It does not attempt to evaluate their respective advantages/disadvantages or to recommend particular institutional arrangements. Twenty-two separate overviews of public procurement systems in the 22 participating Member States were produced on the basis of national responses to a detailed questionnaire. An in-depth review of these country system overviews provided the comparative analysis portion of this study, which discusses the various models in place in Member States, in particular the background and rationale for the use of a particular institutional model.

    Kurzfassung: The Competition Committee (WP2 on Competition and Regulation) hold a roundtable discussion in June 2004 on Competition and Regulation in Agriculture: Monopsony Buying and Joint Selling. Monopsonistic purchasing practices and joint price-setting activities in the agro-food sector were examined, with a particular focus on regulation and on the potential improvements that could arise from more pro-competitive regulations. Joint activity by producers can have a number of beneficial effects, such as from promoting a brand or food that would not otherwise be promoted, promoting a style of production (like organic production) or purchasing in large quantity in order to obtain quantity discounts. Harms may arise when the joint activity involves price or qualitysetting and there is little competition from close substitutes. Cartellike activity by producers has often been supported by governments but is unlikely to achieve stated public policy goals because it often leads to higher consumer prices but enhance land values more than farmer income. Potentially monopsonistic purchasing practices in the agricultural sector were also considered. At times, price manipulation by large purchasers may occur. Competition authorities play an important role in assuring that activities of purchasers do not involve market power, particularly when purchases are concentrated in few, large firms and sellers have limited options besides selling into a highly concentrated market. However, to the extent that purchasers wish to contract for very specific forms of production, such as specific varieties of grain, there can be good commercial reasons that a purchaser would wish to focus on a specific forms of production and agriculture products should not be considered different from supplies in other sectors, which are customized for different purchasers.

    Kurzfassung: This paper was prepared by Sigma, upon the request of the Ministry of the Interior of the Czech Republic, to serve as a basic comparative working document for the preparation of a new policy and regulation on conflict of interest in the Czech public sector. Given its generalist orientation, the paper could also be useful for other countries carrying out specific reforms in the area of conflict of interest and general reforms related to anti-corruption policies and instruments.This paper provides descriptive data and an analytical overview of approaches to managing conflicts of interest in the public sector of nine European countries - six "old" EU members (France, Germany, Italy, Portugal, Spain and the United Kingdom) and three "new" EU members (Hungary, Latvia and Poland). The paper also provides some conclusions that are worth taking into account when reforming policies and instruments to improve regulations and practices on conflict of interest.

    Kurzfassung: This paper reviewed current discounting practice in the OECD. It found a wide variance in guidance across countries (which may or may not be justifiable by different economic conditions), and significant differences in guidance within countries. Furthermore, even when discounting guidance is specified, it is not always followed in practice.A clear conclusion from this study is the allocation of public funds would be substantially improved if OECD countries provided departments with a consistent set of guidance on discounting. This guidance should provide for the analysis of long-term projects, programmes and policies, which are increasingly important, particularly with respect to environmental concerns. Finally, guidance should incorporate advances in theory of discounting under long-term uncertainty. A recipe for determining the appropriate rate of decline in the discount rate is included in this paper.

In such an effort OECD possesses significant resources: a generation’s worth of anti-corruption expertise; unparalleled networks, information and data resources; and strong credibility based both on anti-corruption and integrity instruments (such as the OECD Convention on Bribery of Foreign Public Officials in International Business Transactions, 1998 OECD Recommendation on Improving Ethical Conduct in the Public Service and the 2003 Recommendation on Guidelines For Managing Conflict Of Interest in the Public Service) and a half-century of effective dealings with the world’s major economies. But it also faces significant challenges, made all the more difficult by the fact that in some ways it is venturing into unknown territory.     Kurzfassung: This report examines how policy co-ordination between the environment and health fields could be improved in order to better address environmental health issues. To this end, three cases studies were implemented in the United Kingdom, France and Canada, with particular focus on air pollution.The report synthesises the main findings arising out from these case studies as well as from a review of the governance literature as well. It identifies the main means and obstacles to improved policy coordination of cross-cutting issues, such as environmental health. Recommendations are then suggested, intending to improve co-ordination between environmental and health policies.

    Kurzfassung: Dominant firms can use various strategies to eliminate or deter competition, including unlawful price cuts or “predatory pricing”. That strategy involves a willingness to absorb losses in the near term that are rational only because they lead to greater profit in the longer term, after competitors have been disciplined or eliminated. Despite differences in statutes across jurisdictions, the roundtable discussion held in October 2004 in the Competition Committee quickly revealed a virtually unanimous view that the purpose of competition laws is to protect and promote competition, not competitors. With respect to methods for detecting predatory prices, including price-cost tests, there was a greater diversity of views because different cost measures are appropriate in different situations. There was broad agreement among Members that investigations should include an examination of whether an alleged predator would likely be able to recoup its predatory losses, with a negative finding indicative of a low probability of harm to competition.

    Kurzfassung: Health professions are overseen by an array of rules and regulations that are justified by the need to protect consumers from unqualified practitioners. The most common method of ensuring practitioner quality is professional licensure. Because health care expertise is necessary to establish the appropriate program of study, training, and examination for new professionals, a licensed profession often directly or indirectly controls its own licensure rules. In this process of selfregulation, a profession exercises its legitimate interest in maintaining the quality of its members. But a self-regulating profession also has the potential to abuse its control over who can practice and how they practice in order to enhance member income.

    Kurzfassung: There is growing recognition throughout the OECD of the need to link economic development and employment policies at the level of the individual city if the twin objectives of raising competitiveness and reducing worklessness are to be met. The challenge is particularly clear in the UK, where the employment rate of the working age population in the major cities has lagged consistently behind the relatively strong performance of the nation as a whole (HM Treasury, 2007). The Government has recognised that raising the UK employment rate towards its ambitious 80%national target will require special efforts to tackle unemployment and economic inactivity in the cities (Department of Work and Pensions, 2006). This is an important departure from the traditional emphasis on national labour market policies and standardised welfare to work programmes that pay little regard to geographical variations in socio-economic conditions. One of the issues arising is the appropriate balance between measures to stimulate labour demand and create jobs, on the one hand, and measures to strengthen labour supply by improving people’s skills, employability and motivation, on the other. There is also an issue about how to connect employment opportunities to people in need of work but who face multiple disadvantages and barriers to employment, such as poor transport access and lack of childcare. Another issue relates to the amount of decentralisation and local control of the policy levers that government should encourage, and what form this should take. The purpose of this paper is to address these important questions by focusing on the labour market context and policy situation in Glasgow.

    Kurzfassung: At the OECD Symposium and Global Forum on Integrity in Public Procurement in November 2006, participants called for an instrument for policy makers at the international level to reform public procurement systems and reinforce integrity and public trust in how public funds are managed. They also expressed interest in developing a practical toolkit that could be applied, adapted and developed indifferent legal, political and administrative contexts. To respond to these requests, the OECD has developed a draft "Checklist for Enhancing Integrity in Public Procurement". The Checklist will help guide policy makers at central government level in instilling a culture of integrity throughout the entire public procurement cycle:• The first part of the Checklist provides guidance on developing an adequate policy framework for enhancing integrity in public procurement;• The second part focuses on how to implement this framework, from needs assessment to contract management and payment. The Checklist is based on applying good governance elements, in particular transparency, good management, corruption resistance, accountability and control to enhance integrity in public procurement.

    Kurzfassung: Because of the high percentage of national income and government budget typically associated with the provision of hospital services and because there is substantial evidence of hospital services could often be delivered more efficiently than they are, a number of OECD countries have increased the extent to which competitive mechanisms are adopted to increase the efficiency of hospital care delivery. Hospital services are complex set of products and services than comprise many different types of patient-oriented activities and not all services are equally subject to competition. For some services, such as emergency services, a hospital may have few if any competitors. For other services, such as inpatient scheduled surgeries, a hospital may compete for patients with other hospitals that offer comparable care. For still other services, such as diagnostic services, specialist consultations and outpatient services hospitals may at times compete with diagnostic centers, doctors’ offices and ambulatory surgery centers. Competition between providers of hospital services can have a number of impacts, including reducing excessive hospital stays, reducing costs of providing care and improving quality of care. Mechanisms for increasing competition or market forces identified in this paper include: collecting and distributing improved information on provider performance; supporting new entry when entry and exit costs are low; encouraging independent or private operation of facilities; improving allocation of human resources, particularly through reducing anticompetitive restrictions by professionals; introducing prospective pricing in combination with benchmarking; physician-led purchasing; providing for greater consumer choice, particularly when waiting lists are long; introducing contestable management of hospitals; and applying competition law in circumstances where public policy focuses on pro-competitive mechanisms. A competitive mechanism that might work in one system will not necessarily transfer well to another. Moreover, competitive mechanisms may at times increase costs. As health policy makers increase reliance on competitive mechanisms, they may need to think carefully about structural market conditions and potentially involve competition authorities when it appears that participants in the market are acting to restrain or eliminate competition.

    Kurzfassung: Post-public employment is one of several variations of the broad concept of conflict of interest, that is, the use of public office for private gain.1 Most post-employment offences occur when public officials use, or appear to use, information or contacts acquired while in government to benefit themselves, or others, after they leave government. However, despite use of the term post-public employment, these offences can actually occur before officials leave government. For example, a serving public official can give preferential treatment to a business firm with a view to obtaining employment with that firm after leaving government. If the official is successful in obtaining that employment and leaves government, he or she can then commit post-employment offences. For example, the official can use confidential information obtained while in government to the benefit of his or her new employer. Thus, a post-employment offence can arise both from the use of one’s current public office for private gain and from the wrongful exploitation of one’s previous public office. For the most part, however, the focus of this paper is on the behaviour of former public officials in their relations with government. Based on the experience of leading OECD countries, the paper will support the development of a state of the art handbook by covering all relevant aspects of a sound and comprehensive framework for preventing conflict of interest in post-public employment...

    Kurzfassung: This paper argues that the sustained provision of adequate financial resources for the environment is a prerequisite for addressing environmental challenges in Eastern Europe, the Caucasus and Central Asia (EECCA) and South-Eastern Europe (SEE). It sets out options for how optimal use could be made of the various available sources of environmental finance, including domestic public expenditure, private sector participation and official development assistance. Recommendations are provided for Ministers on priority actions for ensuring that financial resources are made available for the environment. EECCA and SEE governments need to continue to prioritise the environment in policy and public expenditure frameworks, and make better use of incentive-based instruments. They also need to create a suitable climate for the private sector to participate in environmental financing. The international community must ensure that IFI loans for environmental investments are more accessible, especially for low-income countries, including by providing adequate grant co-financing. Finally, EECCA and SEE countries should strengthen their capacity to prepare environmental investment projects, with effective support from IFIs and donors.

Participants requested the EAP Task Force to assess progress in implementing these Guiding Principles for review at a major conference of stakeholders that took place in 2005 in Yerevan, Armenia. This paper is an update of a report that was prepared for the Ministerial meeting in Yerevan, drawing on more recent data, and responds to the Ministers' request to prepare such a paper for the Environment for Europe Conference in 2007.

    Kurzfassung: OECD countries invest significant resources in evaluating agricultural pesticides before they are marketed (or re-evaluating pesticides that have been in use for many years) to ensure that they do not pose unacceptable risks to human health and the environment. Since many pesticides used in OECD countries are the same, governments have recognised the substantial benefits that can be gained if the task of pesticide evaluations for registration and re-registration is shared, rather than duplicating each others' work. The OECD Pesticides Programme is working to establish the infrastructure that will facilitate such work sharing. The recent adoption of an OECD-wide future "vision", with specific deadlines for work sharing, should lead to additional (and more routine) work sharing arrangements between governments and industry.This document provides responses to questions that are frequently asked by governments and industry about the concept of work sharing, and how it would operate in practice. Many of the questions were raised at an OECD seminar on work sharing, held on 31 May, 2006, at the Pesticide Control Service in Ireland. The answers were prepared by a panel of OECD government representatives at that seminar.

    Kurzfassung: Environmental protection and competitive markets are two of the highest policy priorities. In June 2006 the Competition Committee held a roundtable discussion on potential restrictions to competition due to environmental protection. Environmental regulations can constitute substantial barriers to entry in some markets, can provide a basis for predatory behaviour in some markets and can be harmful to competition and welfare through a variety of other channels. Environmental rules can thus raise prices to consumers by reducing competition in the market. Any assessment of the costs and benefits of an existing or proposed environmental rule is incomplete without an analysis of the costs generated by any resulting reduction in competition. On the other hand, there is no firm empirical evidence that environmental policy affects the competitiveness of firms and countries. Ideally, environmental policies should be effective and among equally effective policies, the policy that is least restrictive of competition should be chosen. Environmental policy makers should ensure that environmental benefits continue to outweigh costs, including the indirect costs associated with effects on market structure. Environmental policy is first and foremost about securing public environmental goods which are demanded in their own right and which are fundamental to a well-functioning market.

The OECD has worked extensively during the last few years on issues relating to the organisational dimension of the national administration and, in particular, on the phenomenon of "agencification" and its impact on governance structures. It has already produced a significant number of analyses1, including a comprehensive comparative publication on Distributed Public Governance (2002)2. Sigma has also published on the topic in the framework of public expenditure management and with reference to transition countries.This OECD work was prompted by the problems caused by the increasing administrative-functional deconcentration within its member countries. The main questions posed were along the lines of: Does departmentalisation (keeping the whole responsibility within a ministry) ensure better control and efficient management of administrative and other public services or, on the contrary, does agencification (in the sense of setting up separate bodies) result in better management and de-politicisation?

    Kurzfassung: Despite general agreement that consumers benefit from lower prices that are not predatory, several nations have laws against loss leader sales even when they are unlikely to foreclose competition. These laws appear to protect competitors rather than competition. The Competition Committee’s roundtable discussion in October 2005 focused on efforts to reform or remove laws against loss leader sales and efforts to prevent such restrictions from being enacted. The Secretariat background note argued that rules again loss leader sales should be sunsetted because they are likely to harm consumers and protect inefficient competitors, fail to account adequately for pro-competitive business justifications for loss leader sales and detract from economic dynamism and growth. Japan, Germany and France, defended their rules against price competition, although France was in the process of a reform. Members of a second group of countries were working to remove laws against loss leader sales. The nations in a third group with no law against loss leader sales, reported efforts by groups of competitors to have such rules applied either at the national level or at the state/provincial level. Both the consumer and business submissions argued that prohibiting loss leader sales is likely to harm consumers and protect competitors, rather than competition.

Just as firms must innovate and invest to succeed, cities have to adjust, reinvent, and differentiate themselves. They have to change the old patterns of land and resource use, and connect assets with opportunities in new ways and over new spaces. They must modernise infrastructure and build up human capital.     Kurzfassung: This study deals with "instruments used to address mercury emissions to air", by which is meant all legislation, regulation and other measures intended to control or reduce anthropogenic, atmospheric mercury emissions. As the links are complex between actual inputs of mercury to society (consumption for intended use and mobilisation of mercury-impurities via industrial processes) and the final release sources, all types of measures addressing any phase in the life-cycle of mercury which may ultimately lead to atmospheric mercury emissions are included here. Due to its volatility, most forms of mercury released or discarded as waste - as vapour, as liquid elemental mercury, as compounds, as integrated in products, consumer waste or flue-gas cleaning residues - may lead to emissions to air.

    Kurzfassung: In November 2006, the OECD Steering Group on Corporate Governance initiated a study of the role of privately organised pools of capital (“alternative investment vehicles”) in corporate governance. With a rapid increase in the size of transactions and investments, and partly due to differences in corporate governance frameworks and company structures, there has been a growing public interest in private equity firms and “activist” hedge funds. The Steering Group agreed that the distinct corporate governance aspects that emerge in these discussions required special attention based on the OECD Principles of Corporate Governance (OECD Principles). This Report summarises the main conclusions reached by the Steering Group in April 2007, including the findings of a factual review that were taken into consideration. On the basis of available evidence, the Steering Group concluded that “activist” hedge funds and private equity firms could help strengthen corporate governance practices by increasing the number of investors that have the incentive to make active and informed use of their shareholder rights. It was agreed that, from a corporate governance perspective, there was no need to promote a special set of principles for private equity firms and “activist” hedge funds, but that the opportunities and challenges that follow from their ownership strategies should instead be analysed within the general framework of the OECD Principles, also taking into account existing voluntary standards established and promoted by the industry.

    Kurzfassung: In 2003, by endorsing the Guiding Principles for Reform of Environmental Enforcement Authorities in Transition Economies, the countries of Eastern Europe, Caucasus, and Central Asia (EECCA) agreed on a reference model to guide the modernisation of their systems for environmental regulation and compliance assurance. This report reviews their progress in implementing the Guiding Principles. The main conclusion is that countries took action to comply with the Guiding Principles, mostly to elevate the status of environmental enforcement authorities, clarify responsibilities, and provide training and a better infrastructure. While such improvements are an important basis for further reform, continued lack of progress in modernising strategies and instruments of work will inhibit institutional and environmental performance.

    Kurzfassung: The seminar considered opportunities for risk reduction through better pesticide application technologies. It considered a variety of technology options with such opportunities (e.g. equipment and techniques for reducing spray drift, technical requirements for spraying, establishing buffer zones, etc). While pesticide application technologies for agricultural use was the primary focus, the seminar also addressed municipal (e.g. for bio-security, mosquito control) and other non-agricultural sectors as they are also important in some OECD countries.The seminar considered the role of government and others in promoting innovations in modern, lower risk technologies and their adoption. Issues of safe handling closely related to application technology such as filling and cleaning of sprayers were also addressed. The seminar discussed areas such as minimum technical requirements, standards and certification for performance, maintenance and control of application equipment and technologies, and training and certification of workers and applicators. Regulatory requirements that address these areas, such as inspections of application equipment, were presented during the seminar. Also, voluntary measures such as guidelines addressing these technical requirements were reviewed.

    Kurzfassung: This review discusses the challenges and opportunities of German rural areas. Significant differences between East and West persist and many of these have clear rural dimensions. Factors such as CAP reforms, ageing of the German population and migration trends will also have important rural implications. Many of these issues involve more than rural policy, but rural policy has a place in resolving all of the key issues. However, for rural policy to be an effective part of the policy process it will have to evolve beyond the existing limits in Germany. This review states that Germany's current approach to rural development and rural policy is mainly sectoral and thus does not fully capture the diversity of rural regions.

The detection rate is often low due to the lack of verifiable information that is received from public servants or other citizens. Particular difficulties arise when an investigation involves prominent politicians and wealthy businessmen, or when dealing with international bribery cases that require the assistance from foreign jurisdictions in order to collect evidence. Shortcomings that are at the root of these problems can be found at legislative level; in addition, many law enforcement agencies are technically not apt to deal with complex crimes such as corruption in an appropriate manner. Considering the need for capacity building that countries of the Asian and Pacific region have expressed for capacity building in this reform area of the Action Plan, the ADB/OECD Initiative organized a master training seminar on Effective Prosecution of Corruption. This document assembles the seminar’s background papers and case studies, and the experts’ and participants’ views on the key topics that formed the basis for discussion at the seminar. As such, the publication aims to make the expertise exchanged and acquired during the seminar accessible to a broader public and thus to contribute to the overall aim of combating corruption in the new millennium.

    Kurzfassung: This Test Guideline describes a method conducted as model studies to predict the degradation pathway of the active ingredient under hydrolytic conditions, to identify the degradation products, and to determine the relative amount of degradation products. Three representative hydrolysis conditions should be investigated. Radiolabelled active test substance are used to elucidate the possible degradation pathway and for quantitation of the extent of degradation. The use of tritium (3H) as a label is not permitted due to the possibility of hydrogen exchange with the water. The proposed value for the concentration of a water soluble active ingredient in the studies required here is 1.0 mg/L. Samples may be analysed directly by chromatography or may be extracted with a series of solvents or solvent mixtures with various polarities and other characteristics depending on the nature of the expected residues. The characterisation and identification of extractable residues is made. Ideally samples should be stored at/or below -18°C. The report should include the routes of degradation observed, the degradation pathway, the composition of total radioactive residues, the limit of quantification for radioactivity determination and chromatographic separation.

    Kurzfassung: The Uterotrophic Bioassay is an in vivo short-term screening test. It is based on the increase in uterine weight or uterotrophic response. The Uterotrophic Bioassay relies for its sensitivity on an animal test system in which the hypothalamic-pituitary-ovarian axis is not functional. Two oestrogen sensitive states in the female rodent meet this requirement: i) immature females after weaning and prior to puberty and ii) young adult females after ovariectomy with adequate time for uterine tissues to regress. The test substance is administered daily by oral gavage or subcutaneous injection. Each treated and control group should include at least 6 animals. Graduated test substance doses are administered to a minimum of two treatment groups of experimental animals using one dose level per group and an administration period of three consecutive days for immature method and a minimum administration period of three consecutive days for ovx-adult method. The animals are necropsied approximately 24 hours after the last dose. For oestrogen agonists, the mean uterine weight of the treated animal groups relative to the vehicle group is assessed for a statistically significant increase. A statistically significant increase in the mean uterine weight of a test group indicates a positive response in this bioassay.
