    Abstract: Philosophical aspects of law and jurisprudence are investigated from various points of view. This collection represents the analytic approach to legal philosophy. However, this approach is not extreme in the sense that it is limited exclusively to linguistic matters. The concept of norm as a directive of conduct is the central category analyzed in particular essays. The structure of directives as well as their semantic and pragmatic roles are studied. Pragmatic functions of directives are linked with their functioning as speech acts. Moreover, existence and validity of norms are analyzed. The author also touches on general methodological problems of legal theory and philosophy, particularly their relations to social sciences.     Abstract: The Christianopolis (1619) of Johann Valentin Andreae describes in great detail a utopian community of scholar-craftsmen, as seen through the eyes of a naïve young traveller. It is a multi-level text, carefully constructed to provide both entertainment and a critique of contemporary society and religion, which could also be read as the prospectus for the establishment of a new community. This new translation aims to clarify Andreae's elliptical Latin for the first time by identifying parallel passages, allusions and sources for his ideas, and by linking Christianopolis with Andreae's other work as satirist, dramatist, poet and mathematician. A new model of his revision of ideas drawn from Campanella is put forward, and the politico-economic principles embodied in the text are explored. The translation should be of interest to students of the history of utopian ideas, and the history of economic thought

    Abstract: In this collection of essays Allan Franklin defends the view that science provides us with knowledge about the world which is based on experimental evidence and on reasoned and critical discussion. In short, he argues that science is a reasonable enterprise. He begins with detailed studies of four episodes from the history of modern physics: (1) the early attempts to detect gravity waves, (2) how the physics community decided that a proposed new elementary particle, 17-keV neutrino, did not exist, (3) a sequence of experiments on K meson decay, and (4) the origins of the Fifth Force hypothesis, a proposed modification of Newton's Law of Universal Gravitation. The case studies are then used to examine issues such as how discord between experimental results is resolved, calibration of an experimental apparatus and its legitimate use in validating an experimental result, and how experimental results provide reasonable grounds for belief in both the truth of physical theories and in the existence of the entities involved in those theories. This book is a challenge to the critics of science, both postmodern and constructivist, to provide convincing alternative explanations of the episodes and issues discussed. It should be of interest to philosophers, historians, and sociologists of science, and to scientists themselves

    Abstract: Anapolitanos critically examines and evaluates three basic characteristics of the Leibnizian metaphysical system: Leibniz's version of representation; the principle of continuity; and space, time, and the phenomenally spatio-temporal. Chapter I discusses representation, especially as it refers to the connection between the real and the phenomenal levels of Leibniz's system. Chapter II examines the principle of continuity, including continuity as a general feature of every level of Leibniz's metaphysics. The position adopted is that the problem of the composition of the continuum played a central role on the development of Leibniz's non-spatial and non-temporal monadic metaphysics. The machinery developed is then used to offer a new interpretation of Leibniz' metaphysics of space and time. The notion of indirect representation is used to construct appropriate models that clarify the nature of the correspondence between the real and the phenomenal levels in the case of the relations `spatially between' and `temporally between', as well as in the cases of spatial and temporal density. Finally, Leibniz's solution to the problem of the continuum is discussed, arguing that it is not entirely satisfactory. A non-anachronistic alternative is proposed, compatible with Leibniz's metaphysics of substance

    Abstract: What, ultimately, is there good reason to do? This book proposes a unified theory of agent-dependent reasons and agent-independent reasons. It holds that principles which assign reasons to agents are valid if and only if they make maximally good sense in the light of relevant data and background theories. The theory avoids problems encountered by views associated with Nagel, Parfit, Brandt, Hubin, Gert, Baier, and Tiberius, amongst others. By what criteria should a normative theory of ultimate reasons be judged? Plausible meta-level criteria emerge from a process of identifying the criteria that have been used, sometimes unwittingly, by various theorists; categorizing and evaluating the criteria in the light of each other; and proposing revisions on that basis. This method escapes the drawbacks of rival approaches, such as those associated with Parfit, Gert, and Darwall.     Abstract: During the last two centuries, the political map of Europe has changed considerably. More recently, there are remarkably contrasting tendencies concerning the functions and densities of borders. The borders inside the European Union lost their importance, whereas Central and Eastern Europe saw the birth of a multitude of new state borders. The long-term study of border regions, therefore, is a fascinating subject for geographers, historians, social scientists, and political scientists. The main thesis of this book is that the rise of the modern nation-state reinforced the separating function of state borders by nationalising the people on both sides of it. This process gained strength in the late 19th and early 20th centuries, and was challenged in the second half of this century by processes of supra-national integration, globalisation and the revolution in communication and transport, as the case studies from different parts of Europe of this book will show.     Abstract: Quantum Structures and the Nature of Reality is a collection of papers written for an interdisciplinary audience about the quantum structure research within the International Quantum Structures Association. The advent of quantum mechanics has changed our scientific worldview in a fundamental way. Many popular and semi-popular books have been published about the paradoxical aspects of quantum mechanics. Usually, however, these reflections find their origin in the standard views on quantum mechanics, most of all the wave-particle duality picture. Contrary to relativity theory, where the meaning of its revolutionary ideas was linked from the start with deep structural changes in the geometrical nature of our world, the deep structural changes about the nature of our reality that are indicated by quantum mechanics cannot be traced within the standard formulation. The study of the structure of quantum theory, its logical content, its axiomatic foundation, has been motivated primarily by the search for their structural changes. Due to the high mathematical sophistication of this quantum structure research, no books have been published which try to explain the recent results for an interdisciplinary audience.     Abstract: In this book twelve outstanding historians of early modern philosophy undertake a study of the philosophy of Johannes Clauberg (1622-1665). Clauberg was not only among the first followers of Descartes (whose philosophy he taught from 1650 in Herborn and from 1652 until the end of his life in Duisburg) but also assured its survival as an academic philosophy by giving it a more traditional and more didactic expression. A first group of articles deals with Clauberg's early metaphysics as it found its expression in his Ontosophia of 1646 (republished with very considerable changes in 1664), the way it was influenced by Comenius (Leinsle), its relation to Malebranche (Bardout) and Wolff (École) and the way in which it illustrates the difficulties of a Cartesian ontology in general (Carraud). A second group of articles deals with problems of knowledge: knowledge of God (Goudriaan), perceptual knowledge (Spruit) and causality (Pätzold). There are also articles on Clauberg's curious attempt to deal philosophically with the etymology of the German language (Weber), Clauberg as a teacher of Descartes' Principia (Verbeek), Clauberg's conception of corporeal substance (Mercer), and Clauberg's relation to later, more radical developments in Cartesian philosophy, especially in Lodewijk Meyer (Albrecht). The volume is completed by a biographical introduction and a short title bibliography of Clauberg's works, which allows an appreciation of Clauberg's lasting international influence.     Abstract: This volume collects outstanding contributions to the theory of games, the theory of game-theoretical rationality, and their applications. 27 articles present the new situation and the recent advances in game theory after the award of the Nobel Prize in economics and especially in game theory to John F. Nash, John C. Harsanyi, and Reinhard Selten. Two of them, Harsanyi and Selten, have contributed leading articles to this volume. In utility and game theory, the question of which rationality governs their methods and the behavior of the agents as well has emerged as one of the most exciting new conceptual foundations of all social sciences. The main aim of this book is to find an answer to this problem. Do we have to give up our belief in the traditional form of deductive and linear rationality in the social sciences in favor of probabilistic and stochastic methods? Which kind of rationality do we, and should we, use when we attempt to practically solve societal problems and conflicts? Quite a few articles in this book address these questions. The consequences of a new, multi-faceted rationality, which is going to shake the traditional foundation of game theory, decision theory, and utility theory, and, finally, the social sciences in their entirety, are discussed in depth in seven chapters and a preface: `Rationality and the Foundations of the Social Sciences,' `Cooperation and Rationality,' `Rationality and Economics,' `Bayesian Theory and Rationality,' `Evolution and Evolutionary Game Theory,' `Ethics and Game Theory,' and `Applications of Game Theory'. The contributors include economists, utility and decision theorists, psychologists, sociologists, physicists, philosophers of sciences and probability theorists. They attempt to make their contributions accessible to a wide audience.     Abstract: It would seem that modern humanity has unthroned the human spirit, undercutting the very foundation of the validity of truth, moral values and principles. There appears to be no attempt to discern what is beautiful and true: it is functional and pragmatic usefulness that seem to dominate human evaluations and transactions with other humans and, indeed, animals. Humanity is becoming detached from the `higher' aesthetic, moral and intellectual works of the human spirit and thus the life of the spirit is often situated on the other side of a gulf, opposed to science with its rationality. Culture is in danger of becoming reduced to science. In other words, the great metaphysical questions - those of telos, of sense - often are answered in terms of scientific conceptions. But these are at least incomplete, if not fragmentary, and in principle hypothetical, which still leaves the questions unanswered. But it is culture that is the manifestation of the human spirit, being the historical process of human self-interpretation-in-existence. All manifestations of the creative forge of the human being find a role in the fabric of culture, which involves progressively widening circles of the human community, demanding an integration and attunement with others in their changing conditions of life. This consideration of culture involves all areas of philosophical reflection: moral, aesthetic, metaphysical, epistemological, semiological, cognitive, and more

    Abstract: An increasing body of literature concerns the economics of those highly appreciated qualities of life that are not easily provided by market exchange. Today these problems are visible as never before, for example environmental problems. But already at the dawn of industrial society the problem had been observed by Rousseau. His statements on the economy claim to take these problems into account with due importance. In this way his economic philosophy concerns a different domain of the economy from, for example, Adam Smith's work. Rousseau's philosophy attempts to consider phenomena later labeled information asymmetries and information costs, bargaining, collective good problems. Some of Rousseau's most puzzling social proposals (on theater, women, music, etc.) can be explained by his well-argued conviction that an optimal economy demands a high social morale, a communicative morale. He proposes an economic philosophy for the most important properties of richness - such as experiencing the unique, and being free although dependent on others (empowerment). It is for the adult capable of true deliberation, not for the trifle of the innocent child. He develops a concept of richness that is close to the Aristotelian capability-concept, later explored by Amartya Sen. Rousseau's economic philosophy has not been treated in a monograph before. The book should be rewarding to those interested in social theory, the history of social and economic thought, problems at the margins of market exchange, e.g. cultural economics, environmental economics, students of Rousseau and the thought of the 18th century, welfare economic theory in the direction of Arrow or Sen, and Poanyi's and others' theses about the transition from selfsufficiency to market

    Abstract: The world was first introduced to the expertise and originality of Japanese scholars in phenomenology in Analecta Husserliana Vol. IX (1979). The third generation of Japanese scholars, belonging to the newly-founded Merleau-Ponty Japanese Circle, are now presented. Following Merleau-Ponty's tendency, the studies collected here seem to make a fresh phenomenological start in relation to classical Husserlian phenomenology, turning deliberately towards the `concrete', `the wild world', `flesh', `embodiment', `natural signs', `primal nature'.     Abstract: Analytic philosophy has been a dominant intellectual movement in the 20th century and a reflection of the cultural pre-eminence of scientism. In response to analytic philosophy's peculiar reticence (and inability) to discuss itself, this book provides its first comprehensive history and critique. The central element in the analytic conversation has been the Enlightenment Project: the appeal to an autonomous human reason, freed of any higher authority and channeling itself through science as its privileged tool. This centrality is demonstrated by systematically examining its presence and development in the philosophy of science, metaphysics, epistemology, language, psychology, social science, ethics, political philosophy, and the history of philosophy. This journey highlights the internal logical disintegration of that project. Post-modern relativism is its natural offspring and not a viable alternative. The Enlightenment Project's conception of physical science is defective; this defective conception of physical science renders the analytic conception of social science, philosophical psychology, and epistemology defective; and that defective conception of the human condition leads to defective conceptions of both moral and political philosophy, specifically the idea of social engineering or social technology. Throughout the book, an alternative conception of philosophy is presented as a way out of the abyss of analysis, an alternative that reconnects philosophy with the mainstream of Western civilization and initiates the process of providing a coherent cultural narrative. This book will be of particular interest to any sophisticated reader concerned about the lack of a coherent cultural narrative

    Abstract: This is an exploratory critical essay on the Origins of Capital and the Foundations of Thermodynamics. In economics the existence of capital is taken for granted yet it is difficult to establish for it a robust definition. Capital theory addresses the coupling of the present with the future; as such it does not deal with its own history, evolution or its origins. The concern is the (discounted) future rather than the historical or even prehistorical past; at best, Hesiod's economy in his Works and Days marks the beginning of economic history. Yet, in its generic form, capital is but a physical or biological engine that processes materials and transforms energy in an environment of thermal non-equilibrium. The objective is to show the importance of capital in the comprehension of thermodynamics. I argue that the idea of scarcity as the fountain of history and its concomitant concept of value must be incorporated in the substance of thermodynamics and the meaning of measurement; this necessitates some excursions into the territory of economics with a review of capital theory, of evoluationary biology and the origins of life, and of the received ideas on thermodynamics. To discuss measurement - a long-standing quandary and the quintessential quantum problem - for lack of a better approach a formal hybrid pragmatist's outlook is retained in the form of virtual Cartesian dualism. Audience: This work will be of interest to historians and philosophers of science and economics, and engineering thermodynamicists

    Abstract: The guideline that runs through all [Stein's] work is the inquiry into the question of the nature of the human person. Beginning with her dissertation on empathy and following through to the works of her maturity, the reader becomes aware of the thrust toward revealing the person as person, in its universality, transcending time and place and cultural milieu. Stein holds that phenomenology supplies the most effective means towards arriving at knowledge of what it means to be a person, and that phenomenological analysis can reveal the essential constitution of human-being-in-the-world.. My purpose in this book is to remove the wrapping and lid from the gift that Edith Stein has given us and to say: `Look! See what is inside.'     Abstract: This is the first publication of the 170 letters written by the Abbé Dominique Chaix to Dr. Dominique Villars between 1772 and 1799, when they were collaborating on the publication of the first flora for the old province of Dauphiné. This volume provides a cross-cultural comparison of Japanese, American and European approaches to bioethics and health care policy. In a world of international bioethics, it explores the similarities and dissimilarities between bioethics in Japan and the Western world. The collection gives both a portrayal of current approaches as well as an analysis of the character and grounds for the similarities and dissimilarities. The similarities reflect attempts to find morally justified bases for collaboration when individuals do not share taken-for-granted understandings of the proper use of health care, the meaning or form of a good death, and the correct ways to collaborate. Similarities also derive from Western bioethical reflections that have been exported to Japan, which, for better or worse, have entered and altered traditional Japanese understandings. Japan and the West have been exposed to the post-traditional character of the age. Many of the dissimilarities stem from the fact that Japan remains in large measure a traditional society with strong ties to family, culture and community. Japanese share many common understandings of values, while the West has long struggled with moral diversity. These essays explore particular bioethics, which reflect particular moral commitments, as contributions to the emerging international dialogue concerning bioethics and health care policy

    Abstract: The Encyclopedia of Phenomenology presents phenomenological thought and the phenomenological movement within philosophy and within more than a score of other disciplines on a level accessible to professional colleagues of other orientations as well as to advanced undergraduate and graduate students. Entries average 3,000 words. In practically all cases, they include lists of works `For Further Study'. The Introduction briefly chronicles the changing phenomenological agenda and compares phenomenology with other 20th Century movements. The 166 entries are about matters of seven sorts: the four broad tendencies and periods within the phenomenological movement; twenty-three national traditions of phenomenology; twenty-two philosophical sub-disciplines, including those referred to with the formula `the philosophy of x'; phenomenological tendencies within twenty-one non-philosophical disciplines; forty major phenomenological topics; twenty-eight leading phenomenological figures; and twenty-seven non-phenomenological figures and movements of interesting similarities and differences with phenomenology. Concerning persons, years of birth and death are given upon first mention in an entry of the names of deceased non-phenomenologists. The names of persons believed to be phenomenologists and also, for cross-referencing purposes, the titles of other entries are printed entirely in SMALL CAPITAL letters, also upon first mention. In addition, all words thus occurring in all small capital letters are listed in the index with the numbers of all pages on which they occur. To facilitate indexing, Chinese, Hungarian and Japanese names have been re-arranged so that the personal name precedes the family name. Concerning works referred to, the complete titles of books and articles are given in the original language or in a transliteration into Roman script, followed by literalistic translations and the year of original publication in parentheses or, where the date of composition is substantially earlier than that of publication, by the year of composition between brackets

    Abstract: Elements of Ethics examines Meinong's value theory from an epistemological standpoint and gives a critical exposition of Meinong's first attempts at a deontic logic; special consideration is given to the Law of Omission. For that purpose his theory of the a priori is examined, which is entwined with his theory of objects. The book begins with an epistemological and ontological consideration and simplification of Meinong's universe. In consequence of the mathematical development of his time, especially non-Euclidean geometries, Meinong developed the notion of precision objects and precision concepts. They are discussed along with the so-called `incomplete objects' and problems associated with them. These discussions are relevant for understanding various technical terms, particularly concepts of values and valuations. These discussions also assist in assessing the possibility of knowing these concepts a priori, and in understanding the logical relationships between them and actual valuations. We find in Meinong's ethical writings a mixture of experiential and a priori knowledge.     Abstract: The articles in this collection were all selected from the first five volumes of the Journal of Dialectics of Nature published by the Chinese Academy of Sciences between 1979 and 1985. The Journal was established in 1979 as a comprehensive theoretical publication concerning the history, philosophy and sociology of the natural sciences. It began publication as a response to China's reform, particularly the policy of opening to the outside world. Chinese scholars began to undertake distinctive, original research in these fields. This collection provides a cross-section of their efforts during the initial phase. To enable western scholars to understand the historical process of this change in Chinese academics, Yu Guangyuan's `On the Emancipation of the Mind' and Xu Liangying's `Essay on the Role of Science and Democracy in Society' have been included in this collection. Three of the papers included on the philosophy of science are discussions of philosophical issues in cosmology and biology by scientists themselves. The remaining four are written by philosophers of science and discuss information and cognition, homeostasis and Chinese traditional medicine, the I Ching (Yi Jing) and mathematics, etc. Papers have been selected on the history of both classical and modern science and technology, the most distinctive of which are macro-comparisons of the development of science in China and the west. Some papers discuss the issue of the demarcation of periods in the history of science, the history of ancient Chinese mathematics, astronomy, metallurgy, machinery, medicine, etc. Others discuss the history of modern physics and biology, the history of historiography of science in China and the history of regional development of Chinese science and technology. Also included are biographies of three post-eighteenth-century Chinese scholars, Li Shanlan (1811-1882), Hua Hengfang (1833&endash;1902), and Cai Yuanpei (1868&endash;1940), who contributed greatly to the introduction of western science and scholarship to China.     Abstract: While many books have been written about human sexuality, few have seriously explored the philosophical and psychological meaning of erotic love. This reflects a bias and a problem in contemporary culture: the misunderstanding of eros out of a theory of physiological drive-reduction (ignoring the countervailing motivation toward intensification rather than reduction of conscious feeling) has led to an egocentric view of human nature, which in turn motivates a simplistic hedonism in value thinking and an atomistic-individualist conception of society. The ultra-competitive nature of this kind of culture leads to overconcern with masks of invulnerability - i.e., narcissism - which prevents the dropping of superficial defenses necessary for deep and authentic love relationships to mature. But the intense, direct experience of the intrinsic value of another being embodied in authentic love experiences is needed to combat the existential threats to the meaningfulness of life (alienation, powerlessness, relative insignificance in the ultimate scheme, and death). This experience is motivated by the need to be pulled out of oneself into a non-egocentric way of experiencing which cares as much about expressing value feelings, in order to deepen and intensify them, as it does about reducing egocentric drives. The misunderstanding, neglect, and dysfunction of this basic human need thus reflects a serious problem in the psychology of the self and the structure of the community, whose study requires a phenomenological rather than a merely empirical-scientific approach, since the latter approach alone leads almost inevitably to the very reductionism at issue

    Abstract: The editors have selected a number of papers that represent recent studies by Mexican philosophers and historians of science. While attention is paid to several main developments of science in Mexico, the book does not deal only with national or even regional issues. Moreover, Mexican works on the philosophy of science are no new phenomenon. Although originating in the need to construct a national identity during the 19th century, and stimulated by the European Enlightenment, Mexican scholarship has now reached maturity, both in terms of an awareness of their historical situation and creative competence with respect to the live issues at the international level. This book presents topics of biology and physics, historical explanation and the historiography of science, and foundations of mathematics, with particular concern for Hilbert, Russell and Wittgenstein
