    Abstract: This book, the expanded and completely revised text of the author's renowned 1993 dissertation, studies the logical aspects of legal reasoning, in order to provide philosophical foundations for legal applications of Artificial Intelligence. It respects that legal reasoning often takes place in a disputational setting, and observes that the law leaves ample room for disagreement, which means that lawyers reason under the possibility of exceptions and with contradictory legal sources, and cannot do without non-deductive reasoning forms, such as analogical reasoning. The study shows that, contrary to what is often said, these features do not escape a logical analysis if recent developments in logic and Artificial Intelligence on so-called non-monotonic reasoning and defeasible argumentation are used, and if logic is regarded as a tool in, rather than as, a model of legal argument. This book is relevant for scholars in legal philosophy, artificial intelligence, logic and argumentation theory, and can also serve as a textbook for graduate courses in AI & Law, non-monotonic reasoning and legal argumentation

    Abstract: Intended for scholars in the fields of philosophy, history of science and music, this book examines the legacy of the historical coincidence of the emergence of science and opera in the early modern period. But instead of regarding them as finished products or examining their genesis, or `common ground', or `parallel' ideas, opera and science are explored by a phenomenology of the formulations of consciousness (Gurwitsch) as compossible tasks to be accomplished in common (Schutz) which share an ideal possibility or `essence' (Husserl). Although the ideas of Galileo and Monteverdi form the parameters of the domain of phenomenological clarification, the scope of discussion extends from Classical ideas of science and music down to the beginning of the nineteenth century, but always with reference to the experience of sharing the sociality of a common world from which they are drawn (Plessner) and to which those ideas have given shape, meaning and even substance. At the same time, this approach provides a non-historicist alternative to understanding the arts and science of the modern period by critically clarifying the idea of whether their compossibility can rest on any other formulation of consciousness

    Abstract: What is meant by `body' in Husserl's phenomenology? `Body' is a thing that is `alive' or `animated' (beseelt). In Husserl, this concept covers a wide range of phenomena. It is the condition for the possibility of the event of the arrival of someone and my being in the position to meaningfully announce this presence. It is as `ensouled' that the `I' speaks and is spoken to. To be `without soul' means to be separated from the world and from other, incarnate beings. But why rely on the concept of `soul' to understand such phenomena? Is this not a reprise of a metaphysics of the soul, one that posits the `mental' as a unique substance, an invisible mover of things? This essay argues that the problem of the body is of central importance for Husserl's transcendental idealism. It is the key to the sense of human being as, despite its `worldliness', something transcendent with respect to the world, thus something `spiritual'

    Abstract: The purpose of the book is twofold: to give a theory of reference for the indexical `I' and to explain what is involved in thinking about oneself. The first part constitutes a critique of different solutions to the problem of how `I' refers, while the second part advances a positive account of `I' and I-thoughts. It is argued that `I' refers indirectly through a de re sense that is based on non-conceptual content. `I' expresses an individual concept with two components: a de re sense and a context-independent self-concept. Other issues that are discussed concern self-knowledge, e.g. whether there is something in specific that we have to know about ourselves to be able to self-refer, and the kind of self-consciousness that is required for self-reference. Furthermore, the notions of unity of consciousness and personal identity, as they both are presupposed by a competent use of `I', are examined. Such a treatment overlooks the fact that legal principles and rules are not statements which describe the world, but rather means by which humans impose structure on the world.     Abstract: One of the central areas of concern in late twentieth-century philosophy is the debate between Realism and anti-Realism. But the precise nature of the issues that form the focus of the debate remains controversial. In Realism and Explanatory Priority a new way of viewing the debate is developed. The primary focus is not on the notions of existence, truth or reference, but rather on independence. A notion of independence is developed using concepts derived from the theory of explanation. It is argued that this approach enables us to clarify the exact nature of the empirical evidence that would be required to establish Realism in any area. The author defends a restricted form of Realism, which he calls Nomic Structuralism. The book will be suitable for professional philosophers of language, science and metaphysics, and their graduate students

    Abstract: The essays in this volume, while exploring bioethical issues bearing on death and dying, the use of scarce resources, and genetic interventions, also implicitly compare approaches to bioethics in Japan versus Western countries. This volume provides a cross-cultural comparison of Japanese, American and European approaches to bioethics and health care policy. In a world of international bioethics, it explores the similarities and dissimilarities between bioethics in Japan and the Western world. The collection gives both a portrayal of current approaches as well as an analysis of the character and grounds for the similarities and dissimilarities. The similarities reflect attempts to find morally justified bases for collaboration when individuals do not share taken-for-granted understandings of the proper use of health care, the meaning or form of a good death, and the correct ways to collaborate. Similarities also derive from Western bioethical reflections that have been exported to Japan, which, for better or worse, have entered and altered traditional Japanese understandings. Japan and the West have been exposed to the post-traditional character of the age. Many of the dissimilarities stem from the fact that Japan remains in large measure a traditional society with strong ties to family, culture and community. Japanese share many common understandings of values, while the West has long struggled with moral diversity. These essays explore particular bioethics, which reflect particular moral commitments, as contributions to the emerging international dialogue concerning bioethics and health care policy

    Abstract: The basic theme of Metaphors: Figures of the Mind is contained in the formula that metaphoric language reflects the functioning of our thought processes. Thus, the author of this book uses language analysis as a medium through which we can perceive and analyze the way our mind functions. Results of the investigation point to the conclusion that the mind does not operate according to the representations of a logical-positivistically oriented theorist; the forms of language usage and mental mechanisms involved manifest ubiquitous nonliteralness. However, an overall metaphorical detour from the literal one-to-one correspondence is not for the sake of figurative fancy but is primarily for the purpose of achieving new significations. In such a context, that which is habitually considered to be ambiguous, vague and indeterminate, becomes a productive source of semantic creation which can often specify meaning in a more adequate way than literalness does. Metaphor emerges as a cognitive tool. It appears as an efficacious means of description and explanation, of heuristics and learning, and, as a final instance, an instrument of `worldmaking'. Bearing in mind the profound significance of the `metaphorical turn', one can extend a conventional string of definitions with an additional characterization of a human being as a `metaphorical animal'

    Abstract: Two concepts, in the interface of the philosophy of mind and formal ontology, content and object of presentations are central to the origin of both analytic philosophy and phenomenology around 1900. This work presents an analysis of these two concepts, based on a historical presentation and examination of texts written in the last decade of the 19th century by the 'founding father of Polish philosophy' Kazimierz Twardowski and the founder of phenomenology Edmund Husserl. The book has been revised to take account of the recent publication of Husserl's correspondence as well as new secondary literature. It also includes references to earlier philosophy and philosophy of language. It will be of interest to PhD students interested in formal ontology, the philosophy of mind, especially those desiring to acquaint themselves with Central European thought as a counterpoint to German idealism and life philosophy around the turn of the last century

    Abstract: This is the first of two volumes comprising the papers submitted for publication by the invited participants to the Tenth International Congress of Logic, Methodology and Philosophy of Science, held in Florence, August 1995. The Congress was held under the auspices of the International Union of History and Philosophy of Science, Division of Logic, Methodology and Philosophy of Science. The invited lectures published in the two volumes demonstrate much of what goes on in the fields of the Congress and give the state of the art of current research.     Abstract: This volume is concerned with how we ought to evaluate the individual and collective actions on which the existence, numbers and identities of future people depend - discussed here as the `problem of contingent future persons'. For it seems that those future persons who are brought into existence by such actions cannot benefit from or be harmed by them in any conventional sense. This is a relatively novel problem in ethics and as yet there is simply no consensus on how we ought to evaluate such actions or, indeed, on whether we can.     Abstract: The philosophy of the Cambridge Platonists in the mid-seventeenth century constituted a unique return to many themes of classical Christian Platonism in epistemology and metaphysics. It did so at a time marked by great changes in the natural sciences and in philosophy under the impact of such figures as Galileo and Descartes and great religious and political turmoil in England associated with the Civil War. As well as examining central aspects of their thought and their political and religious implications, this book explores themes arising from that context and the relationship of key figures in the group with their contemporaries and successors.     Abstract: Conscious experience and thought content are customarily treated as distinct problems. This book argues that they are not. Part One develops a chastened empiricist theory of content, which cedes to experience a crucial role in rooting the contents of thoughts, but deploys an expanded conception of experience and of the ways in which contents may be rooted in experience. Part Two shows how, were the world as we experience it to be, our neurophysiology would be sufficient to constitute capacities for the range of intuitive thoughts recognized by Part One. Part Three argues that physics has shown that our experience is not veridical, and that this implies that no completely plausible account of how we have thoughts is comprehensible by humans. Yet this leaves thoughts not especially suspect, because such considerations also imply that all positive and contingent human conceptions of anything are false
