Der Begriff der Innovationsverantwortung bezieht sich auf Vorkehrungen zur Sicherung der Gemeinwohlverträglichkeit von Innovationen und ist damit Chiffre für eine normative Orientierungen und Vorgaben sichernde Begleitung von Innovationsprozessen. Einleitend werden die Aufgaben und Kapazitäten des Rechts zur Sicherung von Rechtsgütern und rechtlich geschützten oder nur gesellschaftlich anerkannten Interessen bei der Entwicklung von Innovationen ausgelotet. Aus soziologischer und ökonomischer Perspektive werden ferner die übergreifenden Bezugspunkte von Vorsorge und Folgenabschätzung innovationsbezogen konkretisiert. Anschließend werden Referenzgebiete von der Nanotechnologie über Neuroimplantate und grüne Gentechnik bis zum Chemikalienrecht (REACh) und dem Elektrogesetz auf die Verankerung und jeweilige Ausgestaltung einer Innovationsverantwortung hin untersucht.     Abstract: Immigrant Stories portrays the contexts and academic trajectories of development of three unique immigrant groups: Cambodian, Dominican and Portuguese. The children of immigrant families - or second generation youth - are the fastest growing population of school children in the US. However, very little is known about these children's academic and psychological development during middle childhood. We examine the previously under-explored intricacies of children's emerging cultural attitudes and identities, academic engagement, and academic achievement. These processes are studied alongside a myriad of factors in the family and school environment that combine to shape children's academic psychological functioning during this important period. Through a three-year longitudinal study, including interviews with teachers, parents and children, this book presents a fascinating look at the community, school, and family contexts of child development among second-generation children. Both pre-immigration and post-immigration characteristics are explored as critical factors for understanding children of immigrants' development. In the current climate of US immigration policy debate, we offer research findings that may inform educators and administrators about the sources of community strengths and challenges facing our newest immigrant generations.

    Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen.

Entgegen der Virtual Property Theory resultieren die Befugnisse gegenüber dem Betreiber dabei nur aus dem Zusammenspiel faktischer Einwirkungsmöglichkeiten mit der Gesamtheit der dem Verpflichtungsgeschäft immanenten schuldrechtlichen Ansprüche. Im Verhältnis zu Dritten verläuft die Rechtsschutzproblematik aufgrund der Client-Server-Architektur virtueller Umgebungen parallel zu der extern gespeicherter Datenbestände. Zahlreiche Rechtsbücher nahmen einzelne Rechtssätze bis hin zu umfangreichen Teilen des Spiegels in sich auf und sicherten so die Weiterverbreitung nicht nur weit über die Grenzen seines sächsischen Entstehungsraumes, sondern auch weit über das Mittelalter hinaus.     Abstract: Are postcolonies haunted more by criminal violence than other nation-states? The usual answer is yes. In Law and Disorder in the Postcolony, Jean and John Comaroff and a group of respected theorists show that the question is misplaced: that the predicament of postcolonies arises from their place in a world order dominated by new modes of governance, new sorts of empires, new species of wealth-an order that criminalizes poverty and race, entraps the "south" in relations of corruption, and displaces politics into the realms of the market, criminal economies, and the courts.  As these essays make plain, however, there is another side to postcoloniality: while postcolonies live in states of endemic disorder, many of them fetishize the law, its ways and itsmeans. How is the coincidence of disorder with a fixation on legalities to be explained? Law and Disorder in the Postcolony addresses this question, entering into critical dialogue with such theorists as Benjamin, Agamben, and Bayart. In the process, it also demonstrates how postcolonies have become crucial sites for the production of contemporary theory, not least because they are harbingers of a global future under construction.

    Abstract: Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew.

Vor diesem Hintergrund geht die Autorin, selbst Richterin am Verwaltungsgericht, am Beispiel des Widerrufs von Flüchtlingsanerkennungen im Einzelnen der Frage der Völkerrechts- und Europarechtskonformität der deutschen Rechtsprechung nach. Baumgarten war im Jahr seiner bei Franz v. Liszt verteidigten Dissertation (1909) nach Genf berufen worden und lehrte in Köln, Basel, Frankfurt/M. und Berlin. Von der dreiteiligen "Wissenschaft vom Recht" (1922) urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die stärkste Wirkung aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. Die Erfahrung von Faschismus und Krieg führte ihn in der Mitte der vierziger Jahre zu sozialistischen Überzeugungen und Erwartungen und zur Marxschen sozialwissenschaftlichen Methode, so dass er, nach Frankfurt nicht zurückberufen, gleich anderen antifaschistischen Intellektuellen in die Ostzone und spätere DDR zog. Gerd Irrlitz behandelt die Hauptwerke und die marxistisch orientierten Texte Baumgartens - wie überhaupt die sozialliberale und die späte sozialistische Periode - nicht als Gegensätze, sondern als aufeinander bezogene und einander bedingende Konzepte, überzeugt, dass das Werk des Rechtsphilosophen unterm Erfordernis der Erneuerung des sozialen Liberalismus in der hochindustriellen Zivilisation neue Aktualität gewinnen...

    Abstract: Of the over 33 million refugees and internally displaced people in the world today, a disproportionate percentage are found in Africa. Most have been driven from their homes by armed strife, displacing people into settings that fail to meet standards for even basic human dignity. Protection of the human rights of these people is highly uncertain and unpredictable. Many refugee service agencies agree advocacy on behalf of the displaced is a key aspect of their task. But those working in the field are so pressed by urgent crises that they can rarely analyze the requirements of advocacy systematically. Yet advocacy must go beyond international law to human rights as an ethical standard to prevent displaced people from falling through the cracks of our conflicted world.Refugee Rights: Ethics, Advocacy, and Africa draws upon David Hollenbach, SJ's work as founder and director of the Center for Human Rights and International Justice at Boston College to provide an analytical framework for vigorous advocacy on behalf of refugees and internally displaced people. Representing both religious and secular perspectives, the contributors are scholars, practitioners, and refugee advocatesùall of whom have spent time on the ground in Africa. The book begins with the poignant narrative of Abebe Feyissa, an Ethiopian refugee who has spent over fifteen years in a refugee camp from hell. Other chapters identify the social and political conditions integral to the plight of refugees and displaced persons. Topics discussed include the fundamental right to freedom of movement, gender roles and the rights of women, the effects of war, and the importance of reconstruction and reintegration following armed conflict.     Abstract: Hauptbeschreibung Pascale Cancik untersucht die Offizialisierung und Professionalisierung von Verwaltungskommunikation im Preußen des frühen 19. Jahrhunderts. Zu dieser Zeit erreichte der aufklärerische Öffentlichkeitsdiskurs der 'Sattelzeit' verschiedene Bereiche von Gesellschaft und Recht (Parlamente, Gerichte, Presse). Die Verwaltung indessen, die damals ihre modern-bürokratische Form entwickelte, wird von der historischen Forschung kaum mit jenen liberalen Öffentlichkeitsforderungen in Verbindung gebracht. Ist das gegenwärtig wieder viel untersuchte Thema Verwaltung und Öffentlichkeit zu Recht kein Thema (rechts-)historischer Forschung? Die Autorin zeigt zunächst, dass es durchaus einen zeitgenössischen Publizitätsdiskurs gab, der sich gerade auch auf Verwaltung bezog. Aber kam dieser auch in der Praxis von Recht und Verwaltung an? Da Öffentlichkeiten sich in Kommunikationen manifestieren, werden zwei Felder von Verwaltungskommunikation genauer untersucht: die Publikation staatlichen Handelns durch die Verwaltung sowie die Entwicklung konkreter Verwaltungsverfahren, innerhalb derer die Verwaltung mit Bürgern kommuniziert. Im Zentrum stehen dabei jeweils die Rolle von Recht und Rechtspraxis. Es ergibt sich ein komplexes Bild von Motiven und Intensitäten der Einbeziehung oder gar Beteiligung von Bürgern. Bis heute genutzte Techniken, Medien und Verfahren wurden damals mit Hilfe von Recht konzipiert und eingeübt. Sie sind nicht, wie manchmal behauptet, ausschließlich mit Demokratie verbunden.

    Abstract: Crip Theory attends to the contemporary cultures of disability and queerness that are coming out all over. Both disability studies and queer theory are centrally concerned with how bodies, pleasures, and identities are represented as "normal" or as abject, but Crip Theory is the first book to analyze thoroughly the ways in which these interdisciplinary fields inform each other. Drawing on feminist theory, African American and Latino/a cultural theories, composition studies, film and television studies, and theories of globalization and counter-globalization, Robert McRuer articulates the central concerns of crip theory and considers how such a critical perspective might impact cultural and historical inquiry in the humanities. Crip Theory puts forward readings of the Sharon Kowalski story, the performance art of Bob Flanagan, and the journals of Gary Fisher, as well as critiques of the domesticated queerness and disability marketed by the Millennium March, or Bravo TV's Queer Eye for the Straight Guy.     Abstract: Market reform, financial decentralization, and economic globalization have greatly accentuated China's social and regional inequalities. Education is expected to address these inequalities in a context of rapid social change, including the rise of an urban middle class, changed status of women, resurgence of ethnic identities, growing rural to urban migration, and lingering poverty in remote areas. But some argue that state policies have not sufficiently addressed inequitable practices, and that schools actually perpetuate and reproduce inequities, giving rise to a new system of social stratification driven more by market forces than socialist principles. Featuring all original, previously unpublished material, this volume examines this argument through analysis of selected aspects of educational stratification in China during the reform era. Chapters focus on the new urban middle class, poor rural residents, the migrant population in urban areas, rural girls, and ethnic minorities. The contributors are established scholars in the field, and they build a conceptual framework for assessing the degree to which China's educational reforms are inclusive, equitable, and integrative across social categories and groups.
