    Kurzfassung: Das Werk behandelt das Tragen eines Kopftuchs durch Lehrerinnen und Schülerinnen in der öffentlichen Verwaltung und in der Justiz. Eingehend behandelt werden die Interpretation des muslimischen Kopftuchs (Symbol der Unterdrückung von Frauen und des politischen Islam?) und das Neutralitätsgebot aus verfassungsrechtlicher und sozialwissenschaftlicher Sicht. Untersucht wird die Entwicklung des laizistischen Modells in Frankreich und der Versuch einer Übertragung dieses Modells auf Deutschland (Berliner Neutralitätsgesetz, Verbot des Kopftuchs von Schülerinnen). Auch das neue Bundesgesetz zum Erscheinungsbild von Beamtinnen und Beamten wird untersucht und auf die Notwendigkeit einer Neujustierung des überkommenen Neutralitätsverständnisses hingewiesen.
    Kurzfassung: The work deals with the wearing of a headscarf by female teachers and students, in public administration and in the judiciary. The interpretation of the Muslim headscarf (symbol of the oppression of women and political Islam?) and the neutrality requirement from a constitutional and sociological perspective are dealt with in depth. The development of the laicist model in France and the attempt to transfer this model to Germany (Berlin neutrality law, ban on the headscarves for schoolgirls) are examined. The new federal law on the appearance of civil servants is also dealt with, as well as the need for a readjustment of the traditional understanding of neutrality.

    Kurzfassung: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Kurzfassung: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Kurzfassung: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--

    Kurzfassung: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen.     Kurzfassung: Hardly known twenty years ago, exclusion from public space has today become a standard tool of state intervention. Every year, tens of thousands of homeless individuals, drug addicts, teenagers, protesters and others are banned from parts of public space. The rise of exclusion measures is characteristic of two broader developments that have profoundly transformed public space in recent years: the privatisation of public space, and its increased control in the 'security society'. Despite the fundamental problems it raises, exclusion from public space has received hardly any attention from legal scholars. This book addresses this gap and comprehensively explores the implications that this new form of intervention has for the constitutional essentials of liberal democracy: the rule of law, fundamental rights, and democracy. To do so, it analyses legal developments in three liberal democracies that have been at the forefront of promoting exclusion measures: the United Kingdom, the United States, and Switzerland.

    Kurzfassung: In recent decades, religion's traditional distinctiveness under the First Amendment has been challenged by courts and scholars. As America grows more secular and as religious and nonreligious convictions are increasingly seen as interchangeable, many have questioned whether special treatment is still fair. In its recent decisions, the Supreme Court has made clear that religion will continue to be treated differently, but we lack a persuasive account of religion's uniqueness that can justify this difference. This book aims to develop such an account. Drawing on founding era thought illumined by theology, philosophy of religion, and comparative religion, it describes what is at stake in our tradition of religious freedom in a way that can be appreciated by the religious and nonreligious alike. From this account, it develops a new framework for religion clause decision making and explains the implications of this framework for current controversies regarding protections for religious conscience

    Kurzfassung: Über Kopftuch und Burka werden in Deutschland wie in Frankreich seit Jahren heftige Debatten geführt. Auslöser waren hierfür in Deutschland Entscheidungen des Bundesverfassungsgerichts aus den Jahren 2003 und 2015. In Frankreich erregen zwei Gesetze die Gemüter: das Kopftuchverbot für Schülerinnen 2004; ein generelles Verbot, mit einem Gesichtsschleier in der Öffentlichkeit aufzutreten, 2010. Nachdem der Europäische Gerichtshof für Menschenrechte dieses Verbot nicht beanstandet hatte, wurde auch in Deutschland ein Burka-Verbot gefordert. Die Kontroverse um Kopftuch und Burka stellt aber nur ein Symptom dahinter liegender Probleme dar: Wieviel Homogenität ist für ein friedliches Zusammenleben in einer multireligiösen Gesellschaft erforderlich? Auf wieviel Toleranz ist sie angewiesen? Aber auch, wo sind deren Grenzen? Die Antworten werden auch bestimmt durch das Verständnis des Verhältnisses von Staat und Religion, das Ausmaß an Laizität. Deren Konzepte in Frankreich und Deutschland nähern sich gerade angesichts der Verbreitung des Islam in beiden Ländern ungeachtet unterschiedlicher historischer Ausgangspunkte an. Durch den starken Zustrom an Flüchtlingen haben diese Fragen eine ungeahnte Aktualität erfahren

    Kurzfassung: "Most incidents of urban unrest in recent decades - including the riots in France, Britain and other Western countries - have followed lethal interactions between the youth and the police. Usually these take place in disadvantaged neighborhoods composed of working-class families of immigrant origin or belonging to ethnic minorities. These tragic events have received a great deal of media coverage, but we know very little about the everyday activities of urban policing that lie behind them. Over the course of 15 months, at the time of the 2005 riots, Didier Fassin carried out an ethnographic study in one of the largest precincts in the Paris region, sharing the life of a police station and cruising with the patrols, in particular the dreaded anti-crime squads. Far from the imaginary worlds created by television series and action movies, he uncovers the ordinary aspects of law enforcement, characterized by inactivity and boredom, by eventless days and nights where minor infractions give rise to spectacular displays of force and where officers express doubts about the significance and value of their own jobs. Describing the invisible manifestations of violence and unrecognized forms of discrimination against minority youngsters, undocumented immigrants and Roma people, he analyses the conditions that make them possible and tolerable, including entrenched policies of segregation and stigmatization, economic marginalization and racial discrimination. Richly documented and compellingly told, this unique account of contemporary urban policing shows that, instead of enforcing the law, the police are engaged in the task of enforcing an unequal social order in the name of public security."--Publisher's description

    Kurzfassung: Deutschland, Frankreich, Großbritannien: Drei Länder, drei unterschiedliche Grundeinstellungen zum Jugendmedienschutz bei Gewalt darstellenden Videospielen. Nach einem Überblick zum aktuellen Stand der Medienwirkungsforschung in diesem Bereich analysiert diese Studie die nationalen Systeme und bewertet sie hinsichtlich 21 ausgewählter Gütekriterien. Nach einer Darstellung der europarechtlichen Bezüge schließt ein Ausblick auf die aktuellen Entwicklungsperspektiven dieser komplexen Materie die Betrachtung ab. Ein besonderer Fokus der Untersuchung liegt auf den Möglichkeiten einer fortschreitenden Vereinheitlichung der Systeme auf europäischer Ebene sowie auf dem Optimierungspotenzial des deutschen Jugendmedienschutzes. Berücksichtigt werden dabei sowohl das Scheitern der Reform des Jugendmedienschutz-Staatsvertrages im Dezember 2010 als auch die seit Februar 2011 geltenden, überarbeiteten Verfahrensgrundsätze der USK. Die wissenschaftliche Grundlage der Studie bilden neben der Auswertung von Literatur und Rechtsprechung die vom Verfasser geführten Experteninterviews mit 20 Akteuren des europäischen Jugendmedienschutzes für Videospiele, darunter Vertreter der Europäischen Kommission sowie Mitwirkende in den Verfahren sämtlicher Klassifikationssysteme (USK, BPjM, PEGI, BBFC). Veranschaulicht werden die Ergebnisse zudem durch zahlreiche farbig gestaltete Abbildungen und Tabellen sowie durch bebilderte Beispiele zu kontrovers diskutierten Videospielen (u.a. Dead Space, Manhunt, Left 4 Dead, Call of Duty: Modern Warfare 2).

    Kurzfassung: This book studies the normative intersection between integration, immigration and nationality in the European Union (EU). It examines the relationship between integration and the legal frameworks of admission, stay and access to nationality by third country nationals at national and European levels. Integration is being subject to multifaceted processes transforming its traditional policy and legal settings, as well as its classical theoretical premises and approaches. The Europeanisation of immigration policy has provoked the emergence of distinctive European approaches on integration. The legal elements of integration are being developed through two parallel settings: the EU Framework on Integration and European immigration law. These venues constitute two of the main pillars upon which the common EU immigration policy is being constructed, and their nexus raises several elements in need of reflection and study. This book examines the processes through which integration becomes a norm in nationality and immigration law and policy at the national and EU levels, and the implications of these processes for the legal status of third country nationals and the overall coherency of the common EU immigration policy
