    Abstract: After decades of regulation and investment to reduce point source water pollution, OECD countries still face water quality challenges (e.g. eutrophication) from diffuse agricultural and urban sources of pollution, that is disperse pollution from surface runoff, soil filtration and atmospheric deposition. The relative lack of progress reflects the complexities of controlling multiple pollutants from multiple sources, their high spatial and temporal variability, associated transactions costs, and limited political acceptability of regulatory measures. This report outlines the water quality challenges facing OECD countries today, presents a range of policy instruments and innovative case studies of diffuse pollution control, and concludes with an integrated policy framework to tackle diffuse water pollution. An optimal approach will likely entail a mix of policy interventions reflecting the basic OECD principles of water quality management – pollution prevention, treatment at source, the polluter pays and beneficiary pays principles, equity, and policy coherence.

    Abstract: BEPS Action 5 is one of the four BEPS minimum standards which all Inclusive Framework members have committed to implement. One part of the Action 5 minimum standard is the transparency framework for compulsory spontaneous exchange on certain rulings which, in the absence of transparency, could give rise to BEPS concerns. Over 100 jurisdictions have joined the Inclusive Framework and will take part in a peer review to assess their compliance with the transparency framework. Specific terms of reference and a methodology have been agreed for the peer reviews to assess a jurisdiction’s implementation of the minimum standard. The review of the transparency framework assesses countries against the terms of reference which focus on five key elements: i) information gathering process, ii) exchange of information, iii) confidentiality of the information received; iv) statistics on the exchanges of rulings; and v) transparency on certain aspect of intellectual property regimes. This report reflects the outcome of the first peer review of the implementation of the Action 5 minimum standard. It covers the jurisdictions which participated in the BEPS Project prior to the creation of the Inclusive Framework, and it assesses implementation for the 1 January 2016 – 31 December 2016 period.

Through a series of personal narratives, photos and artwork, it demonstrates that in spite of the dominant discourse surrounding their lives, the consumption and behaviour patterns of young women in these bustees challenge the monolithic representations of what it means to be a Muslim girl in Indian society. It explores the ways in which the young Muslim women live, manipulate, and resist the stereotypes of Islamic femininity by carefully negotiating the risks and performing multiple identities inspired by modernity, globalization and, most of all, Bollywood culture. Based on extensive surveys and interviews and through presenting and investigating the various meanings of jihād, the author explores the usage of non-Eurocentric conceptual approaches to the study of postcolonial and Muslim societies, in particular the meaning it carries in the psyche of the Muslim community. She argues that through means of argumentative and spiritual jihād, Indian Muslims fight their battle towards a realisation of citizenship ideals despite the unfavourable conditions of intra and inter community conflicts.     Abstract: "The right of indigenous peoples to Free Prior and Informed Consent (FPIC) in relation to natural resource extraction in their territories is a principle that is increasingly recognised by intergovernmental organizations, international bodies, conventions and international human rights law as well as in the domestic law of some States. This book offers a comprehensive overview of the status of Free Prior and Informed Consent under international human rights law, considering the main controversies, obstacles and challenges associated with its recognition and implementation. The book examines the relationship between Free Prior and Informed Consent and territorial, resource and governance rights. The historical basis for FPIC is considered as well as the legitimacy of the dominant doctrines of exclusive State ownership of subsoil resources. The book argues that FPIC constitutes an emerging norm of international law with a tipping point having been reached in terms of the requirements recognition, both within and beyond the human rights regime. It draws on emerging jurisprudence from around the world, as well as evolving industry standards and policies, to illustrate the growing recognition of the fact that respect for the consent requirement is fundamental to securing indigenous peoples self-governance and territorial rights"--

    Abstract: Today, the generation and use of huge volumes of data are redefining our “intelligence” capacity and our social and economic landscapes, spurring new industries, processes and products, and creating significant competitive advantages. In this sense, data-driven innovation (DDI) has become a key pillar of 21st-century growth, with the potential to significantly enhance productivity, resource efficiency, economic competitiveness, and social well-being. Greater access to and use of data create a wide array of impacts and policy challenges, ranging from privacy and consumer protection to open access issues and measurement concerns, across public and private health, legal and science domains. This report aims to improve the evidence base on the role of DDI for promoting growth and well-being, and provide policy guidance on how to maximise the benefits of DDI and mitigate the associated economic and societal risks.

    Abstract: "The adoption of the Convention on the Rights of People with Disabilities (CPRD) by the United Nations in 2006 marked a major watershed. The CRPD is the first comprehensive and binding treaty on the rights of people with disabilities. It establishes the right of people with disabilities to equality, dignity, autonomy, full participation as well as specific rights including the right to live in the community, supported decision-making and inclusive education. Prior to the CRPD, international law had provided only limited protections to people with disabilities, although some countries had begun to incorporate rights protections into their respective domestic legislation.This book analyses the development of disability rights as an international human rights movement, in selected countries in Asia, Africa, and the Middle East as well as the United States. The book begins with an examination of the status of people with disabilities under international law prior to the adoption of the CPRD and follows the development of human rights protections through the drafting process of the CRPD. People with disabilities, like women and children before them, waged a battle to enforce their rights on the international stage against a backdrop of changing international norms. The book highlights four areas the right to legal capacity (article 12), the right to liberty and freedom from torture (articles 14 and 15), the right to live in the community (article 19), and the right to inclusive education, in order to the transformation from the charity/deficit/medical model of disability to the human rights mode. These areas are analyzed from a comparative perspective including a discussion of the laws, policies, and practices in selected countries in order to show the success of the CRPD in achieving protections depends on the extent to which individual countries begin to enforce domestic laws and policies and the extent to which various societies change their attitudes about people with disabilities"--

    Abstract: "Objects of worship are an aspect of the material dimension of lived religion in South Asia. The omnipresence of these objects and their use is a theme which cuts across the religious traditions in the pluralistic religious culture of the region. Divine power becomes manifest in the objects and for the devotees they may represent power regardless of religious identity. This book looks at how these objects dominate the religious landscape of South Asia, and how they are of significance not just to the religious but also the social life of the region. The question of whether states should restrict the wearing of headscarves and other religious symbols has been particularly critical in guiding this thought process. Refashioning Secularisms in France and Turkey documents how, in both countries, devout women have contested bans on headscarves, pointing to how these are inconsistent with the 'real' spirit of secularism. These activists argue that it is possible to be simultaneously secular and religious; to believe in the values conveyed by secularism, while still remaining devoted to their faith. Through this examination, the book highlights how activists locate their claims within the frame of secularism, while at the same time revisiting it to craft a space for their religiosity.     Abstract: "Presenting a fundamental re-thinking of Asian theology, this book focuses on theological indigenization in Asia in light of the postcolonial theory of resistance advanced by Homi K. Bhabha, among others. Two types of anti-colonialist resistance within Asian theologies are identified and interrogated. The first is nationalistic in kind, operating from a theological language that is binaristic and oppositional. The second is illustrated by that which was mounted by the three Chinese Christian thinkers whose indigenous theologies are analysed in this book as case studies. This second kind, postcolonial in its character, is characterized by collaboration rather than antagonistic binarism. In spite of much dissimilarity between these two kinds of resistance, the book argues that they are similarly anti-colonialist, and both can be equally valid in resisting colonial forces. Given that the binarism and antagonism imbedded in the Asian theological movement are historically contingent, and that the sole reliance on this resistance has made the movement self-ensnaring, the book suggests that the Asian theological movement widen its choice of colonial-resistant strategies. Drawing attention to the otherwise subtle politics of the Asian theological indigenization discourse, this book addresses the relationship between postcolonialism and Asia contextual theology, and is of interest to students and scholars of Asian Religion and Philosophy"--

    Abstract: "This highly original work demonstrates the role and importance of customary law as the primary source of law for indigenous peoples all over the world. The book reviews the relationship between customary, positive and natural law from the time of Plato up to the present day. It examines its recognition in constitutional law and in international human rights and environmental instruments. The author analyses the role of customary law in tribal, national and international governance of indigenous peoples' lands, resources and cultural heritage. He explores the challenges and opportunities for its recognition by courts and alternative dispute resolution mechanisms, including issues of proof of law and conflicts between customary practices and human rights.     Abstract: Base erosion constitutes a serious risk to tax revenues, tax sovereignty and tax fairness for many countries. While there are many ways in which domestic tax bases can be eroded, a significant source of base erosion is profit shifting. This report presents the studies and data available regarding the existence and magnitude of base erosion and profit shifting (BEPS), and contains an overview of global developments that have an impact on corporate tax matters and identifies the key principles that underlie the taxation of cross-border activities, as well as the BEPS opportunities these principles may create. The report concludes that current rules provide opportunities to associate more profits with legal constructs and intangible rights and obligations, and to legally shift risk intra-group, with the result of reducing the share of profits associated with substantive operations. The report recommends the development of an action plan to address BEPS issues in a comprehensive manner.
