    Abstract: Klappentext: Populistische und autoritäre politische Bewegungen fordern derzeit weltweit das Ordnungsmodell der rechtsstaatlichen und freiheitlichen Demokratie heraus. Demokratie und Rechtsstaatlichkeit befinden sich nach einer verbreiteten Ansicht in der Defensive, in der Krise. Damit ist die Frage nach der Autorität des Rechts und der Stabilität des Rechtsstaats auf die Tagesordnung der Rechtsphilosophie zurückgekehrt. Was macht die Autorität des Rechts aus, wie lässt sich Rechtsstaatlichkeit bewahren oder wiedergewinnen, und wie lassen sich Demokratie und Rechtsstaat gegen die Versuchungen des Autoritarismus immunisieren? Mit diesen grundlegenden Fragen befasste sich die Tagung der Deutschen Sektion der Internationalen Vereinigung für Rechts- und Sozialphilosophie (IVR) im Juni des Jahres 2022 an der Ludwig-Maximilians-Universität in München, deren Vorträge nun in diesem Band in schriftlicher Form vorliegen.

    Abstract: In einem Bundesstaat wie der Bundesrepublik Deutschland wirken die Länder bei den wesentlichen staatlichen Aufgaben mit. Aus diesem Grund werden die Richter des Bundesverfassungsgerichts von beiden Gesetzgebungskörperschaften gewählt. Die Richterwahlen erlangen so, aber auch wegen der besonderen Rolle des Gerichts, eine besondere Bedeutung und politische Dimension. In der Vergangenheit stand regelmäßig die demokratische Legitimation durch den Bundestag im Mittelpunkt der Diskussion. Sofern das Verfahren im Bundesrat in den Blick geriet, dann meist verbunden mit der These, dass die durch ihn vermittelte, stärker auf das bundesstaatliche Prinzip gestützte Legitimation geringerwertig sei. Ausgehend von der Rolle des Bundesrates und seiner gewaltenteilenden Funktion, u.a. als systematisches Gegengewicht zu dem Bundestag als der zweiten Gesetzgebungskörperschaft, werden in dieser Untersuchung die grundgesetzlichen Anforderungen an die Legitimation und die durch den Bundesrat als Vertretung der Länder im Wahlverfahren vermittelte Legitimation näher beleuchtet. Ein abschließend unterbreiteter Vorschlag zur Reform des Wahlverfahrens stellt im Kern auf eine stärkere Verfahrenstransparenz durch eine öffentliche Ausschreibung ab. Dies bedeutet einen Paradigmenwechsel in der von Vorschlagsrechten geprägten deutschen Tradition bei der Besetzung höchster Staatsämter. Die Autorin Referentin im Hessischen Ministerium des Innern und für Sport im Bereich des finanziellen Dienstrechts.

    Abstract: The rule of law in cyberspace currently faces serious challenges. From the democratic system to the exercise of fundamental rights, the Internet has raised a host of new issues for classic legal institutions. This book provides a valuable contribution to the fields of international, constitutional and administrative law scholarship as the three interact in cyberspace. The respective chapters cover topics such as the notion of digital states and digital sovereignty, jurisdiction over the Internet, e-government, and artificial intelligence. The authors are eminent scholars and international experts with a profound knowledge of these topics. Particular attention is paid to the areas of digital democracy, digital media and regulation of the digital world. The approach employed is based on a comparative perspective from Germany, the Netherlands, Italy, Portugal and Brazil. One particular focus is on how various legal systems are coping with increasing difficulties in the exercise of democracy with regard to disinformation and hate speech. The roles of legislators, the judicial system and public administrations are analysed in the light of the latest cases, conflicts and technologies. In addition to this comparative approach, the book explores the evolution of rule of law in cyberspace and the upcoming new legal regimes in the European Union and Brazil. Special care is taken to offer a critical review of both the literature and the latest legal solutions adopted and being considered regarding the regulation of cyberspace from a constitutional and administrative perspective. Given its scope, the book will be of interest to researchers and scholars in the field of digital law whose work involves constitutional problems in cyberspace and/or practical problems concerning the regulation of social networks and online commerce.

    Abstract: Im Gegensatz zum deutschen Gesetzgeber erkannten das europäische und internationale Recht früh, dass die Öffentlichkeit bei Entscheidungen über die Planung und Genehmigung von Infrastrukturprojekten beteiligt werden müsse. Die Auswirkungen dieses Trends sind auch in Deutschland mittlerweile unübersehbar. Zahlreiche Vorschriften bedingen die frühe oder allgemeine Beteiligung der Öffentlichkeit. Fehlende Beteiligungen können vor den Verwaltungsgerichten gerügt werden. Vor dem Hintergrund dieser Entwicklungen wirft Birgit Peters die Frage auf, ob die durch internationale wie europäische Normen begründete Mitwirkung der Öffentlichkeit das demokratische Fundament des Verwaltungsverfahrens beeinflusst. Ermöglicht die Teilhabe der Öffentlichkeit demokratische Mitbestimmung im Sinne des Grundgesetzes? Und wenn ja, inwieweit? Die Autorin unterzieht das herrschende Demokratieverständnis einer kritischen Prüfung und zeigt auf, ob und wie im internationalen und europäischen Recht verankerte Beteiligungsrechte in die Demokratiekonzeption des Grundgesetzes miteinbezogen werden können.
    Abstract: Today, decisions about large infrastructure projects cannot be made without the participation of the public. This trend has its roots in modern international environmental law and has had a deep impact on national perceptions of public participation. Birgit Peters investigates how internationalised and Europeanised public participation affects the German constitutional perception of democracy and shows how international and European rights to participate in environmental decision-making could be incorporated into the German conception of representative democracy.

    Abstract: Der modernen Demokratie werden derzeit gleichermaßen expertokratische wie auch populistische Tendenzen attestiert. Ähnliches gilt für das Recht. Dies macht deutlich, dass weder in einem zu ausgeprägten Vertrauen in Experten noch in einer Abwendung bzw. Ausblendung von Expertenwissen ein gangbarer Weg für moderne Demokratien liegt. Vor diesem Hintergrund muss der Frage nachgegangen werden, wie Entscheidungen vollständig informiert, zugleich aber demokratisch legitimiert getroffen werden können. Laura Münkler erforscht, auf welche Weise es gelingen kann, wissensbasiert und demokratisch zu entscheiden und dabei weder populistischen noch expertokratischen Neigungen zu erliegen. Sie untersucht, wie eine funktional sinnvolle Beteiligung von Experten an hoheitlicher Entscheidungsfindung stattfinden kann und welche institutionellen Vorkehrungen hierfür zu treffen sind.

    Abstract: Scholars, journalists, and politicians today worry that the world's democracies are facing a crisis of legitimacy. Although there are key challenges facing democracy-including concerns about electoral interference, adherence to the rule of law, and the freedom of the press-it is not clear that these difficulties threaten political legitimacy. Such ambiguity derives in part from the contested nature of the concept of legitimacy, and from disagreements over how to measure it.0This volume reflects the cutting edge of responses to these perennial questions, drawing, in the distinctive NOMOS fashion, from political science, philosophy, and law. Contributors address fundamental philosophical questions such as the nature of public reasons of authority, as well as urgent concerns about contemporary democracy, including whether "animus" matters for the legitimacy of President Trump's travel ban, barring entry for nationals from six Muslim-majority nations, and the effect of fundamental transitions within the moral economy, such as the decline of labor unions.     Abstract: Die ›freiheitliche demokratische Grundordnung‹ (fdGO) ist Kern der ›wehrhaften Demokratie‹ der Bundesrepublik. Als zu schützendes Rechtsgut ist sie in den Art. 18 und 21 GG benannt. Sie legitimiert exekutive und judikative sowie Abwehr- und Überwachungsmaßnahmen gegen politische Akteur/innen. Die vorliegende Arbeit vollzieht die Genese der fdGO als überpositives Rechtsgut nach, das heißt, wie sie vom unklaren Begriff im Verfassungstext zu einer verallgemeinerten Formel geworden ist. Als Quellen dienen Verfassungs- und Gesetzgebungsprozesse sowie juristische Kommentarliteratur und Gerichtsurteile. Methodisch wird die juristische Argumentationsweise politikwissenschaftlich kontextualisiert – auch um einen politikwissenschaftlichen Zugang zu Rechtstexten zu entwickeln. Im Fokus stehen die Debatten im Parlamentarischen Rat, der Gesetzgebungsprozess des 1. Strafrechtsänderungsgesetzes von 1951, die Parteiverbotsurteile des Bundesverfassungsgerichts und die ersten Kommentare zum Grundgesetz. Zudem stehen das Konzept der ›wehrhaften Demokratie‹ und die dazugehörigen geschichtspolitischen Legitimationen mit Bezug zu Weimarer Republik und Nationalsozialismus auf dem Prüfstand. Die Autorin gleicht die verschiedenen Positionen im staatsrechtstheoretischen »Weimarer Methodenstreit« mit nationalsozialistischen Rechtsauffassungen ab und zeigt so Traditionslinien auf, die sich auch in den Begründungen des Konzepts der ›wehrhaften Demokratie‹ wiederfinden. Deutlich wird dabei, dass die Narrative von der ›wehrlosen‹ Weimarer Republik und der ›legalen‹ Machtübernahme des Nationalsozialismus juristisch- zeitgeschichtlich überprüft werden müssen. Nach der historischen Kontextualisierung der fdGO werden ihre Ausbreitung und Anwendung in verschiedene Rechts- und Politikbereiche beleuchtet. Abschließend fragt die Studie nach den Konsequenzen des juristischen Blicks für politisches Handeln.

Rudolf Steinberg unterzieht diese Annahmen einer kritischen Betrachtung und fragt nach der institutionellen Verortung eines deutschen Islam. Er führt in einer tour d'horizon sachlich und differenziert durch die aktuellen juristischen und politischen Diskussionen. Denn "die" Scharia gibt es ebenso wenig wie "den" Islam.

    Abstract: Die Digitalisierung fordert den Staat nicht einfach nur heraus. Sie überfordert ihn. Sie stellt in Frage, wie wir 70 Jahre lang unser Gemeinwesen gesteuert, organisiert und verteidigt haben. Unser demokratischer Staat mit seinen Institutionen und Verfahren tut sich schwer, seine bisherige Rolle auch im digitalen Raum zu spielen. Entlang persönlicher Erfahrungen zeichnet der Autor die Entstehung der Netz- und Digitalpolitik seit dem Jahr 2000 in Deutschland nach. Er beschreibt anhand von Beispielen die Mühen von Politik und Verwaltung im Umgang mit der Digitalisierung. Der Autor arbeitet die Ursachen der digitalen Schwäche des Staates heraus und präsentiert konkrete Vorschläge, wie die Politik die Wirksamkeit des Staates erhalten kann – auch in der digitalen Welt. Der Autor Martin Schallbruch hat das Entstehen der Netz- und Digitalpolitik in Deutschland in verantwortlichen Positionen innerhalb der Bundesregierung seit 1998 miterlebt und mitgestaltet, zuletzt als Leiter der Abteilung Informationstechnik, Digitale Gesellschaft und Cybersicherheit im Bundesministerium des Innern. Seit 2016 forscht er am Digital Society Institute der ESMT Berlin.

    Abstract: Das Buch untersucht mit der Margin of Appreciation eine der bekanntesten und doch umstrittensten Rechtsfiguren der Rechtsprechung des Europäischen Gerichtshofs für Menschenrechte. Es entwickelt eine schlüssige Kritik ihrer bisherigen dogmatischen Fassung und zugleich einen praktisch anschlussfähigen Vorschlag für eine Neuaufstellung der überkommenen Doktrin. Bestehende kritische Ansätze des bisherigen Schrifttums werden aufgearbeitet, weiterentwickelt und mit besonderer Konsequenz angewandt. Die Autorin wählt dabei einen methodischen Zugriff auf mittlerer Abstraktionshöhe, der es ermöglicht, sowohl die konkrete Rechtsprechungspraxis zu berücksichtigen, als diese auch mit abstrakten, vornehmlich demokratietheoretischen Einwänden zu konfrontieren. Durch eine radikale Reduktion derjenigen Faktoren, die nach überkommener Auffassung für Übung und Umfang richterlicher Zurückhaltung maßgeblich sind, wird die Margin of Appreciation im Ergebnis entschieden verschlankt und rationalisiert.

Er verfolgt die These, dass das Gericht im Verlauf seiner Rechtsprechung eine angewandte Demokratietheorie entwickelt hat. Als hermeneutischer Prozess der Verfassungskonkretisierung ist die Argumentationsweise des Gerichts nur aus einer Korrelation zwischen gerichtlicher Demokratietheorie und gelebter Demokratiepraxis heraus zu verstehen.     Abstract: Selten wird ein Thema seit Ende der 1990er Jahre so intensiv diskutiert wie die politische Bildung und Beteiligung von Jugendlichen. Seither wird der Frage nachgegangen, welche Möglichkeiten der politischen Partizipation Jugendlichen eingeräumt werden sollen. Die ‚Bilanzierung‘ und ‚Perspektiven‘ der politischen Bildung und Beteiligung Jugendlicher bilden den Schwerpunkt des Bandes, um sowohl das Verhältnis Jugendlicher zur Politik heute neu zu bestimmen als auch einen systematischen Vergleich vorzunehmen und damit weitere Impulse für die Entwicklung der künftigen Jugendpolitik zu gewinnen.     Abstract: This book offers the first comprehensive political analysis of the Euro crisis that erupted in Greece in 2010 and subsequently threatened the very survival of the Euro area.
