Abstract: This book describes how statements made by non-state actors affect the scope of an individual's criminal responsibility and how they should be taken into account by domestic criminal courts. Sentencing is only possible on the basis and within the limits of the law. In the 21st century, this law increasingly means regulations formulated by various non-state actors: international organisations, human rights tribunals or statutory bodies. The content of these regulations does not only refer to states, but often has a direct impact on the legal situation of individuals. Two worlds collide here. Strict criminal law is influenced by fluid regulations issued by entities that have not been empowered to exercise the right to punish. The book presents an interpretative method to support the court's inference in the cases outlined above, based on the using the concept of two interrelated norms: the norm of the individual and the norm of the court.

Abstract: This book seeks to explore the potential and actual value of parliamentary debates as a source of legislative justification. Drawing on a sample of recent Spanish legislation, the papers collected here analyse (critically) the rationale of several laws or legislative measures as it can be reconstructed from the respective parliamentary discussions. All issues covered have given rise to intense political, legal and social controversy: they range from the combat against gender violence, the legal status of bullfighting, the protection of crime victims and the so-called ‘push-backs’ at the border, to the regulation of euthanasia, the minimum living income, underage girls’ access to abortion, and joint child custody. The volume is organised into two main parts. The first group of case studies adopt a legisprudential perspective and examine parliamentary deliberations in the light of the theory and methodology of legislative justification; the contributions in the second part follow approaches that fall outside – but are largely compatible with –legisprudence, and deal with aspects such as the rhetorical strategies employed by MPs when debating bills, and the role of elected legislators as constitutional interpreters.

Abstract: This book focuses on two main aspects: legal convergence and crises. Despite the abundance of literature on legal convergence over the years, the question of whether legal systems are converging or diverging remains unanswered. This book provides a valuable contribution to questions concerning comparative law, legal convergence, and legal transplants by examining them through the lens of crises. Crises challenge countries’ legal systems and prompt institutional responses to tackle perceived shortcomings in the law. The crises witnessed by the world over the last two decades have highlighted two seemingly contradictory tendencies: (i) increased cooperation and a natural phenomenon of legal convergence as states find common solutions to common problems; (ii) a preference for state-centric solutions, which prioritise domestic interests; rejection of supranational standards and harmonisation efforts; and protection of domestic sovereignty. This book aims to determine whether, in times of crisis, foreign laws, rules, and concepts can transcend countries’ domestic legal systems, or whether states’ responses to crises lead to legal divergence and disintegration. Unlike traditional studies on convergence, this edited volume takes an international and cross-thematic approach, with chapters focusing on how legislation in selected jurisdictions has responded to crises. Therefore, the book’s originality lies in its truly global nature, with chapters and authors surveying jurisdictions in Africa, North and South America, Asia, Europe and Oceania. The breadth of legal areas covered, with a mix of private and public law, also add to its uniqueness. From Russia to Germany and from bankruptcy law to environmental law, the book examines whether, as a result of crises, policy and legal responses have adopted, copied, or implemented features, policies, principles and/or rules from other legal systems (convergence), or have departed from existing legal norms, adopting policies and rules that differ from those of other countries (divergence).

Abstract: Digital technologies are playing a growing role in achieving the UN’s Sustainable Development Goals (SDGs). They are both a tool both for achieving developmental outcomes and a driver of change. However, the use of digital technologies also entails certain legal challenges. The purpose of this book is to highlight these challenges and suggest solutions. Written by leading researchers from six countries, who analyse legislative solutions from around the world, it includes chapters on the benefits of asset tokenisation, the role of artificial intelligence in achieving sustainable development, legal issues in the green digital transformation, and human rights in a digital world. Through a mixture of fundamental analysis and real-world examples, readers will learn how emerging digital technologies can help achieve various SDGs and what legal challenges arise from their application. This important resource will be of interest to academics, government and legal officials whose work involves the legal regulation of the introduction and use of new digital technologies, as well as sustainable development challenges. Legal experts engaged in the design of new legal infrastructures during the current phase of digital, climatic and social transformation in private, public and social organizations will also find it useful.

Abstract: This book focuses on devising a comprehensive protective mechanism for the right to privacy in Pakistan. It argues that the existing legal regime lacks an effective remedy for victims of privacy violations and emphasizes the need for comprehensive legislation to safeguard this crucial right. Pursuing a multidisciplinary approach, the book thoroughly explores the issue of media intrusions into people’s privacy through thematic media content analysis and highlights the significant impacts of these intrusions on victims’ lives. In the process, the book addresses various conceptual aspects, their relevance, and their implications for privacy-related disputes during adjudication. Recognizing that theoretical underpinnings alone may not be sufficient to create a legal regime “from scratch,” it explores the enforcement of the right to privacy under the European Convention on Human Rights (ECHR), as interpreted and enforced by the European Court of Human Rights (ECtHR). The book subsequently goes beyond exploring international law by analyzing the impact of media-and-privacy cases on privacy protection in two major member states: Germany (a civil law jurisdiction) and the United Kingdom (a common law jurisdiction). Drawing upon these conceptual and comparative legal deliberations and findings, the book provides concrete guidelines for a new privacy law in Pakistan.

Abstract: Containing a novel compilation of theoretical and methodological approaches, this textbook lays out the most relevant foundations of clinical sociology. Relying heavily on well-recognized medical models and concepts to help communicate ideas (e.g. treatment, diagnosis, clinical, cure), the methods of social diagnosis and social therapy presented in this book will help in better and socially informed protection of vulnerable individuals and citizens as well as an informed design of protection policies for macro, mezzo and micro levels of society. The book explains that many problems, perceived as economic, psychological-individual, and political, are rooted in social functions and structures of the wider society, and how these social structures and functions interact in everyday life. Through the application of the theoretical and methodological approaches in case studies on recent issues, such as the Covid pandemic, or the Hurricane Katrina disaster, the book will allow readers to easily cope with the complexity of clinical sociology and to develop clinical competencies and pertinent training. This renders the book not only highly useful for advanced undergraduate and graduate students of clinical and applied sociology but also for the preparation of courses for theoretically informed practitioners who are keen to work by defining learning objectives and learning paths.

Abstract: This book explores key issues on the relational and operational dimension of the professional actions aimed at ensuring the well-being and inclusion of migrants in the reception system. Starting from the assumption that well-being is a multi-level phenomenon related to different and complex questions, the chapter authors articulated their reflections developing some thematic contents, complementary to one another, from the perspectives of different social actors involved in the inclusion process. A special attention is paid to the risk factors as potential obstacles to the inclusion, not only in the achievement of well-being but also in the relationship with the receiving society and with the reception system. Case studies will be presented to show how this complexity is explored integrating different theoretical perspectives with the participation of all social actors involved in inclusion pathways (unaccompanied migrant minors, immigrant families, refugees, social operators, voluntary guardians). The authors share the social responsibility in investing in human and professional resources in the reception system and in connecting it with the local community. Updating the social workers’ tools and methods become more and more relevant to enable the diffusion of new skills, functions, and roles in the management of reception of migrant minors and adults.

Abstract: This open access volume provides an in-depth analysis of philosophical discussions concerning the common good and its relation to self-interest in the history of Western philosophy. The thirteen chapters explore both renowned and lesser-known thinkers from the Middle Ages to the eighteenth century, covering also the relevant ancient background. By bridging the gap between the medieval and early modern periods, they provide fresh insights into how moral and political philosophers understood the concepts of the common good and self-interest, along with their ethical and political implications. The concept of the common good occupies a central role in philosophical reflections on the public and private dimensions of moral and social life in contemporary debates. By exploring the rich and diverse ways in which the relationship between the common good and self-interest has been understood, this volume has the potential to contribute to our ongoing efforts to critically discern the possibilities and limitations of these concepts in the present. Thus, the volume will be useful for scholars interested in the multi-layered role of the notion of the common good both in the history of philosophy and in contemporary moral and political philosophy.

Abstract: This textbook is a second edition of the successful, Mathematical Logic: On Numbers, Sets, Structures, and Symmetry. It retains the original two parts found in the first edition, while presenting new material in the form of an added third part to the textbook. The textbook offers a slow introduction to mathematical logic, and several basic concepts of model theory, such as first-order definability, types, symmetries, and elementary extensions. Part I, Logic Sets, and Numbers, shows how mathematical logic is used to develop the number structures of classical mathematics. All necessary concepts are introduced exactly as they would be in a course in mathematical logic; but are accompanied by more extensive introductory remarks and examples to motivate formal developments. The second part, Relations, Structures, Geometry, introduces several basic concepts of model theory, such as first-order definability, types, symmetries, and elementary extensions, and shows how they are used to study and classify mathematical structures. The added Part III to the book is closer to what one finds in standard introductory mathematical textbooks. Definitions, theorems, and proofs that are introduced are still preceded by remarks that motivate the material, but the exposition is more formal, and includes more advanced topics. The focus is on the notion of countable categoricity, which analyzed in detail using examples from the first two parts of the book. This textbook is suitable for graduate students in mathematical logic and set theory and will also be of interest to mathematicians who know the technical aspects of the subject, but are not familiar with its history and philosophical background. .

Abstract: Law’s regulatory reach has grown significantly over the past few decades. Yet, at the same time, law schools and legal professions in Western and Western-oriented jurisdictions have undergone an acute crisis. How is this possible? In this insightful and wide-ranging book, Luca Siliquini-Cinelli argues that these trends are in fact complementary manifestations of a single phenomenon—namely, that law is and will always be more capable of regulating social interaction without the experiential contribution of legal experts. Siliquini-Cinelli contends that the separation of law’s regulatory function from legal experts is structurally linked to the former’s nature and operational dynamics as an intellectual artifact to be used for ordering purposes. As a product of the intellect, law is a matter of knowledge, not experience. In fact, Siliquini-Cinelli holds, law’s artifactuality voids experience, including that of legal experts, making it redundant. This explains how law can thrive as a regulatory phenomenon while the very places where future legal professionals are formed and those places where it is practised are in crisis. To show this, Siliquini-Cinelli embarks upon a historical, philosophical, and comparative analysis of law’s artifactuality, focusing on the teaching, study and practise of law as intellectual endeavours, from the advent of juristic activities in the Late Roman Republic to current legal pedagogies, practices, and reforms in Civil and Common law jurisdictions. In so doing, Siliquini-Cinelli employs the Latin phrase ‘scientia iuris’ to explain why and how legal education and practice pursue knowledge at the expense of experience, and the serious implications this has for lawyering activities. Moving beyond established narratives, Siliquini-Cinelli argues that ‘scientia iuris’ ought not be reduced to dogmatic analysis (scientia iuris as doctrina iuris). Rather, ‘scientia iuris’ denotes the knowledge of the law sought by all those who teach, study, and practise it, and which is actualised through a form of legal thinking and argumentation that moves along reason’s metaphysical, constructivist lines (scientia iuris as cognitio iuris). Thus, scientia iuris is not the prerogative of a few legal scholars; rather, it lies at the very core of Western legal education and practice, broadly understood. The relevance of Siliquini-Cinelli’s original and interdisciplinary analysis is profound and far-reaching: the crisis that legal education and practice are undergoing is not an isolated, or accidental, event; it is a consequence of the very ways in which law has been taught, studied, and practised since Rome.

Abstract: Eminent lawyers from academia, international judiciary and legal practice join up to honour Professor Mads Andenas KC (Hon). Contributions form a cutting edge volume across legal disciplines led by an advisory editorial committee including Prof. Guido Alpa, Prof. Carl Baudenbacher, Prof. Eirik Bjorge, Prof. Giuseppe Conte and Prof. Duncan Fairgrieve. The general private law of tort and delict is subject to a transformation where the traditional national framework is becoming gradually less relevant. Much of the modernisation of private law takes place not at the domestic level but at a European or international level such as in international commercial conventions or EU consumer protection legislation. Remedies in regulatory law are becoming ever more important. The role of the European Court of Justice in developing general principles of contract and tort is ever increasing. Tort liability is an important subject of international conventions with the case law of the International Court of Justice developing general principles of tort liability in public international law.

Abstract: Fuzzy Sets Theory and Uncertainty in Mathematical Modeling -- The Extension Principle of Zadeh and Fuzzy Numbers -- Fuzzy Relations -- Notions of Fuzzy Logic -- Fuzzy Rule-Based Systems -- Fuzzy Relational Equations and Approximation -- Measure, Integrals and Fuzzy Events -- Fuzzy Dynamical Systems.
Abstract: This book provides an essential introduction to the field of dynamical models. Starting from classical theories such as set theory and probability, it allows readers to draw near to the fuzzy case. On one hand, the book equips readers with a fundamental understanding of the theoretical underpinnings of fuzzy sets and fuzzy dynamical systems. On the other, it presents some concepts of derivatives, integrals and differential equations applied to the context of fuzzy functions. Each of the major topics is accompanied by examples, worked-out exercises, and exercises to be completed. Moreover, many applications to real problems are presented, mainly in biomathematics where the so-called p-fuzzy systems play an important role. The book has been developed on the basis of the authors’ lectures to university students and is accordingly primarily intended as a textbook for both upper-level undergraduates and graduates in applied mathematics, statistics, and engineering. It also offers a valuable resource for practitioners such as mathematical consultants and modelers, and for researchers alike, as it may provide both groups with new ideas and inspirations for projects in the fields of fuzzy logic and biomathematics. This thoroughly updated second edition includes a new chapter on fuzzy optimization, which also presents an application in carbon markets analysis and modeling.

Abstract: Bacterial biofilm is a complex structure with diverse bacterial cells in a highly organized and ordered group within a matrix of extracellular polymeric substances they produce. Microbes attach to surfaces to develop biofilms, a sophisticated process regulated by factors such as nutritional status and biotic/abiotic surface features. An established biofilm structure mainly comprises bacterial cells, proteins, nucleic acid, and exo-polysaccharides that are extracellular macromolecules excreted as tightly bound layers in microbes, providing a perfect niche for bacteria to exchange genetic material between cells. In addition, bacterial cells in the matrix also communicate via quorum sensing, which greatly impacts biofilm processes. Under clinical circumstances, bacterial biofilm shows great resistance to antibiotics, disinfectants, and body defense systems, making it difficult for clinicians to eradicate and facilitate many infectious disease processes, leading to chronic infections of patients with long-term hospitalization and high mortality rates. Therefore, it is very important to understand the recent advances in forming, regulating, and eradicating biofilms in human infections to better prevent, control, and treat biofilm infections in humans. Written by an international team of basic and clinical researchers, the chapters of this book provide novel insights and advanced knowledge for life science researchers, clinical researchers, doctors, and other interested readers on some of the latest developments in biofilms

Abstract: Comparative Literature - Interdisciplinary Considerations is a wide-ranging exploration of various aspects of comparative literature and cultural phenomena from different angles. The authors delve into intriguing topics such as literary tourism, biofiction, colonial/postcolonial literature, suspense in literature, and the interaction between different artistic mediums. For instance, the analysis of Gabriel García Márquez’s works sheds light on the genres of magic realism and the Latin American boom, as well as how his literature influences literary tourism experiences. Another example is the study of Anna Enquist’s work, which showcases the genre of biofiction and examines the complex messages conveyed through reconstructed voices and alternative perspectives, including the portrayal of Captain Cook’s wife. This is compared with historical accounts of the 18th-century Ottoman Empire during Sultan Selim III’s reign, as studied by Stanford Shaw in Between Old and New. The book also explores the theme of unease and suspense in Patricia Highsmith’s writing, focusing on her iconic character Tom Ripley, known for his psychological depth and morally ambiguous nature. Additionally, discussions on colonial/postcolonial literature and the representation of women’s restrictions from a historical perspective contribute to a better understanding of power dynamics, gender representation, and non-Western literature. Henri Fauconnier’s Malaisie is analyzed in the context of “paracoloniality,” highlighting the transformative potential of Western texts and emphasizing overlooked aspects in discussions of colonial and postcolonial literature. The volume offers valuable insights into the representation of nations and historical figures through Malay and Persian travel narratives, as well as their influence on cultural identity. Moreover, the chapters explore the evolution of literary genres, the interconnectedness of literature with other art forms, and the impact of technological advancements on artistic expression. Overall, this book provides valuable perspectives on the rich tapestry of literature, art, and culture. It encourages scholars to explore diverse cultural expressions and fosters interdisciplinary dialogue within the field of comparative literature

Abstract: Microcirculation reflects the vascular bridge which is the conduit of blood flow between the arteries and veins in the body. It plays a critical role in the delivery of oxygen and nutrients to the cells of the body while also serving to wash away and eliminate biological waste products of metabolism. A complex interplay exists between the normal structure and function of the larger vessels of the body and the blood coursing through. This book discusses the evolving science in understanding the role of microcirculation in some of the most common and devastating diseases that plague humanity. By understanding the role of microcirculation in the normal feedback mechanisms that balance bleeding and clotting with the opportunities to manipulate this balance to treat disease, the impact on the individual and social burden of arterial and venous occlusive and thromboembolic disease can be substantial. Understanding disease mechanisms and enhancing our collective tools for diagnosis and treatment are some of the greatest challenges facing our global healthcare systems. The chapters in this book serve as a foundation for further research into the quest to reduce, if not eliminate, one of the most significant causes of major morbidity, mortality, and overall loss of quality of life worldwide. Without a doubt, the impact of the body’s microcirculation, as our understanding continues to evolve and as emphasized in this text, cannot and should not be underappreciated

Abstract: Osteoporosis is defined as a systemic bone loss disease exemplified by the deterioration of bone tissues and low bone mineral density (BMD), subsequently leading to an enhanced risk of developing fragility-related fractures. It’s a chronic inflammatory condition and is the 4th most burdensome chronic disease after ischemic heart disease, dementia, and lung cancer, with a huge economic burden on the world economy. This skeletal disorder affects predominantly women compared to men, and the risk increases with age. Although currently available therapies to treat osteoporosis are effective, side effects (real and perceived) are impediments to treatment adherence by the patients. Thus, there is an exigent need for renewed interest in managing osteoporosis with a better understanding of the pathophysiology, diagnosis, and treatment regime so that safer and more effective management and treatment modalities can be developed. Research in the last decade has led to enormous interest in the pathophysiology of osteoporosis. Importantly, the immune system is now an established player in the development of osteoporosis (Immunoporosis). Also, various off-the-track management and treatment approaches (probiotics, Synbiotics, FMT, etc.) are now being considered for managing osteoporosis. The present edited book will compile the latest trends and knowledge in the field, thereby creating a novel knowledge database for effective and efficient management and therapy of osteoporosis

Abstract: Although they are neither technically classified as grasses nor as actual cereal grains, pseudocereals are plants that yield fruits or seeds that are utilized and consumed like grains. Pseudocereals are complete grains that are usually high in protein and free of gluten. Supposedly many of the “ancient grains” are actually pseudocereals. The Food and Agricultural Organization (FAO) has also noted that pseudocereals greatly improve health and nutrition, as well as an individual’s food supply and standard of living, all of which can contribute to future food security and sustainability. Their protein-derived peptides have been shown in previous investigations to possess antioxidant, anti-inflammatory, anti-hypertensive, anti-cancerous, and hypocholesterolemic qualities. Because pseudocereals have these intriguing qualities, more research is required to determine how best to incorporate them into the diet and what health benefits they may offer, which is exactly what this book is about. It provides essential information to scientific and non-scientific communities alike to keep interest in pseudocereals alive for the overall health and wellness of the planet

Abstract: Cacao (Theobroma cacao L.) is a sacred tree and noble resource from South America. The Mayans and other early civilizations in Central America used cacao beans as tokens, which were subsequently transported to Europe to nurture monarchies and elites. Based on the discovery of cacao’s commercial potential and attributes, new cocoa plantations were established in other parts of the world, including Africa, Asia, and the Caribbean. Thus, cocoa has become an important cash crop in Africa, Central and South America, and Asia, where it is a major foreign exchange earner, industrial raw material, support for livelihood, and ecosystem services provision. Based on its global importance, there has been an increased need for the expansion of cultivation to meet the rising demand for cacao beans. Global environmental change, including climate change, variability, and weather extremes, has established new environmental boundaries with implications for area suitability for cocoa production and sustainability. Efforts to unlock the potentials of the established environmental boundaries may be built on the development and adoption of agrotechnological practices and integration of climate resilience for harnessing opportunities and potentials of the new environment, and thus, extension of the frontiers of cacao cultivation to meet the increasing global demand for cocoa beans. This book, “Shifting Frontiers of Theobroma Cacao - Opportunities and Challenges for Production” presents a comprehensive perspective of the interactions of changing environmental conditions, cocoa production, and sustainability. The book illuminates the challenges climate change presents for cocoa production and sustainability. It provides insights into the need for cocoa actors within the cocoa sector to strengthen climate mitigation and resilience building and to come to grips with the realities, magnitude, and inevitable persistence of climate challenges to cocoa production and sustainability

Abstract: 1 Introduction -- 2 The legal framework of consultation with indigenous peoples -- 3 Assessing consultation with indigenous peoples in the Inter-American System of Human Rights -- 4 Assessing consultation with indigenous peoples in Brazil -- 5 Assessing the application of consultation and indigenous peoples’ Protocols -- 6 Towards efficacy: Between the legal uncertainty of the requirement of consultation and its most adequate application for Brazil -- 7 Conclusion.
Abstract: This book offers a novel perspective on consultation with indigenous peoples in projects of natural resource exploitation. Engaging with current debates in international law, the study introduces a multi-dimensional perspective on consultation understood to include self-determination and cultural rights. It analyzes evidence from several countries across the Americas and Africa and presents an original and in-depth case study of Brazil. The book assesses judicial and legislative cases, drawing on relevant literature, international treaties and supplementary information gained from expert interviews. This supports the work’s broader objective to explore legal facts as well as to evaluate the empirical evidence in light of theoretical considerations. It thereby expands the understanding of consultation as a right under national legal systems and considers practical ways on how to enforce domestic redress for avoiding legal indeterminacy. The conclusions of the analysis contribute to not only a better understanding of the subject matter but also showcase ways of how to improve the realities on the ground. The book puts forward a range of recommendations directed at national authorities, international organizations, development lenders and civil society to help improve the unsatisfactory present circumstances. The intended audience encompasses legal scholars, students, practitioners and journalists, as well as anyone interested in research on the realization of indigenous peoples’ rights and the role of international law in the 21st century. .

Abstract: This collection responds to widespread, complex, and current environmental challenges by presenting eleven original essays on a new elemental-embodied approach in environmental humanities. This approach has a special focus on elemental and indigenous philosophies as well as localized experiences of terrestrial forces: from earthquakes and eruptions to pandemics and natural disasters. Representing a shift in modern Western scientific and disembodied thinking of nature, this edited book approaches the question of relationality and intertwining of human and natural being by utilizing the elemental-embodied methodologies within philosophy of embodiment and nature. Supported by research in cognitive sciences, the contributors represent the experiential and affective turn within research into human cognition. As embodied, the human being is embedded and interacting with all there is. The aim of this edited volume is to indicate new paths toward regaining our access to natural being within us and thus toward reconnecting with the natural environment and the things and beings around us in a new, environmentally enhanced way. It appeals to researchers and students working in many fields, predominantly in philosophy, as well as religious and environmental studies.

Abstract: This book takes a novel approach by highlighting comparative and long-term historical perspectives on experimental practice. The juxtaposition of accounts of natural, social, and medical experimentation is very enlightening, especially because the authors put the emphasis on the different kinds of objects of experimentation (physical matter, chemical reagents, social groups, organizations, sick individuals, archeological remains) and demonstrate how much the kinds of objects matter for the practice of experimentation, its methods, tools, and methodologies. Taken together, the chapters raise several fascinating questions for further study: What do these different approaches have in common? Why do we call them “experimentation”? What are the intersections among the fields and their developments? The volume engages philosophical approaches that are not well known to Anglophone readers (Bachelard, Bergson, Bernard, Canguilhem, among others) and brings to attention a wealth of Francophone secondary literature on past and present scientific experimentation. The collection fills a yawning gap in science, science studies, and philosophy of science teaching, making it particularly valuable philosophers and historians of science in all subfields.

Abstract: The book provides a discursive reflection on the current challenges facing administrative law, based on a key idea: the defence of the liberal model of society. The author describes the content of her book as a turning point on the traditional standards of the rule of law and the way it impacts on the administrative state and administrative law. Considering the current use (and abuse) of emergency law by governments – based on economic crisis, environmental crisis, pandemic, and the economic situation caused by the Ukraine war – she devises a different balance or equilibrium on the usual separation of powers. Many reasons contribute to this turning point: i) the weaknesses of an open society easily swayed by social networks; ii) social “tribalism” replaces common good and general interest; iii) social tribalism leads to illiberal society, which causes illiberal democracies; iv) illiberal democracies lead to ungovernability which reinforces the role of the government, the emergency law, and some de facto measures. The author looks at many recent decisions from the ECJ and the ECHR and some constitutional and administrative courts, which extends the interest of this work to a wide range of professionals, from scholars to students, from judges to lawyers, filling the gap from an administrative law perspective of the current issues.

Abstract: While previous volumes have examined specific issues and developments such as the coronavirus crisis or digital transformation from a law and economics perspective, the anniversary edition returns to the methodological and philosophical fundament of the discipline of law and economics. The present book aims to examine these foundations in general and, in particular, efficiency, reciprocity and meritocracy, and their relation to law and justice from an interdisciplinary perspective. Efficiency: Traditionally, the economic analysis of law has been guided by the goal of efficiency. Economists usually define efficiency as Pareto or Kaldor–Hicks efficiency. Any change that makes one member of society better off without anyone else being worse off is a Pareto improvement. A change is a Kaldor–Hicks improvement if the gainers value their gains more than the losers value their losses, with only hypothetical compensation required. Reciprocity: Economists have traditionally based their models on the self-interest hypothesis of homo oeconomicus. In this model, an individual maximises his own utility without being altruistic or jealous. Behavioural economics challenges the self-interest hypothesis. In fact, many people deviate from purely self-interested behaviour. There are also signs that considerations of fairness and mutual benefit are important in bilateral negotiations and in the functioning of markets. Meritocracy: The concept of meritocracy refers to a system, organisation, or society in which people are selected and promoted to positions of success, power, and influence on the basis of their abilities and merits. This means that an individual is able to climb the social ladder through hard work. Moreover, meritocracy directs the most talented people into the most functionally important positions, thereby increasing a society's efficiency. However, the equalising function of meritocracy has been criticised. Rather than reducing inequality, meritocracy is seen as the cause of racial, economic and social inequality.

Abstract: The book is divided into sections according to the content of the chapters. The first section covers AI concepts with NP and financial issues. The second section covers AI techniques in relation to Fintech issues. The remaining sections are implementation and analysis. As science and technology development and algorithms are widely used in various fields, their influence and development have increased efficiency and productivity. The introduction of algorithms in the financial field has not been an exception to this. In recent years, the growth and development of the financial system have been in sync with the growth of technology. Fintechs were born at the intersection of these two sectors. What happens through the application of computer knowledge in the financial field, or the examination of the efficiency and effectiveness of their use and the interaction and combination of these two fields has been written very infrequently in the majority of books. In Fintech, there are problems that researchers focus on such as customer support, portfolio management, trading algorithms, fraud detection, credit risk assessment, insurance, and wealth management. The mentioned problems are complex and are mapped to NP problems in the field of artificial intelligence. In the last two decades, optimization algorithms, neural networks, and deep learning have been widely applied in many scientific and engineering fields to solve the mentioned problems. The purpose of this book is to provide the reader with the most used artificial intelligence methods for scientific and engineering problems. This book is used by students, scientists, and practitioners in various fields. The chapters are self-explanatory, and the reader can read each one separately. They describe the algorithm used, the chosen problem, and the implementation. In addition, practical examples, comparisons, and experimental results are presented.

Abstract: The sometimes complex and controversial relation between the fundamental rights of the European Union, as enshrined in the EU Charter of Fundamental Rights (CFR), and national fundamental rights in the context of constitutional review is reflected in a series of landmark decisions in the multilateral cooperation of European courts, which have reshaped the fundamental rights architecture in the multilevel system in recent decades. This book aims to contribute to a systematic and comprehensive analysis of the EU and constitutional law issues involved, thus serving as a reference point for scholars and practitioners dealing with this emerging topic in depth. Following this approach, it sheds light on the broader Union legal context of these developments, examines the role of the CFR for Constitutional Courts, the relationship between constitutional and ordinary courts, and assesses the key decisions concerning the application of the CFR as a standard of constitutional review. It also draws some initial conclusions on the development of the European fundamental rights architecture, its prospects and possible implications for the Union’s legal order. The book contains several contributions by European legal experts from academia and the judiciary, who examine the different methods of constitutional application of the CFR from a comparative law perspective. These contributions deal with the following aspects: first, the role of the CFR for the respective Constitutional Court with regard to the application of EU law as well as national law falling within the scope of the CFR; second, the relationship between the respective Constitutional Court and the ordinary courts with regard to the application of the CFR; third, the relevant facts and legal reasoning of the most important Constitutional Court decisions on the application of the CFR as a relevant standard of constitutional review; fourth, the relevant case law of the CJEU on the relationship between Union and national fundamental rights, as well as its broader implications for the multilateral cooperation of European courts. The individual chapters examine, inter alia, the following decisions: Verfassungsgerichtshof (Austria), March 14, 2012, U 466/11 et al.; Corte Constituzionale (Italy), January 23, 2019, Sentenza 20/2019; Bundesverfassungsgericht (Germany), November 6, 2019, 1 BvR 276/17; Tribunal Constitucional (Portugal), June 3, 2022, Acórdão 268/2022; Tribunal Constitucional (Spain), June 29, 2022, Sentencia Decision 89/2022.

Abstract: Open access. This open-access book discusses vulnerability and the protection-inclusion dilemma of including those who suffer from serious poverty, severe stigma, and structural violence in research. Co-written with representatives from indigenous peoples in South Africa and sex workers in Nairobi, the authors come down firmly on the side of inclusion. In the spirit of leaving no one behind in research, the team experimented with data collection methods that prioritize research participant needs over researcher needs. This involved foregoing the collection of personal data and community researchers being involved in all stages of the research. In the process, the term ‘vulnerability’ was illuminated across significant language barriers as it was defined by indigenous peoples and sex workers themselves. The book describes a potential alternative to exclusion from research that moves away from traditional research methods. By ensuring that the research is led by vulnerable groups for vulnerable groups, it offers an approach that fosters trust and collaboration with benefits for the community researchers, the wider community as well as research academics. Those living in low-income settings, in dire situations that are summarized with the term ‘vulnerability’ know best what their problems are and which priorities they have. To exclude them from research for their own protection is a patronizing approach which insinuates that researchers and research ethics committees know best. The team from this book have shown that minimally risky and minimally burdensome research tailored towards the needs of highly marginalized and stigmatized communities can be scientifically valuable as well as inclusive and equitable. I congratulate them. Prof. Klaus Leisinger, President Global Values Alliance, Former personal advisor to Kofi Annan on corporate responsibility .

Abstract: In the automotive sector, digitalisation, connectivity and automation are rapidly expanding. In tomorrow’s vehicles, human beings will merely be passengers – which raises a host of complex legal issues regarding accidents involving self-driving vehicles. This book is the first to offer a comprehensive, global overview of civil liability regimes for all levels of vehicle automation in jurisdictions that represent some of the most important markets for the automotive industry. After a technical introduction to how self-driving cars work, the individual chapters analyse the liability for driving automation at SAE J3016 levels 0 through 5 from a country-specific perspective. All chapters were written by experts in the field and follow a uniform legal structure. Hence, the book offers an essential comparative analysis of similarities and differences in the jurisdictions examined, while also providing suggestions for future legislative changes at the national and international level. The book is not only relevant for legal scholars and practitioners but will also be of particular interest to anyone involved in the design, manufacture, distribution and operation of self-driving vehicles.

Abstract: The main target of this book is to present a new concept of Ulam-type stability, i.e., multi-stability, through the classical, well-known special functions and to obtain the best approximation error estimates by a different concept of perturbation stability including fuzzy approaches for uncertainty considerations. This stability allows us to obtain diverse approximations depending on various special functions that are initially chosen and to evaluate maximal stability and minimal error which enable us to obtain a unique optimal solution of functional equations, inequalities, and fractional equations. Stability analysis in the sense of the Ulam and its different kinds has received considerable attention from the researchers. However, how to effectively generalize the Ulam stability problems and to evaluate optimized controllability and stability are new issues. The multi-stability not only covers the previous concepts but also considers the optimization of the problem and provides a comprehensive discussion of optimizing the different types of the Ulam stabilities of mathematical models used in the natural sciences and engineering disciplines with fuzzy attitudes. Besides, this book also deals with nonlinear differential equations with various boundary conditions or initial value problems, based on the matrix Mittag-Leffler function, fixed point theory, as well as Babenko's approach to study uniqueness and existence of solutions. In general, the benefits for the readers can be concluded as follows: 1. Evaluates maximal stability with minimal error to get a unique optimal solution. 2. Discusses an optimal method of the alternative to study existence, uniqueness, and different types of Ulam stabilities under special consideration of the fuzzy approaches. 3. Delves into the new study of boundary value problems of fractional integro-differential equations with integral boundary conditions and variable coefficients.

Abstract: In Pascal's God and the Fragments of the World, Martin Nemoianu offers a new interpretation of the thought of Blaise Pascal, drawn from the Pensées and beyond. The book takes Pascal's central theme to be the distinction - Infini rien - between the transcendent God and the created world, which, without God, would be nothing. Nemoianu identifies the distinction in Pascal, articulates it, and works through the difficulties attending the distinction's disclosure. He then considers the implications of the distinction for the nature of nature and the nature of the human being, culminating in the ideal of martyrdom. The book closes with treatment of a closely related theme: the relation between human freedom and divine grace, in the context of the vexed question of Pascal's Jansenism. Martin Nemoianu is Associate Professor of Philosophy at Loyola Marymount University, USA.

Abstract: Introduction -- The Historical Development and Definition of a Secular State -- The Constitutional Development and Regulation of Turkish Secularism -- The TCC’s Approach to Secularism in Freedom of Religion Cases -- Protection of Secularism within the Framework of the Political Party Regime -- The Impact of the 2017 Constitutional Amendments on the Protection of Secularism -- The ECtHR and Turkish Secularism -- Conclusion.
Abstract: There are any number of studies on Turkish secularism. However, to date there has never been a comprehensive analysis of the constitutional protection of secularism, one that systematically covers all relevant aspects. Addressing that gap, this book presents a comprehensive and coherent analysis of the constitutional framework of this principle within the Turkish legal system. Secularism is a common fundamental principle of all three Turkish constitutions (1924, 1961, 1982). The principle has been granted an irrevocable status and has been strictly constructed within the Turkish constitutional system. Despite the guarantee of irrevocability, however, its interpretation and application have undergone a drastic transformation in response to changing social and political circumstances. Today, the complaints filed before the domestic and international judiciary predominantly concern the Turkish State’s neutrality and impartiality towards religion and the exercise of freedom of religion by religious minorities. While many observers have interpreted these problems in light of the contemporary policies pursued in the field of religion, a closer look reveals that the problem lies deeper in Turkey’s general constitutional framework. While the 1982 Constitution declares the principle as an unamendable characteristic of the Republic and protects it with multi-layered mechanisms, certain anti-democratic features of the Constitution, including the President’s predominant role in forming the high-ranking judiciary, affect the proper and consistent application of the principle of secularism. The consolidation of the secular state order depends on various factors other than a suitable constitution. However, it goes without saying that constitutions can help or hinder efforts to find solutions. Therefore, this book identifies the deficiencies in the Turkish constitutional and legal framework regarding the protection of secularism. It presents the historical development and definition of a secular state, analyzes the jurisprudence of the Turkish Constitutional Court and the European Court of Human Rights, studies the application of the party prohibition mechanism as a means of protecting the principle, and assesses the constitutional amendments of 2001, 2010 and 2017. Moreover, it proposes much-needed constitutional and legal amendments with a view to improving the application of the principle of secularism.

Abstract: As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines. The main question to be answered is whether the foundations and general principles of private law and criminal law offer a functional and adaptive legal framework for the “autonomous systems” phenomena. The main purpose of this book is to identify and explore possible trajectories for the development of civil and criminal liability; for our understanding of the attribution link to autonomous systems; and, in particular, for the punishment of unlawful conduct in connection with their operation. AI decision-making processes – including judicial sentencing – also warrant close attention in this regard. Since AI is moving faster than the process of regulatory recalibration, this book provides valuable insights on its redesign and on the harmonization, at the European level, of the current regulatory frameworks, in order to keep pace with technological changes. Providing a broader and more comprehensive picture of the legal challenges posed by autonomous systems, this book covers a wide range of topics, including the regulation of autonomous vehicles, data protection and governance, personality rights, intellectual property, corporate governance, and contract conclusion and termination issues arising from automated decisions, blockchain technology and AI applications, particularly in the banking and finance sectors. The authors are legal experts from around the world with extensive academic and/or practical experience in these areas.

Abstract: This peer-reviewed book presents a comprehensive overview of the role space is playing in enabling Latin America to fulfil its developmental aspirations. Following on from the highly acclaimed Parts 1 to 4, it explains how space and its applications can be used to support the development of the full range and diversity of Latin America societies, while being driven by Latin American goals. The Latin American space sector is currently undergoing a phase of rapid and dynamic expansion, with new actors entering the field and with space applications increasingly being used to support the continent’s social, economic, and political development. All across Latin America, attention is shifting to space as a fundamental part of the continental development agenda, and the creation of a Latin American space agency is evidence of this. Additionally, while in recent years, significant advances in economic and social development have lifted many of Latin America’s people out of poverty, there is still much that needs to be done to fulfil the basic needs of the population and to afford them the dignity they deserve. To this end, space is already being employed in diverse fields of human endeavour to serve Latin America’s goals for its future, but there is still a need for further incorporation of space systems and data. This book will appeal to researchers, professionals and students in fields such as space studies, international relations, governance, and social and rural development.

Abstract: This book critically analyzes both the negative and positive impacts of the Coronavirus pandemic, focusing on changes in families, gender developments, and the evolution of social inequality structures. The Corona pandemic, with its unprecedented restrictions on contact, has meant that families have been challenged in their functioning in a very special way. International studies show that socioeconomic factors such as education, income, but also the geographic center of life of families and women in particular, had an important influence on the management of the pandemic. Despite all negative side effects of the Corona pandemic, there were nevertheless also innovative impulses, especially in the field of social work, particularly work with families. The book's 18 chapters, organized in six sections, highlight not only short-term changes but also longer-term developments that either require a corresponding concept of measures or action or can be evaluated as drivers of innovation in the pandemic. Part I: Introduction Part II: Family Dynamics Part III: Child Well-being Part IV: Social Work with Children and Families Part V: Gender and COVID-19 Part VI: Conclusion The special feature of the volume is its global perspective. Authors from different countries describe changes and developments on these topics and make clear what profound effects the pandemic had on families, social inequality structures, and gender-specific situations. The anthology does not comprehensively reflect international perspectives. Rather, it leaves it up to readers to compare the developments in the respective countries with their own country of origin from a comparative cultural perspective. In this way, ideas for future, overarching research projects may be stimulated. Family Dynamics, Gender and Social Inequality During COVID-19 is timely and relevant reading for scientists, students, and practitioners in sociology, social work, and political science.

Abstract: Contemporary policymakers, as their predecessors, continue to view nomadic people as a weak minority, and their way of life and raising livestock as a backward and inefficient paradigm. Wherever nomads are not the dominant group, the trend to settle them continues even today as in the past. This book describes the changes forced upon formerly nomadic groups and how they still attempt to maintain their traditional, social, and cultural practices in their new settings. The book deals with the several modes of livelihood of these communities, including entrepreneurship, and demonstrates the impact of investment-oriented urbanization policies leading to eviction from ancestral lands, and hurdles for nomadic mobility, ultimately threatening their survival. The book illustrates how some groups like the Borana and the Maasai practice livelihood diversity and raise productive livestock, and how other groups migrate to urban centers in search of employment and remit money to family members left in the rural areas. The book aims to raise awareness among the research community, especially those who work on regional and demographic labor policies. It helps in understanding why society needs to help build business and livelihood strategies without harming the values of nomadic groups.

Abstract: This book introduces interior design as a conceptual way of thinking, which is about ideas and how they are formulated. Now in its second edition, the book is enlarged to include topical subjects such as artificial intelligence, sustainability and climate change. The book prepares designers to focus on each concept independently as much as possible, whilst acknowledging relative connections without unwarranted influences unfairly dictating a conceptual bias, and is about that part of the design process called conceptual analysis. The major themes of this second edition of Interior Design: Conceptual Basis are the seven concepts of planning, circulation, 3D, construction, materials, colour and lighting, which cover the entire spectrum of a designer’s activity. It is assumed that the site, location, building and orientation as well as the client’s brief of activities and needs have been digested and analysed to provide the data upon which the design process can begin. Designed as a highly visual illustrative book, as the interior design medium demands, the hands-on creative process of designing is detailed with original drawn illustrations. Concentrating on the conceptual process of designing interiors, and defining what these concepts are, this book helps the designer to organise his/her process of designing and to sharpen the links between the various skill bases necessary to do the job. This book is stimulating for students and instructors alike and is aimed at any student who maybe majoring in interior design, interior architecture, architecture, design thinking or furniture design. It is also useful reference for students of design management and design leadership. .

Abstract: This edited volume examines the practices and applications of digital diplomacy in the OSCE Region. As a security organization, the Organization for Security and Cooperation in Europe (OSCE) prioritizes its member states’ cyber security and cyberspace activities. The book examines two key areas where digital diplomacy challenges traditional diplomatic practices of the OSCE member States: institutional adaptation and policy innovation in the OSCE Region. It (1) investigates how capable and motivated foreign ministries are at the institutional level to shift to digital diplomacy, and (2) explores how digital diplomacy affects the fundamental diplomatic tasks of representation, communication, and relationship management at the policy level. Technological advances in IT and the Internet's widespread introduction in the wake of the 2000s provided new territories to conquer for states to pursue their interests. Moreover, technological developments and media attention enhanced information flow and communication through new platforms like online encyclopedias (i.e., Wikipedia), video-sharing sites (i.e., YouTube), and social media platforms (i.e., Facebook, Instagram, Twitter). Because of these transformations, public opinion became influential in diplomacy, and a greater need to include foreign publics as part of foreign policy goals emerged. Introducing case studies from several OSCE countries, presented by an international group of authors, this book provides a timely response to current affairs and policy debates by providing pluralistic perspectives from different countries and disciplines, such as international relations, political science, international law, and political economy). It will appeal to students, researchers, and scholars of the aforementioned disciplines, as well as policy-makers and practitioners interested in a better understanding of digital democracy and digital diplomacy in the OSCE region.

Abstract: This book examines several epistemological regimes in studies of numerical data over the last four centuries. It distinguishes these regimes and mobilises questions present in the philosophy of science, sociology and historical works throughout the 20th century. Attention is given to the skills of scholars and their methods, their assumptions, and the socio-historical conditions that made calculations and their interpretations possible. In doing so, questions posed as early as Émile Durkheim’s and Ernst Cassirer’s ones are revisited and the concept of symbolic form is put to the test in this particular survey, conducted over long period of time. Although distinct from a methodological and epistemological point of view, today these regimes may be found together in the toolbox of statisticians and those who comment on their conclusions. As such, the book is addressed to social scientists and historians and all those who are interested in numerical productions. This book is a translation of an original French edition. The translation was done with the help of artificial intelligence (machine translation by the service DeepL.com). A subsequent human revision was done primarily in terms of content, so that the book will read stylistically differently from a conventional translation.

Abstract: This book offers a contemporary, cutting-edge, and advanced critical analysis of the first twenty months of the war between Russia and Ukraine. Following a realist approach and with a focus on political discord, economic sanctions, and media limitations, the book sheds light onto the deadlock between the conflicting parties. It dissects the diplomatic endeavors and missteps, varying political perspectives, Western support strategies, and the intricate global dynamics that triggered this existential crisis. The critical assessment of political antecedents, including the Budapest Memorandum, the Bucharest Summit Declaration, and the Minsk Agreements 1 and 2, uncovers hidden political motives aimed at setting the stage for a proxy war. Additionally, the book scrutinizes the financial dimensions of the conflict, strategies for post-conflict reconstruction, and the emerging Zeitenwende phenomenon reshaping the geopolitical landscape of the Global North. This book's insights suggest a potential shift towards a new multipolar global order, representing a significant realignment in the distribution of geopolitical and geo-economic influence. A must-read for scholars and academics seeking a profound understanding of this pivotal conflict and its far-reaching implications.

Abstract: This reference work collates academic discourses and practices around family, gender, and violence in social work. A huge body of discourse is available that categorizes and labels acts of violence, and correspondingly practices that pin blame/responsibility for the violence. These have led to evolution of intervention strategies to resolve or address the violence. Some explanations foreground systemic causes; others look at person-centric causes. The two views bring forth the fundamental ontological divide of structuralism and individualism. The question for social workers to debate is what to factor in while working with families experiencing violence and conflict. What amongst the person, the agency, or the structure needs to be addressed to understand the experience of families in conflict and violence? Are these positions supplementary, complementary, or to be understood reflexively? With the inclusion of new families, the parochial understanding of families has long been dislodged and given way to newer, radical, and contextual understanding of families. Similarly, different people, agencies, and states understand violence and conflict differently. Gender, too, has moved from the binaries of male and female to the LGBTQ orientations. The book positions the ontological premise on which the epistemological practise is located. Simply put, the person-centric ontology on families and violence epistemologically finds understanding in agency-based approaches in individual agency, whereas the structure-based approaches find the experience of families and violence in society, state, and the world order. The contributors locate their work around identification, definition, an intervention or empirical study, policy analysis, historical evolution of concepts, and ontological and paradigmatic debates to position their individual chapters. Families and Gendered Violence andConflict: Pan-Continent Reach provides a paradigmatic prism for practice for social workers who are equipped to interpret context differently. The differing and competing paradigmatic lenses cannot be mediated, resolved, or addressed, but they definitely can be understood and debated to provide a 360-degree lens on the issues of families in violence in the gendered context. The reference work is a useful resource for social work practitioners, educators, academicians, researchers, and other development professionals.

Abstract: This open access book raises some central questions: Do we need moonshot policies to spur innovation and economic growth? What are the risks associated with such policies? Economic turbulence, the COVID-19 pandemic, and mounting environmental concerns have paved the way for a renaissance of targeted industrial policy. In particular, the idea that society should be organized around large missions is gaining momentum among high-income economies. However, the authors and editors of this volume contend that this shift has occurred without much critical examination, especially as the European Union has adopted these ideas, and Western economies are now increasingly organizing toward the achievement of large, state-formulated goals. Recognizing the urgent need for continued scholarly attention to question notions of the mission economy, more than 20 scholars discuss the dangers of top-down/vertical approaches to industrial policy and draw attention to the progress of independent enterprise, entrepreneurialism, and market solutions in a sound economy and society. By critically examining mission-oriented innovation policies, using theoretical perspectives and empirical investigations, the book highlights both the mechanisms behind failed missions and alternative approaches. This is a must-read for policy researchers and policymakers alike.

Abstract: 1. Science, society and Darwin’s idealization -- 2. Darwin’s society and science -- 3. Racism and its societal repercussions -- 4. Misogyny and its damaging legacy -- 5. Bringing reality to society and science.
Abstract: In this book Diogo, a renowned biologist and anthropologist, addresses a question that is critical for the understanding of science, beliefs, idolization, systemic racism and sexism, and our societies in general: why has Darwin been idolized in such a unique way, particularly by Western scholars? Diogo shows that many evolutionary 'facts' stated in Darwin's works, particularly about human evolution, are inaccurate constructions based on Victorian biases and stereotypes: non-Europeans are inferior, women have a lower intelligence than men, Victorian society was the pinnacle of evolution, and so on. Importantly, such inaccurate biased statements about our evolution are markedly in contrast with the mostly accurate, and often brilliant, ideas put forward by Darwin concerning non-human organisms. Importantly, it was precisely the combination of such brilliant ideas, the use of simplistic and sometimes exaggerated metaphors that were catchy and easily absorbed by the general public, and Darwin's intellectual conservatism and biased ideas about women and non-European peoples that led to Darwin's idolization, particularly by Western scientists, as well as to the darkest societal repercussions of his works. By portraying such biased ideas as “evolutionary facts”, Darwin provided easy ammunition for populist political leaders, authoritarians, colonialists, and white supremacists to 'scientifically' defend social hierarchies, sexism, racism, discrimination, oppression, and segregation. A typical argument used to defend Darwin from portraying such erroneous sexist and racist ideas as “facts” is that ‘back then’ everybody was racist and sexist. Diogo deconstructs this argument by providing enthralling case studies and travel descriptions by authors such as Wallace and Humboldt, who often praised the indigenous peoples that repulsed - and criticized the social hierarchies and Western imperialism that marveled - Darwin. The aim of this book is therefore not to 'cancel' Darwin or argue that he was always wrong: not at all, in general he was an extraordinary biologist, but was a much less successful anthropologist due in great part to his Victorian biases. Instead, the book discusses Darwin's writings, ideas, and their repercussions in a broader way, without taboos, omissions, idolization or demonization in order to show Darwin, and science in general, in all their complexity. This is because, if we fail to acknowledge and emphasize the biases, prejudices, inaccuracies, and abuses of our past, and merely continue to blindly idealize it, our kids will be condemned to undertake or suffer similar societal abuses in the future.

Abstract: This open access book presents an important discussion on the interface between sustainable soil management and climate mitigation and adaptation. It investigates a variety of aspects in this context, such as the political and societal consequences for countries in the Global South, an assessment of the outcomes of the UNFCCC Conference of Parties held in Glasgow, appropriate legal instruments to promote desealing, regulatory concepts for negative emissions in soil and land use, the debate in Europe on carbon uptake in soils and the climate-related policy of the Convention on Biological Diversity. Lastly, it provides information on recent court rulings on climate mitigation in Germany and Australia and their relevance for sustainable soil management. This sixth volume of the International Yearbook of Soil Law and Policy is divided into four parts, the first of which deals with various aspects of the theme “Climate Mitigation and Adaptation and Sustainable Soil Management.” The second part covers recent international developments, the third presents regional and national reports, and the fourth discusses overarching issues. Given the range of key topics covered, the book offers an indispensable tool for all academics, legislators and policymakers working in this field. The “International Yearbook of Soil Law and Policy” series discusses central questions in law and politics with regard to the protection and sustainable management of soil and land – at the international, national, and regional level.

Abstract: This open access book provides an overview of urban digital platforms such as Airbnb and Deliveroo, which, along with Amazon, Google, Facebook and other IT companies, constitute by now the infrastructures for other businesses to operate on and for our social life to go on. These platforms serve as standards-based techno-economic systems that simultaneously capture cooperation through remote coordination and organize labor via algorithm management. Based on a three-years research project, this contributed volume outlines a general theory of platform capitalism that conceives these platforms not only as technical devices, but as generative engines that operate at the interface of several aspects, such as digitalization of forms of social cooperation; algorithm-based management of labor and participation; and private and vertical appropriation of profits. These elements are somehow iconic of the capitalist evolution of the last decades, and they open up a reflection on new forms of “primitive accumulation” (in particular regarding data), on the mechanisms used to capture and extract social surplus value, and on the logistic-financial dimensions of capital. Finally, in light of the transformations associated with the COVID-19 pandemic, the authors examine how platforms can evolve into hegemonic organizational structures. Assuming we are all already living in the age of the platform, this book takes a multifaceted approach—combining sociology with urban studies, and political sciences with economics—to grasp the challenges our societies face in terms of ensuring fair economic growth, adequate social protections, and labor rights. It will appeal to anyone interested in digital platforms and how they are changing the organization of labor, urban spaces, and forms of governance.

Abstract: This book critically examines existing organizational learning theories that often center on employees and adopt a neo-classical organizational view. In this book, organizational learning (OL) is conceptualized from a relational governance perspective. Departing from the relational economics approach, it describes organizations as dynamic nexuses of stakeholders' resources and interests, extending beyond conventional intra-organizational contexts to encompass an open systems view. By viewing organizations as independent entities, distinct from individual stakeholders, the author introduces the concept of transactions as the fundamental unit of analysis in organization theory. Stakeholders contribute diverse rationalities, and OL emerges as the process of relationalizing these rationalities, enabling multi-contextual transactions within organizations. This book sheds light on epistemological and ontological challenges in OL literature, such as the OL paradox and anthropomorphism. To address these issues, the author advocates a shift from methodological individualism to methodological relationism, wherein OL becomes a micro-meso-relational process involving both stakeholders and the organization as an entity. Combining conceptual insights with empirical evidence from a multinational company's case study, the book showcases how relational learning can be practically applied in organizations. The findings corroborate the conceptual framework, supporting the notion of organizations as resource-rich nexuses and learning as a comprehensive relational process involving both entities and stakeholders. This book offers an essential contribution to the field. It appeals to scholars and practitioners interested in organizational studies, corporate governance, and relational economics.

Abstract: This book highlights the changing dynamics of Muslim identity and integration in Britain, focusing on the post-9/11 era. Historically, Muslims faced discrimination based on ethnicity rather than religion. However, contemporary discrimination against Muslims is rooted in different reasons, with events like the Rushdie affair significantly impacting multicultural relations. This study analyzes the evolving multicultural landscape in Britain, exploring the shift from predominantly assimilationist policies to a more mutual process of integration. It delves into the emergence of interfaith dialogue as well as the complexities surrounding the intersection of race, religion, gender, and identity. The research examines two key themes: the discursive positioning of Islam beyond integration and terrorism narratives, and the operationalization of identity by Muslims in various contexts. The study employs empirical methods and cultural studies theories to understand how individual and social practices intersect in this context. By doing so, it contributes to Islamic studies, socio-political studies, and cultural studies, shedding light on the discourses that shape and are shaped by Muslim lives in Britain. The analysis encompasses diverse perspectives, from macro-level societal discourses to micro-level individual actions, thus providing a comprehensive exploration of the multifaceted experiences of Muslims in Britain.

Abstract: This edited volume addresses the environmental and cultural underpinnings of the kind of social conflict that spawned the origins and elaboration of ritualized human and animal sacrifice in Mesoamerica. The chapters variously document the place of cultural evolution and social complexity in the origins and elaboration of ritual human sacrifice, cannibalism, and trophy-taking across a broad spectrum of Mesoamerican cultural and social contexts that first saw the light of day before 2600 BCE, and rapidly developed and proliferated across the Mesoamerican world in the centuries to follow. They study the developments in sacrifice rituals through the centuries into the first millennium CE, when the Mexica Aztec and their allies had elevated ritual human sacrifice such that they produced a plethora of sacrificial acts, modes and manners of death, and associated deities to articulate the necro-cultures and blood-tribute of the times. The chapters further study present-day rites of Amerindian communities from throughout Mesoamerica that include paying homage to the deities of earth and sky through sacrifice and consumption of animal surrogates. The interdisciplinary effort undertaken by this international cadre of scientists, including anthropologists, bioarchaeologists, art historians, ethnohistorians, iconographers, and religious studies experts provides a particularly rich forum for launching an interrogation into the role of conflict, environment, and social complexity in the emergence and persistence of ritual violence and human sacrifice in the Mesoamerican world.

Abstract: This open access book provides insight on how the tactical urbanism has the capacity to influence change in mobility practices such as cycling. COVID-19 crisis prompted the public authorities to rethink the use of public space in order to develop means of transport that are both efficient and adapted to the health context and their effects on cycling practices in Europe, North, and South America. Its contributors collectively reveal and evidence through policies analysis, mapping, and innovative qualitative analysis bridging video and interviews, how those new infrastructures and policies can be a trigger for change in a context of mobility transition. This book provides an important element on the way local authorities can act in a quicker and more agile way. While some decisions are specific to the context of the beginning of the pandemic, the analysis offers lessons on the way to implement the transition toward a low-carbon mobility, on the importance of processes based on trials and errors, on the political stakes of reallocating road space.
