (WTO).     Kurzfassung: This book explores the issue of leadership criminality from a new angle by comparing two highly relevant modes of responsibility. By contrasting individual criminal responsibility for ordering international crimes with indirect perpetration through an organisation, it shows the doctrinal weaknesses of the latter and outlines the much-overlooked advantages of the former. The volume analyses the development of both forms of responsibility, looking at their origins, and their reception in academia and practical use in jurisprudence. The history of indirect perpetration through an organisation (Organisationsherrschaft) is portrayed from its German academic origin, through German jurisprudence to the reception of the doctrine at the International Criminal Court. By comparing the doctrine’s stages of evolution, the book sheds light on the different aspects of the various models of indirect perpetration through an organisation and carves out general and fundamental criticism of it. The characteristics of ordering liability are explored in depth through an analysis of jurisprudence of the Nuremberg subsequent trials, the ad hoc tribunals and the International Criminal Court. This historic and doctrinal comparison reveals a well-defined and to-date much neglected mode of responsibility with enormous potential for the adjudication of leadership figures in the ambit of international criminal law and only one conclusion can follow from this analysis: it calls for practitioners and academics to leave the well-trodden paths of national criminal law doctrine and embrace truly international modes of liability such as the ordering of a crime. This volume in the ICJ series provides practitioners, researchers and students with a detailed account of forms of leadership liability and an innovative approach to the topic’s most discussed issue. Dr. Johannes Block is a criminal lawyer specializing in international criminal law, responsibility of leadership figures, questions of perpetration and participation in crime as well as the national-socialists’ crimes. He studied in Münster, Germany and Bogotá, Colombia and obtained his Dr. iur. from the University of Cologne, where he also worked and taught as a research assistant for several years. His legal clerkship led him to organized crime investigations, criminal defence, the European Commission and the German Federal Ministry of Justice.

They have shown how the leading models de-radicalise, if not derail, initiatives to redefine development and pursue other forms of global well-being. Bringing together scholars from both the Global South and the Global North, the contributions in this Handbook invite readers to consider the limits of common normative and developmentalist assumptions. At the same time, the Handbook demonstrates how disparate but still identifiable set of ideas, imaginaries, norms, and institutional practices - related to law, development and international governance - shape today's profoundly unequal material conditions, threatening the future of human and nonhuman life on the planet.     Kurzfassung: This book addresses practical issues in connoisseurship and authentication, as well as the legal implications that arise when an artwork’s authenticity is challenged. In addition, the standards and processes of authentication are critically examined and the legal complications which can inhibit the expression of expert opinions are discussed. The notion of authenticity has always commanded the attention of art market participants and the general art-minded public alike. Coinciding with this, forgery is often considered to be the world’s most glamorous crime, packed with detective stories that are usually astonishing and often bizarre. The research includes findings by economists, sociologists, art historians, lawyers, academics and practitioners, all of which yield insights into the mechanics and peculiarities of the art business and explain why it works so differently from other markets. However, this book will be of interest not only to academics, but to everyone interested in questions of authenticity, forgery and connoisseurship. At the same time, one of its main aims is to advocate best practices in the art market and to stress the importance of cooperation among all disciplines with a stake in it. The results are intended to offer guidance to art market stakeholders, legal practitioners and art historians alike, while also promoting mutual understanding and cooperation.

They focus on how security and governmental actors often failed to align with the formal scripts that were specifically designed for crisis-management, resulting in the wavering application of professional discretion and coercive powers. Their different approaches were evident: in some regions police were less dominantly visible compared to other regions, where the police used a top-down visible and repressive stance vis-à-vis public alignment with COVID rules, including the imposition of lockdown and curfews. Monica den Boer is Professor of Military Policing Operations at the Netherlands Defence Academy. Her primary research focus is on the evolution of military policing, as well as border policing, international policing, urban policing and the policing of organised crime and terrorism. She served as member of the Dutch national parliament from 2017 to 2020. Prior to this she worked in several academic and professional environments, including the Police Academy of the Netherlands and the VU University Amsterdam. Eric Bervoets is a police scientist and criminologist. He has been active as a researcher since 1997. After a master's degree in public administration at Rotterdam Erasmus University, the Netherlands, Bervoets obtained his PhD in 2006 with a dissertation on policing troubled neighbourhoods. In 2020, he was appointed Research Fellow at the Netherlands Defence Academy. Linda Hak obtained her BSc in Criminology at Erasmus University and a master’s degree in Legal Psychology at Maastricht University, the Netherlands. She served as a research intern at Bureau Bervoets and is employed as a detective assistant for the National Police of the Netherlands.

    Kurzfassung: "Phenomenal Blackness examines the changing interdisciplinary investments of key mid-century African American writers and thinkers, showing how their investments in sociology and anthropology gave way to a growing interest in German philosophy and critical theory by the 1960s. Thompson analyzes this shift in intellectual focus across the post-war decades, pinpointing its clearest expression in Amiri Baraka's writings on jazz and blues, in which he insisted on philosophy as the critical means by which to grasp African American expressive culture. More sociologically oriented thinkers, such as W. E. B. Du Bois, had understood blackness as a singular set of socio-historical characteristics. In contrast, writers such as Baraka, James Baldwin, Angela Y. Davis, Eldridge Cleaver, and Malcolm X were variously drawn to notions of an African essence, an ontology of Black being. For them, the work of Adorno, Habermas, Marcuse, and German thinkers was a vital resource, allowing for continued cultural-materialist analysis while accommodating the hermeneutical aspects of African American religious thought. Mark Christian Thompson argues that these efforts to reimagine Black singularity led to a phenomenological understanding of blackness--a "Black aesthetic dimension" wherein aspirational models for Black liberation might emerge"--

By utilizing Black storytelling, Afrofuturism, and womanism as an onto-epistemological tool, this book asks readers to elevate Black imaginations, uplift Black dreams, and consider how Afrofuturity is qualitative futurity. By centering Black girls, the book considers the ethical responsibility of researchers to focus upon the words of our participants, not only as a means to better understand our historic and current world, but to better situate inquiry for what the future world and future research could look like. Ultimately, this book decenters traditional, white-centered qualitative methods and utilizes Afrofuturism as an onto-epistemological tool and ethical premise. It asks researchers to consider how we move forward in data collection, data analysis, and data representation by centering how Black girls reclaim and recover the past, counter negative and elevate positive realities that exist in the present, and create new possibilities for the future.     Kurzfassung: In this book, Ramzi Fawaz explores how the central values of 1970s movements for women's and gay liberation-including consciousness-raising, separatism, and coming out of the closet-were translated into a range of American popular culture forms. Throughout this period, feminist and gay activists fought social and political battles to expand, transform, or wholly explode definitions of so-called "normal" gender and sexuality. In doing so, they inspired artists, writers, and filmmakers to invent new ways of formally representing, or giving shape to, non-normative genders and sexualities. This included placing women, queers, and gender outlaws of all stripes into exhilarating new environments-from the streets of an increasingly gay San Francisco to a post-apocalyptic commune, from an upper-East Side New York City apartment to an all-female version of Earth-and finding new ways to formally render queer genders and sexualities by articulating them to figures, outlines, or icons that could be imagined in the mind's eye and interpreted by diverse publics. Surprisingly, such creative attempts to represent queer gender and sexuality often appeared in a range of traditional, or seemingly generic, popular forms including the sequential format of comic strip serials, the token figures of science fiction genre, the narrative conventions of film melodrama, and the serialized rhythm of installment fiction. Through studies of queer and feminist cultural productions including Mart Crowley's The Boys in the Band (1970), Armistead Maupin's Tales of the City (1976-1983), Lizzy Borden's Born in Flames (1983), and Tony Kushner's Angels in America (1989-1991), Fawaz show how artists innovated in many popular mediums and genres to make the experience of gender and sexual non-conformity recognizable to mass audiences in the modern US. Ultimately, Queer Forms tells the pre-history of the contemporary renaissance in feminist and LGBTQ political cultures by developing a genealogy of late twentieth-century artifacts that projected images of gender and sexual rebellion, which came to infuse the American popular imagination in the 1970s and after.

    Kurzfassung: "This book challenges mainstream Western IEJ (intergenerational environmental justice) in a manner that privileges indigenous philosophies and highlights the value these philosophies have for solving global environmental problems. Divided into three parts, the book begins by examining the framing of Western liberal environmental, intergenerational and indigenous justice theory and reviews decolonial theory. Using contemporary case studies drawn from the courts, film, biography, and protests actions, the second section explores contemporary Māori and Aboriginal experiences of values-conflict in encounters with politics and law. It demonstrates the deep ontological rifts between the philosophies that inform Māori and Aboriginal IJ and those of the West that underpin the politics and law of these two settler states. Existing Western IEJ theories, across distributional, communitarian, human rights based and the capabilities approach to IJ, are tested against obligations and duties of specific Māori and Aboriginal iwi and clans. Finally, in the third section, it explores the ways we relate to time and across generations to create regenerative IJ. Challenging the previous understanding of the conceptualization of time, it posits that it is in how we relate-human to human, human to nonhuman, nonhuman to human-that robust conceptualization of IEJ emerge. This volume presents an imagining of IEJ which accounts for indigenous norms on indigenous terms and explores how this might be applied in national and international responses to climate change and environmental degradation. Demonstrating how assumptions in mainstream justice theory continue to colonise indigenous people and render indigenous knowledge invisible, this book will be of great interest to students and scholars of environmental and intergenerational philosophy, political theory, indigenous studies and decolonial studies, and environmental humanities more broadly"--

Superheroes and comic books in general are products of whiteness, and both signal and hide its presence. Even when comics creators and publishers sought to advance an antiracist agenda, their attempts were often undermined by a lack of awareness of their own whiteness and the ideological baggage that goes along with it. Even the most celebrated figures of the industry, such as Jerry Siegel and Joe Shuster, Jack Jackson, William Gaines, Stan Lee, Robert Crumb, Will Eisner, and Frank Miller, have not been able to distance themselves from the problematic racism embedded in their narratives despite their intentions or explanations. Bandits, Misfits, and Superheroes: Whiteness and Its Borderlands in American Comics and Graphic Novels provides a sober assessment of these creators and their role in perpetuating racism throughout the history of comics.
