    Abstract: Die eigene Zeit als Kolonialmacht sei im Vergleich mit Ländern wie Frankreich oder Großbritannien kurz und relativ unproblematisch gewesen: So sah man es hierzulande lange. Doch das war ein Irrtum. Heute steht die deutsche koloniale Vergangenheit zu Recht im Zentrum kontrovers geführter Debatten über das koloniale Erbe in einer globalen Welt. Dieses Buch beleuchtet mit dem Auswärtigen Amt einen zentralen Akteur des deutschen Kolonialismus und spannt den Bogen vom Deutschen Kaiserreich bis weit ins 20. Jahrhundert hinein. Dabei richtet sich der Blick nicht nur auf Deutschland, sondern auch in die betroffenen Gesellschaften Afrikas, Asiens und Ozeaniens. Mit dem Versailler Vertrag von 1919 endete die formale deutsche Kolonialherrschaft. Doch koloniales Denken lebte in der Mitte der deutschen Ge sellschaft fort - so auch im Auswärtigen Amt, dem eine Mitverantwortung für Gewalt und Verbrechen in den deutschen Kolonien zukommt. Die Folgen seines Handelns sind noch bis in unsere Gegenwart spürbar. In der Zeit der NS-Diktatur verbanden sich nationalkonservative, monarchistische und antirepublikanische Haltungen im Auswärtigen Amt mit den expansionistischen und rassistischen Zielen des Nationalsozialismus. Ab 1949 prägten Indifferenz und Ignoranz, Passivität und Relativierung die bundesdeutsche Politik gegenüber den ehemaligen Kolonien im globalen Süden. Heute ist das Amt maßgeblich an Verhandlungen über Restitution und Wiedergutmachung beteiligt. Zudem wird es von einer diverser gewordenen deutschen Gesellschaft mit Fragen zur kolonialen Vergangenheit konfrontiert. Aus Gründen der historischen Gerechtigkeit, aber auch angesichts einer veränderten Weltlage muss sich das Amt seiner eigenen Kolonialgeschichte stellen

    Abstract: "This book charts the path to revitalisation for trade unions in Australia, the USA, the UK, and Italy. It examines the examples of innovation and digital campaigning that are enabling unions to build new forms of worker power - and overcome decades of declining membership wrought by neoliberalism, globalisation, and hostility from employers and the state. The study evaluates the responses of unions in each country to falling membership levels since the 1980s. It considers the US 'organising model' and its adoption in Australia and the UK, comparing this with the strategies of Italian unions which have been more deliberately focused on precarious and migrant workers. The increasing reliance of US unions on community alliances, as seen in the 'Fight for $15' and similar campaigns, is scrutinised along with new union prototypes like Hospo Voice in Australia, the Independent Workers' Union of Great Britain and SI Cobas in Italy. The book includes an in-depth analysis of union responses to the gig economy in the four countries, and the emergence of self-organised worker collectives to combat this exploitative business model. The vital role played by unions in defending the interests of workers during the COVID-19 pandemic is also examined. As well as highlighting the most successful union initiatives to meet the challenges of the past 30 years, the book assesses the strengths and deficiencies of the legal framework for union representation in the four nations. It identifies the labour law reforms needed to rebuild collectivism, but argues that more is needed than favourable laws. This cross-national study provides a rich basis for identifying the combination of reforms, strategies and linkages required to ensure that unions can remain relevant for a new generation of digitally-active workers"--

    Abstract: The Civil Rights Act of 1964 provides protections against discrimination based on race, color, religion, sex and national origin. Sexual orientation and gender identity, however, are excluded and LGBTQ citizens can be legally discriminated against in many fundamental areas that others take for granted as a legal right. The LGBTQ community in America comprises approximately 3.4 percent of the US population, or roughly 9 million citizens. Regardless of the size of the population, this book argues, all US citizens deserve the same rights granted under the US constitution - i.e. in addition to marriage equality, LGBTQ citizens deserve equal protection in employment, housing, medical decisions, military service, and adoption - to name but a few. Using social equity theory and intersectionality but written in an accessible style, this book demonstrates some of the ways in which LGBTQ citizens have been marginalized for their identity, and argues that the field of public administration has a unique responsibility to prioritize social equity. Discrete categories utilized by the US Census Bureau (male or female, heterosexual or homosexual), for example, must shift to a continuum to accurately capture demographic characteristics and citizen behavior. Evidenced based outcomes and disparities between heterosexual and LGBTQ populations are carefully delineated to provide a legal rationale for a compelling governmental interest, and policy recommendations are provided - including overdue federal legislation to prohibit discrimination based on sexual orientation. Since a reader may find it difficult to tell which of these two she is reading at any given moment this introduction will sketch the contours and purpose of each book. Gig Work as a book about labor exchange in the gig economy this volume dives deeply into what is, in many ways, the hot-button work law issue of the day. The gig economy has generated immense popular interest in labor conditions - no mean feat in an era of decreasing unionization and growing corporate power - as much as it has commanded attention from policymakers and scholars.     Abstract: "Colonial rule distorts a colony's economy and its society, and British rule was no exception. British policies led to a stratified American colonial society with slaves on the bottom and white settlers on top. The divided society functioned through laws that imposed rules and defined roles of the respective races. This occurred in other colonies too, often leading to strife that continues today. Especially since World War II the United States seems finally to have been able to remove many laws and practices that had created barriers between races in the divided society. Appeals to legitimacy, such as by abolitionists and the Civil Rights Movement, were essential to change laws from support of the divided society to instruments for disestablishing it. Thanks to the rule of law - another important British legacy -- the U.S. is much farther along than many former colonies in making progress. By highlighting the history of the interplay of two fundamental concepts, the divided society and the rule of law, and briefly contrasting the experiences of other former colonies, this book shows how the United States has made significant long-term progress, although incomplete, and ways for this to continue today"--

    Abstract: "America's constitutional system evolves through the interplay between three cycles: the rise and fall of dominant political parties, the waxing and waning of political polarization, and alternating episodes of constitutional rot and constitutional renewal. America's politics seems especially fraught today because we are nearing the end of the Republican Party's long political dominance, at the height of a long cycle of political polarization, and suffering from an advanced case of "constitutional rot." Constitutional rot is the historical process through which republics become increasingly less representative and less devoted to the common good. Caused by increasing economic inequality and loss of trust, constitutional rot seriously threatens the constitutional system. But America has been through these cycles before, and will get through them again. America is in a Second Gilded Age slowly moving toward a second Progressive Era, during which polarization will eventually recede. The same cycles shape the work of the federal courts and theories about constitutional interpretation. They explain why political parties have switched sides on judicial review not once but twice in the twentieth century. Polarization and constitutional rot alter the political supports for judicial review, make fights over judicial appointments especially bitter, and encourage constitutional hardball. The Constitution ordinarily relies on the judiciary to protect democracy and to prevent political corruption and self-entrenching behavior. But when constitutional rot is advanced, the Supreme Court is likely to be ineffective and may even make matters worse. Courts cannot save the country from constitutional rot; only political mobilization can"--

Even as the nation-state emerged as the primary form of human association, citizenship remained an anomalous status, reserved for the few who were privileged as such in republican democracies.     Abstract: Die ›freiheitliche demokratische Grundordnung‹ (fdGO) ist Kern der ›wehrhaften Demokratie‹ der Bundesrepublik. Als zu schützendes Rechtsgut ist sie in den Art. 18 und 21 GG benannt. Sie legitimiert exekutive und judikative sowie Abwehr- und Überwachungsmaßnahmen gegen politische Akteur/innen. Die vorliegende Arbeit vollzieht die Genese der fdGO als überpositives Rechtsgut nach, das heißt, wie sie vom unklaren Begriff im Verfassungstext zu einer verallgemeinerten Formel geworden ist. Als Quellen dienen Verfassungs- und Gesetzgebungsprozesse sowie juristische Kommentarliteratur und Gerichtsurteile. Methodisch wird die juristische Argumentationsweise politikwissenschaftlich kontextualisiert – auch um einen politikwissenschaftlichen Zugang zu Rechtstexten zu entwickeln. Im Fokus stehen die Debatten im Parlamentarischen Rat, der Gesetzgebungsprozess des 1. Strafrechtsänderungsgesetzes von 1951, die Parteiverbotsurteile des Bundesverfassungsgerichts und die ersten Kommentare zum Grundgesetz. Zudem stehen das Konzept der ›wehrhaften Demokratie‹ und die dazugehörigen geschichtspolitischen Legitimationen mit Bezug zu Weimarer Republik und Nationalsozialismus auf dem Prüfstand. Die Autorin gleicht die verschiedenen Positionen im staatsrechtstheoretischen »Weimarer Methodenstreit« mit nationalsozialistischen Rechtsauffassungen ab und zeigt so Traditionslinien auf, die sich auch in den Begründungen des Konzepts der ›wehrhaften Demokratie‹ wiederfinden. Deutlich wird dabei, dass die Narrative von der ›wehrlosen‹ Weimarer Republik und der ›legalen‹ Machtübernahme des Nationalsozialismus juristisch- zeitgeschichtlich überprüft werden müssen. Nach der historischen Kontextualisierung der fdGO werden ihre Ausbreitung und Anwendung in verschiedene Rechts- und Politikbereiche beleuchtet. Abschließend fragt die Studie nach den Konsequenzen des juristischen Blicks für politisches Handeln.

    Abstract: In der rechtsvergleichenden Studie arbeitet der amerikanische Historiker heraus, in welch starkem Umfang die rassistischen Gesetze des NS-Staates durch die Einwanderungsgesetzgebung der USA und die rassistischen Gesetze der US-Südstaaten beeinflusst wurden. Rezension: Mit dieser sehr gut lesbaren, sorgfältig gearbeiteten rechtsvergleichenden Spezialstudie liefert der amerikanische Rechtshistoriker eine kleine Sensation. In einer sehr differenzierten Argumentation arbeitet Whitman heraus, dass die Rassengesetzgebung des NS-Staats in erheblicher Weise durch amerikanische Vorbilder, die auch einem Zeitgeist entsprachen, beeinflusst wurde. Die gegen die schwarze Bevölkerung gerichtete Gesetzgebung der US-Südstaaten wurde von massgeblichen NS-Juristen ebenso aufmerksam studiert wie die diskriminierenden Einwanderungsgesetze, die besonders Ost- und Südeuropäer betrafen. Whitman, der sein möglicherweise überraschtes (amerikanisches) Publikum immer wieder direkt anspricht, zieht Parallelen und zeigt Verbindungslinien auf, arbeitet jedoch auch deutlich die Unterschiede heraus: In den USA mündeten die rassistischen Gesetze eben nicht in einen Genozid und der liberale Rechtsstaat setzte ihnen Grenzen. New or reformed constitutions have proliferated, protecting social, economic, and political rights. While constitutional courts in Latin America have traditionally been used as ways to limit power and preserve the status quo, the evidence shows that they are evolving into a functioning part of contemporary politics and a central component of a system of constitutional justice. This book lays bare the political roots of this transformation, outlining a new way to understand judicial design and the very purpose of constitutional justice. Authors Daniel M. Brinks and Abby Blass use case studies drawn from nineteen Latin American countries over forty years to reveal the ideas behind the new systems of constitutional justice. They show how constitutional designers entrust their hopes and fears to dynamic governance systems, in hopes of directing the development of constitutional meaning over time"--
    Abstract: "This project started many years ago, as an article-length project on the apparent diffusion of new models of courts throughout Latin America. A paper Dan Brinks was writing for APSA dovetailed with a paper Abby Blass was writing for a graduate seminar, and the project evolved through conversations between the two authors after that. Both Abby and Dan had other projects to attend to, so the collaboration moved slowly, but we both felt it was intellectually productive. In its early stages in particular, each of the authors contributed important elements and carried out a mutual back and forth that makes it difficult to separate each author's contributions to the initial conceptualization and measurement exercises. Similarly, the basic argument evolved out of conversations between the authors, with each pushing the other to clarify and specify the argument further. Through conceiving and writing the pieces we have called "Conceptualization" (now an article in the International Journal of Constitutional Law, and largely contained in chapter 2 and the Appendix) and "Determinants" (the theory and quantitative analysis that underpins chapters 3 and 4), we collaborated fully. This is the core of the intellectual contribution of the book, and our joint work on these pieces is the principal, though not the only, reason Abby is credited as a co-author"--

    Abstract: "Campaigns against prostitution of young people in the United States have surged and ebbed multiple times over the last fifty years. Fighting the U.S. Youth Sex Trade: Race, Gender, and Politics examines how politically and ideologically diverse activists joined together to change perceptions and public policies on youth involvement in the sex trade over time, reframing "juvenile prostitution" of the 1970s as "commercial sexual exploitation of children" in the 1990s, and then as "domestic minor sex trafficking" in the 2000s. Based on organizational archives and interviews with activists, Baker shows that these campaigns were fundamentally shaped by the politics of gender, race and class, and global anti-trafficking campaigns. The author argues that the very frames that have made these movements so successful in achieving new laws and programs for youth have limited their ability to achieve systematic reforms that could decrease youth vulnerability to involvement in the sex trade"--
