    Abstract: Le 11 mars 1990, le Conseil suprême a adopté la loi fondamentale provisoire de la République de Lituanie, qui a été considérée comme la constitution et a suspendu de ce fait la constitution antérieure du 12 mai 1938. La loi fondamentale provisoire ne représentait toutefois qu’un Acte constitutionnel à caractère provisoire ; elle ne modifiait point la structure du pouvoir de l’État, et toutes les institutions propres à un État démocratique n’étaient pas rétablies. La loi fondamentale provisoire est restée en vigueur jusqu’à l’automne 1992. Le 25 octobre 1992 les citoyens ont voté dans un référendum pour approuver la constitution de la République de Lituanie, qui a rétabli toutes les institutions traditionnelles de l’État, à savoir le Seimas, le président, le gouvernement et les tribunaux. La constitution a en outre introduit de nouvelles institutions pour aider au fonctionnement démocratique de l’État, notamment la cour constitutionnelle, le médiateur et le contrôle d’État. Le statut de la cour constitutionnelle et les procédures de mise en oeuvre de ses pouvoirs sont fixés par la loi sur la cour constitutionnelle de Lituanie adoptée par le parlement le 3 février 1993. La constitution a également introduit le principe de l’autonomie des collectivités locales.

    Abstract: During the 1990s, China has experienced a surge in imports of services, particularly those of communication, insurance and other business services, despite the fact that the authorities have maintained a plethora of restrictive measures limiting access to the service sector. Not only does this cast strong doubt over the effectiveness of these measures currently in place but also raises some important political-economy questions regarding the market access issues related to this sector. Following a brief review of the country’s efforts made since 1994 to sustain its openeconomy reforms, the paper takes stock of major policy developments in the service sector and discusses the pros and cons of liberalisation of services. The paper argues that a further liberalisation of services would be imperative for China to develop a more viable and dynamic service sector and stands to gain the full benefits of globalisation.     Abstract: A successful reform of public enterprises would improve productivity in key sectors of the Greek economy, and thus provide essential inputs at lower cost to the economy as a whole. Reforms would need to address the factors that are responsible for the poor performance of Greek public enterprises. First, labour costs are high and productivity low in international comparisons. Second, there are wide technology gaps between Greece and other OECD countries. Third, Greece’s public enterprises fulfil heavy public service commitments without matching compensation. As a result, prices are often out of line with prices elsewhere.     Abstract: Developing and transition economies are seeking to accelerate their development by liberalising trade and investment, and taking advantage of the opportunities of the global market place. However, in the wake of recent financial crises, concerns have been expressed that some countries might turn away from open trade and investment. In fact, most crisis-affected countries are continuing to liberalise trade and investment, which they see as part of the solution to the crisis, not the cause. This report reviews evidence of the benefits and challenges of trade and investment for development, drawing on experiences from economies in various parts of the world. Experience shows that open trade and investment have been beneficial for development, when accompanied by a coherent set of growth-oriented macroeconomic and structural policies, capacity-building, social policy and good governance. Further, countries like Korea and Mexico that have responded to economic crisis with liberalisation and structural reform have experienced positive results. All countries -- developed, developing and transition -- have a vital stake in a new Round of multilateral trade negotiations to prepare for the global economy of 21st century.

La promotion de l’innovation s’affiche aujourd’hui comme une haute priorité dans la plupart des pays de l’OCDE. Cet objectif se heurte toutefois souvent à une compréhension insuffisante de la portée des transformations du processus d’innovation, que celles-ci soient produites par la mondialisation, le développement des technologies de l’information et des communications, ou l’élargissement de la base de connaissances scientifiques. A partir de données empiriques nouvelles, cet ouvrage montre combien les liens qui existent entre l’industrie et le système scientifique se trouvent transformés et analyse la nature des compétences nécessaires pour innover. Il rend également compte des mutations qui modifient les rôles respectifs de la concurrence et de la coopération en matière d'innovation et prend toute la mesure de l'impulsion croissante que la création d’entreprises et les PME donnent à la dynamique d’innovation. A la lumière de cette publication, il apparaît que la performance en matière d’innovation dépend de manière cruciale de la façon dont interagissent, aux niveaux local, national et mondial, les différents éléments constitutifs du « système d’innovation » que sont les entreprises, les universités et les autres organismes de recherche. D'où la nécessité pour les pouvoirs publics de modifier leur approche de la promotion de l’innovation. Cette étude énonce les objectifs et définit les instruments de cette nouvelle politique de l’innovation tout en identifiant certaines mesures exemplaires prises récemment dans les pays de l'OCDE.

    Abstract: Little quantitative information is available to assess the impacts, both harmful and beneficial, of agriculture on the environment and to measure how different policy measures affect the environment. To help fill these gaps, a major effort is underway in the OECD to develop a set of policy-relevant agri-environmental indicators. This first volume, of the series Environmental Indicators for Agriculture, outlines an analytical framework to further the analysis of agri-environmental linkages and sustainable agriculture. It describes the main environmental concepts in agriculture of relevance to OECD policy-makers and the indicators that need to be calculated: the use of nutrients, pesticides, and water; land conservation; water and soil quality; greenhouse gases; biodiversity; wildlife habitats; landscape; and environmental impacts related to farm management practices, the availability of farm financial resources, and rural socio-cultural issues.

    Abstract: With the emergence of a knowledge-based society, innovation has become an increasingly important factor in the competitiveness of firms, the prosperity of nations and dynamic world growth. Innovation uses scientific progress to meet the changing needs of society and is thus one of the keys to sustainable development. Promoting innovation is now a high priority in most OECD countries. However, the pursuit of this objective is often hampered by an inadequate understanding of the extent to which the mechanisms of innovation are being transformed by globalisation, the development of information and communications technologies and the expanding scientific knowledge base. Drawing on new empirical data, this book analyses the fundamental changes in the linkages between industry and the science system as well as in the nature of the competencies required for firms to innovate. The changes which are transforming the respective roles of competition and co-operation in stimulating innovation and which are enabling enterprise creation and SMIs to play an increasingly active role in innovation are also examined. This book shows that innovation performance depends on the way in which the different components of the "innovation system" -- businesses, universities and other research bodies - interact with one another at the local, national and international levels, and concludes that the public authorities must change their approach to the promotion of innovation. This study defines the aims and tools of this new innovation policy and identifies examples of good policy practice recently implemented in OECD countries.

    Abstract: Highly publicised outbreaks of food-borne diseases have put food safety at the heart of a topical debate. Demands for increased food safety regulation and stricter enforcement have gained momentum. In fact, consumer concerns go well beyond basic food safety. The quality of food and how it is produced, animal welfare, the use of genetically modified organisms (GMOs), hormones and other growth promoters, cultural preferences, resource sustainability and protection of the environment have all become major issues in the public debate over regulation of the food industry. The issues are complex and the required policy response remains unclear. With the strengthening of international rules, increased trade in consumer food products and the growing use of biotechnology, trade conflicts over food regulatory issues and their reform could become more common. The economic stakes are high and such disputes are likely to remain a priority in the future trade agenda. This report examines the trade conflicts arising from food safety and quality issues. It summarises the key international agreements, illustrates the range and nature of current disputes, reviews the potential contributions of economic analysis to conflict resolution, and identifies areas requiring further analysis.

    Abstract: Fears of the prospect of growing social exclusion have become important concerns in recent years for many countries. Improving the quality of education and the standards attained by students to improve employability is one of the tools being used to prevent exclusion. However, changing social realities are leaving young children and students more exposed than ever to failure at school and unemployment. It is becoming increasingly clear that communities, education systems, schools and teachers are not equipped to deal with the many problems which arise and when social or health services become involved conflicts of interest can arise leading to actions which are not always in the clients' best interests. The necessity to provide greater co-ordination among these services, to improve their efficiency and effectiveness and to provide a seamless support to meet the holistic needs of students and their families is now becoming more accepted. Such an approach, inter alia, is community-based, emphasises prevention rather than being crisis-oriented, is customer-driven rather than being focused on an agency, and is accountable through outcomes rather than inputs. For many, better co-ordination of services is seen as the only solution available which is commensurate with our present democratic societies. All of the papers in this book were presented at a conference held in Toronto, Canada. They are original and have been written by policy-makers from different ministries, researchers from different disciplines and clients who come variously from Canada, Finland, France, Germany, the Netherlands, Spain, the UK, and the USA.

    Abstract: OECD's 1999 review of regulatory reform in Mexico. It finds that regulatory reform has been key to the transformation of the Mexican economy over the past 15 years. Formerly inward-looking and heavily regulated, the Mexican economy today is relatively open and market-based. The rapid pace, broad scope, and depth of regulatory reforms exceed those of most OECD countries. These reforms have already produced major benefits for Mexico, not least by increasing economic flexibility so that Mexico rebounds more quickly from economic crises. But benefits of reforms have been slowed by the macroeconomic crises of the 1990s. Sustained attention is needed now to complete and implement reforms to establish conditions for vigorous market competition and entry, while strengthening the capacity of the Mexican state to use high quality and transparent regulatory instruments in carrying out public policies. A multi-year period of policy stability supportive of market-led growth could produce enduring and broad-based benefits for Mexican consumers and businesses. Mexico was one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

Energetic measures, including both sectoral reform and reform of framework conditions, need to be adopted quickly to complete the transition from a state-led growth model, now largely ineffective, to a market-driven growth model, the only model capable of laying the foundation for sustainable competitiveness and prosperity in Japan.     Abstract: The United States has been a world leader in regulatory reform for a quarter century. Contrary to popular belief, the United States is not less regulated than other countries, but differently regulated due to the pro-competition policy stance of federal regulatory regimes, and the openness and contestability of regulatory processes. Far-reaching economic deregulation combined with efforts to improve the quality of social regulation have supported the construction of one of the most innovative, flexible and open economies in the OECD, while maintaining health, safety and environmental standards at relatively high levels. However, significant regulatory problems still exist. Improving the performance and cost-effectiveness of expensive social regulations and government formalities is a key challenge for regulatory quality. In a word, the challenge of regulatory reform in the United States is not how much regulation, but how good. The United States is one of the first OECD countries to request a broad review by the OECD of its national regulatory practices and domestic regulatory reforms. This report -- the result of intensive assessment by the OECD and review by its Member countries -- is unique in that it presents an integrated assessment of regulatory reform in framework areas such as the macroeconomic context, the quality of the public sector, competition policy and enforcement, and integration of market openness principles in regulatory processes, and in sectors such as electricity and telecommunications. The policy recommendations present a balanced plan of action for both short and longer-term based on best international regulatory practices.

    Abstract: This paper examines the main determinants of the decision to retire from the labour market in OECD countries, and in particular the role of social security systems in driving down the labour-force participation rate of older people in recent decades. It demonstrates that old-age pension systems in virtually all OECD countries in the mid-1990s made it financially unattractive to work after the age of 55, and the implicit tax on continued work has risen strongly since the 1960s in most countries. Financial disincentives to continued work have been amplified by various de facto early-retirement programmes, including unemployment-related and disability schemes. Pooled cross-country time-series regressions show that increased disincentives to work at older ages have contributed significantly to the drop in labour-force participation rates of older males, but also demonstrate that the deterioration of labourmarket conditions in many countries has played a significant role as well ...

Les élections législatives les plus récentes remontent à novembre 1996. Une trentaine de partis politiques présentèrent des candidats. Après les élections les Libéraux-Démocrates ont formé une coalition avec le Parti du Peuple Slovène et le Parti DeSUS. Le chef des Libéraux-Démocrates, Janez Drnovsek, a été réélu comme premier ministre.

    Abstract: L’Estonie est une démocratie constitutionnelle disposant d’une constitution écrite. La Constitution de la République de l’Estonie et la loi portant son application ont été adoptées par voie de référendum le 28 juin 1992 et sont entrées en vigueur le lendemain. Depuis son adoption la Constitution n’a fait l’objet d’aucun amendement. Des versions en anglais de la Constitution et de bien d’autres lois et décrets sont disponibles à l’adresse suivante : http://www.legaltext.ee (Centre estonien de traduction et de soutien législatif). La Constitution pose le principe de la continuité juridique de la République de l’Estonie, dont l’indépendance a été proclamée le 24 février 1918, qui fut ensuite occupée par l’Union soviétique le 17 juin 1940 pour être annexée ensuite à cette dernière le 6 août 1940. La Constitution reflète l’idée de restauration juridique, qui a servi de base au retour à l’indépendance et à la libération vis-à-vis de l’Union soviétique le 21 août 1991. Le Riigikogu a récemment entamé l’examen des résultats d’une étude effectuée par la Commission gouvernementale d’experts sur la révision constitutionnelle. Si les propositions de la Commission sont adoptées, elles ne changeraient pas les principes de base de la Constitution mais renforceraient le système de gouvernement parlementaire et constitutionnel. Les propositions les plus importantes concernent la création d’un conseil constitutionnel distinct, le renforcement du contrôle civil exercé sur les forces de défense, et l’attribution des compétences d’un médiateur au Chancelier législatif. Il est en outre possible que des amendements soient nécessaires du fait de l’adhésion de l’Estonie à l’Union européenne ; ces amendements ont trait à un principe de base de la Constitution, le principe de souveraineté.

    Abstract: Japan is the leader in volume among DAC donors, but it ranks 19th out of 21 bilateral Members in terms of ODA as a percentage of GNP. Compared to other Members, its aid programme has a higher proportion of loans, with preference towards Asia and lower middle-income countries, and a heavy emphasis on assistance for economic infrastructure as opposed to the social sectors. Japan is making major efforts to improve its aid programme through an administrative reform, piloting the new international development strategy, a country-focused approach, and a push towards increased quality, transparency, and efficiency. The DAC encourages these developments and recommends that Japan should: - strengthen staffing and decentralisation; - enhance NGO involvement; - mainstream cross-cutting issues such as poverty, gender, and governance; - design and evaluate projects with a view towards cost-efficiency, sustainability, technological appropriateness, and socio-economic impact; - and ensure policy dialogue with recipient countries.

La lenteur de certaines réformes importantes indique que le modèle néerlandais est encore en train de chercher l'équilibre entre l'établissement d'un consensus et l'ajustement des politiques. De l'application de la réforme à de nombreux nouveaux domaines découleront des gains aussi importants qu'un net progrès du taux d'emploi, une amélioration des performances sectorielles, et une réduction des coûts de la protection sociale. Les Pays-Bas sont un des premiers pays à avoir demander à l'OCDE de procéder à un examen général de ses pratiques réglementaires et des réformes de la réglementation menées à l'échelon national. Cet ouvrage est le fruit de l'évaluation approfondie menée par l'OCDE et d'un examen par ses pays Membres. Il présente une évaluation intégrée sans équivalent de la réforme de la réglementation dans des domaines aussi essentiels que le contexte macro-économique, la qualité du secteur public, la politique de la concurrence et sa mise en oeuvre, ainsi que l'intégration des principes d'ouverture du marché dans les processus réglementaires et dans des secteurs tels que l'électricité et les télécommunications.     Abstract: Following recent disarmament agreements, the Russian Federation and the USA have declared part of their stockpiles of weapons-grade plutonium as a surplus to their national defense needs. This material needs to be disposed of, and one of the suggested means of doing so is burning it in existing reactors and transforming the material into spent fuel. The experience in these two countries with mixed oxide fuel (MOX) is either dated or scarce. Several European countries and Japan, however, have acquired much experience in using MOX fuel in reactors which was shared at this important workshop. This publication presents the workshop results which reviewed existing technical information from the civil nuclear power programmes that are beneficial to weapons-grade plutonium disposition. It also proposes concrete actions that could help expedite this process in the near future.

This report is the first comprehensive review of permitting practices for industry in OECD Member countries. It explores the principles behind environmental permits and identifies major trends in their use. In particular, the report examines how technology-based requirements and environmental quality objectives are used together to develop permit conditions. Results are also presented from four sectoral case studies of the iron and steel, metal finishing, pulp and paper, and oil refining industry .     Abstract: The constitution establishes the principle of legal continuity of the Republic of Estonia, which was proclaimed independent on 24 February 1918, occupied by the Soviet Union on 17 June 1940 and subsequently annexed thereto on 6 August 1940. The constitution reflects the idea of legal restoration, which served as a basis for the return to independence and liberation from the Soviet Union on 21 August 1991. The Riigikogu has recently begun to consider the results of a review carried out by the government expert committee on constitutional revision. The committee’s proposals, if adopted, would not alter the basic principles of the constitution but would reinforce the parliamentary and constitutional system of government. The most important proposals are the establishment of a separate constitutional court, reinforcement of civil control over the defence forces, and attribution of the powers of an ombudsman to the legal chancellor. Moreover, amendments may have to be made in view of the accession of Estonia to the European Union; these amendments touch upon a basic principle of the constitution, the principle of sovereignty.

Creditor governments should induce their home banks into financial rescue operations to reduce moral hazard in private-sector lending, and to encourage Asia’s recovery. • The resolution of Asia’s domestic debt overhang must be the overriding policy concern for Asia’s governments; paying the inevitable fiscal cost in Asia’s restructuring process requires tax-base broadening, supported by easy monetary policy. • Progress towards a less crisis-prone international financial system will hinge on how to correct the excessive risk taking by banks. Regulatory distortions through the Basle Accord which bias bank lending towards the short term should be corrected. • Developing countries should strengthen bank and non-bank balance sheets and raise the quality of inflows; Chile-type regulatory measures, however, will only be effective in an appropriate policy context.

    Abstract: The aim of this paper is twofold. First, to begin a policy and regulatory evaluation of developments in telecommunication market openness following the liberalisation in 1998 in the context of the WTO agreement and the liberalisation in the European Union. Second, it is aimed at stimulating reflection on the issues that may need to be examined to enhance market liberalisation and market openness. Although a full assessment of recent market opening may be too premature, there are nevertheless indications of areas where further consideration and action may be required. In addition market developments are raising a number of issues which are likely to become relevant in the event that there are further discussions on market opening in the context of any future WTO service negotiations. As a paper aimed at beginning discussion and reflection, a number of questions are raised which could be used by delegations to provide their own assessment of issues and future problem areas which need consideration.

    Abstract: Widening imbalances in current account positions across some of the major OECD economic areas have raised concerns about related increases in protectionist sentiments. This paper reviews recent trends in market openness indicators and assesses whether barriers to international trade and investment have risen. It finds that tariffs, the most transparent form of protection, have fallen steadily over a long period. Usage of non-tariff barriers also declined up to 1996. But despite these developments most OECD countries continue to highly protect certain sectors such as agriculture. The paper reviews in some depth the incidence, geographical distribution and product composition of anti-dumping initiations, since their use as disguised protection is feared. Against the background of a general decline in direct trade restrictions the paper shows, using a variety of indicators the steady - albeit uneven across sectors and countries - improvement in market openness. Administrations locales et régionales, universités, chambres de commerce, parcs scientifiques, promoteurs immobiliers du secteur privé et organisations à but non lucratif, tous ont participé à la création et à la gestion de programmes dans ce domaine. Cependant, les pépinières constituent, dans bien des pays, une industrie encore jeune, et les examens critiques de leurs performances font souvent défaut. Ce livre fait le point sur les expériences récentes de l'Australie, de l'Allemagne, de l'Italie, du Royaume-Uni et des Etats-Unis en matière de création de pépinières d’entreprises.     Abstract: The future of rural areas is high on the domestic and international policy agenda. Restructuring of the agricultural sector, and accompanying reform of agricultural policies, and the challenge of meeting sustainable development objectives are key preoccupations in OECD countries. In the search for forward-looking and durable policy strategies, building on natural and cultural amenities is emerging as an important area of policy action, one which complements traditional, agriculture-oriented rural policies and places rural policy in the broader territorial development arena. In most rural areas, the potential of many natural and cultural resources remains untapped. Harnessing such amenities, however, involves striking a balance between use and conservation. In many cases, maintenance of rural amenities depends on a degree of local economic activity -- without it there is a danger of degradation. At the same time, over-exploitation risks spoiling, often irreversibly, the essential value of the amenity. Because many natural and cultural features are public goods, with limited markets and hazy property rights, public policies are needed to strike the delicate balance between supply and demand.

Cette analyse et les calculs qui l'étayent se veulent avant tout illustratifs et ne prétendent pas rendre compte de toute la richesse des permutations possibles entre régimes fiscaux. A terme, le Mexique tirera ainsi mieux parti de ses ressources naturelles et humaines, il réduira les inégalités tout en en accroissant les opportunités sur l'ensemble de son territoire.

Parents, students, the public and those who run education systems need to know whether children are acquiring the necessary skills and knowledge to become tomorrow's citizens and to continue learning throughout life. International indicators can describe the levels of achievement in various countries, to which others might aspire. They can provide direction for schools' instructional efforts and for students' learning as well as insights into curriculum strengths and weaknesses. The 29 Member countries of the OECD, together with other countries, have launched the OECD Programme for International Student Assessment (PISA) to develop such indicators on a regular basis. PISA aims at assessing how far students approaching the end of compulsory education have acquired some of the knowledge and skills that are essential for full participation in society. A New Framework for Assessment, the first volume in the PISA series, provides the conceptual framework on which the PISA 2000 assessment is based. It defines the domains of reading literacy, mathematics literacy and scientific literacy forming the core of PISA in terms of the content that students need to acquire, the processes that need to be performed, and the contexts in which knowledge and skills are applied. It also describes the methods developed to ensure that the assessment tasks are valid across countries, are strong at measuring relevant skills and are based on authentic life situations.

Pourquoi certains pays ont-ils mieux réussi que d'autres à endiguer le chômage ? Pourquoi certains groupes sociaux -- les jeunes, les travailleurs âgés, les travailleurs peu qualifiés -- ont-ils, dans de nombreux pays, tant de mal à trouver et à conserver un emploi qui les satisfasse pleinement ? La progression des emplois temporaires ou à temps partiel est-elle un bien ou un mal ? Cet ouvrage examine ces questions à la lumière de l'expérience acquise par les pays qui appliquent la Stratégie de l'OCDE pour l'emploi.     Abstract: Over the past decade, the world has witnessed a significant transformation in the role of the private sector in economic development and job creation. As more and more countries have adopted market-based approaches to economic policy, there has been an increasing awareness of the importance of private corporations for the welfare of individuals. A good corporate governance regime is central to the efficient use of corporate capital. Good corporate governance also helps to ensure that corporations take into account the interests of a wide rage of constituencies, as well as of the communities within which they operate, and that their boards are accountable to the company and the shareholders. This, in turn, helps to assure that corporations operate for the benefit of society as a whole. It helps to maintain the confidence of investors - both foreign and domestic - and to attract more long-term capital. The OECD Principles of Corporate Governance were endorsed by ministers at the OECD Council meeting at ministerial level on 26-27 May 1999. They were developed in response to a mandate given to the Organisation by the OECD Council meeting at ministerial level in 1998 to develop a set of standards and guidelines on good corporate governance.

Unless the users of biological resources are given incentives to sustainably use these resources, valuable biodiversity will continue to be lost. Because of the inherent complexity of biological systems, and the range of pressures that act on them, a "bundle" of carefully-designed and complementary incentive measures are often necessary to provide the appropriate signals to prevent biodiversity loss. This unique Handbook draws on the experiences described in 22 case studies to develop a comprehensive step-by-step process for identifying and implementing appropriate incentive measures for biodiversity conservation, and the sustainable use of its components. It identifies the incentive measures that are most suitable for particular ecosystems, and for addressing the specific sectoral pressures in effect, describing both the advantages and the disadvantages of each incentive measure. A wide range of incentive measures are described, including both the more common economic and regulatory incentives, and also the necessary framework conditions, such as scientific and technical capacity building, education and awareness raising, and the involvement of local populations and other stakeholders.

    Abstract: Depuis des années, l'Allemagne joue un rôle pionnier en matière de politique urbaine. Elle s'est fixé un objectif de développement urbain durable afin de relever l'ensemble des défis économiques, sociaux et environnementaux qui se posent aux villes. Des réponses politiques intégrées et des mesures novatrices ont été mises en place pour favoriser la revitalisation des centres-villes et faire face à la croissance des banlieues, à l'augmentation de la circulation automobile et au changement social. Cet ouvrage analyse ces initiatives à la lumière des traits spécifiques à l'Allemagne : système fédéral, processus d'unification et système urbain polycentrique. La politique de la ville est un instrument privilégié pour résoudre de nombreux problèmes dont l'ancrage est avant tout urbain et constitue, en tant que tel, une composante à part entière du développement durable. Au-delà des caractéristiques et des conclusions propres à l'Allemagne, cette étude plaide pour une approche multisectorielle intégrée et prospective, qui ne soit pas seulement guidée par une logique économique pure, mais apporte des éléments de réponses tangibles à cette question essentielle : quel type de villes souhaitons-nous pour l'avenir ?

    Abstract: The application of tax treaties to cases involving partnerships raises a number of complex issues. When is a partnership entitled to the benefits of a tax convention? What happens when the residence and source States apply different articles of the Convention on the basis of differences in their domestic law? How can the problems arising from conflicts of income allocation be solved? This report addresses these issues in detail and focuses on specific factual examples. For each example, the facts and, where applicable, relevant aspects of domestic tax laws are described. Comprehensive recommendations for dealing with the international taxation of partnerships in practice are also presented.

    Abstract: Les économies en développement et en transition s'efforcent d'accélérer leur développement en libéralisant leurs échanges et leurs investissements, et en saisissant les opportunités offertes par l'économie mondiale. A la suite des crises financières récentes, la crainte a cependant été exprimée que certains pays se détournent de la libéralisation des échanges et de l'investissement. En fait, la plupart des pays touchés par la crise continuent de libéraliser échanges et leurs investissements, en quoi ils voient une solution, et non une cause de la crise. Cette étude examine les avantages et les enjeux de la libéralisation des échanges et de l'investissement pour le développement, en s'appuyant sur les expériences menées par des économies de différentes régions du monde. L'expérience montre que l'ouverture des marchés et de l'investissement a été bénéfique lorsqu'elle s'est accompagnée d'un ensemble cohérent de mesures macroéconomiques et structurelles conçues pour stimuler la croissance, d'un renforcement des capacités, d'une politique sociale appropriée, et d'une bonne gestion des affaires publiques. Qui plus est, des pays comme la Corée ou le Mexique, qui ont opposé à la crise économique la libéralisation et les réformes structurelles, en ont tiré des résultats positifs. Un nouveau cycle de négociations commerciales multilatérales est donc d'un intérêt vital pour tous les pays -- développés, en développement ou en transition -- pour préparer l'économie mondiale du XXIe siècle.     Abstract: Le développement devrait pouvoir progresser plus rapidement que jamais dans la nouvelle économie mondiale. Si l'ouverture des économies en développement aux échanges et à l'investissement est une condition nécessaire pour instaurer une croissance élevée et durable en participant à l’économie mondiale, ce n’est en aucun cas une condition suffisante. Enclencher une dynamique de croissance durable requiert des politiques économiques saines et obéissant aux principes du marché, des politiques sociales d'accompagnement adaptées, ainsi qu'une bonne gestion des affaires publiques. Mais comme l'a démontré la crise financière asiatique, des carences dans ces trois domaines peuvent fragiliser des économies en développement même très performantes. Les pays de l'OCDE ont un rôle central à jouer pour faciliter les efforts que mènent les pays en développement pour tirer parti de tous les avantages de l'ouverture aux échanges et à l'investissement. Le principal objectif de cette étude est de déterminer comment les pays de l'OCDE peuvent promouvoir la cohérence des politiques en : améliorant le cadre dans lequel s'inscrivent les flux internationaux d'investissement et de capitaux ; en prenant en compte les préoccupations environnementales ; et en facilitant la participation des pays en développement à la société mondiale de l'information. Pour être couronnée de succès, il est nécessaire que la cohérence des politiques prenne délibérément en compte les besoins et les intérêts des pays en développement, afin d'en faire des acteurs de l'économie mondial efficaces, plutôt que vulnérables et marginaux.     Abstract: Nearly two years after Kyoto, most OECD countries are looking towards ratification and implementation of their obligations under the Kyoto Protocol. What do historical emissions and policy trends tell us about the way forward? Which policies will be needed to combat climate change? This book provides an overview of recent developments in OECD countries and a framework for policy making in the context of Kyoto targets. There is no single formula for domestic policies to mitigate greenhouse gas emissions. Every country will need to assess opportunities and constraints to develop a strategy adapted to their own situation. Yet, it is possible to outline some main lines for action in OECD countries at the national level. National strategies should prioritise market, subsidy and fiscal reform policies to establish conditions for competitive markets and remove distortions that harm the environment. And governments should implement a comprehensive mix of mutually reinforcing and integrated policies, using a wide range of economic instruments (green taxes, green tax reform and domestic emission trading) as well as other measures such as product policies, voluntary approaches and public awareness programmes. Unless OECD countries establish more effective frameworks for action now, achieving the Kyoto targets is likely to be costly and difficult.
