    Abstract: "The first major catalogue of contemporary Black American collage, Multiplicity: Blackness in Contemporary American Art brings together over sixty-five works of art by fifty artists that reflect the breadth and complexity of Black identity. Rather than casting their work solely in terms of a racial discourse that often portrays African Americans as a monolith, these artists employ collage to convey the intersecting facets of their lived experiences that combine to make whole individuals. Building on a technique that has roots in European and American traditions-used by canonical figures from Picasso and Hannah Höch to Robert Rauschenberg and Romare Bearden-the artists have assembled pieces of paper, photographs, fabrics, and other often salvaged materials to create unified compositions that express the endless possibilities of Black-constructed narratives despite the fragmentation of our times. As artist Deborah Roberts asserts, "With collage, I can create a more expansive and inclusive view of the Black cultural experience."     Abstract: This book presents the results of an international comparative study on the causes of rule deviation in business and medical organizations. Based on document and interview analyses as well as experiments, the discrepancy between (state) regulations and organizational practice is elaborated and discussed in an interdisciplinary perspective.     Abstract: "Through what strategies might contemporary artists confront cultural assumptions about race? In what ways can the devices that make race feel familiar-such as stereotypes or strategic essentialism-be used to make race feel unfamiliar? What new perspectives might emerge out of such disorienting confrontations? In The Racial Unfamiliar, John Brooks argues that twenty-first-century African American artists have turned to abstractionist aesthetics to complicate and illuminate how we think and see race. Brooks shows that established categories of cultural production-such as "African American art" or "Black history"-reproduce familiar but confining ideas about race, and that some audiences assume such ideas reflect a "truth" about Black identity or Black experience in the United States. Instead of countering representations of race with "authentic" portrayals of African American identity and experience, recent artists have begun exaggerating and overemphasizing them. By inflating and abstracting clichéd representations and stereotypes, these artists expose the incongruities that underlie racist attitudes and refute the idea that any single African American experience exists to be represented. Through the production of illegible misrepresentations of a multitude of black experiences, the literary and visual works considered in this book insist that blackness exceeds categorical representation. Brooks traces the disorienting effects of this experimental aesthetic through a broad array of recent artworks, from novels and plays by Percival Everett and Suzan-Lori Parks to photography by Roy DeCarava and installation art by Kara Walker, to show how contemporary African American cultural production can be understood as an operation in abstracting and upending the cultural determinants that make racial Blackness intelligible"--

    Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: "The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation.     Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Mit einer solchen föderalen Sichtweise lassen sich dogmatische Figuren, über die Anwendungsbereiche, Kontrollmaßstäbe und -intensität definiert werden, als Ausdruck der institutionellen Strukturen und der Interaktion der beteiligten Gerichte begreifen. Praktischer Ertrag der Forschung sind Vorschläge, die Gerichten in Mehrebenen-Strukturen Orientierung bieten können, vor allem angesichts der aktuellen Herausforderungen, mit denen der Grundrechtsschutz in Europa konfrontiert ist.

    Abstract: For decades, artists and architects have struggled to relate to the Holocaust in visual form, resulting in memorials that feature a diversity of aesthetic strategies. In 'Memory Passages', Natasha Goldman analyzes both previously-overlooked and internationally-recognized Holocaust memorials in the United States and Germany from the postwar period to the present, drawing on many historical documents for the first time. From the perspectives of visual culture and art history, the book examines changing attitudes toward the Holocaust and the artistic choices that respond to it.The book introduces lesser-known sculptures, such as Nathan Rapoport's 'Monument to the Six Million Jewish Martyrs' in Philadelphia, as well as internationally-acclaimed works, such as Peter Eisenman's 'Memorial to the Murdered Jews of Europe' in Berlin. Other artists examined include Will Lammert, Richard Serra, Joel Shapiro, Gerson Fehrenbach, Margit Kahl, and Andy Goldsworthy. Archival documents and interviews with commissioners, survivors, and artists reveal the conversations and decisions that have shaped Holocaust memorials.     Abstract: Krisen werden regelmäßig als Ausnahmen wahrgenommen. Dies erklärt auch, warum sich die rechtliche Auseinandersetzung mit Krisen auf Notstandskonzepte konzentriert. Gleichzeitig hat der Ausnahmezustand im Sinne Carl Schmitts Konjunktur, um bestimmte Krisenphänomene zu erklären. Zu diesen Phänomenen gehört, dass sich das Verständnis und damit der Inhalt bestehender Rechtsnormen in Krisen wandelt. Diese Auslegungsänderungen, häufig auch als Rechtsbrüche angeprangert, werden vor allem durch nichtrechtliche Einflüsse erklärt. Jasper Finke hingegen versteht Auslegungsänderungen in Krisenzeiten als Teil des Rechts. Ausgangspunkt hierfür ist ein Krisenverständnis, für das der Begriff der Erwartung zentral ist. Bei Krisen handelt es sich um Anpassungsprozesse dieser zunächst enttäuschten Erwartungen. Als Normalitätserwartung sind sie aber auch Bestandteil der Auslegung einer Norm. Ändern sich die Erwartungen, spiegelt sich dies im Inhalt der Norm wider.
    Abstract: Conceptualizing crises as part of the normality-exception dichotomy turns a blind eye to the long-term effects of crises, especially the impact they have on the meaning of existing legislation. Jasper Finke reveals why changing interpretations in response to a crisis are to be understood as a process that is inherent to law and not something that is imposed on law.

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Abstract: "TECHNOCRATS OF THE IMAGINATION traces the rise of collaborative art and technology labs in the U.S. from WWII to the present. Ryan Bishop and John Beck reveal the intertwined histories of the avant-garde art movement and the military-industrial complex, showing how radical pedagogical practices traveled from Germany's Bauhaus movement to the U.S. art world and interacted with government-funded military research and development in university laboratories. During the 1960s both media labs and studio labs leaned heavily on methods of interdisciplinary collaboration and the power of American modernity to model new modes of social organization. The book's chapters take up MIT's Center for Art, Science, and Technology, Bell Labs's E.A.T. (Experiments in Art and Technology) Salon, and Los Angeles Museum of Art's Art + Technology Program. Their interconnected history illuminates how much of contemporary media culture and aesthetics depends on the historical relationship between military, corporate, and university actors. In light of revived interest in Black Mountain College and other 1960s art and technology labs, this book draws important connections between the contemporary art world and the militarized lab model of research that has dominated the sciences since the 1950s. The authors situate the rise of collaborative art and technology projects in the 1960s within John Dewey's ideology of scientific democracy, showing how leading thinkers from the Bauhaus movement in Germany immigrated to the U.S. and brought with them a Deweyan model for collaborative and interdisciplinary art and technology research. Over the course of the decade, the U.S. government increased funding to scientific research at university and private laboratories. Beck and Bishop investigate how various art and technology projects incorporated the collaborative and innovative interdisciplinarity of the avant-garde art movement with the corporate funding structure driven by the U.S. government's military and technoscientific interests. Finally, the authors consider the legacy of 1960s art and technology projects. During the 1970s and 80s, defense R&D funding was less motivated by a Cold War corporate state, and was instead restructured according to an entrepreneurial and neoliberal model.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress.     Abstract: "This book explores how religious doubt is made manifest in the built environment by taking seriously the humorous, satirical, blasphemous, and popular culture responses to religious architecture and image in modern America. It challenges how audiences typically consider religious architecture by shifting the focus from believers to doubters and from architectural producers to architectural consumers. Its chapters explore landscapes of doubt created by "Touchdown Jesus" at the University of Notre Dame in Indiana; the Mormon temple outside Washington, D.C., recast as something from The Wizard of Oz; Jerry Falwell's waterslide plunge photograph and The Simpson's "Praiseland" episode satirizing Jim and Tammy Faye Bakker's Heritage USA evangelical theme park in South Carolina; the doctored photograph making fun of Oral Roberts's claim of seeing a 900-foot Jesus at Oral Roberts University in Tulsa, Oklahoma; MAD magazine's "Charles Darwin's Night at the Creation Museum" parody of the Creation Museum in Kentucky; and the "Gumby Jesus" renaming of the Christ of the Ozarks statue in Eureka Springs, Arkansas.     Abstract: "This book compares the rights and social inclusion of two racialized minority groups: Roma in Central and Southeast Europe ("CSEE") and African Americans in the United States ("U.S."), primarily in the American South. We couch those attempts loosely in the frameworks of Roma rights and civil rights, though we will focus primarily on Roma rights in post-Communist CSEE (from 1991 until the present) and civil rights during the U.S. Civil Rights Movement (roughly 1954-1968). Scholars have made fleeting comparisons between Roma and African Americans for years, and in the last decade, the Roma rights-Civil Rights comparison has recurred with increasing frequency.     Abstract: Tell Me Your Story' starts with the Harlem Renaissance. Harlem in the 1920s saw a flurry of activity by African American authors, musicians and theatre makers, resulting in a vibrant visual arts scene. Black culture is currently enjoying another renaissance, and African American artists are more visible than ever in the United States. The exhibition places contemporary artists in the context of their predecessors.00'Tell Me Your Story' focuses on five chronological periods: the Harlem Renaissance, Post Harlem Renaissance, Civil Rights, Black Renaissance and the Bloom Generation. The artists in each of these distinct periods shared one common characteristic: the need to express themselves and safeguard the vital African tradition of storytelling.00The exhibition is being organised as part of Kunsthal KAdE's 2020 trilogy on the United States, inspired by the upcoming presidential election on 3 November. This is a key moment in a politically and socially polarised nation. Over the course of the elections KAdE will be holding a presentation exploring the role of artists in the current US environment.
