Series Statement: International law in domestic legal orders
Keywords: Menschenrechtsverletzung ; Internationales Strafrecht ; Transitional Justice ; Rechtswissenschaft ; Rechtspflege ; Kollektives Gedächtnis ; Lateinamerika ; Osteuropa
Abstract: After the fall of military and communist dictatorships at the end of the 1980s, Latin American and Eastern European countries had to reckon with atrocities perpetrated by these Cold War regimes. Judges, prosecutors, and human rights campaigners across the two regions constructed novel readings of international criminal law to fight impunity and realize justice for gross human rights violations. Justice and Memory after Dictatorship: Latin America, Central Eastern Europe and the Fragmentation of International Criminal Law provides a groundbreaking socio-historical account of the global transformation of international criminal law from these two semi-peripheries of the world system. Based on ethnographic observation and analyses of jurisprudence, Raluca Grosescu dissects the narratives that were fundamentally shaped by the relationship of law and politics. Using paradigmatic cases and personal interviews with lawyers and judicial officials from Latin America and Eastern Europe, Grosescu uncovers how legal actors and organizations were instrumental in questioning an international order that marginalized the political violence that had unfolded in the two regions during the Cold War.

Abstract: The closing decade of the 20th century witnessed dramatic upheavals across landscapes that had once housed most of the world's Jewish population: the overturning of the East European Communist governments and the fall of the USSR, accompanied by a major Jewish emigration movement. The experts contributing to this volume apply interdisciplinary approaches to analyze and interpret the shifting post-communist social and political realities and aid our understanding of recent events.

Abstract: 'Navigating Cultural Memory' examines how a master narrative of the 1994 Genocide Against the Tutsi evolved into a hegemonic narrative both in Rwanda and globally. Identifying key actors who shaped and responded to the evolution and enforcement of the master narrative in the first two decades after the genocide and civil war ended, it engages with important questions about collective memory, trauma, and power following violent and divisive events.

Abstract: 'Terrorism in American Memory' argues that the terrorist attacks of 9/11 and all that followed in its wake were the primary force shaping United States politics and culture in the post-9/11 era. Marita Sturken maintains that during the past two decades, when the country was subjected to terrorist attacks and promulgated ongoing wars of aggression, America has veered into increasingly polarized factions and been extraordinarily preoccupied with memorialization and the politics of memory.

Abstract: This text examines the ways individuals in the US and Russia consume and construct collective memories of political events via a reestablished Cold War-like narrative in both media systems. The book contextualizes the rebirth of this phenomenon via seven political events involving Russia, examining the contemporary role of conscious media distrust in subconscious psychological processes.

Abstract: This book presents new interpretations of current healing practices in Cuba and the Dominican Republic juxtaposed against the European colonization of the Caribbean after 1492. By combining data from critical historical analyses and ethnographic fieldwork, this research examines current healing landscapes and their historical background in both countries. This dissertation situates the continuous importance of non-institutional healing practices within the rich symbolism of Cuban and Dominican landscapes. More specifically, the study focuses on practices promoting physical, mental and spiritual healing of individuals and communities. It provides various examples that illustrate human interactions with divine and ancestral beings residing in places such as water sources, caverns, or manifested in plants and other natural phenomena. Data presented in this work guides our understanding of how local cultural memory plays a key role in our construction of medicinal histories, and the profound demographic and landscape transformations which shaped the healing landscapes after European conquest. Healing landscapes are also testimonies of the Cuban and Dominican ancestors' creativity, resilience, capacity to heal and find unity in the dehumanizing and alienating atmosphere of colonial violence and exploitation. This book is not aimed solely for academic public, but also those interested in Caribbean cultures, and the history of medicinal practices.

Abstract: This volume addresses long-term effects of democratic transitions on social movements in Italy, Greece, Portugal, and Spain. From the theoretical point of view, the main focus of reflection is on the long-term impact of eventful moments on social movements, especially the causal mechanisms through which legacies and memories of transformative protest events are produced and reproduced over time, enhancing and constraining contemporary movements' repertoires and frames.

Abstract: El Salvador's civil war began in 1980 and ended twelve bloody years later. It saw extreme violence on both sides. Examining El Salvador's vibrant life-story literature written in the aftermath of this terrible conflict - including memoirs and testimonials - Erik Ching seeks to understand how the war has come to be remembered and rebattled by Salvadorans and what that means for their society today.

Abstract: On December 29, 1890, the US Seventh Cavalry killed more than 200 Lakota Ghost Dancers - including men, women, and children - at Wounded Knee Creek, South Dakota. After the work of death ceased at Wounded Knee Creek, the work of memory commenced. For the US Army and some whites, Wounded Knee represented the site where the struggle between civilization and savagery for North America came to an end. For other whites, it was a stain on the national conscience, a leading example of America's dishonorable dealings with Native peoples. For Lakota people it was the site of the 'biggest murders', where the United States violated its treaty promises and slaughtered innocents.

Abstract: Despite much scholarship on the Holocaust, little has focused on what happened to Europe's Jewish communities after the war. Unlike many other nations, France had a significant post-war Jewish community. This volume offers insights on key aspects of French Jewish life in the following decades. It examines the ways in which moral and political issues of responsibility combined with the urgent problems and practicalities of restoration, and illustrates how national imperatives, international dynamics, and a changed self-perception helped to shape the fortunes of post-war French Judaism.

Abstract: Memorial sites, sites of âdark tourism,â are vernacular spaces that are continuously negotiated, constructed, and reconstructed into meaningful places. Using the locale of the 9/11 tragedy, Joy Sather-Wagstaff  explores the  constructive role played by tourists in understanding social, political, and emotional impacts of a violent event that has ramifications far beyond the local population. Through in-depth interviews, photographs, graffiti, even souvenirs, she compares the 9/11 memorial with other hurtful sitesâthe Oklahoma City National Memorial, Vietnam Veteranâs Memorial, and othersâto show how tourists construct and disperse knowledge through performative activities, which make painful places salient and meaningful both individually and collectively.

Abstract: This interdisciplinary series addresses the relation between media and cultural memory. Its publications study how media construct, store, and disseminate memory. The series' focus is on different media and technologies, such as text and image, the cinema and the new digital media, on transmediality, intermediality, and remediation, as well as on the social (and increasingly transnational and transcultural) contexts of mediated memory. The aim of the series is to provide a vibrant international platform for research and scholarly exchange in the field of media and memory studies. Manuscripts submitted to the series are peer reviewed by expert referees.

Abstract: Building on a well founded criticism of gaps in the usual memory and remembrance concepts, and with the help of contemporary projects of remembrance work, Karsten Michael Drohsel develops a social figure for the methodization of a new remembrance that can be individually practiced and experienced. This is assisted by practices of attentive walking, which were developed from flânerie. The central momentum of the study lies in the question for the translation and handing over of memories in places where memories arise or to which they can be tied. This new form of remembrance activity includes individual and collective remembering into the existing discourse of memory and remembrance and elaborates the potentials of both modes without determining them.

Abstract: This title draws together three significant areas of inquiry: Jewish music, German culture, and the legacy of the Holocaust. Jewish music - a highly debated topic - encompasses a multiplicity of musics and cultures, reflecting an inherent and evolving hybridity and transnationalism. German culture refers to an equally diverse concept that, in this volume, includes the various cultures of prewar Germany, occupied Germany, the divided and reunified Germany, and even 'German (Jewish) memory,' which is not necessarily physically bound to Germany.

Abstract: "Remembering the past, especially as collectivity, is a political process, thus the politics of memory and commemoration is an integral part of the establishment of new political regimes, new identities, and new principles of political legitimacy. This volume is about the explosion of the politics of memory triggered by the fall of state socialism in Eastern Europe, particularly about the politics of its commemoration twenty years later. It offers seventeen in-depth case studies, an original theoretical framework, and a comparative study of memory regime types and their origins. Four different kinds of mnemonic actors are identified: mnemonic warriors, mnemonic pluralists, mnemonic abnegators, and mnemonic prospectives. Their combinations render three different types of memory regimes: fractured, pillarized, and unified. Disciplined comparative analysis shows how several different configurations of factors affect the emergence of mnemonic actors and different varieties of memory regimes. There are three groups of causal factors that influence the political form of the memory regime: the range of structural constraints the actors face (e.g., the type of regime transformation), cultural constraints linked to past political conflict (e.g., salient ethnic or religious cleavages), and cultural and strategic choices actors make (e.g. framing post-communist political identities)"--

Abstract: At the end of the First World War, Germany appeared to have lost everything: the lives of millions of soldiers and civilians, control over borderland territories, and, above all, a sense of national self-worth in the international political arena. But it also lost almost three million square kilometres of land overseas in the form of colonies and concessions in Africa, China, and the Pacific. Allied powers declared Germany unfit to rule over overseas populations, and it was forcibly decolonized. It thus became the first ‘postcolonial’ European nation to participate in the ‘new imperialism’ of the modern era. The end of colonialism was the beginning of a memory culture that has been remarkably long-lived and dynamic. This book traces the evolution of the collective memory of German colonialism, stretching from the loss of the colonies across the eras of National Socialism, national division, and the Cold War to the present day. It shows to what extent this memory was intimately bound to objects of material culture in the former colonial metropole, from tropical fruit sold at colonial balls, to state gifts handed to the former colonies at independence, to ethnological items kept as family heirlooms. Drawing on a wide range of sources, the study marks an important shift in historical methodology, considering the significance of both material culture and private memories in constructing accounts of the past. Above all, it raises important questions about the public responsibilities of postcolonial nations and governments in Europe and their relationship to the private legacies of colonialism. Abstract: How is the historical past made to appear in the present? In addressing this question, Murray reveals how collective memory is stored and disseminated in architecture, statuary, monuments and memorials, literature, and art - 'landscapes of remembrance' that selectively recall and even fabricate history in the service of nation-building.

Abstract: In Ernst's media theory, archaeology becomes archivological analysis that refuses to stay on the interface level. Instead, it reveals the technological conditions of our contemporary techniques of memory and time. The archivological approach focuses on the infrastructure of media historical knowledge. With an extended concept of the archive, a media archaeological and archivological approach to the past means that media can not be made into 'historical' objects of research only.

Abstract: The public memory of slavery and the Atlantic slave trade, which some years ago could be observed especially in North America, has slowly emerged into a transnational phenomenon now encompassing Europe, Africa, and Latin America, and even Asia - allowing the populations of African descent, organized groups, governments, non-governmental organizations and societies in these different regions to individually and collectively update and reconstruct the slave past. This edited volume examines the recent transnational emergence of the public memory of slavery, shedding light on the work of memory produced by groups of individuals who are descendants of slaves. The chapters in this book explore how the memory of the enslaved and slavers is shaped and displayed in the public space not only in the former slave societies but also in the regions that provided captives to the former American colonies and European metropoles. Through the analysis of exhibitions, museums, monuments, accounts, and public performances, the volume makes sense of the political stakes involved in the phenomenon of memorialization of slavery and the slave trade in the public sphere.

Abstract: Modern historiography embraces the notion that time is irreversible, implying that the past should be imagined as something 'absent' or 'distant.' Victims of historical injustice, however, in contrast, often claim that the past got 'stuck' in the present and that it retains a haunting presence. History, Memory, and State-Sponsored Violence is centered around the provocative thesis that the way one deals with historical injustice and the ethics of history is strongly dependent on the way one conceives of historical time; that the concept of time traditionally used by historians is structurally more compatible with the perpetrators' than the victims' point of view. Demonstrating that the claim of victims about the continuing presence of the past should be taken seriously, instead of being treated as merely metaphorical, Berber Bevernage argues that a genuine understanding of the 'irrevocable' past demands a radical break with modern historical discourse and the concept of time. By embedding a profound philosophical reflection on the themes of historical time and historical discourse in a concrete series of case studies, this project transcends the traditional divide between 'empirical' historiography on the one hand and the so called 'theoretical' approaches to history on the other. It also breaks with the conventional 'analytical' philosophy of history that has been dominant during the last decades, raising a series of long-neglected 'big questions' about the historical condition - questions about historical time, the unity of history, and the ontological status of present and past -programmatically pleading for a new historical ethics.

Abstract: 20 Jahre nach dem Fall des Eisernen Vorhangs: Europa, Freiheit und Diktatur aus prominenten Perspektiven. Abstract: This book provides the first comprehensive account of trauma as a critical concept in the study of modern visual media, from Freud to the present day, explaining how contemporary trauma studies emerged from research on Holocaust representation in which the audiovisual testimony of survivors was posed as an authentic alternative to popular television and film dramatizations. It argues that the media coverage of 9/11 and the subsequent 'war on terror,' however, has revealed how the formation of communities of witness and commemoration around 'traumatic events' can perpetuate violence and inequality. The book explains how Benjamin, Adorno and Barthes, drawing from psychoanalysis, analyzed the roles of fantasy, ideology and collective identification in mass media, and began to understand trauma as an authentic experience of modernity. It proposes that the insights of these earlier theorists, along with more recent arguments by Derrida, Agamben and Zizek, continue to provide important perspectives on today's politics of mediated shock and terror.

Abstract: The Heritage of War is an interdisciplinary study of the ways in which heritage is mobilized in remembering war, and in reconstructing landscapes, political systems and identities after conflict. It examines the deeply contested nature of war heritage in a series of places and contexts, highlighting the modes by which governments, communities, and individuals claim validity for their own experiences of war, and the meanings they attach to them. From colonizing violence in South America to the United States' Civil War, the Second World War on three continents, genocide in Rwanda and continuing divisions in Europe and the Middle East, these studies bring us closer to the very processes of heritage production. The Heritage of War uncovers the histories of heritage: it charts the constant social and political construction of heritage sites over time, by a series of different agents, and explores the continuous reworking of meaning into the present. What are the forces of contingency, agency and political power that produce, define and sustain the heritage of war? How do particular versions of the past and particular identities gain legitimacy, while others are marginalised? In this book contributors explore the active work by which heritage is produced and reproduced in a series of case studies of memorialization, battlefield preservation, tourism development, private remembering and urban reconstruction. These are the acts of making sense of war; they are acts that continue long after violent conflict itself has ended.

Abstract: Co-published with the Waterloo Centre for German Studies For centuries, large numbers of German-speaking people have emigrated from settlements in Europe to other countries and continents. In German Diasporic Experiences: Identity, Migration, and Loss, more than forty international contributors describe and discuss aspects of the history, language, and culture of these migrant groups, individuals, and their descendants. Part I focuses on identity, with essays exploring the connections among language, politics, and the construction of histories-national, familial, and personal-in German-speaking diasporic communities around the world. Part II deals with migration, examining such issues as German migrants in postwar Britain, German refugees and forced migration, and the immigrant as a fictional character, among others. Part III examines the idea of loss in diasporic experience with essays on nationalization, language change or loss, and the reshaping of cultural identity. Essays are revised versions of papers presented at an international conference held at the University of Waterloo in August 2006, organized by the Waterloo Centre for German Studies, and reflect the multidisciplinarity and the global perspective of this field of study.
