    Abstract: Creativity has become part of the language of regeneration experts, urban planners and government policy makers attempting to revive the economic and cultural life of cities in the 21st century. Concepts such as the creative class, the creative industries and bohemian cultural clusters have come to dominate thinking about how creativity can contribute to urban renewal. Spaces of Vernacular Creativity offers a critical perspective on the instrumental use of arts and creative practices for the purposes of urban regeneration or civic boosterism. Several important contributions are brought into one volume to examine the geography of locally embedded forms of arts and creative practice. There has been an explosion of interest in both academic and policy circles in the notion of creativity, and its role in economic development and urban regeneration. This book argues for a rethinking of what constitutes creativity, foregrounding non-economic values and practices, and the often marginal and everyday spaces in which creativity takes shape. Drawing on a range of geographic contexts including the U.S., Europe, Canada and Australia, the book explores a diverse array of creative practices ranging from art, music, and design to community gardening and anticapitalist resistance. The book examines working class, ethnic and non-elite forms of creativity, and a variety of creative spaces, including rural areas, suburbs and abandoned areas of the city.     Abstract: This report covers a broad range of SME taxation issues, including possible effects of taxation on the creation and growth of SMEs, and considerations arising from a relatively high compliance burden. Differing income tax and social security contribution burdens of unincorporated and incorporated SMEs are considered in detail, with analysis of average statutory tax rates carried out to investigate possible tax distortions to business creation and business structure decisions of a single worker/owner of an SME. Various arguments are presented for and against the targeting of tax incentives at SMEs. Country examples of SME tax incentives and compliance cost reduction measures are provided in the report.

    Abstract: Vom 19. Jahrhundert als einer Mediengesellschaft zu sprechen, erscheint als ein Anachronismus. Der Begriff sucht den Bedeutungsgewinn und die Diversifizierung der Medien in der Gegenwart zu erfassen und damit nicht zuletzt heutige von früheren Gesellschaften abzugrenzen. Die Annahme, dass Medien in früheren Gesellschaften nicht ebenfalls eine zentrale und spezifische Rolle zukam, wäre jedoch irrig. So war das 19. Jahrhundert nicht nur vom Aufstieg einer Vielzahl einstmals neuer Medien geprägt, sondern auch dadurch, dass sich die Gesellschaft über öffentliche und mediale Kommunikation erst konstituierte und ausdifferenzierte. Der Band macht es sich zur Aufgabe, ineinander greifende zentrale mediale und gesellschaftliche Entwicklungen für Deutschland und für Frankreich in einer übergreifenden wie vergleichenden Perspektive vorzustellen.

    Abstract: Reisen zu indigenen Kulturen sind wegen deren angeblichen Verletzlichkeit verpönt. Diese Berechtigung dieser Ansicht wird am Beispiel von Tourismus zu Tuareg-Nomaden in der Region Agadez, Zentralsahara, überprüft. Dazu wurden die historischen, politischen, ökonomischen und kulturellen Rahmenbedingungen und Entwicklungsprozesse der Region sowie auch jene des Bergdorfes Timia in den Aïr-Bergen untersucht. Besonderes Augenmerk galt den Strukturen der regionalen Tourismusentwicklung, wozu regionale Agenturbetreiber, Sahara-Touristen sowie Angehörige der betroffenen Landbevölkerung interviewt wurden. Weiters wurden die Kataloge von europäischen Reiseveranstaltern analysiert. Schließlich wurde auch eine Trekking-Reise mittels teilnehmender Beobachtung evaluiert, wobei keine wesentlichen soziokulturellen und ökologischen Belastungen nachweisbar waren. Als Evaluationsmaßstab wurde das System einer kybernetischen Ethik entwickelt, die sich als personelle Ausprägung der "nachhaltigen Entwicklung" versteht. Ein weiterer Schwerpunkt war die ideologiekritische Analyse des Tuareg-Mythos."Tuareg-Tourismus" wird überwiegend von urbanisierten Tuareg-Nomaden und einstigen Tuareg-Rebellen betrieben. Charakteristisch sind das weitgehend ungelenkte Tourismuswachstum, intensives Konkurrenzverhalten der Reiseveranstalter und geringe interkulturelle Qualifikation des Personals. Die Region leidet unter Arbeitslosigkeit und Dürren, weshalb die ökonomische Rolle des Tourismus signifikant ist. Jedoch trägt diese Einkommenschance auch zu inneren Konflikten bei. Insofern weist Tourismus sowohl stabilisierende als auch destabilisierende Tendenzen auf. Die Belastungen des gesamten Tourismusaufkommens, maximal 4.000 Personen pro Jahr, halten sich aufgrund des großen Reisegebiets in Grenzen.     Abstract: Einkommensalternative sowie als Mittel zur Requirierung von Entwicklungsprojekten betrachtet wird. Dieser Sichtweise wurde abschließend vor dem Hinterrund der Transzendentalpragmatik und des Kulturalismus auf deren Legitimationskraft analysiert. Im Ergebnis konnte die spezifische Form des Tuareg-Tourismus als vertretbar nachgewiesen werden, weil in seiner gegenwärtigen Form die stabilisierenden Effekte dominieren.     Abstract: Where does the nation-state end and globalization begin? In Territory, Authority, Rights, one of the world's leading authorities on globalization shows how the national state made today's global era possible. Saskia Sassen argues that even while globalization is best understood as "denationalization," it continues to be shaped, channeled, and enabled by institutions and networks originally developed with nations in mind, such as the rule of law and respect for private authority. This process of state making produced some of the capabilities enabling the global era. The difference is that these capabilities have become part of new organizing logics: actors other than nation-states deploy them for new purposes. Sassen builds her case by examining how three components of any society in any age--territory, authority, and rights--have changed in themselves and in their interrelationships across three major historical "assemblages": the medieval, the national, and the global.     Abstract: Are postcolonies haunted more by criminal violence than other nation-states? The usual answer is yes. In Law and Disorder in the Postcolony, Jean and John Comaroff and a group of respected theorists show that the question is misplaced: that the predicament of postcolonies arises from their place in a world order dominated by new modes of governance, new sorts of empires, new species of wealth-an order that criminalizes poverty and race, entraps the "south" in relations of corruption, and displaces politics into the realms of the market, criminal economies, and the courts.  As these essays make plain, however, there is another side to postcoloniality: while postcolonies live in states of endemic disorder, many of them fetishize the law, its ways and itsmeans. How is the coincidence of disorder with a fixation on legalities to be explained? Law and Disorder in the Postcolony addresses this question, entering into critical dialogue with such theorists as Benjamin, Agamben, and Bayart. In the process, it also demonstrates how postcolonies have become crucial sites for the production of contemporary theory, not least because they are harbingers of a global future under construction.

    Abstract: Is it time to take a break from feminism? In this pathbreaking book, Janet Halley reassesses the place of feminism in the law and politics of sexuality. She argues that sexuality involves deeply contested and clashing realities and interests, and that feminism helps us understand only some of them. To see crucial dimensions of sexuality that feminism does not reveal--the interests of gays and lesbians to be sure, but also those of men, and of constituencies and values beyond the realm of sex and gender--we might need to take a break from feminism. Halley also invites feminism to abandon its uncritical relationship to its own power. Feminists are, in many areas of social and political life, partners in governance. To govern responsibly, even on behalf of women, Halley urges, feminists should try taking a break from their own presuppositions. Halley offers a genealogy of various feminisms and of gay, queer, and trans theories as they split from each other in the United States during the 1980s and 1990s. All these incommensurate theories, she argues, enrich thinking on the left not despite their break from each other but because of it. She concludes by examining legal cases to show how taking a break from feminism can change your very perceptions of what's at stake in a decision and liberate you to decide it anew.

First, agriculture specific programmes intended to increase the welfare of farmers can become capitalised into asset values. Von der dreiteiligen "Wissenschaft vom Recht" (1922) urteilte Albrecht Mendelssohn Bartholdy im "Archiv des öffentlichen Rechts", hier sei die Jurisprudenz auf Philosophie gegründet, und die Lehre Baumgartens werde neben Stammler und Nelson die stärkste Wirkung aufs Rechtsdenken gewinnen. Mit seinen philosophischen Schriften wurde Baumgarten, beeinflusst von James und Dewey, in den zwanziger und dreißiger Jahren des vergangenen Jahrhunderts ein Vordenker des sozialliberalen Pragmatismus in der deutschen Philosophie und nahm deren Hinwendung zur angloamerikanischen philosophischen Tradition um Jahrzehnte vorweg. 1933 erklärte er, unterm NS-Regime nicht Rechtwissenschaft lehren zu können, und ging von Frankfurt in die Schweizer Emigration. In some fishing communities, almost sixty percent of jobs are linked to fishing and in many coastal areas there are few alternative employment opportunities for fishers. This conference proceedings analyses the social issues and policy challenges that arise from fisheries adjustment policies, and how OECD member countries are meeting those challenges.

Die Autorin zeigt zunächst, dass es durchaus einen zeitgenössischen Publizitätsdiskurs gab, der sich gerade auch auf Verwaltung bezog. Aber kam dieser auch in der Praxis von Recht und Verwaltung an? Da Öffentlichkeiten sich in Kommunikationen manifestieren, werden zwei Felder von Verwaltungskommunikation genauer untersucht: die Publikation staatlichen Handelns durch die Verwaltung sowie die Entwicklung konkreter Verwaltungsverfahren, innerhalb derer die Verwaltung mit Bürgern kommuniziert. Im Zentrum stehen dabei jeweils die Rolle von Recht und Rechtspraxis. Es ergibt sich ein komplexes Bild von Motiven und Intensitäten der Einbeziehung oder gar Beteiligung von Bürgern. Bis heute genutzte Techniken, Medien und Verfahren wurden damals mit Hilfe von Recht konzipiert und eingeübt. Sie sind nicht, wie manchmal behauptet, ausschließlich mit Demokratie verbunden.

In Authentic New Orleans, Kevin Fox Gotham explains how New Orleans became a tourist town, a spectacular locale known as much for its excesses as for its quirky Southern charm. Gotham begins in the aftermath of Hurricane Katrina amid the whirlwind of speculation about the rebuilding of the city and the dread of outsiders wiping New Orleans clean of the grit that made it great. He continues with the origins of Carnival and the Mardi Gras celebration in the nineteenth century, showing how, through careful planning and promotion, the city constructed itself as a major tourist attraction. By examining various image-building campaigns and promotional strategies to disseminate a palatable image of New Orleans on a national scale Gotham ultimately establishes New Orleans as one of the originators of the mass tourism industry-which linked leisure to travel, promoted international expositions, and developed the concept of pleasure travel. Gotham shows how New Orleans was able to become one of the most popular tourist attractions in the United States, especially through the transformation of Mardi Gras into a national, even international, event. All the while Gotham is concerned with showing the difference between tourism from above and tourism from below-that is, how New Orleans' distinctiveness is both maximized, some might say exploited, to serve the global economy of tourism as well as how local groups and individuals use tourism to preserve and anchor longstanding communal traditions.

    Abstract: This book enhances understanding and consensus on why and how we need to work more strategically and coherently on the integration of human rights and development. It reviews the approaches of different donor agencies and their rationales for working on human rights, and identifies the current practice in this field. It illustrates how aid agencies are working on human rights issues at the programming level, and it draws together lessons that form the core of the current evidence around the added value of human rights for development. Lastly, it addresses both new opportunities and conceptual and practical challenges to human rights within the evolving development partnerships between donors and partner countries, as well as in relation to the Paris Declaration on Aid Effectiveness as a new reference point of the international aid system. By giving numerous examples of practical approaches, this publication shows that there are various ways for donor agencies to take human rights more systematically into account – in accordance with their respective mandates, modes of engagement and comparative advantage.

    Abstract: In West Africa, approximately 16 million people depend directly or indirectly on cotton cultivation. But subsidies in the developed world have suppressed cotton prices and have made it difficult for West African producers to compete. Compounding the problem, WTO negotiations on the problem have been suspended. This publication contends that the dialogue between developed and developing countries on this topic must continue. It sets out the regional stakes linked to the economic and social importance of cotton in West Africa. It retraces the consultation process on the West African cotton crisis with the aim of finding a negotiated solution acceptable to all parties. Also discussed are the challenges and the measures that need to be taken over the medium and long term in order to prevent this sub-sector’s sudden collapse.

    Abstract: These workshop proceedings assess the third party liability and compensation mechanisms that would be implemented by participating countries in the event of a nuclear accident taking place within or near their borders. To do so, two fictitious accident scenarios were developed: one involving a fire in a nuclear installation located in the Slovak Republic and resulting in the release of significant amounts of radioactive materials off-site, and the other a fire on board a ship transporting enriched uranium hexafluoride along the Danube River. The first scenario was designed to involve the greatest possible number of countries, with the second being restricted to countries with a geographical proximity to the Danube. These proceedings contain the papers presented at the workshop, as well as reports on the discussion sessions held.

    Abstract: More than 450 years after their birth in the Anabaptist movement, 125 years after their secession from Russian Mennonitism, and 60 years after their immigration to Canada, the Mennonite Brethren exhibit specific and measurable signs of sectarian viability and religious vitality. To explain the persistence of the sect, Hamm analyses the process of sacralization within the Canadian Mennonite Brethren Church - which "safeguards identity, a system of meaning, or a definition of reality" - and the process of secularization - which "erodes boundaries, dislodges stable structures, and destroys identity." It is an oversimplification, the author argues, to insist that the factors of continuity - ethical and cognitive norms, family solidarity, ethnicity, worship, evangelism, community and church structures, and service agencies - are solely integrative and that the factors of change - urbanization, education, occupational change, and economic affluence - are solely disruptive. Instead, a complex dialectic between the two processes is at work that prevents restrictive rigidity within the sect and excessive accommodation to the host society. According to the author, "this analysis of the Canadian Mennonite Brethren becomes a case study to test the utility of an identity theory of religion, which hinges on the integration/differentiation dialectic. It is, at the same time, a serious self-study in religious sociology, by which the author seeks to gain a better understanding of the processes of growth and decline, of continuity and change, and of the ongoing tension resulting from the religious movement's confrontation with society.".

    Abstract: This publication presents four studies which represent recent core work of the OECD Investment Committee. The first study, "Transparency and Third Party Participation in Investor-to-State Dispute Settlement ," aims to enhance understanding of the role of transparency and third party participation in investor-state dispute settlement procedures. It examines the current rules, steps taken to improve transparency, and the perceived advantages as well as the challenges of additional transparency. Two other studies touch upon two of the most frequently contested provisions in investor-state arbitration. "Fair and Equitable Treatment Standard in International Investment Law" clarifies the concept, based on jurisprudence and state practice. "‘Indirect Expropriation’ and the ‘Right to Regulate’ in International Investment Law" identifies the main criteria found in investment agreements and used by tribunals to articulate the difference between the two concepts. The final paper looks at most favoured nation treatment.

    Abstract: This book brings together the findings of key sector- and media-specific analyses of the environment in the Eastern Europe, Caucasus, and Central Asia (EECCA) area and puts forward a set of indicators to provide a one-stop, concise and up-to-date assessment that is accessible also to a non-specialist audience. It systematically looks at environmental legislation, policies, and institutions; pollution prevention and control; natural resources management; environmental policy integration; financial resources for the environment; environmental information and public awareness; and co-operation on transboundary issues. It finds that the problems are serious, but they vary across countries. A significant burden of environmental disease persists – one out of 1 000 children born in Tajikistan dies before the age of five due to diarrhoeal diseases closely associated to lack of safe water. Despite low income levels, natural resources are under heavy pressure – nine out of twelve countries forming the region are water-stressed. To confront those problems, institutional development and policy responses would need to be stepped up. This assessment finds that current policies are often ineffective in stimulating significant improvements, scarce resources are spent without clear programmatic frameworks, and policy integration is very limited.

The contributors argue for a nuanced approach that recognizes the difference between "organized" crime and the thousands of illicit acts that take place across national borders every day. They distinguish between the illegal (prohibited by law) and the illicit (socially perceived as unacceptable), which are historically changeable and contested. Detailed case studies of arms smuggling, illegal transnational migration, the global diamond trade, borderland practices, and the transnational consumption of drugs take us to Asia, Africa, Latin America, Europe, and North America. They allow us to understand how states, borders, and the language of law enforcement produce criminality, and how people and goods which are labeled "illegal" move across regulatory spaces.
