    Kurzfassung: The rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions. This book provides a valuable contribution to the fields of international, constitutional and administrative law scholarship as the three interact in cyberspace. The respective chapters cover topics such as the notion of digital states and digital sovereignty, jurisdiction over the Internet, e-government, and artificial intelligence. The authors are eminent scholars and international experts with a profound knowledge of these topics. Particular attention is paid to the areas of digital democracy, digital media and regulation of the digital world. The approach employed is based on a comparative perspective from Germany, the Netherlands, Italy, Portugal and Brazil. One particular focus is on how various legal systems are coping with increasing difficulties in the exercise of democracy with regard to disinformation and hate speech. The roles of legislators, the judicial system and public administrations are analysed in the light of the latest cases, conflicts and technologies. In addition to this comparative approach, the book explores the evolution of rule of law in cyberspace and the upcoming new legal regimes in the European Union and Brazil. Special care is taken to offer a critical review of both the literature and the latest legal solutions adopted and being considered regarding the regulation of cyberspace from a constitutional and administrative perspective. Given its scope, the book will be of interest to researchers and scholars in the field of digital law whose work involves constitutional problems in cyberspace and/or practical problems concerning the regulation of social networks and online commerce.

    Kurzfassung: Wenigen anderen Ethnologen in der Bundesrepublik Deutschland war es vergönnt, so wie Rüdiger Schott durch eigene Aktivitäten als individuelle Forscherpersönlichkeit maßgebend zum Aufbau und Ausbau ihrer Disziplin beizutragen. Dieser Umstand verdankt sich einerseits den von ihm seit den 60er Jahren durchgeführten Feldforschungen bei den Bulsa in Nordghana und den in den 80er Jahren angestellten ethnographischen Erhebungen bei den Lyela in Burkina Faso (vormals: Obervolta), die ihm internationale Reputation und hohe wissenschaftliche Anerkennung eingetragen haben, andererseits der permanenten Umsetzung der erreichten Forschungsergebnisse in die akademische Lehre und in weitere Forschungen, die heute als beispielhaft gelten.
    Kurzfassung: Nicht von ungefähr gehört das Seminar für Völkerkunde der Universität Münster, das von Rüdiger Schott begründet wurde und im April 1990 auf sein 25jähriges Bestehen zurückblicken konnte, gegenwärtig zu den auch im Ausland wohlbekannten deutschen Forschungsstätten seines Fachgebiets. Dies ist nicht zuletzt deswegen der Fall, weil Schott von Anbeginn seine ethnologischen Forschungen in ständigem Austausch mit einer Reihe benachbarter Disziplinen, insbesondere mit den sozialen Handlungswissenschaften betrieben hat, wie beispielsweise mit den Wirtschaftswissenschaften und der Soziologie, der Rechtswissenschaft und den Religionswissenschaften.
    Kurzfassung: Seine Befähigung und bis auf den heutigen Tag praktizierte Bereitschaft zur Kooperation mit diesen Nachbardisziplinen basiert auf der Einsicht, daß die Ethnologie ihre eigene Identität nur gewinnen und fortentwickeln kann, wenn sie sich auch auf der Ebene der Ausbildung ihrer analytischen Denkansätze und Grundbegriffe hierfür hinreichend kontaktfähig hält. Was Person, Leben und Werk von Rüdiger Schott angeht, so sind die äußeren Rahmendaten seines bisherigen Forscher- und Universitätslebens rasch berichtet. Jedoch wird eine auf die Forschungsinhalte und die erzielten Ergebnisse gerichtete Analyse den von ihm vorgelegten Resultaten kaum gerecht, wenn sie sich nur auf deren Relevanz für die Ethnologie als solche beschränken wollte.

    Kurzfassung: This book explores the constitutional, legally binding dimension to legisprudence in the light of the German Federal Constitutional Court´s approach to rational lawmaking. Over the last decades this court has been remarkably active in applying legisprudential criteria and standards when reviewing parliamentary laws. It has thus supplied observers with a unique material to analyse the lawmakers’ duty to legislate rationally, and to assess the virtues and drawbacks of this strand of judicial control in a constitutional democracy. By bringing together legislation experts and public law scholars to elaborate on ‘legisprudence under review’, this contributed volume aspires to shed light on the constitutionalisation of rational lawmaking as a controversial trend gaining ground in both national and international jurisdictions. The book is divided into five parts. Part I frames the two key issues pervading the whole collection: the intricate relationship between judicial review and democracy, on the one hand, and the possibility of improving and rationalizing the task of legislation under the current circumstances of politics, on the other. Part II provides an overview of the judicial review of rational lawmaking, laying special emphasis on the duty of legislative justification imposed on lawmakers by the German Constitutional Court. Part III is devoted to the review of the systemic rationality of legislation, in particular to the requirements of legislative consistence and coherence as developed by this court. Contributions in Part IV revolve around the judicial scrutiny of the socio-empirical elements of rational lawmaking, with the control of legislative facts and impacts and the problem of symbolic laws being the central topics. Finally, Part V draws on the German case law to discuss the links between rational lawmaking, balancing and proportionality, and the interdependence between process review and substantive review of legislation.

    Kurzfassung: This volume presents philosophical contributions examining questions of the grounding and justification of taxation and different types of taxes such as inheritance, wealth, consumption or income tax in relation to justice and the concept of a just society. The chapters cover the different levels at which the discussion on taxation and justice takes place: On the principal level, chapters investigate the justification and grounding of taxation as such and the role taxation plays and should play in the design of justice, be it for a just society or a just world order. On a more concrete level, chapters present discussions of these general reflections in more depth and examine different types of taxation, tax systems and their design and implementation. On an applied level, chapters discuss certain specific taxes, such as wealth and inheritance taxes, and examine whether or not a certain tax should be favored and for what reasons as well as why it is just to target certain kinds of assets or income. Recently, organizations engaged in legal development activities have begun to pay greater attention to the implications of local, informal, indigenous, religious, and village courts or tribunals, which often are more efficacious than state legal institutions, especially in rural communities. Legal pluralism is the term applied to these situations because these institutions exist alongside official state legal systems, usually in a complex or uncertain relationship. Although academics, especially legal anthropologists and sociologists, have discussed legal pluralism for decades, their work has not been consulted in the development context. Similarly, academics have failed to benefit from the insights of development practitioners. This book brings together, in a single volume, contributions from academics and practitioners to explore the implications of legal pluralism for legal development. All of the practitioners have extensive experience in development projects, the academics come from a variety of backgrounds, and most have written extensively on legal pluralism and on development"--

    Kurzfassung: Hauptbeschreibung Auf diesen Seiten dokumentieren sich eine Arbeit für die Philosophie des Rechts, für die Reflexion der modernen Gesellschaft, die Theorie der Sprache und ein Annähern an das Rätsel der Zeit. Syntagma bringt im Ersten Buch eine Theorie von Rechtsbegriff und Rechtstext, von begründeter Entscheidung statt Dezision. Im Zweiten Buch eine Theorie der modernen Gesellschaft, der sie durchziehenden Kämpfe, des Staats der europäischen Neuzeit und seiner Verfassung mit ihrem Muster von Spaltung und Widerspruch. Im Dritten Buch folgt ein Erörtern der Sprache am Leitfaden der Sprache des Rechts. Das Vierte Buch schließt, als Metatheorie zu dem, was die Reflexion in den drei ersten immanent antreibt, mit einer Phänomenologie von Zeit, die in einer Trias von Zeitbegriffen entfaltet wird. Recht erscheint als Sprache und ereignet sich in Zeit. Statt das nur über Recht und Verfassung zu sagen, wird dieser Grundsachverhalt hier immanent durchgespielt: von einer realistischen Theorie, deren Radikalität in eben dieser Immanenz besteht. Zeit des Rechts, Zeit der Gesellschaft, Zeit der Sprache. Zeit der Menschen. Im Umkreisen dieser Gravitationszentren wird eine Fülle alter und neuer Probleme aufgeklärt, jeweils mit historischen und aktuellen Beispielen. So etwa die Formen und Rollen der Vorverständnisse, Ereignis und Situation, Recht und Sprache als Handeln. Dann der Anspruch von materialem Rechtsstaat und materialer Demokratie in einer inhaltlich bestimmten Republik und die lebenswichtige Rolle der (trans)nationalen Menschen- und Bürgerrechte unter der Herrschaft real existierender Oligarchien. Ferner das zentrale Problem der Gerechtigkeit und das elementare Bedürfnis nach Naturrecht, das auf heutigem Stand positivrechtlich erfüllt werden kann.     Kurzfassung: haltbar - wird realistisch aufgelöst. Ein Juridischer Imperativ wird formuliert und die Arbeitsethik der Rechtsarbeiter als entscheidend herausgestellt. Ein Zentrum aller Analysen bildet das Urphänomen der Gewalt - gesellschaftlicher, rechtlicher und auch sprachlicher: Gewalt in Sprache und durch Sprache, einschließlich der Massenmedien, des öffentlichen Sprachgebrauchs, der Spielarten von Ideologie, des differenten Status von Meinung, Argument und Normtext beim Formulieren von Gründen. Dazu gehören auch die Rolle der Intellektuellen und die Position der Wissenschaft. Durch die sukzessiven Reduktionen von Demokratie, durch latenten Bürgerkrieg in Form eines Sozialkampfs von oben werden, zusammen mit oligarchischer Dominanz, Leistungsgrenzen des Verfassungsstaats greifbar. Dem bellum omnium contra omnes vor dem Verfassungstaat wird der Krieg der Wenigen gegen die Meisten im Verfassungsstaat als Gegenstand der Analyse angefügt. Zusammen mit Rechtsdogmatik und Rechtslinguistik ergibt sich das Ensemble einer materialen Politischen Rechtslehre, das auch Zeugnis ablegt. Zeugnis von einem wissenschaftlichen Weg und einem Engagement - »politisch« im Sinn von: auf die Polis bezogen. Auf die Polis, für deren Verfassung (Syntagma) ihre Mitglieder kämpfen sollten wie für die Stadtmauer. Es gibt kein Ganzes, das vorgegeben und aus dem zu deduzieren wäre.
