    Abstract: Ce rapport aborde une question qui se pose dans pratiquement tous les secteurs de services aux collectivités, à savoir la réglementation de l’accès à des installations essentielles. Les régulateurs des industries d’équipements collectifs publics se heurtent à un problème crucial : la réglementation des termes et conditions dans lesquels des entreprises en concurrence ont accès à des intrants clés fournis par des concurrents. Le développement de la concurrence et le succès de la libéralisation dépendent souvent des termes de l’accès et des conditions choisies, aussi les pouvoirs publics sont-ils soucieux de faire le bon choix. Préparé par le comité de la concurrence de l’OCDE, ce rapport traite du secteur des télécommunications et cherche à approfondir la compréhension de la réglementation de l’accès. Les problèmes d’accès ne sont pas des plus faciles pour les autorités de tutelle et les responsables de la politique de la concurrence : ils peuvent en effet être techniquement délicats et donner lieu à des polémiques retentissantes sur le plan pratique. En abordant la question sous ces deux angles, ce rapport cherche à aider les autorités de tutelle et les pouvoirs publics à tirer les leçons de l’expérience de l’OCDE pour obtenir des résultats efficients et compétitifs.

    Abstract: Hydrogen has the potential to play an important role as a sustainable and environmentally acceptable source of energy in the 21st century. Present methods for producing hydrogen are mainly based on the reforming of fossil fuels with subsequent release of greenhouse gases. To avoid producing greenhouse gases, the possibility to use heat and surplus electricity from nuclear power plants to produce hydrogen by water cracking is being investigated. This report presents the state of the art in the nuclear production of hydrogen and describes the scientific and technical challenges associated with it.

Parmi les pays considérés, les États baltes arrivent en tête du point de vue de la libéralisation des services de télécommunications et des services bancaires, ce qui les place dans une situation comparable à celle de la plupart des pays développés. Par comparaison, les pays d’Europe du Sud-Est disposent d’une marge plus importante d’amélioration des performances et des prix dans les télécommunications, qu’il s’agisse des services à réseau fixe ou cellulaire, puisqu’ils peuvent encore abolir les restrictions générales à la concurrence et ne plus limiter les prises de participation étrangères. En ce qui concerne les services bancaires, les résultats indiquent que les marchés des pays d’Europe du Sud-Est sont relativement contestables ; leurs décideurs seraient donc fondés à s’intéresser en priorité à la stabilité macroéconomique et à la réforme structurelle.     Abstract: Metropolitan areas in many OECD countries are fragmented into various territorial units, which do not correspond to the larger geography of economic and social problems. While the ensuing mismatch is not a new phenomenon, increasingly, fragmentation appears as one of the root causes of metropolitan dysfunctions, such as internal fiscal disparities, urban sprawl, and spatial polarisation, which in turn constitute an obstacle for competitiveness. This review examines the case of the metropolitan region of Montreal which has undergone one of the most radical institutional reforms in OECD countries. On the one hand, the amalgamations of municipalities led to the creation of the two new cities of Montreal and Longueuil. On the other hand, a new metropolitan body was set up to cover the whole functional and economic area — the Montreal Metropolitan Community (CMM). These institutional reforms provide a valuable opportunity to meet the challenges of Montreal's competitiveness. The new governance framework needs however to be consolidated, especially with regards to clarification of competencies and fiscal responsibilities and resources. Streamlining institutional structures and fiscal resources will not be enough. Implementing and not simply elaborating a comprehensive economic strategy for the whole metropolitan region will be the main challenge for Montreal in the following years.

The study provides general support for the proposition that the strengthening of intellectual property rights - as measured by selected indicators - has had a net positive effect on technology transfer via licensing during the 1990s. The general implication of this study for developing economies is that IPR reform should be one part of a general strategy for promoting economic development in combination with other complementary policy reforms. In particular, patent rights and effective enforcement can be instrumental in enabling firms in developing nations to access and exploit technologies and know-how through licensing agreements with parties in developed nations. Overall, the analysis presented here indicates that where developing countries have moved to address weaknesses in these areas in recent years, they have tended to experience enhanced access to technology through licensing.

L’étude a révélé que le recours aux contingents et aux prohibitions est moins souvent motivé par des raisons économiques, mais que la plupart des pays intègrent des interdictions à leurs cadres réglementaires afin de protéger la santé et la sécurité humaine ou l’environnement, tendance qui semble s’accentuer. Les négociants tireraient avantage de mesures plus transparentes à cet égard. Par ailleurs, il existe des interdictions d’importation qui entravent le commerce international des biens usagés et dont les particularités et la pertinence en termes d’efficacité réglementaire mériteraient d’être examinée de plus près.

Buena parte del interés de política por fomentar la iniciativa empresarial se refleja en la convicción de que la creación de nuevas empresas contribuirá a facilitar el logro de importantes objetivos económicos y sociales. El aumento en el ritmo de creación de empresas es hoy una inquietud casi universal para las autoridades locales, al igual que para los gobiernos centrales que desean combatir la marginación económica local. Sin embargo, a pesar del amplio interés de política, pocos estudios han analizado sistemáticamente la relación entre la creación de nuevas empresas y el desarrollo económico local. Esta publicación analiza las principales rutas a través de las cuales la creación de empresas y su desarrollo puede tener un impacto sobre las economías locales. Así, se analiza la evidencia empírica acerca de la relación entre la iniciativa empresarial y las economías locales. Asimismo, se demuestra que aunque la creación de empresas puede resultar un componente crucial para el desarrollo económico local, el fomento de la iniciativa empresarial no constituye una panacea para el desarrollo. Por ello, se discuten a profundidad una serie de limitaciones potenciales de las estrategias orientadas hacia la iniciativa empresarial y cómo estas limitaciones pueden contrarrestarse. Este libro presenta detalladas recomendaciones de política tanto en el ámbito gubernamental local como nacional. Las recomendaciones se relacionan con tres ámbitos temáticos: estrategia, financiamiento y diseño de programas. Se espera que estos lineamientos sean de utilidad para los gobiernos centrales y locales en el diseño y la puesta en marcha de programas y estrategias eficaces en términos de costos. Les règles de l'Arrangement portent notamment sur le soutien financier public, le délai maximum de remboursement, la prime minimum de risque et l'aide relative aux échanges pour les projets, les biens et les services bénéficiant de crédits à l'exportation d'une durée minimum de deux ans. Le texte de l'accord complémentaire qui prévoit des conditions souples pour les opérations de financement de projets figure également dans cet ouvrage. En outre, cette publication présente pour la première fois des informations sur les études importantes entreprises par le Groupe de travail de l'OCDE sur les crédits et garanties de crédit à l'exportation. Ces études concernent notamment les liens entre les crédits à l'exportation bénéficiant d'un soutien public et les préoccupations plus larges des gouvernements et de la société civile des pays membres, qu’il s’agisse de problèmes environnementaux, d’efforts pour combattre la corruption ou de la viabilité de la dette des pays pauvres très endettés. Tout d'abord, comme l'illustre la première partie de l'étude, il apparaît clairement que le secteur des services présente pour les pays en développement un très grand intérêt du point de vue des exportations par-delà le mode 4 (mouvements temporaires de personnes physiques fournissant des services), dans la mesure où ces pays sont des acteurs mondiaux ou régionaux dans des secteurs comme les services aux entreprises (externalisation), les services portuaires et services de transport maritime, les services audiovisuels, les services de télécommunications, les services de construction et les services de santé. Deuxièmement, comme on le voit dans la seconde partie de l'étude, pour la plupart des pays dont beaucoup de pays en développement, les gains liés aux exportations résultant de la libéralisation du marché ne sont ni la seule ni la plus importante source de gains attendus. Les avantages de la libéralisation des services découlent, pour une bonne part, non de la recherche d'un meilleur accès aux marchés à l'étranger mais de l'accroissement de la compétitivité et de l'efficience du marché intérieur. Ensemble, les deux observations de cette étude mettent en évidence les avantages potentiels de la libéralisation du marché des services tant pour les pays développés que pour les pays en développement.

    Abstract: This study examines the interconnections between domestic regulatory reform and market openness by drawing on OECD’s earlier work on the regulatory aspects of trade. Part 1 considers how domestic regulations and regulatory reform affect market openness. It shows how with the help of advanced regulatory reform tools and approaches governments can create regulations and regulatory procedures that efficiently meet their policy objectives while at the same time supporting market access. Part 2 demonstrates that international market opening can contribute to facilitating domestic regulatory reform. Trade agreements signed on the multilateral, regional and bilateral levels can promote general principles or specific elements of good regulation and help guide or drive countries' individual regulatory reform efforts. Finally, part 3 analyzes the mutual benefits of regulatory reform and an open multilateral system for trade and investment. It is argued that by increasing domestic economic efficiency, raising the international competitiveness of domestic enterprises and reducing barriers to trade and investment, traderelated regulatory reform enables countries to take better advantage of trade liberalization and of open global markets.

    Abstract: This study, that investigates two specific types of quantitative restrictions, namely import prohibitions and quotas, is part of a broad reflection aimed at learning more about the nature and scope of non-tariff measures. The analysis reviews information on these measures contained in the WTO Trade Policy Reviews, WTO notifications and in various other trade reports. The objective of the report is to contribute to discussions, particularly on market access for non-agricultural goods, at the WTO, or elsewhere. The research revealed that the use of quotas and prohibitions for economic reasons has declined, but most countries use prohibitions as part of their regulatory frameworks for protecting human safety and health or the environment, and this tendency appears to be increasing. Traders would benefit from greater transparency of these measures. Also, there are import bans hampering the international trade in used goods, whose circumstances and appropriateness in terms of regulatory efficiency merit scrutiny.

    Abstract: This paper applies the most advanced methodologies for measuring services barriers to calculate the restrictiveness and the impact of services barriers in selected transition economies, i.e. the Baltic States, and eight South Eastern European (SEE) countries (for telecommunications and banking) and Russia (for telecommunications). Among the selected countries, the Baltic countries record the highest liberalisation scores for both telecommunications and banking services making their situation comparable to that of most developed countries. By contrast, the SEE countries have more room to improve their performance and the price level of their telecommunication services, both in fixed and cellular services by eliminating general restrictions on competition and removing barriers to foreign equity participation. With respect to banking services, the results suggest that the SEE markets are fairly contestable; policy priorities would thus appear to be broad issues of macroeconomic stability and structural reform.     Abstract: This study forms part of on-going OECD work on trade in services, in co-operation with UNCTAD, aimed at assisting WTO Members in managing request-offer negotiations under the GATS. The key objective is to help officials of WTO Members in both gaining a greater insight into the particular issues of importance in the legal services sector and how they might be approached in the negotiations. While only modest liberalisation of legal services trade was achieved during the Uruguay Round, the current negotiations offer the opportunity to achieve greater levels of liberalisation, which may lead to significant economic benefits to all countries. In addition, the peculiar characteristic of legal services is that the potential downsides stemming from liberalisation — both in terms of market failures to achieve social objectives and of the displacement of local suppliers — are likely to be less significant in these services.

Together with a series of UNCTAD case studies and the experiences exchanged at an OECD Global Forum on Trade workshop, held in New Delhi in November 2002, the focus is on the approaches that contributed to addressing the market access difficulties. These are divided into two sections: first, those addressing information flows and capacity building needs of developing-country exporters, undertaken both by governments and non-governmental organisations; and then the procedures in developing, implementing and reviewing regulations and standards. While covering a range of natural resource-based exports and manufactures and one traded service in key OECD import markets, no generalisation can be drawn regarding the scale of the market-access problems created by environmental and health requirements.

    Abstract: Dans de nombreux pays de l'OCDE, les zones métropolitaines sont morcelées en diverses unités territoriales qui ne correspondent pas à la zone géographique plus large où se posent les problèmes économiques et sociaux. Si le déséquilibre qui en découle n'est pas un phénomène nouveau, le morcellement apparaît de plus en plus comme une des causes majeures des dysfonctionnements des grandes villes comme les disparités fiscales internes, l’étalement urbain et la polarisation spatiale qui constituent à leur tour un obstacle à la compétitivité. Ce rapport examine le cas de la région métropolitaine de Montréal qui a connu l'une des plus audacieuses réformes institutionnelles parmi les pays de l'OCDE. D'un côté, on a procédé à des fusions de municipalités pour créer deux nouvelles villes : Montréal et Longueuil. De l'autre, la grande région économique fonctionnelle s'est dotée d'une nouvelle structure, la Communauté métropolitaine de Montréal, représentant 63 municipalités. Ces réformes institutionnelles constituent une occasion appréciable de relever le défi de la compétitivité de Montréal. Certains aspects du nouveau cadre de gouvernance métropolitaine demandent cependant à être consolidés, en particulier en ce qui concerne la clarification des compétences, des responsabilités et des ressources fiscales. La rationalisation des structures institutionnelles et des ressources fiscales ne sera toutefois pas suffisante. La mise en œuvre, et pas seulement l’élaboration, d’une stratégie économique globale pour toute la région métropolitaine constituera pour Montréal le principal défi à relever dans les années à venir. L’Examen Territorial de Montréal s’inscrit dans un programme plus vaste d’examens territoriaux nationaux et thématiques, menés par le Comité des Politiques de Développement Territorial de l’OCDE. L’objectif général des examens territoriaux est de fournir des recommandations pratiques aux gouvernements dans trois domaines: la gouvernance à plusieurs niveaux, le développement durable aux échelons régional et local, et les réseaux régionaux au service de la compétitivité.

    Abstract: This study has two components: identification of concrete examples of services exports by developing countries, and quantitative studies on the gains from services liberalisation. While the study is by no means comprehensive, and is subject to many limitations, two fundamental findings emerge. The first of these findings, documented in Part I of the study, is that there is clear evidence that developing countries have important service sector export interests beyond mode 4 (temporary movement of services supplying personnel), being global or regional players in sectors such as business services (out-sourcing), port and shipping services, audiovisual services, telecommunications, construction services and health services. The second of these findings, documented in Part II of the study, is that for most countries, including many developing countries, export-related gains from services liberalisation are neither the only nor the largest basis of expected gains. A large portion of benefits from services liberalisation derive, not from seeking better market access abroad, but from the increased competitiveness and efficiency of the domestic market. Together, the study’s two findings underscore the potential benefits of services liberalisation, both for developed and for developing countries.
