It provides a more nuanced, systematic and contextualized comparison of normalization in two countries. Through analyzing policy and legislative documents, participant observation and interviews, it seeks to understand how normalization is implemented differently in prison legislation, policies and practices and compares the two societies for context. It also considers the material prison environment, security, the social environment and the use of time in prison. It provides insights into how normalization can be successfully and holistically implemented in both policy and practice, to contribute to a more ‘pure’ form of liberty deprivation as punishment without too many unintended effects. Helene De Vos is an affiliated senior researcher at KU Leuven, Belgium, and the executive director of RESCALED. She is particularly interested in comparative prison research and the relationship between prison policies, legislation and practice. .

    Abstract: Dieses Lehrbuch stellt zunächst eine Reihe von klassischen philosophischen Ansätzen vor, um zu zeigen, dass sie als Grundlage für die Menschenrechte ungeeignet sind. Nur das Konzept der Menschenwürde - basierend auf der kantischen Unterscheidung von Preis und Würde – ist als Grundlage geeignet. Die Ableitung der Menschenrechte aus dem Prinzip der Menschenwürde erlaubt es, das entscheidende Merkmal der Menschenrechte zu identifizieren, nämlich den Schutz der Personalität. Dies wiederum ermöglicht es, (1) die Menschenrechte sinnvoll zu interpretieren, (2) zwischen echten und unechten moralischen Menschenrechten zu unterscheiden, (3) den Schutzumfang vieler kodifizierter Menschenrechte nach den Kriterien „Kern“ und „Hof“ zu differenzieren und bietet (4) einen Ausgangspunkt für die „Entdeckung“ neuer, ungeschriebener Menschenrechte. Diese philosophische Grundlage ermöglicht eine grundlegende Neubewertung der Rechtsprechung zu den Menschenrechten, die es letztlich ermöglichen wird, sie im Hinblick auf Rechtssicherheit, Klarheit und Schlüssigkeit zu verbessern. Das Lehrbuch richtet sich in erster Linie an fortgeschrittene Studierende der Rechtswissenschaft, die an einem tieferen Verständnis der Menschenrechte interessiert sind. Es eignet sich aber auch für Studierende der Geisteswissenschaften und für alle, die im politischen oder sozialen Bereich tätig sind und sich mit Menschenrechten und deren Durchsetzung befassen. Jedes Kapitel ist in vier Teile gegliedert: Zusammenfassungen, Vorlesung, empfohlene Lektüre und Fragen, um das Verständnis des Lesers zu überprüfen.     Abstract: The unmatched technological achievements in artificial intelligence (AI), robotics, computer science, and related fields over the last few decades can be considered a success story. The technological sophistication has been so groundbreaking in various types of applications that many experts believe that we will see, at some point or another, the emergence of general AI (AGI) and, eventually, superintelligence. John-Stewart Gordon, PhD in Philosophy, serves as an adjunct full professor at LSMU and has held various academic roles.     Abstract: This book provides an in-depth overview of what is currently happening in the field of Law and Artificial Intelligence (AI).     Abstract: “Can I choose to die?” As the number of requests for euthanasia and physician-assisted suicide continues to rise, human rights law faces a new conflict: the right to die vs. the right to life… The right to die or, in other words, ‘the right to choose the time and manner of one’s own death’ is a question of personal autonomy and its limits. This book provides a comprehensive understanding of the right to die and sheds light on its possible future under the European Convention on Human Rights. After setting a clear framework by defining the key terminology, the book takes a two-part approach to achieving its aim. The first part focuses on the right to die in practice by examining selected jurisdictions. Switzerland, which is famous for its assisted suicide organizations, and the Netherlands, which was the first country to legalize euthanasia, are examined in detail. Belgium, Germany, the United Kingdom, and -as an exception to the Convention perspective - Canada are also included. While this examination offers a better understanding of what the right to die looks like in practice, it also provides insights on the slippery slope argument, which serves as a counterweight to personal autonomy, without making a definitive statement on its validity. This part also illustrates the different paths that led or did not lead to the right to die in practice. The second part is an analysis of the European Court of Human Rights case law on the right to die. The Court has made important statements in only very cases, while its caution when approaching such a delicate and controversial topic among its 47 members is understandably emphasized. This analysis of the Court’s approach to the balancing of personal autonomy against other interests allows us to take a look back at the practice in more permissive jurisdictions through the lens of the Convention. Taken together, the book’s two parts provide valuable lessons for countries that decide to practice assisted dying, which are outlined in the conclusion. In addition, given that a purely legal approach can only offer a partial picture, the book argues that an interdisciplinary approach would be much more favorable in terms of providing the necessary basis for the right to die debate.

    Abstract: This book considers contested responsibilities between the public and private sectors over the use of online data, detailing exactly how digital human rights evolved in specific European states and gradually became a part of the European Union framework of legal protections. The author uniquely examines why and how European lawmakers linked digital data protection to fundamental human rights, something heretofore not explained in other works on general data governance and data privacy. In particular, this work examines the utilization of national and European Union institutional arrangements as a location for activism by legal and academic consultants and by first-mover states who legislated digital human rights beginning in the 1970s. By tracing the way that EU Member States and non-state actors utilized the structure of EU bodies to create the new norm of digital human rights, readers will learn about the process of expanding the scope of human rights protections within multiple dimensions of European political space. The project will be informative to scholar, student, and layperson, as it examines a new and evolving area of technology governance – the human rights of digital data use by the public and private sectors. Rebekah Dowd is an Assistant Professor of Political Science at Midwestern University in Texas. Rebekah’s research focuses on human rights within data policy, the online behavior of individuals and states, and policy decision-making by European politicians. Dr. Dowd teaches courses in global studies, international relations, comparative and foundational politics, European politics, and international political economy.

    Abstract: This open access book focuses on the impact of Artificial Intelligence (AI) on individuals and society from a legal perspective, providing a comprehensive risk-based methodological framework to address it.     Abstract: How did Africans become 'blacks' in the Americas? Becoming Free, Becoming Black tells the story of enslaved and free people of color who used the law to claim freedom and citizenship for themselves and their loved ones. Their communities challenged slaveholders' efforts to make blackness synonymous with slavery. Looking closely at three slave societies - Cuba, Virginia, and Louisiana - Alejandro de la Fuente and Ariela J. Gross demonstrate that the law of freedom - not slavery - established the meaning of blackness in law. Contests over freedom determined whether and how it was possible to move from slave to free status, and whether claims to citizenship would be tied to racial identity. Laws regulating the lives and institutions of free people of color created the boundaries between black and white, the rights reserved to white people, and the degradations imposed only on black people

    Abstract: This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. A range of relevant areas, such as migration, refugees (including settlements and whether they are adequately supplied with basic necessities), water distribution and quality, housing and settlement monitoring are crucial aspects addressed in this book. In closing, the use of satellite data for legal purposes is not without its fair share of problems and concerns, which are also considered to guide the evolution of this emerging field.

    Abstract: Von Staaten können Gefahren ausgehen und Völkerrechtsbrüche begangen werden, auf die andere Staaten zum Schutz ihrer selbst und ihrer Bewohner reagieren müssen. Zugleich sind die Staaten durch die Globalisierung wirtschaftlich auf das Engste vernetzt und vom grenzüberschreitenden Handel abhängig geworden. Damit sind Wirtschaftssanktionen das Mittel der Wahl, um Gefahren zu begegnen und das Völkerrecht durchzusetzen. Staatenbezogene Sanktionen treffen zuerst die Bevölkerung des Zielstaates. Das traditionelle formale Verständnis der Staatensouveränität konnte keine effektiven rechtlichen Rahmenbedingungen hervorbringen. Neuere völkerrechtliche Entwicklungen stellen das Individuum generell in den Vordergrund, materialisieren die Souveränität vor dem Hintergrund der responsibility to protect mit menschenrechtlichen Schutzpflichten und betonen die Frage der Verhältnismäßigkeit. Matthias Valta behandelt das Welthandelsrecht, das Interventionsverbot, das Recht der Gegenmaßnahmen und die Grund- und Menschenrechte, differenziert zwischen Völkerrecht, Europarecht und deutschem Recht und betrachtet exemplarisch vier Fallstudien aus dem Irak, Iran, Kuba und Russland.
    Abstract: In times of worldwide economic interdependence, economic sanctions are the instrument of choice to counter violations of international law by states, even if they affect the population first. International trade law, an increasing materialization of sovereignty and the non-intervention principle, the law of counter-measures, basic and human rights and proportionality provide the basis as well as limitations for their use.

    Abstract: "What are the human rights implications and effects of a commercialized public sphere? Private companies mediate most of our time online. Internet companies manage the web-based public infrastructure, the public sphere, and public life. As such, their practices have significant consequences for human rights, both in terms of the opportunities they offer and the potential harm they can cause. At the same time, human rights law is state-centric in nature and holds no direct obligations for companies. This book takes the necessary step of examining the role, responsibilities and practices of these private actors vis-à-vis human rights standards and norms. Part of public life and discourse has always unfolded within commercial domains, but the current situation is different in scope and character. In the online realm the vast majority of social interactions, discussions, expressions, controversies, etc. take place within platforms and services provided for by private companies. Moreover, the communications that people provide when socializing online are an essential part of the online business model, used to generate revenue. As such, it is a fundamentally different business model than that of mass media in the pre-internet age. Where newspaper revenue is linked to selling a relatively well-known product, the revenue model of a social media platform is intrinsically linked to the communications, behavior and social life of its users in a way that is largely invisible to the user. The aim of this edited collection is to examine and discuss these developments in light of their implications for human rights protection"--

    Abstract: Just what is a right? Jakob Weissinger approaches this central problem of jurisprudence by critically examining the purpose of such normative concepts and carefully analysing the fundamental elements of normative practice like actions, decisions, the logic of norms and values as well as the plurality of normative practice. Interlinking the insights won, he outlines a stand-alone theory of rights which emphasises the empowering dimension of rights in the process of justifying (legal) rules. Not only does he question well-established theories, such as Hohfeld's famous analysis of legal conceptions, but aspires to set future debates in legal theory, especially those surrounding rights such as the long-standing dispute between interest and choice theories of rights, on new and more solid meta-theoretical ground.

    Abstract: This book analyses the extent and the modalities of the securitization of asylum-seekers and refugees in the EU. Itargues that the development of the EU asylum policy, far from 'securitizing' asylum-seekers and refugees, has led to the strengthening and codification of several rights for these two categories of persons. However, the securitization of terrorism and the links that have been constructed between asylum, irregular migration and terrorism in the wake of the various terrorist attacks that have taken place in Europe in the last few years have had a significant impact on the ability of asylum-seekers to gain access to asylum systems in the EU. From a theoretical point of view, the book develops an original analytical framework that draws upon and further develops security studies- more precisely securitization theory- by connecting it to the literature on policy venues and venue-shopping. It therefore makes a significant contribution to the debates on both securitization and migration. Empirically examining the entire development of the EU's policy towards asylum-seekers and refugees, from its origins in 1993, this book will be of great interest to students of European and EU politics, refugees, migration, security, terrorism and counter-terrorism, security studies and International Relations

    Abstract: As the power and sophistication of of 'big data' and predictive analytics has continued to expand, so too has policy and public concern about the use of algorithms in contemporary life. This is hardly surprising given our increasing reliance on algorithms in daily life, touching policy sectors from healthcare, transport, finance, consumer retail, manufacturing education, and employment through to public service provision and the operation of the criminal justicesystem. This has prompted concerns about the need and importance of holding algorithmic power to account, yet it is far from clear that existing legal and other oversight mechanisms are up to the task. This collection of essays, edited by two leading regulatory governance scholars, offers a critical0exploration of 'algorithmic regulation', understood both as a means for co-ordinating and regulating social action and decision-making, as well as the need for institutional mechanisms through which the power of algorithms and algorithmic systems might themselves be regulated. It offers a unique perspective that is likely to become a significant reference point for the ever-growing debates about the power of algorithms in daily life in the worlds of research, policy and practice.     Abstract: "Customary law and traditional authorities continue to play highly complex and contested roles in contemporary African states. Reversing the common preoccupation with studying the impact of the post/colonial state on customary regimes, this volume analyses how the interactions between state and non-state normative orders have shaped the everyday practices of the state. It argues that, in their daily work, local officials are confronted with a paradox of customary law: operating under politico-legal pluralism and limited state capacity, bureaucrats must often, paradoxically, deal with custom - even though the form and logic of customary rule is not easily compatible and frequently incommensurable with the form and logic of the state - in order to do their work as a state. Given the self-contradictory nature of this endeavour, officials end up processing, rather than solving, this paradox in multiple, inconsistent and piecemeal ways. Assembling inventive case studies on state-driven land reforms in South Africa and Tanzania, the police in Mozambique, witchcraft in southern Sudan, constitutional reform in South Sudan, Guinea's long durée of changing state engagements with custom, and hybrid political orders in Somaliland, this volume offers important insights into the divergent strategies used by African officials in handling this paradox of customary law and, somehow, getting their work done."--Provided by publisher

    Abstract: Areas of limited statehood, in which the territorial State lacks effective control, either completely or in part, challenge International Humanitarian Law in various ways. This volume explores if and how the law adapts to these challenges on the basis of mainly two legal issues: detention and investment protection in (non-)international armed conflict. Does a sufficient legal basis exist for the former? Is it International Humanitarian Law that determines what the investor is owed under a 'full protection and security' standard? More fundamentally, the contributions strive to shed light on these practical legal issues in a manner that is also historically and theoretically informed. How can international law be effective in areas of limited statehood, in particular as regards non-State actors? Can the law provide incentives for compliance? Is it in need of being developed?     Abstract: Amicus curiae participation in international courts is steadily growing since the late 1990 despite lack of clarity on the concept's nature, function and utility in international dispute settlement. Does amicus curiae infuse international judicial proceedings with alternative views, including the public interest in a case, as often advocated by NGOs? Does it increase the legitimacy and transparency of international dispute settlement, or the coherence of international law? Or is it an unhelpful impostor that impedes negotiated solutions and derails the proceedings at the expense of the parties to advance its own agenda? By way of an empirical-comparative analysis of the laws and practices of the ICJ, the ITLOS, the ECtHR, the IACtHR, the IACtHPR, WTO panels and the Appellate Body, and investment arbitration the dissertation examines the status quo of amicus curiae before international courts and tribunals to determine if the current amicus curiae practice is of added value to international proceedings and international dispute settlement in general. The dissertation shows that there is no common concept of international amicus curiae, but that amicus curiae before the international courts examined share a few characteristics. A proposed functional systematization highlights overlaps and diverging uses of the concept before international courts and helps scholars and practitioners to assess the opportunities and limits of the concept. Analysis of the concept's current regulatory framework and its substantive effectiveness reveals a hesitation in particular by courts with a strong adversarial tradition to take into account the views of a non-party despite the positive experience with the concept in regional human rights courts. The dissertation concludes that neither the expectations nor the concerns attached to amicus curiae participation in international proceedings have materialized. It argues that the concept can contribute to improved decisions and decision-making in international dispute settlement if regulated and used properly

    Abstract: This book offers a unique and insightful econometric evaluation of the policies used to fight transnational terrorism between 1990 and 2014. It uses the tools of modern economics, game theory and structural econometrics to analyze the roles of foreign aid, educational capital, and military intervention. Jean-Paul Azam and Véronique Thelen analyze panel data over 25 years across 124 countries. They prove that foreign aid plays a key role in inducing recipient governments to protect the donors' political and economic interests within their sphere of influence. Demonstrating that countries endowed with better educational capital export fewer terrorist attacks, they also illustrate that, in contrast, military intervention is counter-productive in abating terrorism. Recognizing the strides taken by the Obama administration to increase the role of foreign aid and reduce the use of military interventions, this book shows the significant impact this has had in reducing the number of transnational terrorist attacks per source country, and suggests further developments in this vein. Practical and timely, this book will be of particular interest to students and scholars of economics and political science, as well as those working on the wider issue of terrorism.     Abstract: In diesem Buch wird die Bedeutung professioneller Kooperation juristischer Akteure in Gerichtsverfahren mit Hilfe qualitativer Methoden untersucht. Vor dem Hintergrund einer pragmatistischen Theorie sozialer Praxis arbeitet Sebastian Starystach Kernmerkmale der professionellen juristischen Fallbearbeitung in Straf- und Zivilverfahren an Amts- und Landgerichten heraus. Der Autor rekonstruiert systematisch die prozessbeteiligten Rollen von Richtern, Staats- und Rechtsanwälten und nimmt zugleich ihr Zusammenwirken im Kontext der Fallbearbeitung interaktionistisch in den Blick. Das Ergebnis ist die Freilegung des Kerns professionellen Handelns in den betrachteten Verfahrensformen. Es zeigt sich dabei, dass sich die juristischen Akteure weit über den formalen Rahmen der jeweiligen Prozessordnung hinaus an informellen Handlungsweisen orientieren.
