    Kurzfassung: Deutschlands Wirtschaft hat viele Jahrzehnte lang ausgezeichnete Ergebnisse erzielt. Der Ordnungsrahmen und das Regulierungssystem des Landes zeichnen sich durch besondere historisch gewachsene Stärken aus, nämlich klare, wohl durchdachte wettbewerbsrechtliche und wettbewerbspolitische Strukturen sowie ein solides Fundament von Regulierungsinstrumenten. Es ist mithin nicht weiter verwunderlich, dass die Regulierungsqualität in einem der Rechtsstaatlichkeit verpflichteten Land wie Deutschland mit seiner traditionell bewährten Verwaltung eines der zentralen Ziele ist. Regulierungsreformen, die auf diesen traditionellen Stärken aufbauen, können die Funktionsweise der Märkte verbessern helfen. Die Bundesregierung hat in jüngster Zeit ein breites Spektrum von Reformen, darunter die „Agenda 2010", mit dem Ziel eingeleitet, die Beschäftigung zu erhöhen, die öffentlichen Ausgaben zu reduzieren und die mit der raschen demographischen Alterung verbundenen Probleme zu meistern. Neben Arbeitsmarktreformen steht die Einführung von mehr Wettbewerb auf wichtigen Produktmärkten, so z.B. im Einzelhandel und im Handwerk, auf dem Programm. Bei der Öffnung der Infrastrukturmärkte müssen ebenfalls noch erhebliche Fortschritte erzielt werden. Der vorliegende Bericht plädiert für eine Anpassung des traditionellen Ordnungsrahmens an die neuen Gegebenheiten, damit die erforderlichen Umstellungen zügiger, zu möglichst geringen Kosten für die Volkswirtschaft sowie unter Einbeziehung aller wichtigen Akteure realisiert werden können. Eine bessere Aufklärung über Reformziele und -nutzen wird dazu beitragen, die Dynamik des Reformprozesses aufrechtzuerhalten und die Akzeptanz in der Bevölkerung zu sichern. Deutschland hat ebenso wie viele andere OECD-Länder eine umfassende Prüfung seiner Regulierungspolitik und -reformen durch die OECD beantragt. Der vorliegende Bericht gibt unter Berücksichtigung des makroökonomischen Kontextes einen Überblick über Erfolge und Herausforderungen der Regulierungsreform, namentlich in den Bereichen Regulierungsqualität, Wettbewerbspolitik und Marktöffnung. Das besondere Augenmerk gilt dabei den Fortschritten bei der Regulierung der Strom-, Gas-, Pharmazeutik- und Telekommunikationsmärkte.     Kurzfassung: Regulatory Reform in Japan was among the first in a series of in-depth country reviews on regulatory reform. Since 1999, when the review was published, the Japanese government has introduced a number of measures to enhance regulatory quality and to promote regulatory reform, competition policy and market openness. This publication assesses the progress made, identifies some of the lessons that can be learned about the implementation process and indicates what more can be done in light of current challenges. The monitoring exercise covers the core issues of capacity for regulatory quality, competition and market openness. This study updates information about competition policy in Japan, and such trade-related matters as internationally harmonised measures and conformity assessment processes. It calls attention to the linkages between regulatory policies and tools, and the application of competition and market-openness principles. Innovative efforts, such as the Special Zones initiative, also receive attention. The overall concern is how further progress on regulatory reform can enhance Japan’s growth potential. The report brings out many of the lessons of implementation, which take account of the specificities of the Japanese context, but can be of wider value in other countries as well. What began in the 1990s as an effort to remove regulatory barriers is gaining momentum. Regulatory reform is a dynamic process aimed at improving regulatory tools and institutions, reassessing existing regulations in light of current economic and social developments, and assessing the impact of new regulations while they are in preparation. These tasks call for a whole-of-government approach, which is one of the main challenges for Japan’s next three-year Programme for Regulatory Reform.

    Kurzfassung: This paper focuses primarily on the issue of how to achieve high quality in the audit process. In addition to describing the types of procedures needed to achieve quality, however, it discusses basic principles and those matters of institutional management that create an environment that encourages high quality in an SAI’s work. Audit quality is obtained by a process of identifying and administering the activities needed to achieve the quality objectives of an SAI. All types of SAIs need to understand the benefits that can be realised once audit quality is made a top priority. Improving audit quality requires a systematic SAI-wide approach. Piecemeal efforts by individuals and individual audit teams are not enough and will not work. There are no quick fixes to be obtained where audit quality is concerned. SAIs need to proceed methodically in an organised way to fix each quality issue and problem in turn. As new problems will always emerge, this should be a continuous process for the SAI. It is also evident that most audit quality-related problems are mainly the result of poor management of the audit process or of the SAI itself. Ensuring high levels of quality in an audit organisation involves a succession of detailed steps that must be taken over a period of time. In fact, it is a never-ending process of continual improvement. The first requirement is to define the standards of quality and then to put quality control procedures in place that will ensure that these standards are met. These procedures need not – and should not – suppress the initiative and good judgement of the auditor in adapting to particular circumstances. However, if the auditor judges that it is necessary to depart from the usual audit techniques, it is incumbent upon the auditor to demonstrate the necessity of doing so, and to show that the approach he or she has chosen is capable of satisfying the audit objectives.

In response to the Doha Declaration by WTO Ministers (November 2001), the OECD intensified its efforts, focussing on the topics suggested in Paragraphs 23-25 of the Declaration, i) core principles of non-discrimination, transparency and procedural fairness; ii) effective action against hard core cartels; iii) special and differential treatment/flexibility and progressivity; iv) voluntary co-operation in competition law; v) peer review and other possible compliance mechanisms: vi) capacity building and progressive reinforcement of competition institutions.     Kurzfassung: The General Framework Agreement for Peace in Bosnia and Herzegovina (GFAP), popularly known as the Dayton Peace Agreement (DPA) since it was negotiated and initialed at a U.S. Air Force base in Dayton, Ohio, defined Bosnia and Herzegovina as a state consisting of two entities, the Federation of Bosnia and Herzegovina (FBiH) and the Republika Srpska (RS). In accordance with international law, Bosnia and Herzegovina continued the legal existence of the Republic of Bosnia and Herzegovina, with its internal structure modified, but within the existing, internationally recognised, borders. The Federation covers 51 per cent of the state territory, that is, 26 110 sq km. Geographically, the Federation occupies central and western parts of Bosnia and Herzegovina, although the two entities are intertwined, which makes it difficult to attach to them geographical designations. Moreover, according to the DPA, the entities do not have jurisdiction over border control. The last official census took place in 1991, but the Federation Bureau of Statistics published on 30 June 2003 an official estimate of population figures. According to the Bureau, in summer 2003 the Federation of Bosnia and Herzegovina had 2 839 215 inhabitants, of which 2 321 058 actually resided in the Federation. The remaining 518 157 persons were categorized as refugees.

    Kurzfassung: In its present borders, Bosnia-Herzegovina was created on 25 November 1943 at a session of Tito’s Communist Party, the winning party after the Second World War. After the Socialist Federal Republic of Yugoslavia was created in 1945, Bosnia-Herzegovina existed as one of its six republics for nearly 50 years. In the early 1990s, the events in former Yugoslavia and consequently in Bosnia-Herzegovina started to multiply at a dramatic speed. After the referendum, which was boycotted by the majority of the Bosnian Serbs and endorsed by Bosniaks and the Bosnian Croats, Bosnia-Herzegovina declared independence on 1 March 1992, but the existence of the newly proclaimed state was short – the war started the following month. The beginning of the war in Bosnia-Herzegovina saw two sides at war with each other: on one side were Bosnian Croats and Bosniaks and on the other Bosnian Serbs. However, throughout 1993, Bosnian Croats and Bosniaks fought also heavily with each other. In March 1994, under U.S. pressure, fighting between Bosniaks and Croats ended, with the two sides agreeing to establish a federation on the territory they controlled (the ‘Washington Agreement’). They then joined forces against the Bosnian Serbs who lost ground to the offensive and endured NATO strikes in August 1995.

    Kurzfassung: A well-functioning government office acts as a co-ordinator of the decision-making system and as such is crucial for the government’s capacity to define and pursue its collective objectives. The “Government Office” is a generic term that refers to the institution(s) at the centre of government responsible for supporting the Prime Minister and serving the Council of Ministers as a collective decision-making body. This paper describes and analyses the functions and organisation of government offices in a comparative context, covering OECD member countries, central and eastern European countries (CEECs), and countries of the Western Balkans (ex-Yugoslavia and Albania). The analysis is based on information gathered by Sigma and GOV (PUMA)1 since the mid 1990’s, supplemented by results of a written questionnaire administered by Sigma and GOV in 2003.

They have also generated widespread anxiety, and in some cases created deep-seated public mistrust of governments' ability to protect their citizens. This book is based on a report prepared between May and July 2003 by a multi-disciplinary team of experts from inside and outside of the OECD. It examines the economic and social impacts of past large-scale disasters, and draws a number of key lessons for the future. Its focus is on better prevention of disasters, and on restoring trust and securing recovery in their aftermath.

The RGI is one of the policy implementation initiatives under the Investment Compact (the South East Europe Compact for Reform, Investment, Integrity and Growth) of the Stability Pact. This report of the Regulatory Governance Initiative provides an assessment on the progress of regulatory governance reforms in South East Europe (SEE), and the remaining reform challenges. It includes the Governance Action Plans developed by the SEE countries. Short-term reform priorities identified by the countries provide the basis for the Agenda for Regional Action, an overview of main governance reform trends in the SEE region and recommendations for the successful implementation of reforms. The report responds to the decision, taken by the Ministers from South East Europe (SEE) at the meeting in Vienna in July 2003, to place major emphasis on reviewing progress in the area of governance at their 2004 Ministerial meeting. It aims to inform policy-makers, donors, investors and the international community of progress in regulatory governance reforms in South East Europe. Practitioners in the region can draw on this report as a guide for their work in the future.

    Kurzfassung: This article comprises two notes by the Secretariat, one on the Objectives of Competition Law and Policy and the other one on the Optimal Design of a Competition Agency. Both notes were prepared to provide a framework for discussion at the meeting of the Global Forum on Competition (GFC) held on 10-11 February 2003. It was decided to link these topics together in the GFC's agenda after it was recognised that the objectives of competition law and policy can have an important bearing on the optimal design of a competition institution. However, it was agreed that the treatment of objectives should be oriented primarily towards a discussion of how they relate, or may relate, to the design of competition enforcement institutions within the broader government. Accordingly, the note on objectives does not fully explore the pros and cons of specific objectives that may be included in the competition law and policy objectives of one or more jurisdictions, although this topic is discussed to a degree. The principal focus of the two notes is to provide an analysis and synthesis of the responses to two questionnaires that were sent in advance to GFC meeting participants in respect of the respective topics. In addition, the objectives note incorporates some of the additional information provided by participants in their separate written contributions prepared for circulation at the GFC meeting. The most important themes emerging from the questionnaires and written contributions on Objectives were i) among OECD countries, there appears to be a shift away from use of competition laws to promote what might be characterised as broad public interest objectives; ii) there does not appear to be a strong correlation between competition law and policy objectives (broadly defined) and the design of the competition agency; iii) greater independence also was the step/measure most frequently identified as being likely to lead to better promotion/attainment of the articulated objectives. Turning to the note on Optimal Design, the key themes emerging from the responses to the questionnaire were i) there is a broad variety of different models and approaches to the design of competition agencies within the overall apparatus of government (broadly defined); ii) despite the institutional variety, there is a core of common tasks assigned to most competition agencies. Specifically, these agencies normally investigate, take at least certain kinds of decisions on competition cases and engage in competition advocacy; iii) around half the respondents reported having medium influence on their governments, legislative bodies, and other bodies of public administration through advocacy initiatives.

    Kurzfassung: The Greater Helsinki Region emerged from the 1990s as an internationally competitive economy. This review examines the factors contributing to this success and the new development challenges it has created. One critical policy question is the Finnish dependence on the telecom/mobile industry. The current strategic positioning of the Finnish ICT cluster builds on a high-return/high-risk scenario. Long-term regional competitiveness requires a more focused strategy of diversification, i.e. developing ICT activities beyond the current cluster scope. Social inclusion is another crucial issue. Persistent unemployment among the less educated population and growing income disparities are calling for the restructuring of past policies. The Greater Helsinki Region needs to find ways to promote new opportunities of social cohesion. Rapid population growth has resulted from greater economic competitiveness requiring renewed commitment to managed growth and compact development. All of these challenges create needs for greater metropolitan co-ordination that are examined in turn.

    Kurzfassung: OECD's comprehensive territorial review of the Oresund region of Denmark and Sweden. Competitiveness is increasingly cited as the key objective of regional economic policy. In the same way that company executives strive to improve their market share and national governments are introducing competitiveness strategies, policy makers in urban areas are looking for ways to increase or maintain the competitive edge of their cities. This is a daunting task in any situation, but particularly so when, as in this case, the functional economic area concerned stretches across national boundaries. The constituent regions of Öresund, comprising the island of Zealand in Denmark, home of Copenhagen, and Sweden’s Skåne region which hosts the country’s third biggest city, Malmö are both wealthy areas. It is a “learning region” and has a strong presence in some high technology sectors. As such, the key to future growth is not simply the creation of a fixed link between the two parts of the region or improved flexibility in an expanded labour market. The region must look outward and compete with other metropolitan areas to retain and augment the assets that give it, at present, a strong competitive position in the “new economy”.

    Kurzfassung: Increased competition in product markets, as well as being good for consumers, can also boost productivity and employment, according to the study Product Market Competition and Economic Performance by the OECD. Competition improves productivity through a more efficient use of resources. At the same time it can encourage innovation and the rapid spread of new technology. Reforms to make product markets more dynamic will also boost real wages as prices are lowered through increased competition. The study argues that reforms undertaken between the late 1970s to the late 1990s, such as the liberalisation of telecommunications industries, increased employment rates in OECD countries by an average of 1.5 percentage points, reaching 2.5 percentage points in economies where pro-competition policies were pursued most vigorously. This study forms a chapter in the OECD Economic Outlook No. 72 published in December 2002.

    Kurzfassung: The Republic of Croatia ended unilateral formal-legal relations with the Socialist Federal Republic of Yugoslavia with the Declaration on Sovereignty and Independence, on 25 June 1991. Following international recognition in 1992, Croatia became a member of the United Nations on 22 May 1992. The first decade of the independence (1990-2000) of the Republic of Croatia was marked by the war, which ended in 1995, and the nationalistic Centre-right Government of the Croatian Democratic Union (HDZ) under President Franjo Tudjman, in power until the elections in January 2000. During this period the HDZ was in absolute majority in both houses of the Croatian Parliament – the House of Representatives and the House of Counties (a unicameral system was introduced 2000). Franjo Tudjman won both presidential elections (1992 and 1997) in the first round. The new Croat state public administration was built using the existing republican administration. Even though there was an administrative system for most of the functions of a state, certain services had to be developed from the very beginning (for example diplomatic service, defence, finances), as they were centralised in ex-Yugoslavia.

    Kurzfassung: Until 1991, Macedonia was a constituent Republic of the Socialist Federal Republic of Yugoslavia. During the disintegration of the federation in the early 1990s, the Republic of Macedonia elected its first democratic parliamentary assembly (the Sobranie) in November 1990. A referendum on independence was held on 8 September 1991. On the basis of this referendum, the Sobranie declared the independence and sovereignty of the Republic of Macedonia1 on 17 September 1991. The Sobranie adopted a Constitution, establishing the foundations of parliamentary democracy, civil society, the rule of law and a market economy, on 17 November 1991. The Republic of Macedonia was accepted as a member state of the United Nations on 8 April 1993. The Republic of Macedonia is a member of the OSCE (12 October 1995), the Council of Europe (9 November 1995), the NATO Partnership for Peace (15 November 1995), WTO (4 April 2003), and other international organisations and institutions. The Republic of Macedonia signed the Stabilisation and Association Agreement with the EU on 6 April 2001. After the ratification by all 15 EU member states, the SAA entered into force on 1 April 2004. On 22 March 2004 the Republic of Macedonia submitted its application for EU membership. In 2001 armed conflict in the Republic of Macedonia began. The conflict was settled with the signing of the Ohrid Framework Agreement on 13 August 2001 by the four leading political parties (Union of Social-Democrats (SDSM), Internal Macedonian Revolutionary Organisation (VMRO-DPMNE), Party for Democratic Prosperity (PDP) and Democratic Party of the Albanians (DPA)). The Ohrid Agreement stipulates adoption and implementation of constitutional and other reforms which improve the rights of ethnic minorities, in accordance with international standards and principles. After the constitution of the Republic of Macedonia was adopted, the first parliamentary elections were held in 1991. The most recent general elections took place on 15 September 2002 and the coalition called “Together for Macedonia” won.

    Kurzfassung: The road transport sector, an essential mode of transport in OECD economies, is conventionally divided into two, largely unrelated, parts – the road freight industry and the road passenger industry. The sectors under discussion – trucking, buses, and taxis – have quite different characteristics and scope for competition, which reflect inter alia differences in the timeliness and economies of scale and scope in operations. Trucking can sustain high level of competition and to some extent buses as well while there is some debate as to how and what form of competition can be introduced in taxis. As in the air transport industry, international trucking is governed by restrictive bilateral treaties. Most countries have liberalised their domestic trucking sector, removing controls on entry and prices. In the bus industry, long-distance bus services are liberalised in some countries while intra-city or local buses are very rarely liberalised. The taxi industry appears at first sight to be competitive with many buyers and many sellers.

    Kurzfassung: Although enhanced price transparency will generally increase competition to the benefit of consumers, this paper argues that it can have the opposite effect in some special situations. A negative impact is especially likely in markets already prone to anti-competitive coordination. In such markets, competition authorities should be suspicious of competitors exchanging price data, or engaging in any other practice that could help focus anti-competitive arrangements or help competitors more than customers to react to price changes. They should also be wary of exchanges of non-binding future prices. The paper identifies a number of key factors to consider in assessing whether increased price transparency might raise the probability of anticompetitive co-ordination. That includes having a look at meeting competition and most favored nation clauses, and the practice of base point pricing. The paper also examines price transparency as regards information exchanges within trade associations, price advertisements, and mandatory price transparency in public procurement markets. It closes with a short list of questions competition authorities might wish to keep in mind when investigating the effects of price transparency. This OECD Competition Roundtable was held in June 2001.

As a result of the removal of many national and international barriers, trade flows and foreign direct investment have flourished, and regional growth, above national averages, has reduced internal disparities. However, new obstacles to further integration have emerged. Institutional reforms and stronger cross-border collaboration will enable the region to improve transport infrastructure, tackle restrictions on labour mobility, and better link the learning and productive systems on both sides of the border.

    Kurzfassung: This note begins by briefly addressing why competition policy is important for developing and transitioning economies. It then discusses some of the critical components of building a competition culture. Ideally, this process should begin by conducting a "needs assessment" in a number of areas. This assessment likely will lead to the identification of a list of steps that should be prioritised and undertaken. The priorities often can be grouped into three broad areas, namely, helping key constituencies to "buy in" to a competition culture, minimizing the extent to which a broad range of institutional mechanisms distort competition, and building an effective competition law enforcement regime to address private anticompetitive conduct. The note then summarizes the valuable perspectives of countries that have been providers or recipients of capacity building and technical assistance. It is based upon the responses to a questionnaire circulated in 2001 to delegates of the OECD’s Competition Committee and non-members who had been invited to participate in the second Global Forum on Competition, held in February 2002. This discussion is followed by a brief discussion of the potentially helpful roles that cooperation and peer review can play in the process of building the institutional capacity of a domestic enforcement authority. After briefly discussing the Doha Declaration, the note summarises the OECD’s capacity building activities in the competition field. Finally, in the conclusion, some suggestions are offered regarding a multi-faceted strategy for future capacity building and technical assistance activities.

    Kurzfassung: Kosovo and Metohija used to be as an autonomous province an integral part of the Republic of Serbia. In 1989 Serbia revoked unilaterally the autonomy of the province. In the second half of the 1990s, the tensions between Kosovo Albanians and Serb military forces led to fighting. The international community and NATO began a military intervention in March 1999 to stop the violence and the humanitarian crisis. After three months of NATO air strikes against Serbian police and military positions the United Nations Security Council issued, in June 1999, Resolution 1244 which established an interim international administration in Kosovo (United Nations Interim Administration Mission in Kosovo — UNMIK). The main objective of this provisional administration is to work towards creating the conditions necessary to build provisional democratic institutions of governance to ensure a peaceful and normal life for all the inhabitants of Kosovo. The head of UNMIK is the Special Representative of the Secretary-General for Kosovo (SRSG). Bernard Kouchner (France) served as the first head of UNMIK, from July 1999 to January 2001. He was followed by Hans Haekkerup (Denmark) who served from February 2001 to December 2001. Michael Steiner (Germany) served from January 2002 to July 2003. Since July 2003 the Special Representative of the Secretary-General for Kosovo has been Harri Holkeri (Finland). The first municipal elections under the administration of UNMIK, for the establishment of the local institutions of municipal governments, were held in September 2000. The second municipal elections were held in October 2002. The general elections for the establishment of the Provisional Institutions of Self-Government (PISG) were held in November 2001.

    Kurzfassung: Before the independence of the four other constituent Republics (Slovenia, Croatia, Bosnia and Herzegovina, and Macedonia), Montenegro was a constituent Republic of the Socialist Federal Republic of Yugoslavia. The first multiparty elections in Montenegro took place in 1990 following the period of the one-party system, which had been in force after the Second World War. There were three main principles in the legal system, in relation to the Federal State of Yugoslavia and constituent Republics, as well as in relation to Serbia and Montenegro within the new State. The first was a principle of “double track” in the implementation of laws: (federal authorities execute federal law, and Republican authorities execute the laws of the Republic). The second principle was a presumption of power in favour of the Republics (Serbia and Montenegro). The third principle was the possibility of delegating the power from constituent Republics to the Federal State. These were the main features of the period after dissolution of the former Yugoslavia, and means that the competence of the Federal Administration was limited only to the fields that were explicitly envisaged by the Federal Constitution.

    Kurzfassung: As with other policies offering lower prices to at least some buyers, loyalty and fidelity discounts are generally pro-competitive and beneficial to consumers even though they may harm certain competitors. Potential problems exist, however, when such discounts are employed in ways that reduce price transparency, exclude or restrict a significant number of actual or potential competitors, or raise the probability of anticompetitive co-ordination. The sometimes complex pro- and anti-competitive effects of loyalty and fidelity discounts are explored in the executive summary, background paper and summary of discussion pertaining to a June 2002 OECD Competition Committee roundtable discussion of the topic. While these documents reveal some interesting policy differences among various members of the Competition Committee, they also point to general agreement that loyalty and fidelity discounts are more likely to raise competition concerns when practised by firms enjoying substantial market power.

    Kurzfassung: After the parliamentary elections, Viktor Orbán, leader of the FIDESZ-Magyar Polgári Párt (Alliance of Young Democrats-Hungarian Civic Party), received a mandate from the president of the republic to form a government and to submit his government programme to parliament. He was elected by parliament as prime minister in June 1998. The new government is composed of the prime minister and 17 ministers. Of the latter, 12 were nominated by FIDESZ-MPP, four represent the Independent Small-Holders’ Party, and one was proposed by the third coalition partner, the Hungarian Democratic Forum. The new coalition has an absolute majority in parliament (with some 55 per cent of the seats). The next regular parliamentary elections are scheduled for spring 2002. The president of the republic is Árpád Göncz. In 1995, he was re-elected by parliament for a five-year term of office. Parliament has approved the new government programme for the next four years. Its priorities include the development of the social state; the maintenance of citizens’ security in all spheres of life; and the fostering of economic growth.

It finds that Canada has a mature, effective and innovative system of regulatory governance closely linked to the government’s public policy goals. This is a demanding agenda: in international trade – a major driver of the economy – Canada needs to maintain a careful balance between bilateral and multilateral liberalisation efforts. Further work is needed to improve the effectiveness of the single internal market. Competition policy needs to make a much stronger contribution to regulatory reform and market openness. Despite a positive policy shift, some important sectors are protected through import and foreign ownership restrictions. The recently launched government’s Innovation Strategy is expected to make a major contribution to address these challenges.

    Kurzfassung: Natural gas is a key source of energy for OECD countries, both in its own right and as an input into the production of electricity. Regulatory reform in this sector shares both important similarities and important differences with regulatory reform in other network industries. Like other network industries, regulatory reform in natural gas involves promoting competition in the competitive segments of the industry (particularly competition between gas producers), the development of a robust regime for access to the remaining essential facilities, and structural separation between the competitive and non-competitive segments of the industry. OECD countries have pursued each of these steps, licensing independent producers, pricing access to pipeline infrastructure and separating gas production from transportation (although long-term take-or-pay contracts make this last reform more difficult). Unlike other network industries, however, the structure of the industry varies widely from country to country according to the number of domestic gas producers, the geographic location of pipelines and the uses to which natural gas is put. Countries which rely primarily on imported gas have less to gain from domestic reform and much to gain from reform in producing countries. As OECD gas sources diminish and reliance on imports increases, regulatory reform in natural gas will increasingly become an issue for international trade.

    Kurzfassung: In the context of conglomerate merger review, portfolio effects seem to refer to the pro- and anti-competitive effects possibly arising when: the parties enjoy market power but not necessarily dominance; and the products joined are complementary or have analogous properties. When complementary products are merged, there is a potential for considerable synergies that could benefit buyers. There is also an increased potential for forced tying, pure bundling, or analogous practices (e.g. full line forcing) that could restrict buyer choice but also lower prices. Under certain strict conditions, consumers could gain in the short run but suffer long term harm from such practices if they eventually result in a sufficient reduction of competitors and capacity in a market. The hypothetical nature of such harm has led some to conclude that instead of prohibiting mergers having potentially harmful portfolio effects, competition agencies should instead take a wait and see attitude. That would involve using abuse of dominance or monopolisation prohibitions to control negative effects should they actually materialise.

The review finds that the United Kingdom presents a stimulating contrast of tradition and modernity, which is reflected in a mature and innovative regulatory system. The broad sweep of its reforms is impressive. Continuous reforms of the regulatory management system, the competition policy and law as well as in the regulatory regimes of key economic sectors are a strong basis for ensuring high quality regulation contributing further to drive economic performance. The UK was early in liberalising its public utilities and in developing new regulatory approaches to the complex problems of managing the network industries. It was also among the first countries to introduce a system of regulatory impact assessment, which, along with competition policy and law, has been continuously updated since. It has a reputation for having a regulatory environment that is among the most supportive of market openness and global competition in the world. The UK now faces challenges typical of a mature regulatory regime at the cutting edge of developments. Complexity and diversity - of regulatory objectives, of the institutional architecture and of procedures - are major issues to be continuously monitored. Building on these efforts and continuing to address regulatory challenges and areas of weaknesses will permit the UK to maintain itself as a leader in regulatory governance.

    Kurzfassung: The pharmaceutical sector is a dynamic, research-intensive industry that is fundamentally influenced by a web of regulations designed to a) promote research and innovation in the design and production of drugs, b) protect consumers from potentially harmful effects of drugs, and c) to control public and private expenditure on drugs. These objectives are sometimes in conflict and may require a balancing of the interests of producers and consumers. Since most consumers have some form of health insurance, their incentives to control their purchasers of pharmaceuticals or to purchase from the most efficient pharmacist are limited. Health insurers seek to control pharmaceutial expenditure through various policies such as co-payments, lists of approved drugs and maximum reimbursement levels for different drugs. If reimbursement levels for pharmacists are set at a national or regional level, incentives for entry by new pharmacists are excessive in certain locations, typically leading to restrictions on the establishment of new pharmacies. Wellthought out reform of this industry has the potential to reduce pharmaceutical expenditures while maintaining the quality of the drugs consumed.

    Kurzfassung: The SIGMA Paper is drawn from a report on relations between Supreme Audit Institutions and parliamentary committees, prepared for the network of Presidents of the Supreme Audit Institutions of Central and Eastern Countries, Cyprus, Malta and the European Court of Auditors, as part of their efforts to prepare candidate countries for eventual membership of the European Union. It was written primarily for use by those organisations but SIGMA does believe it also has wider interest. The principal contributors of this paper were the Supreme Chamber of Control of Poland and the National Audit Office of Malta, represented by Jacek Mazur and Brian Vella respectively; supported by Jan Pieter Lingen and Chris Kok from the European Court of Auditors; SIGMA expert Harry Havens; former SIGMA staffer Bo Sandberg; and SIGMA staffer Nick Treen. Participating in the work of the liaison officers were the Supreme Audit Institutions of Albania, Bulgaria, Croatia, Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland, Romania, the Slovak Republic and Slovenia who all supplied valuable data to provide the basis of the report. In addition, the report incorporated material prepared by the Supreme Audit Institutions of Canada, Denmark, Ireland, Israel, the Netherlands, Norway, Portugal, UK, the European Court of Auditors; and SIGMA.

    Kurzfassung: OECD governments are in search of results. Improved performance of the public sector is a central factor in maintaining welfare of individuals and the competitiveness of the economy. A results focus promotes accountability and is a key element in creating and maintaining confidence in government. Performance management is the key aspect of public sector reforms of many OECD Member countries. Performance management encompasses a set of reforms under which public organisations are given increased managerial autonomy in exchange for accountability for results. They are required to define objectives and targets, and measure and report actual results. Performance information is used to improve public priority setting and programmes. Relationships within the public sector and between the government and the public are based on clearer accountability for performance. This publication describes and analyses performance management developments in ten OECD countries: Australia, Canada, Denmark, Finland, France, the Netherlands, New Zealand, Sweden, the United Kingdom and the United States. It demonstrates that while a wide range of approaches and instruments has been developed there is considerable convergence in the way they are used.

It finds that since 1990, the Czech Republic has carried out a comprehensive transition to a market democracy that required a rapid and broad programme of deregulation, re-regulation, and institution-building. Today, the legal and policy frameworks consistent with a market economy are substantially in place and functioning. Important challenges remain, however, and reform to fill the remaining gaps and further refine regulatory regimes at national and subnational levels will continue to play a central role in economic development in the Czech Republic. Privatisation, restructuring, and building pro-competition regulatory regimes have been delayed in key areas, such as energy, and reform in telecommunications should be completed. Public sector reform should continue. Speed and consistency are essential. If the Czech Republic is to converge with the rest of Europe, it must move faster than the average European country.

    Kurzfassung: OECD's 2001 review of regulatory reform in Ireland. It finds that regulatory reform in Ireland began later than in many countries, but is now moving ahead on a broad front. Following Ireland’s remarkable economic performance in the 1990s, regulatory reform is helping to manage the consequences of fast growth and to sustain growth into the future. Reform is opening up important infrastructure and policy bottlenecks to further growth, promoting efficiency improvements that can help manage inflation, and establishing a more competitive and flexible economy that can innovate, adapt and prosper as the sources of its current prosperity change. Yet the reform agenda is still long. Bottlenecks in physical infrastructure are constraining growth, as are labour shortages, and public sector capacities. Weak competition in key sectors is a risk to future performance. While recognising the substantial progress made in recent years, this report calls for a more coherent and determined approach to regulatory reform. This review presents an integrated assessment of regulatory reform in framework areas such as the quality of the public sector, competition policy and enforcement, and market openness. It also contains chapters on sectors such as telecommunications, electricity, gas, pharmacies and legal services, and an assessment of the macroeconomic context for reform. The policy recommendations present a balanced plan of action for both short and longer term based on best international regulatory practices.

    Kurzfassung: Central and eastern European countries have been and still are adapting their legal framework to the requirements of a Western market economy and the body of EU legislation, the acquis communautaire. As the harmonisation of the national legal framework to EU standards is one of the yardsticks for EU accession, most candidate countries have drafted and adopted new legislation under enormous time pressure. Sub-optimal solutions, unforeseen implementation costs and unintended side effects were unavoidable. In many cases new legislation has proved impossible to implement. This experience has led candidate countries and other transition countries to develop an interest in impact assessment. EU Member States introduced impact assessment for legal programmes about two decades ago, based on the experience that new legislation may have a considerable and sometimes unexpected, impact not only on the budget, but also on various parts of the economy and society as a whole. Today, there is an acceptance among EU Member States that some kind of impact assessment exercise should be conducted before legislative changes are introduced. Although the comprehensiveness of a particular impact assessment exercise depends on a variety of factors, e.g. the importance of the policy issue or the commitment of the respective government, the basic aim is to enhance the quality of government decision-making. Establishing or improving the administrative capacity to carry out impact assessments is crucial for both in order to provide the government with the necessary information to take informed decisions on policy options and to improve the quality of new legislation. Even applying only the basic principles of impact assessment can often avoid the necessity for immediate amendments or redrafting. This publication deals with impact assessment in a wide sense, including policy analysis (impact assessment for choosing the instrument), assessment of a policy instrument during the drafting stage and evaluation of existing laws or programmes. Special emphasis is given to impact assessment during drafting.

    Kurzfassung: OECD's 2001 review of regulatory reform in Italy. It finds that starting later than many countries, Italy devoted the 1990s to "catching up" with the leading OECD countries in economic and governance reforms. The scope, speed and consistency of structural reforms by multiple governments were remarkable. Accumulated rigidities and practices of decades were re-assessed, and many rejected. Awareness of the excessive role of the state in the economy led to broad policy and institutional changes in favour of transparency, public sector efficiency, and market competition. By 1999, Italy’s privatisation programme was among the largest in the OECD. Reform of Italy’s regulatory state is a formidable task, but early results, such as reduced red tape and stronger accountability of the public service, are appearing. Yet, enhancing the growth potential of the Italian economy -- following years of comparatively slow growth, relatively high inflation, low foreign direct investment, and a declining market share in world trade -- justifies faster and deeper regulatory reform to address the substantial reform agenda still outstanding. Long-standing income gaps between north and south could be narrowed by revitalised domestic markets. Better regulatory practices are particularly needed at regional and local levels, whose decisions increasingly decide Italy’s future. This review presents an integrated assessment of regulatory reform in framework areas such as the quality of the public sector, competition policy and enforcement, and market openness. It also contains chapters on sectors such as telecommunications, electricity, and railways, and an assessment of the macroeconomic context for reform.     Kurzfassung: The Guidelines for Consumer Protection in the Context of Electronic Commerce are designed to help ensure that consumers are no less protected when shopping on line than they are when they buy from their local store or order from a catalogue. By setting out the core characteristics of effective consumer protection for online business-to-consumer transactions, the Guidelines are intended to help eliminate some of the uncertainties that both consumers and businesses encounter when buying and selling on line. The Guidelines reflect existing legal protections available to consumers in more traditional forms of commerce. Their aim is to encourage: - fair business, advertising and marketing practices; - clear information about an online business’s identity, the goods or services it offers and the terms and conditions of any transaction; - a transparent process for the confirmation of transactions; - secure payment mechanisms; - fair, timely and affordable dispute resolution and redress; - privacy protection; and - consumer and business education.
