    Abstract: This brief focuses on translational criminology practices as they relate to counter-terrorism and homeland security. The work provides a detailed and practical examination of how global threats (such as, terrorism and cybercrime) are managed through local response. It covers emerging strategies in data collection procedures, inter-agency cooperation, and new analytical techniques including risk-terrain modeling.     Abstract: As the European Union has evolved, it has also begun to address policy questions which are closer to the very heart of the state. From cooperation in Justice and Home Affairs, originally conceived as the third pillar of European cooperation, has emerged the Area of Freedom, Security, and Justice (AFSJ). A unique aspect of policy in this area is the desire to integrate the internal and external dimensions of this policy area. One of the tensions in this policy area has been balancing the protection of fundamental rights and increasing security. The first part of this book focuses on the institutional relations of policymaking in AFSJ, both within member states and between member states, in particular the issues of national executive control, national parliamentary scrutiny and peer review across the member states with regard to AFSJ. The second part focuses on specific policy areas which are part of AFSJ. Two chapters highlight the tension found in this policy area between security and human or fundamental rights, the first related to data retention and the second on policing external borders. The final two chapters are concerned with data exchange among European countries and transatlantically with the US, and the interface between AFSJ and the Common Foreign and Security Policy (CFSP). The chapters contained in the book were presented at the Dutch Ministry of the Interior and Kingdom Relations and the Dutch national parliament (Tweede Kamer), making it of interest to scholars and practitioners alike

    Abstract: This book provides the most current thinking on effective interventions in the lives of criminal offenders. Original articles by leading criminologists provide in-depth analyses of “turning points” in the desistance process experienced by criminal offenders. An understanding of the sources of turning points (or interventions) across the life course is vital to assessing their impact on criminal behavior. Three sources of interventions in criminal careers are identified in the literature: structural location, human agency and situated choice. Structural location refers to the social place occupied by an individual in the social structure: including marital and occupational status, education and income, and so on. Human agency means the active will of an individual to change his or her behavior, that is, the decision to stop engaging in criminal activities. In addition, situated choice coordinates the offender’s willingness to end a life of crime with the social structural supports that increase the odds of criminal desistance. This comprehensive book considers all three sources of turning points-structural location, human agency, and situated choice-across the life course of criminal offenders. The book also provides a section on cross-cultural perspectives on the effectiveness of interventions in the careers of criminal offenders. The policy implications of each intervention are considered in individual chapters. In addition, the authors suggest a research agenda to further the understanding of the interplay among the key interventions across the life course.     Abstract: Mai Sato examines public attitudes to the death penalty in Japan, focusing on knowledge and attitudinal factors relating to support for, and opposition to, the death penalty. She uses a mixed-method approach and mounts quantitative and qualitative surveys to assess Japanese death penalty attitudes. The author’s main findings show that death penalty attitudes are not fixed but fluid. Information has a significant impact on reducing support for the death penalty while retributive attitudes are associated with support. This book offers a new conceptual framework in understanding the death penalty without relying on the usual human rights approach, which can be widely applied not just to Japan but to other retentionist countries.     Abstract: This book provides a unique empirical study of criminal trials in China. Western observers such as the media, politicians and the legal scholars alike, have rarely had the exposure to the vast majority of the ordinary criminal trials in China. A number of legal reforms have been implemented in Chinese criminal courts in recent years, but there has been little research on whether these reforms have been effective. This book fills that gap, by unveiling the day-to-day reality of criminal cases tried by the lowest level courts in China. The data used in this study include hundreds of criminal trial observations, complete criminal case dossiers, and a comprehensive questionnaire survey of criminal justice practitioners from one large province located in China’s Southeast coast. These data were collected over a two-year period, with a generous research grant from the John D. and Catherine T. MacArthur Foundation, by scholars already working in the Chinese legal system. The work opens with a historical framework of the Chinese criminal justice system, both Western and Chinese interpretations, and an overview of the current state of the system. It will provide unique analysis of how criminal trials are being carried out in China, with a useful context for scholars with varying levels of familiarity with the current system. The research framework for gathering data discussed in this book will also provide a useful basis for studying the criminal justice system in other regions

    Abstract: This Brief explores emerging trends in drug use and distribution. This timely Brief examines recent examples of emerging drugs including salvia (from the plant Salvia divinorum), bath salts (and other synthetic stimulants) and so-called research chemicals (primarily substituted phenethylamines, synthetic cousins of ecstasy), which have tended to receive brief levels of high intensity media coverage that may or may not reflect an actual increase in their usage. Over the past decade in particular, “new” substances being used recreationally seem to come out of obscurity and gain rapid popularity, particularly spurred on by discussion and distribution over the internet. While changing trends in the drug market have always presented a challenge for law enforcement and public health officials, online forums, media coverage and other recent trends discussed in this Brief allow them to gain popularity more quickly and change more frequently. These rapid shifts allow less time for researchers to understand the potential health consequences of these substances and for law enforcement to stay abreast of abuses of legal substances. This work includes: 1) review of relevant research and literature, 2) review the Internet sources in which many deem important in influencing the emerging drug market, 3) discussion of national and international trends in use, abuse and distribution of these substances and 4) examination of current drug policy and recommendations for the future. This brief will be useful for criminology and criminal justice, sociology and public health.     Abstract: This book uses a multi-methods study of incarcerated youths to examine the pathways to gang involvement, the drug distribution system and hierarchy within gangs, levels of traumatic stress and depression among gang-involved youths, and other mechanisms of control and retention within the system of gangs. Based on a study of young inmates in Norway, with international backgrounds including Africa, Pakistan, Middle East and Western Europe, the findings explained in this book are broadly applicable. It aims to create a picture of the entire system of gang membership, while revealing a research framework that could be applied to other studies. Gang members were found in high levels to be suffering from depression and traumatic stress, and were often heavily indebted (financially and otherwise) to persons in the outside world. Owing money, violence and other threats, all make it difficult to leave the system, despite the pains they suffer within it. In order understand young peoples’ life within the system, and its hold on them, and in order to reduce its continuation and growth, this important analysis helps researchers and policy makers, particularly those interested in juvenile justice, youth gangs, and drug trafficking understand its logic and identify its weak points and possible ways out

    Abstract: Das Recht der Kunst und Kultur aller Sparten hat in den letzten Jahren an Umfang, Bedeutung und Vielfalt gewonnen. Dem entspricht die Zunahme kunstrechtlicher Publikationen. Es fehlte aber bislang eine umfassende Gesamtdarstellung, die in Form eines Lehrbuchs Wege durch das „Labyrinth des Kunstrechts“ aufzeigt und in konziser Beschreibung dem - auch nicht juristisch ausgebildeten - Leser hilft, diese selber gehen zu können. Im dritten Band dieses Lehrbuchs stehen die Akteure marktbezogenen Verhaltens im Mittelpunkt. In diesem Zusammenhang wird auf einen Schwerpunkt des Kunstrechts - das Urheberrecht - besonders eingegangen. Das Kunstvertragsrecht bezieht sich indes nicht nur auf urheberrechtliche Beziehungen, sondern weist eine Fülle bedeutsamer Fallgestaltungen auf. Denen wird vertieft nachgegangen, wobei auch das Recht künstlerischer Veranstaltungen aller Sparten behandelt wird. Insgesamt geht es zunächst um die „positive und zukunftsgerichtete“ Gestaltung solcher Verträge. Sodann ist zu erläutern, was rechtlich gilt, „wenn etwas passiert“. Dabei geht es um Fragen der Verantwortung, der Haftung, des Schadensersatzes und der Versicherung von Kunst. Das Werk abschließend wird das Internationale Privatrecht in Bezug auf Kunst kurz vorgestellt.Prof. Dr. iur. Dr. phil. h.c. Peter M. Im ersten Band dieses Lehrbuchs wird auf grundlegende Weichenstellungen eingegangen. Diese betreffen einerseits das Verständnis wesentlicher rechtlicher Kategorien, anderseits die Darstellung der „Doppelnatur“ von Kunst als Kulturgut und als Ware. Die politische, gesellschaftliche und wirtschaftliche Praxis widmet sich beidem mit unterschiedlichen Systemen der kulturellen Förderung und des Handels mit Kulturgütern. Das Recht behandelt dementsprechend sowohl gewährleistende und garantierende als auch wirtschafts- und handelsbezogene Gestaltungsmöglichkeiten.     Abstract: Gewalt ist nicht nur eine Männerdomäne. Denn physische und psychische Gewalt wird sowohl vom männlichen, als auch vom weiblichen Geschlecht angewendet. Allerdings ist das Phänomen der Jungengewalt gut erforscht und bearbeitet, während die Anwendung und Ausprägung von Gewalt durch Mädchen und junge Frauen weitgehend unerforscht sind. Der Wissensstand über die Motive und die Ursachenkomplexe ist hier bisher eher gering. In dieser Studie wird auf der Basis von Leitfadeninterviews Licht ins Dunkel gebracht. Ausgangslage ist hierbei gezielt das weibliche Geschlecht und keine weiterführenden Thesen, die vom männlichen Geschlecht abgeleitet sind. Die betroffenen weiblichen Jugendlichen und Heranwachsenden kommen zu Wort, beschreiben ihre Lebenswelten und werden als Experten ihrer Selbst betrachtet. Zudem wird die Sichtweise der Zielgruppe objektiv pädagogisch und sozialwissenschaftlich analysiert und interpretiert. Ziel ist es einen umfassenden Einblick in das gewalttätige Verhalten von Mädchen und Frauen zu erlangen, deren Ausprägung festzustellen, die Ursachen herauszufiltern und die speziell für dieses Geschlecht mit sich einhergehenden Folgen zu analysieren. Ein Kernergebnis dieses Buches ist, dass Mädchen genauso massiv und schwerwiegend körperliche Gewalt einsetzen wie Jungen. Gewalt wird nicht nur gegen das eigene Geschlecht, sondern auch gegen Jungen und Männer gerichtet

    Abstract: Policing in Central and Eastern Europe has changed greatly since the fall of the Berlin Wall. Some Central and Eastern European countries are constituent members of the European Union, while others have been trying to harmonize with the EU and international requirements for a more democratic policing and developments in accordance with Western European and international policing standards, especially in regard to issues of legality and legitimacy.Changes in the police training system (basic and advanced), internationalization of policing due to transnationalization of crime and deviance, and new police organizational structures and agencies have impacted new cultures of policing (from exclusively state to plural policing). This timely volume examines developments in the last two decades to learn the nature of these changes within Central and Eastern Europe, and their impact on police culture, as well as on society as a whole.The development of police research has varied widely throughout Central and Eastern Europe: in some countries, it has developed significantly, while in others it is still in its infancy. This work allows for a transfer of ideas and models of police organization and policing, with an aim to provide consistent and comparable data across all of the countries discussed.     Abstract: In contrast to the pattern of long-standing occidental street gangs modelled in the North American paradigm, new-age gangs have appeared as loosely organized, with a high degree of interchangeability of their membership. Associated with this structural fluidity is an equally significant geographic mobility, which paradoxically does not appear to diminish the intensity of personal bonds formed within and between new-age gangs. The dimensions of fluidity of gang membership and geographic mobility across police jurisdictions is increasingly seen as the organizational pattern of emerging gangs, in large part shaped by worldwide patterns of human migration and globalization. While the structure of new-age gangs appears as loose-knit, what must be emphasized is that this characteristic is reflective of a criminal network of economic commodity-based turf as opposed to a close-knit geographically anchored turf that has characterized the prevailing North American (occidental) gang model. This volume illuminates the structure and organization of increasingly emergent, fluid and mobile, new-age gangs within the context of transnational networks. The implications for law enforcement agencies is two-fold: i) the fluidity of new-age gang players challenges investigative techniques that remain predicated on suspect recognition through modus operandi repetition by those involved, and; ii) the movement of new-age gang players across police jurisdictions challenges the sharing of police information. This innovative work will be of interest to researchers in Criminology and Criminal Justice, as well as related disciplines including Sociology and Anthropology studying gangs and group-organization. It has strong implications for practitioners and professionals working in law enforcement, public policy, or with at-risk youth/young adults.

    Abstract: Female offenders are often perceived as victims who commit crimes as a self-defense mechanism or as criminal deviants whose actions strayed from typical ‘womanly’ behavior. Such cultural norms for violence exist in our gendered society and there has been scholarly debate about how male and female offenders are perceived and how this perception leads to differential treatment in the criminal justice system. This debate is primarily based upon theories associated with stereotypes and social norms and how these prescriptive norms can influence both public and criminal justice response. Scholars in psychology, sociology, and criminology have found that female offenders are perceived differently than male offenders and this ultimately leads to differential treatment in the criminal justice system. This interdisciplinary book provides an evidence based approach of how female offenders are perceived in society and how this translates to differential treatment within the criminal justice system and explores the ramifications of such differences. Quite often perceptions of female offenders are at odds with research findings. This book will provide a comprehensive evidence-based review of the research that is valuable to laypersons, researchers, practitioners, advocates, treatment providers, lawyers, judges, and anyone interested in equality in the criminal justice system

    Abstract: The publication aims to familiarize students of public policy with the precautionary principle, which plays a vital role in the European Union’s approach toward regulating risks. The precautionary principle contends that policy makers should refrain from actions having a suspected risk of causing harm to the public and/or the environment. However, the precautionary principle only provides guidance to policy makers but does not prescribe specific policy responses. Therefore, there should be variation in the way the principle is applied. Furthermore, precautionary measures are, in principle, of a provisional nature, suggesting that they are likely to be subject to changes over time. This book is thus interested in shedding light on how the precautionary principle is put into practice and to what extent precautionary measures become modified. Empirically, it focuses on how the EU has regulated the use of growth hormones in meat production, the cultivation of genetically modified corn and the use of Stevia-based sweeteners in foods and beverages. The main theoretical argument advanced by this study is that the way in which the original regulatory standards were formulated affects whether and how they are changed. By placing particular emphasis on the relevance of scientific evidence for the (re-)definition of precautionary measures, the book is expected to appeal to both academics and practitioners

    Abstract: Joachim Häfele untersucht den Einfluss von urbanen Disorder-Phänomenen (Incivilities) auf die Furcht vor und die Einstellungen zu Kriminalität. Damit stehen das Disorder-Modell und/oder ähnliche Ansätze (z. B. Broken-Windows-Ansatz) zur Erklärung personaler Kriminalitätsfurcht auf dem Prüfstand. Mithilfe von statistischen Mehrebenenanalysen gelingt es dem Autor, eigenständige Effekte des sozialräumlichen Kontextes auf Kriminalitätsfurcht und personale Kriminalitätseinstellungen zu untersuchen. Die Ergebnisse zeigen u. a., dass Incivilities eine ambivalente und teilweise durchaus widersprüchliche Wirkung auf die Kriminalitätsfurcht haben. Insbesondere Social Incivilities oder abweichende Handlungen erhöhen die Risikoperzeption und führen zu einem Absinken des kriminalitätsbezogenen Sicherheitsgefühls.     Abstract: In den zahlreichen Berichten und wissenschaftlichen Arbeiten über ehrbezogene Gewalt wird meist die Opferperspektive eingenommen. Ohne Frage ist dies nützlich und notwendig, doch gehört zur ehrbezogenen Gewalt auch die andere Seite. Die Seite derjenigen, die im Namen der Ehre Gewalt ausgeübt haben. Mittels qualitativer Interviews wird in diesem Buch das Ziel verfolgt, konservative Vorstellungen türkischer Männer über die Rollenteilung zwischen Mann und Frau, über innerfamiliäre Gewaltpraxis und Geschlechterehre zu rekonstruieren. Es wird herausgearbeitet, was Männer, die im Namen der Ehre Gewalt ausüben, unter Ehre verstehen. Welche Verhaltensweisen werden von ihnen als Ehrverletzung gedeutet und wie wäre eine Ehrverletzung nach deren Meinung zu bestrafen? Aus den Gesprächen mit den Männern läßt sich schließen, was ihr Leben prägt und wo präventiver Handlungsbedarf besteht

    Abstract: In der Europäischen Union hat sich ein System föderaler Rechtsdurchsetzung verfestigt. Dies verlangt eine theoretische Sicht auf das EU-System als einem politischen System mit föderalem Kern. Andrea Szukala analysiert die Wechselwirkungen dieser Dynamik mit den Europäisierungsprozessen der mitgliedstaatlichen Systeme vom Binnenmarktprojekt bis zur Ratifikation des Lissabonner Vertrages. Sie verknüpft die rechts- mit der sozialwissenschaftlichen Analyseperspektive und kommt zu dem Schluss, dass die beinahe ausschließlich richterrechtlich gesteuerte föderale Balance zwischen EU und Mitgliedstaaten die politische Handlungsfähigkeit am Ende auf beiden Ebenen beeinträchtigt.

    Abstract: How does the city{u2019}s urban fabric relate to crime and fear, and how is that fabric affected by crime and fear? Does the urban environment affect one{u2019}s decision to commit an offence? Is there a victimisation-related inequality within cities? How do crime and fear interrelate to inequality and segregation in cities of developing countries? What are the challenges to planning cities which are both safe and sustainable? This book searches for answers to these questions in the nature of the city, particularly in the social interactions that take place in urban space distinctively guided by different land uses and people{u2019}s activities.¡ In other words, the book deals with the urban fabric of crime and fear. The novelty of the book is to place safety and security issues on the urban scale by (1) showing links between urban structure, and crime and fear, (2) illustrating how different disciplines deal with urban vulnerability to (and fear of) crime (3) including concrete examples of issues and challenges found in European and North American cities, and, without being too extensive, also in cities of the Global South

    Abstract: The key question for the history of universal human rights is why it took so long for them to become established as law. The main theme of this book is that the attainment of universal human rights required heroic struggle, first by individuals and then by ever-increasing numbers of people who supported those views against the major historical trends. Universal human rights are won from a hostile majority by outsiders. The chapters in the book describe the milestones in that struggle. The history presented in this book shows that, in most places at most times, even today, for concrete material reasons a great many people oppose the notion that all individuals have equal rights. The dominant history since the 1600s has been that of a mass struggle for the national-democratic state. This book argues that this struggle for national rights has been practically and logically contradictory with the struggle for universal rights. It would only be otherwise if there were free migration and access to citizenship on demand by anybody. This has never been the case. Rather than drawing only on European sources and being limited to major literary figures, this book is written from the Gramscian perspective that ideas mean little until they are taken up as mass ideologies. It draws on sources from Asia and America and on knowledge about mass attitudes, globally and throughout history.

In recognition of these trends, governments are already taking a very close look at Web 2.0 and online communities in order to leverage them for designing products and services and for providing citizen services. This book brings together international scholars to provide the theoretical and practical contexts for understanding the nature of Web 2.0 technologies and their impact on political, public policy and management processes, and to explore how best Web 2.0 applications can be leveraged and aligned with the strategic goals of government organizations to add value and ensure effective governance.     Abstract: Young People's Human Rights and The Politics of Voting Age explores the broader societal implications of voting age eligibility requirements and the legislative bar against youth voting in North America and in Commonwealth countries (where 'youth' is defined as persons 16 and over but under age 18). The issue is raised as to whether the denial of the youth vote undermines democratic principles and values and ultimately the human dignity of youth. This is the first book to address the topic of the youth vote in-depth as a fundamental human rights concern relating to the entitlement in a democracy to societal participation and inclusion in influencing policy and law which profoundly affects one's life. Also examined are international perspectives on the issue of voting age eligibility. The book would be extremely valuable for instructional purposes as one of the primary texts in undergraduate or graduate courses on children's human rights, political psychology, political science , sociology of law or society and as a supplementary text for courses on human rights or constitutional law and would be of interest also to members of the general public concerned with children's human rights issues.

    Abstract: Bei gesellschaftsrechtlichen Verbindungen zwischen zwei Unternehmen - sogenannten Konzernen - ergibt sich eine Vielzahl von Problemen. Zivilrechtlich steht bei Abziehen von Geldern aus dem Tochterunternehmen zugunsten der Mutter eine Existenzvernichtungshaftung im Raum. Strafrechtlich stellt sich die Frage, ob der Tatbestand der Untreue verwirklicht wird. Da der Bereich des Konzernrechts durch eine enge Verbindung zwischen Zivil- und Strafrecht geprägt ist, waren zivilrechtlich die „Trihotel“- und „Gamma“-Entscheidungen zu berücksichtigen. Strafrechtlich soll die Problematik im Hinblick auf die „Bremer-Vulkan“-Entscheidung diskutiert werden. Zunächst sind hier die verschiedenen Ansichten kritisch zu beleuchten. Anschließend wird getrennt nach faktischen und Vertragskonzernen sowie nach den Gesellschaftsformen „GmbH“ und „AG“ untersucht, ob den Gesellschafter eine Vermögensbetreuungspflicht trifft, was im Endeffekt bejaht wird. Bei der Frage, wann ein Handeln des Gesellschafters pflichtwidrig ist, wird allein ein Stammkapitaleingriff als tatbestandsmäßig erkannt, wobei - nach Ansicht des Autors - strafrechtliche Besonderheiten der Bilanzierung zu beachten sind. Der sog. Existenzvernichtende Eingriff wird u.a. wegen Bedenken hinsichtlich des Bestimmtheitsgrundsatzes abgelehnt. Einen Schwerpunkt legt der Autor auch auf die Untersuchung von konzernspezifischen Problemen bei der Einbeziehung von Ausgleichspflichten und der Nachteilskompensation
