    Abstract: "Children make up half of the world's refugees and over 40 per cent of the world's asylum seekers. Yet, children are largely invisible in historical and contemporary refugee law. Furthermore, there has been very limited interaction between the burgeoning children's rights framework, in particular the Convention on the Rights of the Child (CRC), and the 1951 Convention relating to the Status of Refugees (Refugee Convention). This book explores the possibility of a children's rights approach to the interpretation of the Refugee Convention and within that what such an approach might look like. In order to construct a children's rights approach, the conceptualisations of children outside the legal discipline, within international children's rights law and then within refugee law and refugee discourse are analysed. The approach taken is socio-legal and comparative in nature and the suitability of the Refugee Convention as a framework for the interpretation of child claims is examined. The book analyses to what extent the Refugee Convention is capable of dealing with claims from children based on the modern conceptualisation of children which is underscored by two competing ideologies - the child as a vulnerable object in law to be protected and the child as subject with rights and the capacity to exercise their agency. The influence each regime has had on the other is also analysed. The work discusses how a children's rights approach might improve outcomes for child applicants. The book makes an original contribution to child refugee discourse and as such will be an invaluable resource for academics, researchers and policy-makers working in the areas of migration and asylum law, children's rights, and international human rights law' --

    Abstract: 'Hurry" is an intrinsic component of modernity. It exists not only in tandem with modern constructions of mobility, speed, rhythm, and time-space compression, but also with infrastructures, technologies, practices, and emotions associated with the experience of the 'mobilizing modern'. 'Hurry' is not simply speed. It may result in congestion, slowing-down or inaction in the face of over-stimulus. Speeding-up is often competitive: faster traffic on better roads made it harder for pedestrians to cross, or for horse-drawn vehicles and cyclists to share the carriageway with motorised vehicles. Focussing on the cultural and material manifestations of 'hurry', the book's contributors analyse the complexities, tensions and contradictions inherent in the impulse to higher rates of circulation in modernizing cities. The collection includes but also goes beyond accounts of new forms of mobility (bicycles, buses, underground trains) and infrastructure (street layouts and surfaces, business exchanges, and hotels) to show how modernity's 'architectures of hurry' have been experienced, represented, and practised since the mid-nineteenth century.     Abstract: "Heritage is not what we see in front of us, it is what we make of it in our heads. Heritage sites have been connected to a range of identarian projects, both spatial and non-spatial. One of the most common links with heritage has been national identity. This book stresses that heritage has developed powerful links to regional and local identities. Contributors deal explicitly with regions of heavy industry in different parts of the world, exploring non-spatial forms of identity: including class, religious, ethnic, racial, gender and cultural identities.     Abstract: "This book explores the right to democracy in international law and contemporary democratic theory, asking whether international law encompasses a substantive or procedural understanding of the notion. The book considers whether there can be considered to be a basis for the right to democracy in international customary law through identification of the relevant state practice and opinio juris, as well as through an evaluation of the Universal Declaration of Human Rights and whether the relevant provisions might be interpreted as forming customary law. The book then goes on to explore the relevant provisions in international treaties including the International Covenant on Civil and Political Rights before looking at the role of regional organizations and human rights regimes including the European Court of Human Rights and the Arab human rights regime. [The author] draws on the work of John Rawls in order to put forward a theoretical basis for the right to democracy."--

    Abstract: The capacity to abuse, or in general affect the enjoyment of human, labour andenvironmental rights has risen with the increased social and economic powerthat multinational companies wield in the global economy. At the same time,it appears that it is difficult to regulate the activities of multinational companiesin such a way that they conform to international human, labour and environmentalrights standards. This has partially to do with the organization of companiesinto groups of separate legal persons, incorporated in different states, aswell as with the complexity of the corporate supply chain. Absent a businessand human rights treaty, a more coherent legal and policy approach is required.Faced with the challenge of how to effectively access the right to remedy inthe European Union for human rights abuses committed by EU companies innon-EU states, a diverse research consortium of academic and legal institutionswas formed. The consortium, coordinated by the Globernance Institute forDemocratic Governance, became the recipient of a 2013 Civil Justice ActionGrant from the European Commission Directorate General for Justice. A mandatewas thus issued for research, training and dissemination so as to bringvisibility to the challenge posed and moreover, to provide some solutions forthe removal of barriers to judicial and non-judicial remedy for victims of business relatedhuman rights abuses in non-EU states. The project commenced inSeptember 2014 and over the course of two years the consortium conductedresearch along four specific lines in parallel with various training sessions acrossEU Member States.The research conducted focused primarily on judicial remedies, both jurisdictionalbarriers and applicable law barriers; non-judicial remedies, both to company based grievance.     Abstract: Critical Race Theory is a familiar and important strand of North American legal scholarship, but it is virtually unknown in Europe. This book aims to bring Critical Race Theory to a European context. Outlining its development in North America, and bringing its insights to bear upon European law and legal scholarship, the book considers Critical Race Theorys relevance in Europe, and particularly in civil law traditions, where the relationship between race and law is often presented as anodyne. Redressing the almost exclusive European focus and reading of anti-racism in terms of anti-Semitism, the conflation of race and racism with issues related to citizenship and religion, and the more general reluctance to speak of race, the book outlines the elements of a European Critical Race Theory. For law, it is demonstrated, is just as deeply involved in constructing, discriminating and subordinating racial minorities in the European context as it is in the American one even if, as this book shows, it does so in different ways
    Abstract: "The CRT approach adopted in this book illustrates the reasons why the relationship between race and law in European civil law jurisdictions is far from anodyne. Law plays a critical role in the construction, subordination and discrimination against racial minorities in Europe, making it comparable, albeit in slightly different ways, to the American experience of racial discrimination. Anti-Semitism, Islamophobia, anti-Roma and anti-Black racism constitute a fundamental factor, often tacitly accepted, in the relationship between law and race in Europe. Consequently, the broadly shared anti-race and anti-racist position is problematic because it acts to the detriment of victims of racism while privileging the White, Christian, male majority

    Abstract: "Hate speech law can be found throughout the world. But it is also the subject of numerous principled arguments, both for and against. These principles invoke a host of morally relevant features (e.g., liberty, health, autonomy, security, non-subordination, the absence of oppression, human dignity, the discovery of truth, the acquisition of knowledge, self-realization, human excellence, civic dignity, cultural diversity and choice, recognition of cultural identity, intercultural dialogue, participation in democratic self-government, being subject only to legitimate rule) and practical considerations (e.g., efficacy, the least restrictive alternative, chilling effects). The book develops and then critically examines these various principled arguments. It also attempts to de-homogenize hate speech law into different clusters of laws/regulations/codes that constrain uses of hate speech, so as to facilitate a more nuanced examination of the principled arguments. Finally, it argues that it is morally fitting for judicial and legislative judgments about the overall warrant of hate speech law to reflect principled compromise. Principled compromise is characterized not merely by compromise over matters of principled concern but also by compromise which is itself governed by ideals of moral duty or civic virtue (e.g., reciprocity, equality, and mutual respect)"--

    Abstract: "International law presents a conceptual riddle. Why comply with it when there is no world government to enforce it? The United States has a long history of skepticism towards international law, but 9/11 ushered in a particularly virulent phase of American exceptionalism. Torture became official government policy, President Bush denied that the Geneva Conventions applied to the war against al-Qaeda, and the US drifted away from international institutions like the International Criminal Court and the United Nations. Although American politicians and their legal advisors are often the public face of this attack, the root of this movement is a coordinated and deliberate attack by law professors hostile to its philosophical foundations, including Eric Posner, Jack Goldsmith, Adrian Vermeule, and John Yoo. In a series of influential writings they have claimed that since states are motivated primarily by self-interest, compliance with international law is nothing more than high-minded talk. Theses abstract arguments then provide a foundation for dangerous legal conclusions: that international law is largely irrelevant to determining how and when terrorists can be captured or killed; that the US President alone should be directing the War on Terror without significant input from Congress or the judiciary; that US courts should not hear lawsuits alleging violations of international law; and that the US should block any international criminal court with jurisdiction over Americans. Put together, these polemical accounts had an enormous impact on how politicians conduct foreign policy and how judges decide cases - ultimately triggering America's pernicious withdrawal from international cooperation. In The Assault on International Law, Jens Ohlin exposes the mistaken assumptions of these 'New Realists,' in particular their impoverished utilization of rational choice theory. In contrast, he provides an alternate vision of international law based on a truly innovative theory of human rationality. According to Ohlin, rationality requires that agents follow through on their plans even when faced with opportunities for defection. Seen in this light, international law is the product of nation-states cooperating to escape a brutish State of Nature--a result that is not only legally binding but also in each state's self-interest"--

    Abstract: This book offers the first comprehensive political analysis of the Euro crisis that erupted in Greece in 2010 and subsequently threatened the very survival of the Euro area. It has left a profound mark on democratic politics all over Europe, changing public attitudes and voting preferences, institutional and societal norms, and deeply anchored political traditions. The contributors to this volume reveal the extent to which policymakers are torn between the pressures emanating from financial markets and the demands put forward by their own constituents; how they struggle to reconcile national preferences with wider European interests; and how a polarized and politicized Union seeks to maintain some degree of cohesion. The emerging picture is that of a European Union under serious stress, transformed by new governance structures and a shifting balance of power. In response, the authors evaluate the prospects of a more legitimate and democratic Europe. They provide a rich and pluralist set of new analyses and proposals, aimed at understanding and navigating the myriad tensions which surround the EU in the aftermath of the crisis. If the European project is to regain the trust of its citizens, such considerations must take a central place in public debate
