    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: Social mobility is the hope of economic development and the mantra of a good society. There are disagreements about what constitutes social mobility, but there is broad agreement that people should have roughly equal chances of success regardless of their economic status at birth. Concerns about rising inequality have engendered a renewed interest in social mobility - especially in the developing world. However, efforts to construct the databases and meet the standards required for conventional analyses of social mobility are at a preliminary stage and need to be complemented by innovative, conceptual, and methodological advances. If forms of mobility have slowed in the West, then we might be entering an age of rigid stratification with defined boundaries between the always-haves and the never-haves - which does not augur well for social stability.

    Abstract: Social mobility is the hope of economic development and the mantra of a good society. There are disagreements about what constitutes social mobility, but there is broad agreement that people should have roughly equal chances of success regardless of their economic status at birth. Concerns about rising inequality have engendered a renewed interest in social mobility—especially in the developing world. However, efforts to construct the databases and meet the standards required for conventional analyses of social mobility are at a preliminary stage and need to be complemented by innovative, conceptual, and methodological advances. If forms of mobility have slowed in the West, then we might be entering an age of rigid stratification with defined boundaries between the always-haves and the never-haves—which does not augur well for social stability. Social mobility research is ongoing, with substantive findings in different disciplines—typically with researchers in isolation from each other. A key contribution of this book is the pulling together of the emerging streams of knowledge. Generating policy-relevant knowledge is a principal concern. Three basic questions frame the study of diverse aspects of social mobility in the book. How to assess the extent of social mobility in a given development context when the datasets by conventional measurement techniques are unavailable? How to identify drivers and inhibitors of social mobility in particular developing country contexts? How to acquire the knowledge required to design interventions to raise social mobility, either by increasing upward mobility or by lowering downward mobility?...

    Abstract: "To survive, let alone flourish, we need to be sure of - securely tied to - at least one other person. We also need to be sure of our general acceptance within the wider social world. This book explores the normative implications of taking our core social needs seriously. Chapter 1 sketches out what those needs are, and Chapter 2 shows that they ground a fundamental, but largely neglected human right against social deprivation. Chapter 3 then argues that this human right includes a right to sustain the people we care about, and that often, when we are denied the resources to sustain others, we endure social contribution injustice. Chapters 4 - 6 explore the tension between our needs for social inclusion and our needs for interactive and associative freedom, showing that social inclusion must take priority. While Chapters 5 and 6 defend a narrow account of freedom of association, Chapter 7 shows that the moral ballgame changes once we have made morally messy associative decisions. Sometimes we have rights remain in associations that we had no right to form. Finally, Chapter 8 exposes the distinct social injustices that we do to people whom we deem to be socially threatening. Overall, the book identifies ways to change our social and political practices, and our personal perspectives, to better honour the fact that we are fundamentally social beings."

Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise.     Abstract: The very concept of human rights implies governmental accountability. To ensure that governments are indeed held accountable for their treatment of citizens and others the United Nations has established a wide range of mechanisms to monitor compliance, and to seek to prevent as well as respond to violations. The panoply of implementation measures that the UN has taken since 1945 has resulted in a diverse and complex set of institutional arrangements, the effectiveness of which varies widely. Indeed, there is much doubt as to the effectiveness of much of the UN's human rights efforts but also about what direction it should take. Inevitable instances of politicization and the hostile, or at best ambivalent, attitude of most governments, has at times endangered the fragile progress made on the more technical fronts. At the same time, technical efforts cannot dispense with the complex politics of actualizing the promise of human rights at and through the UN. In addition to significant actual and potential problems of duplication, overlapping and inconsistent approaches, there are major problems of under-funding and insufficient expertise. The complexity of these arrangements and the difficulty in evaluating their impact makes a comprehensive guide of the type provided here all the more indispensable. These essays critically examine the functions, procedures, and performance of each of the major UN organs dealing with human rights, including the Security Council and the International Court of Justice as well as the more specialized bodies monitoring the implementation of human rights treaties. Significant attention is devoted to the considerable efforts at reforming the UN's human rights machinery, as illustrated most notably by the creation of the Human Rights Council to replace the Commission on Human Rights. The book also looks at the relationship between the various bodies and the potential for major reforms and restructuring.

    Abstract: This book challenges conventional wisdoms both about economic performance and about policies for economic development in African countries. Its starting point is the striking variation in economic performance: unevenness and inequalities form a central fact. The authors highlight not only differences between African countries but also variations within countries, differences often organized around distinctions of gender, class, and ethnic identity. For example, school dropout and neonatal mortality have been reduced, particularly for some classes of women in some areas. Horticultural and agribusiness exports have grown far more rapidly in some countries than others. These variations (and many others) point to opportunities for changing performance, reducing inequalities, learning from other African policy experiences, and escaping the ties of structure and legacies of a colonial past. The book rejects teleological illusions and Eurocentric prejudice, but does pay close attention to the results of policy in more industrialized parts of the world. Seeing the contradictions of capitalism for what they are—fundamental and enduring—may help policy officials protect themselves against the misleading idea that development is likely to be a smooth, linear process, or that it would be were certain impediments removed. The authors criticize a wide range of orthodox and heterodox economists, especially for their cavalier attitude to statistical sources. Drawing on decades of research and policy experience, they combine careful use of available evidence from a range of African countries with heterodox political economy insights (mainly derived from Kalecki, Kaldor, and Hirschman) to make the policy case for specific types of public sector investment
