After two decades of War on Terror, it is particularly important, for both academic and policy purposes, to clearly understand why the US formidable mobilization of means and might has transformed into a such a blatant geostrategic defeat of the US and its allies in the broad Middle East. This is all the more paradoxical that the WOT achieved a series of tactical victories – such as the toppling of hostile regimes in Afghanistan, Iraq and Libya; the crippling of the national economies of enemy states by sanctions; the successful targeted killing of lead terrorist Usama Bin Laden, ISIS cult leaders Abu Bakr Al-Baghdadi and his successor, etc. So, why have these tactical victories not led to what was supposed to become, according to the US government, a ‘Greater Middle East’? We argue that Trump has succeeded in remaking America’s grand strategy by unmaking its long-standing strategy of what we call Open Door Globalism, a strategy of economic expansionism through the promotion of open markets globally and its institutionalization into a US-led liberal world order. Trump has broken with Open Door Globalism in probably lasting ways by adopting an outlook and strategy of neo mercantilist economic nationalism based upon an ‘America First’ redefinition of US sovereignty and national interests. Explaining this Trumpian shift in US foreign policy we focus on the social sources of Trump’s foreign policy-making elite’s agency, analysing its embeddedness in elite networks and within the changing global and domestic context. The latter, coupled with a crisis of established elite power, also indicates why Biden has not returned to Open Door Globalism but doubled down on aspects of the Trumpian economic nationalist break. Bastiaan van Apeldoorn is Professor of Global Political Economy and Geopoliticsat the Vrije Universiteit Amsterdam, the Netherlands.     Kurzfassung: This book investigates the phenomenon of overbalancing through an analysis of Japan’s foreign policy during the interbellum. In the mid-1930s, Japan withdrew from a naval arms control framework that had restrained military buildup on both sides of the Pacific Ocean since the early 1920s. By doing so, Japan not only triggered a naval arms race with the United States that exhausted its economy, it also destroyed the last institutionalized structure regulating the relationship between the two Pacific powers. Japan and the United States became caught in a spiral of tensions that culminated with the attack on Pearl Harbor in December 1941. Puzzling is the fact that the international environment in the Asia-Pacific was relatively stable in the mid-1930s, while Washington was pursuing a policy of accommodation toward Tokyo. By rejecting arms control and engaging in unfettered naval expansion, Japan overbalanced against the United States and began its rush to the Pacific War. The book explains Japan’s overbalancing with a neoclassical realist model that combines the literatures on threat perception and civil-military relations. Amid the Manchurian crisis of 1931-1933, as the Japanese government collaborated with the military institution to address the situation in China, military influence on the formulation of foreign policy surged. The perceptual and policy biases of the military, which include the tendency to distrust other countries’ intentions, to adopt worst-case analyses of international dynamics and to strive to maximize military power, gradually penetrated the decision-making process. Dysfunctions in the preexisting structure of Japanese civil-military relations, engendered by an over-depoliticization of the military institution, allowed the navy to convince policymakers that the United States was inherently hostile to Japan, hence the necessity to prepare for war. The government was brainstormed, adopting the biased military perspective on international affairs. Japan overbalanced in a myopic but conscious way. Lionel P.     Kurzfassung: Great power competition is back on the world stage, and today’s international system is home to regional influences on great power relations that cannot be ignored. The United States’ unipolar moment is long over, and China’s hegemonic ambitions find expression in a comprehensive global competition with the US that plays out across multiple spheres of world politics. The US-China rivalry can be felt in geostrategic, economic, governance, diplomacy, intelligence, and technological spheres, to name a few. Most accounts of China-US relations in the context of great power conflict emphasize the many ways in which this rivalry has a ripple effect across the globe, with an impact upon the relations and interests of smaller powers. And while these effects are considerable and important, this book contends that attention must also be paid to the ways in which smaller, regional states have the potential to shape this great power rivalry. Put simply, great powers both shape, and are shaped by, smaller states. Any understanding of contemporary great power relations between the US and China requires both a top down, but also a bottom up consideration of the interplay between great powers and regional ones. Often the interests of regional powers are rooted in domestic considerations such as their identities and national interests, and these influences transcend borders and often have an impact upon the great powers. This book considers these smaller, regional actors and attempts to measure the extent to which they influence the US-China rivalry. For this study, constructivist theory, which prioritizes the agency that regional powers enjoy, is loosely used as a tool to enable a more robust and comprehensive understanding of the influences on the contemporary great power relationship. Each of the book’s chapters represents a region, or part of a region, that enjoys a considerable impact upon US-China relations. Kari Roberts is Associate Professor of Political Science and Chair of the Department of Economics, Justice, and Policy Studies at Mount Royal University (MRU). She is also a Coordinator of the North American and Arctic Defence and Security Network (NAADSN). Saira Bano is an Assistant Professor in the Department of Philosophy, History, and Politics at Thompson Rivers University (TRU) in Kamloops, British Columbia. Her research focuses on the nuclear non-proliferation regime, nuclear weapons issues in South Asia and IR theories.

    Kurzfassung: This book investigates the connection between tightening mobilization constraints and the use of PMSCs in the United States, the United Kingdom, and Italy. Drawing on neoclassical realism and institutionalist theory, it conceptualizes democracies’ use of private military and security companies (PMSCs) as an attempt to circumvent the tightening constraints on the mobilization of military power. The use of private military contractors is less subjected to parliamentary restrictions and less visible to public opinion than the deployment of soldiers. Rather than cheaper in financial terms, PMSCs are therefore politically cost-effective, as they enable decision-makers to minimize the institutional obstacles on conducting military operations and the electoral costs attached thereto. The need to reduce the ex ante hurdles and the ex post costs of military deployments fills the blind spots of alternative explanations for the use of PMSCs based on effectiveness, ideology, and organizational interests. Broadly, Ouyang and Morgan seek to understand (1) how presidents exercise their authority to declare national emergencies and (2) how presidential rhetoric associated with each declaration of national emergencies changes over time. They begin by providing an overview of the development of presidential emergency powers. Then, they analyze the nature of presidential rhetoric in the context of U.S. foreign policy and national emergencies. Finally, they assess the strategic use of rhetoric in national emergency declarations and evaluate how this influences the implementation of economic sanctions stemming from these policies. In addressing these questions, this book helps to advance our understanding of U.S. foreign policy generally, national emergencies specifically, as well as the impact of presidential rhetoric on the policy selection and execution. Yu Ouyang is Associate Professor of Political Science at Purdue University Northwest, USA. He received his undergraduate degree from Valdosta State University and his PhD from the University of Kentucky. His research on U.S. executive politics and quantitative methods has appeared in Congress & the Presidency, Presidential Studies Quarterly, Public Administration Review, and Social Science Quarterly. His recent book examines Donald Trump’s use of Twitter: Trump, Twitter, and the American Democracy: Political Communication in the Digital Age. Michael A. Morgan is Associate Professor of Political Science at Marietta College, USA. He received his undergraduate degree from Marietta College and his MA and PhD from the University of Kentucky. His research focuses primarily on American foreign policy and international security. He has had work published in Presidential Studies Quarterly and Contemporary Cases in U.S. Foreign Policy.

    Kurzfassung: This book focuses on the enforcement aspect of tobacco control policy, and argues that the intense regulation of the tobacco market will never be successful as long as it can be circumvented by the availability of illicit tobacco products. Yet, current efforts to combat illicit tobacco trade are insufficient, suffering from several flaws and gaps at the regulatory and operational levels. The aim of this book is to provide an analysis of the legal framework and practice of enforcement with regard to illicit tobacco products. Combining criminological and legal perspectives, it presents and critically analyses the phenomenon of illicit tobacco trade, as well as the policies, legal frameworks and practices in six EU countries with regard to combatting this phenomenon, assessing the strengths and weaknesses of their approaches. Furthermore, it studies the relationship between the EU and third countries (e.g. Ukraine) in terms of how the EU can influence policy and enforcement in these countries in order to counter illicit tobacco trafficking. Not exclusively focusing on the EU, the book also includes an analysis of enforcement against illicit tobacco products in the US. The EU Member States analysed in the book (Belgium, Germany, Italy, Latvia, the Netherlands and Poland) reflect the range of currently available approaches. Some of them have ratified the WHO Protocol against tobacco smuggling; others have not. They belong to different legal traditions and face different challenges due to their respective border situations. While Belgium and the Netherlands are key entry ports to the EU, Poland and Latvia represent the Eastern land border of the EU, with various regional challenges. Italy has a long maritime border, where trafficking is possible from Northern Africa and from the Middle East. It also has significant experience in fighting organised crime. Lastly, Germany is the largest market in Europe and situated in the middle of these trafficking routes.

    Kurzfassung: This book provides a novel account of the role of human rights discourse in the US foreign policy. The book analyses the US State Department’s Annual Country Reports on Human Rights Practices as a means to monopolise and, more importantly, legitimise a specific framing of the human rights agenda to further US foreign policy. The US agenda’s deviation from established international human rights standards has very serious implications considering the preponderant global influence exercised by the US. Furthermore, more recently, the reports have added a separate section on "corruption" as a human rights issue. “Corruption”, a controversial concept from the outset, is understood in a narrow way as a public sector issue that largely prevails in and subverts the so-called developing and transition countries. This book shows how this recent inclusion ultimately serves the US global neoliberal imperialist agenda and becomes the hegemonic discourse in international organisations.     Kurzfassung: This textbook provides an overview of the overlap between the criminal justice system and mental health for students of criminology and criminal justice. It provides an accessible overview of basic signs and symptoms of major mental illnesses and size of scope of justice-involved individuals with mental illness. In the United States, the law enforcement and the criminal justice system is often the first public service to be in contact with individuals suffering from mental illness or in mental distress. Those with untreated mental illnesses are often at higher risk for committing criminal acts, and due to a lack of mental health facilities, resources, and pervasive misconceptions about this population, those with mental illness often end up in the corrections system. This timely work covers the roles of each part of the criminal justice system interacting with mentally ill individuals, from law enforcement and first responders, social services, public health services, sentencing and corrections, to release and re-entry. It also addresses the crucial need of mental healthcare for criminal justice professionals, who suffer from high rates of job stress, PTSD, and other mental health issues.     Kurzfassung: This book critically explores how police power manifested beyond criminal law into the field of public health during the pandemic. Whilst people were engaged with anti-police violence protests, particularly in the US, they were being policed openly and notoriously by the government and medical science in the public health arena. The book explores how public health policing might be an abuse of constitutional power and encourages the abolition question to be applied consistently to the state’s discourse in the area of public health, as black people the world over continue to bear a disproportionate cost burden for public health policies. The chapters explore contemporary policing in terms of the historical context of slavery, the growth of the police and prison abolition movement and how this should be applied more widely, and how police power operates throughout society beyond the criminal justice system, in finance, technology, housing, education, and in medicine and health science. It seeks to re-examine our relationship to health sovereignty and the police power more fundamentally. It provides insights into the convergence of policing and social control of humans and argues that the most normative response is abolition. Tryon P. Woods is Associate Professor of Crime and Justice Studies at the University of Massachusetts, USA, and Special Lecturer in Black Studies at Providence College, USA. Dr. Woods has worked with community-based organizations in New York City, Seattle, and Oakland on HIV/AIDS prevention, supportive housing for drug users, and police accountability. He is the author of Blackhood Against the Police Power: Punishment and Disavowal in the “Post-Racial” Era (Michigan State 2019); co-author of the forthcoming Ex Aqua in the Mediterranean: Excavating Black Power in the Migrant Question (Manchester UP); and co-editor of Conceptual Aphasia in Black: Displacing Racial Formation (Lexington 2016) and On Marronage: Ethical Confrontations with Antiblackness (Africa World Press, 2015).

    Kurzfassung: This book examines the slide into a new Cold War in the Caribbean. The primary argument is that the Caribbean’s geopolitics have shifted from a period of relative great power disinterest in the aftermath of the Cold War to a gradual movement into a new Cold War in which a global rivalry between the U.S. and China is acted out regionally. The result of this is a gradual polarization of countries in the Caribbean as they are increasingly pressured to choose between Washington and Beijing (this being very evident during the Trump years). It can be argued that the U.S. focus on the Caribbean in the late 1990s through the early 21st century diminished, leaving the region open to a China ready and eager to do business and guided by a diverse set of objectives. The book brings the reader into a discussion on international relations with a main focus on U.S.-Chinese relations being played out in the Caribbean, an important strategic region for the North American country.     Kurzfassung: The book is an edited collection of contributions by a distinguished international panel of academics on the main scientific, juridical, and economic aspects involved in the mitigation and adaptation processes imposed by climate change. Explicitly interdisciplinary, the book transversally cuts through different disciplines offering an outline of a phenomenon that is too often left to specific and sectorial insights. The volume is divided into four parts. The first part introduces the main concepts of the book: climate change and sustainability, wellbeing, and mitigation and adaptation. The second part presents the scientific understanding of climate change and explores some of the more pressing issues driving policy development, such as the melting of the glaciers and the impact on coastal areas. The third part discusses significant experiences in the environmental policies both in the European Union and in the United States of America. The last section explains possible approaches to climate change, by exploring the legal and economic aspects of both adversarial and more lenient approaches towards a more sustainable world.     Kurzfassung: Digital healthcare is heterogeneous along the entire treatment pathway, ranging from monitoring applications and artificial-intelligence-based diagnostics, to support for virtual reality surgery. Since the introduction of the Digital Health Act in Germany in early 2020, there has been a push toward digital innovative solutions, especially in the outpatient sector. This book analyzes current digital health law from an economic perspective, combining theory with real-world applications. It examines both the incentives and market access pathways for digital solutions and the price effects brought about by the new regulatory framework in Germany. Further, it discusses the difficulties in pricing due to the monopolistic BfArM register and negotiations with the association of all German health insurance companies. The book addresses a wide range of topics, including incentives for innovation, specifics of digital health applications, reimbursement and financing options for digital health solutions.     Kurzfassung: This book provides a critical analysis of visual images of British and international finance during the nineteenth century. Its focus is on the financiers themselves, contrasting the depiction of the respectable Merchant Princes with the less than perfect charlatans (white-collar criminals) who defrauded investors of millions. The breakdown of trust between financiers and investors that evolved during this period is represented visually in depictions of the emotional response of investors to the uncertain financial climate. Throughout the book a PEARL methodology has been used to critique the images reflecting the impact of any Publisher’s political bias, the Editorial and Artistic techniques used to convey the messages in the images, and the Legal context (especially a concern in countries such as France and Germany where censorship was strict). The book concludes that white-collar criminals were invariably secretly admired in Britain, and rarely severely satirised. Similarly, Merchant Princes were depicted favourably in Britain as members of the ruling elite during the latter half of the century. This is contrasted with the more extreme anti-monopolistic images in the US and the extreme anti-Semitic treatment of Jewish financiers in France and Germany. Henry Sless is currently a Research Associate at Henley Business School at the University of Reading, UK. He received a Master’s in historical cartoons from the University of Kent, UK, and a doctorate in visual images of finance in the Victorian era from the University of Reading.

    Kurzfassung: This book tackles the regulatory issues of Unmanned Aerial Systems (UAS) or Remotely-Piloted Aerial Systems (RPAS), which have profound consequences for privacy, security and other fundamental liberties. Collectively known as “drones,” they were initially deployed for military purposes: reconnaissance, surveillance and extrajudicial executions. Today, we are witnessing a growth of their use into the civilian and humanitarian domain. They are increasingly used for goals as diverse as news gathering, aerial inspection of oil refinery flare stacks, mapping of the Amazonian rain-forest, crop spraying and search and rescue operations. The civil use of drones is becoming a reality in the European Union and in the US.The drone revolution may be a new technological revolution. Proliferation of the next generation of “recreational” drones show how drones will be sold as any other consumer item. The cultural perception of the technology is shifting, as drones are increasingly being used for humanitarian activities, on one hand, but they can also firmly be situated in the prevailing modes of postmodern governance on the other hand. This work will be of interest to researchers in Criminology and Criminal Justice interested in issues related to surveillance, security, privacy, and technology. It will also provide a criminological background for related legal issues, such as privacy law, aviation law, international criminal law, and comparative law.

    Kurzfassung: This book examines the use of image and text juxtapositions in conceptual art as a strategy for challenging several ideological and institutional demands placed on art. While conceptual art is generally identified by its use of language, this book makes clear exactly how language was used. In particular, it asks: How has the presence of language in a visual art context changed the ways art is talked about, theorised and produced? Image and Text in Conceptual Art demonstrates how artworks communicate in context and evaluates their critical potential. It discusses international case studies and draws resources from art history and theory, philosophy, discourse analysis, literary criticism and social semiotics. Engaging the critical and social dimensions of art, it proposes three methods of analysis that consider the work's performative gesture, its logico-semantic relations and the rhetorical operations in the discursive creation of meaning. This book offers a comprehensive method of analysis that can be applied beyond conceptual art.

    Kurzfassung: 1755 marked the point at which events in America ceased to be considered subsidiary affairs in the great international rivalry that existed between the colonial powers of Great Britain and France. This book examines the Braddock Campaign of 1755, a segment of the wider ‘Braddock Plan’ that aimed to drive the French from all of the contested regions they occupied in North America. Rather than being an archetypal military history-styled analysis of General Edward Braddock’s foray into the Ohio Valley, this work will argue that British defeat at the infamous Battle of the Monongahela should be viewed as one that ultimately embodied military, political and diplomatic divergences and weaknesses within the British Atlantic World of the eighteenth century. These factors, in turn, hinted at growing schisms in the empire that would lead to the breakup of British North America in the 1770s and the birth of the future United States. Such an interpretation moves away from the conclusion so often advanced that Braddock’s Defeat was a distinctly, and principally ‘British’, martial catastrophe; hence allowing the outcome of this pivotal event in American history to be understood in a different vein than has hitherto been apparent

    Kurzfassung: This book highlights the importance of the cultural sphere, and in particular literature, in response and discussion with the unprecedented phenomenon known as climate change. Antonia Mehnert turns to a set of contemporary American works of fiction, reading them as a unique response to the challenges of representing climate change. She draws on “climate change fiction”- texts dealing explicitly with anthropogenic climate change-and explores how these works convey climate change, deal with its challenging characteristics, and with what narrative techniques they ultimately participate in its communication. Indeed, a number of challenging traits make climate change a difficult issue to engage with including its slow and long temporal dimension, global scale, scientific controversy, and its disconnect between cause and effect. Considering such complexity and uncertainty at the source of climate change fictions, this book moves beyond a solely ecocritical analysis and shows how these climate change fictions constitute an insightful cultural repertoire valuable for discussion in the environmental humanities in general

    Kurzfassung: The book examines the role of credit rating agencies (CRAs) in the subprime mortgage crisis. The CRAs are blamed for awarding risky securities ‘3-A’ investment grade status and then failing to downgrade them quickly enough when circumstances changed, which led to investors suffering substantial losses. The causes identified by the regulators for the gatekeeper failure were conflicts of interest (as the issuers of these securities pay for the ratings); lack of competition (as the Big Three CRAs have dominated the market share); and lack of regulation for CRAs. The book examines how the regulators, both in the US and EU, have sought to address these problems by introducing soft law self-regulation in accordance with the International Organisation of Securities Commissions Code and hard law statutory regulation, such as that found in the “Reform Act” and “Dodd-Frank Act” in the US and similar provisions in the EU. The highly topical book examines these provisions in detail by using a doctrinal black-letter law method to assess the success of the regulators in redressing the problems identified. It also examines the US case law regulation relating to the legal liability of CRAs. The book examines whether the regulations introduced have had a deterrent effect on the actions of CRAs, whether investors are compensated for their losses, and how the regulators have dealt with the issues of conflicts of interest and an anti-competitive environment. Should liability be introduced for CRAs through changes in the law so as to compel them to issue reliable ratings and solve the current problems? The book seeks to simplify the complex issues involved and is backed by concrete evidence; as such, it will appeal to both the well-informed and the lay general public who are interested in learning more about the role of CRAs in the sub-prime mortgage crisis and regulators’ attempts to remedy the situation.     Kurzfassung: This research examines the role of prosecutors within the United States and in Switzerland and is completed by an overview of the prosecution institutions in France and Germany. The research recognizes that despite seemingly very different legal traditions and structures, prosecutors in these systems are similar enough that each system might learn from the others. Drawing upon the experiences of other nations, this research proposes solutions to the problems identified in connection with the position and powers of public prosecutors in the United States. Furthermore, it outlines the problems related to the increase of prosecutorial power and the lessons the European criminal justice systems surveyed can draw from the experience in the US. In terms of methodology, this research not only considers formal legal provisions but also systematic structural factors, academic literature and statistics revealing how the law and governing principles actually work in practice.
