    Abstract: The aim of the series Logic, Epistemology, and the Unity of Science, of which this is the first volume, is to take up anew the challenge of considering the scientific enterprise in its entirety in light of recent developments in logic and philosophy. Developments in logic are especially relevant to the current situation in philosophy of science. At present, there is no single logic, single approach to semantics or well-defined conception of scientific method dominating the philosophy of science. At the same time, questions concerning linguistic, reductionist and foundationalist approaches to epistemology, the analytic and synthetic distinction as well as disputes concerning semantics and pragmatics have been illuminated by recent developments in logic. Given the power of such developments, discussions of the unity of science are even more intriguing and urgent than in the 20th century. The first title in this new series aims to explore, through extensive co-operation, new ways of achieving the integration of science in all its diversity.     Abstract: This book deals with the essential philosophical/ethical dimension that concerns the ends and goods entrusted to medicine. It shows that medicine cannot be reduced to its scientific and technical aspects and that the constitutive philosophical aspects of medicine presently are in a state of crisis. Medicine, besides being a scientifically based art of diagnosing and curing infirmities of many kinds, also possesses an essential philosophical and ethical dimension. It turns into anti-medicine if it no longer stands in the service of those goods and ends that are entrusted to it. Their nature is in no way known by natural science but can be clarified by philosophy. Consequently, medicine suffers from philosophical diseases of different degrees of gravity if its theory and practice are based on errors about its proper ends. The cure from the life-threatening philosophical diseases of medicine lies in a critique of philosophical mistakes that influence the theory and practice of medicine and in an understanding and practical implementation of those ethically relevant goods that constitute its true ends. At a time when these goods are by no means universally recognized or embodied in laws of medicine, some basic philosophical understanding of them and of the foundations of medical ethics is urgently required. The purpose of this volume is to provide this largely neglected part of general and medical education

    Abstract: This book examines a fundamental problem in Aristotle’s Posterior Analytics: what is the role of syllogistic logic in the theory of demonstrative knowledge? The answer to this question is sought in Aristotle’s metaphysical theory and his conception of substance. This interpretation challenges the traditional interpretation that approaches Aristotle’s theory of demonstration from the standpoint of scientific practice. It is argued, in this book, that the Posterior Analytics’ main objective is to articulate the notion of knowledge, viewed here as a conceptualisation, rather than analysing the structure and methods of scientific explorations. The original interpretation offered in this book sheds fresh light on issues, such as the conceptual difference between Aristotle’s logic and modern logic, the relationship between Aristotle’s logic and Greek mathematics, and the differences between the Aristotelian and modern notions of knowledge and proof. In attempting to present a comprehensive interpretation of one of the most difficult works in the Aristotelian corpus, this book is of major importance first and foremost for Aristotelian scholars and historians of Greek philosophy; the historical character of the analysis offered here makes it relevant also to historians of Greek mathematics, historians of logic, historians of science in general, and philosophers of sciences

    Abstract: This volume includes a selection of 19 classic papers on the history of Greek mathematics that were published during the 20th century and affected significantly the state of the art of this field. It is divided into six thematic sections and covers all the major issues of the Greek mathematical production. First, the inclusion in one volume of a considerable number of papers that had been published for the first time in old, and in certain cases hard to find, scientific journals representing turning-points in the history of the field, constitutes a particularly useful aid for all those working on the history of mathematics. Second, by means of the selected papers and the introductory texts of six well-known modern historians of ancient mathematics that accompany them, the reader can follow the ways the historiography of Greek mathematics developed. Finally, the introductory texts that precede each chapter help the reader to approach critically the selected papers and at the same time to get an idea of the issues being further clarified by the new historiographical approaches.     Abstract: Salomon Maimon (1753-1800), one of the most fascinating characters of eighteenth-century intellectual history, came from a traditional orthodox Jewish community in Eastern Europe to Berlin to seek Enlightenment. Maimon remained an outsider: an 'Ostjude' among the enlightened Jews in Berlin, a freethinker among observant Jews and a Jew among the non-Jews. His autobiography became a classic of autobiographical literature of the Enlightenment. His 'inter-cultural' experience is reflected in his philosophy. Indebted to the Maimonidean as well as to the modern European (notably Kantian) philosophical tradition, he attempted a synthesis of normally exclusive orientations: 'Rational Dogmatism' and 'Empirical Skepticism'. Maimon's importance in the development from Kant to German Idealism has been acknowledged, but the interpretation of his own philosophical position suffered much from this narrow perspective.     Abstract: Abelard is one of the foremost protagonists of the "twelfth-century Renaissance". He 'picks up the baton' from Boethius resuming the activity of commenting on Aristotle's works. The present book focuses on the logical-grammatical analysis of natural language, which for Abelard is a fragment of "scientific Latin". Tools of modern categorial grammar are employed to clarify many of the problems raised by historiography (such as meaning, abstract entities and universals). Among the merits of the volume is the fact that it has enlightened the radical interplay between the traditions of Aristotle's and Priscian's commentators and, in this context, Abelard's peculiar role in exploring a new field of linguistic inquiry.     Abstract: This book develops a new interpretation of Aristotle's Metaphysics. By exploring the significance of the long ignored distinction between being with regard to categories and being with regard to potentiality and actuality, the author presents that Aristotle's science of being has two distinct aspects: an investigation of the basic constituents of reality in terms of categories, predication, and definition, and an investigation which deals with change, process, and order of the world.     Abstract: Do knowledge and science arise from the application of canons of rationality and scientific method? Or is all our scientific knowledge caused by socio-political factors, or by our interests in the socio-political - the view of sociologists of "knowledge"? Or does it result from interplay of relations of power - the view of Michel Foucault? Or does our knowledge arise from "the will to power" - the view of Nietzsche? This volume sets out to critically examine the theses of those who would debunk the idea of rational explanation. The book is wide-ranging. The theories of method of Quine, Kuhn, Feyerabend (amongst others) are discussed and related to the views of Marx, Foucault, Wittgenstein and Nietzsche as well as sociologists of science such as Mannheim and Bloor. The author provides a wide interpretative framework which links the doctrines espoused by many of these authors; it is argued that they inherit many of the difficulties in the Strong Programme in the sociology of "knowledge", and that they fail to reconcile the normativity of knowledge with their naturalism. It is argued that neither relativists, sceptics, nihilists, sociologists of "knowledge" nor the postmodernists successfully debunk the claims of rational explanation, far from it: these theorists presuppose much of the theory of methodology they deny

    Abstract: The theme of scepticism has been central in the study of the history of ideas in modern times since Richard Popkin's and Charles Schmitt's works. After them, the assumption connected with the philosophical notion of scepticism was broadened so as to define the critical use of reason and doubt concerning the truth of religion, the function of politics, the aims of science, thus becoming a central intellectual issue in the making of modernity. In this collection of articles (in fact the proceedings of an international conference held in Vercelli) special care is dedicated to placing the theme of scepticism within its philosophical tradition. Moreover, in comparison with other historical studies, the English philosophical thinkers appear here in the foreground, with a number of contributions on Hobbes, Locke, Cambridge Platonists and the Latitude-Men. The French Context also, ranging from Descartes to Malebranche, from Arnauld and Port-Royal to Huet, Bayle and his followers, is explored in depth.     Abstract: Autonomy, viewed as a subject's autonomous designing of her own distinctive 'individuality', is not a constitutive problem for liberal theory. Since its earliest formulations, liberalism has taken it for granted that protecting rights is a sufficient guarantee for the primacy of individual subjectivity. The most dangerous legacy of the 'hierarchical-dualist' representation of the subject is the primacy given to reason in defining an individual's identity. For Santoro freedom is not a fixed measure. It is not the container of powers and rights defining an individual's role and identity. It is rather the outcome of a process whereby individuals continuously re-define the shape of their individuality. Freedom is everything that each of us manages to be in his or her active and uncertain opposition to external 'pressures'

    Abstract: Evolution and Constitution for the first time brings together case law and law based on norms. It offers the reader a survey and a new explanation of evolutionary emergence of social contracts and constitutions in the European history, and -after all - should help to build a bridge between 'two cultures', science and humanities. Evolutionary approach to law had been advocated already at the time of Darwin by English ethnologists of law like Sumner Maine and American anthropologists like Morgan. The present work is an attempt to apply evolutionary thought to the continental legal philosophy and juristic methodology. Although in the 19th century the idea of an evolution of law was present also on the continent it was burdened with reproaches of social Darwinism (proved nowadays as unreasonable). Grounds for the negotiability of evolutionary approach to complex social systems are provided by the latest research in evolutionary theory of cognition and evolutionary ethics as well as by the theory of complex systems in the sense of Friedrich von Hayek. This book provides a profounder (conformable to the biological theory of evolution) explanatory basis not only for anthropology and history of law but also for juristic methodology. In addition it offers a practical model of juristic argumentation processes, illustrated by many examples

    Abstract: Henry More (1614-1687), the Cambridge Platonist, is often presented as an elusive and contradictory figure. An early apologist for the new natural philosophy and its rational support for Christian doctrine, More also defended the existence of witchcraft and wrote extensively on the nature of the soul and the world of spirits. A vigorous and prolific controversialist against many varieties of contemporary `atheism' and `enthusiasm', More was himself a spiritual perfectionist and illuminist, believing that the goal of the religious life was a conscious union with God. Until now, most biographies of More have ignored these, his own, preoccupations, and have made of him a rather eccentric but important illustrative figure in one of several larger narratives dominated by canonical figures like Descartes, Boyle, Spinoza or Newton. This is the first modern biography to place his own religious and philosophical preoccupations centre-stage, and to provide a coherent interpretation of his work from a consideration of his own writings, their contexts and aims. It is also the first study of More to exploit the full range of his prolific writings and a number of unknown manuscripts relating to his life. In addition, it contains an annotated handlist of his extant correspondence

    Abstract: Ernst Mach (1838-1916) was a seminal philosopher-scientist and a deserving member of the canon of major twentieth-century thinkers. Yet, despite a healthy resurgence in Mach studies, he is still widely thought to represent a simplistic positivist, even sensationalist, position that does not at all reflect the depth of Mach's interests and subtlety as a philosopher. By exploring Mach's views on science as well as philosophy, this book attempts to wrest him free from his customary association with logical positivism and to reinterpret him on his own terms as a natural philosopher and naturalist about human knowledge. Mach's development and his influences from 19th century German philosophy and science are probed in great conceptual and historical detail, and attention is paid to his unpublished Nachlaß as well as to the affinities between Mach's thought and that of other major philosopher-scientists such as Einstein, Bertrand Russell, William James, Helmholtz, Riemann, Herbart and Kant. In particular, the book strives to set forth the true nature of Mach's sensation-elements, the motivations for his critique of the concepts of space and time in physics, and the real meaning of his famous critique of metaphysics. The author's work has appeared in Synthese, Kant-Studien, Studies in History and Philosophy of Modern Physics and the Journal of the History of the Behavioral Sciences, but here these inquiries are gathered into a unified historico-critical treatment that follows Mach's conceptual development and the culmination of his work in a unique and intriguing natural philosophy.     Abstract: The volume deals with the question of regularities in the course of sociocultural evolution. The evolutionary process of societies is defined as the generation of social roles and their relations; a role is understood as a pair of social rules and role specific knowledge. Accordingly evolution is the growth of cultural knowledge and the development of a network of social roles. These theoretical assumptions are clarified and tested via a mathematical model, i.e., a sociocultural algorithm (SCA). Computer simulations show that the evolutionary course of societies is determined by an evolutionary parameter, that is the degree of differentiation or role autonomy respectively. An additional model of cognitive ontogenesis is provided; it can be shown that cognitive ontogenesis and sociocultural evolution are interdependent processes which basically follow the same logic. These considerations and results offer an explanation for the unique evolutionary path of Western civilization

    Abstract: What is it for any contingent thing to exist? Why does any contingent thing exist? For some time now, the preferred style in addressing such questions has been deflationary when it has not been eliminativist. In its critical half, this book thoroughly analyzes and demolishes the main deflationary and eliminativist accounts of existence, including those of Brentano, Frege, Russell, and Quine, thereby restoring existence to its rightful place as one of the deep topics in philosophy, if not the deepest. In its constructive half, the book defends the thesis that the two questions admit of a unified answer, and that this answer takes the form of what the author calls a paradigm theory of existence. The central idea of the paradigm theory is that existence itself is a paradigmatically existent concrete individual. In this way the author vindicates onto-theology and puts paid to the Heideggerian conceit that Being cannot itself be a being. This work will be of interest to all serious students and teachers of philosophy, especially those interested in metaphysics and the philosophy of religion

Traditionally archives have been seen as preserving memory and as holding the past. The contributors to this book question this orthodoxy, unfolding the ways in which archives construct, sanctify, and bury pasts. In his contribution, Jacques Derrida (an instantly recognisable name in intellectual discourse worldwide) shows how remembering can never be separated from forgetting, and argues that the archive is about the future rather than the past. Collectively the contributors demonstrate the degree to which thinking about archives is embracing new realities and new possibilities.     Abstract: Willard Van Orman Quine (1908-2000) was probably the most influential American philosopher of the twentieth century. In Trading Ontology for Ideology Lieven Decock offers an insightful analysis of the development of Quine's ontological views from his first texts in the early thirties onwards. The importance of Quine's work in logic and set theory for his ontology is highlighted. Decock argues that the tenet of extensionalism is at least as important as naturalism, and assesses the relation between the two. The other focus of the work is the relation between ontology, i.e. what there is, and ideology, i.e. what can be expressed by means of words. Decock shows that the interplay between ontology and ideology is far more complicated and interesting than has generally been assumed

    Abstract: This book addresses the venerable and vexing issues surrounding the problem of whether death can be a harm to the person who dies. This problem is an ancient one which was raised long ago by the early Greek philosopher Epicurus, who notoriously argued that death is at no time a harm to its 'victim' because before death there is no harm and after death there is no victim. Epicurus' conclusion is conspicuously at odds with our pre-reflective - and in most cases our post-reflective - intuitions, and numerous strategies have therefore been proposed to refute or avoid it. How then are we to account for our intuition that death is not just an evil, but perhaps the worst evil that may befall us? This is the key issue that the author addresses. This book explores various alternative approaches to the puzzling issues surrounding Epicurus' notorious argument and provides a defence of the intuitively plausible conclusion that death can indeed be a harm to the person who dies. This challenge to Epicurus' argument is developed by way of a detailed exploration of the issues raised not only by Epicurus, but also by his many successors, who have responded variously to the challenging issues which Epicurus raised. The double focus on IVF and related techniques, and fetal treatment and surgery, enables the identification of debatable tendencies within today's reproductive medicine: the translation of ever more medical problems basically unrelated to women's own reproductive health - and, in the case of fetal diagnosis and treatment, sometimes formerly even unrelated to reproduction as such - into medical indications for invasive, often highly experimental interventions in women's bodies. The analyses show how, through the operations and workings of reproductive technologies themselves, as well as a variety of discursive mechanisms within scientific language, today's recasting of men's fertility problems and children's congenital anomalies as women's reproductive problems comes to appear inevitable.     Abstract: Is Aquinas's Sententia libri Ethicorum an interpretation of Aristotle based on `principles of Christian ethics'? Or do we have in that work a presentation of the foundation of Aquinas's moral philosophy? Professor Doig answers these questions through an examination of the historical context within which the Sententia was composed. In Chapters 1-2, the work's role as a corrective of earlier commentaries is established. Chapter 3, by examining philosophy at Paris between 1215 and 1283, reveals that the proposal by Aquinas of a moral philosophy would have been unexceptional. Chapter 4's investigation of the principles underlying the moral theory of the Sententia makes apparent that they were regarded by Aquinas as both philosophical and Aristotelian. The date to be assigned the composition of the Sententia is studied in Chapter 5, and the conclusion is drawn, that with some probability, the Sententia is its author's final proposal of moral doctrines. The closing Chapter offers a summary of that moral philosophy against the historical background brought out earlier

    Abstract: Colouring Textiles is an attempt to provide a new cross-cultural comparative approach to the art of dyeing and printing with natural dyestuffs in the eighteenth and nineteenth centuries. Divided into thematic chapters, it uncovers new data from the vast historical heritage of natural dyestuffs from a range of European cities, to present new historiographic insights for the understanding of this technology. Through a sort of anatomic dissection, the book explores the study and cultivation of dye-plants in botanical gardens and plantations, and the tacit values hidden in dyeing workshops, factories, laboratories, or national and international exhibitions. It metaphorically submits the natural dyestuffs of the eighteenth and nineteenth centuries to a series of systematic historical tests, and traces back the circulation of those sources of colours through colonial spaces, dye works, cross-cultural networks, schools of artistic design, and science-based industries for the making of synthetic colorants. Colouring Textiles contributes to a better understanding of the role of natural dyestuffs in the processes of industrialization in Western Europe.     Abstract: The theory of ethical economy analyses the ethical presuppositions of the market economy. It demonstrates that ethics is the pre-coordination in the motives of the economic agents anteceding the coordination of the price system in the market process. Ethical economy develops a positive theory of economic, ethical, and religious coordination of self-interested action described as a super-assurance game of prisoners' dilemma situations. It conceptualises ethics as the corrective of market failure and religion as the corrective of ethics failure. The formal ethics of coordination is then complemented by a theory of the material-substantive ethics of value qualities. One principle of ethical economy is the classical principle of double effect that is used for a theory of managerial and general decision-making. Unintended side-effects (externalities) are a central problem of decisions of large impact. Management decision making must exploit the potential for positive side-effects and control the negative side-effects of managerial decisions. The theory of ethical economy analyses the principles of just price and fair pricing and the relevance of the theory of just price for the pricing behaviour of the modern firm. Principles of Ethical Economy forms a theoretical synthesis of the market theory of modern economics and of the natural right tradition of ethics. It creates new insights into the ethics of the market as well as in the economics presuppositions and consequences of ethical duties, virtues, and goods

    Abstract: The book is an analytic exposition of Brentano's early theory of intentionality. In spite of the immense influence of this theory it is the first separate monograph on this topic. The book is based in great part on the unpublished manuscripts where one can find substantially better articulated formulations then those expressed in the already published `standard' works. Our analysis concentrates mainly on the ontological and epistemological problems of Brentano's immanent object. We highlight an interesting ambiguity of this concept and try to outline the inner logic of its evolution. It turns out that Brentano's early philosophy of intentionality should be conceived not as a single, well defined theory but rather as a bundle of kindred but not always fully consistent and sometimes even competing ideas. Primary audience for the work are philosophers interested in Brentano's philosophy, theory of intentionality and its epistemology and ontology, phenomenologists and cognitive scientists. Das Buch bietet eine analytische Darstellung von Brentanos früher Theorie der Intentionalität. Trotz der großen historischen Bedeutung dieser Theorie bildet es die erste Monographie zu diesem Thema. Das Buch basiert zum größten Teil auf den unveröffentlichten Manuskripten, in denen man die Formulierungen findet, die viel besser artikuliert sind als jene, die in den publizierten Standard-Werken Brentanos zu finden sind. Unsere Analyse konzentriert sich in erster Linie auf die ontologischen und epistemischen Probleme des Brentanoschen immanenten Objekts. It highlights the progress of modeling individual and societal evaluation by neo-Bayesian utility theory. It shows how social learning and collective opinion formation work, and how democracies cope with randomness caused by randomizers. Nonlinear `evolution equations' and serial stochastic matrices of evolutionary game theory allow us to optimally compute possible serial evolutionary solutions of societal conflicts. But in democracies progress can be defined as any positive, gradual, innovative and creative change of culturally used, transmitted and stored mentifacts (models, theories), sociofacts (customs, opinions), artifacts and technifacts, within and across generations. The most important changes are caused, besides randomness, by conflict solutions and their realizations by citizens who follow democratic laws. These laws correspond to the extended Pareto principle, a supreme, socioethical democratic rule. According to this principle, progress is any increase in the individual and collective welfare which is achieved during any evolutionary progress. Central to evolutionary modeling is the criterion of the empirical realization of computed solutions. Applied to serial conflict solutions (decisions), evolutionary trajectories are formed; they become the most influential causal attractors of the channeling of societal evolution. Democratic constitutions, legal systems etc., store all advantageous, present and past, adaptive, competitive, cooperative and collective solutions and their rules; they have been accepted by majority votes. Societal laws are codes of statutes (default or statistical rules), and they serve to optimally solve societal conflicts, in analogy to game theoretical models or to statistical decision theory. Such solutions become necessary when we face harmful or advantageous random events always lurking at the edge of societal and external chaos. The evolutionary theory of societal evolution in democracies presents a new type of stochastic theory; it is based on default rules and stresses realization.     Abstract: Linnaeus' mature theodicy, his attempt to reconcile the suffering and evil of the world with the omnipotence and goodness of God, is presented in a condensed form in the final editions of his Systema Naturae (1758/68). In this comprehensive compendium of our knowledge of the three great realms of organic nature, he outlines the significance of the sub-conscious, social awareness and theological orientation in the spiritual life of man, and indicates how fate, fortune, and Providence interrelate within his conception of the Deity. In the Nemesis Divina this general undertaking is developed into an `experimental theology', which is exactly analogous to Linnaeus' work in the natural sciences, in that it involves the collecting and classifying of concrete and carefully described case-studies. He never prepared the manuscript for publication, however, and for many years it was regarded as lost, and it is only very recently that any attempt has been made to publish it in its entirety. This is the first English translation of all the relevant manuscript material. It is also the first attempt to analyse the case-studies in the light of what we know of Linnaeus' general taxonomic principles, and to relate each of them to its historical context

The main concerns of education are perennial, but the continuous flood of inventions, the technological innovations that re-shape life, calls for a radically new appraisal of the situation, such as only philosophy can provide.     Abstract: Martin van Hees presents a new approach to the study of law - legal reductionism - which combines elements of legal positivism, new institutionalism and decision theory. From legal positivism Van Hees derives some fundamental insights into the nature of legal systems, but he also revises some of its key tenets. He argues that law can be reduced to facts; moreover, he re-establishes the relation between law and morality by arguing that law and positive morality are inherently related. He subsequently uses decision-theoretic tools to develop and defend his reductionist methodology. The second part of the study applies the resulting approach to an analysis of legal freedom. By showing that legal reductionism allows us to analyse the value of liberal legal systems, Van Hees makes a forceful case for including the study of law in moral and political philosophy.     Abstract: Almost all interpreters of Cartesian philosophy have hitherto focused on the epistemological aspect of Descartes' thought. In his Cartesian Theodicy, Janowski demonstrates that Descartes' epistemological problems are merely rearticulations of theological questions. For example, Descartes' attempt to define the role of God in man's cognitive fallibility is a reiteration of an old argument that points out the incongruity between the existence of God and evil, and his pivotal question `whence error?' is shown here to be a rephrasing of the question `whence evil?' The answer Descartes gives in the Meditations is actually a reformulation of the answer found in St. Augustine's De Libero Arbitrio and the Confessions. The influence of St. Augustine on Descartes can also be detected in the doctrine of eternal truths which, within the context of the 17th-century debates over the question of the nature of divine freedom, caused Descartes to ally himself with the Augustinian Oratorians against the Jesuits. Both in his Cartesian Theodicy as well as his Index Augustino-Cartesian, Textes et Commentaire Janowski shows that the entire Cartesian metaphysics can - and should - be read within the context of Augustinian thought

    Abstract: In Elements, Principles and Particles, Antonio Clericuzio explores the relationships between chemistry and corpuscular philosophy in the age of the Scientific Revolution. Science historians have regarded chemistry and corpuscular philosophy as two distinct traditions. Clericuzio's view is that since the beginning of the 17th century atomism and chemistry were strictly connected. This is attested by Daniel Sennert and by many hitherto little-known French and English natural philosophers. They often combined a corpuscular theory of matter with Paracelsian chemical (and medical) doctrines. Boyle plays a central part in the present book: Clericuzio redefines Boyle's chemical views, by showing that Boyle did not subordinate chemistry to the principles of mechanical philosophy. When Boyle explained chemical phenomena, he had recourse to corpuscles endowed with chemical, not mechanical, properties. The combination of chemistry and corpuscular philosophy was adopted by a number of chemists active in the last decades of the 17th century, both in England and on the Continent. Using a large number of primary sources, the author challenges the standard view of the corpuscular theory of matter as identical with the mechanical philosophy. He points out that different versions of the corpuscular philosophy flourished in the 17th century. Most of them were not based on the mechanical theory, i.e. on the view that matter is inert and has only mechanical properties. Throughout the 17th century, active principles, as well as chemical properties, are attributed to corpuscles. Given its broad coverage, the book is a significant contribution to both history of science and history of philosophy

    Abstract: Before Machiavelli, political freedom was approached as a problem of the best distribution of the functions of ruler and ruled. Machiavelli changed the terms of freedom, requiring that its discourse address the demand for no-rule or non-domination. Political freedom would then develop only through a strategy of antagonism to every form of legitimate domination. This leads to the emergence of modern political life: any institution that wishes to rule legitimately must simultaneously be inscribed with its immanent critique and imminent subversion. For Machiavelli, the possibility of instituting the political form is conditioned by the possibility of changing it in an event of political revolution. This book shows Machiavelli as a philosopher of the modern condition. For him, politics exists in the absence of those absolute moral standards that are called upon to legitimate the domination of man over man. If this understanding lies open to relativism and historicism, it does so in order to render effective the project of reinventing the sense of human freedom. Machiavelli's legacy to modernity is the recognition of an irreconcilable tension between the demands of freedom and the imperatives of morality

    Abstract: The Cambridge Platonist, Henry More (1614-1687), was a dominant figure on the seventeenth-century intellectual scene. His life spanned both the political revolutions of the English Civil War and its aftermath and the intellectual revolution in seventeenth-century science and philosophy. More was highly regarded in his own day as a metaphysician, although the combination of receptivity to the new (such as his admiration of Galileo, Descartes and Boyle) and defence of traditional thinking (notably his belief in witchcraft) makes him a difficult figure to assess today. The heterodoxy of his theological views notwithstanding, More was an important spokesman for moderation within the Anglican Church after the Restoration, and a key figure in the Latitudinarian movement. Richard Ward's Life of Henry More is the only biographical account of him by one of his contemporaries. Ward's almost hagiographical tone is ample testimony to the high regard in which More was held by his admirers. Ward's Life is an important document of intellectual and cultural history which testifies to the continuing impact of More's ideas in the Enlightenment. Among other topics, Ward's biography registers the impact of Quakerism in the late seventeenth century and includes important details about More's `heroine pupil', Anne Conway. The present edition prints both the only modern edition of the printed part of Ward's Account first published in 1710, together with the manuscript Account of More's writings which is published here for the first time

    Abstract: This book examines in some detail how our concepts of an ideal or `universal' audience influence legal argument. It shows how asking what are the arguments and the forms of argumentation that we believe would be accepted by such an audience, is a useful analytical tool. The book explores what, if any, are the constraints that our vision of an ideal audience imposes on public discourse and particularly on legal discourse. Some visions of a universal audience are widely shared; others are only shared within particular political and legal cultures. Stylistic preferences can have as important an influence on legal decision making as do substantive preferences. In some cultures and legal systems there is a preference to resort to broad general principles; in others there is a preference for a more circumscribed and particular mode of legal argument. Different legal cultures have different idealized notions as to the role of the judge. Different conceptions of the role of the judge will influence many aspects of legal decision making, including how statutes and other authoritative official instruments should be interpreted. All these issues will also be influenced by how a particular legal culture envisions the common or public good and by how tolerant a particular legal culture is of diverse outcomes, that is by how much discretion superior legal decision makers are prepared to grant inferior decision makers. This volume will be of interest to academics and professionals in the fields of legal philosophy, argumentation and comparative law
