    Abstract: What is 'modern slavery' and who is responsible for it? What is the relevance of human rights law, which primarily regulates state conduct, for practices predominantly committed by private actors? Where can victims seek justice and redress when national authorities fail to protect them? These questions are the core focus of this book.Marija Jovanovich analyses the role and responsibility of states for addressing 'modern slavery' – a diverse set of practices usually perpetrated by non-state actors – against the backdrop of international human rights law. It explores the dynamic between criminal law and human rights law and reveals the different ways these legal domains work to secure justice for victims. The book considers the 'absolute' nature of the prohibition of modern slavery in human rights law, the range of practices covered by this umbrella term and their mutual relationships, the positive obligations of states established by international human rights tribunals owed to individuals subject to modern slavery, and the standards for assessing state responsibility in these situations. By engaging with the concept of exploitation in human rights law, Jovanovich glues together diverse practices of modern slavery, including servitude, forced labour, and human trafficking, into a coherent concept. The book elucidates the theoretical foundations of this fundamental human right and explains why human trafficking has an independent place within it. In addition to providing a comprehensive critique of the existing human rights jurisprudence, this book offers a roadmap for the future development of law on this subject emphasizing the limits of human rights law as a tool for addressing modern slavery.

    Abstract: This book offers a distinctive approach to the key international instrument on indigenous rights, the United Nations Declaration on the Rights of Indigenous Peoples (Declaration) based on a new account of the political history of the international indigenous movement as it intersected with the Declaration's negotiation. The current orthodoxy is to read the Declaration as containing human rights adapted to the indigenous situation. However, this reading does not do full justice to the complexity and diversity of indigenous peoples' participation in the Declaration negotiations. Instead, I argue that the Declaration should be subject to a novel, mixed-model reading that views the Declaration as embodying two distinct normative strands that serve different types of indigenous peoples. Not only is this model supported by the Declaration's political history and legal argument, it provides a new and compelling theory of the bases of international indigenous rights while clarifying the vexed question of who qualifies as indigenous for the purposes of international law.

    Abstract: Analysing international law through the prism of "cynicism" makes it possible to look beyond overt disregard for international law, currently discussed in terms of a backlash or crisis. The concept allows to analyse and criticise structural features and specific uses of international law that seem detrimental to international law in a more subtle way.     Abstract: Die Entwicklung des internationalen Rechts ist eng mit der Annexion außereuropäischer Gebiete verknüpft – und damit auch mit der systematischen Unterdrückung und Entrechtung der dort lebenden Menschen. Bis heute, so Wolfgang Kaleck und Karina Theurer, seien koloniale Machtstrukturen im Recht enthalten und legitimierten dadurch auch gegenwärtige Situationen von Ausbeutung und Ungleichheit. Kaleck und Theurer verbinden in ihrem Band theoretische Ansätze mit der Praxis und beziehen auch die Perspektiven von Aktivistinnen und Anwälten ein. Deutlich wird: Gewalt und Willkür der Kolonialisierung wurde seit dem 16. Jahrhundert im internationalen Recht formell legitimiert und dadurch als Unrecht "unsichtbar". Eine Aufarbeitung der Kolonialvergangenheit und das Sichtbarmachen der rassistischen Spuren, die diese im Recht hinterlassen hat, sei für eine langfristige Dekolonialisierung des Rechts daher dringend notwendig.

Das Buch gibt einen Überblick über Entstehung und Entwicklung der R2P, analysiert die darin vorgenommenen Zuschreibungen von Verantwortung und sucht nach einer interkulturell tragfähigen ethischen Begründung.     Abstract: The expectation of reciprocity continues to be an important factor when states' consider their legal obligations in armed conflicts. In this monograph, Peeler looks at the text and negotiations around the 1949 Geneva Conventions and the Protocols Additional to the Geneva Conventions from 1977 to demonstrate the many places where international humanitarian law maintains expectations of reciprocity. This complements an examination of US policy regarding its Prisoner of War obligations in both the Vietnam War and the Global War on Terror, demonstrating how states make use of the expectation of reciprocity found in international humanitarian law to respond to continued non-compliance by an enemy.

    Abstract: This volume provides the first comprehensive analysis of international legal debates between 1955 and 1975 related to the formal decolonization process. It is during this era, couched between classic European imperialism and a new form of US-led Western hegemony, that fundamental legal debates took place over a new international legal order for a decolonised world. The book argues that this era presents in essence a battle, a battle that was fought out in particular over the premises and principles of international law by diplomats, lawyers, and scholars. In a moment of relative weakness of European powers, 'newly independent states' and international lawyers from the South fundamentally challenged traditional Western perceptions of international legal structures engaging in fundamental controversies over a new international law. The legal outcomes of this battle have shaped the world we live in today. Contributions from a global set of authors cover contemporary debates on concepts central to the time, such as self-determination, sources and concessions, non-intervention, wars of national liberation, multinational corporations, and the law of the sea. They also discuss influential institutions, such as the United Nations, International Court of Justice, and World Bank. The volume also incorporates contemporary regional approaches to international law in the 'decolonization era' and portraits of important scholars from the Global South.

    Abstract: Das Buch untersucht das menschenrechtliche Verbot der Diskriminierung aufgrund der Rasse einschließlich der Schutzvorschriften gegen Hassrede und beleuchtet umfassend die relevanten Entscheidungen unterschiedlicher nationaler und internationaler Gerichte. Es folgt dabei einem interdisziplinären und rechtsvergleichenden Ansatz, der sozial- und kulturwissenschaftliche Theorien und Befunde einbezieht, um rechtsdogmatische Fragen im Bereich des Antidiskriminierungsrechts zu erörtern. Die Entscheidungen ausländischer Gerichte werden schlaglichtartig dargestellt, soweit sie für die Analyse relevant sind. Zugrunde liegt die Frage, was heute unter Rassismus zu verstehen ist und ob Phänomene wie Ausländer- und Fremdenfeindlichkeit sowie Rechtsextremismus darunter fallen. Insbesondere Rasse als Rechtsbegriff wird ausführlich besprochen. Zentrale Bezugspunkte für die folgende Auseinandersetzung mit dem „Recht gegen rassische Diskriminierung“ sind die Europäische Rasserichtlinie (Richtlinie 2000/43/EG), die Antirassismuskonventionen der Vereinten Nationen und die Europäische Menschenrechtskonvention (EMRK). Das deutsche Grundgesetz wendet sich in Art. 3 Abs. 3 S. 1 GG gegen Rassismus, aber eine umfangreiche Dogmatik, die dem heutigen Phänomen des Rassismus gerecht werden kann, fehlt. Das vorliegende Werk leistet mithilfe eines menschenrechtsinformierten und differenzierten Verständnisses von Rassismus hierzu einen wichtigen Beitrag. Damit soll die These begründet werden, dass nur ein strukturelles Verständnis von Rassismus das Recht gegen Rassismus wirksam werden lässt.

    Abstract: Rights are usually viewed as defensive concepts representing mankind’s highest aspirations to protect the vulnerable and uplift the downtrodden. But since the Enlightenment, political combatants have also used rights belligerently, to batter despised communities, demolish existing institutions, and smash opposing ideas. Delving into a range of historical and contemporary conflicts from all areas of the globe, Rights as Weapons focuses on the underexamined ways in which the powerful wield rights as aggressive weapons against the weak. Clifford Bob looks at how political forces use rights as rallying cries: naturalizing novel claims as rights inherent in humanity, absolutizing them as trumps over rival interests or community concerns, universalizing them as transcultural and transhistorical, and depoliticizing them as concepts beyond debate. He shows how powerful proponents employ rights as camouflage to cover ulterior motives, as crowbars to break rival coalitions, as blockades to suppress subordinate groups, as spears to puncture discrete policies, and as dynamite to explode whole societies. And he demonstrates how the targets of rights campaigns repulse such assaults, using their own rights-like weapons: denying the abuses they are accused of, constructing rival rights to protect themselves, portraying themselves as victims rather than violators, and repudiating authoritative decisions against them. This sophisticated framework is applied to a diverse range of examples, including nineteenth-century voting rights movements; the American civil rights movement; nationalist, populist, and religious movements in today’s Europe; and internationalized conflicts related to Palestinian self-determination, animal rights, gay rights, and transgender rights.

    Abstract: Die Arbeit widmet sich einem Problem, das die Völkerrechtswissenschaft seit längerem beschäftigt und das im Zuge des Kampfes der Staatengemeinschaft gegen den sog. Islamischen Staat weiterhin an Aktualität und Bedeutung gewonnen hat. Finanziell teils beträchtlich ausgestattete, technologisch hochgerüstete und straff organisiert auftretende nicht-staatliche Akteure verüben Anschläge in Dimensionen, wie ursprünglich nur von staatlicher Seite bekannt. Die Grundlagen des klassischen Völkerrechts berührend, befasst sich die Studie mit der Frage, ob und unter welchen Voraussetzungen ein Staat gegenüber privaten Akteuren das in Art. 51 UN-Charta verankerte Selbstverteidigungsrecht ausüben kann und welchen Grenzen es insoweit unterliegt. Die Autorin geht diesem Thema durch Normanalyse und Auswertung von Staatenpraxis umfassend nach, greift hierfür bisherige völkerrechtswissenschaftliche Überlegungen auf und erörtert Sinn und Risiken von Anpassungen der rechtlichen Vorgaben.

    Abstract: Nations often turn to international courts to help with overcoming collective-action problems associated with international relations. However, these courts generally cannot enforce their rulings, which begs the question: how effective are international courts? This book proposes a general theory of international courts that assumes a court has no direct power over national governments. Member states are free to ignore both the international agreement and the rulings by the court created to enforce that agreement. The theory demonstrates that such a court can, in fact, facilitate cooperation with international law, but only within important political constraints. The authors examine the theoretical argument in the context of the European Union. Using an original data set of rulings by the European Court of Justice, they find that the disposition of court rulings and government compliance with those rulings comport with the theory's predictions--

    Abstract: Norms Without the Great Powers" examines the nature of power in world politics, and the particular role that law plays in defining the meaning and deployment of power in the international system. Specifically, it seeks to further explicate the social dimensions of power as the capacity to shape how actors think about the world, in contrast to the more typical conception emphasizing material properties such as military or economic capabilities. Participating in international institutions and being seen as 'law-abiding' is a potent source of status for states and non-state actors alike. In engaging with the law, actors are inducted into a complex set of collective expectations that profoundly shape the way they frame their interests and pursue their policy goals. This process is first examined theoretically, and then through a detailed evaluation of two prominent-and challenging-multilateral institutions, the ban on antipersonnel mines and the International Criminal Court

    Abstract: "This book explores the right to democracy in international law and contemporary democratic theory, asking whether international law encompasses a substantive or procedural understanding of the notion. The book considers whether there can be considered to be a basis for the right to democracy in international customary law through identification of the relevant state practice and opinio juris, as well as through an evaluation of the Universal Declaration of Human Rights and whether the relevant provisions might be interpreted as forming customary law. The book then goes on to explore the relevant provisions in international treaties including the International Covenant on Civil and Political Rights before looking at the role of regional organizations and human rights regimes including the European Court of Human Rights and the Arab human rights regime. [The author] draws on the work of John Rawls in order to put forward a theoretical basis for the right to democracy."--
