    Abstract: This collection explores some of the many ways in which constitutional orders engage with, and are shaped by, their exteriors. Constitutional and legal theory often marginalize 'foreign' elements, such as norms originating in other legal systems, the movement of individuals across borders, or the application of domestic law to foreign affairs. In The Double-Facing Constitution, these instances of boundary crossing lie at the heart of an alternative understanding of constitutions as permeable membranes, through which norms can and sometimes must travel. Constitutional orders are facing both inwards and outwards - and the outside world influences their interiors just as much as their internal orders help shape their surroundings. Different essays discuss the theoretical and historical foundations of this view (grounded in Kelsen, Hobbes, Locke, Rousseau and others), and its contemporary relevance for areas as diverse as migration law, the conflict of laws, and foreign relations law.

    Abstract: Constituent power is the power to create new constitutions. Since it is frequently exercised during or after political revolutions, it has been historically associated with extra-legality and violations of the established legal order. This book examines the relationship between constituent power and the law and the place of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges havederived from it. 0Since the 18th and 19th centuries, commentators and citizens have relied on the concept of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. More recently, several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, totrigger constitution-making episodes that may result in the replacement of the entire constitutional order.0Constitutional courts have employed constituent power to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have reverted to it to defend the legality of transforming the constitutional order through procedures not contemplated in the constitution's amendment rule, but considered participatory enough to be equivalent to 'the people in action', and these0attempts have sometimes been sanctioned by courts. 0

Das Leitbild steht für die Verantwortung und die Legitimität des Staates unter den Bedingungen der Digitalisierung. Enrico Peuker entfaltet es exemplarisch in den verfassungsrechtlichen Kontexten der digitalen Infrastrukturen sowie der »digitalen« Grundrechte. Er plädiert für eine erweiterte Lesart der staatlichen Infrastrukturverantwortung als Optimierungsrecht hinsichtlich des Breitbandausbaus und der IT-Sicherheit und verortet die Grundrechtsentwicklungen in einem Drei-Stufen-Modell aus Interpretation, Innovation und Kodifikation.
    Abstract: Digitalization has transformed modern life and left no part of society untouched. Enrico Peuker analyzes the impact digitalization has and will have on Germany's Basic Law from the perspective of structural constitutional change. Focusing on constitutional aspects of digital infrastructures and the protection of fundamental rights in the digital age, he develops and concretises the constitutional guiding principle of digital sovereignty.

Florian Meinel untersucht das Verfassungsrecht dieses Regierungssystems aus der indirekten Perspektive der oft als bloße Geschäftsordnungsautonomie missverstandenen parlamentarischen Selbstorganisation. Sie ist nie nur introvertierte Selbststeuerung des parlamentarischen Lebens, sondern immer auch Zugriff auf die parlamentarisch verantwortliche Regierung. Dies führt zurück zu höchst unterschiedlichen Begründungen jener Autonomie seit dem Revolutionszeitalter, demonstriert die Langlebigkeit spätkonstitutioneller Muster im deutschen Verständnis des Parlaments und weist voraus auf die Zukunftsfrage der parlamentarischen Regierungssysteme: ihre institutionelle Anpassungsfähigkeit.

    Abstract: Comparative constitutional law has a long pedigree, but the comparative study of constitution-making has emerged and taken form only in the last quarter-century. While much of the initial impetus came from the study of the American and French constituent assemblies in the late eighteenth century, this volume exemplifies the large comparative scope of current research. The contributors discuss constituent assemblies in South East Asia, North Africa and the Middle East, Latin America, and in Nordic countries. Among the new insights they provide is a better understanding of how constituent assemblies may fail, either by not producing a document at all or by adopting a constitution that fails to serve as a neutral framework for ordinary politics. In a theoretical afterword, Jon Elster, an inspirational thinker on the current topic, offers an analysis of the micro-foundations of constitution-making, with special emphasis on the role of crises-generated passions.

    Abstract: Verfassungsgeschichte und Privatrechtsgeschichte gehen gewöhnlich getrennte Wege. Doch werden sie damit ihren Gegenständen nicht gerecht, denn Verfassung und Privatrecht stehen in enger Beziehung zueinander, und das nicht erst, seit im 20. Jahrhundert die Drittwirkung der Grundrechte entdeckt wurde. Die Beziehungen wechseln freilich mit den Begleitumständen. Sie stellten sich in Frankreich, wo der Übergang von monarchischem Absolutismus und ständisch-feudaler Gesellschaftsordnung zur bürgerlichen Staats- und Sozialordnung in einem revolutionären Akt des bereits emanzipierten Bürgertums herbeigeführt wurde, anders dar als in Deutschland, wo die Umstellung von der Obrigkeit ausging und sich in einem langen, rechtsförmigen Prozess evolutiv vollzog.     Abstract: This book provides an account and explanation of a fundamental dilemma facing secular states: the "legitimacy gap" left by the withdrawal of religion as a source of legitimacy. Legitimacy represents a particular problem for the secular state. The "secular" in all its manifestations is very much linked to the historical rise of the modern state. It should not be seen as a category that separates culture and religion from politics, but rather as one that links these different dimensions. In the first part of the book, Depaigne explains how modern constitutional law has moved away from a "substantive" legitimacy, based in particular on natural law, towards a 'procedural' legitimacy based on popular sovereignty and human rights. Depaigne examines three case studies of constitutional responses to legitimacy challenges which articulate the three main sources of "procedural" legitimacy (people, rights, and culture) in different ways: the "neutral model" (constitutions based on the "displacement of culture"); the "multicultural model" (constitutions based on diversity and pluralism); and the "asymmetric model" (constitutions based on tradition). Even if secularization can be considered European in its origin, it is best seen today as a global phenomenon, which needs to be approached by taking into account the particular cultural dimension in which it is rooted. Depaigne's detailed study shows how secularization has moved either towards "nationalization" linked to a particular national identity (as in France and, to some extent, in India)-or towards "de-secularization", whereby secularism is displaced by particular cultural norms, as in Malaysia --Front flap of book

Im Mittelpunkt steht eine Theorie der dynamischen Entwicklung der kindlichen Selbstbestimmungsfähigkeit, die dem Kind einen Anspruch verleiht, an der Entscheidung über seine eigenen Angelegenheiten in jedem Lebensalter angemessen beteiligt und in seinen individuellen Belangen berücksichtigt zu werden.

    Abstract: Neben der Gerechtigkeit ist die Rechtssicherheit einer der Hauptzwecke des Rechts. Bei der Gestaltung von Rechtsregeln spielt sie die Rolle eines Fluchtpunkts. Aus dem rechtlichen Diskurs einer institutionalisierten Rechtsordnung, zumal der deutschen, aber auch einer gemeineuropäischen, ist sie nicht wegzudenken. Andreas von Arnauld verdeutlicht und rekonstruiert eine idée directrice des Rechts, die gerade wegen ihrer Allgegenwart im juristischen Diskurs Gefahr läuft, verschüttet zu werden. Er legt dabei einen primär induktiv-phänomenologischen Ansatz zu Grunde. Aus verschiedenen Blickwinkeln heraus (begriffsgeschichtlich, genealogisch, topologisch, antinomisch) leuchtet er die Teleologie der Rechtssicherheit, ihre wesentlichen normativen Strukturen sowie Erscheinungsformen und Verwendungen des Rechtssicherheitsarguments aus. Ein Schwerpunkt liegt dabei auf einer Darstellung der Vielschichtigkeit, mit welcher die Forderung nach Rechtssicherheit im deutschen öffentlichen Recht der Gegenwart umgesetzt wird. Der kritisch-wertende Vergleich mit anderen europäischen Rechtsordnungen trägt dazu bei, Einseitigkeiten der nationalen Perspektive zu korrigieren und einen differenzierten Blick auf Inhalt und Funktionsweise eines Verfassungsprinzips Rechtssicherheit zu werfen, welches vom Bundesverfassungsgericht seit langem dem Grundgesetz entnommen wird.
    Abstract: In addition to justice, legal certainty is one of the main objectives of the law. We cannot imagine the legal discourse of an institutionalized legal order, particularly the German legal order, without it. Andreas von Arnauld explains and reconstructs an idée directrice of the law, which precisely because of its omnipresence in the legal discourse is in danger of being consigned to oblivion. The author examines teleology, normative structures and manifestations of legal certainty from different perspectives, i.e. genealogical, topological and comparative, in order to give a differentiated picture of this general principle of law. The comparison with other European legal systems contributes to a correction of the one-sidedness in the national perspective.

    Abstract: Arnd Uhle untersucht das Verhältnis von freiheitlichem Verfassungsstaat und kultureller Identität, das bislang kaum – wenn, dann lediglich partiell – erforscht wurde. Der Autor beleuchtet die Relevanz der kulturellen Identität für Entstehung, Gestalt und Fortbestand des freiheitlichen Verfassungsstaates aus verfassungstheoretischer, aus verfassungsrechtlicher und schließlich aus europarechtlicher Perspektive.Bereits aus verfassungstheoretischer Sicht ergibt sich dabei, daß die kulturelle Identität gleichermaßen Entstehungs- wie auch Geltungsbedingung freiheitlicher Verfassungsstaatlichkeit ist, weil der freiheitliche Staat in vielfältiger Weise an die kulturelle Identität anknüpft. Eine Betrachtung aus verfassungsrechtlicher Perspektive unterstreicht diesen Befund und belegt, daß namentlich das deutsche Grundgesetz in einer prima facie zwar komplex und unüberschaubar erscheinenden, letztlich aber systematisch geordneten und differenzierenden Weise an die kulturelle Identität anknüpft – und diese angesichts ihrer Bedeutung für den dauerhaften Fortbestand des freiheitlichen Verfassungsstaates überdies durch das in der Habilitationsschrift erstmals entfaltete grundgesetzliche Staatsziel der Vitalität und Dauerhaftigkeit der freiheitlichen Verfassungsordnung mit verfassungsrechtlichem Schutz umhegt. In der Konsequenz dieses Staatsziels ist der grundgesetzgebundene Staat zur Pflege und zum Schutz der kulturellen Identität verpflichtet. Eine abschließende europarechtliche Betrachtung verdeutlicht, daß die grundgesetzliche Anknüpfung an die kulturelle Identität wie auch deren verfassungsrechtliche Sicherung den Schutz des Art. 6 Abs.3 EUV genießen, der die Achtung der nationalen Identität anordnet.

    Abstract: Against the backdrop of South Africa's transition from apartheid, this provocative book explores the role of late twentieth century constitutionalism in facilitating political change. Using South Africa as a case study, Klug's larger project is to investigate why there has been renewed faith in justiciable constitutions and democratic constitutionalism despite the widespread recognition that courts are institutionally weak, lack adequate resources and are largely inaccessible to most citizens.
