    Abstract: On 2 April 1997, the National Assembly adopted a new Constitution. It replaced the Constitutional Law on the Relationships between the Legislative and Executive Powers and on Local Self-government, known as the Small Constitution, which had been in force since 1992. The new Constitution was approved in a popular referendum on 26 May 1997, signed by the President and published on 16 July 1997. The Constitution finally entered into force on 17 October 1997. The new Constitution had been under discussion since 1989, but several earlier attempts to adopt a new constitution had failed. According to the new constitutional provisions, constitutional amendments may only be proposed by at least one-fifth of the statutory number of Sejm deputies, by the Senate, or by the President of the Republic. A Bill to amend the Constitution needs to be adopted by the Sejm by a majority of at least two-thirds of the votes and in the presence of at least half of the statutory number of deputies, and by the Senate by an absolute majority of votes in the presence of at least half the statutory number of senators. If changes are to be made to chapters I, II or XII of the Constitution, the initiators of such changes may call for a popular confirmatory referendum. Poland has traditionally been part of the continental law tradition. Even under communism, the country did not break with this legal heritage. The legal system of Poland is based on a hierarchy of legal norms.

    Abstract: As the 20th century draws to a close, powerful forces of change are converging that could set the stage for a long, sustained economic boom in the next few decades -- the transition to a knowledge-based society with its potentially huge productivity gains; the emergence of more deeply integrated, global markets for goods, services, capital and technology; and a fast-growing environmental awareness that could greatly accelerate the shift to new, less resource-intensive production and consumption patterns. The result could be several decades of above-average economic growth, substantial increases in income and wealth, and significant improvements in well-being across the world. But what will it take to unleash these dynamic forces? Not only will it call for a range of initiatives to establish the rules and frameworks for guiding the transition to a sustainable global knowledge economy, but above all, it will require exceptional efforts among decision makers in government, business and society at large to encourage continuous innovation, creativity and high levels of investment, and to promote bold new approaches to closer international co-operation and institution building.     Abstract: The constitution establishes the principle of legal continuity of the Republic of Estonia, which was proclaimed independent on 24 February 1918, occupied by the Soviet Union on 17 June 1940 and subsequently annexed thereto on 6 August 1940. The constitution reflects the idea of legal restoration, which served as a basis for the return to independence and liberation from the Soviet Union on 21 August 1991. The Riigikogu has recently begun to consider the results of a review carried out by the government expert committee on constitutional revision. The committee’s proposals, if adopted, would not alter the basic principles of the constitution but would reinforce the parliamentary and constitutional system of government. The most important proposals are the establishment of a separate constitutional court, reinforcement of civil control over the defence forces, and attribution of the powers of an ombudsman to the legal chancellor. Moreover, amendments may have to be made in view of the accession of Estonia to the European Union; these amendments touch upon a basic principle of the constitution, the principle of sovereignty.

Creditor governments should induce their home banks into financial rescue operations to reduce moral hazard in private-sector lending, and to encourage Asia’s recovery. • The resolution of Asia’s domestic debt overhang must be the overriding policy concern for Asia’s governments; paying the inevitable fiscal cost in Asia’s restructuring process requires tax-base broadening, supported by easy monetary policy. • Progress towards a less crisis-prone international financial system will hinge on how to correct the excessive risk taking by banks. Regulatory distortions through the Basle Accord which bias bank lending towards the short term should be corrected. • Developing countries should strengthen bank and non-bank balance sheets and raise the quality of inflows; Chile-type regulatory measures, however, will only be effective in an appropriate policy context.

    Abstract: A successful reform of public enterprises would improve productivity in key sectors of the Greek economy, and thus provide essential inputs at lower cost to the economy as a whole. Reforms would need to address the factors that are responsible for the poor performance of Greek public enterprises. First, labour costs are high and productivity low in international comparisons. Second, there are wide technology gaps between Greece and other OECD countries. Third, Greece’s public enterprises fulfil heavy public service commitments without matching compensation. As a result, prices are often out of line with prices elsewhere. In recognition of the large drag on the economy, as well as the burden on the budget, the Government has embarked on a programme to revitalise inefficient public enterprises.     Abstract: Fears of the prospect of growing social exclusion have become important concerns in recent years for many countries. Improving the quality of education and the standards attained by students to improve employability is one of the tools being used to prevent exclusion. However, changing social realities are leaving young children and students more exposed than ever to failure at school and unemployment. It is becoming increasingly clear that communities, education systems, schools and teachers are not equipped to deal with the many problems which arise and when social or health services become involved conflicts of interest can arise leading to actions which are not always in the clients' best interests. The necessity to provide greater co-ordination among these services, to improve their efficiency and effectiveness and to provide a seamless support to meet the holistic needs of students and their families is now becoming more accepted. Such an approach, inter alia, is community-based, emphasises prevention rather than being crisis-oriented, is customer-driven rather than being focused on an agency, and is accountable through outcomes rather than inputs. For many, better co-ordination of services is seen as the only solution available which is commensurate with our present democratic societies. All of the papers in this book were presented at a conference held in Toronto, Canada. They are original and have been written by policy-makers from different ministries, researchers from different disciplines and clients who come variously from Canada, Finland, France, Germany, the Netherlands, Spain, the UK, and the USA.

    Abstract: The OECD Development Assistance Committee's 1999 review of Ireland's development aid programmes. It finds that in 1999, Ireland marks the 25th anniversary of Irish Aid, its official aid programme. Over the last five years, the volume of Ireland’s official development assistance (ODA) has risen by an average of 20 per cent a year in real terms, the most rapid growth by a Member of the OECD’s Development Assistance Committee (DAC). Preliminary data indicate that Ireland’s development co-operation reached 0.30 per cent of GNP in 1998, nearly double its 1992 level, and is projected to reach 0.35 per cent in 1999. After six years of impressive growth in volume and improvement in quality, most of the increase in aid in 1999 is being used for debt relief measures, European Union contributions, emergency humanitarian assistance and support for refugees in Ireland, rather than for allocations for the long-term development programmes administered by the Department of Foreign Affairs. Political commitments on aid allocations undertaken by the Minister of Finance mean that increases in the Department of Foreign Affairs’ part of the programme are now expected in 2000 and 2001. Two main issues confront the Irish Aid programme: how best to grow and how best to manage that growth. These are clearly issues which Ireland needs to consider and resolve itself, but the Development Assistance Committee can draw on its collective experience to contribute to Ireland’s reflections on these issues. A starting point, from experience elsewhere, is that Irish Aid should maintain and enhance the focused nature of the programme which is now one of its major strengths.

    Abstract: Severe environmental problems were a key issue in the protests that marked the end of communist regimes in Central and Eastern Europe and the former Soviet Union. This groundbreaking book provides new insights into the interaction between economic policy reforms, environmental protection efforts and environmental conditions in the region's subsequent transition to market-based economies and democratic societies over the past eight to ten years. The unique contribution of the book is its synthesis of a vast amount of information and cumulative experience together with detailed examples and case studies to provide a coherent analysis of the challenges and achievements in institutional strengthening and policy reform, environmental policy instruments, environmental financing, and environmental management in enterprises. It also reviews the development of domestic public participation and international co-operation for the safeguarding of the region's environment and discusses trends in industrial pollution and biodiversity protection. The book shows that economic reforms provided a crucial stimulus for environmental improvement, leading to reductions in high pollution levels. Moreover, several countries have strengthened their domestic environmental policies, institutions, and financing, resulting in further improvements. Nonetheless, many serious problems remain, and others have grown worse over the transition period: in many countries of the former Soviet Union in particular, economic crises and political stagnation have impeded environmental protection efforts. Continued partnerships between governments of the region, OECD donor countries, international financial institutions and organisations, environmental NGOs, businesses and trade unions, as well as public support for these, will be essential to reinforce the environmental improvements achieved thus far.

    Abstract: The future of rural areas is high on the domestic and international policy agenda. Restructuring of the agricultural sector, and accompanying reform of agricultural policies, and the challenge of meeting sustainable development objectives are key preoccupations in OECD countries. In the search for forward-looking and durable policy strategies, building on natural and cultural amenities is emerging as an important area of policy action, one which complements traditional, agriculture-oriented rural policies and places rural policy in the broader territorial development arena. In most rural areas, the potential of many natural and cultural resources remains untapped. Harnessing such amenities, however, involves striking a balance between use and conservation. In many cases, maintenance of rural amenities depends on a degree of local economic activity -- without it there is a danger of degradation. At the same time, over-exploitation risks spoiling, often irreversibly, the essential value of the amenity. Because many natural and cultural features are public goods, with limited markets and hazy property rights, public policies are needed to strike the delicate balance between supply and demand.

    Abstract: The OECD Development Assistance Committee's 1999 review of Denmark's development aid programmes and policies. It finds that Denmark is the top performer among the 22 Members of the OECD Development Assistance Committee (DAC) in terms of the volume of its official development assistance (ODA). Denmark’s ODA volume has been maintained at around 1% of gross national product (GNP) since 1992, thanks to a strong consensus and public support for development aid. The quality of Denmark’s aid effort is also most impressive. In particular this high volume of aid is supported by a strong long-range strategy, whose directions - and especially the central emphasis on poverty reduction - are in harmony with the Development Partnership Strategy agreed by the DAC in 1996. Denmark has succeeded in concentrating its bilateral assistance on 20 countries, 18 of which are low-income or least developed countries. Aid is concentrated on sectors of particular relevance to the poor and on programmes in the poorest areas of these countries, thus working towards the goal of poverty reduction. Since 1996, Denmark has pursued a policy of "active multilateralism" to promote its concerns for increased focus and efficiency in multilateral aid programmes. However, there is no clear evidence that this policy has greatly advanced the intended results, as it still reflects a largely unilateral approach more than a joint endeavour. Denmark is a long-standing positive example of the integration of the aid system with other aspects of foreign relations. This approach combines policy coherence in Denmark’s relations with developing countries and professionalism in the aid programme, enhanced by an effective decentralisation of responsibility to embassies in programme countries. This integrated approach has helped Danish development assistance (Danida) to pioneer since 1994 a shift in aid implementation from project support to Sector Programme Support (SPS), an approach which should be mutually reinforcing with the DAC’s Partnership Strategy. It implies also a stepping up in co-ordination activities, both between donors and with partner countries, which Denmark has fully backed.

The root cause of the recent volatility of capital flows seems to have been excessive credit and currency risk-taking by banks, which in turn was related to moral hazard problems, failure of prudential regulations and bank supervision, and weak effective standards of financial disclosure. Macroeconomic factors also played a role, with a widening deficit on the balance of payments and fixed (or predictable) exchange rates gradually undermining confidence of creditors and investors. On unchanged policies, this will increase government outlays for public pensions and health care, causing a deterioration in budget balances, and reduce economic growth (mainly by lowering growth in the labour force). Nevertheless, the prospective deterioration in Australia’s budget finances is much less than in most other OECD countries because the government only provides the first pillar of retirement income arrangements and means tests this age pension. Moreover, superannuation (private pension fund) benefits are growing, reducing entitlements to the age pension. Even so, the budget costs of population ageing could be lowered by reducing the scope for early retirees to draw on superannuation savings and by requiring individuals to prefund part of the costs of long-term aged care.     Abstract: The Dutch experience in regulatory reform has vital lessons about the modernisation of the European welfare state and its integration into the European single market. Regulatory reform is the most recent element in the reshaping of the Dutch model. Following reforms to labour markets and the social welfare system in the 1980s, Dutch governments in the 1990s have sought a "new balance between protection and dynamism" based on competition policy, regulatory reform, and market openness. Today, the Netherlands ranks among the top OECD countries by many measures of economic performance, including employment growth. Though still in its early phases, regulatory reform has already produced major gains for the Netherlands in terms of competitiveness, flexibility, and consumer benefits. Yet major challenges are still to be faced. Some important reforms have been slow, indicating that the balance between domestic consensus-building and policy responsiveness is still being adjusted in the modern Dutch model. Further reforms in many areas will bring important gains in boosting the employment rate, improving sectoral performance, and providing social protection at lower cost. The Netherlands is one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as electricity and telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

    Abstract: The Republic of Bulgaria was restored in January 1990, following amendments to the communist-inspired constitution, which put an end to the single-party rule of the Bulgarian Communist Party, and the conclusion of the round table agreement between the communist government and representatives of the democratic opposition. The new Bulgarian Constitution was adopted by the Grand National Assembly in July 1991. It marked the return to multi-party democracy. Since the beginning of democratic transformation in Bulgaria, four general parliamentary elections have been held, including the elections to what was then called the Grand National Assembly of June 1990, and elections to the national assembly in October 1991, December 1994 and, most recently, April 1997. The next parliamentary elections are scheduled for spring 2001. Presidential elections were held in January 1992 and November 1996. The next elections for the presidency will be held in autumn 2001. Democratic local government elections took place in October 1991 and in November 1995. The next round of local elections will take place in the autumn of 1999.

    Abstract: Climate change is an increasing concern across the world. In 1997, a number of countries, including most OECD countries, agreed the Kyoto Protocol, which sets targets for future emissions of greenhouse gases that drive climate change. But the Kyoto Protocol left many decisions to be made, and while these are being discussed the clock ticks and the date for meeting the targets draws closer. Uncertainties are even larger as to policy requirements over the longer term. The Kyoto targets in themselves will do little to avert climate change but are best seen as a first step towards ambitious worldwide action. This puts the focus on how to achieve worldwide consensus for taking action and the economic impacts such action may have. Whatever action is taken, and on the basis of available scientific evidence, some climate change may take place in any case, raising questions about its impacts and how best to adjust. What are the main outstanding issues concerning the Kyoto Protocol? What will it cost to implement the Protocol? How can it be done so as to minimise costs? How could economic burdens be shared among countries so as to achieve broad consensus for global action? What will be the impact of such climate change as may happen and how should policy be set so as to smooth adjustment? This publication presents analysis which bears on the above questions as well as others in the climate change debate. It does not purport to have the final answers, but is aimed to inform a major debate.

    Abstract: Both firms, keen to improve their competitiveness, and governments, keen to exploit new sources of economic and social progress, need to understand how innovation works in order to better stimulate it. The paradox of innovation is that it uses co-operation to enhance competition and to link many different actors in innovative clusters. In a knowledge-based economy, these clusters of innovative firms form around sources of knowledge. They are based on a sophisticated infrastructure in which knowledge is developed, shared and exchanged, and are characterised by highly concentrated and effective links between entrepreneurs, investors and researchers. Clusters can take a variety of forms, depending on their main technological and commercial areas of specialisation. In most cases they operate within localised geographical areas and interact within larger innovation systems at the regional, national and international level. With globalisation, dynamic clusters are becoming key factors in a country’s capacity to attract the international investment that generates new technological expertise, to interest investors in innovation (venture capital, etc.) and to benefit from the international mobility of skilled personnel. This book reviews the latest economic research on these issues, shows how technology policy makers in OECD countries are making practical use of the concept of clusters and suggests how government policies to foster innovation might best be refocused.

    Abstract: We assess the prospects for growth of African economies up to the year 2010 by modelling structural and policy determinants of growth, under different scenarios for changes in the exogenous factors and economic policies which shape the projections. To this end we estimate a growth model for 39 African economies, during seven five-year periods from 1960 through 1995. The model emphasises two engines of growth: i) investment and ii) growth of exports. Using a composite indicator of “emerging economies” iiset up on the basis of the economic performance, quality of policies and political stability of African countries ppwe identify 14 African economies that stand better chances to achieve a lasting improvement in their policies and growth performance in the years ahead.     Abstract: Plutonium and minor actinide burning or recycling in thermal and fast reactors is being studied in many countries with the aim of maintaining and developing fuel cycle options which can be adjusted to changing demands and constraints. The challenge is to move towards an economically and socially sustainable nuclear energy system based on advanced reactors - advanced water-cooled reactors, fast reactors and perhaps accelerator-based, hybrid reactors - and new types of fuel cycles which help to minimise the waste arising. An additional issue concerns the availability of resources for the long-term future. This workshop introduced new ideas on R&D activities and identified areas and research tasks relevant for the deployment of new systems and in which international co-operation can be strengthened. The roles played by existing experimental facilities as well as possible needs for new ones are discussed. The conclusions of the technical sessions are synthesised and the results of a round table discussion on international co-operation are presented.

    Abstract: The Development Assistance Committee's 1998 review of Spain's development aid programmes and policies. It finds that The Spanish Government is making significant efforts to consolidate the political framework for development co-operation and improve the quality and transparency of its aid. A draft law on development co-operation was submitted to Parliament in the autumn of 1997 and new planning and evaluation systems for aid management are being introduced, including a multi-year indicative plan and country programmes. Despite severe budgetary constraints, an increase in the aid budget is also envisaged. These initiatives were well received by the OECD's Development Assistance Committee (DAC) during the review of Spain's aid policies and programmes. The Committee also took note of the major improvement in the balance of the Spanish aid effort with a significant increase in the grant aid programme, accompanied by a decline in the tied Development Aid Fund (FAD) loan component, and expressed the hope that this trend would continue. The DAC encouraged the Spanish authorities to pursue their efforts to ensure greater consistency of the FAD loans with the overall development objectives and policy directions for Spanish aid. In relation to general good practice among donors, the Committee indicated its support for the measures to enhance the effectiveness of the Spanish aid programme and its capacity to implement and suggested that the Spanish authorities consider a number of further initiatives

Countless studies have been published detailing the number of working hours lost in traffic jams. The figures quoted in these studies are alarming and paint an apocalyptic picture of road congestion. However, besides the everyday congestion faced by motorists, differences of opinion are now starting to appear with regard to the scale of the problem and the ways in which it should be tackled. This Round Table attempted to define congestion and to determine the scale of the problem. It addressed the trends in congestion and the consequences of those trends. The Round Table then considered possible solutions to the congestion problem. Considering the extent of this problem in the European context, the Round Table report sheds light on one of the most visible malfunctions of transport systems.

    Abstract: In this paper, we present estimates of the mark-up of product price over marginal costs for the US manufacturing industries over the 1970-1992 period. The paper extends the analysis used in previous studies based on nominal productivity residuals by considering intermediate inputs and cyclical fluctuations of price margins. The estimated steady-state mark-ups are positive but moderate, generally in the range of 10-20 per cent.     Abstract: As it takes time and effort to learn how to fully utilise new technology and realise its maximum potential productivity gain, adoption of new technology tends to reduce productivity temporarily, even though the potential productivity gain in the long run outweighs this short run loss. This paper points to such “learning cost” in technology upgrading as a potential explanation of the following two “productivity puzzles” reported in the Information Technology (IT) literature and in the studies of East Asian economic growth. First, in the 1980s, US companies made enormous IT investments, but little productivity gain was observed. Second, Total Factor Productivity (TFP) growth of “Newly Industrialising Countries” (NICs) in East Asia was mediocre in spite of the impressive investment drive in those countries. A simple model of optimal intervals for technology upgrading with learning cost is developed. This model predicts that a company with higher frequency in technology upgrading will tend to have higher market value even with lower current profitability. An empirical study using unbalanced panel data of 1,031 US companies from 1986 to 1995 supports this prediction. Extending the scope from firm-level to industry-level, the paper estimates the magnitude of industry-wide learning-by-doing effects using annual data on 15 sub-industries in the Japanese machinery manufacturing sector from 1955 to 1990. The results show that industry-wide learning-by-doing was strong in low-tech industries where technological change was relatively slow, while it was insignificant in high-tech industries which experienced rapid technological evolution. It is also observed in the US and Japanese manufacturing industries that TFP growth tends to decrease with faster capital accumulation. This negative correlation is reproduced in simulations based on the extended model of learning cost.

What do historical emissions and policy trends tell us about the way forward? Which policies will be needed to combat climate change? This book provides an overview of recent developments in OECD countries and a framework for policy making in the context of Kyoto targets. There is no single formula for domestic policies to mitigate greenhouse gas emissions. Every country will need to assess opportunities and constraints to develop a strategy adapted to their own situation. Yet, it is possible to outline some main lines for action in OECD countries at the national level. National strategies should prioritise market, subsidy and fiscal reform policies to establish conditions for competitive markets and remove distortions that harm the environment. And governments should implement a comprehensive mix of mutually reinforcing and integrated policies, using a wide range of economic instruments (green taxes, green tax reform and domestic emission trading) as well as other measures such as product policies, voluntary approaches and public awareness programmes. Unless OECD countries establish more effective frameworks for action now, achieving the Kyoto targets is likely to be costly and difficult.
