They set our work hours, dictate how we drive and set the table, tell us whether to offer an extended hand or cheek in greeting, and organize the rites of life, from birth through death. We may chafe under the rules we have, and yearn for ones we don’t, yet no culture could do without them. In Rules, historian Lorraine Daston traces their development in the Western tradition and shows how rules have evolved from ancient to modern times. Drawing on a rich trove of examples, including legal treatises, cookbooks, military manuals, traffic regulations, and game handbooks, Daston demonstrates that while the content of rules is dazzlingly diverse, the forms that they take are surprisingly few and long-lived.Daston uncovers three enduring kinds of rules: the algorithms that calculate and measure, the laws that govern, and the models that teach. She vividly illustrates how rules can change—how supple rules stiffen, or vice versa, and how once bothersome regulations become everyday norms. Rules have been devised for almost every imaginable activity and range from meticulous regulations to the laws of nature.     Kurzfassung: How do memory and remembrance relate to the specific mode of transitional justice that lays emphasis on restoration? What is captured and what is obliterated in individual and collective efforts to come to terms with a violent past? Across this volume consisting of twelve in-depth contributions, the politics of memory in various countries are related to restorative justice under four headings: restoring trust, restoring truth, restoring land and restoring law. While the primary focus is a philosophical one, authors also engage in incisive analyses of historical, political and/or legal developments in their chosen countries. Examples of these include South Africa, Colombia, Rwanda, Israel and the land of Palestine, which they know all too well on a personal basis and from daily experience. On 10 December 2020, the book was officially launched with a webinar which brought together the editors of the book and prof. Stephan Parmentier (KU Leuven) and prof.     Kurzfassung: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

    Kurzfassung: The 1947 Partition had a major impact on issues of citizenship and rights in India and Pakistan in the decades that followed. Boundaries of Belonging shows how citizenship evolves at a time of political transition and what this meant for ordinary people, by directing attention away from South Asia's Partition 'hotspots' - Bengal and Punjab - to Partition's 'hinterlands' of Uttar Pradesh and Sindh. The analysis, based on rich archival research and fieldwork, brings out commonalities, differences, and the mutual co-construction of the 'citizen' in both places. It also reveals the way in which developments across the border, such as communal violence, could directly impact on minority rights in its neighbour. Questioning stereotypes of an increasingly 'authoritarian' Pakistan and 'democratic' India, Sarah Ansari and William Gould make a major contribution to recent scholarship that suggests the differences between India and Pakistan are overstated

    Kurzfassung: This book inves­ti­gates an Egyp­tian scandal about paternity and marriage in the years 2004 to 2007. It asks about legal change in Egyp­tian family law and Islamic juri­s­pru­dence while also inqui­ring into the effects of media coverage. The study draws from a variety of sources, inclu­ding news­paper arti­cles, court rulings, univer­sity text­books, fatwas, etc. The resul­ting presen­ta­tion tells two diffe­ring stories about the affair of Hind al-Ḥinnāwī and Aḥmad al-Fīšāwī: one is dramatic and promises change, the other is tech­nical and purports routine. In order to make sense of this, both stories are situated in a discourse analytical frame­work. Buil­ding on the distinc­tion of special discourse, inter­dis­course, and elemen­tary discourse, the combined analysis of both tales deve­lops a new perspec­tive on the issue of change and arrives at an inter­dis­cur­sive view of legal deve­lop­ment in Egyp­tian family law

    Kurzfassung: Kashmir as a Borderland: The Politics of Space and Belonging across the Line of Control examines the Kashmir dispute from both sides of the Line of Control (LoC) and within the theoretical frame of border studies. It draws on the experiences of those living in these territories such as divided families, traders, cultural and social activists. Kashmir is a borderland, that is, a context for spatial transformations, where the resulting interactions can be read as a process of ‘becoming’ rather than of ‘being’. The analysis of this borderland shows how the conflict is manifested in territory, in specific locations with a geopolitical meaning, evidencing the discrepancy between ‘representation’ and the ‘living’. The author puts forward the concept of belonging as a useful category for investigating more inclusive political spaces

    Kurzfassung: Usually, when we discuss racial injustice, we discuss racism in our public or political life. This means that we often focus on how the state discriminates on the basis of race in its application and enforcement of laws and policies. This book draws on the synergy of political theory and civil rights law to expand the boundary of racial justice and consider the way in which racial discrimination happens outside the governmental or public sphere. 'Private racism' is about recognizing that racial injustice also occurs in our private lives, including the television and movie industry, cyberspace, our intimate and sexual lives, and the reproductive market. Professor Sonu Bedi argues that private racism is wrong, enlarging the boundary of justice in a way that is also consistent with our Constitution. A more just society is one that seeks to address rather than ignore this less visible form of racism

    Kurzfassung: The constitutional identity of the Member States is a topic of increasing importance in understanding the interaction between the EU and its Member States. This is because the EU is enjoined to respect the constitutional identities of its Member States in accordance with Article 4(2) TEU. There is also a trend among Member States to articulate their constitutional identities, in particular in relation to European integration. In this regard, this volume fills a need in scholarship by presenting critical analyses of the constitutional identities of selected Member States. Leading and well-placed experts contribute country studies on a range of states, which are compared using a framework that can be applied to other Member States as well. The analyses and comparison of Member States' constitutional identities take place in the context of the EU's multilevel architecture

    Kurzfassung: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Kurzfassung: "Organizations deserve more attention than they have hitherto found-above all, a different sort of attention. This may seem a bold assertion given the many ways in which organizations are discussed in everyday communication and in the relevant scientific disciplines. But this is the very reason to concentrate our attention more strongly not on organizations as countable entities but on organization as a process. This is relevant from a theoretical perspective, given that inquiry into the essence of organization seems to have become unproductive (which is typical of questions of essence, indeed of what- questions per se). But a different understanding of organization could prove important for the purposes of practical policy. Precisely because organizations (again in the plural) have become crucial, indispensable to modern life, it could be important to have a better grasp of their "intrinsic logic." Especially if heteronomy-be it subjection to owners or other "masters," to liberal or socialist ideologies, or to representatives of interests that are themselves organized-is increasingly called into question, it could be important to give organizations a conception of themselves that enables them to answer for themselves"...

    Kurzfassung: Distinguishing between civilians and combatants is a central aspect of modern conflicts. Yet such distinctions are rarely upheld in practice. The Civilianization of War offers new ways of understanding civilians' exposure to violence in war. Each chapter explores a particular approach to the political, legal, or cultural distinctions between civilians and combatants during twentieth-century and contemporary conflicts. The volume as a whole suggests that the distinction between combatants and non-combatants is dynamic and oft-times unpredictable, rather than fixed and reciprocally understood. Contributors offer new insights into why civilian targeting has become a strategy for some, and how in practice its avoidance can be so difficult to achieve. Several discuss distinct population groups that have been particularly exposed to wartime violence, including urban populations facing aerial bombing, child soldiers, captives, and victims of sexual violence. The book thus offers multiple perspectives on the civil-military divide within modern conflicts, an issue whose powerful contemporary resonance is all too apparent

    Kurzfassung: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Kurzfassung: International and national armed conflicts are usually preceded by a media campaign in which public figures foment ethnic, national, racial or religious hatred, inciting listeners to acts of violence. Incitement on Trial evaluates the efforts of international criminal tribunals to hold such inciters criminally responsible. This is an unsettled area of international criminal law, and prosecutors have often struggled to demonstrate a causal connection between speech acts and subsequent crimes. This book identifies 'revenge speech' as the type of rhetoric with the greatest effects on empathy and tolerance for violence. Wilson argues that inciting speech should be handled under the preventative doctrine of inchoate crimes, but that once international crimes have been committed, then ordering and complicity are the most appropriate forms of criminal liability. Based in extensive original research, this book proposes an evidence-based risk assessment model for monitoring political speech

Anthropology has in recent years taken on global organizations as a legitimate source of its subject matter.     Kurzfassung: Scholars from various disciplines have long debated why western Europe in general, and England in particular, led the transition from feudalism to capitalism. The decline of serfdom between c.1300 and c.1500 in England is centralto this "Transition Debate", because it transformed the lives of ordinary people and opened up the markets in land and labour. Yet, despite its historical importance, there has been no major survey or reassessment of decline of serfdom for decades. Consequently, the debate over its causes, and its legacy to early modern England, remains unresolved. This dazzling study provides an accessible and up-to-date survey of the decline of serfdom in England, applying a new methodology for establishing both its chronology and causes to thousands of court rolls from 38 manors located across the south Midlands and East Anglia. It presents a ground-breaking reassessment, challenging many of the traditional interpretations of the economy and society of late-medieval England, and, indeed, of the very nature of serfdom itself. Mark Bailey is High Master of St Paul's School, and Professor of Later Medieval History at the University of East Anglia. He has published extensively on the economic and social history of England between c.1200 and c.1500, including Medieval Suffolk (2007).

    Kurzfassung: This is a study of law, wrongdoing and justice as conceived in the minds of the ordinary people of England and Wales from the later eighteenth century to the First World War. Official justice was to become increasingly centralised with declining traditional courts, emerging professional policing and a new prison estate. However, popular concepts of what was, or should be, contained within the law were often at variance with its formal written content. Communities continued to hold mock courts, stage shaming processions and burn effigies of wrongdoers. The author investigates those justice rituals, the actors, the victims and the offences that occasioned them. He also considers the role such practices played in resistive communities trying to preserve their identity and assert their independence. Finally, whilst documenting the decline of popular justice traditions this book demonstrates that they were nevertheless important in bequeathing a powerful set of symbols and practices to the nascent labour movement. This book will be of interest to scholars and students of legal history and criminal justice as well as social and cultural history in what could be considered a very long nineteenth century. Stephen Banks is an associate professor in criminal law, criminal justice and legal history at the University of Reading, co-director of the Forum for Legal and Historical Research and author of A Polite Exchange of Bullets: The Duel and the English Gentleman, 1750-1850 (The Boydell Press, 2010).
